## Policy Analysis Report: Amendment to Bureau of Indian Standards Notification
**1. Executive Summary:**
This report analyzes an amendment to a notification by the Bureau of Indian Standards (BIS) regarding the establishment of IS 458: 2021. The amendment, published in the Gazette of India on April 22, 2022, corrects a date error, changing the effective date of IS 458: 2021 from December 22, 2021, to December 22, 2022. This seemingly minor correction has significant implications for ensuring regulatory compliance within the affected industry by ensuring the correct effective date is used.
**2. Introduction:**
This report aims to provide a clear understanding of the amendment to the Bureau of Indian Standards (BIS) notification concerning IS 458: 2021, as published in the Gazette of India. The analysis is based solely on the provided policy text.
**3. Policy Overview:**
* **Amendment To:** Notification of Government of India under the Ministry of Consumer Affairs, Food and Public Distribution Department of Consumer Affairs published on 30 March 2021 in Part III, Section 4 of the Gazette of India, in pursuance of Subrule 1 of Rule 15 of the Bureau of Indian Standards Rules, 2018: Extraordinary vide HQPUB01242020 PubBIS 147 dated 24 March 2021
* **Core Objective (of the amendment, inferred):** To rectify a factual error in the original notification regarding the effective date of IS 458: 2021.
**4. Background and Rationale:**
The provided text strongly suggests the amendment addresses an error in the original notification. The date for the establishment of IS 458: 2021 was incorrectly stated. This amendment is necessary to ensure the accuracy and legal validity of the standard's implementation timeline and prevent confusion or non-compliance based on the incorrect date.
**5. Key Provisions / Changes:**
This section focuses exclusively on the changes introduced by the amendment:
* **Specific Part of Original Policy Being Changed:** "Sl. No. 1, column 5 of the schedule notifying the establishment of IS 458 : 2021" (as described in the original notification). The column presumably contains the effective date.
* **New Rule/Provision:** The effective date for IS 458: 2021 is now stipulated as "22 December 2022".
* **Difference/Effect of Change:** The original notification incorrectly stated the effective date as December 22, 2021. This correction delays the effective date by one year to December 22, 2022. This provides affected entities with additional time to comply with IS 458: 2021.
**6. Target Audience and Stakeholders:**
Based on the text, the target audience and stakeholders are those industries and organizations subject to IS 458: 2021. This includes manufacturers, suppliers, and users of products covered by this standard. They need to be aware of the corrected effective date for compliance purposes.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Bureau of Indian Standards (BIS) is the responsible agency for implementing and enforcing this standard.
* **Timelines/Procedures:** The key timeline element is the corrected effective date of December 22, 2022. Affected parties must ensure compliance with IS 458: 2021 by this date. The implementation procedure likely involves the BIS monitoring and auditing compliance with the updated standard.
**8. Expected Outcomes / Impact of Changes:**
The intended outcome of this amendment is to ensure the correct effective date for IS 458: 2021 is implemented. This correction prevents confusion and potential non-compliance due to the incorrect date previously published. The likely impact is a delay in implementation, providing the target audience with more time to adapt to the requirements of the standard. Industries can utilize this grace period for a seamless transition.
**9. Conclusion:**
The amendment to the BIS notification regarding IS 458: 2021 is a crucial correction, changing the effective date to December 22, 2022. This change is significant for the target audience, providing an extended timeframe for compliance and ensuring regulatory clarity. While seemingly minor, this correction prevents potential legal and operational issues arising from an incorrectly implemented standard. It underscores the importance of accurate communication of policy details and regulatory requirements.
