L.-33004/99 सी.जी.-डी.एल.-अ.-08082024-256190 CG-DxLx-xEG-I0D8H0x8x2x0 24-256190 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 3046] नई ददल्ली, बुधिार, अगस्ट्त 7, 2024/ श्रािण 16, 1946 No. 3046] NEW DELHI, WEDNESDAY, AUGUST 7, 2024/ SHRAVANA 16, 1946 जिद्यतु मत्रं ालय आदेि नई ददल्ली, 6 अगस्ट्त, 2024 का.आ. 3195(अ).—िबदक मेससस एसिेिीएन जलजमटेड, जिसका पंिीकृत कायासलय िजि सदन कॉरपोरेट मुख्यालय, िनान जिमला-171006 जिमाचल प्रदिे , भारत म ें जस्ट्ित ि,ै न े “एसिेिीएन जलजमटेड की 66 मगे ािाट की धौलाजसद्ध िलजिद्युत पररयोिना स े जबिली की जनकासी के जलए रांसजमिन प्रणाली । “ के तित ओिरिडे रांसजमिन लाइन जबछाने के जलए जिद्युत अजधजनयम, 2003 की धारा 164 के अतं गतस प्राजधकृत करने िते ु आिेदन दकया ि।ै और िबदक, केंद्रीय जिद्युत प्राजधकरण (के.जि.प्रा.), जिद्युत मत्रं ालय, भारत सरकार न े अपन े पत्र स.ं CEA-PS- 11-21(25)/1/2018-PSPA-I ददनांदकत 19.01.2022 के द्वारा “एसिेिीएन जलजमटेड की 66 मगे ािाट की धौलाजसद्ध िलजिद्युत पररयोिना स े जबिली की जनकासी के जलए रांसजमिन प्रणाली । “के अतं गतस आने िाली ओिरिडे रांसजमिन लाइनों के जलए जिद्युत अजधजनयम की धारा 68(1) के अंतगसत पूिस अनुमोदन प्रदान दकया िा। मेसस स एसिेिीएन जलजमटेड ने स्ट्िानीय समाचार पत्रों टाइम्स ऑफ़ इंजडया (अग्रं ेिी म)ें ददनांक 10.06.2023, जिमाचल दस्ट्तक (हिदं ी म)ें ददनांक 10.06.2023 और भारत के साप्ताजिक रािपत्र ददनाकं 13.01.2024 म ें रांसजमिन योिना के जलए प्रस्ट्ताजित रांसजमिन माग स पर प्रकािन की तारीख स े 2 मिीने के भीतर आम िनता की रटप्पजणयों / अभ्यािेदन की मागं करत े हुए नोरटस प्रकाजित दकया िा । इसके पश्चात, मेससस एसिेिीएन जलजमटेड न े 21.03.2024 4971 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ददनांदकत एक िलफनामा प्रस्ट्ततु दकया, जिसम ें घोषणा की गई ि ै दक भारत सरकार के आजधकाररक रािपत्र एि ं स्ट्िानीय समाचार पत्रों म ें प्रकािन की तारीख स े 2 मिीन े के भीतर िनता स े कोई आपजि प्राप्त निी की गई ि।ै और अब आिेदक न े जिद्युत अजधजनयम, 2003 की धारा 164 के अतं गतस “एसिेिीएन जलजमटेड की 66 मगे ािाट की धौलाजसद्ध िलजिद्युत पररयोिना स े जबिली की जनकासी के जलए रांसजमिन प्रणाली ।” के तित रांसजमिन लाइन जबछाने के जलए उसे िे सभी िजियां प्रदान करने का अनुरोध दकया ि,ै िो भारतीय टेलीग्राफ अजधजनयम, 1885 के तित टेलीग्राफ के प्रयोिन के जलए सरकार द्वारा स्ट्िाजपत अििा अनुरजित दकय े गए टेलीग्राफ लाइन एि ं खम्भ े या इस प्रकार की स्ट्िापना और अनुरिण दकय े िाने के जलए, टेलीग्राफ प्राजधकरण को प्राप्त ि।ैं योिना के अंतगतस जनम्नजलजखत ओिरिडे रांसजमिन लाइन ि:ैं 1. धौलाजसद्ध एचईपी - सुिानपुर (एचपीपीटीसीएल) 220 केिी डी/सी लाइन । उपरोि योिना के अंतगसत ओिरिडे रांसजमिन लाइन रािस्ट्िान के जनम्न ादं कत गााँिों,कस्ट्बों और ििरों स े िोकर, उन पर स,े उनके आसपास स ेऔर बीच स े िोकर गुज़रेगी। क्र. गािाँ के नाम तिसील जिला 1 सलासी, सनोटू, डी.पी.एफ. िीिण नादौन िमीरपुर भोग, करोट, लौंगणी, गािजलयााँ, जमयाणा, भलेठ, रोपा, गरौडू, दाडला, रटक्कर, टीिरा- 2 िमीरपुर िोल कला,ं डोली, टीिरा- सुिानपुर, काछ, िोल, बािडू, पोई, बैरी सुिानपुर बलडी, बरिाला, भरेड, चौंकी, चौंकी-ढोररयां, छरड, डडल, ढखर, डुिक, िरंडी, मझीण कांगड़ा ज्योड, कासड़, कोटू- ढोररयां, मनेरा, मनन,ू कुरी, मरिाना, मैिसी, बलडा, 3 भटािा,ं बुल्ली, दबकेढ, धतेड, जडब, ििर, क्योड़, मझीण, परोंठा, सौली, सब स नाटी, सरोिी, जसयालकड़, तरयामलू, रटिरी, रटपरी 4 मकड़, नलोटी, रच्छािण, सुराणी खुजडयााँ कांगड़ा कुिन ख़ास, डली, भलुंदर, डाडू, भेड़ी जनचली, भेड़ी उपरली, पपरोला, बीड, 5 आलमपरु कांगड़ा िांगल, मलोदन, धार ब्रिमपुरी, मसह्िार, रडाम कलां, गढ, िमूला 6 िेरघ्रटा, चूला, धजनयारा, डुिक कलां, लािड़, डुिक, लाह्डू, उमरी िुरल कांगड़ा अब, सािधानीपूिसक जिचार करने के पश्चात, जिद्युत मंत्रालय, भारत सरकार, मेससस एसििे ीएन जलजमटेड को उपरोि ओिरिडे रांसजमिन लाइन को लगान े के जलए ि े सभी िजिया ं जनम्नजलजखत जनबधं नों एि ं ितों के साि प्रदान करता ि,ै िो भारतीय टेलीग्राफ अजधजनयम, 1885 के तित टेलीग्राफ के प्रयोिन के जलए सरकार द्वारा स्ट्िाजपत अििा अनुरजित दकय े गए टेलीग्राफ लाइन एि ं खम्भ े या इस प्रकार की स्ट्िापना और अनरु िण दकय े िाने के जलए, टेलीग्राफ प्राजधकरण को प्राप्त ि-ैं i. यि अनुमोदन 25 िषों के जलए प्रदान दकया िाता ि।ै ii. आिेदक को प्रस्ट्ताजित लाइन की स्ट्िापना स े पूि स संबंजधत प्राजधकरणों अिासत ् स्ट्िानीय जनकायों, रेलिे, राष्ट्रीय रािमागस, राज्य रािमागस आदद की सिमजत प्राप्त करनी िोगी। iii. आिेदक को जिद्युत अजधजनयम, 2003 के तित समुजचत आयोग के द्वारा तैयार दकए गए रांसजमिन, ओ एडं एम, ओपन एक्सेस आदद के जिजनयमों/संजिताओं का पालन करना िोगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 iv. आिेदक केंद्र सरकार के जिद्युत जनरीिक/मख्ु य जिद्युत जनरीिक के अनुमोदन के पश्चात िी लाइन का प्रचालन करेगा। v. यि अनुमोदन आिेदक द्वारा जिद्युत अजधजनयम, 2003 के प्रािधानों और उसके तित बनाए गए जनयमों की अपेिाओं का अनुपालन दकए िाने के अध्यधीन ि।ै vi. मेसस स एसिेिीएन जलजमटेड को जिद्युत जनरीिण के समय जिमानन एि ं रिा प्राजधकरणों इत्यादद, स े अपेजित अनुमजत को प्राप्त करने के बाद, इस े केंद्रीय जिद्युत प्राजधकरण को जिद्युत जनरीिण के समय प्रस्ट्तुत करना िोगा। vii. यदद उपरोि ओिरिडे लाइन का माग स (या उपरोि ओिरिडे लाइन के माग स का कुछ भाग) ग्रेट इंजडयन बस्ट्टड स (िीआईबी) ित्रे म ें आता ि ै तो आिेदक को ग्रेट इंजडयन बस्ट्टडस (िीआईबी) मामले के संबंध म ें 2019 की याजचका संख्या 838 पर माननीय उच्चतम न्यायालय के आदिे ों का और माननीय उच्चतम न्यायालय द्वारा गरठत तकनीकी/जििेषज्ञ सजमजत के जनदेिों का पालन करना िोगा। [फा. सं. 25-16/31/2024-पीिी] एम.िी.एन. िरा प्रसाद, अिर सजचि (पीिी) MINISTRY OF POWER ORDER New Delhi, the 6th August, 2024 S.O. 3195(E).—Whereas M/s SJVN Limited having its registered address at Shakti Sadan, Corporate Head Quarter, Shanan, Shimla -171006, Himachal Pradesh, India has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line under “Transmission System for evacuation of Power from 66 MW Dhaulasidh Hydro Electric Project of SJVN Limited”. And whereas, Ministry of Power, Government of India vide its letter no. l/19915 /2022 dated 19.01.2022 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead line covered under “Transmission System for evacuation of Power from 66 MW Dhaulasidh Hydro Electric Project of SJVN Limited”. M/s SJVN Limited has published notice for transmission scheme in local newspapers The Times of India (in English) dated 10.06.2023, Himachal Dastak (in Hindi) dated 10.06.2023 and in Weekly Gazette of India dated 13.01.2024 for the general public to make observations/representations on the proposed transmission route within 2 Months from the date of publication. Subsequently, M/s SJVN Limited has submitted an affidavit dated 21.03.2024 declaring that no observation/representation was received within 2 months from the date of Publication in the official gazette of Government of India. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of electric lines under “Transmission System for evacuation of Power from 66 MW Dhaulasidh Hydro Electric Project of SJVN Limited”. The following overhead transmission line is covered under this scheme: 1. Dhaulasidh HEP - Sujanpur (HPPTCL) 220 kV D/C line. The transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and cities of Himachal pradesh: Sr. No. Name of Villages/Towns/Cities Tehsil District 1. Bairghat, Chuhla, Dhaniara, Duhk Kalan, Lahar, Duhk, Lahru, Umri Thural Kangra Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s SJVN Limited for laying above overhead line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned line, namely: i. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line. iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003. iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s SJVN Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the Great Indian Bustard (GIB) zone, the applicant has to comply with the orders of the Hon’ble Supreme Court in the petition No.838 of 2019 regarding Great Indian Bustard (GIB) case, and the directions of the technical/expert committee constituted by the Hon’ble Supreme Court in this regard.
