CEA-PS- 11-23(20)/1/2018-PSPA-I Division-Part (1)/84-85 I/26209/2023 dated 10.02.2023 के द्वारा “खािडा आर.ई. पाकण में खािडा पूललग स्ट्टेिन -3 (केपीएस 3) की स्ट्थापना “ के अंतगतण आन े िाली जिरोपरर रांसजमिन लाइनों के जलए जिद्युत अजधजनयम की धारा 68(1) के अंतगणत पूिण अनुमोदन प्रदान दकया था। मेससण पािरजिड केपीएस3 रांसजमिन जलजमटेड न े स्ट्थानीय समाचार पत्रों द टाइम्स ऑफ़ इंजडया (अंिेजी म)ें ददनांक 07.07.2023, राजस्ट्तान पजत्रका (लहदी म)ें ददनांक 07.07.2023, गुजरात समाचार (गुजरती म)ें ददनांक 07.07.2023 और भारत के साप्ताजहक राजपत्र ददनांक 05.08.2023 म ें रांसजमिन योजना के जलए प्रस्ट्ताजित रांसजमिन मागण पर प्रकािन की तारीख स े 2 महीने के भीतर आम जनता की रटप्पजणयों / अभ्यािेदन की मांग करते हुए नोरटस प्रकाजित दकया था । इसके पिात, मेससण पािरजिड केपीएस3 रांसजमिन जलजमटेड न े 22.11.2023 ददनांदकत एक हलफनामा प्रस्ट्तुत दकया, जजसम ें घोषणा की गई ह ै दक भारत सरकार के आजधकाररक राजपत्र एि ं स्ट्थानीय समाचार पत्रों में प्रकािन की तारीख स े 2 महीने के भीतर कोई रटप्पणी / अभ्यािेदन प्राप्त नहीं हुआ था। 7688 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और अब आिेदक न े जिद्युत अजधजनयम, 2003 की धारा 164 के अंतगतण “खािडा आर.ई. पाकण म ें खािडा पूललग स्ट्टेिन -3 (केपीएस 3) की स्ट्थापना ” के तहत रांसजमिन लाइन जबछाने के जलए उसे िे सभी िजियां प्रदान करने का अनुरोध दकया ह,ै जो भारतीय टेलीिाफ अजधजनयम, 1885 के तहत टेलीिाफ के प्रयोजन के जलए सरकार द्वारा स्ट्थाजपत अथिा अनुरजित दकय े गए टेलीिाफ लाइन एि ं खम्भ े या इस प्रकार की स्ट्थापना और अनुरिण दकये जाने के जलए, टेलीिाफ प्राजधकरण को प्राप्त ह।ैं योजना के अंतगतण जनम्नजलजखत जिरोपरर रांसजमिन लाइन ह:ैं  केपीएस3 - केपीएस2 765 के.िी. डी/सी लाईन उपरोि योजना के अंतगणत जिरोपरर रांसजमिन लाइन गुजरात प्रदेि के जनमन् ांदकत गााँिों,कस्ट्बों और िहरों स े होकर, उन पर स,े उनके आसपास स े और बीच स े होकर गुज़रेगी। गािाँ ों के नाम: तहसील जजला मोटा रण, सिेिण रजहत भूजम (कोई गांि नहीं), आर.ई. पाकण के जलए आिंरटत ित्रे भुज कच्छ अब, सािधानीपूिणक जिचार करन े के पिात, जिद्युत मंत्रालय, भारत सरकार, मेससण पािरजिड केपीएस3 रांसजमिन जलजमटेड को उपरोि जिरोपरर रांसजमिन लाइन को लगाने के जलए ि े सभी िजियां जनम्नजलजखत जनबंधनों एिं ितों के साथ प्रदान करता ह,ै जो भारतीय टेलीिाफ अजधजनयम, 1885 के तहत टेलीिाफ के प्रयोजन के जलए सरकार द्वारा स्ट्थाजपत अथिा अनुरजित दकय े गए टेलीिाफ लाइन एि ं खम्भ े या इस प्रकार की स्ट्थापना और अनुरिण दकय े जाने के जलए, टेलीिाफ प्राजधकरण को प्राप्त ह-ैं i. यह अनुमोदन 25 िषों के जलए प्रदान दकया जाता ह।ै ii. आिेदक को प्रस्ट्ताजित लाइन की स्ट्थापना स े पूिण संबंजधत प्राजधकरणों अथाणत ् स्ट्थानीय जनकायों, रेलि,े राष्ट्रीय राजमाग,ण राज्य राजमाग ण आदद की सहमजत प्राप्त करनी होगी। iii. आिेदक को जिद्युत अजधजनयम, 2003 के तहत समुजचत आयोग के द्वारा तैयार दकए गए रांसजमिन, ओ एंड एम, ओपन एक्सेस आदद के जिजनयमों/संजहताओं का पालन करना होगा। iv. आिेदक केंद्र सरकार के जिद्युत जनरीिक/मुख्य जिद्युत जनरीिक के अनुमोदन के पिात ही लाइन का प्रचालन करेगा। v. यह अनुमोदन आिेदक द्वारा जिद्युत अजधजनयम, 2003 के प्रािधानों और उसके तहत बनाए गए जनयमों की अपेिाओं का अनपु ालन दकए जाने के अध्यधीन ह।ै vi. मेससण पािरजिड केपीएस3 रांसजमिन जलजमटेड को जिद्युत जनरीिण के समय जिमानन एि ं रिा प्राजधकरणों इत्यादद, स े अपेजित अनुमजत को प्राप्त करन े के बाद, इस े केंद्रीय जिद्युत प्राजधकरण को जिद्युत जनरीिण के समय प्रस्ट्तुत करना होगा। vii. यदद उपरोि ओिरहडे लाइनों का मागण (या उपरोि ओिरहडे लाइन के माग ण का कुछ भाग) मानजचत्र में जचजहहत िेट इंजडयन बस्ट्टड ण (जीआईबी) संभाजित िेत्र (या प्राथजमकता िेत्र) में आता ह ै जो माननीय उच्चतम हयायालय के िेट इंजडयन बस्ट्टड ण (जीआईबी) मामल े के संबंध म ें 2019 की याजचका संख्या 838, आदेि ददनांदकत 19.04.2021 का जहस्ट्सा ह ै | आिेदक को उपरोि ओिरहडे रांसजमिन लाइन के भूजमगत होने के संबंध एिं / या बडण डायिटणर लगाने के जलये , जैसा भी मामला हो , माननीय उच्चतम हयायालय के आदिे ददनांक 19.04.2021 के जनदेिों का और माननीय उच्चतम हयायालय द्वारा गरित तकनीकी सजमजत के जनदेिों का पालन करना ह।ै [फ़ा. स.ं 25-16/35/2023-पीजी] एम. िी. एन. िरा प्रसाद, अिर सजचि (पीजी) MINISTRY OF POWER ORDER New Delhi, the 11th December, 2023 S.O. 5295(E).—Whereas POWERGRID KPS3 Transmission Limited (a 100% wholly owned subsidiary of Power Grid Corporation of India Ltd.) the applicant with its registered office at B-9, Qutab Institutional Area, Katwaria Sarai, New Delhi, South Delhi, Delhi, India-110016, has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line under “Establishment of Khavda Pooling Station-3 (KPS3) in Khavda RE Park”.[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 3 And whereas, Central Electricity Authority (CEA), Ministry of Power, Government of India vide its letter CEA-PS-11-23(20)/1/2018-PSPA-I Division-Part(1)/84-85 I/26209/2023 dated 10.02.2023 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead line covered under “Establishment of Khavda Pooling Station-3 (KPS3) in Khavda RE Park”. M/s POWERGRID KPS3 Transmission Limited had published notice for transmission scheme in local newspapers The Times of India (in English) dated 07.07.2023, Rajasthan Patrika (in Hindi) dated 07.07.2023, Gujarat Samachar (in Gujrati) dated 07.07.2023 and in Weekly Gazette of India dated 05.08.2023 for the general public to make observations/representations on the proposed transmission route within 2 Months from the date of publication. Subsequently, M/s POWERGRID KPS3 Transmission Limited has submitted an affidavit dated 22.11.2023 declaring that no observation/representation was received within 2 Months from the date of Publication in the official gazette of Government of India. And now the applicant has requested to confer upon him, all the powers under Section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of transmission line under “Establishment of Khavda Pooling Station-3 (KPS3) in Khavda RE Park”. The following overhead line is covered under this scheme:  KPS3- KPS2 765 kV D/C line. The transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and cities of Gujarat: Name of Villages Tehsil District Mota Rann, Unsurveyed paiki land (No villages), Area allocated for RE parks Bhuj Kutch Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s POWERGRID KPS3 Transmission Limited for laying above overhead line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned line, namely: i. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line. iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003. iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s POWERGRID KPS3 Transmission Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above overhead line ) falls in the Great Indian Bustard (GIB) potential zone (or priority zone) marked in the map which is part of the order of the Hon’ble Supreme Court order dated 19.04.2021, in the petition No.838 of 2019 regarding Great Indian Bustard (GIB) case, the applicant has to comply with the directions of the Hon’ble Supreme Court, with regard to undergrounding of the above overhead transmission line and / or fixing of bird diverters, as the case may be as per the Hon’ble Supreme Court Order dated 19.04.2021 and the directions of the technical committee constituted by the Hon’ble Supreme Court in this regard.
