(1) इन जनर्मों का सजं क्षप्त नाम को बटै री अपजिष्ट प्रबधं न (सिं ोधन) जनर्म, 2024 कहा िाएगा। (2) वे रािपत्र में उनके प्रकािन की तारीख से प्रवृत्त होंगे। 2. बटै री अपजिष्ट प्रबधं न जनर्म, 2022 (जिस ेइसके पश्चात ्उि जनर्म कहा गर्ा ह)ै म,ें जनर्म 10 म:ें - (क) उप-जनर्म (17) के स्ट्र्ान पर, जनम्नजलजखत उप-जनर्म रखा िाएगा, अर्ाता ्: - “(17) केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा जवस्ट्ताररत जनमााता उत्तरिाजर्त्व प्रमाण-पत्रों के जलए उच्चतम और न्र्ूनतम कीमत तर् करेगा िो जनर्म 13 के अधीन केंद्रीर् प्रिषू ण जनर्ंत्रण बोड ा द्वारा र्र्ा जनधााररत जवस्ट्ताररत जनमााता उत्तरिाजर्त्व की पूर्त ा न करने के जलए बाध्र् इकाइर्ों पर लगाए िाने वाले पर्ाावरणीर् प्रजतकर के क्रमिः 100% और 30% के बराबर होगा।"; (ख) उप-जनर्म (17) के पश्चात,् जनम्नजलजखत उप-जनर्म अंतःस्ट्र्ाजपत दकर्ा िाएगा, अर्ाात:् - 1910 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] "(18) पोटाल के माध्र्म से रजिस्ट्रीकृत इकाइर्ों के बीच जवस्ट्ताररत जनमााता उत्तरिाजर्त्व प्रमाणपत्र का जवजनमर् मूल्र् उप-जनर्म (17) में जनर्िष्टा उच्चतम और जनम्नतम कीमतों के बीच होगा।" 3. उि जनर्मों के जनर्म 13 म,ें उप-जनर्म (3) के स्ट्र्ान पर, जनम्नजलजखत उप-जनर्म रखा िाएगा, अर्ाता :्- “(3) केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा इन जनर्मों का अनुपालन न करने की जस्ट्र्जत में, अपजिष्ट बटै री के नवीनीकरण और पुनचाक्रण का काम करन े वाल े उत्पािकों और इकाइर्ों से पर्ाावरणीर् प्रजतकर लगान े और एकत्र करन े के जलए मागाििाक जसद्ांत तैर्ार करेगा और जसफाररि करेगा। केंद्रीर् प्रिषू ण जनर्ंत्रण बोड ा जनर्म 15 के अधीन गरित कार्ाान्वर्न सजमजत से परामि ा कर सकता ह ै । अनिु ंजसत मागाििाक जसद्ांत सहमजत के जलए पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को प्रस्ट्तुत दकए िाएंगे। 4. उि जनर्मों की अनसु चू ी-II म,ें - (क) खडं (vi) और (vii) म,ें सारणी म,ें स्ट्तंभ (5) के अधीन प्रजवजष्टर्ों में, “तर्ाजप, अगले अनपु ालन चक्र के जलए िस वषा के चक्र के िौरान प्रजत वष ा बािार में रखी गई बैटरी की औसत मात्रा का 60% तक आगे बढार्ा िा सकता ह।ै ” िोनों स्ट्र्ानों पर आने वाल े िब्िों और अंकों के स्ट्र्ान “तर्ाजप, लागू अनुपालन चक्र के िौरान बािार में पेि की गई बैटरी की िेष मात्रा का 60% तक अगले अनुपालन चक्र में आगे बढार्ा िा सकता ह।ै " िब्िों और अंकों को रखा िाएगा; (ख) खंड (viii) म,ें सारणी म,ें स्ट्तंभ (5) के अधीन प्रजवजष्टर्ों में, "तर्ाजप, अगल े अनुपालन चक्र के जलए सात वषा के चक्र के िौरान प्रजत वषा बािार में रखी गई बैटरी की औसत मात्रा का 20% तक आगे बढार्ा िा सकता ह।ै " िोनों स्ट्र्ानों पर आने वाल े िब्िों और अंकों के स्ट्र्ान पर “तर्ाजप, लाग ू अनुपालन चक्र के िौरान बािार में पेि की गई बैटरी की िेष मात्रा का 60% तक अगल े अनपु ालन चक्र में आग े बढार्ा िा सकता ह।ै " िब्िों और अंकों को रखा िाएगा; (ग) खंड (ix), (x) और (xi) में, सारणी म,ें स्ट्तंभ (5) के अधीन प्रजवजष्टर्ों म,ें "तर्ाजप, अगल े अनुपालन चक्र के जलए सात वषा के चक्र के िौरान प्रजत वषा बािार में रखी गई बैटरी की औसत मात्रा का 60% तक आगे बढार्ा िा सकता ह।ै " िोनों स्ट्र्ानों पर, िब्िों और अंकों के स्ट्र्ान पर "तर्ाजप, लाग ू अनुपालन चक्र के िौरान बािार म ें पेि की गई बैटरी की िेष मात्रा का 60% तक अगले अनुपालन चक्र में आगे बढार्ा िा सकता ह।ै " िब्िों और अंकों को रखा िाएगा; (घ) खडं (xii) म,ें सारणी म,ें स्ट्तंभ (5) के अधीन प्रजवजष्टर्ों म,ें "दफर भी, चौहर वषीर् चक्र के िौरान बािार म ें प्रजत वषा रखी गई बैटरी की औसत मात्रा का 20% अगल े अनपु ालन चक्र में आग े ले िार्ा िा सकता ह।ै " िोनों स्ट्र्ानों पर, िब्िों और अंकों के स्ट्र्ान पर "तर्ाजप, लाग ू अनुपालन चक्र के िौरान बािार में पेि की गई बैटरी की िषे मात्रा का 60% तक अगल ेअनपु ालन चक्र में आगे बढार्ा िा सकता ह।ै " िब्िों और अंकों को रखा िाएगा; (ङ) खडं (xii) म,ें सारणी म,ें क्रम संख्र्ा (xiv) के पश्चात,् अंक "(viii)" के स्ट्र्ान पर, अंक "(xv)" रखा िाएगा। [फा. सं. 12/36/2019-एचएसएमडी] नरेि पाल गगं वार, अपर सजचव रटप्पणी: मलू अजधसूचना भारत के रािपत्र, असाधारण, भाग II, खंड 3, उप-खंड (ii) म,ें संख्र्ा एसओ 3984 (अ), तारीख 22 अगस्ट्त, 2022 द्वारा प्रकाजित की गई र्ी और संख्र्ा एस.ओ. 4669(अ) तारीख 25 अक्टूबर 2023 के द्वारा इसमें अंजतम बार संिोधन दकर्ा गर्ा र्ा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 14th March, 2024 G.S.R. 190(E).— In exercise of the powers conferred by sub-section (1), clauses (v) and (vii) of sub-section (2) of section 3, sub-section (1), clauses (c) and (d) of sub-section (2) of section 6, section 8, clause (b) of sub-section (2) of section 25 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby makes the following rules further to amend the Battery Waste Management Rules, 2022, namely:- 1. (1) These rules may be called the Battery Waste Management (Amendment) Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Battery Waste Management Rules, 2022 (hereinafter referred to as the said rules), in rule 10: — (a) for sub-rule (17), the following sub-rule shall be substituted, namely:— “(17) The Central Pollution Control Board shall fix the highest and the lowest price for Extended Producer Responsibility certificates which shall be equal to 100% and 30%, respectively of the Environmental Compensation leviable on the obligated entities for non-fulfilment of Extended Producer Responsibility obligations as determined by the Central Pollution Control Board under rule 13.”; (b) after sub-rule (17), the following sub-rule shall be inserted, namely:— “(18) The exchange price of Extended Producer Responsibility certificate between registered entities through the portal shall be between the highest and the lowest prices referred to in sub-rule (17).”. 3. In rule 13 of the said rules, for sub-rule (3), the following sub-rule shall be substituted, namely:— “(3) The Central Pollution Control Board shall prepare and recommend guidelines for imposition and collection of Environmental Compensation from producers and entities involved in refurbishment and recycling of waste battery, in case of non-compliance of these rules. The Central Pollution Control Board may consult the Committee for Implementation constituted under rule 15. The recommended guidelines shall be submitted to the Ministry of Environment, Forest and Climate Change for concurrence.”. 4. In Schedule -II to the said rules, — (a) in clauses (vi) and (vii), in the table, in the entries under column (5), for the words and figure “However, there may be a carry forward of up to 60% of the average quantity of Battery placed in the market per year during the ten year cycle to the next compliance cycle.” occurring at both the places, the words and figure “However, up to 60% of the remaining quantity of battery placed in the market during the applicable compliance cycle may be carried forward to the next compliance cycle.” shall be substituted; (b) in clause (viii), in the table, in the entries under column (5), for the words and figure “However, there may be a carry forward of up to 20% of the average quantity of Battery placed in the market per year during the seven year cycle to the next compliance cycle.” occurring at both the places, the words and figure “However, up to 60% of the remaining quantity of battery placed in the market during the applicable compliance cycle may be carried forward to the next compliance cycle.” shall be substituted; (c) in clauses (ix), (x) and (xi), in the table, in the entries under column (5), for the words and figure “However, there may be a carry forward of up to 60% of the average quantity of Battery placed in the market per year during the seven year cycle to the next compliance cycle.” occurring at both the places, the words and figure “However, up to 60% of the remaining quantity of battery placed in the market during the applicable compliance cycle may be carried forward to the next compliance cycle.” shall be substituted; (d) in clause (xii), in the table, in the entries under column (5), for the words and figure “However, there may be a carry forward of up to 60% of the average quantity of Battery placed in the market per year during the fourteen year cycle to the next compliance cycle.” occurring at both the places, the words and figure “However, up to 60% of the remaining quantity of battery placed in the market during the applicable compliance cycle may be carried forward to the next compliance cycle.” shall be substituted; (e) in clause (xii), in the table, after Sl.No. (xiv), for the figure “(viii)”, the figure “(xv)” shall be substituted.
