WHEREAS, the report of the Director of Municipal Administration stating that Tmt. K. Sakuntala, 11th Ward Councillor and Chairperson of Usilampatti Municipal Council, is to be removed under section 52 of the Tamil Nadu Urban Local Bodies Act, 1998 (Tamil Nadu Act 9 of 1999) for the following reasons, namely:- Tmt. K. Sakuntala had conducted the statutory meetings of the Council in her official Chamber instead of Council Hall, as required under the Act; usurping the powers of the Council had given pre-approval to certain tenders which ought to be decided by the Council; and unilaterally cancelled the contract by which the Solid Waste Management activities of the town has been outsourced, without following prescribed procedure and without making necessary alternate arrangement and thereby abused her powers; AND WHEREAS, on the basis of the said report of the Director of Municipal Administration, a show cause notice was issued under sub-section (2) of section 52 of the said Act by the Government, containing the above said allegations and she was directed to submit her reply in writing to the Government within 15 days from the date of receipt of the notice; AND WHEREAS, Tmt. K. Sakuntala furnished her reply denying all the allegations putforth against her; AND WHEREAS, after receiving the reply from Tmt. K. Sakuntala, Chairman of Usilampatti Municipal Council, the report of the Director of Municipal Administration was sought for. The Director of Municipal Administration has stated that she abuses the power vested in her under the Act and recommended to the Government for further course of action, thereby he confirmed the allegations putforth against Tmt. K. Sakuntala; II-2 Ex. (138) [1]2 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY AND WHEREAS, the Government after independently and carefully examined the allegations against Tmt. K. Sakuntala, 11th Ward Councillor and Chairperson of Usilampatti municipal council, sent by the Director of Municipal Administration, the reply submitted by Tmt. K. Sakuntala, 11th Ward Councillor and Chairperson of Usilampatti municipal council and the opinion of the Director of Municipal Administration, have come to the conclusion that the reply furnished by Tmt. K. Sakuntala, 11th Ward Councillor and Chairperson of Usilampatti municipal council deserves to be rejected and she wilfully disobeyed the provisions of the said Act and abused the powers vested in her; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) of section 52 of the Tamil Nadu Urban Local Bodies Act, 1998 (Tamil Nadu Act 9 of 1999), the Governor of Tamil Nadu, hereby removes Tmt. K. Sakuntala, 11th Ward Councillor and Chairperson of Usilampatti municipal council, from the office of Councillor of 11th Ward and Chairperson of the said municipal council with immediate effect. D.
