(ख क) “प्राजधकृत समुरी िाहक” स े अजभप्राय उस िलयान के माजलक स े ह ै जिससे आयाजतत माल या जनयाडत माल या तटीय माल की ढुलाई हो रही हो या उसके दकसी एिेंट/या अन्द्य व्यजि स े ह ैं जिसे केन्द्रीय सरकार ने ऐसे िलयान के मामले म ेंउि अजधजनयम की धारा 30 की उप-धारा (1) के अंतगतड अजधसूजचत दकया हो; (ख ख) “प्राजधकृत रेन ऑपरेटर” स े अजभप्राय ऐसे रेन ऑपरेटर स े ह ै िो की आयाजतत माल या जनयाडत माल का िाहन कर रहा हो; (ख ग) “संरक्षक” स े अजभप्राय ऐस े व्यजि स े ह ै जिसे प्रधान आयुि या आयुि, सीमािुल्क द्वारा उि अजधजनयम की धारा 45 के उद्यश्े य स ेअनुमोजनत दकया गया हो;”; (ii) जिजनयम 3 के पश्चात जनम्नजलजखत जिजनयम को प्रजतस्ट्थाजपत दकया िाएगा, यथा: – “3क. पंिीकरण. – (1) प्राजधकृत िाहक को इन जिजनयमों के पठरजिष्ट के रूप म ें ददय े गय े फॉमड-II म ें पंिीकरण के जलए अजधकार क्षत्रे िाले प्रधान आयुि या आयिु , सीमािुल्क के यहााँ आिेदन करना होगा। (2) िहां अजधकार क्षत्रे िाला प्रधान आयुि या आयिु , सीमािुल्क, फॉमड-II म ें भरे गए आिेदन म ें दी गयी सूचना स े संतुष्ट ह ैतो िहा ं िह ऐसे आिेदक के पंिीकरण को, ऐसे पंिीकरण को िारी दकए िान े की तारीख स े तीन िर्ड की अिजध तक के जलए इन जिजनयमों के अंतगडत अपना कारोबार करने के जलए, अनुमोददत करेंगे। (3) अजधकार क्षत्रे िाल े प्रधान आयुि या आयुि, सीमािुल्क, ऐसी प्रारजम्भक तीन िर् ड की अिजध के समाप्त होने के पहल े ऐसे पंिीकरण की समीक्षा करेगा और िह ऐस े पंिीकरण को एक बार म ें पााँच िर् ड की और अिजध के जलए और दकसी प्राजधकृत इकनॉजमक ऑपरेटर के मामले म ेंदस िर्ड की अिजध के जलए बढ़ा सकता ह।ै (4) सी कागो मेंजनफेस्ट्ट और राजं िपमेंट रेग्युलिे नस, 2018, के जिजनयम 3 के अंतगडत प्राजधकृत िाहक के जलए यह माना िाएगा दक िह इन जिजनयमों के अंतगडत भी पंिीकृत ह।ै ” (iii) जिजनयम 4 म,ें उपिाक्ट्य (क) के स्ट्थान पर जनम्नजलजखत को प्रजतस्ट्थाजपत दकया िाएगा, यथा: – “(क) नेपाल को भेि े िान े िाल े कागो और नेपाल म ें अंजतम गतं व्य पत्तन की घोर्णा अराइिल मेंजनफेस्ट्ट म ें करेगा, यदद उसे सी कागो मेंजनफेस्ट्ट और रांजिपमेंट रेग्यलु ेिनस, 2018 म ें ऐसा करना िरूरी हो तो;” (iv) “फॉम”ड , को अब “फॉमड-I” कहा िाएगा और इस “फॉमड-I” के बाद जनम्नजलजखत “फॉमड-II” को अंत:स्ट्थाजपत दकया िाएगा, यथा: - “फॉम-ड II (देख े जिजनयम 3 क) पिं ीकरण के जलए आिदे न 1. आिेदक का नाम पेरमानेंट अकाउंट नंबर (पैन) का ब्योरा सजहत: - (यदद आिेदक कोई फ़मड या कंपनी ह ैतो फ़मड के प्रत्यके साझीदार या कंपनी के प्रत्येक जनदेिक, िैसी भी जस्ट्थजत हो, का नाम) 2. आिेदक की श्रणे ी (समुरी िाहक, प्राजधकृत रेन ऑपरेटर, जिपपग लाइन या संरक्षक):-[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 3. संपकड का ब्योरा:- फोन नंबर:- ईमेंल पता: - 4. आिेदक का परू ा पता: - (यदद आिेदक कोई फ़मड या कंपनी ह ैतो फ़मड के प्रत्येक साझीदार या कंपनी के प्रत्येक जनदेिक, िैसी भी जस्ट्थजत हो, का पूरा पता) 5. प्राजधकृत व्यजि का नाम और पता: - (यदद आिेदक कोई फ़मड या कंपनी ह ैतो, इसके साझीदार या साझीदारों जनदेिक या जनदेिकों या उन जिजधित प्राजधकृत कमडचाठरयों का नाम िो रांजिपमेंट की घोर्णा को भरने म ेंिास्ट्तजिक रूप स े सलं गन हो) । 6. ऐसे प्रत्येक व्यजि की िैक्षजणक योग्यता िो रांजिपमेंट की घोर्णा को भरन े म ेंिास्ट्तजिक रूप स े संलगन होंगे: - 7. आिेदक के जखलाफ सीमािुल्क अजधजनयम के अंतगडत दिड मामलों का ब्योरा, यदद कोई हो: - 8. संलगनक: - क) अनुबंध, या ख) समझौता ज्ञापन, या ग) करार, िो दक प्राजधकृत कराने िाल े जिदेिी एिेंट के साथ हुआ हो, की प्रजत। म/ैं हम, एतदद्वारा, घोर्णा करता ह/ाँ करती ह/ाँ करत े ह ैंकी उपयुडि परै ाग्राफ म ेंकही गयी बात ें मेरी/ हमारी सिोत्तम िानकारी म ें सत्य ह।ै ददनांक: - स्ट्थान: - आिेदक/ आिेदकों के हस्ट्ताक्षर” [फा.स.ं 554/02/2014-एलसी] आनंद राधाकृष्णन, उप सजचि ठटप्पणी: प्रधान अजधसूचना संख्या 68/2019- सीमािुल्क (ग.ैट.ै ), को सा. का. जन. 704 (अ), ददनांक 30 जसतंबर, 2019, के तहत, भारत के रािपत्र, असाधारण म ेंप्रकाजित दकया गया था। MINISTRY OF FINANCE (Department of Revenue) (CENTRAL BOARD OF INDIRECT TAXES AND CUSTOMS) NOTIFICATION New Delhi, the 31st July, 2020 No. 64/2020-Customs (N.T.) G.S.R. 484(E).—In exercise of the powers conferred by section 157 read with sub-section (1) of section 54 and section 143AA of the Customs Act, 1962 (52 of 1962), the Central Board of Indirect Taxes and Customs hereby makes the following regulations, to amend the Transhipment of Cargo to Nepal under Electronic Cargo Tracking System Regulations, 2019, namely: -4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 1. Short title and commencement. - (1) These regulations may be called the Transhipment of Cargo to Nepal under Electronic Cargo Tracking System (Amendment) Regulations, 2020. (2) They shall come into force on the day of their publication in the Official Gazette. 2. In the Transhipment of Cargo to Nepal under Electronic Cargo Tracking System Regulations, 2019, - (i) in the sub-regulation (1) of regulation 2, for clause (b), the following clauses shall be substituted, namely: - ―(b) ―authorised carrier‖ means an authorised sea carrier, authorised train operator or custodian, registered under regulation 3A; (ba) ―authorised sea carrier‖ means the master of the vessel carrying imported goods, export goods and coastal goods or his agent or any other person notified by the Central Government in terms of sub- section (1) of section 30 of the Act, in the case of a vessel; (bb) ―authorised train operator‖ means the train operator carrying imported goods and export goods; (bc) ―custodian‖ means a person approved by the Principal Commissioner or Commissioner of Customs, for the purposes of section 45 of the Act;‖; (ii) after regulation 3, the following regulation shall be inserted, namely: – ―3A. Registration. – (1) The authorised carrier shall apply to the jurisdictional Principal Commissioner or Commissioner of Customs for registration in the Form-II, appended to these regulations. (2) Where the jurisdictional Principal Commissioner or Commissioner of Customs is satisfied with the information provided by the applicant in Form-II, he shall approve the registration of such applicant for transacting business under these regulations for a period of three years from the date of issue of such registration. (3) The jurisdictional Principal Commissioner or Commissioner of Customs shall review the registration before the expiry of the initial period of registration of three years and may extend such registration to a further period of five years at a time and in case of an authorised economic operator for a period of ten years. (4) An authorised carrier registered under regulation 3 of the Sea Cargo Manifest and Transhipment Regulations, 2018, shall be deemed to be registered under these regulations.‖ (iii) in the regulation 4, for clause (a), the following shall be substituted, namely: – ―(a) declare the cargo destined to Nepal and the port of final discharge in Nepal in the arrival manifest, if he is required to do so as per the Sea Cargo Manifest and Transhipment Regulations, 2018;‖ (iv) the ―Form‖, shall be numbered as ―Form-I‖, and after Form-I as so numbered, the following ―Form-II‖ shall be inserted, namely: - ―FORM – II (See Regulation 3A) Application for Registration 1. Name of applicant with details of Permanent Account Number (PAN): - (In case the applicant is a firm or a company, the name of each of the partners of the firm or the directors of the company as the case may be) 2. Category of the applicant (authorised sea carrier, authorised train operator, shipping line or custodian): - 3. Contact details:- Phone number :- Email address: - 4. Full address of the applicant: - (In case the applicant is a firm or a company, the full address of each of the partners of the firm or the directors of the company as the case may be) 5.
