Authorization under Section 164 of the Electricity Act, 2003 for laying of dedicated overhead transmission line

L.-33004/99 सी.जी.-डी.एल.-अ.-03032025-261444 CG-DxLx-xEG-I0D3H0x3x2x0 25-261444 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 1069] नई ददल्ली, सोमिार, मार् च3, 2025/फाल्ग नु 12, 1946 No. 1069] NEW DELHI, MONDAY, MARCH 3, 2025/PHALGUNA 12, 1946 जिद्यतु मत्रं ालय आदेि नई ददल् ली, 3 मार्,च 2025 का.आ. 1077(अ).—िबदक मसे सच एजपपन एनिी ग्रीन प्राइिेट जलजमटेड, आिेदक ने जिसका रजिस्ट्टडच ऑदिस 309, तीसरी मंजिल, रेक्टेंगल िन, िरे ेटन होटल के पीछे, साकेत, नई ददल्ली, भारत-110017 पर जस्ट्ित ह,ै ने प्रस्ट् ताजित 300 MW हाईजिड पािर प्रोिेक्ट बाडमेर, रािस्ट् िान में प्रस्ट् ताजित रांसजमिन स्ट्कीम सयं ोिकता में िाजमल ओिरहडे रांसजमिन लाइन जबछाने के जलए जिद्युत अजधजनयम, 2003 की धारा 164 के अतं गतच प्राजधकृत करने हते ु आिेदन दकया ह।ै और िबदक, केंद्रीय जिद्युत प्राजधकरण (CEA) जिद्यतु मंत्रालय, भारत सरकार न े अपने फाइल नं. 25-17/65/2024-पीिी ददनांदकत 01 िुलाई, 2024 के अंतगतच प्रस्ट् ताजित 300 MW हाईजिड पािर प्रोिेक्ट बाडमेर, रािस्ट् िान में प्रस्ट् ताजित रांसजमिन स्ट्कीम संयोिकता में िाजमल ओिरहडे रांसजमिन लाइन जबछान े के जलए जिद्युत अजधजनयम, 2003 की धारा 68(1) के अतं गतच पूि चअनुमोदन प्रदान दकया िा। मेससच एजपपन एनिी ग्रीन प्राइिेट जलजमटेड न े प्रस्ट्ताजित रांसजमिन माग च के बारे में स्ट्िानीय अखबारों, द टाइपस ऑि इजण्डया (अग्रं ेिी म)ें ददनांक 26.07.2024 और दैजनक भास्ट्कर (जहन्दी म)ें ददनांक 26.07.2024, तिा भारत के साप्ताजहक रािपत्र ददनांक 24.08.2024 म ें प्रकािन की तारीख स े दो महीनों के भीतर आम िनता स े अिलोकन/प्रजतजनजधत्ि की मांग करते हुए नोटटस प्रकाजित दकया िा। इसके पश् र्ात, मेससच एजपपन एनिी ग्रीन प्राइिेट 1552 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] जलजमटेड, ने ददनांदकत 01.11.2024 को एक हलफनामा प्रस्ट्तुत दकया, जिसमें घोषणा की गई िी दक भारत के िासकीय रािपत्र में सािचिजनक सूर्ना के प्रकािन के दो महीनों के भीतर िनता स ेकोई अिलोकन/ प्रजतजनजधत्ि प्राप्त नहीं हुआ ह।ै और अब आिेदक ने जिद्युत अजधजनयम, 2003 की धारा 164 के अंतगचत मेससच एजपपन एनिी ग्रीन प्राइिेट जलजमटेड के जलए ओिरहडे रासं जमिन लाइन जबछान े के जलए उन्ह ें ि े सभी िजियां प्रदान करने का अनरु ोध दकया है, िो टेलीग्राफ लाइन्स के प्रयोिन के जलए सरकार द्वारा स्ट्िाजपत टेलीग्राफ लाइन्स और खंबों या उनके रख-रखाि के जलए भारतीय टेलीग्राफ अजधजनयम 1885 के अतं गतच टेजलग्राफ प्राजधकरण के पास ह।ै इस स्ट्कीम के अंतगचत जनम्नजलजखत ओिरहडे लाइन्स िाजमल ह:ैं • एएमपी एनिी ग्रीन आठ, दस और तीन हाइजिड पािर प्रोिेक्् स का कॉमन पूललगं स्ट् टेिन गॉि बलाई , जिला बाडमेर, रािस्ट्ि ान - फतेहगढ़ र्तुिच (आईएसटीएस) पूजलग स्ट्ट ेिन (सेक -I) 220 केिी एस/सी लाइन। इस योिना के अंतगतच ओिरहडे पारेषण लाइनें रािस्ट्िान राज्य के जनम्नांदकत गााँिों, कस्ट्बों और िहरों से होकर, उन पर स,े उनके आसपास से और बीर् से होकर गुज़रेगी - गािाँ ों तहसील जिला राज्य गूंगा, पूिराि लसंह की ढाणी, जबसु काला, पूषद, सीताराम की िेओ बाडमेर रािस्ट्िान ढाणी अब, सािधानीपूिचक जिर्ार करने के पश्चात, जिद्युत मंत्रालय, भारत सरकार, जिद य ुत अजधजनयम, 2003 की धारा 164 के अंतगचत मेससच एजपपन एनिी ग्रीन प्राइिेट जलजमटेड को उपरोि ओिरहडे रासं जमिन लाइन को लगाने के जलए िे सभी िजियां जनम्नजलजखत जनबंधनों एिं ितों के साि प्रदान करता है, िो टेलीग्राफ के उद्देश्य के जलए सरकार द्वारा स्ट्िाजपत टेलीग्राफ लाइनों और खंबों या उनके रख-रखाि के जलए भारतीय टेलीग्राफ अजधजनयम, 1885 के अंतगचत टेलीग्राफ प्राजधकरण के पास ह ै i. यह अनुमोदन 25 िषों के जलए प्रदान दकया िाता ह।ै ii. आिेदक को प्रस्ट्ताजित लाइनों की स्ट्िापना स े पूिच संबंजधत प्राजधकाटरयों अिाचत स्ट्िानीय जनकायों, रेलिे, राष्ट्रीय रािमागच, राज्य रािमागच आदद की सहमजत प्राप्त करनी होगी। iii. आिेदक को जिद्युत अजधजनयम, 2003 के अंतगचत समुजर्त आयोग के द्वारा तैयार दकए गए पारेषण, ओ एडं एम, ओपन एक्सेस आदद के जिजनयमों/संजहताओं का पालन करना होगा। iv. आिेदक केंद्र सरकार के जिद्युत जनरीक्षक/मख्ु य जिद्युत जनरीक्षक के अनुमोदन के पश्चात ही लाइनों का प्रर्ालन करेगा। v. यह अनुमोदन आिेदक द्वारा जिद्युत अजधजनयम, 2003 के प्रािधानों और उसके अंतगचत बनाए गए जनयमों की अपेक्षाओं का अनुपालन दकए िाने के अध्यधीन ह।ै vi. मेससच एजपपन एनिी ग्रीन प्राइिेट जलजमटेड को जिद्युत जनरीक्षण के समय जिमानन एि ं रक्षा प्राजधकरणों इत्यादद, से अपेजक्षत अनुमजत को प्राप्त करने के बाद, इस े केंद्रीय जिद्युत प्राजधकरण को जिद्युत जनरीक्षण के समय प्रस्ट्ततु करना होगा। vii. अगर उपरोि ओिरहडे लाइनों का मागच (या उपरोि ओिरहडे लाइन के माग च का कुछ जहस्ट्सा) ग्रेट इंजडयन बस्ट्टड च (िीआईबी) क्षेत्र म ें आता ह,ै तो आिेदक को ग्रेट इंजडयन बस्ट्टड च (िीआईबी) के मामले म ें याजर्का सं. 2019 के न.ं[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 838 में माननीय सिोच्च न्यायालय द्वारा ददए गए आदेिों तिा माननीय सिोच्च न्यायालय द्वारा इस बारे में गटठत टेदिकल/एक्सपटच कमेटी के जनदिे ों का पालन करना पड़ेगा I [फा. स.ं 25-16/14/2025-पीिी] एम.िी.एन. िरा प्रसाद, अिर सजर्ि (पीिी) MINISTRY OF POWER ORDER New Delhi, the 3rd March, 2025 S.O. 1077(E).—Whereas M/s AMPIN Energy Green Private Limited, the applicant with its registered office at 309, 3rd Floor, Rectangle One, Behind Sheraton Hotel, Saket, New Delhi, India- 110017, has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of dedicated overhead transmission line included in the transmission scheme for providing connectivity to M/s AMPIN Energy Green Private Limited for its proposed 300 MW Hybrid Power Project in Barmer, Rajasthan. And whereas, Central Electricity Authority (CEA), Ministry of Power, Government of India vide its File No. 25-17/65/2024-PG dated 01st July, 2024 had granted prior approval under section 68(1) of the Electricity Act, 2003 for laying of dedicated overhead transmission line included in the transmission scheme for providing connectivity to M/s AMPIN Energy Green Private Limited for its proposed 300 MW Hybrid Power Project in Barmer, Rajasthan. M/s AMPIN Energy Green Private Limited had published notice for transmission scheme in local newspapers The Times of India (in English) dated 26.07.2024 & Dainik Bhaskar (in Hindi) dated 26.07.2024, and in Weekly Gazette of India dated 24.08.2024 for the general public to make observations/ representations on the proposed transmission route within two months from the date of publication. Subsequently, M/s AMPIN Energy Green Private Limited has submitted an affidavit dated 01.11.2024 declaring that no observation/ representation was received within two months from the date of Publication in the official Gazette of Government of India. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of dedicated overhead transmission line for providing connectivity to M/s AMPIN Energy Green Private Limited for its proposed 300 MW Hybrid Power Project in Barmer, Rajasthan. The following overhead transmission line is covered under this scheme: • Common Pooling station of AMP Energy Green Eight, Ten & Three Hybrid Power Projects in village Balai, District Barmer, Rajasthan – Fatehgarh IV (ISTS) Pooling Station (Sec-I) 220kV S/c line The overhead transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and cities of Rajasthan: Villages Tehsil District State Gunga, Pujraj Singh Ki Dhani, Bisu Kala, Pushad, Sita Sheo Barmer Rajasthan Ram Ki Dhani Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s AMPIN Energy Green Private Limited for laying above overhead transmission line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above-mentioned line, namely: I. The approval is granted for 25 years. II. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line. III. The Applicant shall have to follow regulations/ codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under the Electricity Act, 2003.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] IV. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. V. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. VI. M/s AMPIN Energy Green Private Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. VII. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the Great Indian Bustard (GIB) area, the applicant has to comply with the orders of the Hon’ble Supreme Court in the petition No.838 of 2019 regarding Great Indian Bustard (GIB) case, and the directions of the technical/expert committee constituted by the Hon’ble Supreme Court in this regard.
