(1) इन जनयमों का संजिप्त नाम केन्‍दरीय मोटर यान (छठा संिोधन) जनयम, 2023 ह।ै (2) ये रािपत्र में इनके प्रकािन की तारीख से लाग ूहोंगे। 6160 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. केंरीय मोटर यान जनयम, 1989 (जिसे इसमें इसके प‍च ात् उक्त जनयम कहा गया ह)ै म,ें जनयम 126-घ के पश्चात ् जनम्न जलजखत जनयम अंतःस्ट्थाजपत दकया िाएगा, अथागत्- “126-ड. भारत नई कार जनधागरण कायगक्रम –(1) इस जनयम के अधीन कार जनधागरण कायगक्रम 1 अ‍टूबर, 2023 को या उसके पश्चात ििे म ेंजवजनर्मगत या आयाजतत श्रेणी एम1 के अनमु ोदित प्रकार के यानों पर लाग ूहोगा। (2) 1 अ‍टूबर 2023 से, मोटर यानों के जवजनमागता या आयातक अपने मोटर यान का परीिण और एआईएस:197 के अनुसार स्ट्टार रेटटंग दिलवान े के जलए जनधागरण करान े हते ु केंरीय सरकार द्वारा अजभजहत दकए गए अजभजहत अजभकरण को प्ररूप 70क में एक आवेिन प्रस्ट्ततु करेंगे। (3) स्ट्टार रेटटंग के जलए जनधागरण के प्रयोिन के जलए मोटर यान की लागत और ऐसे जनधागरण की लागत संबंजधत जवजनमागता या आयातक द्वारा वहन की िाएगी। (4) मोटर यानों का एआईएस-197 के अनुसार जनधागरण के प्रयोिनाथ ग जवजनमागता, आयातक या जवजनमागता या आयातक के अजधकृत डीलर के पररसर से अजभजहत अजभकरण द्वारा यािजृ छछक रूप स ेचयन दकया िाएगा। (5) अजभजहत अजभकरण उप-जनयम (2) म ें चयजनत यानों के जनधागरण के जलए जनयम 126 म ें जनर्िगष्ट दकसी भी परीिण अजभकरण का चयन करेगा। (6) जवजनमागता या आयातक चयजनत यानों को उप-जनयम (4) के अधीन चयजनत परीिण अजभकरण को भेिगे ा। (7) परीिण अजभकरण एआईएस-197 के अनुसार यानों का मल्ू यांकन करेगा और अजभजहत अजभकरण को प्ररूप 70-ख म ें जनधागरण ररपोटग प्रस्ट्तुत करेगा। (8) परीिण और मूल्यांकन ररपोटग के अनुमोिन पर, अजभजहत अजभकरण द्वारा अजभजहत पोटगल पर यान की स्ट्टार रेटटगं अपलोड की िाएगी। (9) इस जनयम की कोई बात जनयम 126 के अधीन छूट प्राप्त यान पर लाग ूनहीं होगी।'' 3. उक्त जनयमों के प्ररूप 69 के पश्चात, जनम्नजलजखत प्ररूप अंतःस्ट्थाजपत दकए िाएगं े, अथागत:् - “प्ररूप स.ं 70 क [जनयम 126 ड. (1) These rules may be called the Central Motor Vehicles (Sixth Amendment) Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2 In the Central Motor Vehicles Rules, 1989 (hereinafter referred as the said rules), after rule 126D, the following rule shall be inserted, namely:- “126E. Bharat new car assessment programme.- (1)The car assessment programme under this rule shall be applicable on the type approved vehicles of category M1, manufactured or imported in the country on or after the 1st day of October, 2023. (2) On and from the 1st day of October 2023, the manufacturer or importer of motor vehicles shall submit an application in FORM 70A, to the designated agency, designated by the Central Government to get their motor vehicle examined and assessed for star rating in accordance with AIS:197. (3) The cost of the motor vehicle for the purpose of assessment for star rating and the cost of such assessment shall be borne by the respective manufacturer or importer. (4) The motor vehicles for the purpose of assessment shall be randomly selected by the designated agency, from the premises of the manufacturer, importer, or authorised dealer of the manufacturer or importer, in accordance with AIS- 197. (5) The designated agency shall select any of the testing agency, referred to in rule 126, for the assessment of the vehicles selected in sub-rule (2). (6) The manufacturer or importer shall send the selected vehicles to the testing agency selected under sub-rule(4). (7) The testing agency shall evaluate the vehicles in accordance with AIS-197 and submit the assessment report to the designated agency in FORM 70B. (8) On examination and approval of the assessment report, the star rating of the vehicle shall be uploaded on the designated portal by the designated agency: (9) Nothing in this rule shall apply to a vehicle exempted under rule 126.”. 3.
