L.-33004/99 सी.जी.-डी.एल.-अ.-06062026-273230 CG-DxLx-xEG-I0D6H0x6x2x0 26-273230 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 2733] िई ददल्ली, बुधवार, ििू 3, 2026/ज्य ष्े ि 13, 1948 No. 2733] NEW DELHI, WEDNESDAY, JUNE 3, 2026/JYAISTHA 13, 1948 वाजणज्य और उद्योग मत्रं ालय (वाजणज्य जवभाग) (जवदेि व्यापार महाजिदेिालय) अजधसचू िा िई ददल्ली, 2 िूि, 2026 स.ं 20 /2026-27 जवषय: जविषे आर्थकि क्षत्रे (एसईिडे ) इकाइयों और डेवलपस िद्वारा आयात पर गणु वत्ता जियत्रं ण आदेि (क्यसू ीओ)/बीआईएस आवश्यकताओं की प्रयोज्यता-एफटीपी, 2023 के परै ा 2.03 (क)(iii) म ेंसिं ोधि के सबं धं म।ें का.आ. 2827(अ).— समय-समय पर यथा संिोजधत जवदेि व्यापार िीजत (एफटीपी), 2023 के पैरा 1.02 के साथ पठित, जवदेि व्यापार (जवकास और जवजियमि) अजधजियम, 1992 (1992 का 22) की धारा 5 के साथ पठित धारा 3 द्वारा प्रदत्त िजियों का प्रयोग करते हुए, केंद्र सरकार एतद्द्वारा एफटीपी, 2023 के परै ा 2.03 (क)(iii) म ेंतत्काल प्रभाव स ेएसईिेड आयात स े संबंजधत जिम्नजलजखत संिोधि करती ह,ै िो इस प्रकार ह:ैं 3980 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] मौिूदा पैरा 2.03 (क)(iii) संिोजधत पैरा 2.03 (क)(iii) बीआईएस अजधजियम, 2016 के तहत िारी अजिवाय ि बीआईएस अजधजियम, 2016 के तहत िारी गणु वत्ता क्यूसीओ की प्रयोज्यता स ेछूट उि जिजवजियों के आयात पर जियंत्रण आदेिों (क्यूसीओ) की प्रयोज्यता स े छूट जविेष एसईिेड को प्रदाि की िाएगी िो जियाित उत्पादि के जलए आर्थिक क्षेत्रों (एसईिेड) के भीतर प्राजधकृत संचालि के जलए आवश्यक ह।ैं ऐसी जिजवजियों या ऐसी जिजवजियों स े आवश्यक कच्च ेमाल, घटकों, उपभोग्य वस्ट्तुओं, कलपुि ेऔर जिर्मित माल की कोई डीटीए जिकासी की अिुमजत िहीं ह।ै पूंिीगत वस्ट्तुओं सजहत सभी अिुमत वस्ट्तओंु के आयात के इस आिय का एक वचि एसईिेड इकाई द्वारा आयात के जलए एसईिेड इकाइयों या एसईिेड डेवलपसि को एसईिडे समय एसईिेड के संबंजधत जवकास आयिु को प्रस्ट्तुत दकया अजधजियम, 2005 और इसके तहत बिाए गए एसईिडे िाएगा। क्यूसीओ स ेछूट केवल व्यावहाठरक जियाितों के जलए जियमों, 2006 के जियम 27 के प्रावधािों के अिुसार प्रदाि उपलब्ध होगी। यह छूट एफटीपी के परै ा 2.03 (ग) के अधीि ह।ै की िाएगी। ऐसी छूट केवल प्राजधकृत संचालि के जलए एसईिडे के भीतर आयाजतत माल के उपयोग के जलए लागू होगी। तथाजप, ऐस े माल, या वहां जिर्मित या प्रसंस्ट्कृत माल को, एसईिेड स े घरेल ू प्रिल्ु क क्षत्रे (डीटीए) स े हटािे, अंतठरत करिे या जिकासी, लागू गुणवत्ता जियंत्रण आदेिों (क्यूसीओ), भारतीय मािक ब्यूरो (बीआईएस) आवश्यकताओं और जिकासी के समय लागू ऐस े दकसी भी अन्य लागू कािूिों, जियमों या जवजियमों के अिुपालि के अध्यधीि होगा। इस आिय का एक वचि आयात के समय एसईिेड इकाई या एसईिेड डेवलपर द्वारा संबंजधत एसईिेड जवकास आयुि को प्रस्ट्तुत दकया िाएगा। इस अजधसचू िा का प्रभाव: एसईिेड इकाइयों और डेवलपसि द्वारा दकए गए आयात के जलए गुणवत्ता जियंत्रण आदेिों (क्यूसीओ) की प्रयोज्यता स े छूट स े संबंजधत प्रावधािों को एसईिेड अजधजियम, 2005 और एसईिेड जियम, 2006 के प्रावधािों के साथ संरेजखत करिे और क्यूसीओ की प्रयोज्यता के संबंध म ें स्ट्पिता लािे के जलए एफटीपी, 2023 के पैरा 2.03 (क) (iii) म ें संिोधि दकया गया ह।ै इस े वाजणज्य एव ं उद्योग मंत्री के अिुमोदि स े िारी दकया िाता ह।ै [फा. स. ं 01/89/180/13/एएम-15 /पीसी-2(ए)/ई-5910] लव अग्रवाल, महाजिदिे क जवदिे व्यापार एव ं पदेि अपर सजचव[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 MINISTRY OF COMMERCE AND INDUSTRY (Department of Commerce) (DIRECTORATE GENERAL OF FOREIGN TRADE) NOTIFICATION New Delhi, the 2nd June, 2026 No. 20/2026-27 Subject: Applicability of Quality Control Orders (QCOs)/BIS requirements on imports by Special Economic Zone (SEZ) Units and Developers- Amendment in Para 2.03(A)(iii) of FTP, 2023-reg. S.O. 2827(E).— In exercise of the powers conferred by Section 3 read with Section 5 of the Foreign Trade (Development & Regulation) Act, 1992 (22 of 1992), read with Paragraph 1.02, of the Foreign Trade Policy (FTP), 2023, as amended from time to time, the Central Government hereby makes the following amendments relating to SEZ imports in Para 2.03(A) (iii) of the FTP, 2023, with immediate effect, as under: Existing Para 2.03A(iii) Revised Para 2.03A(iii) Exemption from applicability of mandatory QCOs Exemption from applicability of Quality Control Orders issued under the BIS Act, 2016, shall be provided to (QCOs) issued under the BIS Act, 2016, shall be provided to SEZ on import of inputs which are required for SEZ Units or SEZ Developers for import of all permissible export production. No DTA clearance of such inputs goods, including raw materials, components, consumables, or goods manufactured spares, and capital goods, required for authorised operations made out of such inputs, are allowed. An within Special Economic Zones (SEZs), in accordance with undertaking to that effect will be submitted to the the provisions of the SEZ Act, 2005 and Rule 27 of the SEZ concerned Development Commissioner of the SEZ Rules, 2006 made thereunder. by the SEZ Unit at the time of importation. The exemption from QCO will be available for physical Such exemption shall apply only for the use of the imported exports only. This exemption is further subject to goods within the SEZ for authorised operations. However, any para 2.03 (c) of FTP. removal, transfer or clearance of such goods, or goods manufactured or processed therefrom, from the SEZ into the Domestic Tariff Area (DTA) shall be subject to compliance with the applicable Quality Control Orders (QCOs), Bureau of Indian Standards (BIS) requirements and any other applicable laws, rules or regulations in force at the time of such clearance. An undertaking to the above effect shall be submitted to the concerned Development Commissioner of the SEZ by the SEZ Unit or SEZ Developer at the time of importation. Effect of this Notification: Para 2.03A(iii) of FTP, 2023 is amended to align the provisions relating to exemption from applicability of Quality Control Orders (QCOs) for imports by SEZ Units and Developers with the provisions of the SEZ Act, 2005 and SEZ Rules, 2006, and to bring clarity regarding the applicability of QCOs.
