18-जून-2024 के अंतगसत रासं जमिन स्ट्कीम ‘‘गुजरात के निीनाल (मुंद्रा) क्षत्रे म ें जबजली की जनकासी के जलए नेटिकस
जिस्ट्तार योजना” म ें िाजमल ओिरहडे रांसजमिन लाइन जबछाने के जलए जिद्युत अजधजनयम, 2003 की धारा 68(1) के
अंतगसत पूि सअनुमोदन प्रदान दकया था।
मेसस स निीनाल रांसजमिन जलजमटेड ने प्रस्ट्ताजित रांसजमिन मागस के बारे में स्ट्थानीय अखबारों, दद इंजडयन
एक्सप्रेस (अंग्रेजी म)ें ददनादं कत 17 अक्टूबर 2024, राजस्ट्थान पजत्रका (जहन्दी म)ें ददनादं कत 17 अक्टूबर 2024 और कच्छ
जमत्र (गुजराती म)ें ददनादं कत 17 अक्टूबर 2024, तथा भारत के साप्ताजहक राजपत्र ददनादं कत 09 निंबर 2024 म ें प्रकािन
की तारीख स े दो महीनों के भीतर आम जनता स े अिलोकन/ अभ्यािेदन की मांग करते हुए नोटटस प्रकाजित दकया था।

इसके पिच् ात, मेससस निीनाल रांसजमिन जलजमटेड, ने ददनादं कत 16 जनिरी 2025 को एक हलफनामा प्रस्ट्ततु दकया,
जजसमें घोषणा की गई थी दक भारत के िासकीय राजपत्र म ें सािसजजनक सचू ना के प्रकािन के दो महीनों के भीतर जनता स े
कोई अिलोकन/अभ्यािेदन प्राप्त नहीं हुआ था।
और अब आिेदक ने जिद्युत अजधजनयम, 2003 की धारा 164 के अंतगसत रांसजमिन स्ट्कीम ‘‘गुजरात के निीनाल (मुंद्रा)
क्षत्रे में जबजली की जनकासी के जलए नेटिकस जिस्ट्तार योजना” म ें िाजमल ओिरहडे रांसजमिन लाइन जबछाने के जलए उन्ह ेंिे
सभी िजियां प्रदान करने का अनुरोध दकया ह,ै जो टेलीग्राफ लाइन्स के प्रयोजन के जलए सरकार द्वारा स्ट्थाजपत टेलीग्राफ
लाइन्स और खंबों या उनके रख-रखाि के जलए भारतीय टेलीग्राफ अजधजनयम 1885 के अंतगसत टेजलग्राफ प्राजधकरण के
पास ह।ै

अब, सािधानीपूिकस जिचार करने के पश्चात, जिद्युत मंत्रालय, भारत सरकार, जिद्युत अजधजनयम, 2003 की धारा 164 के
अंतगसत मेसस स निीनाल रांसजमिन जलजमटेड को उपरोि ओिरहडे रांसजमिन लाइन को लगाने के जलए िे सभी िजिया ं
जनम्जलजखत जनबंधनों एि ं ितों के साथ प्रदान करता ह,ै जो टेलीग्राफ के उद्देश्य के जलए सरकार द्वारा स्ट्थाजपत टेलीग्राफ
लाइनों और खंबों या उनके रख-रखाि के जलए भारतीय टेलीग्राफ अजधजनयम, 1885 के अतं गसत टेलीग्राफ प्राजधकरण के
पास ह:ै
i. यह अनुमोदन 25 िषों के जलए प्रदान दकया जाता ह।ै
ii. आिेदक को प्रस्ट्ताजित लाइनों की स्ट्थापना स े पूिस संबंजधत प्राजधकाटरयों अथासत् स्ट्थानीय जनकायों, रेलिे, राष्ट्रीय
राजमाग,स राज्य राजमागस आदद की सहमजत प्राप्त करनी होगी।[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 3
iii. आिेदक को जिद्युत अजधजनयम, 2003 के अंतगसत समजु चत आयोग के द्वारा तैयार दकए गए पारेषण, ओ एडं एम,
ओपन एक्सेस आदद के जिजनयमों/संजहताओं का पालन करना होगा।
iv. आिेदक केंद्र सरकार के जिद्युत जनरीक्षक/मुख्य जिद्युत जनरीक्षक के अनुमोदन के पश्चात ही लाइनों का प्रचालन
करेगा।
v. यह अनुमोदन आिेदक द्वारा जिद्युत अजधजनयम, 2003 के प्रािधानों और उसके अंतगसत बनाए गए जनयमों की
अपेक्षाओं का अनुपालन दकए जाने के अध्यधीन ह।ै
vi. मेससस निीनाल रांसजमिन जलजमटेड को जिद्युत जनरीक्षण के समय जिमानन एि ं रक्षा प्राजधकरणों इत्यादद, स े
अपेजक्षत अनुमजत को प्राप्त करन े के बाद, इस े केंद्रीय जिद्युत प्राजधकरण को जिद्युत जनरीक्षण के समय प्रस्ट्तुत करना
होगा।
vii. अगर उपरोि ओिरहडे लाइनों का मागस (या उपरोि ओिरहडे लाइन के मागस का कुछ जहस्ट्सा) ग्रटे इंजडयन बस्ट्टड स
(जीआईबी) क्षत्रे म ें आता ह,ै तो आिेदक को ग्रेट इंजडयन बस्ट्टड स (जीआईबी) के मामले म ें याजचका स.ं 2019 के नं.
838 म ें माननीय सिोच्च न्यायालय द्वारा ददए गए आदिे ों तथा माननीय सिोच्च न्यायालय द्वारा इस बारे म ें गटठत
टेदिकल/एक्सपटस कमटे ी के जनदिे ों का पालन करना पिेगा।

ORDER
New Delhi, the 19th January, 2026
S.O. 259(E).—Whereas M/s Navinal Transmission Limited, the applicant with its registered office at C-105,
Anand Niketan, New Delhi-110 021, has applied for authorization under Section 164 of the Electricity Act, 2003 for
laying of overhead transmission line under the transmission scheme for “Network Expansion Scheme in Navinal
(Mundra) area of Gujarat for drawal of power in the area”
And whereas, Central Electricity Authority (CEA), Ministry of Power, Government of India vide its File No.
25-17/59/2024-PG dated 18-June-2024 had granted prior approval under section 68(1) of the Electricity Act, 2003 for
laying of overhead transmission line included in the transmission scheme for “Network Expansion Scheme in Navinal
(Mundra) area of Gujarat for drawal of power in the area”.
M/s Navinal Transmission Limited had published notice for transmission scheme in local newspapers The
Indian Express (in English) dated 17-Oct-2024, Rajasthan Patrika (in Hindi) dated 17-Oct-2024 & Kutch Mitra (in
Gujrati) dated 17-Oct-2024 and in Weekly Gazette of India dated 09-Nov-2024 for the general public to make
observations/ representations on the proposed transmission route within two months from the date of publication.
Subsequently, M/s Navinal Transmission Limited has submitted an affidavit dated 16-Jan-25 declaring that no
observation/representation was received within two months from the date of Publication in the official Gazette of
Government of India.
And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity
Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of
telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so
established or maintained for laying of electric lines under the transmission scheme “Network Expansion Scheme in
Navinal (Mundra) area of Gujarat for drawal of power in the area” The following overhead transmission line is
covered under this scheme:
LILO of Bhuj-II-Lakadia 765 kV D/C line at Navinal (Mundra) (GIS) S/s with associated bays at Navinal
(Mundra) (GIS) S/s
The overhead transmission line covered under the above scheme will pass through, over, around and between the

Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act,
2003, confers all the powers to M/s Navinal Transmission Limited for laying above overhead transmission line, which
telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts
for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to
following terms and conditions for installing the above mentioned line, namely:
i. The approval is granted for 25 years.
ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways,
National Highways, State Highways etc. before erection of proposed line.
iii. The Applicant shall have to follow regulations/ codes of the Appropriate Commission regarding
transmission, O&M, open access, etc., framed under the Electricity Act, 2003.
iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of
Central Government.
v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and
the rules made there under by the applicant.
vi. M/s Navinal Transmission Limited shall have to submit the requisite clearances to Central Electricity
Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of
Electrical Inspection.
vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the
Great Indian Bustard (GIB) area, the applicant has to comply with the orders of the Hon’ble Supreme Court
in the petition No.838 of 2019 regarding Great Indian Bustard (GIB) case, and the directions of the
technical/expert committee constituted by the Hon’ble Supreme Court in this regard.
