[जजसमें 39.343 दक.मी. की सड़क और 1057 मीटर की सरचनाएं िाजमल ह ै (जजनकी लम्बाइ 60 मीटर से ऄजधक ह)ै और जजसकी समकक्ष लम्बाइ 10.57 .मी. ह]ै हते ु सारणी 1 के स्ट्तम्भ (2) में जवजनर्ददष्ट दर पर (जजस े आसमें आसके प्‍ चात ् ‘‘अधार दर‘‘ कहा गया ह)ै , चार या ऄजधक लेन के खण्डों के ईपयोग के जलए नीचे सारणी 1 के स्ट्तम्भ (1) में जवजनर्ददष्ट प्रकार के वाहनों पर िुल्क ईद्ग्रहीत दकया जाएगा और नीच े सारणी 1 के स्ट्तम्भ (2) म ें जनर्ददष्ट वाहनों पर बाइपास के जलए जजसकी लंबाइ 23.10 दकमी ह ै , सारणी 1 के स्ट्तम्भ (2) में जवजनर्ददष्ट बेस रेट पर डेढ़ गनु ा (60 मीटर स े ऄजधक वाली संरचना को छोड़कर) िुल्क ईद्ग्रहीत दकया जाएगा ईि ररयायतग्राही को कायागरंभ करन े की तारीख को तथा ईस तारीख स े ऄथवा आस ऄजधसूचना के राजपत्र म ें प्रकािन पर, जो भी बाद म ें हो, करार म ें जवजनर्ददष्ट समापन की तारीख तक िल्ु क संग्रहीत तथा प्रजतधाररत करन े हते ु प्राजधकृत करती ह ै । यह िुल् क ऄजधसचू ना टीओटी पररयोजना पर कायागरंभ करने की तारीख से प्रभावी होगी:-[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3 सारणी 1 वाहन का प्रकार अधार वष ग2007-08 के जलए चार ऄथवा ऄजधक लने ों के रारा खण्ड ों के जलए प्रजत दक.मी.* िल्ु क की अधार दर (ूपपए म)ें (1) (2) कार, जीप, वैन या हल् के मोटर वाहन 0.65 हल् के वाजणजज्यक वाहन, हल् के माल वाहक वाहन ऄथवा जमनी बस 1.05 बस या रक (दो धुरी वाले) 2.20 तीन धरु ी वाल ेवाजणजज्यक वाहन 2.40 भारी संजनमागण मिीनरी (भा.स.ंम.) या ऄथ गमूलवग ईपस्ट् कर (ऄ.मू.ई.) या 3.45 बहुधुरीय वाहन (ब.ध.ु वा.) दरू ी हते ु िोध्य और संदेय होगाः िुल्क प्लाजा का ऄवस्ट्थान लम्बाइ (दकलोमीटर में) जजसके जलए िुल्क दर जजस पर िुल्क संदेय ह ै संदेय ह ै तूतीकोररन जजल ेमें सालइपुधरु गांव के 39.343 (0.345 दकमी की लबं ाइ की उपर साररणी-1 में ईजल्लजखत जनकट 125.350 दक.मी. पर संरचना को छोड़कर) अधार दरों का 100% 2 ईपरोि के ऄलावा 10 करोड़ रुपये से ऄजधक की लागत वाले जनम्नजलजखत बाइपास के ईपयोग के जलए जनर्ददष्ट बाइपास की लंबाइ ईसके जलए वषग 2020-21 के जलए माजसक पास की दर 275.00/- ूपपए (दो सौ पचहत्तर ूपपए मात्र) होगी और राष्ट्रीय राजमागग िुल्क (दरों का ऄवधारण और संग्रहण) जनयम, 2008 के ईपबंधों के ऄनुसार ईसम ेंप्रत्येक वषग संिोधन दकया जायेगा । 5. राजमागग खण्ड पर बहुयात्रा) हते ु पास जनम्नजलजखत दरों पर जारी दकया जाएगा, ऄथागतः् संदेय राजि ऄनुज्ञात एकतरफा यात्रा) जवजधमान्द्यता की ऄवजध की ऄजधकतम संख्या एकतरफा यात्रा के जलए िल्ु क का डेढ़ गुना दो संदाय के समय से चौबीस घंटे पचास या ऄजधक एकल यात्रा) के जलए संदेय पचास या ऄजधक संदाय की तारीख से एक मास िुल्क की राजि का दो-जतहाइ 6. जजस जजले में िुल्क प्लाजा पड़ता ह ै ईस जजले में पंजीकृत वाजणजज्यक वाहन (राष्ट्रीय परजमट के ऄधीन चल रह े वाहनों को छोड़कर) के जलए िुल्क ईस श्रणे ी के जलए वाहन के जलए जनधागररत िल्ु क का 50% होगा बिते के ऐस े वाजणजज्यक वाहनों के ईपयोग के जलए कोइ सर्शवस रोड ऄथवा वैकजल्पक सड़क ईपलब्ध न हो । 7. जो यांजत्रक वाहन ऄपनी श्रेणी के जलए जनधागररत ऄनुज्ञेय भार की ऄपेक्षा ऄजधक भार से लदा हुअ होगा ईसके चालक ऄथवा माजलक ऄथवा प्रभारी व्यजि को ऐसे ऄजधक भार से लदे हुए वाहन को राष्ट्रीय राजमागग में प्रवेि कराने के जलए िल्ु क संग्रहण एजेंसी को रारा िल्ु क जनयम 2008 के जनयम 10 के ईप जनयम (1ए) के ऄनुसार िुल्क का भुगतान करना होगा और ईसे राजमाग ग खण्ड का ईपयोग करन े की तब तक ऄनुमजत नहीं होगी जब तक दक ऐसे यांजत्रक वाहन स े ऄजधक भार को हटा नहीं ददया जाए। 8. यांजत्रक वाहनों की श्रणे ी, ईनके जलए ऄनुज्ञेय भार, छूट-प्राप्त वाहनों की श्रणे ी, सर्शवस रोड, वैकजल्पक सड़क अदद सजहत सभी पररभाषाएं जनयमों में जवजनर्ददष्ट पररभाषा) के ऄनुसार होंगी । 9. ईि जनयमों के जनयम 12 के ऄनुसार, ईपयोगकताग) की जानकारी के जलए िल्ु क की दरें प्रदर्शित की जाएगं ी। 10. उपर सारणी-1 में यथा-ईजल्लजखत, अधार वषग 2007-08 के जलए प्रजत दकलोमीटर िुल्क की अधार दर के अधार पर, यांजत्रक वाहनों से जलए जानेवाल े वास्ट्तजवक िल्ु क और कटौजतयों की गणना प्राजधकरण द्वारा खंडों की पूरी कर ली गइ लम्बाइ के अधार पर की जायेगी और ईसम ेंईि जनयमों के जनयम 5 के ऄनुसार वार्शषक तौर पर संिोधन दकया[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5 जाएगा तथा ईस,े तदनुसार, ऄंग्रेजी और स्ट्थानीय भाषा के कम-स-े कम एक-एक समाचार पत्र में प्रकाजित दकया जाएगा, परंतु ितग यह ह ै दक िुल् क म ें जपछली बार की गइ वृजधि की तारीख से 6 माह की ऄवजध के भीतर कोइ संिोधन नहीं दकया जाएगा। [फा. सं. भाराराप्रा/13013/650/सीओ/19-20 Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 465 (E) dated 26.04.2002, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from km 0.000 to km 231.600 (Madurai to Kanyakumari Section) of National Highway No. 7 in the State of Tamilnadu to the National Highways Authority of India (hereinafter referred to as the “Authority”); And whereas, in exercise of the powers conferred by Section 7 of the National Highway Act, 1956 (48 of 1956) read with Rule (3) of the National Highway Fee (Determination of Rates and Collection) Rules 2008, the Central Government by notification of the Government of India authorized Authority for levying and collecting fee on mechanical vehicles for the use of stretches as follows: Vide S.O.No. 2009(E) dated 18th May, 2018 for the section from km 0.000 to km 231.600 (New Chainage 0.000 to km 243.170) of NH- 7 in the State of Tamilnadu. And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement (hereinafter referred to as said agreement) with M/s Salaipudhur-Madurai Tollway Limited, having its registered office at 5th Floor, OSE Commercial Block, Hotel Aloft, Asset No. 5B, Aerocity IGI Airport, New Delhi, South West Delhi -110037, (hereinafter referred to as the “Concessionaire”), on 27.12.2019 for the bid submitted on 11.11.2019 for the Tolling, Operation, Maintenance and Transfer (ToT mode) of Madurai to Kanyakumari Section from Km 116.500 to Km 180.000 (length 63.500 Km) of NH-7 in the state of Tamilnadu (hereinafter referred to as the said section) of the National Highway; Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 [GSR 838 (E) dt. 05.12.2008] read along with National Highways Fee (Determination of Rates and Collection) Amendment Rules, 2010 [GSR 950(E) 03.12.2010], National Highways Fee (Determination of Rates and Collection) Amendment Rules, 2011 [GSR 15(E) 12.01.2011], National Highways Fee (Determination of Rates and Collection) Second Amendment Rules, 2011 [GSR 756 (E) 12.10.2011], National Highways Fee (Determination of Rates and Collection) Amendment Rules, 2013 [GSR 778(E) 16.12.2013], National Highways Fee (Determination of Rates and Collection) Amendment Rules, 2014 [GSR 26(E) 16.01.2014], National Highways Fee (Determination of Rates and Collection) Amendment Rules, 2014 [GSR 831(E) 21.11.2014], National Highways Fee (Determination of Rates and Collection) Amendment Rules, 2014 [GSR 02(E) 29.12.2014], National Highways Fee (Determination of Rates and Collection) Amendment Rules 2015 [GSR 220(E) 23.03.2015], National Highways Fee (Determination of Rates and Collection) Amendment Rules 2016 [GSR 585(E) 08.06.2016], National Highways Fee (Determination of Rates and Collection) Amendment Rules 2016 [GSR 1114(E) 02.12.2016], The National Highways Fee (Determination of Rates and Collection) Amendment Rules, 2017 [GSR 248(E) 14.03.2017] and The National Highways Fee (Determination of Rates and Collection) Amendment Rules, 2018 [GSR 920(E) 25.09.2018] and any other amendments till bid due date and in supersession of the Notification Number S.O. No. 2009(E) dated 18th May, 2018 except as respect things done or omitted to be done before such supersession, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said Section of said National Highway, interest on the capital invested, reasonable return, the volume of traffic and the period of said agreement entered between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles at the rate specified in column (2) of the Table 1 for total equivalent road length of 49.913 km [including 39.343 km road and 1057 m of structures (having length more than 60m) with equivalent length of 10.57 km] for use of four and more lane sections (hereinafter referred to as “base rate”) and at one and one half times the base rate specified in columns (2) of the Table 1 for bypasses having length of 23.10 km (excluding structure length having more than 60 m) on the Type of Vehicles specified in column (1) of the Table 1 below and authorizes the said Concessionaire to collect and retain the fee on and from the Appointed Date or publication of this Notification in the Official Gazette,6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] whichever is later, till the date of termination as specified in the agreement. This fee notification shall be effective from the Appointed Date of the ToT project. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 275.00 (Rupees Two Hundred Seventy Five only) for the year 2020-21 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008. 5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely : Amount Payable Maximum number of one way Period of validity journeys allowed One and half times of the fee for one way Two Twenty four hours from the time of journey payment Two-third of amount of the fee payable for Fifty or more One month from date of payment fifty or more single journeys 6. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, as per Rule 10 (1A) of NH Fee Rule 2008 and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules. 9. The Fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules. 10. Based on the Base Rate of Fee per km for the base year 2007-08 as mentioned in Table-1, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of completed length of the Project Highway. The same shall be got published by the Authority through the Concessionaire in at least one newspaper, each in English and vernacular language and thereafter revised annually in accordance with the rule 5 of the said rules and provision of Concession Agreement and got published, provided that no revision shall be effected within a period of 6 (six) months from the date of the preceding revision of Fee.
