L.-33004/99 सी.जी.-डी.एल.-अ.-07032024-252690 CG-DxLx-xEG-I0D7H0x3x2x0 24-252690 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 147] नई दिल्ली, बुधवार, माच ग6, 2024/फाल्ग नु 16, 1945 No. 147] NEW DELHI, WEDNESDAY, MARCH 6, 2024/PHALGUNA 16, 1945 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 6 माच,ग 2024 सा.का.जन. 159(अ).—केन्द्रीय मोटर यान अजधजनयम, 1988 की धारा 212 की उपधारा (1) की अपेक्षानुसार केन्द्रीय मोटर यान जनयम, 1989 का संिोधन करन े के जलए कजतपय जनयमों का प्रारूप, भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उपखडं (i) म ें भारत सरकार के सड़क पररवहन और रािमाग ग मंत्रालय की अजधसूचना सं. सा.का.जन. 724(अ) तारीख 5 अक्तूबर, 2023 द्वारा प्रकाजित दकए गए थे, जिनमें उस तारीख स े जिसको उक्त अजधसूचना को अंतर्वष्टग करने वाली रािपत्र की प्रजतया ं िनसाधारण को उपलब्ध कराई गई थी, तीस दिन की अवजध के भीतर प्रभाजवत होने वाल े सभी व्यजक्तयों से आक्षपे और सझु ाव आमंजत्रत दकए गए थ े; और उक्त रािपत्र अजधसूचना की प्रजतयां िनसाधारण को 6 अक्तूबर, 2023 को उपलब्ध करा िी गई थी ; और उक्त प्रारूप जनयमों के संबंध में िनसाधारण से प्राप्त आक्षपे ों और सुझावों पर केंरीय सरकार द्वारा सम्यक् रूप से जवचार कर जलया गया ह ै; अतः अब केन्द्रीय सरकार, केन्द्रीय मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 110 द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए, केन्द्रीय मोटर यान जनयम, 1989 का और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती ह,ै अथागत ् :— 1615 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 1. संजक्षप्त नाम और प्रारंभ.- (1) इन जनयमों का संजक्षप्त नाम केन्द्रीय मोटर यान (चौथा संिोधन) जनयम, 2024 ह ै। (2) य ेजनयम 1 जसतंबर, 2025 से प्रभावी होंगे । 2. केन्द्रीय मोटर यान जनयम, 1989 (जिसे इसमें इसके पश्चात ्उक्त जनयम कहा गया ह)ै के जनयम 47 के उपजनयम (1) के खडं (v) के उपखंड (छ) में, “और, दकसी बस बॉडी सरं चना फैब्रीकेटर द्वारा ड्राईव अवे चेजसस पर जनर्मगत बस की बॉडी के स्ट्वप्रमाणन के मामले म,ें प्ररूप 22ख में अनुपालन का प्रमाणपत्र” िब्िों, अंकों और अक्षर का लोप दकया िाएगा । 3. उक्त जनयमों के जनयम 125ग म,ें - (क) उपजनयम (1) म,ें परंतुक और सारणी के पश्चात ्जनम्नजलजखत परंतुक अंत:स्ट्थाजपत दकया िाएगा, अथागत ् :- “चालक को छोड़कर 13 या अजधक याजत्रयों के बैठन े की क्षमता वाली बसों की बॉडी के जनमागण का परीक्षण और अनुमोिन, बस बॉडी जनमागता द्वारा एआईएस:052 (पनु रीक्षण 1)-2008 के अनुसार होगा तथा जनयम 126 के अधीन जवजनर्िगष्ट परीक्षण अजभकरणों द्वारा एक अनुमोदित प्रकार होगा ।”; (ख) उपजनयम (7) म,ें खंड (ख) के पश्चात ् जनम्नजलजखत खडं अतं :स्ट्थाजपत दकया िाएगा, अथागत् :- “(ग) बस बॉडी जनमागता द्वारा जनर्मगत, चालक को छोड़कर 22 से अजधक याजत्रयों के बैठन े की क्षमता वाली बस ें एआईएस-153 के अनुसार अपक्षे ाओं के अनरूु प होंगी ।”। 4. उक्त जनयमों के जनयम 126 में, िसवें और ग्यारहवें परंतुक का लोप दकया िाएगा । 5. उक्त जनयमों म ेंप्ररूप 22ख का लोप दकया िाएगा । [फा. स.ं आरटी-11028/02/2013-एमवीएल] महमूि अहमि, अपर सजचव रटप्पण : मलू जनयम, भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उपखंड (i) म ें अजधसचू ना सं. सा.का.जन. 590(अ), तारीख 2 िून, 1989 द्वारा प्रकाजित दकए गए थ े और अंजतम संिोधन सा.का.जन. 141(अ), तारीख 27 फ़रवरी, 2024 द्वारा दकया गया । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 6th March, 2024 G.S.R. 159(E).—WHEREAS, the draft of certain rules to amend the Central Motor Vehicles Rules, 1989, were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 724(E), dated the 5th October, 2023, in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby within a period of thirty days from the date on which copies of the official Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the said Gazette notification were made available to the public on the 6th October, 2023; AND WHEREAS, objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 NOW, THEREFORE, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:- 1. Short title and commencement.-(1) These rules may be called the Central Motor Vehicles (Fourth Amendment) Rules, 2024. (2) They shall come into force with effect from 1st September, 2025. 2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), in rule 47, in sub-rule (1), in clause (v), in sub-clause(g), the words, figures and letter, “and, in case of self-certification of the bus body built on a drive away chassis by a bus body structure fabricator, certificate of compliance in Form 22B” shall be omitted. 3. In the said rules, in rule 125C,- (a) in sub-rule (1), after the proviso and the Table, following proviso shall be inserted, namely:— “Provided further that, the testing and approval of body building of buses with seating capacity of 13 or more passenger excluding driver, by bus body builder shall be in accordance with AIS:052 (Revision 1)-2008 and shall be a type approved by the Test Agencies specified under rule 126.”; (b) in sub-rule (7), after clause (b), the following clause shall be inserted, namely:— “(c) The buses with seating capacity exceeding 22 passenger excluding driver, built by bus body builder shall meet the requirements as per AIS-153.”. 4. In the said rules, in rule 126, the tenth and eleventh provisos shall be omitted. 5. In the said rules, Form 22B shall be omitted. [F. No. RT-11028/02/2013-MVL] Mahmood Ahmed, Addl. Secy.
