थान पेरोजलयम कापोरेिन जलजमटेड (एच.पी.सी.एल) द्वारा पाइपलाइन जबछाने के प्रयोिन के जलए उपयोग के अजधकार का अिनज के अपने आिय की घोषणा की थी; और उक्त असाधारण रािपत्र अजधसूचना की प्रजतया िनता को ताररख 28 िनवरी 2020 तक उपब् ध करा िी गई थी; और सक्षम प्राजधकारी न,े उक्त अजधजनयम की धारा 6 की उपधारा (1) के अधीन केन्द्रीय सरकार को ररपोट ज ि ेिी ह;ै और केन्द्रीय सरकार न,े उक्त ररपोट ज पर जवचार करन े के NATURAL GAS NOTIFICATION New Delhi, the 25th June, 2020 S.O. 2049(E).—Whereas by a notification of the Government of India in the Ministry of Petroleum and Natural Gas S.O.No.62(E) dated the 27th December 2019, issued under Sub-section (1) of Section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), published in the Extra Ordinary Gazette of India dated the 02nd January 2020, the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying pipeline in state of Andhra Pradesh for transportation of LPG, from Hassan (Karnataka) to Cherlapalli (Telangana) Pipeline by Hindustan Petroleum Corporation Limited (HPCL). And whereas copies of the said Extra Ordinary Gazette notification were made available to the public up to 28 January 2020. And whereas the competent authority has under Sub-section (1) of Section 6 of the said Act submitted report to the Central Government. And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein; Now, therefore, in exercise of the powers conferred by Sub-section (1) of the Section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline; And further, in exercise of the powers conferred by Sub-section (4) of Section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Hindustan Petroleum Corporation Limited (HPCL), free from all encumbrances. अवर सजचव NOTIFICATION New Delhi, the 25th June, 2020 S.O. 2050(E).—Whereas by a notification of the Government of India in the Ministry of Petroleum and Natural Gas S.O.No.62(E) dated the 27th December 2019, issued under Sub-section (1) of Section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), published in the Extra Ordinary Gazette of India dated the 02nd January 2020, the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying pipeline in state of Andhra Pradesh for transportation of LPG, from Hassan (Karnataka) to Cherlapalli (Telangana) Pipeline by Hindustan Petroleum Corporation Limited (HPCL). And whereas copies of the said Extra Ordinary Gazette notification were made available to the public up to 18 January 2020. And whereas the competent authority has under Sub-section (1) of Section 6 of the said Act submitted report to the Central Government. And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein; Now, therefore, in exercise of the powers conferred by Sub-section (1) of the Section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline; And further, in exercise of the powers conferred by Sub-section (4) of Section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Hindustan Petroleum Corporation Limited (HPCL), free from all encumbrances. पिचात उक्त अजधजनयम कहा गया ह)ै की धारा 3 की उपधारा (1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना संख्या का. आ. 62(अ) तारीख 27 दिसम्बर 2019, िो भारत के असाधारण रािपत्र तारीख 02 िनवरी 2020, म ें प्रकाजित की गई थी, द्वारा उस अजधसूचना स े संलग्न अनुसूची म ें जवजनर्िष्टज भूजम म ें आंध्रप्रिेि राज्य म ें हासन (कनाजटक) स े चेरलापल्ली (तले ंगाना राज्य) तक एल.पी.िी के पररवहन के जलए जहन्द्िस्ट्ु थान पेरोजलयम कापोरेिन जलजमटेड (एच.पी.सी.एल) द्वारा पाइपलाइन जबछाने के प्रयोिन के जलए उपयोग के अजधकार का अिनज के अपने आिय की घोषणा की थी; और उक्त असाधारण रािपत्र अजधसूचना की प्रजतया िनता को ताररख 29 िनवरी 2020 तक उपलब्ि करा िी गई थी; और सक्षम प्राजधकारी न,े उक्त अजधजनयम की धारा 6 की उपधारा (1) के अधीन केन्द्रीय सरकार को ररपोट जिे िी ह;ै और केन्द्रीय सरकार न,े उक्त ररपोट ज पर जवचार करन े के पश्चात, और यह समाधान हो िाने पर की उक्त भूजम पाइपलाइन जबछाने के जलए अपेजक्षत ह,ै उसम ें उपयोग के अजधकार का अिनज करने का जवजनश्चय दकया ह;ै32 THE GAZETTE OF INDIA : जवजनर्िष्टज भूजम म ें पाइपलाइन जबछान े के जलए उपयोग के अजधकार का अिजन दकया िाए; और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, यह जनिेि िेती ह ै की उक्त भूजम म ें उपयोग का अजधकार इस घोषणा के प्रकािन की तारीख स े केन्द्रीय सरकार म ें जनजहत होने के बिाए, सभी जवल्लंगमों स े मक्तु होकर जहन्द्िस्ट्ु थान पेरोजलयम कापोरेिन जलजमटेड (एच.पी.सी.एल) म ें जनजहत होगा । पेरोजलयम और खजनि पाइपलाइन अजधजनयम, 1962 दक धारा 10 के अधीन दकसी भी क्षजतपूर्तज के जलए जहन्द्िस्ट्ु थान पेरोजलयम कापोरेिन जलजमटेड (एच.पी.सी.एल) पूणजतया उत्तरिायी होगी और धारा 13 अधीन by a notification of the Government of India in the Ministry of Petroleum and Natural Gas S.O.No.62(E) dated the 27th December 2019, issued under Sub-section (1) of Section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), published in the Extra Ordinary Gazette of India dated the 02nd January 2020, the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying pipeline in state of Andhra Pradesh for transportation of LPG, from Hassan (Karnataka) to Cherlapalli (Telangana) Pipeline by Hindustan Petroleum Corporation Limited (HPCL). And whereas copies of the said Extra Ordinary Gazette notification were made available to the public up to 29 January 2020. And whereas the competent authority has under Sub-section (1) of Section 6 of the said Act submitted report to the Central Government. And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein; Now, therefore, in exercise of the powers conferred by Sub-section (1) of the Section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline; And further, in exercise of the powers conferred by Sub-section (4) of Section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Hindustan Petroleum Corporation Limited (HPCL), free from all encumbrances. Hindustan Petroleum Corporation Limited (HPCL) shall be exclusively liable for any compensation in terms of Section 10 of the P&MP Act, 1962 and according to Section 13, no suit, claim or legal proceeding would lie against the Central Government, Competent Authority or any State Government or Corporation for any matter relating to the pipeline. And whereas copies of the said Extra Ordinary Gazette notification were made available to the public up to 21 January 2020. And whereas the competent authority has under Sub-section (1) of Section 6 of the said Act submitted report to the Central Government. And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein; Now, therefore, in exercise of the powers conferred by Sub-section (1) of the Section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline; And further, in exercise of the powers conferred by Sub-section (4) of Section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Hindustan Petroleum Corporation Limited (HPCL), free from all encumbrances. Hindustan Petroleum Corporation Limited (HPCL) shall be exclusively liable for any compensation in terms of Section 10 of the P&MP Act, 1962 and according to Section 13, no suit, claim or legal proceeding would lie against the Central Government, Competent Authority or any State Government or Corporation for any matter relating to the pipeline. NOTIFICATION S.O. 62(E).—Whereas by a notification of the Government of India in the Ministry of Petroleum and Natural Gas S.O.No.62(E) dated the 27th December 2019, issued under Sub-section (1) of Section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), published in the Extra Ordinary Gazette of India dated the 2nd January 2020, the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying pipeline in state of Andhra Pradesh for transportation of LPG, from Hassan (Karnataka) to Cherlapalli (Telangana) Pipeline by Hindustan Petroleum Corporation Limited (HPCL). And whereas copies of the said Extra Ordinary Gazette notification were made available to the public up to 09 January 2020. And whereas the competent authority has under Sub-section (1) of Section 6 of the said Act submitted report to the Central Government. And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein; Now, therefore, in exercise of the powers conferred by Sub-section (1) of the Section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline; And further, in exercise of the powers conferred by Sub-section (4) of Section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Hindustan Petroleum Corporation Limited (HPCL), free from all encumbrances. And whereas copies of the said Extra Ordinary Gazette notification were made available to the public up to 05 February 2020. And whereas the competent authority has under Sub-section (1) of Section 6 of the said Act submitted report to the Central Government. And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein; Now, therefore, in exercise of the powers conferred by Sub-section (1) of the Section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline; And further, in exercise of the powers conferred by Sub-section (4) of Section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Hindustan Petroleum Corporation Limited (HPCL), free from all encumbrances. No. 61(E) dated the 27th December 2019, issued under Sub-section (1) of Section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), published in the Extra Ordinary Gazette of India dated the 02nd January 2020, the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying pipeline in state of Andhra Pradesh for transportation of LPG, from Hassan (Karnataka) to Cherlapalli (Telangana) Pipeline by Hindustan Petroleum Corporation Limited (HPCL). And whereas copies of the said Extra Ordinary Gazette notification were made available to the public up to 11 February 2020. And whereas the competent authority has under Sub-section (1) of Section 6 of the said Act submitted report to the Central Government. And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein; Now, therefore, in exercise of the powers conferred by Sub-section (1) of the Section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline; And further, in exercise of the powers conferred by Sub-section (4) of Section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Hindustan Petroleum Corporation Limited (HPCL), free from all encumbrances. Hindustan Petroleum Corporation Limited (HPCL) shall be exclusively liable for any compensation in terms of Section 10 of the P&MP Act, 1962 and according to Section 13, no suit, claim or legal proceeding would lie against the Central Government, Competent Authority or any State Government or Corporation for any matter relating to the pipeline.
