(संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ परित उपधारा (1) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, िारी करन े का प्रस्ट्ताव करती ह,ै पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) की अपेक्षानुसार, इस िनसाधारण की िानकारी के जलए, एतद्वारा प्रकाजित दकर्ा िाता ह;ै जिनके उससे प्रभाजवत होने की संभावना ह,ै और एतद्वारा र्ह सूजचत दकर्ा िाता ह ै दक उि प्रारूप अजधसूचना पर, उस तारीख स,े जिसको इस अजधसूचना को अंतर्वाष्ट करन े वाले भारत के रािपत्र की प्रजतर्ां िनसाधारण को उपलब्ध करा िी िाती ह,ैं साि दिनों की अवजध की समाजि पर उप-संभाग म ें हथित ह ै और चम्बा वन्यजीव संभाग के प्रशासहनक हनयंत्रण के अंतगगत आता ह।ै यह अभयारण्य मूलत: अहिसूचना स.ं एफटी.-1/48 ददनांक 1 जुलाई, 1949 के द्वारा गेम अभयारण्य के रूप म ें अहिसूहचत दकया गया िा। हनयम और हवहनयम भारतीय वन अहिहनयम, 1927 और पंजाब वन्यजीव संरक्षण अहिहनयम, 1959 के अिीन बनाए गए िे। यह क्षत्रे वन्यजीव (संरक्षण) अहिहनयम, 1972 के तहत स.ं 5-11/70-एसएफ ददनांक 27 माच,ग 1974 के द्वारा वन्यजीव अभयारण्य घोहित दकया गया िा। यौहिकीकरण के बाद नवीनतम अहिसूचना स.ं एफएफई-बी-एफ (6)-11/2005-II ददनांक 7 जून, 2013 को जारी की गई िी; और, गमगलु -सीयाबेही वन्यजीव अभयारण्य अक्षांशों 320 47’52”उ से 320 55’ 67”उ और देशातं रों 75047’88” पू स े 75058’44” प ू के बीच हथित ह ै जो दक भारतीय सवेक्षण टोपोशीट स.ं 43पी/13 पैमाना 1:50,000 के अंतगतग आता ह।ै गमगलु -सीयाबेही वन्यजीव अभयारण्य चम्बा हजले के सलौनी उप-संभाग म ें हथित ह ै और चम्बा वन्यजीव संभाग के प्रशासहनक हनयंत्रण के अंतगतग आता ह।ै संरहक्षत क्षत्रे का कुल क्षेत्रफल 108.40 वग ग दकलोमीटर ह;ै और, यह अभयारण्य सीउल नाला (रावी नदी की सहायक नदी) के जलग्रहण क्षत्रे म,ें पयागवास स े दरू और दरू थि क्षत्रे म ें हथित ह।ै इस अभयारण्य के आदश ग पयागवास के हलए इसम ें वनथपहत की प्रजाहतयों जैसे देवदार (सेडरूस िेवदार), कैल (हपनस वाहललहचअना), स्ट्प्रूस (हपकेया हथमिीअना), जसल्वर फीर (एहबस पपंड्रोव), बान (क्वेरकस सेमीकापोफोजलर्ा), पपंक बुरांस (रोडोडेंड्रोन कैम्पैनलु ैटम), आदद का वास ह;ै और, अभयारण्य से मुख्य जीवजंतु कस्ट्तूरी जहरन (मोस्ट्चस मोस्ट्चीफेरूस), तेंिआु जबल्ली (जप्रर्नैलुरस बगेंालेंजसस), सामान्द्र् तेंिआु (पैंथरेा पाडास), काला भाल ू (उरसुस जथबेटेनस), जहमालर्न गोरल (नेमोरहडेस गोरल), र्ेलो थ्रोटेड माटेन (माटेस फ्लाजवगलु ा), लाल लोमडी (वुलपेस वुलपस), कोकलास (पुकाराजसर्ा मैक्रोलोफा), कालीि (लोफुरा ल्र्ूकोमेलानोस), चकोर (अलेक्टोररस चुकार), आदद उपलब्ि ह।ै यहां वृक्षावृत क्षेत्रों का अच्छा इन्टरफेस और चरागाहों का बृहत् हवथतार ह ैजो पशुओं के साि-साि पहक्षयों के हलए आदश गपयागवास बनाता ह;ै और, ऊंचाई और अवहथिजत के साि वन फसल का संघटन हवहवि ह।ै बृहत ् पत्ती प्रजाहतयााँ शुद्ध और हमहित रूप में उच्च ऊंचाई शंकुवृक्षों जैसे देवदार, कैल, फीर और थप्रूस के रूप में हनचला ऊंचाई म ें समशीतोष्ण क्षत्रे म ें उग रह े ह।ैं दहक्षणी अवहथिजत म ें कैल प्रमुख ह,ै जबदक शीतलक थिानों म ें देवदार, फर और थप्रूस पाए जाते ह।ैं अलपाइन क्षत्रे म ें चरागाह और खडी चट्टानें हवद्यमान ह।ैं जैव-भौगोहलक रूप स,े अभयारण्य का क्षत्रे हहमालयी पार क्षत्रे के अंतगतग आता ह;ै और, गमगलु -सीयाबेही वन्यजीव अभयारण्य एक तरफ से हहमाचल प्रदेश के चुराह वन संभाग और अन्य तरफ पर जम्मू एवं कश्मीर राज्य स े हघरा हुआ ह।ै अभयारण्य के समीपवती चुराह वन संभाग के क्षत्रे म ें बत्तीस ग्राम ह ैं जबदक अभयारण्य का समीपवती जम्मू एवं कश्मीर का क्षत्रे उच्च पवगत चोटटयों, बफग स े हघरा हुआ और पयागवास स े मुि ह।ै अतः अभयारण्य की सीमा से एक दकलोमीटर की चौडाई वाला 28.90 वर्ग दकलोमीटर (चुराह वन संभाग का क्षत्रे ) से युि पाटरहथिहतकी संवेदी जोन प्रथताहवत ह;ै और, गमगलु -सीयाबेही वन्यजीव अभयारण्य के चारों ओर के क्षेत्र को, जिसका जवस्ट्तार और सीमाएं इस अजधसूचना के पैराग्राफ 1 में जवजनर्िष्टा ह,ैं पाररजस्ट्थजतकी, पर्ाावरणीर् और िैव-जवजवधता की िजृ ष्ट स े पाररजस्ट्थजतकी संवेिी िोन के रूप में सुरजक्षत और सरं जक्षत करना तथा उि पाररजस्ट्थजतकी संवेिी िोन म ें उद्योगों र्ा उद्योगों की श्रेजणर्ों के प्रचालन तथा प्रसंस्ट्करण को प्रजतजिद्ध करना आवश्र्क ह;ै[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 अतः अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्मावली, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इसमें इसके पश्चात ् पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की उपधारा (1) तथा धारा 3 की उपधारा (2) के खंड (v) और खंड (xiv) एवं उपधारा (3) के द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, जहमाचल प्रदेश राज्र् के हजला चम्बा म ें गमगुल-सीयाबेही वन्यजीव अभयारण्य की सीमा के चारों ओर शून्य स े 1.00 दकलोमीटर तक जवस्ट्ताररत क्षेत्र को पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके पश् चात् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अिागत:् - 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमा-(1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार गमगलु -सीयाबेही वन्यजीव अभयारण्य की सीमा के चारों ओर शून्य स े 1.00 दकलोमीटर तक हवथतृत ह ै और पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल 28.90 वगा दकलोमीटर ह।ै राज्य द्वारा पाटरहथिहतकी संवेदी जोन का शून्य हवथतार उहचत ठहराया गया ह ै दक “वन्यजीव अभयारण्य की सीमा उत्तर-पूवी और उत्तर-पहिमी भाग पर जम्मू और कश्मीर की राज्य सीमा के साि सह समाप्त होती ह।ै अत:, इन ददशाओं म ें पाटरहथिहतकी संवेदी जोन को प्रथताहवत नहीं दकया गया ह ै और यह हसफग दहक्षणी भाग के साि प्रथताहवत दकया गया ह।ै” (2) गमगलु -सीयाबेही वन्यजीव अभयारण्य और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का हववरण अनलु ग्नक-I के रूप में संलग्न ह।ै (3) सीमा जववरण और अक्षांि और ििे ांतर के साथ पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करत े हुए गमगलु -सीयाबेही वन्यजीव अभयारण्य के मानजचत्र अनलु ग्नक –IIक, अनलु ग्नक-IIख और अनलु ग्नक-IIग के रूप में संलग्न ह।ै (4) पाररजस्ट्थजतकी संवेिी िोन और गमगलु -सीयाबेही वन्यजीव अभयारण्य की सीमा के भू-जनिेिांकों की सूची अनलु ग्नक - III की सारणी क और सारणी ख म ेंिी गई ह।ै (5) मुख्य पबंदओंु के भू-हनदेशाकं ों के साि पाररजस्ट्थजतकी संवेिी िोन के अंतगात आन े वाल े ग्रामों की सूची अनलु ग्नक -IV के रूप म ें संलग्न ह।ै 2. पाररजस्ट्थजतकी संविे ी िोन के जलए आचं जलक महार्ोिना.–(1) राज्र् सरकार, द्वारा पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिन के जलए, रािपत्र म ें अंजतम अजधसूचना के प्रकािन की तारीख स े िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और इस अजधसूचना में दिए गए अनुबंधों का पालन करते हुए, राज्र् सरकार के सक्षम प्राजधकारी के अनुमोिनाथ ा एक आंचजलक महार्ोिना बनाई िार्ेगी। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसूचना में जवजनर्िष्ा ट रीजत स े तथा प्रासंजगक केंरीर् और राज्र् जवजधर्ों के अनुरूप तथा केंरीर् सरकार द्वारा िारी दििा जनििे ों, र्दि कोई हों, के अनुसार बनार्ी िाएगी। (3) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी और पर्ाावरण सबं ंधी सरोकारों को िाजमल करने के जलए इसे राज्य सरकार के जनम्नजलजखत जवभागों के परामिा से बनार्ा िाएगा, अथाात:् (i) पर्ाावरण; (ii) वन और वन्द्र्िीव; (iii) कृजि; (iv) रािस्ट् व;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (v) िहरी जवकास; (vi) पर्ाटन; (vii) ग्रामीण जवकास; (viii) पसंचाई और बाढ़ जनर्ंत्रण; (ix) नगरपाहलका; (x) पंचार्ती राि; (xi) हहमाचल प्रदेश राज्र् प्रििू ण जनर्ंत्रण बोडा; और (xii) लोक जन मााण जव भाग। (4) िब तक इस अजधसूचना में जवजनर्िष्टा न हो, आंचजलक महार्ोिना में वतामान में अनमु ोदित भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा तथा आचंजलक महार्ोिना में सभी अवसंरचनाओं और दक्रर्ाकलापों में सुधार करके उन्ह े अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनान ेकी व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना म ें वनरजहत और अवक्रजमत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, जलग्रहण क्षेत्रों के प्रबंधन, िल-हवभाजन के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी एव ं पर्ाावरण के ऐसे अन्द्र् पहलओंु की व्यवस्ट्था की िाएगी जिन पर ध्र्ान दिय े िान ेकी आवश्र्कता ह।ै (6) आंचजलक महार्ोिना में सभी जवद्यमान पूिा स्ट् थलों, ग्रामों एवं िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों एवं दकस्ट् मों, कृजि क्षेत्रों, उपिाऊ भूजम, उद्यानों एवं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा का सहार्क मानजचत्र के साथ जनधाारण दकर्ा िाएगा और वतगमान और प्रस्ट्ताजवत भू-उपर्ोग की जविेिताओं का ब्र्ौरा भी दिर्ा िाएगा। (7) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी संवेिी िोन म ें होने वाले जवकास का जवजनर्मन दकर्ा िाएगा और सारणी में र्थासूचीबद्ध पैराग्राफ 4 में प्रजतजिद्ध एव ं जवजनर्जमत दक्रर्ाकलापों का पालन दकर्ा िाएगा। इसमें स्ट् थानीर् िनता की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनश्चर् एवं संवधान दकर्ा िाएगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) इस प्रकार अनुमोदित आचं जलक महार्ोिना, जनगरानी सजमजत के जलए एक संिभा िस्ट्तावेि होगी तादक वह इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपने कताव्यों का जनवाहन कर सके । 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्:- (1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खुल े स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा संपररवतान अनुमत्र् नहीं दकर्ा िाएगा: परंत ु पाररजस्ट्थजतकी संवेिी िोन के भीतर भाग (क), म ें जवजनर्िष्टा प्रर्ोिन स े जभन्न प्रर्ोिन के जलए कृजि और अन्द्र् भूजम का संपररवतान, मानीटरी सजमजत की जसफाररि पर और सक्षम प्राजधकारी के पूवा अनमु ोिन स े क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा र्था लाग ू केन्द्रीर् सरकार एव ं राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन तथा इस अजधसूचना के उपबंधों के अनुसार स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् िरूरतों को पूरा करने के जलए अनुमत्र् दकर्ा िाएगा िैसे:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (i) जवद्यमान सड़कों को चौड़ा करना, उन्द्ह ेंसुिढ़ृ करना और नई सड़कों का जनमााण करना; (ii) बुजनर्ािी ढाचं ों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रििू ण उत्पन्न न करने वाल े लघ ुउद्योग; (iv) कुटीर उद्योग एव ं ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाए ं तथा गहृ वास; और (v) पैराग्राफ-4 में उजल्लजखत बढ़ावा दिए गए दक्रर्ाकलापः परंत ु र्ह भी दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म के अधीन सक्षम प्राजधकारी के पूवा अनमु ोिन के जबना तथा राज्र् सरकार के अन्द्र् जनर्मों एवं जवजनर्मों एवं संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगता अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का प्रर्ोग अनुमत्र् नहीं होगा: परंत ु र्ह भी दक पाररजस्ट् थजतकी संवेिी िोन के अतं गता आने वाली भूजम के अजभलेखों म ें हुई दकसी त्रुरट को, मानीटरी सजमजत के जवचार प्राि करन े के पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामल े म ें एक बार सुधारा िाएगा और उि त्रुरट को सुधारन े की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह भी दक उपर्ुाि त्रुरट को सुधारन े म,ें इस उप-पैरा में र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भू- उपर्ोग का पररवतान िाजमल नहीं होगा। (ख) अनुप्रर्िु र्ा अनुत् पािक कृजि क्षेत्रों में वनीकरण तथा पर्ाावास की बहाली कायगकलापों के द्वारा पुन:वनीकरण दकया जाएगा। (2) प्राकृजतक िल स्रोत.- आंचजलक महार्ोिना में सभी प्राकृजतक िलमागों के आवाह क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना में उनके संरक्षण और बहाली की र्ोिना सजम् मजलत की िाएगी और राज्र् सरकार द्वारा िल आवाह प्रबंधन र्ोिना इस रीजत से बनाई िाएगी दक ऐस े क्षेत्रों म ें और इनके आस-पास जवकास दक्रर्ाकलापों को प्रजतजिद्ध रखा जाए । (3) पर्टा न एव ं पाररजस्ट्थजतकी पर्टा न.– (क) पाररजस्ट्थजतकी संवेिी िोन में सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संविे ी िोन के हलए तय पर्ाटन महार्ोिना के अनुसार अनमु त्य होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् सरकार के पर्ाावरण और वन जवभाग के परामिा स े राज्य सरकार के पर्ाटन जवभाग द्वारा बनार्ी िाएगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का घटक होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबधं ी दक्रर्ाकलाप जनम्न ानुसार जवजनर्जमत दकए िाएंग,े अथाात:्- (i) संरहक्षत क्षत्रे की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनम ें िो भी अजधक जनकट हो, दकसी होटल र्ा ररिॉटा का नर्ा सजन्नमााण अनुमत्य नहीं होगा:6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] बशते, पाररजस्ट्थजतकी पर्ाटन सजु वधाओं के जलए संरहक्षत क्षत्रे की सीमा से एक दकलोमीटर की िरू ी स े परे पाररजस्ट्थजतकी संवेिी िोन की सीमा तक पूवा पररभाजित और अभीजहत क्षेत्रों में पर्ाटन महार्ोिना के अनुसार, नए होटलों और ररिॉटा की स्ट्थापना अनुमत्य होगी; (ii) पाररजस्ट्थजतकी संवेिी िोन के अन्द्िर सभी नए पर्ाटन दक्रर्ा-कलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा िारी दििाजनिेिों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेने वाल े राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी दििाजनिेिों (समर्-समर् पर र्था सिं ोजधत) के अनुसार होगा; (iii) आंचजलक महार्ोिना का अनुमोिन होने तक, पर्ाटन के जवकास और जवद्यमान पर्टा न दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा मानीटरी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमत्र् दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन में दकसी नए होटल, ररिॉट ा र्ा वाजणजज्र्क प्रजतष्ठान का संजन्नमााण अनुमत्र् नहीं होगा । (4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन के अंतगता आने वाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पूल ररिवा क्षत्रे , िैल संरचना, िल प्रपात, झरन,े िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (6) ध्व जन प्रििू ण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रििू ण (जवजनर्मन और जनर्त्रं ण) जनर्म, 2000 में जनर्त उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रििू ण का हनवारण और जनर्ंत्रण दकया जाएगा । (7) वार् ु प्रििू ण.- पाररजस्ट्थजतकी संवेिी िोन म,ें वार्ु प्रििू ण का जनवारण और जनर्ंत्रण वार्ु (प्रििू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकया जाएगा । (8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत बजहस्राव का जनस्ट्सारण, पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आन े वाले पर्ाावरणीर् प्रििू कों के जनस्ट्सारण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक किोर हो, के उपबधं ों के अनुसार होगा। (9) िोस अपजिष्ट.- िोस अपजिष्ट का जनपटान एवं प्रबन्द्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं. का.आ. 1357(अ), दिनांक 8 अप्रैल, 2016 के तहत प्रकाजित िोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन स ेबाहर जचजन्द्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन (ईएसएम) अनुमत्र् दकर्ा िार्ेगा। (10) िैव जचदकत्सा अपजिष्ट .- िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्–समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016 के तहत प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुमत्र् दकर्ा िार्ेगा। (11) प्लाजस्ट्टक अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 के तहत प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबधं ो के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 317(अ), तारीख 29 माचा, 2016 के तहत प्रकाजित संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित तथा समर्-समर् पर र्था संिोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) सड़क-र्ातार्ात.- सड़क-र्ातार्ात को पर्ाावास-अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध म ें आंचजलक महार्ोिना में जवििे उपबंध िाजमल दकए िाएंग।े आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी स े अनुमोदित होन े तक, हनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके तहत बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार सड़क-र्ातार्ात के अनुपालन की हनगरानी करेगी। (15) वाहन िजनत प्रििू ण.- वाहन िजनत प्रििू ण की रोकथाम और जनर्ंत्रण लाग ू जवजधर्ों के अनुसार दकर्ा िाएगा। और स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएगं े । (16) औद्योजगक ईकाइर्ा.ं - (i) सरकारी रािपत्र म ें इस अजधसचू ना के प्रकािन की तारीख को र्ा उसके बाि पाररजस्ट्थजतकी संवेिी िोन म ें दकसी नए प्रििू णकारी उद्योग की स्ट्थापना अनमु त्र् नहीं होगी। (ii) िब तक इस अजधसूचना म ें जवजनर्िष्टा न हो, पाररजस्ट्थजतकी संवेिी िोन म ें केंरीर् प्रििू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी दििाजनिेिों म ें दकए गए उद्योगों के वगीकरण के अनुसार केवल गैर-प्रििू णकारी उद्योगों की स्ट्थापना अनुमत्र् होगी। इसके अजतररि, गैर-प्रििू णकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा। (17) पहाड़ी ढलानों का सरं क्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना म ें पहाड़ी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी संजनमााण की अनज्ञु ा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खड़ी पहाड़ी ढलानों म ें अत्र्जधक भ-ू क्षरण होता ह ै उनम ें दकसी भी संजनमााण की अनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी सवं िे ी िोन म ें प्रजतजिद्ध र्ा जवजनर्जमत दकए िान े वाल े दक्रर्ाकलापों की सचू ी- पाररजस्ट्थजतकी संवेिी िोन म ें सभी दक्रर्ाकलाप, पर्ाावरण अजधजनर्म उसके अधीन बने जनर्मों के उपबंधों जिसमें तटीर् जवजनर्मन िोन, 2011 एवं पर्ाावरणीर् प्रभाव आकलन अजधसूचना, 2006 िाजमल ह ै सजहत वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का माननीर् उच्चतम न्द्र्ार्ालर् के आदेश 4 अगस्ट्त, 2006 और 2012 की ररट र्ाजचका (जसजवल) सं. 435 म ें गोवा फाउंडेिन बनाम भारत संघ के मामले म ें तारीख 21 अप्रलै , 2014 के आिेि के अनुसरण म ें होगा । 2. प्रििू ण (िल, वार्,ु मृिा, ध्वजन, पाररजस्ट्थजतकी संवेिी िोन म ें कोई नर्ा उद्योग लगाने और वतामान आदि) उत्पन्न करन े वाल े उद्योगों की प्रििू णकारी उद्योगों का जवस्ट्तार करने की अनमु त्य नहीं होगीः स्ट्थापना । िब तक दक इस अजधसूचना में जवजनर्िष्टा न हो, पाररजस्ट्थजतकी संवेिी िोन में फरवरी, 2016, में केंरीर् प्रििू ण जनर्ंत्रण बोडा द्वारा िारी दििाजनिेिों म ें दकए गए उद्योगों के वगीकरण के अनुसार केवल गैर- प्रििू णकारी उद्योगों की स्ट्थापना होगी और इसके अजतररि, गैर- प्रििू णकारी कुटीर उद्योगों को प्रोत्साहन दिर्ा िाएगा। 3. बड़ी िल जवद्युत पररर्ोिनाओं की प्रजतजिद्ध। स्ट्थापना । 4. दकसी पररसंकटमर् पिाथ ा का प्रर्ोग प्रजतजिद्ध। र्ा उत्पािन र्ा प्रस्ट्संकरण । 5. प्राकृजतक िल जनकार्ों र्ा भूजम क्षेत्र प्रजतजिद्ध। में अनुपचाररत बजहस्रावों का जनस्ट्सारण । 6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा जमलों का जवस्ट्तार अनुमत्र् नहीं होगा । 7. ईंट भट्टों की स्ट्थापना करना। प्रजतजिद्ध। 8. िलावन लकड़ी का वाजणजज्र्क प्रजतजिद्ध। उपर्ोग। 9. पॉजलथीन बगै का उपर्ोग। प्रजतजिद्ध। ख.जवजनर्जमत दक्रर्ाकलाप 10. होटलों और ररसोटों की वाजणजज्र्क पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हते ु लघु अस्ट्थार्ी संरचनाओं के स्ट्थापना । जनमााण के जसवार्, संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना अनुमत्य नहीं होगी: परंतु, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनम ें िो भी अजधक जनकट हो, पर्ाटन महार्ोिना और लागू दििाजनिेिों के अनुसार सभी नए पर्ाटन दक्रर्ाकलाप करने र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार करन े की अनुज्ञा होगी । 11. संजनमााण दक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक िो भी जनकट हो, दकसी भी प्रकार का वाजणजज्र्क संजनमााण अनुमत्र् नहीं दकर्ा िाएगा: परंतु स्ट् थानीर् लोगों को पैराग्राफ 3 के उप परै ाग्राफ (1) में सूचीबद्ध दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम म ें स्ट्थानीर् हनवाहसयों की आवासीर् आवश्र्कताओं को पूरा करने जलए संजनमााण करने की अनुमहत भवन उपजवजधर्ों के अनुसार िी िाएगी। परन्द्त ु ऐसे लघ ु उद्योगों िो प्रििू ण उत् पन्द् न नहीं करते ह,ैं से संबंजधत संजनमााण दक्रर्ाकलाप जवजनर्जमत दकए िाएंगे और लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमहत से ही न्द् र्नू तम पर रखे िाएंग े । (ख) एक दकलोमीटर स े आगे आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे । 12. गैर प्रििू णकारी लघ ुउद्योग। फरवरी, 2016 म ें केन्द्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा िारी उद्योगों के वगीकरण के अनुसार गरै -प्रििू णकारी उद्योग तथा अपररसंकटमर् लघ ु और सेवा उद्योग, कृजि, पुष्प कृजि, बागबानी र्ा कृजि आधाररत उद्योग, िो पाररजस्ट्थजतकी संवेिी िोन से िेिी सामजग्रर्ों से उत्पाि बनाते ह,ैं सक्षम प्राजधकारी द्वारा अनुमत्र् होंगे। 13. वृक्षों की कटाई । (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनमु हत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत केंरीर् र्ा राज्र् के अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी । 14. वन उत्पािों और गैर काष्ठ वन लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा । उत्पािों का संग्रहण । 15. जवद्युत और संचार राजत्र म ें वाहन र्ातार्ात का लाग ूजवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होगा । संचलन । 21. स्ट्थानीर् िनता द्वारा अपनार्ी िा स्ट्थानीर् िनता के प्रर्ोग के जलए लागू जवजधर्ों के अधीन Wildlife Sanctuary is located in Salooni sub-division of Chamba district and falls under the administrative control of Wildlife Division Chamba in the State Himachal Pradesh. This Sanctuary was originally notified as Game Sanctuary vide notification No.ft.-1/48 dated 1st July 1949. The rules and regulations had been framed under the Indian Forest Act, 1927 and Punjab Wildlife preservation Act, 1959. The area was further declared as Wildlife Sanctuary under Wildlife (Protection) Act, 1972 vide No. 5-11/70-SF dated 27th March, 1974. The latest notification after rationalization was issued vide no. FFE-B-F (6)-11/2005-II dated 7th June, 2013;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 19 AND WHEREAS, the Gamgul Siyabehi Wildlife Sanctuary is situated between 320 47’52” N to 320 55’ 67” N Latitudes and 75047’88” E to 75058’44” E Longitudes which falls on Survey of India toposheet No.43P/13 Scale1:50,000. The Gamgul Siyabehi Wildlife Sanctuary is located in Saloni sub-division of Chamba district and falls under the administrative control of Wildlife Division Chamba. The total area of the Protected Area is 108.40 square kilometers; AND WHEREAS, the Sanctuary is located in the catchment of Siul nala, (a tributary of Ravi River) away from habitation and in the remote area. Thus the significance can be attributed to the ideal habitat of the Sanctuary, which harbors flora species such as deodara (Cedrus deodara), kail (Pinus wallichiana), spruce (Picea smithiana), silver fir (Abies pindrow), ban (Quercus semicarpofolia), pink burans (Rhododendron campanulatum), etc; AND WHEREAS, major fauna available from the Sanctuary are musk deer (Moschus moschieferus), leopard cat (Prionailurus bengalensis), common leopard (Panthera pardus), black bear (Ursus thibetanus), Himalayan goral (Naemorhedus goral), yellow throated marten (Martes flavigula), red fox (Vulpes vulpus), koklash (Pucrasia macrolopha), kaleej (Lophura leucomelanos), chakor (Alectoris chukar), etc. There is a good interface of wooded areas and vast expenses of pastures that forms an ideal habitat for animals as well as birds; AND WHEREAS, the composition of the forest crop varies with altitude and aspect. The high altitude conifers like deodar, kail, fir and spruce in pure and mixed forms along with broad leaved species are growing in the temperate zone in the lower elevation. The kail is predominant in the southern aspect whereas deodar, fir and spruce are occupying the cooler locations. The pastures and rocky cliffs exist in the alpine zone. Bio-geographically, the area of the Sanctuary falls in the Trans - Himalayan zone; AND WHEREAS, Gamgul Siyabehi Wildlife Sanctuary is surrounded by Churah forest Division of Himachal Pradesh from one side and state of Jammu and Kashmir on the another side. The area of Churah forest Division adjoining to the sanctuary is having thirty two villages while the area of Jammu and Kashmir adjoining to the Sanctuary is having high mountain peaks, snow bound and free from habitation. Hence, Eco sensitive Zone comprising of 28.90 square kilometers (area of Churah Forest Division) having width of one kilometer from the boundary of the Sanctuary is proposed; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Gamgul- Siyabehi Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from zero to 1.00 kilometre around the boundary of Gamgul-Siyabehi Wildlife Sanctuary, in Chamba district in the State of Himachal Pradesh as the Eco- sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of zero to 1.00 kilometre around the boundary of Gamgul-Siyabehi Wildlife Sanctuary and the area of the Eco-sensitive Zone is 28.90 square kilometres. Zero extent of Eco-sensitive Zone was justified by the State as “the boundary of the Wildlife Sanctuary is co- terminus with the State boundary of Jammu and Kashmir on the North-Eastern and North-Western side. Hence, no Eco-sensitive Zone has been proposed in these directions and it has been proposed only along the Southern side”. (2) The boundary description of Gamgul-Siyabehi Wildlife Sanctuary and its Eco-sensitive Zone is appended in Annexure-I. (3) The maps of the Gamgul-Siyabehi Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB and Annexure-IIC. (4) List of geo-coordinates of the boundary of Gamgul-Siyabehi Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure III. (5) The list of villages falling in the proposed Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV. 2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco- sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority of State.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj; (xi) Himachal Pradesh State Pollution Control Board; and (xii) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including home stay; and[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 21 (v) promoted activities given under paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-Medical Waste.– Bio Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 TABLE S. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or up to extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] S. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal. [F.
