पर्ाावरणीर् और िैव-जवजवधता की िजृ ष्ट स े पाररजस्ट्थजतकी संवेिी िोन के रूप म ें सुरजक्षत और सरं जक्षत करना तथा उि पाररजस्ट्थजतकी संवेिी िोन म ें उद्योगों र्ा उद्योगों की श्रेजणर्ों के प्रचालन तथा प्रसंस्ट्करण को प्रजतजषद्ध करना आवश्र्क ह;ै अतः अब, केन्द्रीर् सरकार, पर्ाावरण (सरं क्षण) जनर्मावली, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इसम ें इसके पश्चात ् पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उपधारा (1) और उप-धारा (2) के खंड (v) और खंड (xiv) एव ं उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, ओजडिा राज्र् के भीतरकजनका राष्ट्रीर् उद्यान, भीतरकजनका वन्द्र्िीव अभर्ारण्र् और गाजहरमाथा (समुरी) वन्द्र्िीव अभर्ारण्र् की सीमा के चारों ओर 0.10 दकलोमीटर स े 8.7 दकलोमीटर तक जवस्ट्ताररत क्षत्रे को भीतरकजनका राष्ट्रीर् उद्यान, भीतरकजनका वन्द्र्िीव अभर्ारण्र् और गाजहरमाथा (समुरी) वन्द्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी संवेिी िोन (जिस े इसम ें इसके पश् चात् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप म ें अजधसजू चत करती ह,ै जिसका जववरण जनिानुसार ह,ै अथाात:्- 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमा.-(1) पाररजस्ट्थजतकी संवेिी िोन भीतरकजनका राष्ट्रीर् उद्यान, भीतरकजनका वन्द्र्िीव अभर्ारण्र् और गाजहरमाथा (समुरी) वन्द्र्िीव अभर्ारण्र् की सीमा के आसपास 0.10 दकलोमीटर से 8.7 दकलोमीटर की सीमा तक होगा और पाररजस्ट्थजतकी संविे ी िोन का क्षत्रे 497.67 वग ा दकलोमीटर होगा। (2) भीतरकजनका राष्ट्रीर् उद्यान, भीतरकजनका वन्द्र्िीव अभर्ारण्र् और गाजहरमाथा (समुरी) वन्द्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण अनुलग्नक –I के रूप म ेंसंलग्न ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (3) सीमा जववरण और अक्षािं और िेिातं र के साथ पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करते हुए भीतरकजनका राष्ट्रीर् उद्यान, भीतरकजनका वन्द्र्िीव अभर्ारण्र् और गाजहरमाथा (समरु ी) वन्द्र्िीव अभर्ारण्र् के मानजचत्र अनलु ग्नक –IIक, अनुलग्नक –IIख और अनुलग्नक –IIग के रूप म ें संलग्न ह।ैं (4) भीतरकजनका राष्ट्रीर् उद्यान, भीतरकजनका वन्द्र्िीव अभर्ारण्र् और गाजहरमाथा (समुरी) वन्द्र्िीव अभर्ारण्र् और पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू-जनिेिांकों की सूची अनलु ग्नक -III की सारणी क और सारणी ख में िी गई ह।ै (5) मुख्र् सबंिओंु पर भ-ू जनिेिांकों के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाले ग्रामों की सूची अनलु ग्नक –IV के रुप म ेंसंलग्न ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना.–(1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख स े िो वषा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामि ा स े और इस अजधसूचना म ें दिए गए अनुबंधों का पालन करत े हुए आंचजलक महार्ोिना तैर्ार करेगी जिसे राज्र् म ें सक्षम प्राजधकारी द्वारा जवजधवत अनुमोदित दकर्ा िाएगा। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसूचना म ें जवजनर्िष्ा ट रीजत स े तथा प्रासंजगक केंरीर् और राज्र् जवजधर्ों के अनरूु प और राज्र् सरकार द्वारा िारी दििा जनिेिों, र्दि कोई हों, के अनुसार बनार्ी िाएगी। (3) आंचजलक महार्ोिना उि र्ोिना म ें पाररजस्ट्थजतकी और पर्ाावरण संबंधी सरोकारों को िाजमल करन े के जलए राज्र् सरकार के जनिजलजखत जवभागों के परामि ास े बनार्ा िाएगी, अथाात:्- (i) पर्ाावरण; (ii) वन और वन्द्र्िीव; (iii) कृजष; (iv) रािस्ट्व; (v) िहरी जवकास; (vi) पर्ाटन; (vii) ग्रामीण जवकास; (viii) जसचांई और बाढ़ जनर्ंत्रण; (ix) नगरपाजलका; (x) पंचार्ती राि; और (xi) लोक जन मााण जव भाग। (4) िब तक इस अजधसूचना म ें जवजनर्िष्टा न हो, आंचजलक महार्ोिना म ें वतामान म ें अनमु ोदित भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा तथा आचंजलक महार्ोिना म ें सभी अवसंरचनाओं और दक्रर्ाकलापों म ें सुधार करके उन्द्ह े अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनान े की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना म ें वनरजहत और अवक्रजमत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी एव ं पर्ाावरण के ऐस ेअन्द्र् पहलुओं की व्यवस्ट्था की िाएगी जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै (6) आंचजलक महार्ोिना म ें सभी जवद्यमान पूिा स्ट् थलों, ग्रामों एव ं िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों एव ं दकस्ट् मों, कृजष क्षेत्रों, ऊपिाऊ भूजम, उद्यानों एव ं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 जनकार्ों की सीमा का सहार्क मानजचत्र के साथ जनधाारण दकर्ा िाएगा और वतामान एव ं प्रस्ट्ताजवत भ-ू उपर्ोग की जविेषताओं का ब्र्ौरा भी दिर्ा िाएंगा। (7) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी संवेिी िोन म ें जवकासात्मक दक्रर्ाकलापों को जवजनर्जमत करन े के जलए प्रदक्रर्ा प्रिान करेगा और सारणी म ें र्थासूचीबद्ध पैरा 4 म ें प्रजतजषद्ध और जवजनर्जमत दक्रर्ाकलापों का पालन दकर्ा िाएगा। इसम ें स्ट् थानीर् िनता की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनश्चर् एवं संवधान दकर्ा िाएगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) अनुमोदित आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक संिभा िस्ट्तावेि होगी तादक वह इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपने कताव्यों का जनवाहन कर सके। 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनिजलजखत उपार् करेगी, अथाात्:- (1) भ-ू उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खलु े स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा संपररवतान अनुमत नहीं दकर्ा िाएगा: परंतु पाररजस्ट्थजतकी संवेिी िोन के भीतर भाग (क), म ें जवजनर्िष्टा प्रर्ोिन स े जभि प्रर्ोिन के जलए कृजष और अन्द्र् भूजम का संपररवतान, जनगरानी सजमजत की जसफाररि पर और क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा र्था लागू केन्द्रीर् सरकार एव ं राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन तथा इस अजधसूचना के उपबंधों के अनुसार सक्षम प्राजधकारी के पूवा अनुमोिन स े स्ट्थानीर् जनवाजसर्ों की जनिजलजखत आवासीर् िरूरतों को परू ा करने के जलए अनुमत दकर्ा िाएगा िैस:े- (i) जवद्यमान सडकों को चौडा करना, उन्द्ह ें सुिढ़ृ करना और नई सडकों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रिषू ण उत्पि न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योग एव ं ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और (v) पैराग्राफ-4 म ें उजल्लजखत बढ़ावा दिए गए दक्रर्ाकलापः परंत ु र्ह भी दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म तथा राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना एव ं संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगता अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनपु ालन दकए जबना वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का प्रर्ोग अनुज्ञात नहीं होगा: परंत ु र्ह भी दक पाररजस्ट्थ जतकी संवेिी िोन के अतं गता आने वाली भूजम के अजभलेखों म ें हुई दकसी त्रुरट को, जनगरानी सजमजत के जवचार प्राि करने के पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार सुधारा िाएगा और उि त्रुरट को सुधारने की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह भी दक उपर्िुा त्रुरट को सुधारन े म,ें इस उप-पैरा म ें र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भू-उपर्ोग का पररवतान िाजमल नहीं होगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) अनुप्रर्ुि र्ा अनुत्प ािक कृजष क्षेत्रों म ें वनीकरण तथा पर्ाावासों की बहाली के कार्ाकलापों स े पनु : वनीकरण दकए िाने के प्रर्ास दकए िाएगं े। (2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक िलमागों के िलग्रहण क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना म ें उनके संरक्षण और बहाली की र्ोिना सजम् मजलत की िाएगी और राज्र् सरकार द्वारा दििा-जनिेि इस रीजत से तैर्ार दकए िाएगं े दक उसम ेंऐस े क्षेत्रों म ें र्ा उसके पास जवकास दक्रर्ाकलापों को प्रजतजषद्ध और जनबंजधत दकर्ा गर्ा हो । (3) पर्टा न एव ं पाररजस्ट्थजतकी पर्टा न.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन संबंधी पर्ाटन महार्ोिना के अनुसार अनुमत होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् सरकार के पर्ाावरण और वन जवभाग के परामिा स े पर्ाटन जवभाग द्वारा बनार्ी िाएगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का घटक होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनम्न ानुसार जवजनर्जमत दकए िाएंग,े अथाात:्- (i) संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनम ें स े िो भी अजधक जनकट हो, दकसी होटल र्ा ररिॉट ा का नर्ा सजिमााण अनुमत नहीं दकर्ा िाएगाः परंत ु र्ह, पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर की िरू ी स े परे पाररजस्ट्थजतकी संवेिी िोन की सीमा तक पूव ा पररभाजषत और अभीजहत क्षेत्रों म ें पर्ाटन महार्ोिना के अनुसार, नए होटलों और ररिॉट ा की स्ट्थापना अनुमत होगी; (ii) पाररजस्ट्थजतकी संवेिी िोन के अन्द्िर सभी नए पर्ाटन दक्रर्ा-कलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा िारी दििाजनिेिों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेन े वाल े राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी दििाजनिेिों (समर्-समर् पर र्था संिोजधत) के अनुसार होगा; (iii) आंचजलक महार्ोिना का अनमु ोिन होने तक, पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा जनगरानी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमत दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन म ें दकसी नए होटल, ररिॉट ा र्ा वाजणजज्र्क प्रजतष्ठान का संजिमााण अनुमत नहीं होगा । (4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन के अंतगता आन े वाल े बहुमल्ू र् प्राकृजतक जवरासत के सभी स्ट्थलों िैस े दक िीन पूल ररिवा क्षत्रे , िैल संरचना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके सरं क्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (6) ध्व जन प्रिषू ण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रिषू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 म ें जनर्त उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन म ेंध्वजन प्रिषू ण की रोकथाम और जनर्ंत्रण दकर्ा िाएंगा ।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (7) वार् ु प्रिषू ण.- पाररजस्ट्थजतकी संवेिी िोन म,ें वार् ु प्रिषू ण का जनवारण और जनर्ंत्रण, वार्ु (प्रिषू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा । (8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत बजहस्राव का जनस्ट्सरण, पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आने वाल े पर्ाावरणीर् प्रिषू कों के जनस्ट्सरण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक किोर हो, के उपबंधों के अनुसार होगा। (9) िोस अपजिष्ट.- िोस अपजिष्ट का जनपटान एव ं प्रबन्द्धन जनिानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट का जनपटान और प्रबधं न भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना स.ं का.आ. 1357(अ), दिनांक 8 अप्रलै , 2016 के तहत प्रकाजित िोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन स ेबाहर जचजन्द्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत स े दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् प्रौद्योजगदकर्ों का प्रर्ोग करत े हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबधं न अनुमत दकर्ा िार्ेगा। (10) िवै जचदकत्सा अपजिष्ट.- िैव जचदकत्सा अपजिष्ट का प्रबंधन जनिानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् की समर्–समर् पर र्था संिोजधत अजधसूचना स.ंसा.का.जन 343 (अ), तारीख 28 माच,ा 2016 के तहत प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् प्रौद्योजगदकर्ों का प्रर्ोग करत े हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनकु ूल प्रबंधन अनुमत दकर्ा िार्ेगा। (11) प्लाजस्ट्टक अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन म ें प्लाजस्ट्टक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना स.ं सा.का.जन 340(अ), तारीख 18 माच,ा 2016 के तहत प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबधं ो के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन म ें जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ावा रण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 317(अ), तारीख 29 माचा, 2016 के तहत प्रकाजित संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा प्रकाजित तथा समर्-समर् पर र्था संिोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) सडक-र्ातार्ात.- सडक-र्ातार्ात को पर्ाावास-अनुकूल तरीके स े जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना म ें जविेष उपबंध िाजमल दकए िाएंगे। आंचजलक महार्ोिना के तर्ै ार होन े और राज्र् सरकार के सक्षम प्राजधकारी स े अनुमोदित होन े तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके तहत बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार सडक-र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन िजनत प्रिषू ण.- वाहन िजनत प्रिषू ण की रोकथाम और जनर्ंत्रण लागू जवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे ।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (16) औद्योजगक ईकाइर्ा.ं- (क) रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पश्चात पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिषू णकारी उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी। (ख) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 म ें िारी समर्-समर् पर संिोजधत मागाििाक जसद्धान्द्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें इस प्रकार जवजनर्िष्टा न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रिषू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रिषू णकारी उद्योगों को बढ़ावा दिर्ा िाएगा। (17) पहाडी ढलानों का सरं क्षण.- पहाडी ढलानों का संरक्षण जनिानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना म ें पहाडी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी संजनमााण की अनुज्ञा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खडी पहाडी ढलानों म ें अत्र्जधक भ-ू क्षरण होता ह ै उनम ें दकसी भी संजनमााण की अनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी सवं िे ी िोन म ें प्रजतजषद्ध र्ा जवजनर्जमत दकए िान े वाल े दक्रर्ाकलापों की सचू ी- पाररजस्ट्थजतकी संवेिी िोन म ें सभी दक्रर्ाकलाप, पर्ाावरण अजधजनर्म उसके अधीन बन े जनर्मों जिसम ें तटीर् जवजनर्मन िोन, 2011 एव ं पर्ाावरणीर् प्रभाव आकलन अजधसूचना, 2006 िाजमल ह ै सजहत वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्द्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) अन्द्र् लाग ू जनर्मों के उपबंधों तथा उनम ें दकए गए संिोधनों के अनुसार िाजसत होंगे और नीच े िी गई सारणी म ें जवजनर्िष्टा रीजत स े इकाइर्ां तत्काल प्रभाव से प्रजतजषद्ध होंगी; (ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) सं. 202 में टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले में माननीर् उच्चतम न्द्र्ार्ालर् के आििे 4 अगस्ट्त ,2006 और 2012 की ररट र्ाजचका (जसजवल) सं. 435 में गोवा फाउंडेिन बनाम भारत संघ के मामले में तारीख 21 अप्रैल , 2014 के आििे के अनुसरण में होगा । 2. प्रिषू ण (िल, वार्ु, मृिा, ध्वजन, आदि) पाररजस्ट्थजतकी संवेिी िोन म ें कोई नर्ा उद्योग लगाने और वतामान प्रिषू णकारी उद्योगों का जवस्ट्तार करने की अनुमजत नहीं होगीः उत्पि करने वाले उद्योगों की स्ट्थापना। परन्द्तु र्ह दक केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी समर्-समर् पर संिोजधत माग ा ििाक जसद्धान्द्तों में उद्योगों के वगीकरण के अनुसार िब तक दक अजधसूचना में ऐसा जवजनर्िष्टा न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गैर-प्रिषू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि गैर-प्रिषू णकारी कुटीर उद्यागों को बढ़ावा दिर्ा िाएगा। 3. बडी िल जवद्युत पररर्ोिनाओं की प्रजतजषद्ध। स्ट्थापना । 4. दकसी पररसंकटमर् पिाथा का प्रर्ोग र्ा प्रजतजषद्ध। उत्पािन र्ा प्रस्ट्संकरण । 5. प्राकृजतक िल जनकार्ों र्ा भूजम क्षेत्र में प्रजतजषद्ध।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 अनुपचाररत बजहस्रावों का जनस्ट्सरण प्रजतजषद्ध। 9. िलावन लकडी का वाजणजज्र्क प्रजतजषद्ध। उपर्ोग। ख.जवजनर्जमत दक्रर्ाकलाप 10. होटलों और ररसोटों की वाजणजज्र्क पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हते ु लघ ु अस्ट्थार्ी संरचनाओं के जनमााण के स्ट्थापना । जसवार्, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना की अनुमजत नहीं होगी: परंतु, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, पर्ाटन महार्ोिना और लाग ू दििाजनििे ों के अनुसार सभी नए पर्ाटन दक्रर्ाकलाप करने र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार करने की अनुज्ञा होगी । 11. संजनमाणा दक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक िो भी जनकट हो, दकसी भी प्रकार का वाजणजज्र्क संजनमाणा अनुमत नहीं दकर्ा िाएगा: परंतु स् थानीर् लोगों को पैराग्राफ 3 के उप पैराग्राफ (1) में सूचीबद्ध दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम में स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने जलए संजनमााण करने की अनुमजत भवन उपजवजधर्ों के अनुसार िी िाएगी: परन्द्तु ऐसे लघु उद्योगों िो प्रिषू ण उत् पन् न नहीं करते हैं, से संबंजधत संजनमााण दक्रर्ाकलाप जवजनर्जमत दकए िाएंग े और लाग ू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूव ा अनुमजत से ही न र्् ूनतम पर रखे िाएंग े। (ख) एक दकलोमीटर से आग े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंग े। 12. गैर प्रिषू णकारी लघ ुउद्योग। फरवरी, 2016 में केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा िारी समर्-समर् पर संिोजधत उद्योगों के वगीकरण के अनुसार गैर-प्रिषू णकारी उद्योग और अपररसंकटमर्, लघ ु और सेवा उद्योग, कृजष, पुष्प कृजष, उद्यान कृजष र्ा पाररजस्ट्थजतकी संवेिी िोन से ििे ी सामग्री से उत्पािों को उत्पि करने वाले कृजष आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे। 13. वृक्षों की कटाई । (क) राज्र् सरकार के सक्षम प्राजधकारी की पूव ा अनुमजत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत केंरीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी । 14. वन उत्पािों और गैर काष्ठ वन उत्पािों लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा । का संग्रहण । 15. जवद्युत और संचार टॉवर लगाने, तार- लाग ू जवजधर्ों के अधीन जवजनर्जमत होगा भूजमगत केबल जबछाने को बढ़ावा दिर्ा िाएगा। जबछाने तथा अन्द्र् बुजनर्ािी ढांचे की व्यवस्ट्था । 16. नागररक सुजवधाओं सजहत बुजनर्ािी लाग ू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध दििाजनिेिों के साथ ढांचा। न्द्र्ूनीकरण उपार् करना। 17. जवद्यमान सडकों को चौडा करना, उन्द्हें लाग ू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध दििाजनिेिों होगा । िैसे दक पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से गमा वार्ु के गुब्बारे, हले ीकाप्टर, िोन, माइक्रोलाइट्स उडाना आदि। 19. पहाडी ढालों और निी तटों का संरक्षण। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा । 20. राजत्र में वाहन र्ातार्ात का संचलन । लाग ूजवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होगा । 21. स्ट्थानीर् िनता द्वारा अपनार्ी िा रही स्ट्थानीर् िनता के प्रर्ोग के जलए लाग ूजवजधर्ों के अधीन अनुमत होंगे। वतामान कृजष और बागवानी पद्धजतर्ों के साथ डेर्ररर्ां, िग्ुध उत्पािन, िल कृजष और मत्स्ट्र् पालन। 22. प्राकृजतक िल जनकार्ों र्ा भ ू क्षत्रे म ें िल जनकार्ों में उपचाररत अपजिष्ट िल र्ा बजहस्रााव के जनस्ट्सारण से बचा उपचाररत अपजिष्ट िल/बजहस्रााव का िाएगा। उपचाररत अपजिष्ट िल के पुनचाक्रण और पुन:उपर्ोग के प्रर्ास दकए जनस्ट्सारण । िाएंगे। अन्द्र्था उपचाररत अपजिष्ट िल र्ा बजहस्रााव का जनस्ट्सरण लागू जवजधर्ों के अनुसार जवजनर्जमत दकर्ा िाएगा। 23. सतही और भूिल का वाजणजज्र्क लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा । जनष्कषाण । 24. फमों, जनगम और कंपजनर्ों द्वारा बड े स्ट्थानीर् आवश्र्कताओं को पूरा करने के जलए लागू जवजधर्ों के अधीन जवजनर्जमत होंग े। पैमाने पर वाजणजज्र्क पिुओं और कुक्कुट फामों की स्ट्थापना । 25. खुल े कुंआ, बोर कुंआ, आदि कृजष और जवजनर्जमत और सम्बद्ध प्राजधकारी द्वारा दक्रर्ाकलापों की सख्ती स े जनगरानी की िाएगी। अन्द्र् उपर्ोग के जलए । 26. िोस अपजिष्ट प्रबंधन। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा । 27. जवििे ी प्रिाजतर्ों को लाना। लाग ूजवजधर्ों के सिस्ट्र्; 6. पर्ाावरण के क्षेत्र में कार्ारत गैर-सरकारी संगिन का एक प्रजतजनजध ओजडिा सरकार द्वारा सिस्ट्र्; नाजमत दकर्ा िाएगा 7. पर्ाावरण, वन्द्र्िीव और पाररजस्ट्थजतकी के क्षेत्र में एक जविेषज्ञ को ओजडिा सरकार द्वारा सिस्ट्र्; नाजमत दकर्ा िाएगा 8. राज्र् सरकार द्वारा नाजमत दकर्ा िाने वाला िैव जवजवधता में एक जविेषज्ञ। सिस्ट्र्; 9. संभागीर् वनाजधकारी, भरक वन्द्र् िीव प्रमंडल सिस्ट्र्; 10. संभागीर् तत्क ालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना स.ं का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अनुसूची के अधीन सजम्मजलत दक्रर्ाकलापों और इस अजधसूचना के पैरा 4 के अधीन सारणी म ें र्था जवजनर्िष्टा प्रजतजषद्ध गजतजवजधर्ों के जसवार् आने वाले ऐसे दक्रर्ाकलापों की वास्ट्तजवक जवजनर्िष्टा स्ट्थलीर् ििाओं के आधार पर जनगरानी सजमजत द्वारा संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूव ा पर्ाावरण अनापजत्त लेने के जलए केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतना मंत्रालर् को जनर्िष्टा की िाएगी। (4) इस अजधसूचना के पैरा 4 के अधीन सारणी म ें र्था जवजनर्िष्टा प्रजतजषद्ध दक्रर्ाकलापों के जसवार्, भारत सरकार के तत्क ालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ा का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अजधसूचना की अनुसूची के अधीन ऐसे दक्रर्ाकलापों, जिन्द्ह ें सजम्मजलत नहीं दकर्ा गर्ा ह,ै परंत ु िो पाररजस्ट्थजतकी संवेिी िोन म ें आते ह,ैं ऐसे दक्रर्ाकलापों की वास्ट्तजवक जवजनर्िष्टा स्ट्थलीर् ििाओं के आधार पर जनगरानी सजमजत द्वारा संवीक्षा की िाएगी और उसे संबद्ध जवजनर्ामक प्राजधकरणों को जनर्िष्टा दकर्ा िाएगा । (5) जनगरानी सजमजत का सिस्ट्र्-सजचव र्ा संबंजधत उपार्िु ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लंघन करता ह,ै पर्ाावरण अजधजनर्म की धारा 19 के अधीन पररवाि िार्र करने के जलए सक्षम होगा। (6) जनगरानी सजमजत संबंजधत जवभागों के प्रजतजनजधर्ों र्ा जविेषज्ञों, औद्योजगक संघों के प्रजतजनजधर्ों र्ा संबंजधत जहतधारकों को, प्रत्र्ेक मामले म े आवश्र्कता के अनुसार, अपने सजमजत को उसके कृत्र्ों के प्रभावी जनवाहन के जलए ऐस े जनिेि ि े सकेगा िो वह उजचत समझे । 7. अजतररक्त उपार्.- इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए केंरीर् सरकार और राज्र् सरकार, अजतररक्त उपार्, 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are it to the e-mail address of the Ministry at esz-mef@nic.in Draft Notification WHEREAS, the Bhitarkanika National Park is spread over an area of 145 square kilometers, notified vide Notification No. 19686/F&E dated. 16.09.1998 and is located in Kendrapara District in the State of Odisha. AND WHEREAS, the Bhitarkanika Wildlife Sanctuary is spread over an area of 673 square kilometers and is located in Rajnagar, Kanika and Mahakalapada Tehsil of Kendrapara District in the State of Odisha. The boundary of Bhitarkanika Wildlife Sanctuary has been rationalized and re-notified under sub-section (1) with clause (b) of section 26A of the Wildlife (Protection) Act, 1972 vide Notification No. FE-WL-WLF-0054-2015-2289 dated. 01.02.2020 of Forest & Environment Department, Government of Odisha by excluding 52 villages with an extent of 54.45 sq. km and by including 8 numbers of Forest Block of Mahakalapada Tehsil with an area of 55.45 square kilometer; AND WHEREAS, the Gahirmatha (Marine) Wildlife Sanctuary is spread over an area of 1435 square kilometers, notified vide Notification No. 8F(WL) 4/97-18805/F&E dated. 27.09.1997 and is located in Rajnagar and Mahakalapada Tehsil of Kendrapara district in the state of Odisha; AND WHEREAS, the boundary of Bhitarkanika National Park is within the Bhitarkanika Wildlife Sanctuary and the Gahirmatha (Marine) Wildlife Sanctuary is contiguous with the eastern boundary of Bhitarkanika Wildlife Sanctuary and these protected areas form a contiguous land and water body which is identified as the Eco- Sensitive Zone; AND WHEREAS, the protected area rich in biodiversity and high productive ecosystem having estuarine and marine ecosystem with 61 species of Invertebrates like Protozoa (2 species), Coelenterates (3 species), Mollusca (7 species), Annelids (34 species), Arthropods (15 species) and vertebrates like Fish (20 species), Amphibians (5 species), and Reptiles (42 species), birds (more than 280 species), Mammals (28 species including Cetaceans); AND WHEREAS, the Bhitarkanika area has the largest natural population of estuarine crocodile in India and is known for its reptilian diversity. The area has the largest heronry in Asia, which is an annual activity during monsoon and winter migrants visiting the Bhitarkanika wetland is more than one lakh every year. AND WHEREAS, the Bhitarkanika is the second Ramsar site in the state of the Odisha which is a wetland of International importance and the Gahirmatha (Marine) Wildlife Sanctuary is globally known for mass nesting of Olive Ridley Sea Turtles. Many of the endangered species of flora and fauna enlisted in the Wildlife (Protection) Act, 1972 and enlisted in the Red Data Book of International Union for Conservation of Nature (IUCN) are available in these protected areas.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, the rare, endangered and threatened faunal species present in the area are fan throated lizard (Sitana ponticeriana), skink (Riopa punctate), great cormorant (Phalacocorax carbo), little grebe (Tachybaptus ruficollis), brahminy kite (Haliastur indus), small pratincole (Glareola lacteal), Indian skimmer (Rynchops albicollis), baula kumbhira (Crocodylus porosus), olive ridley turtle (Lepidochelys olivacea), pani godhi (Varanus salvator), ajagar (Python molurus), batagur turtle (Batagur baska), nabarangi (Pitta megarhyncha) AND WHEREAS, the mammal species present in the protected area are spotted deer (Axis axis), sambar (Cervus unicolor), Indian wild boar (Sus scrofa), Asiatic jackal (Canis aurecus), fishing cat (Felis viverrina.), jungle cat (Felis.chaus), leopard cat (Felis bengalansis.), hyaena (Hyaena hyaena), common mangoose (Herpestes edwardsi.), otter (Lutra perspicillata.), small Indian civet (Viverricula indica.), Indian porcupine (Hystrix indica.), rhesus macaque (Macaca mulatta mulatta.), Gangetic dolphins (Platamista gangetica), humpback dolphin (Sousa chincusis), Irrawady dolphin (Orcaella brevirostris) and Indian mole rat (Bandicota bengalensis) etc; AND WHEREAS, the rare, endangered and threatened floral species present in the area are paniamba (Cerbera odollam), oanra (Aglaia cucullata), maasitha (Intsia bijuga), harakancha (Acanthus ilicifolius), banarua (Aegialitis rotundifolia), kharsi (Aegiceras corniculatum), bada bani (Avicennia officinalis), lati sundari (Brownlowia tersa), kaliachua (Bruguiera cylindrica), garani (Ceriops decandra), kala katiranai (Derris trifoliata), sundari (Heritiera fomes), sindhuka (Kandelia candel), churunda (Lumnitzera racemosa), nalia ghasa (Myriostachya wightiana), rai (Rhizophora apiculata), hental (Phoenix paludosa), goda bani (Sesuvium portulacastrum), orua (Sonneratia alba), keruan (Sonneratia apetela), orua (Sonneratia caseolaris), giria (Suaeda maritime), giria (Suaeda nudiflora), jagula (Tamarix troupii), pitamari (Xylocarpus mekongensis), dhala bani (Avicennia alba), bandari (Bruguiera gymnorhiza), dot (Bruguiera parviflora) khasai lata (Finlaysonia obovata), batula (Salicornia brachiata); AND WHEREAS, the biodiversity of mangroves in the Bhitarkanika wetland area is one of the highest, with 88 species of mangroves and their associates identified taxonomically. The area also provides habitat to Kanika Sundari (Heritiera kanikensis) an endemic species to the Bhitarkanika area; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Bhitarkanika National Park, Bhitarkanika Wildlife Sanctuary and Gahirmatha (Marine) Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0.10 kms to 8.7 kilometres around the boundary of Bhitarkanika National Park, Bhitarkanika Wildlife Sanctuary and Gahirmatha (Marine) Wildlife Sanctuary, in the State of Odisha as the Bhitarkanika National Park, Bhitarkanika Wildlife Sanctuary and Gahirmatha (Marine) Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: 1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to the extent of 0.10 kilometres to 8.7 kilometres around the boundary of Bhitarkanika National Park, Bhitarkanika Wildlife Sanctuary and Gahirmatha (Marine) Wildlife Sanctuary and the area of the Eco-sensitive Zone is 497.67 square kilometres. (2) The boundary description of Eco-sensitive Zone around of Bhitarkanika National Park, Bhitarkanika Wildlife Sanctuary and Gahirmatha (Marine) Wildlife Sanctuary is appended in Annexure-I. (3) The maps of the of Bhitarkanika National Park, Bhitarkanika Wildlife Sanctuary and Gahirmatha (Marine) Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB and Annexure-IIC.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 25 (4) Lists of geo co-ordinates of the boundary of of Bhitarkanika National Park, Bhitarkanika Wildlife Sanctuary and Gahirmatha (Marine) Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure-III. (5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV. 2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj; and (xi) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph; (b) efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco- sensitive Zone; (b) the Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests; (c) the Tourism Master Plan shall form a component of the Zonal Master Plan; (d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco- sensitive Zone; (e) the activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27 resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco- sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco- tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under. (8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made there under or standards stipulated by the State Government, whichever is more stringent. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016; (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco- sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone; (b) only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco- sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye- laws to meet the residential needs of the local residents: Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 12. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional Measures. - The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8.
