2023 का.आ. 5133(अ).— िबदक मैससस अल्रा एक्सगी पािर प्राईिेट जलजमटेड, जिसका पंिीकृत कायासलय जितीय तल, स्ट्वायर िन मॉल, साकेत जबिनेस जडजस्ट्रक्ट, कोटस चौक, पुष्प जिहार नई ददल्ली-110017, भारत में जस्ट्ित ह,ै ने “िैसलमेर, रािस्ट्िान में अपन े 380 मेगािाट सोलर पािर पलांट के जलए मैससस अल्रा एक्सगी पािर प्राईिेट जलजमटेड को कनेजक्टजिटी प्रदान करने हते ु रांसजमिन प्रणाली” के तहत ओिरहडे रांसजमिन लाइन जबछाने के जलए जिद्युत अजधजनयम, 2003 की धारा 164 के अंतगसत प्राजधकृत करने हते ु आिेदन दकया ह।ै और िबदक, जिद्युत मंत्रालय, भारत सरकार ने अपन े पत्र सं. 25-17/3/2023-PG ददनांदकत 26.06.2023 के िारा “िैसलमेर, रािस्ट्िान में अपने 380 मेगािाट सोलर पािर पलांट के जलए मैससस अल्रा एक्सगी पािर प्राईिेट जलजमटेड को कनेजक्टजिटी प्रदान करन े हते ु रांसजमिन प्रणाली” के अतं गसत आन े िाली ओिरहडे रांसजमिन लाइन के जलए जिद्युत अजधजनयम की धारा 68(1) के अंतगतस पूिस अनुमोदन प्रदान दकया िा। मैससस अल्रा एक्सगी पािर प्राईिेट जलजमटेड न े स्ट्िानीय समाचार पत्रों द टाइम्स ऑफ इंजडया (अंग्रेिी में) ददनांक 05.07.2023, राष्ट्रदतू (हहदं ी में) ददनांक 05.07.2023, दैजनक भास्ट्कर (हहदं ी में) ददनांक 05.07.2023 और भारत के साप्ताजहक रािपत्र ददनांक 29.07.2023 म ें रांसजमिन योिना के जलए प्रस्ट्ताजित रांसजमिन मागस पर प्रकािन की तारीख 7448 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] से 2 महीने के भीतर आम िनता की टटपपजणयों / अभ्यािेदन की मांग करत े हुए नोटटस प्रकाजित दकया िा । इसके पश्चात, मैससस अल्रा एक्सगी पािर प्राईिेट जलजमटेड ने 12.10.2023 ददनांदकत एक हलफनामा प्रस्ट्तुत दकया, जिसमें घोषणा की गई ह ै दक भारत सरकार के आजधकाटरक रािपत्र एिं स्ट्िानीय समाचार पत्रों म ें प्रकािन की तारीख से 2 महीने के भीतर कोई टटपपणी / अभ्यािेदन प्राप्त नहीं हुआ िा। और अब आिेदक न े जिद्युत अजधजनयम, 2003 की धारा 164 के अतं गतस “िैसलमेर, रािस्ट्िान म ें अपने 380 मेगािाट सोलर पािर पलांट के जलए मैससस अल्रा एक्सगी पािर प्राईिेट जलजमटेड को कनेजक्टजिटी प्रदान करन े हते ु रांसजमिन प्रणाली” के तहत रासं जमिन लाइन जबछाने के जलए उसे िे सभी िजियां प्रदान करने का अनरु ोध दकया है, िो भारतीय टेलीग्राफ अजधजनयम, 1885 के तहत टेलीग्राफ के प्रयोिन के जलए सरकार िारा स्ट्िाजपत अििा अनरु जित दकय े गए टेलीग्राफ लाइन एि ं खम्भे या इस प्रकार की स्ट्िापना और अनुरिण दकये िान े के जलए, टेलीग्राफ प्राजधकरण को प्राप्त ह।ैं योिना के अतं गतस जनम्नजलजखत ओिरहडे रांसजमिन लाइन ह:ैं o मैससस अल्रा एक्सगी पािर प्राईिेट जलजमटेड (नीम्बा गांि, तहसील फतेहगढ, जिला-िैसलमेर, रािस्ट्िान म ें िनरेिन जस्ट्िचयाडस) स े फतेहगढ-III पीएस (न्य ू)(आईएसटीएस सबस्ट्टेिन) तक 220 के.िी एस.सी लाइन । उपरोि योिना के अंतगसत ओिरहडे रांसजमिन लाइन रािस्ट्िान राज्य के जनमन् ांदकत गााँिों, कस्ट्बों और िहरों स े होकर, उन पर स,े उनके आसपास से और बीच से होकर गुज़रेगी। गॉिों के नाम तालकु जिला नीम्बा, मण्डई, संिीत फतेहगढ िैसलमेर अब, सािधानीपूिसक जिचार करने के पश्चात, जिद्युत मंत्रालय, भारत सरकार, मैससस अल्रा एक्सगी पािर प्राईिेट जलजमटेड को उपरोि ओिरहडे रांसजमिन लाइन को लगाने के जलए िे सभी िजियां जनम्नजलजखत जनबंधनों एिं ितों के साि प्रदान करता ह,ै िो भारतीय टेलीग्राफ अजधजनयम, 1885 के तहत टेलीग्राफ के प्रयोिन के जलए सरकार िारा स्ट्िाजपत अििा अनुरजित दकय े गए टेलीग्राफ लाइन एिं खम्भ े या इस प्रकार की स्ट्िापना और अनरु िण दकय े िाने के जलए, टेलीग्राफ प्राजधकरण को प्राप्त ह-ैं i. यह अनुमोदन 25 िषों के जलए प्रदान दकया िाता ह।ै ii. आिेदक को प्रस्ट्ताजित लाइन की स्ट्िापना स े पूि स संबंजधत प्राजधकरणों अिासत ् स्ट्िानीय जनकायों, रेलि,े राष्ट्रीय रािमाग,स राज्य रािमागस आदद की सहमजत प्राप्त करनी होगी। iii. आिेदक को जिद्युत अजधजनयम, 2003 के तहत समुजचत आयोग के िारा तैयार दकए गए रांसजमिन, ओ एडं एम, ओपन एक्सेस आदद के जिजनयमों/संजहताओं का पालन करना होगा। iv. आिेदक केंद्र सरकार के जिद्युत जनरीिक/मुख्य जिद्युत जनरीिक के अनुमोदन के पश्चात ही लाइन का प्रचालन करेगा। v. यह अनुमोदन आिेदक िारा जिद्युत अजधजनयम, 2003 के प्रािधानों और उसके तहत बनाए गए जनयमों की अपेिाओं का अनुपालन दकए िाने के अध्यधीन ह।ै vi. मैससस अल्रा एक्सगी पािर प्राईिेट जलजमटेड को जिद्युत जनरीिण के समय जिमानन एि ं रिा प्राजधकरणों इत्यादद, से अपेजित अनुमजत को प्राप्त करने के बाद, इसे केंद्रीय जिद्युत प्राजधकरण को जिद्युत जनरीिण के समय प्रस्ट्ततु करना होगा। vii. यदद उपरोि ओिरहडे लाइनों का मागस (या उपरोि ओिरहडे लाइन के मागस का कुछ भाग) मानजचत्र में जचजननत िीआईबी संभाजित िेत्र (या प्रािजमकता िेत्र) में आता ह ै िो माननीय सुप्रीम कोटस के िीआईबी मामले के संबंध म ें 2019 की याजचका संख्या 838, आदेि ददनांक 19.04.2021 का जहस्ट्सा ह ै | आिेदक को उपरोि ओिरहडे[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 रांसजमिन के भूजमगत होन े के संबंध या बडस डायिटसर लगान े के जलये , िैसा भी मामला हो , माननीय उच्चतम न्यायालय के आदिे ददनांक 19.04.2021 के जनदेिों का और माननीय उच्चतम न्यायालय िारा गटित तकनीकी सजमजत के जनदेिों का पालन करना ह ै। [फा. सं. 25-16/31/2023-पीिी] एम.िी.एन. िरा प्रसाद, अिर सजचि (पीिी) MINISTRY OF POWER ORDER New Delhi, the 1st December, 2023 S.O. 5133(E).— Whereas M/s Altra Xergi Power Private Limited, the applicant, with its registered office at 2nd Floor, Square One Mall, Saket Business District, Court Chowk, Pushp Vihar, New Delhi – 110017, India, has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line under “Transmission system for providing connectivity to M/s Altra Xergi Power Private Limited for its 380 MW Solar Power Plant in Jaisalmer, Rajasthan”. And whereas, Ministry of Power, Government of India vide its letter 25-17/3/2023-PG dated 26.06.2023 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead line covered under “Transmission system for providing connectivity to M/s Altra Xergi Power Private Limited for its 380 MW Solar Power Plant in Jaisalmer, Rajasthan”. M/s Altra Xergi Power Private Limited had published notice for transmission scheme in local newspapers The Times of India (in English) dated 05.07.2023, Rashtradoot (in Hindi) dated 05.07.2023, Dainik Bhaskar (in Hindi) dated 05.07.2023 and in Weekly Gazette of India dated 29.07.2023 for the general public to make observations/representations on the proposed transmission route within 2 Months from the date of publication. Subsequently, M/s Altra Xergi Power Private Limited has submitted an affidavit dated 12.10.2023 declaring that no observation/representation was received within 2 Months from the date of publication in the official gazette of Government of India. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of electric line under “Transmission system for providing connectivity to M/s Altra Xergi Power Private Limited for its 380 MW Solar Power Plant in Jaisalmer, Rajasthan”. The following overhead line is covered under this scheme: o Altra Xergi Power Private Limited (Generation Switchyard in Village Neemba, Tehsil Fatehgarh, Jaisalmer District, Rajasthan) – Fatehgarh-III PS (new) (ISTS substation) 220 kV S/c line. The transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and cities of Rajasthan: Sl. Name of Villages Taluka District No. 1. Neemba, Mandai, Sanjeet Fatehgarh Jaisalmer Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s Altra Xergi Power Private Limited for laying above overhead line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above-mentioned line, namely: i. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line. iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s Altra Xergi Power Private Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the Great Indian Bustard (GIB) potential area (or priority area) marked in the map which is part of the order of the Hon’ble Supreme Court order dated 19.04.2021, in the petition No.838 of 2019 regarding GIB case, the applicant has to comply with the directions of the Hon’ble Supreme Court, with regard to undergrounding of the above overhead transmission line and/or fixing of bird diverters, as the case may be as per the Hon’ble Supreme Court Order dated 19.04.2021 and the directions of the technical committee constituted by the Hon’ble Supreme Court in this regard.
