जाएगा, ऄथागत् :- “(6) आस जनयम में ऄंतर्ववष्ट दकसी भी बात के होते हुए भी, ऄजधजनयम की धारा 56 के प्रयोजनों के जलए स्ट्वचाजलत परीक्षण स्ट्टेिन की मान्द्यता, जवजनयमन और जनयंत्रण, आन जनयमों के ऄध्याय 11 के ऄनुसार होगा।”। 3. ईि जनयमों मेंऄध्याय 10 के प‍ चात्, जनम्नजलजखत ऄध्याय को ऄंत:स्ट्थ ाजपत दकया जाएगा, ऄथागत्: - “ऄध्याय11 स्ट्वचाजलत परीक्षण स्ट्ट ेिन की मान्द्यता, जवजनयमन और जनयत्रं ण 173. लाग ू होना- आस ऄध्याय के ईपबंध स्ट्वचाजलत परीक्षण स्ट्टेिनों की मान्द्यता, जवजनयमन और जनयंत्रण, स्ट्वचाजलत ईपकरणों के माध्यम से वाहनों के दफटनेस परीक्षण की प्रदिया और स्ट्वचाजलत परीक्षण स्ट्टेिनों द्वारा दफटनेस प्रमाणपत्र प्रदान करने की प्रदिया के जलए लागू होंगे। 174. पररभाषाएं - आस ऄध्याय में, जब तक दक संदभग से ऄन्द्यथा ऄपेजक्षत न हो, - (i) "ऄजधजनयम" से मोटर यान ऄजधजनयम, 1988 (1988 का 59) ऄजभप्रेत ह।ै (ii) "स्ट्वचाजलत परीक्षण स्ट्टेिन" से राज्य सरकार द्वारा ऄजधकृत कोइ भी स्ट्वचाजलत परीक्षण सुजवधा ऄजभप्रेत ह,ै जहां आन जनयमों के ऄनुसार दफटनेस परीक्षण दकया जा सकता ह।ै (iii) "दफटनेस प्रमाण पत्र" से ऄजधजनयम की धारा 56 (1) में जवजनर्ददष्ट दकसी जनधागररत प्राजधकारी या पररवहन यान के जलए प्रूपप 38 में और गैर-पररवहन यान के जलए प्रूपप 25 में जारी दकया गया प्रमाण पत्र ऄजभप्रेत है,जैसा भी मामला हो, आस प्रभाव के जलए दक ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों की सभी ऄपेक्षाओं के साथ वाहन कुछ समय के जलए ऄनुपालन करता है; (iv) "रजजस्ट्रीकरण प्राजधकरण" से राज्य सरकार द्वारा नामजनदजे ित पररवहन अयुि के पद से ऄन्द्यून कोइ भी ऄजधकारी ऄजभप्रेत ह,ै और स्ट्वचाजलत परीक्षण स्ट्टेिनों के रजजस्ट्रीकरण के जलए आस ऄध्याय के ऄधीन प्रारंजभक रजजस्ट्रीकरण प्रमाण पत्र जारी करने, रजजस्ट्रीकरण प्रमाण पत्र जारी करने और नवीनीकृत करने के जलए सिि बनाता ह;ै (v) जनयम 183 के प्रयोजन के जलए "ऄपीलीय प्राजधकारी" से राज्य सरकार द्वारा नामजनदजे ित क्षेत्रीय पररवहन ऄजधकारी के पद से ऄन्द्यून कोइ ऄजधकारी ऄजभप्रेत है, जजसके समक्ष एक स्ट्वचाजलत परीक्षण स्ट्टेिन द्वारा ददए गए वाहन के परीक्षा पररणाम के जवरुद्ध ऄपील की जा सकती है; (vi) "प्रारंजभक रजजस्ट्रीकरण प्रमाणपत्र" से रजजस्ट्रीकरण प्राजधकारी द्वारा ददया गया प्रमाणपत्र ऄजभप्रेत ह ै जो अवेदक को एक स्ट्वचाजलत परीक्षण स्ट्टेिन की स्ट्थापना या जनमागण या स्ट्थापना िुूप करने की ऄनुमजत दते ा है; (vii) "रजजस्ट्रीकरण प्रमाण पत्र" से रजजस्ट्रीकरण प्राजधकरण द्वारा ददया गया प्रमाण पत्र ऄजभप्रेत ह ै जो दकसी भी स्ट्वचाजलत परीक्षण स्ट्टेिन को संचालन िुूप करने की ऄनुमजत दते ा ह;ै (viii) "स्ट्वामी" से दकसी व्यजि या कंपनी या संघ या व्यजियों के जनकाय या जविेष प्रयोजन वाहन या राज्य सरकार सजहत एक व्यजि ऄजभप्रेत ह,ै जो एक स्ट्वचाजलत परीक्षण स्ट्टेिन का रजजस्ट्रीकृत माजलक है; (ix) एक जवत्तीय वषग के जलए "जनवल मूल्य" से कुल संपजत्त और कुल देनदाररयों के बीच का ऄंतर ऄजभप्रेत है; (x) "ऑपरेटर" से दकसी व्यजि या कंपनी या संघ या व्यजियों के जनकाय या जविेष प्रयोजन वाहन या राज्य सरकार सजहत एक व्यजि ऄजभप्रेत ह,ै जजसे राज्य सरकार के रजजस्ट्रीकरण प्राजधकरण द्वारा स्ट्वचाजलत परीक्षण स्ट्टेिन के मामलों और संचालन के प्रबंधन की जजम्मेदारी लेने के जलए ऄजधकृत दकया गया ह ैजैसे कमगचाररयों को काम पर रखना, वाहनों का दफटनेस परीक्षण करना, पूरे संचालन की ऄखंडता सुजनजित करना, दफटनेस प्रमाण पत्र जारी करना और नवीनीकरण करना और आस ऄध्याय के ईपबंधों के ऄनुसार ऑजडट और मूल्यांकन के संचालन की सुजवधा प्रदान करना ह ै; (xi) "एंड ऑफ लाआफ" से कोइ भी ऐसा वाहन ऄजभप्रेत ह,ै -[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 (क) जो ऄब वैध ूपप से रजजस्ट्रीकृत नहीं है; या (ख) जजसका रजजस्ट्रीकरण ऄजधजनयम के ऄध्याय 4 के ऄधीन रद्द कर ददया गया है; या (ग) जजसे आस ऄध्याय के ईपबंधों के ऄधीन जनर्ददष्ट परीक्षण या पुन: परीक्षण के बाद ऄयोग्य घोजषत दकया गया है; या (घ) जो अग, क्षजत, प्राकृजतक अपदा, दगं ों या दघु गटनाओं से ईतपन्न होने वाली दकसी भी पररजस्ट्थजत के कारण वैध रजजस्ट्रीकृत माजलक द्वारा ऄपजिष्ट वाहन के ूपप में स्ट्वयं घोजषत ह।ै (2) ईन िब्दों और पदों के,जो आसमें प्रयुि हैं,और पररभाजषत नहीं हैं दकन्द्तु ऄजधजनयम में पररभाजषत हैं,वही ऄथग होंगे जो ईस ऄजधजनयम में ह ैं। 175. परीक्षण स्ट्टेिन के जलए रजजस्ट्रीकरणप्रदिया - (1) एक स्ट्वचाजलत परीक्षण स्ट्टेिन का कोइ भी ऑपरेटर प्रूपप 62 में रजजस्ट्रीकरण प्राजधकारी द्वारा ईसे प्रदान दकए गए दकसी भी वाहन का दफटनेस प्रमाण पत्र जारी या नवीनीकृत नहीं करेगा या रजजस्ट्रीकरण प्रमाण पत्र के जबना कोइ भी संचालन िुूप नहीं करेगा। (2) एक नए स्ट्वचाजलत परीक्षण स्ट्टेिन के मामले में, रजजस्ट्रीकरण प्रमाण पत्र प्रदान करने के जलए अवेदन ऐसे स्ट्टेिन के जनमागण या स्ट्थापना के जलए एक प्रारंजभक रजजस्ट्रीकरण प्रमाण पत्र के ऄनुदान से पहले दकया जाएगा और ईसके बाद, स्ट्वचाजलत की स्ट्थापना या जनमागण या स्ट्थापना पर परीक्षण स्ट्टेिन और आसके सफल पूवग-कमीिननग ऑजडट और मूल्यांकन के जलए, अवेदक संचालन िुूप करने के जलए रजजस्ट्रीकरण प्रमाण पत्र प्रदान करने के जलए एक अवेदन प्रस्ट्तुत कर सकता ह।ै (3) ईपजनयम (2) के ऄधीन प्रारंजभक रजजस्ट्रीकरण प्रमाण पत्र के ऄनुदान के जलए अवेदन माजलक या ऑपरेटर द्वारा रजजस्ट्रीकरण प्राजधकारी को प्रूपप 63 में दकया जाएगा और जनयम 188 में जनर्ददष्ट िुल्क के साथ होगा। (4) (i) रजजस्ट्रीकरण प्राजधकारी, प्रारंजभक रजजस्ट्रीकरण प्रमाण पत्र के ऄनुदान के जलए एक अवेदन पर जवचार करते समय, यह सुजनजित करेगा दक अवेदक जनयम 176 में जनर्ददष्ट सभी ऄपेक्षाओं को पूरा करता ह।ै (ii) रजजस्ट्रीकरण प्राजधकारी आस जनयम के ऄधीन एक अवेदन पर जवचार करते समय आस तथ्य को ध्यान में रखेगा दक स्ट्वचाजलत परीक्षण स्ट्टेिन की स्ट्थापना से ऐस ेस्ट्वचाजलत परीक्षण स्ट्टेिन के जलए वाहनों की संखया और जनकटता दोनों के संबंध में क्षेत्र म ेंपरीक्षण सुजवधाओं की ईपलब्धता में सुधार होगा। (5) रजजस्ट्रीकरण प्राजधकारी, ईप-जनयम (3) के ऄधीन अवेदन प्राि होने पर, और खुद को संतुष्ट करने के बाद दक अवेदक ने ईप-जनयम (4) की ऄपेक्षाओं का ऄनुपालन दकया है, ऐसे अवेदन की प्राजि की तारीख से तीस ददनके भीतर प्रूपप 61 में प्रारंजभक रजजस्ट्रीकरण प्रमाण पत्र प्रदान करता ह।ै परंतु प्रारंजभक रजजस्ट्रीकरण प्रमाणपत्र प्रदान करने के जलए दकसी भी अवेदन को रजजस्ट्रीकरण प्राजधकारी द्वारा तब तक ऄस्ट्वीकार नहीं दकया जाएगा जब तक दक अवेदक को सुनवाइ का ऄवसर नहीं ददया जाता ह ै और आस तरह के आनकार के कारण रजजस्ट्रीकरण प्राजधकारी द्वारा जलजखत ूपप में नहीं ददए जाते हैं। (6) अवेदक, स्ट्वचाजलत परीक्षण स्ट्टेिन की स्ट्थापना पर, परीक्षण और ऄंिांकन प्रयोगिालाओं के जलए राष्ट्रीय प्रतयायन बोडग - मान्द्यता प्राि ऄजभकरण या केंद्रीय सरकार द्वारा ऄजधसूजचत दकसी ऄन्द्य ऄजभकरण को पूवग-कमीिन ऑजडट करने और स्ट्वचाजलत परीक्षण स्ट्टेिन के मूल्यांकन के जलए जनयुि करेगा। (7) रजजस्ट्रीकरण प्रमाण पत्र के ऄनुदान या नवीनीकरण के जलए अवेदन प्रूपप 64 में रजजस्ट्रीकरण प्राजधकारी को दकया जाएगा और आसके साथ होगा, - (क) जनयम 188 में जनर्ददष्ट िुल्क; (ख) जनयम 188 में जनर्ददष्ट सुरक्षा जमा या बैंक गारंटी; (ग) ईप-जनयम (2) में जनर्ददष्ट प्रारंजभक रजजस्ट्रीकरण प्रमाणपत्र, जहां कहीं लागू हो; (घ) प्रूपप 66 में सफल प्री-कमीिननग ऑजडट और जनधागरण ररपोटग। (8) रजजस्ट्रीकरण प्राजधकारी, रजजस्ट्रीकरण प्रमाण पत्र के ऄनुदान या नवीनीकरण के जलए एक अवेदन पर जवचार करते समय यह सुजनजित करेगा दक अवेदक जनयम 176 से 179 में प्रदान अवेदक ने ईप- जनयम (8) की ऄपेक्षाओं का ऄनुपालन दकया है,अवेदन प्राि होने की तारीख से साठ ददनों के भीतर प्रूपप 62 में रजजस्ट्रीकरण प्रमाण पत्र प्रदान या नवीनीकृत कर सकता ह।ै परंतु रजजस्ट्रीकरण प्रमाण पत्र प्रदान करने के जलए दकसी भी अवेदन को रजजस्ट्रीकरण प्राजधकारी द्वारा तब तक ऄस्ट्वीकार नहीं दकया जाएगा जब तक दक अवेदक को सुनवाइ का ऄवसर नहीं ददया जाता है और रजजस्ट्रीकरण प्राजधकारी द्वारा आस तरह से आनकार करने के कारण जलजखत ूपप में नहीं ददए जाते ह।ैं (10) प्रारंजभक रजजस्ट्रीकरण प्रमाण पत्र, रजजस्ट्रीकरण प्रमाण पत्र, प्रारंजभक रजजस्ट्रीकरण प्रमाण पत्र और रजजस्ट्रीकरण प्रमाण पत्र प्रदान करने के जलए अवेदन के संबंध में दकए गए सभी ऄवलोकन, अपजत्तयां या कारण जजसके कारण प्रारंजभक रजजस्ट्रीकरण प्रमाण पत्र या रजजस्ट्रीकरण प्रमाण पत्र ऄस्ट्वीकार कर ददया गया है, ईप-जनयम (5) और (9) के ऄधीन कोइ अदिे पाररत करने के तीन कायग ददवसों के भीतर आलेक्रॉजनक पोटगल पर सम्यक ूपप से ऄपलोड दकया जाएगा । 176. पात्रता.-(1) दकसी स्ट्वचाजलत परीक्षण केन्द्द्र का, यथाजस्ट्थजत, स्ट्वामी या प्रचालक राज्य सरकार या दकसी कम्पनी या संगम या व्यजि या व्यजियों के जनकाय या जविेष प्रयोजन यान,या तो प्रतयक्ष ूपप से या पजब्लक-प्राआवेट भागीदारी के माध्यम से, होगी । परन्द्तु कोइ यान जवजनमातग ा या सवे ा केन्द्द्र या मोटर गाड़ी डीलर या यान के सुधार या जवजनमागण या यान के जविय या मोटर गाड़ी के पूजों से संबंजधत कोइ व्यजि दकसी स्ट्वचाजलत परीक्षण केन्द्द्र का प्रतयक्ष ूपप से स्ट्वामी या प्रचालक नहीं बनेगा : परन्द्तु यह और दक जहां कोइ यान जवजनमागता या सेवा केन्द्द्र या मोटर गाड़ी डीलर या यान के सुधार या जवजनमाणग या यान के जविय या मोटर गाड़ी के पूजों से संबंजधत कोइ व्यजि दकसी स्ट्वचाजलत परीक्षण केन्द्द्र का स्ट्वामी या प्रचालक बनने का अिय रखता है तो वह कोइ समनुषंगी या संयुि ईद्यम या कोइ जविेष प्रयोजन यान बनाकर ऐसा कर सकेगा । (2) ईप-जनयम (1) में ऄन्द्तर्ववष्ट दकसी बात के होते हुए भी, दकसी स्ट्वचाजलत परीक्षण केन्द्द्र का स्ट्वामी ऐसे स्ट्वचाजलत परीक्षण केन्द्द्र का प्रचालक भी हो सकेगा । (3) दकसी स्ट्वचाजलत परीक्षण केन्द्द्र के स्ट्वामी या प्रचालक के पास जनम्नजलजखत होगा,- (i) जनगमन प्रमाणपत्र या दकु ान ऄजधजनयम रजजस्ट्रीकरण या ईद्यम अधार ; (ii) जवजधमान्द्य माल और सेवा कर प्रमाणपत्र ; और (iii) जवजधमान्द्य स्ट्थायी खाता संखयांक । (4) दकसी स्ट्वचाजलत परीक्षण केन्द्द्र के स्ट्वामी या प्रचालक के पास जपछले जवत्तीय वषग के दौरान न्द्यूनतम तीन करोड़ रुपए की िुद्ध माजलयत होगी और ऄंजतम दो जवत्तीय वषों में कर के पिात् जनजित लाभ होना चाजहए । (5) जहां स्ट्वचाजलत परीक्षण केन्द्द्ररखा जाना ह ैवे पररसर या तो स्ट्वामी के स्ट्वाजमतव में हों या कम से कम दस वषग की ऄवजध के जलए पट्टे या भाड़े पर जलए गए हों। 177. जहतों का टकराव– (1) कायग के संचालन के दौरान ऐसे जहतों का कोइ टकराव नहीं होगा जो दकसी स्ट्वचाजलत परीक्षण केन्द्द्र के स्ट्वामी या प्रचालक के जवत्तीय या वृजतक जहतों और आस ऄध्याय के ऄधीन ईनकी बाध्यताओं के कारण ईद्भूत हुए ह ैंया हुए समझे गए ह ैं। स्ट्पष्टीकरण – आस जनयम के प्रयोजनों के जलए, जवत्तीय या वृजत्तक जहत से कोइ वैयजिक, जवत्तीय या ऄन्द्य प्रजतफल जजसके दकसी स्ट्वचाजलत परीक्षण केन्द्द्र के स्ट्वामी या प्रचालक के वृजत्तक व्यवहार पर ऄसर डालने या समझौते की संभावना ह।ै (2) स्ट्वचाजलत परीक्षण केन्द्द्र केवल परीक्षण सुजवधा के ूपप में कायग करेगा और यानों के सुधार या जवजनमाणग या यानों के जविय या मोटर गाड़ी के पूजों से संबंजधत कोइ सेवा ईपलब्ध नहीं करेगा । (3) स्ट्वचाजलत परीक्षण केन्द्द्र के परीक्षण पदधारी,यान के वगग और प्रकार से संबंजधत परीक्षण पररणाम की बाबत जानकारी को ऄजतगोपनीय बनाए रखेंगे । (4) दकसी स्ट्वचाजलत परीक्षण केन्द्द्र का प्रचालक हर समय एक पारदिी और पक्षपातरजहत रीजत में कृतय करेगा और प्ररुप 64 में यथा- जवजनर्ददष्ट ईप-जनयम (1), ईप-जनयम (2) और ईप-जनयम (3) के ईपबंधों से संबंजधत एक वचनबन्द्ध हस्ट्ताक्षर करेगा । 178. ऄवसंरचना ऄपक्षे ा–(1) परीक्षण के प्रयोजनों के जलए प्रयोग की जानी वाली कोइ सुजवधा, दोपजहया यानों या जतपजहया यानों के जलए न्द्यूनतम प्रजत पथ क्षेत्र 500 वगगमीटर और हल्के या मध्यम या भारी मोटरयानों के जलए एक हजार पांच सौ वगग मीटर होगा[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 5 जजसके ऄन्द्तगगत प्रिासजनक ब्लाक के जलए ऄनुूपप स्ट्थान, जजसमें स्ट्वागत या जानकारी केन्द्द्र, प्रजतक्षा केन्द्द्र, सूचना प्रौद्योजगकी सवगर और कायगिाला, िौचालय, अदद हों, भी ह ैं। (2) स्ट्वचाजलत परीक्षण केन्द्द्र में परीक्षण पथ पररभाजषत करने हेतु जनम्नजलजखत सारणी के ऄनुसार न्द्यूनतम लम्बाइ-चौड़ाइ होगी, ऄथागत् :- [सारणी क] िम स.ं दकसी परीक्षण पथ की न्द्यनू तम दोपजहया जतपजहया और हल्के मध्यम और भारी (3) दकसी स्ट्वचाजलत परीक्षण केन्द्द्र मानक संचालन प्रदिया पजब्लक के साथ-साथ कमगचाररवृंद्ध के जलए प्रतीक्षा क्षेत्र म ें ईपदर्वित की जाएगी । (4) ईपयोजगताओं जैसे रांसफामगर, जनम्न दबाव या ईच्च दबाव पैनल सुरक्षा सजहत या सुरक्षा युजियां, वायु कम्पेसर, जनर्ववरोध जवद्युत स्रोत, जल कूलर, ऄजि सुरक्षा और पयागि क्षमता वाला ऄजििमन संयंत्र और परीक्षण पथ क्षेत्र में पयागि संवातन और धुंअ जनकासी संयंत्र ईपलब्ध कराने के जलए पयागि स्ट्थान होगा । (5) दकसी स्ट्वचाजलत परीक्षण केन्द्द्र में परीक् ाण के जलए लाए गए यानों की पा्कग और जनबागध अवागमन के जलए पयागप्त स्ट् थान होगा और अव‍ यक साआबर सुरक्षा प्रमाणन, सूचना प्रौद्योजगकी संयंत्र के जलए वाहन डाटा बेस को, यथालागू, सुरजक्षत पहुचं हते ु ईपलब् ध कराया जाएगा । (6) परीक्षण ईपस् कर और सूचना प्रौद्योजगकी ऄवसंरचना जनयम, 190 के ऄनुसार होगी । 179. जनिजक्त ऄपक्षे ा :(1) न्द् यूनतम जनिजक् त ऄपेक्षा जनम् नजलजखत सारणी के ऄनुसार होगी, ऄथागत्:- [सारणी–ख] िम स.ं पदनाम न्द्य नू तम जनिजक्त न्द्य नू तम ऄहतग ा ऄपक्षे ा (1) (2) (3) (4) 1. मुखय प्रधान/प्रबंधक 1 मोटरगाड़ी या यांजत्रकी या जवद्यतु या आलेक्रॉजनकी आंजीजनयरी म ें स्ट् नातक के साथ कम से कम दस वषग का वृजत तक ऄनुभव हो जजसम ें कम से कम पांच वषग का यान जनरीक्षण, जवजनमागण या सुधार का ऄनुभव है और ऄजधजनयम और तदधीन बनाए गए जनयमों के बारे में सम्पूणग ज्ञान, जविेष रुप से मोटरयानों के रजजस्ट्र ीकरण और मोटरयानों के सजन्द् नमाणग , ईपस्ट् कर तथा ऄनुरक्षण से संबंजधत ऄध्य ायों के बारे में, होगा । 2. सूचना प्रौद्योजगकी 1(2 पथों तक) मास्ट् टर ऑफ कंप्य ूटर एप् लीकेिन या आंजीजनयरी स्ट् नातक या कंप्य ूटर प्रभारी/संयंत्र जवज्ञान में प्रौद्योजगकी स्ट् नातक या सूचना प्रौद्योजगकी या आलैक् राजनकी 2 (4 पथों तक) और संचार आंजीजनयरी स्ट् नातक के साथ दकसी मान्द् यता प्राप्त संगठन जव‍ लेषक या संस्ट् थान से हाडगवेयर, साफ्टवेयर और नेटव्कग में कम से कम तीन वषग का ऄनुभव ।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 3. डाटा एंरी अप्रेटर 2 कंप्य ूटर एप् लीकेिन में जडप् लोमा या दकसी जवषय के साथ स्ट् नातक के साथ कंप्य ूटर का बुजनयादी ज्ञान । 4. चालक (हल् का यान ) 2 प्रजत पथ प्रजत पारी चालन ऄनुज्ञजप्त के साथ (हल् के मोटर यान या भारी मोटर यान) कम से कम पांच वषग का चालन ऄनुभव । 5. पथ प्रभारी/ऄधीक्षक 1 प्रजत पथ प्रजत पारी औद्योजगक प्रजिक्षण संस्ट् थान से मोटर यांजत्रकी में जडप्ल ोमा या यांजत्रकी या मोटरगाड़ी या जवद्युत में जडप् लोमा के साथ दकसी मान्द् यता प्राप्त संगठन या संस्ट् थान से मोटरगाड़ी सुधार और ऄनुरक्षण का न्द् यूनतम तीन वषग का ऄनुभव । 6. पथ प्रचालक 2 प्रजत पथ प्रजत पारी औद्योजगक प्रजिक्षण संस्ट् थान से मोटर यांजत्रकी या जवद्युत या कंप्य ूटर में जडप्ल ोमा के साथ दकसी मान्द् यता प्राप्त संगठन या संस्ट् थान स े मोटरगाड़ी सुधार और ऄनुरक्षण का न्द् यूनतम दो वषग का ऄनुभव । 7. ऄनुरक्षण 1 प्रजत पथ प्रजत पारी वातानुकूलन और प्रिीतन में औद्योजगक प्रजिक्षण संस्ट् थान से जडप्ल ोमा तकनीजियन या औद्योजगक प्रजिक्षण संस्ट् थान से जवद्युतकार जडप्ल ोमा या यांजत्रकी या जवद्युत में जडप्ल ोमा के साथ दकसी मान्द् यताप्राप्त संगठन या संस्ट् थान से जवद्युत ऄनुरक्षण का न्द् यूनतम दो वषग का ऄनुभव । 2. स्ट्वचाजलत परीक्षण केन्द्द्र, तत समय प्रवृत त सभी जवजधयों, जजसके ऄंतगगत यथालागू श्रमजवजधयां भी हैं, की ऄनुपालना सुजनज‍ चत करेगा । 180. रजजस्ट्रीकरण की वैधता और नवीकरण - (1) प्रारजम्भक रजजस्ट्रीकरण प्रमाण पत्र स्ट्वचाजलत परीक्षण स्ट्टेिन को तैयार करने या संजनमाणग या स्ट्थापना की ऄवजध के जलए वैध होगा, जो राज्य सरकार तथा स्ट्वामी या प्रचालक के बीच पारस्ट्पररक सहमजत से होगा तथा प्रारजम्भक रजजस्ट्रीकरण प्रमाणपत्र में जवजनर्ददष्ट दकया जाएगा । (2) रजजस्ट्रीकरण प्रमाणपत्र जारी करने की तारीख से दस वषग की ऄवजध के जलए वैध होगा तथा आसका पिातवती नवीकरण, यथाजस्ट्थजत, नवीकरण की तारीख से पांच वषग के जलए वैध होगा । (3) प्रारजम्भक रजजस्ट्रीकरण प्रमाणपत्र तथा रजजस्ट्रीकरण प्रमाणपत्र हस्ट्तांतरणीय नहीं होगा । (4) जहां प्रारजम्भक रजजस्ट्रीकरण प्रमाणपत्र या रजजस्ट्रीकरण प्रमाणपत्र खो या नष्ट हो जाता ह,ै तो ऐसे प्रमाणपत्र का धारक रजजस्ट्रीकरण प्राजधकारी को तथ्यों की सूचना दगे ा जजसन े प्रमाणपत्र ऄनुदत्त या नवीकृत दकया ह ै और ईसके कारण दर्वित करते हुए प्ररुप 65 में ईपजनयम (5) के ऄधीन ऄनुप्रजत प्रमाणपत्र के जलए अवेदन करेगा । (5) ऄनुप्रजत प्रारजम्भक रजजस्ट्रीकरण प्रमाणपत्र या रजजस्ट्रीकरण प्रमाणपत्र को जारी करने के जलए अवेदन जनयम 188 में यथाजवजनर्ददष्ट समुजचत फीस के साथ प्ररुप 65 में दकया जाएगा । (6) रजजस्ट्रीकरण प्राजधकारी, यथाजस्ट्थजत, प्ररुप 61 या प्ररुप 62 में ऄनुप्रजत प्रमाणपत्र जारी कर सकेगा जजसके उपरी दाएं कोन े पर "ऄनुप्रजत" िब्द स्ट्पष्ट ूपप से जलखा होगा । (7) ऄनुप्रजत प्रमाणपत्र रजजस्ट्रीकरण प्राजधकारी को तुरन्द्त ऄभ्यर्वपत कर ददया जाएगा यदद दकसी भजवष्यवती तारीख को मूल प्रमाणपत्र ढूंढ जलया जाता ह ैया पाया जाता ह ै। 181. परीक्षण प्रदिया और कायजग वजध - (1) दकसी स्ट्वचाजलत परीक्षण स्ट्टेिन पर दफटनेस परीक्षण के जलए जमलने हते ु बुककग केन्द्द्रीय मोटर यान (आक्कीसवां संिोधन) जनयम, 2021 की ऄजधसूचना की तारीख से छह मास के भीतर केजन्द्द्रय सरकार द्वारा स्ट्थाजपत आलैक्राजनक पोटगल के माध्यम से आलैक्राजनक ढंग से या केन्द्द्रीय सरपकार द्वारा ऄजभकजथत दकसी ऄन्द्य रीजत में जनयम 81 में यथाजवजनर्ददष्ट फीस जमा करके की जाएगी ।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 7 (2) जब तक ईपजनयम (1) में जनर्ददष्ट आलैक्राजनक पोटगल जवकजसत नहीं हो जाता, दफटनेस परीक्षणों के जलए बुककग या तो हस्ट्तचाजलत ढंग से या राज्य ऄथवा संघ राज्य क्षेत्र सरकारों के आलैक्राजनक पोटगल के माध्यम से की जाएंगी । (3) दकसी स्ट्वचाजलत परीक्षण स्ट्टेिन में दफटनेस परीक्षण हते ु स्ट्लाट बुक करते समय जनम्नजलजखत दस्ट्तावेज और जानकारी ऄपलोड की जाएगी - (i) प्ररुप 25 के साथ यान का रजजस्ट्रीकरण प्रमाणपत्र, जहां कहीं लागू हो (ii) वैध बीमा प्रमाण पत्र (iii) ऄंजतम वैध ऄनुज्ञजि, जहां कहीं लागू हो (iv) रजजस्ट्रीकृत स्ट्वामी या प्राजधकृत हस्ट्ताक्षरकताग की मोबाआल संखया और इमेल अइडी (4) यान से संबंजधत ऄन्द्य जववरण, जो केवल जनम्नजलजखत तक ही सीजमत नहीं है, वाहन डेटाबेस से स्ट्वचाजलत ूपप से प्राि दकया जाएगा, ऄथागत् - (i) चेजसस संखया; (ii) आंजन संखया; (iii) ईंधन ; (iv) यान का वगग ; (v) यान का प्रवगग ; (vi) मेक और मॉडल ; (vii) सकल यान भार (जीवीडब् ल् यू) ; (viii) जवजनमाणग का महीना और वषग ; (ix) स्ट्पीड गवनगर िम संखया, जहां कहीं लागू हो । (5) जनदिे मानकों के साथ संचाजलत दकए जाने वाले परीक्षणों की सूची, समय-समय पर यथाऄनुयोज्य जनयम 189 के ऄनुसार होगी । (6) डाटा सृजन, प्रदियागत करने तथा भंडारण को ऐसी रीजत में दकया जाएगा जजससे यह सुजनजित दकया जा सके दक: (i) डाटाबेस का भंडारण डाटा का ऄन्द्य प्लेटफामो के साथ असान जवजनमय और जवश्लेषण में समथग बनाने के जलए डाटा प्रबन्द्धन साफ्टवेयर प्लेटफामग में दकया । (ii) सभी स्ट्वचाजलत परीक्षण पररणामों को स्ट्वचाजलत परीक्षण स्ट्टेिन में लगाए गए केन्द्द्रीय सवगर में स्ट्वचाजलत ढंग से पारेजषत कर ददया जाएगा तथा जवजुऄल चैक डाटा, जजसके ऄन्द्तगगत फोटोग्राफ भी ह,ैं को भी ईसी सवगर पर ऄन्द्तररत कर ददया जाएगा । (iii) ईत्तीणग या ऄनुतीणग होने के जलए दफटनेस मानदडं स्ट्वचाजलत होंगे तथा जनयम 189 के ऄनुसार होंगे । (iv) (क) दकसी परीक्षण पथ में परीक्षण स्ट्टेिन का प्रदिगक दकसी परीक्षण पररणाम को दर्वित नहीं करेगा । (ख) परीक्षण पथ में सभी परीक्षण पररणामों को एनदिप्टेड परीक्षण डाटा से जछपाया जाएगा । (ग) परीक्षण ररपोटग स्ट्वतः ही सृजजत होगी तथा सभी परीक्षणों के पूणग होने के तुरन्द्त पिात् सुसंगत ब्यौरों के साथ जडजजटल ूपप से हस्ट्ताक्षररत की जाएगी । (v) सृजजत परीक्षण डाटा और ररपोटग सुरजक्षत और रजक्षत प्रसुजवधा म ें रखी जाएगी तथा आलैक्राजनक पोटगल पर ऄपलोड की जाएगी ।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (vi) यान तथा ईसकी चेजसस और आंजन संखया का छायाजचत्र वैजिक जस्ट्थजत प्रणाली समथग कैमरा से जलया जाएगा तथा रजक्षत प्रसजु वधा में रखा जाएगा और परीक्षण डाटा तथा ररपोटग के साथ आलैक्राजनक पोटगल पर ऄपलोड दकया जाएगा । (7) यथाजस्ट्थजत, प्ररुप 25 या प्ररुप 38 में दफटनेस का प्रमाणपत्र, यदद ऄनुदत्त दकया गया हो, और आस प्रकार सृजजत परीक्षण ररपोटग भौजतक तथा आलैक्राजनक ढंग से रजजस्ट्रीकृत स्ट्वामी या प्राजधकृत हस्ट्ताक्षरी को भेजी जाएगी तथा परीक्षण ररपोटग में जनम्नजलजखत सजम्मजलत होगा, ऄथागत् :- (i) स्ट्टेिन का नाम और रजजस्ट्रीकरण संखया ; (ii) परीक्षण की तारीख और समय ; (iii) यान के ब्यौरे - रजजस्ट्रीकरण संखया, प्रकार, मेक और मॉडल ; (iv) द‍ृ य जांच के ब्यौरे ; (v) कायागतमक परीक्षणों के मापे गए और ऄनुज्ञेय मूल्य ; (vi) ईस स्ट्वचाजलत परीक्षण स्ट्टेिन के प्रतयेक ईपस्ट्कर के ऄंििोधन की तारीख, जजस पर परीक्षण दकए जाते हैं ; (vii) दफटनेस प्रमाणपत्र ऄनुदत्त नहीं दकए जाने की दिा में, ईन कायागतमक परीक्षणों या द‍ृ य जांचों की सूची जजनम ें यान ऄसफल रहा । (8) पररणाम वाहन डाटाबेस के साथ भी एकीकृत दकए जाएंगे । 182. पनु : परीक्षण प्रदिया - (1) ईस यान के रजजस्ट्रीकृत स्ट्वामी को, जो जनयम 189 में यथाजवजनर्ददष्ट ऄपेजक्षत सभी या दकन्द्हीं परीक्षणों म ें ऄसफल रहा ह,ै ईजचत वकगिॉप से अरजम्भक जनरीक्षण की परीक्षण ररपोटग जवजनर्ददष्ट त्रुरटयों को ठीक करवाने के पिात्, ऐसे पररणाम के तीस ददन के भीतर पुनः परीक्षण हते ु अवेदन करने का ऄवसर प्रदान दकया जाएगा । (2) यान का रजजस्ट्रीकृत स्ट्वामी या प्राजधकृत हस्ट्ताक्षरी जनयम 81 में यथाजवजनर्ददष्ट फीस जमा करने के पिात् पुनपरीक्षण का जवकल्प चुन सकेगा तथा परीक्षण ररपोटग में यथाजवजनर्ददष्ट अरजम्भक जनरीक्षण में केवल ऄसफल परीक्षण (णों) के जलए ऐस े यान का पुनः परीक्षण दकया जाएगा । (3) जनयम 183 के ऄधीन रहते हुए, वह यान जो ईप-जनयम (1) में जवजनर्ददष्ट समय के भीतर पुनः परीक्षण नहीं दकया जाता है या ऐसे पुनः परीक्षण में ऄसफल रहता ह,ै ऐसे यान का जीवन समाि घोजषत दकया जाएगा। (4) आस जनयम में ऄन्द्तर्ववष्ट दकसी बात के होते हुए भी, जनयम 183 के ईपजनयम (2) के ऄधीन अंजिक या पूणग पुनःपरीक्षण करन े के ऄपील प्राजधकारी के अदिे की दिा में, ईसे तद्नुसार दकया जाएगा । 183. परीक्षण पररणामों के जवरुद्ध ऄपील - (1) परीक्षण पररणाम से व्यजथत कोइ व्यजि, ऐसे पररणाम की प्राजि की तारीख से सात ददन के भीतर, आस संबंध में केन्द्द्रीय सरकार द्वारा जवजनर्ददष्ट आलैक्राजनक पोटगल के माध्यम से, प्ररुप 68 में ऄपील प्राजधकारी को ऄपील प्रस्ट्तुत करेगा तथा ऐसी ऄपील के साथ जनयम 188 में यथाजवजनर्ददष्ट फीस तथा परीक्षण पररणाम की एक प्रजत संलि होगी । (2) ऄपील प्राजधकारी ऐसी ऄपील की प्राजि के प्रन्द्द्रह कायग ददवसों के भीतर यान के अंजिक या पूणग पुनः परीक्षण का अदिे कर सकेगा । (3) ऐसा पुनः परीक्षण यान द्वारा ईत्तीणग करने के पाररणाजमक, ऄपील प्राजधकारी ऐसे यान को दफटनेस प्रमाणपत्र जारी करेगा । (4) ऄपील प्राजधकारी का जनणगय ऄंजतम और बाध्यकारी होगा । 184. सपं रीक्षा और जनधारग ण - (1) स्ट्वचाजलत परीक्षण स्ट्टेिन का जनष्पादन और कृतय अवजधक संपरीक्षाओं तथा जनधागरण के माध्यम से ईप-जनयम (3) में यथाजवजनर्ददष्ट ऐसे ऄन्द्तरालों पर मॉजनटर दकया जाएगा ।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 9 (2) रजजस्ट्रीकरण प्राजधकारी ऐसी संपरीक्षा और जनधागरण संचाजलत करने के जलए केन्द्द्रीय सरकार द्वारा ऄजधसूजचत परीक्षण और ऄंििोधन प्रयोगिाला प्रतयायन ऄजभकरण या दकसी ऄन्द्य ऄजभकरण हते ु राष्ट्रीय प्रतयायन बोडग जनयुि करेगा । (3) स्ट्वचाजलत परीक्षण स्ट्टेिन की संपरीक्षा और जनधागरण प्रतयेक छह मास में दकया जाएगा तथा ऐसी संपरीक्षा और जनधागरण की लागत का वहन ऐसी स्ट्टेिन के प्रचालक द्वारा दकया जाएगा । (4) स्ट्वचाजलत परीक्षण स्ट्टेिनों की संपरीक्षा और जनधागरण में जनम्नजलजखत पहलू सजम्मजलत होंगे, ऄथागत् :- (i) परीक्षण ईपस्ट्कर की पूणगता ; (ii) वषग में कम से कम एक बार या जवजनमागता की जसफाररि के ऄनुसार ऄपेजक्षत अवृजत्त पर ईपस्ट्कर ऄंििोधन, जो भी पहले हो ; (iii) आस ऄध्याय के ऄधीन यथाजवजनर्ददष्ट परीक्षण प्रदियाएं ; (iv) मिीनरी की ऄंििोधन प्रदिया ; (v) आस ऄध्याय के ऄधीन जवजनर्ददष्ट ऄहतग ा के ऄनुसार जनिजि ; (vi) प्रतयेक पथ से कम से कम तीन यानों की नमूना जांच ; (vii) डाटा समेकन ; (viii) स्ट्टेिन में लगाए गए सभी क्लोज सर्दकट टेजलजवजन की कायगप्रणाली (5) अपवाददत पररजस्ट्थजतयों में, रजजस्ट्रीकरण प्राजधकारी स्ट्वचाजलत परीक्षण स्ट्टेिन की औचक संपरीक्षा और जनधागरण भी संचाजलत कर सकेगा, जो पयागि ूपप से ऄजभजलजखत दकया जाएगा तथा ऐसी संपरीक्षा और जनधागरण की लागत प्रचालक द्वारा वहन की जाएगी । (6) स्ट्वचाजलत परीक्षण स्ट्टेिन के पदधारी कायागलय घंटों के दौरान दकसी भी समय जनरीक्षण को समथग बनाने और सहयोग करने के जलए ईत्तरदायी होंगे । (7) प्ररुप 67 में यथाजवजनर्ददष्ट संपरीक्षा और जनधागरण ररपोटग, जजसके ऄन्द्तगगत औचक संपरीक्षा और जनधागरण भी ह,ै छायाजचत्र साक्य के साथ, आस संबंध में केन्द्द्रीय सरकार द्वारा जवजनर्ददष्ट आलैक्राजनक पोटगल पर ऄपलोड की जाएगी । (8) (i) जहां संपरीक्षा और जनधागरण के दौरान जवसंगजत आंजगत की जाती है, तो ईसे संपरीक्षा और जनधागरण ररपोटग जारी करने की तारीख से दस कायगददवसों के भीतर प्रचालक द्वारा सुधार दकया जाएगा । (ii) सुधार ररपोटग केन्द्द्रीय सरकार द्वारा आस संबंध म ेंजवजनर्ददष्ट दकए गए आलैक्राजनक पोटगल के माध्यम से ऄनुमोदन हते ु सपं रीक्षा और जनधागरण ऄजभकरण को तथा सूचना हते ु रजजस्ट्रीकरण प्राजधकारी को प्रस्ट्ततु की जाएगी । (iii) संपरीक्षा और जनधागरण ऄजभकरण, यदद वह ऐसी वांछा करता ह,ै तो जवजधमान्द्यकरण और ऄनमु ोदन हते ु पुनःसंपरीक्षा तथा पुनःजनधागरण कर सकेगा । 185. रजजस्ट्र ीकरण प्रमाणपत्र जनलजं बत या रद्द करन े या प्रजतभजू त जनक्षपे सपं हरण करन े की रजजस्ट्र ीकरण प्राजधकारी की िजक्त – रजजस्ट्र ीकरण प्रमाणपत्र के धारक को सुने जाने का ऄवसर दने े के प‍ चात् यदद रजजस्ट्र ीकरण प्राजधकारी को यह समाधान हो जाता है दक वह,- (i) जनयम 176 से 179 में यथाऄजधकजथक ऄपेक्षाओं का पालन करने में ऄसफल हो गया है; या (ii) संपरीक्षा और जनधागरण के यथासूजचत समय पर परीक्षण के सही मानकों का संप्रेषण करने में ऄसफल हो गया है; या (iii) समय पर संपरीक्षा और जनधागरण कराने में ऄसफल हो गया है; या (iv) दकसी ऄनाचार में ऄंतवगजलत होने पर जनम् नजलजखत अदिे जलजखत में दकया जा सकेगा,- (क) जवजनर्ददष् ट ऄवजध के जलए रजजस्ट्र ीकरण प्रमाणपत्र जनलंजबत दकया जा सकेगा; या10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) रजजस्ट्र ीकरण प्रमाणपत्र का रद्द करने और प्रजतभूजत जनक्षेप और ेटोमेरटड परीक्षण स्ट् टेिन द्वारा जारी की गइ बैंक गारंटी के संपहरण का अदिे दकया जा सकेगा। 186. ऄपील.- जनयम 175 के ईपजनयम (9) या जनयम 185 के ऄधीन रजजस्ट्र ीकरण प्राजधकरण के अदिे द्वारा य जथत कोइ य जक्त अदिे की प्राजप्त की तारीख से तीस ददनों के भीतर राज्य या संघ राज्य क्षेत्र सरकार द्वारा आस ूपप में जनयुक्त दकए गए रजजस्ट्र ीकरण प्राजधकरण की पंजक् त के ईपर के दकसी ऄजधकारी को ऄपील कर सकेगा। 187. ऄपील के जलए प्रदिया.- (1) जनयम 186 के ऄधीन कोइ ऄपील रजजस्ट्र ीकरण प्राजधकरण के अदिे से अपजत त के अधारों को बताते हुए ज्ञापन के प्रूपप में प्रस्ट् तुत की जाएगी; (2) ऄपील ऄजधजनयम, 1988 में यथाजवजनर्ददष् ट ऄपेजक्षत फीस के साथ प्रस्ट् तुत की जाएगी; (3) जनयम 186 में जनर्ददष् ट ऄजधकारी पक्षकारों को सुने जाने का ऄवसर दने े के प‍ चात् और ऐसी जांच जजसे वह अव‍ यक समझे, करने के प‍ चात् ऐसी ऄपील की प्राजप्त की तारीख से पैंतालीस ददनों की ऄवजध के भीतर युजक् तयुक्त अदिे पाररत करेगा। 188. फीस– आस ऄध्य ाय के ईपबंधों के ऄधीन भाररत फीस जनम् नजलजखत सारणी में यथा-जनर्ददष् ट धुअं घनतव सीमाएं होंगी । (12) ब्रेककग प्रणाली हां हां द‍ृ यमान और ए.अइ.एस - 128 (I) द‍ृ यमान जनरीक्षण मानदडं : कायागतमक (i) जुड़नार सुरजक्षत दकया जाएगा; (ii) ब्रेक क्षेत्र क्षजत या दरक नहीं होगी; (iii) ब्रेक द्रव का ररसाव न हो; (II) कायागतमक परीक्षण ऄपेक्षाएं रोलर पर पररजभव ब्रेककग जनपुणता ब्रेक परीक्षण कम से कम 27.23 प्रजतित होनी चाजहए । (13) पररचालन जगयर हां हां कायागतमक जनयम 98 कायागतमक परीक्षण ऄपेक्षाएं बैंक लैि/ पररचालन जगयर में 30 जडग्री से कम नहीं होगा । (14) तरफ दफसलन परीक्षण नहीं नहीं कायागतमक के जवजनदिे न के ऄनुसार ऄनुसार (3-चौपजहयों के जसवाए यानों के सभी प्रवगों के जलए यह परीक्षण लागू होता ह ै) (15) प्रलंबन परीक्षण नहीं नहीं कायागतमक कायागतमक परीक्षण ऄपेक्षाएं: (3- जतपजहयों ऄपवर्वजत ऄंतर के बीच प्रंलबन प्रणाली 3.5 तक जी. वी. डब्ल्यू वाए ऄनुपुरक नहीं है और यान यानों के जलए लागू) दाजहने की तरफ हो । (16) जोड़ गजतजवजध परीक्षण नहीं हां द‍ृ यमान द‍ृ यमान जनरीक्षण मानदडं : कायागतमक (क) प्रलबंन प्रणाली : (i) चेजजज या धूरी के जलए नस्ट्प्रग और धक्का ऄविोषक के असंग18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] को सुरजक्षत को सुजनजित करना; (ii) नस्ट्प्रगों को क्षजतग्रस्ट्त या जवभंजजत नहीं होगा; (iii) धक्का ऄविोषक ऄवमंदकों में दकसी तेल में ररसाव नहीं होगा; (iv) चूल छल्ला जपन या प्रवणी या प्रलंबन जोड़ों पर ऄजधक घरटत नहीं होगा ; (v) वायु प्रलंबन के मामले में श्रवण योग्य प्रणाली में ररसाव ना सुजनजित करना (ख) धूरी : (i) धूरी यान को अबद्ध सुरजक्षत करना ; (ii) धूरी को जवभंजजत या जवकृत नहीं होगा ; (iii) चूलछल्ला या जपन या प्रवणी में ऄतयजधक पहनना घरटत नहीं होगा । (17) स्ट्पीडोमीटर (क) स्ट्पीडोमीटर नहीं हां द‍ृ यमान जनयम 117 और द‍ृ यमान जनरीक्षण मानदडं : अइ एस 11827- 2008 (i) सुरजक्षत ठीक दकया गया ; (ii) पयागि रुप से प्रदीपन करना; (iii) डायल अच्छदन खंजडत नहीं होगा; (iv) संकेतक सुइ का पररचालन । (ख)स्ट्पीडोमीटर परीक्षण नहीं नहीं कायागतमक जवजनदिे न के सीधा या सपाट सड़क पर जबना (इ-ररक्िा या इ-छकड़ा के ऄनुसार लक्य की दिा (पूणग भाड़ा के जलए) साथ और पूणग संकलक पर की जस्ट्थजत पर)जबनालाद ेमें यान संचालन होगा औरजब यान पूणग गजत प्राि करता ह,ै ऄजधक गजत जनयतन दरू ी (ऄथागत् 50मीटर ) यात्रा को समय लेने पर माप द्वारा पररकजलत दकया जाएगा । (18) चालन संरक्षण के ऄधीन नहीं हां द‍ृ यमान जनयम 124(1क) द‍ृ यमान जनरीक्षण मानदडं : पृष्ठ भाग और अइ.एस. (i) पृष्ठ भाग ऄधो सवारी युजि एन 2, एन 3, टी 3 14812-2005 संरक्षण दरकदार, संक्षररत या[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 19 और टी 4 के जलए युजि क्षजतग्रस्ट्त नहीं होगा ; (ii) यह सुजनजित करना दक भूजम जनकासी और पृष्ठ भाग ऄधो सवारी संरक्षण मुजि अइ एस. 14812-2005 के ऄनुसार होगा । (19) एन 2, एन 3, टी 3 और टी नहीं हां द‍ृ यमान जनयम 124 (1क) द‍ृ यमान जनरीक्षण मानदडं : 4 के जलए चलने के जलए और अइ 14682- ऄधीन पािवीय 2004 (i) चालन संरक्षण युजि के ऄधीन पािवीय दफट दकया जाएगा ; (ii) युजक्त्त संरक्षण चालन के ऄधीन पािवीय दरकदार संक्षररत या क्षजतग्रस्ट्त नहीं होगा ; (iii) सुजनजित करना दक संरक्षण युजि चालन के ऄधीन पािवीय अइ. एस. 1468202004 के ऄनुसार होगा। (20) िीघ्रगामी जचप्पी नहीं हां द‍ृ यमान जनयम 138(क) द‍ृ यमान जनरीक्षण मानदडं : (i) ध्वारोक िीिा मुख पर जचपकाया जाए ; (ii) िीघ्रगामी जचप्पी क्षजतग्रस्ट्त नहीं होना चाजहए । (21) जवजभन्न रुप से योग्य नहीं हां द‍ृ यमान ईप-जनयम(1) और द‍ृ यमान जनरीक्षण मानदडं : याजत्रयों और गजतिीलता जनयम 125 ग का मेंकमी याजत्रयों के साथ के 7, ए.अइ. एस. (i) पूवीकता सीट के साथ दफट जलए पूवीकता सीटों पर 052(पुनरीजक्षत 1) की गईं बसें बाहर से द‍ृ यमान पूवीकता सीटें, संकेत और ए.अइ. 153 जचत्रलेख होगा, बस की तरफ सहारों को सुरजक्षत पास मुखय दोनो ेर सुसंगत होना/बेंत/पक्ष पदाचारी सेवा द्वार के जलए जनकटवती हस्ट्त रेल धूनी हों ; (ii) जचत्रलेख पूवीकता सीट के जलए अंतररक जनकटवती स्ट्थान होगा ; (iii) सभी प्रकार की बसें जमनी और मध्य बसों के मामले में सीटों में कम से कम दो यात्री होंगे और जनिि व्यजियों के जलए पूवीकता सीटों के रुप म ें ऄजभजहत ऄन्द्य बसों के मामले में चार यात्री होंगे । (iv) ऄग्रवती-ऄग्रभाग प्रकार की पूवगकता सीटें केवल होगी और20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ऄजधमानता चालक की सीट के पीछे ऄवजस्ट्थत होगी । (v) ऄिि व्यजियों के जलए सुजवधाजनक यात्रा सुकर करने के जलए िच, बेत/ पदचारी सुरजक्षत करने के जलए पूवीकता सीटे समुजचत सजु वधा प्रदान की जाएगी (vi) सभी प्रकार की बसें प्रवेि हस्ट्थरेल या थमने को प्रदान दकया जाएगा (vii) ठहरावों की अव‍यकाता के जलए पूवीकता सीटों को सभी प्रकार अइ एन डी एक्स बसें समीप जनयंत्रणों को प्रदान दकया जाएगा और जो चालक चेतावनी दते ा ह ैदक जबना चढे के जलए ईपयोिा आच्छा से गजतिील हो । (viii) दकसी पूवीकता सीट के जलए संचार युजियों को सभी परखा जाएगा । (22) जवजभन्न रुप से योग्य नहीं हां द‍ृ यमान ईप-जनयम ()(1) द‍ृ यमान मानदडं : जवजभन्न याजत्रयों के जलए और (7) 125 ग हील चेऄर प्रवेि अवासन ((पुन 1) और ए.अइ (i) बाहर की तरफ से जपक्टोग्राम ऄजभबंधन के जलए व्यवस्ट्था एस.-153 बसें स्ट्थान में हील चेऄर को और कमी गजतिीलता के दफट दकया जाएगा, बस की साथ यात्री तरफ बाहर दोनो ऄग्रभाग पर और सुसंगत सेवा द्वार के समीप हो (ii) ईपदिगन स्ट्थान प्रतयेक हील चेऄर के जलए जपकटोग्राम में से एक अरंजभक रुप से रखा जाएगा चाह ेबस के ऄग्र या ररयर ऄग्र भाग मुखय भाग जस्ट्थजत में होना चाजहए । (iii) हील चेऄर रोक योग्य रोक प्रणाली स्ट्थान में प्रदान दकया जाएगा । (iv) व्यजि की सहायता के जबना को हीर चेयर ईपयोिा के जलए पयागि स्ट्थान सुजनजित करना । (v) प्रकार के यानों को हील चेऄर ईपयोिा हीव चेऄर कम से कम स्ट्थान की पहचान को क्षेत्र होगा ।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 21 (vi) संचार युजियां हील चेऄर क्षेत्र पहचाने के भीतर जस्ट्थत होगा । (23) यान स्ट्थापन पथन नहीं हां द‍ृ यमान ए.अइ.एस. द‍ृ यमान जनरीक्षण मान दडं : (वीएलवी) युजि (i) यान स्ट्थापन ऄवसंजस्ट्थत दकया जाएगा ; (ii) अपात चेतावनी बटन कायग कर रहा है । (24) ईच्च सुरक्षा रजजस्ट्रीकरण नहीं हां द‍ृ यमान जनयम और ए. अइ. द‍ृ यमान जनरीक्षण मानदडं : एस-159 (i) मुख पर ईच्च सुरक्षा रजजस्ट्रीकरण प्लेटों को संस्ट्थाजपत दकया जाएगा। (25) बैटरी नहीं हां द‍ृ य - द‍ृ य जनरीक्षण प्राचल: (i) सुरजक्षत अधार; (ii) सुजनज‍ चत करें दक कोइ ररसाव न हो; (iii) सुजनज‍ चत करें उपरी सतह स्ट् वच् छ, िुष् क, धूल और काजलक से मुक् त हो । (26) सुरक्षा बैल् ट नहीं हां द‍ृ य जनयम 125 (1-क) द‍ृ य जनरीक्षण प्राचल: और एअइएस-015 (सीट बैल् ट) अज्ञापक सुरक्षा बैल् ट ईपलब् ध या अइएस होगी और सुरजक्षत ूपप से लगी 15140:2003 हुइ होगी; (i) सुरक्षा बैल् ट क्षजतग्रस्ट्त नहीं होनी चाजहए; (ii) सुरक्षा बैल् ट जस्ट् थरक ढीला नहीं हो; (iii) सीट बैल् ट ऄनुस्ट् मारक प्रणाली, यदद ईपलब् ध हो तो कायग करनी चाजहए । (27) गजत जनयंत्रक नहीं हां द‍ृ य और जनयम:118 और द‍ृ य जनरीक्षण प्राचल: दियािील एअइएस-018 (i) सुरजक्षत ूपप से लगा हुअ हो ; (ii) 1 ऄक् तूबर, 2015 को या ईसके प‍ चात जवजनर्वमत पररवहन यानों के जलए जो डंपर, टैंकर, स्ट् कूल बस है, जो पररसंकटमय माल का वहन करते ह ैं या ऐसे ऄन्द् य प्रवगग के यान, जैसा केन्द् द्रीय सरकार द्वारा ऄजधसूचना द्वारा जवजनर्ददष् ट दकया जाए, ऄजधकतम गजत सीमा 60 दक.मी./घं. या ऄन्द् य कोइ गजत सीमा जो केन्द् द्रीय सरकार द्वारा जवजनर्ददष् ट की जाए होगी । (28) फुअरा जनरोध युजक् त नहीं हां द‍ृ य एअइएस-013 द‍ृ य जनरीक्षण प्राचल: (अरइवी.1) सुरजक्षत ूपप से लगे हुए फुअरा जनरोध युजक् त की ईपजस्ट् थजत सुजनज‍ चत करें । (29) टायर नहीं हां द‍ृ य जनयम 94 और द‍ृ य जनरीक्षण प्राचल: जनयम 95 (i) टायर में कोइ भारी नुकसान या कटा हुअ न हो (वल् कजनत मरम् मत से जभन्द् न बाहरी गुल् फत्राण पैवंद द्वारा पैवंद लगाया हुअ या मरम् मत दकया हुअ) ; (ii) जवजनमाणग के समय टायरों में लगे हुए तल् ला जघसाव ईपदिगक (पीडब् ल् यूअइ) से नीचे जतपजहया यान, चौपजहया यान, इ-ररक्ि ा और इ-गाड़ी की दिा में गैर दफसलन गहराइ (एनएसडी) 0.8 जम.जम. और ऄन्द् य मोटर यानों की दिा में 1.6 जम.मी. स े कम न हो ; (iii) टायर में ठीक से हवा भरी हो;[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 23 (iv) टायर, स्ट् थानीय जवकृजत या ईभाड़ द्वारा अरंजभक खराबी के जचन्द् ह नहीं दिागता हो; (v) टायर अवरक वस्ट्त्र , तल् ले के जघसने या दकसी ऄन्द् य वल् कजनत जसरे या ईसके दकसी भाग म ें ऄपघषगण के कारण प्रदर्वित नहींहोता हो ; (vi) ऄस्ट् थायी ऄजतररक् त पजहया या टायर पंचर मरम् मत दकट ईपलब् ध हो । (30) प्रजत-परावतगक और नहीं हां द‍ृ य जनयम:104, द‍ृ य जनरीक्षण प्राचल: परावतगक टेप एअइएस-090 और (ऄ) परावतगक- एअइएस-037, (i) स्ट् वच् छ परावतगकों की एअइएस-057 और ईपजस्ट् थजत सुजनज‍ चत करें ; एअइएस-057 (अरइवी.1) (ii) परातवगक सुरजक्षत ूपप से लगे हों ; (iii) परावतकग क्षजतग्रस्ट्त ऄवस्ट्थ ा में न हों ; (iv) यह सुजनज‍ चत करें दक परावतगकों का रंग, जनयम 104 के ऄनुसार हो ऄथागत् पीछे के जलए लाल रंग और अगे के जलए सफेद रंग । (अ) परावतगक टेप – (i) स्ट् वच् छ परावतगक टेप की ईपजस्ट् थजत सुजनज‍ चत करे ; (हां/नहीं) यदद हां, तो ब्यौरा दें : (कृपया परीक्षण पररणाम की प्रजत संलि करें)।”। [स.अरटी-25035/05/2021-अरएस] ऄजमत वरदान, संयुि सजचव रटप्पणः मूल जनयम भारत के राजपत्र, ऄसाधारण, भाग II, खंड 3, ईपखंड (i) में ऄजधसूचना संखयांक सा.का.जन. 590(ऄ) तारीख 2 जून, 1989 द्वारा प्रकाजित दकए गए थे और ऄजधसूचना संखयांक सा.का.जन. 594(ऄ) तारीख 26 ऄगस्ट्त, 2021 द्वारा ऄंजतम बार संिोजधत दकए गए थे । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 23rd September, 2021 G.S.R. 652 (E).— Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989, were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 278 (E), dated the 8th April, 2021 in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to the public; And, whereas, copies of the said Gazette notification were made available to the public on the 8th April, 2021; And, whereas, the objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government;[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 43 Now, therefore, in exercise of powers conferred by section 56 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: - 1. Short title and commencement. - (1) These rules may be called the Central Motor Vehicles (Twenty first Amendment) Rules, 2021. (2) They shall come into force with effect from the 25th day of September, 2021. 2. In the Central Motor Vehicles Rules, 1989(herein after referred to as the said rules), in rule 63, after sub-rule (5), the following sub-rule shall be inserted, namely: - ―(6) Notwithstanding anything contained in this rule, the recognition, regulation and control of automated testing station, for the purposes of section 56 of the Act, shall be as per Chapter XI of these rules.‖. 3. In the said rules, after Chapter X, the following chapter shall be inserted, namely: - ―CHAPTER XI RECOGNITION, REGULATION AND CONTROL OF AUTOMATED TESTING STATION 173. Applicability. – The provisions of this chapter shall be applicable for the recognition, regulation and control of automated testing stations, the procedure for fitness testing of vehicles through automated equipment and the procedure for grant of Certificate of Fitness by automated testing stations. 174. Definitions. – (1) In this Chapter, unless the context otherwise requires, - (i) ―Act‖ means The Motor Vehicles Act, 1988 (59 of 1988); (ii) ―automated testing station‖ means any automated testing facility, authorised by the State Government, where vehicle fitness testing may be conducted through automated vehicle testing equipment in accordance with the provisions of this chapter; (iii) ―certificate of fitness‖ means the certificate issued by a prescribed authority, referred to in sub-section (1) section 56 of the Act, or by an authorised testing station, in Form 38 for transport vehicles and in Form 25 for non-transport vehicles, as the case maybe, to the effect that the vehicle complies, for the time being, with all the requirements of the Act and the rules made thereunder; (iv) ―registering authority‖ means any officer not below the rank of Transport Commissioner nominated by the State Government and empowered to issue Preliminary Registration Certificates, issue and renew Registration Certificates under this chapter for the registration of automated testing stations; (v) ―Appellate Authority‖ for the purpose of rule 183, means any officer not below the rank of Regional Transport Officer nominated by the State Government before whom appeal against test result for a vehicle given by an automated testing station can be preferred; (vi) ―Preliminary Registration Certificate‖ means the certificate granted by the Registering Authority permitting the applicant to commence setting up or construction or establishment of an automated testing station; (vii) ―Registration Certificate‖ means the certificate granted by the Registering Authority permitting any automated testing station to commence operations; (viii) ―owner‖ means a person including any individual or company or association or body of individuals or special purpose vehicle or State Government, who is a registered owner of an automated testing station; (ix) ―net worth‖ for a financial year means the difference between total assets and total liabilities; (x) ―operator‖ means a person including any individual or company or association or body of individuals or special purpose vehicle or State Government, authorised by the Registering Authority of the State Government to undertake the responsibility of managing the affairs and operations of the automated testing station such as hiring of staff, conduct of fitness testing of vehicles, ensuring the integrity of the whole operations, issuance and renewal of certificate of fitness and facilitating the conduct of the audit and assessment in accordance with the provisions of this chapter; (xi) ―End of Life Vehicle‖ means any vehicle, - (a) which is no longer validly registered; or (b) of which registration has been cancelled under Chapter IV of the Act; or (c) which has been declared unfit after undergoing test or re-test as specified under the provisions of this44 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] chapter; or (d) which is self-declared by the legitimate registered owner as a waste vehicle due to any circumstances that may arise from fire, damage, natural disaster, riots or accidents. (2) Words and expression used herein and not defined, but defined in the Act shall have the same meanings, as respectively, assigned to them in the said Act. 175. Registration Procedure for Automated Testing Station. – (1) No operator of an automated testing station shall issue or renew a certificate of fitness to any vehicle or commence any operations without having a Registration Certificate, granted to it by the registering authority in Form 62. (2) In case of a new automated testing station, the application for grant of Registration Certificate shall be preceded by the grant of a Preliminary Registration Certificate for construction or establishment of such station and thereafter, upon setting up or construction or establishment of the automated testing station and its successful pre- commissioning audit and assessment, the applicant can submit an application for grant of Registration Certificate to start operations. (3) The application for grant of Preliminary Registration Certificate under sub-rule (2) shall be made in Form 63 by the owner or operator to the registering authority and shall be accompanied by the fee as specified in rule 188. (4) (i) The registering authority, shall, while considering an application for the grant of a Preliminary Registration Certificate, ensure that the applicant satisfies all the requirements as specified in rule 176. (ii) The registering authority shall while considering an application under this rule, take into consideration the fact that the setting up of the automated testing station shall improve the availability of testing facilities in the area both in relation to the number of vehicles and proximity to such automated testing station. (5) The registering authority, on receipt of an application under sub-rule (3), and after satisfying himself that the applicant has complied with the requirements of sub- rule (4), grant the Preliminary Registration Certificate in Form 61 within thirty days from the date of receipt of such application: Provided that no application for the grant of a Preliminary Registration Certificate shall be refused by the registering authority unless the applicant is given an opportunity of being heard and reasons for such refusal are given in writing by the Registering Authority. (6) The applicant, upon the establishment of the automated testing station, shall appoint National Accreditation Board for Testing and Calibration Laboratories - accredited agency or any other agency notified by the Central Government for conducting pre- commissioning audit and assessment of the automated testing station. (7) An application for grant or renewal of a Registration Certificate shall be made in Form 64 to the registering authority and shall be accompanied by, — (a) the fee as specified in rule 188; (b) security deposit or bank guarantee as specified in rule 188; (c) the Preliminary Registration Certificate as referred to in sub-rule (2), wherever applicable; (d) successful pre-commissioning audit and assessment report in Form 66. (8) The registering authority shall, while considering an application for the grant or renewal of a Registration Certificate, ensure that the applicant satisfies all the requirements as provided in rules 176 to 179. (9) The registering authority may, on receipt of an application under sub-rule (7), and after satisfying himself that the applicant has complied with the requirements of sub- rule (8), grant or renew the Registration Certificate in Form 62 within sixty days from the date of receipt of the application: Provided that no application for grant of a Registration Certificate shall be refused by the registering authority unless the applicant is given an opportunity of being heard and reasons for such refusal are given in writing by the registering authority. (10) The Preliminary Registration Certificate, Registration Certificate, all observations made in relation to the application for grant of Preliminary Registration Certificate and Registration Certificate, the objections or reasons due to which the Preliminary Registration Certificate or Registration Certificate is refused, shall be duly uploaded on the electronic portal within three working days of passing any order under sub-rules (5) and (9). 176. Eligibility. – (1) The owner or operator, as the case may be, of an automated testing station shall be the State Government or any company or association or body of individuals or individual or special purpose vehicle either directly or through public- private partnership.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 45 Provided that a vehicle manufacturer or service station or automobile dealer or any person related to repair of vehicle or manufacturing or sale of vehicle or automobile spares shall not become the owner or operator of an automated testing station directly: Provided further that, where, a vehicle manufacturer or service station or automobile dealer or any person related to repair of vehicle or manufacturing or sale of vehicle or automobile spares intends to become the owner or operator of an automated testing station, it may do so, by forming a subsidiary or joint venture or a special purpose vehicle (2) Notwithstanding anything contained in sub-rule (1), the owner of an automated testing station may also be the operator of such automated testing station. (3) The owner or operator of an automated testing station shall possess, - (i) certificate of Incorporation or Shop Act registration or Udyam Aadhar; (ii) valid Goods and Service Tax certificate; and (iii) valid Permanent Account Number. (4) The owner or operator of an automated testing station shall have a minimum net worth of three crore rupees during the last financial year and should have a positive profit after tax in the last two financial years. (5) The premises where the automated testing station is to be housed shall either be owned or taken on lease or hired by the owner for a period not less than ten years. 177. Conflict of Interest. – (1) There shall be no conflict of interest during the course of operations that may arise or may be perceived due to financial or professional interest of the owner or operator of an automated testing station and their obligations under this chapter. Explanation -For the purposes of this rule, financial or professional interest means any personal, financial, or other considerations that may have the potential to influence or compromise the professional behavior of the owner or operator of an automated testing station. (2) The automated testing station shall act as test-only facility and shall not provide any services related to repair of vehicles or manufacturing or sale of vehicles or automobile spares. (3) Testing officials of the automated testing station shall maintain strict confidentiality of information regarding test results related to vehicle make and type. (4) The operator of an automated testing station, at all times, shall function in a transparent and impartial manner and shall sign an undertaking related to provisions of sub-rules (1), (2) and (3) as specified in Form 64. 178. Infrastructure requirement. – (1) Any facility to be used for the purposes of testing shall have a minimum per lane area for two-wheeler vehicles or three-wheeler vehicles as five hundred square meters and for Light or Medium or Heavy Motor Vehicle as one thousand five hundred square meters, which includes commensurate space for the administrative block including reception or information centre, waiting area, Information technology server and workstation, washrooms etc. (2) The automated testing station shall have the minimum dimensions for defining test lane, as per the following table, namely: - [Table-A] Sl. (4) Adequate space shall be available for fitment of utilities like transformers, Low Tension or High-Tension panels with safety or protective devices, Gensets, Air Compressor, Uninterrupted Power Source, water coolers, fire protection and firefighting system of adequate capacity and test lane area shall be provided with adequate ventilation and fume extraction system. (5) An automated testing station shall have adequate space for parking and free movement of vehicles brought for testing and necessary cyber security certifications shall be provided for the Information technology Systems for safe access to the VAHAN database as applicable. (6) Testing equipment and Information technology infrastructure shall be as per rule 190. 179. Manpower requirement. – (1) The minimum requirement of manpower shall be as per the following table, namely:- [Table-B] Sl. Information technology 1 (up to 2 Lanes) Master of Computer Application or Bachelor of in charge/ System Engineering or Bachelor of Technology in 2 (up to 4 lanes) Analyst Computer Science or Information technology or Electronics and Communication Engineering with at least three years of experience in Hardware, software and Networking from any recognised organisation or institutions. 3. Data Entry Operator 2 Any Graduation Degree or Diploma in Computer Application with basic computer knowledge. 4. Driver (Light Motor 2 per lane per shift Driving license with minimum five years of Vehicle/Heavy Motor driving experience (Light Motor Vehicle or Vehicle) Heavy Motor Vehicle). 5. Lane in charge / 1 per lane per shift Industrial Training Institute Diploma in Motor Supervisor Mechanics or Diploma in Mechanical or automobile or electrical stream with minimum three years of experience in automobile repair and Maintenance from any recognised organisation or institutions. 6. Lane Operator 2 per lane per shift Industrial Training Institute Diploma in Motor Mechanics or Electrical or Computer stream with minimum two years of experience in automobile repair and maintenance from any recognised organisation or institutions. 7. Maintenance Technician 1 per lane per shift Industrial Training Institute Diploma in Air Conditioning and Refrigeration or Industrial[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 47 Training Institute Electrician or Diploma in Mechanical or Electrical, with minimum two years of experience in electrical Maintenance from any recognised organisation or institutions. (2) The automated testing station shall ensure compliance of all laws for the time being in force, including labour laws as applicable. 180. Validity and renewal of Registration. – (1) A Preliminary Registration Certificate shall be valid for the period of setting up or construction or establishment of the automated testing station, which shall be mutually agreed between the State Government and the owner or operator and specified in the Preliminary Registration Certificate. (2) A Registration Certificate shall be valid for a period of ten years from the date of issuance and its subsequent renewal shall be valid for five years from the date of renewal, as the case maybe. (3) The Preliminary Registration Certificate and Registration Certificate shall not be transferable. (4) Where the Preliminary Registration Certificate or Registration Certificate is lost or destroyed, the holder of such certificate shall intimate the facts to the registering authority which has granted or renewed the certificate and shall apply for a duplicate certificate under sub-rule (5) in Form 65 intimating the reasons thereof. (5) An application for issuance of duplicate Preliminary Registration Certificate or Registration Certificate shall be made in Form 65, along with appropriate fee, as specified in rule 188. (6) The registering authority may issue a duplicate certificate in Form 61 or Form 62, as the case may be, with clearly marked word "DUPLICATE" on top right corner. (7) The duplicate certificate shall be immediately surrendered to the registering authority if the original is traced out or found at a future date. 181. Testing Process and Procedure.– (1) The appointment for fitness test at any automated testing station shall be booked electronically, through the electronic portal, set up by the Central Government within six months from the date of notification of the Central Motor Vehicles (Twenty First Amendment) Rules, 2021, on depositing the fee as specified in rule 81, electronically or such other manner as may be laid down by the Central Government. (2) Until the electronic portal referred to in sub-rule(I) is developed, the bookings for fitness tests shall be done either manually or through the electronic portal of the State or Union territory Governments. (3) The following documents and information shall be uploaded at the time of booking a slot for fitness test at an automated testing station, namely: - (i) Registration Certificate of Vehicle, along with Form 25, wherever applicable; (ii) valid Insurance Certificate; (iii) last valid Permit, wherever applicable; (iv) mobile number and email ID of the registered owner or authorised signatory. (4) The other details related to the vehicle, not limited to the following, shall be fetched automatically from the VAHAN database, namely: - (i) Chassis Number; (ii) Engine number; (iii) Fuel; (iv) Vehicle Class; (v) Vehicle Category; (vi) Make and Model; (vii) Gross Vehicle Weight (GVW); (viii) Month and Year of Manufacture; and (ix) Speed Governor Serial Number, wherever applicable. (5) The list of tests to be conducted along with the reference standards shall be as per rule 189, as applicable from48 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] time to time. (6) The data generation, processing and storage shall be done in a manner so as to ensure that, - (i) the database is stored in a data management software platform to enable easy exchange and analysis of data with other platforms; (ii) all automated test results shall be automatically transmitted to a central server installed in the automated testing station and visual checks data, including photographs, shall also be transferred on the same server; (iii) the fitness criteria for pass or fail shall be automatic and in accordance with rule 189; (iv) (a) display of testing station in a test lane shall not indicate any test result; (b) all test results shall be masked on the test lane with encrypted test data; (c) the test report shall be generated automatically and digitally signed with relevant details, immediately after completion of all tests; (v) the test data and report generated shall be kept in a safe and secured facility and uploaded on the electronic portal; (vi) photographs of vehicle and its Chassis and Engine number shall be captured by Global Positioning System enabled camera and shall be kept in a secured facility and uploaded on the electronic portal along with the tests data and report. (7) The certificate of fitness, if granted, in Form 25 or Form 38, as the case may be, and test report so generated shall be sent to the registered owner or authorised signatory through physical and electronic mode and the test report shall include the following, namely: - (i) station Name and registration number; (ii) date and time of the test; (iii) vehicle details – Registration number, Type, Make and Model; (iv) visual check details; (v) measured and permissible values of functional tests; (vi) date of calibration of each equipment of the automated testing station on which tests are conducted; (vii) list of functional tests or visual checks failed by the vehicle, in case certificate of fitness is not granted. (8) The results shall also be integrated with VAHAN Database. 182. Re-testing Procedure. – (1) The registered owner of the vehicle that fails any or all of the required test(s), as specified in rule 189, shall be given an opportunity to apply for a re-test within thirty days of such result, after getting the defects specified in the test report of the initial inspection, rectified from a suitable workshop. (2) The registered owner or authorised signatory of the vehicle may opt for a re-test after depositing fee, as specified in rule 81 and such vehicle shall be re-tested only for the test(s) which it failed in the initial inspection, as specified in the test report. (3) Subject to rule 183, the vehicle that is not re-tested within the time specified in sub-rule (1) or fails such re-test shall be declared as End of Life Vehicle. (4) Notwithstanding anything contained in this rule, in the event of an order of the Appellate Authority to conduct a partial or complete re–test under sub-rule (2) of rule 183, the same shall be conducted accordingly. 183. Appeal against test results. – (1) Any person aggrieved by the test result shall, within seven days of the date of receipt of such result, submit an appeal to the Appellate Authority in Form 68, through the electronic portal specified by the Central Government in this regard and such an appeal shall be accompanied by the fee as specified in rule 188 and a copy of the test result. (2) The Appellate Authority may order a partial or complete re-test of the vehicle, within fifteen working days of receipt of such appeal. (3) Consequent to the vehicle passing such re-test, the Appellate Authority shall issue a certificate of fitness to such vehicle. (4) The decision of Appellate Authority shall be final and binding.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 49 184. Audit and Assessment. – (1) The performance and functioning of an automated testing station shall be monitored through periodic audits and Assessment, at such intervals as specified in sub-rule (3). (2) The registering authority shall appoint National Accreditation Board for Testing and Calibration Laboratory accredited agency or any other agency notified by the Central Government for conducting such audits and assessments. (3) The audit and assessment of an automated testing station shall be conducted every six months and the cost of such audit and assessment shall be borne by the operator of such station. (4) The audit and assessment of Automated Testing Stations shall cover the following aspects, namely: - (i) test equipment completeness; (ii) equipment calibration at the required frequency at least once a year or as per manufacturer‘s recommendation, whichever is earlier; (iii) testing procedures as specified under this chapter; (iv) calibration process of machinery; (v) manpower as per specified qualification under this chapter; (vi) sample check of at least three vehicles from each lane; (vii) data integrity; and (viii) functioning of all the Closed-Circuit Televisions installed in the station. (5) The registering authority, under exceptional circumstances, which shall be adequately recorded, may also conduct surprise audits and assessments of an automated testing station and the cost of such audit and assessment shall be borne by the operator. (6) The officials of the automated testing station shall be responsible for enabling and cooperating with the inspection at any point of time during office hours. (7) The audit and assessment report, including surprise audit and assessment, as specified in Form 67, along with the photographic evidence, shall be uploaded on the electronic portal specified by the Central Government in this regard. (8) (i) Where any discrepancy pointed out during the audit and assessment, the same shall be rectified by the operator within ten working days from the date of issuance of the audit and assessment report. (ii) The rectification report shall be submitted through the electronic portal specified by the Central Government in this regard to the audit and assessment agency for approval and registering authority for information. (iii) The Audit and Assessment agency, if it so desires, may undertake re-audit and re-assessment for validation and approval. 185. Power of registering authority to suspend or cancel the Registration Certificate or forfeit security deposit. – After giving the holder of a Registration Certificate an opportunity of being heard, if the registering authority is satisfied that he has, - (i) failed to comply with the requirements as laid down in rules 176 to 179; or (ii) failed to observe correct standards of testing, as noticed at the time of audit and assessment; or (iii) failed to conduct timely audit and assessment; or (iv) Involved in any malpractice, it may, by order in writing to, – (a) suspend the Registration Certificate for a specified period; or (b) cancel the Registration Certificate and order forfeiture of the security deposit and bank guarantee furnished by the automated testing station. 186. Appeal. – Any person aggrieved by an order of the registering authority under sub- rule (9) of rule 175 or rule 185, may, within thirty days of the receipt of the order, appeal to any officer above the rank of registering authority, as appointed by the State or Union territory Government. 187. Procedure for appeal. – (1) An appeal under rule 186 shall be submitted in the form of a memorandum, setting forth the grounds of objections to the order of the registering authority.50 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) The appeal shall be submitted along with the requisite fee as specified in rule 188. Equipment Specification for Automated Testing Station. - (1) The equipment used at an automated testing station shall be capable of measuring maximum safe axle weight as notified under section 58 of the Act. (2) The equipment shall be able to test all categories of vehicle under fitness regime. (3) The software of the equipment shall allow modification in the inspection system as required by the registering authority. (4) All equipment shall be able to operate in the following environmental conditions, namely: - (i) temperature range 0°C to 55°C; (ii) humidity up to 95%; (iii) dust: Typical Indian testing condition.
