(ख) “बोडध” से अजधजनयम की धारा 27क के अधीन गरित केंद्रीय बायलर बोडध अजभप्रेत ह ै; (ग)“मरख्य जनरीिक” से अजधजनयम के अधीन मरख्य जनरीिक के रूप में जनयरि कोई व्यजि अजभप्रेत ह ै; और (घ)“तकनीकी सलाहकार” से अजधजनयम की धारा 4क की उपधारा (1) के अधीन तकनीकी सलाहकार अजभप्रेत ह।ै 5934 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) उन िब्दों और पदों के, जो इन जनयमों म ें प्रयरि ह ैं और पररभाजषत नहीं हैं, ककतर अजधजनयम में पररभाजषत हैं, वहीं अथ ध होंगे, जो अजधजनयम में क्रमि: उनके ह ैं। 3. दघर नध नाओं की जाचं —अजधजनयम की धारा 18 के अधीन बायलर या बायलर संघनक की दघर धनना की ररपोनध की प्राजि पर प्रारंजभक जांच उस संबंजधत राज्य में संचाजलत की जाएगी, जजसकी अजधकाररता में दघर धनना घरनत हुई ह ै। 4. दघर नध नाओं के पररणामस्ट्वरूप कोई मत्ृ य र होना—ऐसे संबंजधत राज्य का मरख्य जनरीिक, जजसकी अजधकाररता में दघर धनना के कारण कोई मृत्यर हुई है, प्रारंजभक जांच के आधार पर, प्ररूप ‘क’ में तकनीकी सलाहकार को अजवलंब ररपोनध अग्रेजषत करेगा । 5. दघर नध नाओं के पररणामस्ट्वरूप दकसी मत्ृ य र की जाचं —जनयम 3 पर प्रजतकूल प्रभाव डाले जबना, जहां दकसी दघर धनना के कारण कोई मृत्यर हुई है, वहां केंद्रीय सरकार द्वारा भी जांच संचाजलत की जाएगी । 6. जाचं सजमजत का गिन—(1) जांच, जनम्नजलजखत से जमलकर बनने वाली जांच सजमजत द्वारा की जाएगी, अथाधत् :-- (i) तकनीकी सलाहकार – अध्यि ; (ii) बायलर का मरख्य जनरीिक या जनदेिक – सदस्ट्य ; (iii) बोडध में बायलर और बायलर संघनक जवजनमाधता का प्रजतजनजध या बायलरों का उपयोिा – सदस्ट्य । (2) केंद्रीय सरकार, जांच सजमजत में, ऐसे दकसी अन्य व्यजि को भी सहयोजजत कर सकेगी, जजसका दघर धनना के साथ कोई जहत का नकराव न हो, यदद जांच संचाजलत करने में उसकी उपजस्ट्थजत को उपयोगी समझा जाता ह ै। (3) जांच सजमजत का गिन, संबंजधत राज्य के मरख्य जनरीिक से दघर धनना के पररणामस्ट्वरूप हुई दकसी मृत्यर की ररपोनध प्राि होने के पन्द्रह ददन के भीतर दकया जाएगा और मरख्य जनरीिक से दघर धनना की ररपोनध प्राि होने के पैंतालीस ददन के भीतर जांच संचाजलत की जाएगी । 7. जाचं के दौरान प्रदक्रया—(1) जांच सजमजत िजतग्रस्ट्त परजों की सावधानीपूवधक जांच करेगी और ऐसे मापमान या स्ट्केच लेगी तथा ररपोनध के प्रयोजन के जलए ऐसे फोनो ले सकेगी, जो वह आव‍यक समझे । (2) जांच सजमजत, दघर धनना की पररजस्ट्थजतयों, उसकी प्रकृजत तथा जवस्ट्तार, मृत्यर का कारण तथा व्यजियों को हुई िजत और संपजत्त को हुए नरकसान की जांच करेगी तथा इसकी ररपोनध केंद्रीय सरकार को प्रस्ट्तरत करेगी । 8. दघर नध नाओं के पररणामस्ट्वरूप दकसी मत्ृ य र के पश्चात ् बायलर का उपयोग—(1) बायलर को तब तक प्रयोग में नहीं लाया जाएगा, जब तक जांच पूरी नहीं हो जाती ह ै। (2) जांच पूरी होने के पश्चात्, संबंजधत राज्य का मरख्य जनरीिक इस बारे में जवजनश्चय करेगा दक क्या बायलर के उपयोग को, मरम्मत के जबना या ऐसी दकसी मरम्मत या पररवतधन, जजसका वह आदिे करे, के पूरा होने तक, उसी दाब पर या जनम्नतर दाब पर अनरज्ञात दकया जा सकता ह ै। “प्ररूप ‘क’ (जनयम 4 दजे खए) बायलर स.ं ……………………म ेंहुई दघर नध ना की प्रारंजभक जाचं की ररपोनध सेवा में तकनीकी सलाहकार (बायलर), उद्योग संवधधन और आंतररक व्यापार जवभाग, वाजणज्य और उद्योग मंत्रालय, भारत सरकार । महोदय/महोदया,[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 हमने बायलर सं. ……………………में हुई दघर धनना की प्रारंजभक जांच की ह ैऔर अब जनम्नजलजखत ररपोनध करते ह ैं:-- 1. दघर धनना की तारीख और स्ट्थान : 2. जांच की तारीख : 3. स्ट्वामी का नाम और पता : 4. मृत और घायल व्यजि : 5. जनमाधता का नाम : 6. बायलरों का संजिि वणधन, साधारण अवस्ट्था, अन्य बायलरों के संबंध में उसका अवस्ट्थान, वह प्रयोजन, जजसके जलए इसका प्रयोग दकया गया ह ैऔर बायलर की आयर : 7. तारीखों के साथ पूवध में की गई मरम्मतों की जवजिजियां : 8. बायलर का ...................... को ....................................... द्वारा अंजतम बार जनरीिण दकया गया था । 9. दघर धनना की प्रकृजत : 10. दघर धनना का कारण : 11. सामान्य रनप्पजणयां : बायलर मरख्य जनरीिक ।” [फा. सं.पी.-30020/8/2021-बायलर] सरजमता डावरा, अपर सजचव MINISTRY OF COMMERCE AND INDUSTRY (Department for Promotion of Industry and Internal Trade) NOTIFICATION New Delhi, the 14th October, 2021 G.S.R. 743 (E) .—In exercise of the powers conferred by sub-section (1),clause (g) of sub-section (1A) of section 28A and sub-section (3) of section 18 of the Boilers Act, 1923 (5 of 1923), the Central Government hereby makes the following rules, namely: - 1. Short title and commencement.- (1) These rules may be called the Boiler Accident Inquiry Rules, 2021. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions.- (1) In these rules, unless the context otherwise requires,- (a) "Act" means the Boilers Act, 1923 (5 of 1923); (b) ―Board‖ means Central Boilers Board constituted under section 27A of the Act; (c) " Chief Inspector‖ means a person appointed to be a Chief Inspector under the Act; and (d) ―Technical Adviser‖ means the Technical Adviser appointed under sub-section (1) of section 4A of the Act. (2) Words and expressions used and not defined in these rules, but defined in the Act shall have the same meanings respectively assigned to them in that Act. 3. Inquiry of accidents.-On receipt of a report of an accident to a boiler or boiler component under section 18 of the Act, a preliminary inquiry shall be conducted in the concerned State in whose jurisdiction the accident has occurred. 4. Accidents resulting in any death.- The Chief Inspector of the concerned State in whose jurisdiction any death has resulted due to the accident , based on preliminary inquiry, shall forward a report without delay to the Technical Adviser in Form “A‖.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 5. Inquiry of accidents resulting in any death.-(1) Without prejudice to rule3, where any death has resulted due to any accident, aninquiry shallalso be conducted by the Central Government. 6. Constitution of inquiry committee.- (1)The inquiry shall be conducted by an inquiry committee consisting of the following, namely:- (i) Technical Adviser –Chairman; (ii) a Chief Inspector or Director of Boiler –Member; (iii) a representative of Boiler and boiler component manufacturer or user of boilers in the Board – Member. (2) The Central Government may also co-opt any other person, who does not have any conflict of interest with the accident, in the inquiry committee if his or her presence is considered useful in conducting the inquiry. (3) The inquiry committee shall be constituted within fifteen days of receipt of report of accident resulting in any death from the Chief Inspector of the concerned state and inquiry shall be conducted within forty-five days of receipt of report of accident from the Chief Inspector. 7. Procedure during inquiry.- (1)The inquiry committee shall make a careful examination of the damaged parts and shall take such measurements or sketches and may take such photographs for the purpose of report as they may deem necessary. (2) The inquiry committee shall inquire into the circumstances of the accident, its nature and extent, the cause of death and injury to persons and the damage to property and shall submit the inquiry report to the Central Government. 8. Use of Boiler after accident resulting in any death.- (1) The boiler shall not be put to use till the inquiry is completed. (2) After completion of inquiry, the Chief Inspector of the concerned state shall decide whether the use of boiler can be permitted at the same or at a lower pressure without repairs or pending the completion of any repairs or alterations that he may order. “FORM ‘A’ (See rule 4) Report of the preliminary inquiry of the accident to Boiler No………………..
