Ms. No. 228, Law (LS), 24th July 2018, Aadi 8, Vilambi, Thiruvalluvar Aandu-2049.] No. SRO B-63/2018.—In exercise of the powers conferred by the proviso to Article 309 of the constitution of India, the governor of Tamil Nadu hereby makes the following amendments to the Special Rules for the Tamil Nadu Legal Educational Service (Section 33 in Volume II of the Tamil Nadu Services Manual, 2016). 2. The amendments hereby made shall be deemed to have come into force on and from the 26th April 2013. Amendments. In the said Special Rules,- (1) in rule 1, in the tabular column, after the entry “I” under the heading “class” in column (1) and the corresponding entry “Director of Legal Studies” in column (3) thereof, the following entries shall, respectively, be inserted namely:- IA -- Principal”.; (2) in rule 2, in sub-rule (a), after the entry “class I Director of Legal Studies” in column (1) and the corresponding entries in column (2) thereof, the following entries shall, respectively, be inserted namely:- “class IA (i) By promotion from the categories of Associate Professor Principal and Associate Professor (Pre Law) in a single common seniority list; Explanation.- For the purpose of item (i), a single common seniority list shall be prepared in accordance with section 7 of the Tamil Nadu government Servants (conditions of Service) Act,2016 with reference to the seniority already determined irrespective of the date of appointment to the categories of Assistant Professor or Assistant Professor (Pre Law). ”. (ii) By direct recruitment, if no qualified and suitable candidate is available for appointment by method (i) above.”; (3) in rule 4,- (a) in sub-rule (a), in the Table, after the entry “Director of Legal Studies” in column (1) and the corresponding entry in column (2) thereof, the following entries shall, respectively, be inserted, namely:- “Principal 48 years.” ; (b) in sub-rule (b), in the Table, after the entry “class I Director of Legal Studies” in column (1) and the corresponding entries in columns (2) and (3) thereof, the following entries shall, respectively, be inserted, namely:- “class IA (i) Promotion (i) Must have obtained Master’s degree in Law with not less Principal than fifty five percentage of marks or a degree of equivalent standard of any other University and recognized as equivalent thereto by the Tamil Nadu Dr.Ambedkar Law University: Provided that candidates belonging to Scheduled castes or Scheduled Tribes, shall possess not less than fifty percentage of marks in the Master’s degree in Law: Provided further that the holders of Ph.D., degree in Law, who have passed the Master’s degree examination prior to the 19th September 1991, shall possess not less than fifty percentage of marks in the Master’s degree in Law:Aug. 8, 2018] TAMIL NADU gOVERNMENT gAzETTE 97 Provided also that the holders of the posts of Associate Professor and Associate Professor (Pre Law) on the 24th March 1999, shall possess not less than fifty percentage of marks in Master’s degree in Law; (ii) A Ph.D., degree in Law; and (iii) Must have experience as Associate Professor or Associate Professor (Pre-Law) in a Law college for a period of not less than three years. (ii) Direct (i) A Master’s degree with atleast fifty five percentage of marks Recruitment (or an equivalent grade in a point scale wherever grading system is followed) by a recognized University; (ii) A Ph.D., degree in Law with evidence of published work and research guidance; (iii) Associate Professor or Professor with total experience of not less than fifteen years in teaching or research or administration in Universities or colleges and other Institutions of Higher Education; (iv) A minimum score as stipulated in the Academic Performance Indicator (API) based Performance Based Appraisal System (PBAS), as set out in the University grants commission (Minimum Qualifications for appointment of Teachers and other Academic staff in Universities and Colleges and Measures for the Maintenance of Standards in Higher Education) Regulations, 2010.”; (5) in rule 5, in sub-rule (b), for the expression “members of the service in the categories in class II”, the expression “members of the service in class IA and in the categories in class II.” shall be substituted; (6) in rule 6, for the expression “Director of Legal Studies”, the expression “Director of Legal Studies or Principal” shall be substituted; (7) for rule 8, the following rule shall be substituted, namely:- “8. Transfers and postings.-The government shall be the competent authority for transfers and postings in respect of members of class I and IA and the Director of Legal Studies shall be the competent authority for transfers and postings in respect of members of other classes.”.
