## Policy Analysis Report: Land Acquisition for NH709B (Shamli to Saharanpur Section) **1. Executive Summary:** This report analyzes a notification from the Ministry of Road Transport and Highways, Government of India, regarding land acquisition for the building, widening, four-laning, maintenance, management, and operation of National Highway 709B (NH709B) on the stretch from Km 67.3 to Km 137.9 (Shamli to Saharanpur Section) in the district of Shamli, Uttar Pradesh. The notification declares the Central Government's intention to acquire specific land parcels as detailed in the schedule, following the due process outlined in the National Highway Act, 1956. Key findings indicate a focused effort to facilitate infrastructure development by acquiring private agricultural land, impacting specific landowners and villages along the designated highway stretch. **2. Introduction:** This report provides an overview of the notification S.O. 1469(E), dated 7th April, 2021, issued by the Ministry of Road Transport and Highways, pertaining to the acquisition of land for the NH709B project. The analysis is based solely on the provided text. **3. Policy Overview:** * This notification likely serves as an amendment/continuation to an earlier policy/notification S.O. 632(E) date 10.02.2021 (mentioned in the text). * **Core Objective:** To acquire land for the building, widening, four-laning, maintenance, management, and operation of NH709B on the stretch of land from Km 67.3 to Km 137.9 (Shamli to Saharanpur Section). **4. Background and Rationale:** The text indicates that the Central Government intends to acquire land for infrastructure development specifically for NH709B. The problem/issue the notification addresses is the *need for land* to facilitate the building, widening, four-laning, maintenance, management and operation of the highway. The mention of notification S.O. 632E date 10.02.2021 suggests that this is a continuation of a prior declaration of intent, likely proceeding to the next stage of formal land acquisition. **5. Key Provisions / Changes:** * The notification declares that the Central Government will acquire the land specified in the Schedule. This follows the publication of the initial intent in Gazette notification S.O. 632E dated 10.02.2021 and subsequent publications in Dainik Jagran and Hindustan Times, both dated 19.02.2021. * The Schedule lists the specific land parcels to be acquired, including their survey numbers, type of land (private, agriculture), area in hectares, and the names of the landowners/interested parties. * It specifies that the land will vest absolutely in the Central Government, free from all encumbrances, upon publication of the notification in the Official Gazette. * The notification follows the process outlined in the National Highway Act, 1956, including consideration and disallowance of objections and submission of a report by the competent authority. **6. Target Audience and Stakeholders:** The primary target audience and stakeholders are: * Landowners whose land is being acquired, as listed in the Schedule (e.g., Indrajit Singh, Ramkumar, Kela Devi, Sanjeev Kumar, Brajpal Singh, Anita Narendra Singh, Harendra Kumar, Harbir Singh, Kapil Rana, Dharmabiri Late Harbir Singh, Subhalesh Late Ranveer Singh, Mrs. Lichho Devi, Mrs. Suresh Devi, Pramod Kumar, Rishipal Singhs sons Phim Singh, Satyapal Asaram, Upendra Nirwal, Mrs. Usha, Ravindra Kumar Mahaveer, Jitendra Kumar Mahaveer, Geeta Devi, Utkarsh Naba, Mahak Singh Bhanwar Singh, Sompal Singh Bhanwar Singh, Rajkumar Bhanwar Singh, Kuldeep Brajpal Singh, Pradeep Brajpal Singh, Vimala Devi, Jagram Naubat, Sanjeev Kumar Baljorsih, Rajiv Baljorsingh, Surendra Prakasha, Devendra Prakasha, Yogendra Prakasha, Dinesh Prakasha). * Residents and communities in the villages of Banat Jagwati, Sisauli, N.Bantikheda, Ni.gram, Shamli and Tajpur Simbhalka. * The Uttar Pradesh State Highway Authority * Potentially, industries and businesses reliant on transportation infrastructure in the region. **7. Implementation Aspects (Inferred):** * **Responsible Agency:** Ministry of Road Transport and Highways, along with a "competent authority" responsible for conducting surveys, hearing objections, and submitting reports. * **Procedure:** The implementation follows the National Highway Act, 1956, involving notifications, consideration of objections, submission of reports, and final declaration of acquisition. * **Timelines:** The document mentions the date of notification (7th April 2021) and refers to earlier publications (10.02.2021 and 19.02.2021), suggesting an ongoing process with specific deadlines and timelines prescribed by the Act (though not explicitly stated in this notification). **8. Expected Outcomes / Impact of Changes:** The intended outcome is the legal acquisition of the specified land parcels by the Central Government. This will facilitate the building, widening, four-laning, maintenance, management, and operation of NH709B. The impact of these specific changes is likely to be: * Transfer of ownership of the specified land parcels to the Central Government. * Potential displacement or relocation of landowners and residents, requiring compensation and resettlement. * Improved transportation infrastructure, leading to better connectivity, reduced travel times, and potential economic benefits for the region. **9. Conclusion:** The notification S.O. 1469(E) represents a crucial step in the development of NH709B. It formalizes the acquisition of land necessary for the highway's expansion and improvement. This notification is significant for the stakeholders impacted by the acquisition as well as those who will benefit from the improved transportation infrastructure. Further research into the broader NH709B project and compensation packages offered to affected landowners is recommended for a more complete understanding.
