ररक व्यापार जवभाग) आदेि नई ददल्ली, 21 अगस्ट्त, 2025 का. आ. 3850अ).—भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 का 11) की धारा 17 ओर धारा 25 की उप-धारा (3) के साथ परित धारा 16 द्वारा प्रदत्त िजियों का प्रयोग करते हुए और खाद्य और पेय पदाथों के जलए बतनध और जडब्बे, और इसी प्रकार के कुकवेयर (गणु वत्ता जनयंत्रण) आदेि, 2024 के अजधक्रमण में, जसवाय ऐसे कायों के िो अजधक्रमण स े पहले दकए गए अथवा जिन्ह ें दकए िान े से छोड़ ददया गया, केन्र सरकार का, भारतीय मानक ब्यरू ो स े परामि ध करन े के बाद यह मत ह ैदक यह िनजहत म ेंआवश्यक अथवा जहतकर है, अत: एतद्द्वारा जनम्नजलजखत आदेि करती ह,ै नामत:- 1. सजं िप्त िीर्कध , और प्रारंभ.- (1) इस आदेि को खाद्य और पेय पदाथों के जलए बतधन और जडब्बे, और इसी प्रकार के कुकवेयर (गुणवत्ता जनयंत्रण) आदेि, 2025 कहा िाएगा। (2) यह आदिे रािपत्र में प्रकािन की जतजथ से लाग ूहोगा। 2. मानक जिह्न का अजनवाय ध प्रयोग- ताजलका के कॉलम (2) में जवजनर्दधष्ट वस्ट्तुएं या सामान ताजलका के कॉलम (3) म ें जवजनर्दधष् ट भारतीय मानक संबंधी तदनुरूपी प्रजवजष्ट के अनरूु प होंग े तथा उन पर भारतीय मानक ब्यूरो (अनरूु पता मूल्यांकन) जवजनयम, 2018 की अनुसूिी-II की स्ट्कीम-I के अनसु ार ब्यूरो के लाइसेंस के तहत मानक जिह्न लगा होगा। 5606 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] बिते यह भी दक इस आदेि म ेंसे कुछ भी जनयाधत की िान े वाली स्ट्वदेि म ें जवजनर्मधत वस्ट्तुओं या सामानों पर लाग ू नहीं होगा: बिते यह भी दक सूक्ष्म, लघु और मध्यम उद्यम जवकास अजधजनयम, 2006 (2006 का 27) के तहत पररभाजर्त लघ ु उद्यम और सूक्ष्म उद्यम क्रमिः ताजलका के कॉलम (6) और (7) म ें जवजनर्दधष्ट सगं त प्रजवजष्ट में जवजनर्दधष्ट जतजथ स े ऐस े भारतीय मानकों का अनुपालन करेंग;े बिते यह भी दक इस आदेि में स े कुछ भी सूक्ष्म, लघ ु और मध्यम उद्यम मंत्रालय के उद्यम पोटधल के अंतगतध पंिीकृत दकसी उद्यम द्वारा घरेल ू स्ट्तर पर जवजनर्मधत वस्ट्तओंु या सामानों पर लाग ू नहीं होगा, जिसमें संयंत्र और मिीनरी या उपकरण में मलू लागत पर जनवेि पच्चीस लाख रुपए से अजधक नहीं ह ै और िाटधड ध अकाउंटेंट द्वारा प्रमाजणत दकए गए अनुसार जपछले जवत्त वर्ध का टनधओवर दो करोड़ रुपए स ेअजधक नहीं ह:ै बिते दक इस आदेि म ें से कुछ भी, ब्यूरो द्वारा प्रमाजणत जवजनमाधता या प्रमाणन के जलए ब्यरू ो को आवेदन करन े वाले जवजनमाधता या सुसंगत वस्ट्तुओं और सामानों के जलए आयातक द्वारा इस आदेि की ताजलका में जनर्दधष्ट कायाधन्वयन की जतजथ से पहल े घरेल ू रूप स े जवजनर्मधत या आयाजतत वस्ट्तुओं या सामानों पर लाग ू नहीं होगी, और ऐसे जवजनमाधता या आयातक को इस आदिे की ताजलका में जवजनर्दधष्ट कायाधन्वयन की जतजथ से छह माह तक ऐसे घोजर्त स्ट्टॉक को बेिने या प्रदर्िधत करन े या उसे जिक्री हते ु पेि करन े की अनुमजत होगी, बिते दक ऐसा जवजनमाधता या आयातक िाटधड ध अकाउंटेंट द्वारा ब्यूरो के समि इस आिय की घोर्णा करे: बिते यह भी दक इस आदिे म ें से कुछ भी भारत में आयात दकए िात े समय िोस, रव या गसै , दकसी भी रूप म ें सामग्री से भरे माल या वस्ट्तओंु पर लाग ूनहीं होगी: बिते यह भी दक इस आदिे म ें से कुछ भी खाद्य और पेय पदाथों के जलए बतधन और जडब्बे, और इसी प्रकार के कुकवेयर जवजनमाधताओं द्वारा अनुसंधान और जवकास के उद्देश्य स े प्रजत वर् ध आयाजतत दो सौ वस्ट्तुओं या सामानों के जलए लाग ू नहीं होगा, इस ित ध के साथ दक ऐसी आयाजतत वस्ट्तुए ं और सामानों की वाजणजज्यक रूप से जबक्री नहीं की िाएगी और उन्ह ें स्ट्क्रैप के रूप में जनपटाया िा सकता ह ै और जवजनमाधता वस्ट्तुओं या सामानों का वर्धवार ररकॉडध रखेंगे और उसे केंर सरकार के समि प्रस्ट्ततु करेंगे। ताजलका का नवीनतम संस्ट्करण लाग ूहोगा। 3. प्रमाणन और प्रवतनध प्राजधकरण – उक्त ब् यरू ो ताजलका के कॉलम (2) में जवजनर्दधष् ट वस्ट् तुओं या सामान के जलए प्रमाणन और प्रवतधन प्राजधकरण होगा। 4. उल्ल घं न के जलए पने ल्ट ी– इस आदेि के प्रावधानों का उल्ल घं न करन े वाले व् यजि को भारतीय मानक ब् यूरो अजधजनयम, 2016 के प्रावधानों के तहत दंजडत दकया िाएगा। [फा. स.ं पी-29026/14/2023-एलईआई] संिीव, संयुक्त सजिव MINISTRY OF COMMERCE AND INDUSTRY (Department for Promotion of Industry and Internal Trade) ORDER New Delhi, the 21st August, 2025 S.O. 3850(E).—In exercise of the powers conferred by section 16 read with section 17 and sub-section (3) of section 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016) and in supersession of the Cookware, Utensils and Cans for foods and beverages (Quality Control) Order 2024, except as respects things done or omitted to be done before such supersession, the Central Government, after consulting the Bureau of Indian Standards, is of the opinion that it is necessary or expedient so to do in the public interest, hereby makes the following order, namely:- 1. Short title and commencement. – (1) This Order may be called the Cookware, Utensils and Cans for Foods and Beverages (Quality Control) Order, 2025. (2) It shall come into force on the date of its publication in the official Gazette. 2. Compulsory use of Standard Mark.- Goods or articles specified in column (2) of the Table shall conform to the corresponding Indian Standard specified in column (3) of the Table and shall bear the Standard Mark under a license from the Bureau as per Scheme-1 of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018: Provided that nothing in this order shall apply to goods or articles manufactured domestically for export: Provided further that the micro enterprise and small enterprise, as defined under the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006) shall conform to such Indian Standards from the date specified in the corresponding entry under columns (6) and (7) of the Table respectively: Provided also that nothing in this order shall apply to goods or articles manufactured domestically by an enterprise, registered under Udyam portal of the Ministry of Micro, Small and Medium Enterprises, wherein the investment in plant and machinery or equipment at original cost does not exceed twenty-five lakh rupees and the turnover does not exceed two crore rupees for the previous financial year as certified by a Chartered Accountant: Provided also that nothing in this order shall apply to goods or articles domestically manufactured or imported before the date of implementation specified in the Table of this order by the manufacturer certified by the Bureau or manufacturer who has applied to the Bureau for certification or by the importer for the relevant goods and articles and such manufacturer or importer shall be permitted to sell or display or offer to sell such declared stock up to six months from the date of implementation specified in the Table of this Order, subject to the condition that such manufacturer or importer shall make a declaration to this effect certified by a Chartered account to the Bureau: Provided also that nothing in this order shall apply to goods or articles filled with material in any form solid, liquid or gas, when imported into India: Provided also that nothing in this order shall apply for two hundred numbers of goods or articles imported for the purpose of research and development by manufacturers of Cookware, Utensils and Cans for Food and Beverages per year with the condition that such imported goods and articles shall not be sold commercially and shall be disposed of as a scrap and the manufacturer shall maintain a year-wise record of such goods and articles and furnish to the Central Government.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] TABLE S.No. Goods or Indian Title of Indian Date of Date of Date of articles Standard Standard implementation in implementation implementation general (other than for small for micro micro and small enterprises enterprises enterprises) (1) (2) (3) (4) (5) (6) (7) 1. Certification and enforcement authority.—The Bureau shall be the certifying and enforcing authority for the goods or articles specified in column (2) of the Table. 4. Penalty for contravention.— Any person who contravenes the provisions of this Order shall be punishable under the provisions of the Bureau of Indian Standards Act, 2016. [F.
