अिधसूिचत करने वाली कना(cid:23)टक सरकार क(cid:28) अिधसूचना सं. ईई 159 एफ ड1(cid:3)यू एल 91, तारीख 17.10.1994 !ारा अभयारFय बनाया
गया ह ै । इसके अित(cid:31)र$, वष(cid:23) 2008 म: कना(cid:23)टक सरकार ने बुSा सगारा आरि(cid:27)त वन (cid:27)े0 के 26.85 वग(cid:23) (cid:1)क.मी. के अित(cid:31)र$ (cid:27)े0 को
अपनी अिधसूचना सं. एफईई 119 एफड1लयू एल 2008, तारीख 3.10.2008 !ारा दारोजी भालू (cid:27)े0 के अभयारFय के (cid:17)प म:
अिधसूिचत (cid:1)कया है । वत(cid:23)मान म: दारोजी भालू अभयारFय का कुल (cid:27)े0 82.72 वग(cid:23) (cid:1)क.मी. ह ै।

दारोजी भालू अभयारFय भारत म: केवल ऐसा अभयारFय ह ैजो संकटापU *तनपायी भारतीय रीछ (मेलसस(cid:23) असKनस) के संर(cid:27)ण के
िलए *प<तया घोिषत (cid:1)कया गया ह,ै इस अभयारFय म: शैलमय िशलाखंड और गुफाँएं, झाड़ीदार जंगल और भ-ूभाग, रीछ% तथा चीत% के
िलए अभी< (cid:15)ाकृितक आवास बनाए ह4 ।
*थानीय गैर सरकारी संगठन% और वAय जीव काय(cid:23)कता(cid:23)\ क(cid:28) सहायता से वन िवभाग !ारा अपनाई गई कठोर संर(cid:27)क सबं ंधी
प>ितय% के कारण अभयारFय को पुनःजीिवत (cid:1)कया गया है । और संपूण(cid:23) पा(cid:31)रि*थितक(cid:28)य (cid:15)णाली म: पूण(cid:23)तया प(cid:31)रवत(cid:23)न (cid:1)कया गया ह ै।
संपूण(cid:23)स अ_युव(cid:23)र वन*पित दठूठ% स े और भालू\ तथा पि(cid:27)य% !ारा (cid:1)कए गए बीज िछतराव !ारा पुनःजीिवत क(cid:28) जाती है । कभी बंजर,
िवकृत (ए जंगल अब हरे भरे हो गए ह 4 उ"री कना(cid:23)टक के झाड़ीदार वन म: िविश< पादप% क(cid:28) असं‘य (cid:15)जाितयां यहां (cid:1)दखाई देती ह 4 ।
aयो(cid:1)क जंगल को पुनःजीिवत (cid:1)कया गया ह,ै इसिलए वAय जीव यहां फलफूल रहा है । भारतीय रीछ% क(cid:28) जनसं‘या म: वृि> (ई ह ै। चीता,
साही, साल, गीदड़, काले रोएंदार खरगोश और लाल नेवला आ(cid:1)द क(cid:28) जनसं‘या म: भी वृि> (ई ह ै और यहां लगभग पि(cid:27)य% क(cid:28) 150
(cid:15)जाितयां िजनम: दलु (cid:23)भ पीत कंठदार बुलबुल, रंग िबरंगा पदकAटमुगा(cid:23) भी ह,ै पहचान क(cid:28) गई ह ै तथा यहां *टार कछु\, अजगर, रसल
वाईपर रेड सैAड बोआ, कोबरा जैसे सरीसृप और ब(त से सांर (cid:1)दखाई देते ह4 ।
और, दारोजी भालू अभयारFय के चार% ओर के (cid:27)े0 को, िजसका िव*तार और सीमाएं इस अिधसूचना के पैरा 1 म: िविन?द< ह,4

तक के िव*तार (cid:27)े0 को दारोजी भालू अभयारFय पा(cid:31)रि*थितक संवेदी जोन (िजसे इसम: इसके पe चात् पा(cid:31)रि*थितक संवेदी जोन कहा गया

राजप0 म: इस अिधसूचना के अंितम (cid:15)काशन क(cid:28) तारीख से दो वष(cid:23) क(cid:28) अविध के भीतर, *थानीय 9ि$य% के परामश(cid:23) से और इस
अिधसूचना म: (cid:1)दए गए अनुबंध% का पालन करते (ए आंचिलक महायोजना तैयार करेगी ।
(2) उ$ योजना को राCय सरकार म: स(cid:27)म (cid:15)ािधकारी !ारा अनुमो(cid:1)दत (cid:1)कया जाएगा ।
(3) पा(cid:31)रि*थितक संवेदी जोन के िलए आंचिलक महायोजना राCय सरकार !ारा इस अिधसूचना म: यथािविन?द< रीित म: और
सुसंगत क:(cid:21)ीय और राCय िविधय% और क:(cid:21)ीय सरकार !ारा जारी माग(cid:23)दश(cid:23)क िसcांत%, य(cid:1)द कोई ह%, के सामंज*य से तैयार क(cid:28) जाएगी ।
(4) पया(cid:23)वरणीय और पा(cid:31)रि*थ ितक(cid:28) बात% को इसम: समकिलत करने के िलए आंचिलक महायोजना सभी संबंिधत राC य
िवभाग% के साथ परामश(cid:23) से तैयार (cid:1)क जाएगी, अथा(cid:23)त् :--
(i) पया(cid:23)वरण;
(ii) वन;
(iii) शहरी िवकास;
(iv) पय(cid:23)टन;
(v) नगरपािलका;

(vii) कृिष;
(viii) कना(cid:23)टक राCय (cid:15)दषू ण िनयं0ण बोड(cid:23);
(ix) qसचाई; और
(x) लोक संकम(cid:23) िवभाग
(5) आंचिलक महायोजना अनुमो(cid:1)दत िवcमान भू-उपयोग, अवसंरचना_ मक और (cid:1)tयाकलाप%, पर कोई िनबuधन अिधरोिपत नहv
करेगी जब तक (cid:1)क इस अिधसूचना म: इस (cid:15)कार िविन?द< न (cid:1)कया जाए और उ$ आंचिलक महायोजना सभी अवसंरचना_ मक और
(cid:1)tयाकलाप% म: द(cid:27)ता और पा(cid:31)रि*थितक(cid:28)य अनुकूलता का सुधार करेगी ।
(6) आंचिलक महायोजना म: अनाwछा(cid:1)दत (cid:27)े0% के जीणd>ार, िवcमान जल िनकाय% के संर(cid:27)ण, आवाह (cid:27)े0% के (cid:15)बंधन, जल-
संभर% के (cid:15)बंधन, भूतल जल के (cid:15)बंधन, मृदा और नमी संर(cid:27)ण, *थानीय समुदाय% क(cid:28) आवeयकता\ तथा पा(cid:31)रि*थितक(cid:28) और पया(cid:23)वरण से
संबंिधत ऐसे अAय पहलू\, िजन पर Lयान दने ा आवeयक ह,ै के िलए उपबंध ह%गे ।
(7) आंचिलक महायोजना सभी िवcमान पूजा * थल%, pाम% और नगरीय बंदोब*त%, वन% के (cid:15)कार और (cid:1)क* म%, कृिष (cid:27)े0%,
ऊपजाऊ भिू म, ह(cid:31)रत (cid:27)े0 जैसे उcान और उसी (cid:15)कार के * थान, उcान कृिष (cid:27)े0, आ?कड%, झील% और अAय जल िनकाय% का अyयकंन
करेगी ।
(8) आंचिलक महायोजना *थ ानीय पा(cid:31)रि* थतक(cid:28)य जोन म: िवकास को िविनियमत करेगी िजससे समुदाय% क(cid:28) जीवकोपाज(cid:23)न क(cid:28)
सुर(cid:27)ा के िलए पा(cid:31)रि*थ ितक(cid:28) अनुकूल िवकास का सुिन e चय (cid:1)कया जा सके ।
3. रररराााा(cid:28)(cid:28)(cid:28)(cid:28)यययय ससससररररककककाााारररर (cid:29)(cid:29)(cid:29)(cid:29)ाााारररराााा (cid:30)(cid:30)(cid:30)(cid:30)ककककएएएए जजजजाााानननन ेे ेेववववााााललललेे ेे उउउउपपपपाााायययय-------- राCय सरकार इस अिधसूचना के उपबंध% को (cid:15)भावी करने के िलए िन(cid:13)िलिखत
उपाय करेगी, अथा(cid:23)त् :--
(1) भभभभ--ूू--ूूउउउउपपपपययययोोोोगगगग ---- पा(cid:31)रि*थ ितक संवेदी जोन म: आमोद-(cid:15)मोद के (cid:15)योजन के िलए िचिAहत (cid:1)कए गए ह 4वन%, उcान-कृिष (cid:27)े0%, कृिष
(cid:27)े0%, पाकz और खुले *थान% का वािणिCयक और औcोिगक संब> िवकास (cid:1)tयाकलाप% के िलए उपयोग या संप(cid:31)रवत(cid:23)न नहv होगा :
परंतु पा(cid:31)रि*थितक संवेदी जोन के भीतर कृिष भूिम का संप(cid:31)रवत(cid:23)न, मानीटरी सिमित क(cid:28) िसफा(cid:31)रश पर और राCय सरकार के पूव (cid:23)
अनुमोदन से, *थानीय िनवािसय% क(cid:28) आवासीय ज(cid:17)रत% को पूरा करने के िलए और पैरा 4 क(cid:28) सारणी के *तंभ (2) के अधीन tमांक 11,
17, 23, 28, और 31 के सामने सूचीब> (cid:1)tयाकलाप% को पूरा करने के िलए अनु{ात ह%गा, अथा(cid:23)त् :-
(i) पा(cid:31)रि*थ ितक(cid:28)य अनुकूल पय(cid:23)टन (cid:1)tयाकलाप% के िलए पय(cid:23)टक% के अ* थायी 9वसाय के िलए पा(cid:31)रि* थितक(cid:28)य अनुकूल
आरामगाह जैसे टट: , लकड़ी के मकान आ(cid:1)द ;
(ii) िव cमान सड़क% को चौड़ा करना और सुदढ़ृ करना तथा नई सड़क% का संिA }न माण(cid:23) ;
(iii) (cid:15)दषू ण उ_पU न करने वाले लघु उcोग,
(iv) वषा(cid:23) जल संचय, और
(v) कुटीर उcोग, िजसके अंतग(cid:23)त pामीण उcोग, सुिव धाजनक * टोर और * थानीय सुिव धाएं भी ह,4 :
परंतु यह और (cid:1)क राCय सरकार के पूव(cid:23) अनुमोदन और भारत के संिवध ान के अनुw छेद 244 तथा त_समय (cid:15)वृ" िविध के उपबंध%
के अनुपालन के िबना, िजसके अंतग(cid:23)त अनुसूिचत जनजाित और अAय परंपरागत वन िनवासी (वन अिधकार% क(cid:28) माAयता) अिधिनयम,
2006 (2007 का 2) भी ह,ै वािणिCयक या उcोग िवकास (cid:1)tयाकलाप% के िलए जनजातीय भूिम का उपयोग अनु{ात नहv होगा :
परंतु यह और भी (cid:1)क पा(cid:31)रि*थ ितक संवेदी जोन के भीतर भू-अिभलेख% म: उपसंजात कोई 0ु(cid:31)ट मानीटरी सिमित के िवचार (cid:15)ा6
करने के प7ात ् राCय सरकार !ारा (cid:15)_येक मामले म: एक बार संशोिधत होगी और उ$ 0ु(cid:31)ट के संशोधन क(cid:28) भारत सरकार के पया(cid:23)वरण,
वन और जलवायु प(cid:31)रवत(cid:23)न मं0ालय को सूचना दने ी होगी :
परंतु यह और भी (cid:1)क उपयु(cid:23)$ 0ु(cid:31)ट का संशोधन म: इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:1)कसी भी दशा म: भू-उपयोग
का प(cid:31)रवत(cid:23)न सि(cid:9)मिलत नहv होगा :
परंतु यह और भी (cid:1)क िजससे ह(cid:31)रत (cid:27)े0 म: जैसे वन (cid:27)े0, कृिष (cid:27)े0 आ(cid:1)द म: कोई पा(cid:31)रणािमक कटौती नहv होगी और अन(cid:15)युa त

(2) (cid:19)(cid:19)(cid:19)(cid:19)ााााककककृृृृििििततततकककक झझझझररररननननेे ेे -- आचंिलक महायोजना म: सभी (cid:15)ाकृितक ~ोत% क(cid:28) पहचान क(cid:28) जाएगी और उनके संर(cid:27)ण और
पुन(cid:127)(cid:128)भूतकरण के िलए योजना सि(cid:9)म िलत (cid:1)कया जाएगा और राC य सरकार !ारा ऐसे (cid:27)े0% पर या उनके िनकट िवकास (cid:1)tयाकलाप
(cid:15)ितिष> करने के िलए ऐसी रीित से माग(cid:23)िनदश(cid:129) तैयार (cid:1)कए जाएंगे ।
(3) पपपपयययय(cid:4)ट(cid:4)ट(cid:4)ट(cid:4)टनननन –––– (क) पा(cid:31)रि*थितक संवेदी जोन के भीतर पय(cid:23)टन संबंधी (cid:1)tयाकलाप, पय(cid:23)टन महायोजना के अनुसार ह%गे, जो आंचिलक
महायोजना का भाग ह%गे ।
(ख) पय(cid:23)टन महायोजना पय(cid:23)टन िवभाग !ारा राCय सरकार के वन और पया(cid:23)वरण िवभाग के परामश(cid:23) से तैयार होगी ।
(ग) पय(cid:23)टन संबंधी (cid:1)tयाकलाप िन(cid:9) निलिखत के अधीन िविनयिमत ह%गे, अथा(cid:23)त् :-
(i) पा(cid:31)रि*थितक संवेदी जोन के भीतर सभी नए पय(cid:23)टन (cid:1)tयाकलाप% या िवcमान पय(cid:23)टन (cid:1)tयाकलाप% का िव*तार केA(cid:21) सरकार के
पया(cid:23)वरण, वन और जलवायु प(cid:31)रवत(cid:23)न मं0ालय !ारा जारी माग(cid:23)िनदशे % तथा रा(cid:130) (cid:131)ीय (cid:132) या(cid:133) संर(cid:27)ण (cid:15)ािधकरण !ारा जारी पय(cid:23)टन
माग(cid:23)िनदशे % के अनुसार होगा िजसम: पा(cid:31)रि*थितक पय(cid:23)टन, पा(cid:31)रि*थितक िश(cid:27)ा और पा(cid:31)रि*थितक िवकास को मह_व (cid:1)दया जाएगा और
पा(cid:31)रि*थितक संवेदी जोन क(cid:28) वहन (cid:27)मता के अLययन पर आधा(cid:31)रत होगा ;
(ii) पा(cid:31)रि*थ ितक(cid:28)य अनुकूल पय(cid:23)टन (cid:1)tयाकलाप% के संबंिधत पय(cid:23)टक% के अ* थायी िनवास के िलए आवासन के िसवाय पा(cid:31)रि* थितक संवेदी
जोन के भीतर होटल और (cid:31)रसाट(cid:23) के नए संिनमा(cid:23)ण पेनगंगा वA य जीव अभयारF य क(cid:28) सीमा के 1 (cid:1)कलोमीटर के भीतर अनु{ात नहv ह%गे :
(iii) आंचिलक महायोजना का अनुमोदन (cid:1)कए जाने तक, पय(cid:23)टन के िलए िवकास और िवcमान पय(cid:23)टन (cid:1)tयाकलाप% के िव*तार को
वा*तिवक *थल िविन?द< संवी(cid:27)ा तथा मानीटरी सिमित क(cid:28) िसफा(cid:31)रश पर आधा(cid:31)रत संबंिधत िविनयामक (cid:15)ािधका(cid:31)रय% !ारा अनु{ात

NOTIFICATION
New Delhi, the 22nd September, 2015
S.O.2609(E).-The following draft of the notification, which the Central Government proposes to issue in
exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-
section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under
sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected
thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry
of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to
the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft

Draft Notification
Whereas, Daroji Bear Sanctuary in Hospet and Sandur Taluk of Bellari District of Karnataka State and spread
over an area of 82.72 Sq.Kms and lies between latitudes N 150 14’to N 15007’ and longitude E 760 31’ to E 760 40’ and
this sanctuary is formed vide Government of Karnataka Notification No. FEE 159 FWL 91 dated 17-10-1994 notifying
an area of 55.873 Sq. Kms. as the Daroji Bear Sanctuary under sub-clause (b) of section 26 A of the Wild Life
(Protection) Act, 1972 (53 of 1972) and further, in the year 2008 the Government of Karnataka vide its notification no.
FEE 119 FWL 2008 dated 03-10-2008 notified an additional area of 26.85 Sq.kms of Bukkasagara Reserved Forest area
as Daroji Bear Sanctuary and presently, the total area of Daroji Bear Sanctuary is 82.72 sq.kms;
And wheras, the Daroji Bear sanctuary is the only sanctuary in India precisely declared for the conservation of
endangered mammal Indian Sloth Bear (Melursus ursinus) and the rocky boulders and caves, scrub jungle and terrain in
this sanctuary become an ideal habitat for Sloth Bears and Leopards;
And wheras, owing to the stringent conservation practices by the forest department with the support of local
NGOs and wildlife activists, the sanctuary has been regenerated and the entire ecosystem has been undergone
metamorphosis and the entire luxuriant flora is regenerated from the stumps and by the seed dispersal by the bears and
birds and once barren, degraded jungle has now become a verdant green forest. Innumerable species of plants typical to
the North Karnataka Scrub forest are seen here. As the forests are regenerated, the wildlife is flourishing here. The
population of Indian Sloth bears has been increased. Population of Leopard, Porcupine, Pangolin, Jackal, Black-napped
Hare, and Ruddy Mongoose etc. also increased and about 150 species of birds including rare Yellow-throated Bulbul,
Painted Spurfowl have been identified here and Reptiles like Star tortoise, Python, Russell’s viper, Red Sand Boa, Cobra
and many snakes are seen here;
And whereas, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in
paragraph 1 of this notification around the protected area of Daroji Bear Sanctuary as Eco- sensitive Zone from
ecological and environmental point of view and to prohibit industries or class of industries and their operations and
processes in the said Eco-sensitive Zone;
Now therefore, in exercise of the power conferred by sub section(1) and clauses (v) and (xiv) of sub-section (2) and
sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the
Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of 150 meters to
4.7 kms around the boundary of Daroji Bear Sanctuary in the State of Karnataka as the Daroji Bear Sanctuary Eco-
sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:—
1. Extent and Boundaries of Eco-sensitive Zone.— (1) The Eco-Sensitive Zone is spread over an area of 132.016 sq.
kms with an extent varying from 150 meters to 4.7 kms around the boundary of Daroji Bear Sanctuary and the
boundary description of such Zone is given in Annexure-I.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15
(2) The list of villages falling within Eco-sensitive Zone along with co-ordinates of prominent points is appended as
Annexure-II.
(3) The maps of the Eco-sensitive Zone along with boundary details is appended as Annexure-III.
(4) Key locations (GPS points) on the eco-sensitive zone boundary as well as on the sanctuary are appended as
Annexure-III A.
2. Zonal Master Plan for the Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification.
(2) The said Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner
as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines
issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(ix) Karnataka State Pollution Control Board;
(x) Irrigation; and
(xi) Public Works Department,
for integrating environmental and ecological considerations into it.
(5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities,
unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and
activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture conservation,
needs of local community and such other aspects of the ecology and environment that needs attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types
and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural
areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly
development for livelihood security of local communities.
3. Measures to be taken by State Government.—The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:—
(1) Land use.— Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational
purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related
development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of local residents, and for the activities listed against serial numbers 11, 17, 23, 28 and 31 in column (2)
of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly
tourism activities;
(ii) Widening and strengthening of existing roads and construction of new roads;
(iii) Small scale industries not causing pollution;
(iv) Rainwater harvesting; and
(v) Cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of article 244 of
the Constitution of India or the law for the time being in force, including the Scheduled Tribes and other Traditional
Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said
error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.—The catchment areas of all natural springs shall be identified and plans for their conservation and
rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State
Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such
areas.
(3) Tourism. — (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,
which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests
and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate
Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to
time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the
Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the
Daroji Bear Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism
activities;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities
shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation
of the Monitoring Committee.
(4) Natural heritage. — All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and
preserved and plan shall be drawn up for their protection and conservation, within six months from the date of
publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites. — Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be
prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution. — The Environment Department of the State Government or Karnataka State Pollution Control
Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance
with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made there
under.
(7) Air pollution.- The Environment Department of the State Government or Karnataka State Pollution Control Board
shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the
provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under.
(8) Discharge of effluents. —The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made there under.
(9) Solid wastes. — Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste
(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of
Environment and Forests vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time
to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable
components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) The inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the
Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste. — The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the
provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 17
the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20th July, 1998 as
amended from time to time.
(11) Vehicular traffic. — The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is
prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial Units
(a) No establishment of new wood based Industries within the proposed Eco-sensitive zone shall be permitted
except the existing wood based Industries set up as per the Law.
(b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco-
sensitive zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive
Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made
thereunder, and be regulated in the manner specified in the Table below, namely: —

However, beyond one kilometer and upto the extent of the
Eco-sensitive Zone, all new tourism activities or expansion
of existing activities would in conformity with the Tourism
Master Plan.
12. Construction activities. (a) No new commercial construction of any kind shall be
permitted within one kilometre from the boundary of the
Protected Area:
Provided that, local people shall be permitted to
undertake construction in their land for their residential use
including the activities listed in sub-paragraph (1) of
paragraph 3:
Provided further that the construction activity related to
small scale industries not causing pollution shall be
regulated and kept at the minimum, with the prior
permission from the Competent Authority as per
applicable rules and regulations, if any.
Further, beyond one kilometer upto the extent of Eco-
Sensitive Zone construction for bone fide local needs shall
be allowed and other construction activities shall be
regulated as per Zonal Master Plan.
13. Felling of trees. (a) There shall be no felling of trees in the forest or
Government or revenue or private lands without prior
permission of the Competent Authority in the State
Government.
(b) The felling of trees shall be regulated in accordance
with the provisions of the concerned Central or State Acts
and the rules made thereunder.
(c) In case of Reserve Forests and Protected Forests the
Working Plan prescriptions shall be followed.
14. Commercial water resources including (a) The extraction of surface water and ground water shall

Terms of Reference:
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to
the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental
clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are
falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and
referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park
Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment
(Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments,
representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending
on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of
every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at
Annexure-IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal .

BOUNDARIES OF DAROJI BEAR SANCTUARY
The point number -1 is located at the north of the Daroji Bear Sanctuary (Bukkasgara Block) on the bank of
Tungabhadra River (N 15°22’46.30” E 76°32’37.72”) the Eco-sensitive Zone boundary line movers straight towards east
to point no.-2 (N 15° 22’ 43.76” E 76° 34’ 11.86”), then the boundary line moves towards south to point no.-3 (N 15°
21’ 49.46” E 76° 34’ 12.94”), then the boundary line movers round the Ramasagara Tank to point no.-4 (N 15° 21’
39.11” E 76° 34’ 42.31”), then the boundary line moves south to point no.-5( N 15°20’51.34” E 76°34’42.73”) situated
on Tungbhadra Right bank canal, then the boundary line runs east along the canal to point no.-6 (N 15°21’02.47”
E 76°35’14.71”), then boundary line runs down in south-east direction upto point no.- 7 (N 15°19’ 71.32”
E 76°36’44.32”), then the boundary line runs along the bottom of the hillock to point no.-8 and point no-9, excluding the
Metri village settlement, then the boundary line joins the Metri-Devalapuram Road at point no-9A (N 15°18’04.72”
E 76°37’49.21” ), then the boundary line runs along the road to point no.- 10 (15°17’ 27.64” E 76° 38’ 23.58”), then
takes turn towards south-east up to point no.-10A (N 15°17’18.82” E 76°38’11.57” ), then the boundary line turns
south up to point no. 11 (N 15°17’01.10” E 76°38’24.90”) located outside the Develapuram village settlement, then the
boundary line runs straight in south-east direction reaching point no.-12 (N 15°16’34.11” E 76°39’41.04”) then
boundary line runs in east up to point no.-13 (N 15°16’32.42” E 76°40’23.38”) located on the bank of the water channel,
then the boundary line runs south along the water channel through point no.-14 upto point no.-15 located on the northern
edge of the Daroji Tank, then the boundary line runs along the boundary of the Daroji Tank to point no.- 16 , then the
boundary line runs south-east straight upto point no.-17 located on the Hospet-Bellari Road, then the boundary line runs
along the road to point no. -18 (N 15°13’27.43” E 76°36’57.42”), then the boundary line runs towards north upto point

E 76°35’ 34.38”), then the boundary line runs in south to point no.-21 located on the Railway line boundary, then the
Eco-sensitive Zone boundary line runs west along the Railway line through point no.-22, 23, 24, 25, 26, 27, up to point
no. 28, then the boundary line runs towards north to point no. 29 located on the boundary of the Bilikallu west Reserve
forest, then the boundary line runs north-west straight to point 30 loacted on the western-most point of the Bilikallu
West RF, then the boundary line runs east along the boundary of the Bilikallu West RF upto point no. 33 located on the
Tungabhadra High level canal, then the boundary line runs along the Tungabhadra High level canal up to point no.- 35,
then the boundary line turns north up to point no.-36 then the boundary line moves for further up to point no.-37 located
on the Kamlapura – Ramasagara Road, then the boundary line moves north-east along the road up to point no.- 41, then
the boundary line turns north to point no.-42 located on the bank of the Tungabhadra River, then the boundary line runs
north-east along the bank of Tungabhadra River to reach the starting point no.-1.
