NOTIFICATION
New Delhi, the 19th February, 2014
S.O. 476(E).—Whereas, by the notification of the Government of India in the erstwhile Ministry of Surface
Transport, number S.O.660(E), dated the 27th September, 1996 and S.O.239(E) dated 24th March,1998, issued under
section 11 of the National Highways Authority of India Act,1988 (68 of 1988), the Central Government had entrusted the
stretches from km. 36.630 to km 162.500 in the States of Haryana and Rajasthan and from km. 11.000 to km. 36.630 in
the National Capital Territory of Delhi and the State of Haryana, of the National Highway No. 8 to the National
Highways Authority of India (hereinafter referred to as the “Authority”).
And whereas, the Authority had entered into a concession agreement on 18th April, 2002 (hereinafter referred to
as “agreement”) with M/s. JAYPEE DSC VENTURES LIMITED (now Delhi Gurgaon Super Connectivity Limited i.e.
DGSCL) having its registered office at Dundahera, Gurgaon-Delhi Border, Km. 24 Milestone, NH-8, Gurgaon – 122016
Also at E-9, 3rd Floor, South Extension-II, New Delhi–110049 (hereinafter referred to as “the Concessionaire”) for the
development and maintenance of National Highway No. 8 from km 14.300 to km 24.000 in the National Capital Territory
of Delhi and from km. 24.000 to km. 42.000 in the State of Haryana (hereinafter referred to as the “said section”).
And whereas, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of
1956), read with rule 3 of the National Highways (Collection of Fees by any person for the use of section of National
Highway/Permanent Bridge/Temporary Bridge on National Highway) Rules, 1997, the Central Government by
notification of the Government of India vide S.O. No. 994 (E) dated 18th June, 2007 authorized the Concessionaire for
levying and collecting fees on the mechanical vehicles for the use of the said section at the rates and at the toll plazas
specified in its schedule.
And whereas, Hon’ble High Court of Delhi vide Order dated 19th February, 2014 in OMP No. 288/2013 (filed by
DGSCL) and Execution Petition No. 88/2013 (filed by IDFC on behalf of the Senior Lenders) observed that the Authority,
the Concessionaire and the Senior Lenders have agreed that DGSCL be substituted in the said Concession Agreement by
SPV formed by the Senior Lenders (IDFC & Others) as a Selectee. And the liabilities and obligations of DGSCL are taken
over and assumed by IDFC and upon appointment of a new Selectee, the said obligations and liabilities shall be assumed
and taken over by the said new Selectee. It is further agreed between the parties that as the revised toll notification
becomes effective, no toll or user fee shall be collected from km. 24.000 toll plaza and the said toll plaza shall be¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
dismantled and accordingly, the user fee at km. 42.000 toll plaza now shall be the sum of user fee at km. 24.000 toll plaza
and that at km. 42.000 toll plaza previously.
Now, therefore, in view of the directions issued by the Hon’ble High Court of Delhi vide Order dated
19th February, 2014 in OMP No. 288/2013 and Execution Petition No. 88/2013, the Central Government, hereby notifies
that there shall be levied and collected fee on the mechanical vehicles for the use of the said section at the rates and toll
plazas specified in the schedule below and authorizes the Receiver/Selectee/New Concessionaire to collect and retain the
fees from the date of publication of this notification in the Official Gazette and until the termination date as specified in
the agreement.
SCHEDULE
The Fee shall be collected at two toll plazas, one at the end of the project at km 42.000 (sum of the user fee at km. 24.000
toll plaza and that at km. 42.000 toll plaza previously) of NH-8 (Kherki Daula village, District Gurgaon in the state of
Haryana) and second as side plaza at km. 19.100 of NH-8 (at the intersection with Indira Gandhi International Airport
road in the state of NCT of Delhi).

1. The aforesaid fee at columns (3), (4) and (5) shall be revised at the beginning of each financial year with effect from
1st April every year. The increase will be based on a fee revision Index Computed to two decimal places which has a
value of 1.00 as on April 1, 2005 and is increased based on wholesale price index as on 1st April every year. The
revised/actual fee shall be computed as follows :
Revised/Actual Fee = Base Fee × WPI-B

WPI-A = is the Wholesale Price Index as on 1st April, 2005 i.e. 191
WPI-B = is the Wholesale Price Index as on 31st December preceding the fee revision date.
The actual Fees to be charged shall be rounded off to the nearest one rupee.
2. The following vehicles shall be exempted from payment of user fee :—
“Ambulances, fire tenders and official vehicles transporting and accompanying the President of India, the Vice
President of India, the Prime Minister of India, Ministers of Government of India, Governors, Lt Governor,
Chief Ministers, Presiding Officers of Central and State Legislatures having jurisdictions, Ministers of State
Government, Judges of the Supreme Court of India and of the High Court having jurisdiction, Secretaries and6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Commissioner of State Government, Foreign Dignitaries on State visit to India, Heads of Foreign Missions
stationed in India using cars with CD symbol, Executive Magistrates, officers of Ministry of Road Transport &
Highways and National Highways Authority of India, person required to use the project for discharging their
statutory obligations in relation to the site, Independent Consultant and the Central and State Forces in uniform
including armed forces, para military forces and police”.
3. The rates of Fees, the Categories of vehicles exempted from payment of fee and the name, address and telephone
number of the Receiver/Selectee/New Concessionaire to whom complaints, if any, should be addressed, shall be
conspicuously and prominently displayed 500 metres ahead of the toll booth, 100 metres ahead of the toll booth and
at the toll booth also. The height of the display boards and size of letters being such that it is easy for drivers to read
the display boards.
4. A table of fees authorized to be collected on any section of National Highway/Permanent Bridge/Temporary Bridge
on National Highway shall be put up by such person in a conspicuous place near a fee collection booth legibly
written or printed in English, Hindi and the regional language of the area in which the National Highway is situated.
5. The Receiver/Selectee/New Concessionaire shall nominate an official as in-charge of fee collection and official so
nominated shall be responsible to ensure that fees is collected at not more than agreed rates and the Fee collection is
smooth without causing undue hardship to the road users, and for all other matters connected therewith.
6. The Receiver/Selectee/New Concessionaire shall not collect any fees from local personal traffic in excess of 50% of
the applicable fees for the specific category of vehicle and from local commercial traffic in excess of 66% of the
applicable fee for the specific category of vehicle at the two toll plazas as under provided the local traffic take a pass
for 40 trips valid for 30 days.

*Though as per Concession Agreement, the discount has to be calculated w.r.t. actual rates levied at the Toll Plaza, however, in the light of para (d) of
Exhibit A read with Exhibit D of the Hon’ble High Court of Delhi Order dated 19th February, 2014, local traffic at km. 42.000 will be charged as per
existing rate structure. Accordingly, the discount has been calculated by taking the rates leviable at km. 42.000 only and impact of km. 24.000, which
has been transferred to km. 42.000, has not been taken into account for calculating the discounted rate at km. 42.000.
The above rates shall be revised as per provisions given in para-1 above.
Provided that if a separate service lane is opened for free use by local traffic, the Receiver/Selectee/New Concessionaire
shall levy and collect fee from such local traffic, if they use the eight/six lane access controlled Highway.
7. The Receiver/Selectee/New Concessionaire shall get published the contents of this notification in two local
newspapers (one of which shall be in vernacular language).¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 7
8. For the purpose of this notification, unless the context otherwise requires :—
(i) “Local commercial traffic” means any commercial vehicle including buses, trucks, light motor vehicles or
taxis engaged in carrying goods and passengers registered with the Receiver/Selectee/New Concessionaire
at one of the toll plazas as plying routinely on the project highway without crossing more than one of the
toll plazas.
(ii) “Local personal traffic” means and includes a personal vehicle which is registered with the Concessionaire
at one of the toll plazas as plying routinely on the project highway without crossing more than one of the
toll plazas.
(iii) “Termination Date” means the date on which the said agreement entered into between the Authority and
the Receiver/Selectee/New Concessionaire expires pursuant to the provisions of the said agreement or is
terminated by a termination notice.
(iv) The words and expression used in this notification and not defined but defined in the agreement dated
18.04.2002 entered into between the Authority and the Concessionaire in respect of section from
Km. 14.300 to Km. 42.000 of the National Highway No. 8 shall have the same meanings as assigned to
them respectively in the said agreement.
