L.-33004/99 सी.जी.-डी.एल.-अ.-16012024-251374 xxxGIDHxxx CG-DLxx-xEG-I1D6E0x1x2x0 24-251374 असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 37] िई ददल्ली, मगं लर्ार, ििर्री 16, 2024/पौष 26, 1945 No. 37] NEW DELHI, TUESDAY, JANUARY 16, 2024/PAUSHA 26, 1945 उपभोक्ता मामल,े खाद्य और सार्िव जिक जर्तरण मत्रं ालय (खाद्य और सार्विजिक जर्तरण जर्भाग) आदेि िई ददल्ली, 15 ििर्री, 2024 सा.का.जि. 43(अ).—केन्द्रीय सरकार, आर्श्यक र्स्ट्त ु अजधजियम, 1955 (1955 का 10) की धारा3 द्वारा प्रदत्त िजक्तयों का प्रयोग करत े हुए,लजययत सार्विजिक जर्तरण प्रणाली (जियंत्रण) आदेि, 2015 म ें और संिोधि करि े के जलए जिम्नजलजखत आदिे करती ह,ै अर्ावत्:- 1. संजिप्त िाम और प्रारंभ-(1) इस आदिे का संजिप् त िाम लजययत सार्विजिक जर्तरण प्रणाली (जियंत्रण) संिोधि आदेि, 2024 ह।ै (2) ये रािपत्र में उिके प्रकािि की तारीख से प्रर्ृत्त होंगे। 2. लजययत सार्विजिक जर्तरण प्रणाली (जियंत्रण) आदेि, 2015 (जिसे इसमें इसके पश् चात् उक्त आदेि कहा गया ह)ै के खंड-1 के उपखंड (2) म,ें परंतुक का लोप दकया िाएगा। 3. िुरू से अतं तक,उक्त आदेि म,ें िहां कहीं भी "उजचत दर दकु ाि का स्ट् र्ामी" िदद आत े ह ैं के स्ट्र्ाि पर "उजचत दर दकु ाि डीलर" िदद रखे िाएंगे। 309 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 4. उक्त आदेि में खंड 2 के उपखंड (ठ) के पश्चात् जिम्नजलजखत उप-खंड अतं :स्ट्र्ाजपत दकया िाएगा, अर्ावत:्- "(ठ क) "एक राष्ट्र एक रािि काडव योििा" से, खाद्य सुरिा अजधजियम के अधीि पात्र लाभार्र्वयों को िारी दकए गए रािि काडों की राष्ट्रव्यापी सुर्ाह्यता के जलए योििा अजभप्रेत ह;ै"। 5. उक्त आदेि म,ें खंड 4 के उपखंड (20) में"उपाबंध 2 में प्ररूप" िददों और अंकों के पश्चात् जिम्नजलजखत अतं :स्ट्र्ाजपत दकया िाएगा, अर्ावत:्- "और राज्य सरकार जियजमत रूप से िए रािि काडों को िारी करिे,रािि काडों का रद्दकरण या लोप तर्ा उिके रािि काडों के सदस्ट्यों के िाम िोड़ि,े लोप करि े या अद्यति करि े के जलए, केन्द्रीय सरकार को ररपोर्व करेगी तादक उस े केन्द्रीय जिघाि म ेंअद्यति दकया िा सके।"। 6. उक्त आदेि के खंड 4 के उपखंड (20) के पश्चात, जिम्नजलजखत उपखंड अंत:स्ट्र्ाजपत दकया िाएगा, अर्ातव :- ''(21) खाद्य सुरिा अजधजियम के अधीि िारी दकए गए रािि काडों के सभी पात्र लाभार्ी, एक राष्ट्र एक रािि काडव योििा के अधीि बायोमेररक अजधप्रमाणि के पश्चात् दिे भर में दकसी भी उजचत दर दकु ाि से अपिा अजधकृत खाद्यान्न प्राप्त कर सकेंगे।"। 7. उक्त आदेि के खडं 7 के उपखडं (12) म ें "के प्ररूप में" िददों के स्ट्र्ाि पर "म ें यर्ा उपबंजधत इलेक्ट्रोजिक ढंग के माध्यम से" िद द रखे िाएगं े। 8. उक्त आदेि के खंड 10 के उप खंड (10) के पश्चात,् जिम्नजलजखत उपखंड अंत:स्ट्र्ाजपत दकया िाएगा, अर्ातव ्:- "(11) राज्य सरकार यह सुजिजश्चत करेगी दक- (क) खाद्य सुरिा अजधजियम के अधीि सभी लाभार्र्वयों को एक राष्ट्र एक रािि काड व योििा के अधीि अतं र- और अंतरा-राज्यीय सुर्ाह्यता उपलदध ह,ैिो उजचत दर दकु ािों पर इलेक्ट्रॉजिक प् र्ाइंर् स सेल युजक्तयों के माध्यम से बायोमेररक अजधप्रमाणि के पश्च ात् उस राज्य म ेंप्रव्रजित हुए ह;ैं (ख) एक राष्ट्र एक रािि काड वयोििा के अधीि ऐसे प्रर्ासी लाभार्र्वयों को जर्तरण के जलए उजचत दर दकु ािों पर पयावप्त मात्रा में अजतररक्त खाद्यान्न की उपलदधता ह;ै (ग) उजचत दर दकु ाि पर खाद्यान्नों की प्राजप्त काइलेक्ट्रॉजिक अजभलेख और खाद्यान्नों के आरंजभक अजतिेष और जर्तरण की मात्रा के आधार पर उजचत दर दकु ािों के अतं अजतिषे की स्ट् र्त: सगं णिा तर्ा इलेक्ट्रॉजिक ढ़ंग से उक्त िािकारी को केंरीय सरकार को अग्रेजषत करे; (घ) उजचत दर की दकु ािों पर इलैक्ट्रॉजिक युजक्त,खाद्य सुरिा अजधजियम के अधीि लजययत सार्विजिक जर्तरण प्रणाली की उजचत दर दकु ाि के अंत अजतिेष, आरंजभक अजतिेष, र्तवमाि स्ट्र्ॉक,जर्क्रय रजिस्ट्र्र, अंत्योदय अन्न योििा और प्रार्जमकता र्ाले पररर्ारों के लाभार्र्वयों सजहत समस्ट्त अपेजित िािकारी प्रस्ट्ततु करेगी तादक र्तवमाि आबंर्ि और जपछले मासके अंत अजतिषे का जर्जिश्चय दकया िा सके; (ड) कोई भी उजचत दर दकु ाि डीलर खाद्य सुरिा अजधजियम के अधीि ऐस े पात्र प्रर्ासी लाभार्र्वयों को एक राष्ट्र एक रािि काड वयोििा के अधीि खाद्यान्नों के जर्तरण के जलए मिा िहीं करेगा।"। 9. उक्त आदेि के, खडं 11 म,ें- (क) उपखडं (6) के स्ट्र्ाि पर जिम्नजलजखत उप खंड रखा िाएगा, अर्ातव ्:- "(6) राज्य सरकार उपाबंध -VI में यर्ा उपबंजधत इलेक्ट्रॉजिक ढ़ंग के माध्यम से केंरीय सरकार को सतकवता सजमजतयों की कायव-प्रणाली पर छह माजसक ररपोर्व भेिगे ी।"; (ख) उपखंड (12) में, "के प्ररूप में" िददों के स्ट्र्ाि पर "में यर्ाउपबंजधत इलेक्ट्रॉजिक ढ़ंग के माध् यम स"े िद द रख े िाएंगे;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (ग) उपखडं (14) और उपखडं (15) के स्ट्र्ाि पर, जिम्नजलजखत उप खंड रखे िाएंगे, अर्ावत्:- "(14) राज्य सरकार आर्जधक ररपोर्र्िंग की एक प्रणाली जर्जहत करेगी, राज्य के भीतर जर्जभन्न स्ट्तरों पर इलेक्ट्रॉजिक सुर्ाह्यता के माध्यम से उजचत दर दकु ािों के कायवकरण और केंरीय सरकार की केंरीय प्रणाली पर उजचत दर दकु ाि के प्रचालिों की जियजमत ररपोर्र्िंग सुजिजश्चत करेगी। (15) राज्य सरकार, इलेक्ट्रॉजिक सुर्ाह्यता के माध्यम से लजययत सार्विजिक जर्तरण प्रणाली के एक जसरे से दसू रे जसरे तक प्रचालिों की माजिर्री सुजिजश्चत करेगी और केंरीय सरकार की केंरीय प्रणाली में लजययत सार्विजिक जर्तरण प्रणाली का एक जसरे स ेदसू रे जसरे तक प्रचालिों की जियजमत रूप से इलेक्ट्रॉजिक ररपोर्र्िंग सजु िजश्चत करेगी।"। 10. उक्त आदेि में, उपाबंध-III के स्ट्र्ाि पर, जिम्नजलजखत उपाबंध को रखा िाएगा, अर्ावत्:- [सा. सं. 2-1/2023-पीडी-II] अजिता कण,व संयक्ट्ु त सजचर् "उपाबंध-III िूि या जसतंबर या ददसंबर या माचव को समाप्त जतमाही के जलए उजचत दर दकु ािों के द्वार तक होि े र्ाले पररदाि का जर्र्रण [खंड 7 का उप खंड (12) देख]ें राज्य या संघ राज्य िेत्र में जिलों की कुल संख्या : ……………………………. राज्य या संघ राज्य िेत्र में उजचत दर दकु ािों की कुल संख्या: ........................ क्र.स.ं अजभकरण का अजभकरण का अजभकरणों द्वारा अजभकरणों द्वारा द्वार उजचत दर दकु ािों की िाम प्रकार* द्वार तक पररदाि के तक पररदाि के कुल सख्ं या िहा ं जलए कर्र दकए गए अधीि कर्र की गई न्द्यायसगं त कारणों जिलों की सख्ं या उजचत दर दकु ािों की सजहत द्वार तक सख्ं या पररदाि िहीं दकए गए (1) (2) (3) (4) (5) (6) 1. 2. 3. 4. कुल *अजभकरण के प्रकार के संबंध में, कृपया उपदर्िवत करें दक क्ट्या राज्य िागररक आपूर्तव जिगम या अन्द्य िीष व जिकाय, सहकारी सजमजतयों, जििी अजभकरण उदाहरणतयााः र्ोक जर्क्रेता, बृहत िेत्र की बहु-प्रयोिि सहकारी सजमजतयााँ, प्रार्जमक कृजष प्रत्यय सोसाइरर्यां या अन्द्य कोई अजभकरण ह।ैं दकसी जिले म ें एक स े अजधक अजभकरण द्वारा द्वार तक पररदाि दकए िाि े की दिा में उसे भी उपदर्िवत दकया िाएगा। रर्प्पण : प्रत्येक जतमाही के अंत के पश्चात् दो सप्ताह के भीतर सूचिा प्रस्ट्तुत की िाएगी।"। रर्प्पण : मूल आदिे , भारत के रािपत्र, असाधारण, भाग II, खंड 3, उप खंड (i) में सा.का.जि सं. 213 (अ) तारीख 20 माच,व 2015 द्वारा प्रकाजित दकया गया र्ा और तारीख 28 अक्तूबर, 2015 सा.का.जि सं. 814 (अ) द्वारा अंजतम संिोधि दकया गया र्ा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] MINISTRY OF CONSUMER AFFAIRS, FOOD AND PUBLIC DISTRIBUTION (Department of Food and Public Distribution) ORDER New Delhi, the 15th January, 2024 G.S.R. 43(E).—In exercise of the powers conferred by section 3 of the Essential Commodities Act, 1955 (10 of 1955), the Central Government hereby makes the following Order further to amend the Targeted Public Distribution System (Control) Order, 2015, namely :- 1. Short title and commencement.-(1) This Order may be called the Targeted Public Distribution System (Control) Amendment Order, 2024. (2) It shall come into force on the date of its publication in the Official Gazette. 2. In the Targeted Public Distribution System (Control) Order, 2015 (hereinafter referred to as the said Order), in clause 1, in sub-clause (2), the proviso shall be omitted. 3. Throughout the said Order, for the words “fair price shop owner”, wherever they occur, the words “fair price shop dealer” shall be substituted. 4. In the said Order, in clause 2, after sub-clause (l), the following sub-clause shall be inserted, namely:- “(la) “One Nation One Ration Card plan” means the plan for nation-wide portability of ration cards issued to eligible beneficiaries under the Food Security Act;”. 5. In the said Order, in clause 4, in sub-clause (20), after the words and letters “the format at Annex-II”, the following shall be inserted, namely:- “and the State Government shall regularly report the issuance of new ration cards, cancellation or deletion of ration cards and addition, deletion or updationof members of their ration card to the Central Government to update the same in the Central Repository.”. 6. In the said Order, in clause 4, after sub-clause (20), the following sub-clause shall be inserted, namely:- “(21) All eligible beneficiaries of ration cards issued under the Food Security Act may avail their entitled foodgrains across the country from any fair price shop after biometric authentication under One Nation One Ration Card plan.”. 7. In the said Order, in clause 7, in sub-clause (12), for the words “in the format at” the words “through electronic mode as provided in” shall be substituted. 8. In the said Order, in clause 10, after sub-clause (10), the following sub-clause shall be inserted, namely:- “(11) The State Government shall ensure- (a) that inter-State and intra-State portability under One Nation One Ration Card plan is available to all beneficiaries under the Food Security Act, who have migrated to that State, after biometric authentication through electronic point of sale devices at fair price shops; (b) that availability of sufficient quantity of additional foodgrains at fair price shop for distribution to such migrant beneficiaries under One Nation One Ration Card plan; (c) that the electronic recording of receipt of foodgrains at fair price shop and also automatic calculation of closing balance of fair price shop based on the opening balance and distribution quantity of foodgrains and forward the said information to the Central Government in electronic mode; (d) that the electronic device at fair price shops shall furnish all the requisite information including closing balance, opening balance, current stock, sale register, Antyodaya Anna Yojana and Priority Household beneficiaries of fair price shop of Targeted Public Distribution System under the Food Security Act, so as to decide current allocation and the closing balance of the previous month; (e) that no fair price shop dealer shall deny distribution of foodgrains under One Nation One Ration card plan to such eligible migrant beneficiaries under the Food Security Act.”. 9. In the said Order, in clause 11, - (a) for sub-clause (6), the following sub-clause shall be substituted, namely:- “(6) The State Government shall send a report half-yearly to the Central Government on the functioning of vigilance committees through electronic mode as provided inAnnex-VI.”;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (b) for sub-clause (12), for the words “in the format at” the words “through electronic mode as provided in” shall be substituted; (c) for sub-clauses (14) and (15), the following sub-clauses shall be substituted, namely:- “(14) The State Government shall prescribe a system of periodic reporting, the functioning of fair price shops through electronic platform at various levels within the State and ensure regular reporting of fair price shop operations on the Central System of the Central Government. (15) The State Government shall ensure monitoring of the end-to-end operations of the Targeted Public Distribution System through the electronic platform and ensure regular electronic reporting of end-to-end operations of Targeted Public Distribution System on the Central System of the Central Government.’’. 10. In the said Order, for Annex-III, the following Annex shall be substituted, namely:- [F. No. 2-1/2023-PD-II] ANITA KARN, Jt.
