(vi) िे दकसान जिनके लाइसेन्दस को ीसल िि थ 1999-2000 से 2021-22 के िौरान इस आधार पर रद्द कर दि ा
ग ा र्ा दक उन्दहोने घरट ा दकस्ट्ं कम अीमं िंा कराई र्ी लेदकन नींच ा गािीपुर के सरकारी अीमं
क्षारोि कारख़ाना ं ेंदकए गए परीक्षण से पता चला दक उनंें ंोीीन का अि ि 6% से अजधक र्ा्
(vii) ऐसे दकसान जिनके लाइसेन्दस को ीसल ििथ 1998-99 से ीसल ििथ 2020-21 के िौरान रद्द कर दि ा ग ा
हो लेदकन उन्दहोन े न े लाइसेन्दस के रद्द दकए िानेिाल े िि थ को जंलाकर लगातार चार ििो तक ऐसी धसत
अीमं/ंोीीन िंा कराई हो जिनंें कुल MQY (अगल े ििथ कम लाइसेंससंग के जलए जनधाथररत के 100% ा
इससे अजधक हो। दकसी कानूनी उत्तराजधकारी को लाइसेन्दस अतं ररत दकए िान े के ंांल े ं ें ंृतक दकसान के
्ारा दकए गए िंा के धसत पर भी िंा कम िानेिाली अीमं के कुल धसत कम गणना करते सं ध् ान
दि ा िा ेगा्
(viii) ंृतक दकसान के कानूनी उत्तराजधकारर ों ंें से ऐसा कोई भी उत्तराजधकारी जिसे जिजधित प्रदि ा का
अनुपालन करन े के बाि जनधाथररत दक ा ग ा हो धर िह ीसल ििथ 1999-2000 से लाइसेन्दस का पा् हो,
लाइसेन्दस प्राप्त नहीं कर पा ेगा दि उसके हााँ कानूनी उत्तराजधकार को लेकर कोई जििाि चल रहा हो्
(ix) ऐसे दकसान जिनका ,एनडीपीएस अजधजन ं, 1985 के तहत दकसी सक्षं अिालत ं ें - दकसी अपराध के
जलए आरोप/आरोपों के आधार पर लाइसेंस संाप्त कर दि ा ग ा हो धर सक्षं अिालत ्ारा उक्त ंांले/
ंांलों ं ें उन्दह ें बरी कर दि ा ग ा हो ि 31 िुलाई, 2022 तक े आिेि अनंजतं हो चुके हों, तब ऐस े
दकसान भी अीमं पोस्ट्त कम खते ी करन े के जलए लाइसेंस के पा् होंगे बित े दक िे अन्द सभी िततों कम पूर्त थ
पर करते हों अिालत के जनणथ ि इस आि कम घोिणा कम प्रंाजणत प्रजत प्रस्ट्ततु करें।
नोट्- दकसानों कम श्रेणी ं ेंउनके कानूनी उत्तराजधकारी भी आते ह।ैं
3. लाइससें कम ित ें
दकसी भी दकसान को तब तक लाइसेंस ंंिूर नहीं दक ा िाएगा िब तक िह जनम्न जलजखत िततों को पूरा न करता
हो/करती हो्-
(i) उसने ीसल ििथ 2021-22 के िौरान पोस्ट्त कम खेती के जलए लाइसेंसिुिा िास्ट् तजिक क्षे् से 5% ‘क्षम् क्षे्’ स े
अजधक क्षे् ं ेंखेती न कम हो।
(ii) उसने कभी भी अीमं पोस्ट् त कम अि:ध खेती न कम हो तर्ा स्ट् िापक धिजध तर्ा ंन्प्रभािी र पिार् थ
अजधजन ं, 1985 धर उसके अंतगतथ बना े गए जन ंों के अंतगतथ उस पर दकसी अपराध के जलए दकसी सक्षं
न्द ा ाल ंें आरोप नहीं लगा जसध क दक ा ग ा हो।[भाग II—खण् ड 3(i)] भारत का रािप् ् असाधारण 3
(iii) ीसल िि थ 2021-22के िौरान उसन े केन्दर ी नाकोरटक्स ब रू ो/नाकोरटक्स आ क्ु त ्ारा दकसानों को िारी दकन्दह ीं
जिभागी अनुिेिों का उल्ल ंघन नहीं दक ा हो।
4. अजधकतं क्ष्े
(i) सभी पा् दकसानों ंें से प्रत् ेक को 0.10 हक्े टे र के जलए लाइसेन्दस दि ा िा ेगा।
(ii) कोई भी दकसान िो भ-ू खंडों से अजधक ंें अीमं कम खेती नहीं कर पा ेगा।
(iii) दि दकसान चाह ें तो उनको िसू रों के स्ट् िाजंत् ि िाल े भूखंडो को प्े पर लेन े कम अनुंजत िी िा सकती ह:,
तादक उतनी िंीन पर खेती कर सकें जितन ेके जलए लाइसेंस दि ा ग ा ह।:
5. लाइसन्दे स कम अिजध
(i) पोस्ट्ट भूस जिसके लांससंग से रस न जनकलता हो, के उत्पािन के जल े अीमं पोस्ट्त कम खेती के जल े लाइसेन्दस
इसके िारी होने से पााँच ीसल िितों के जल े िारी दक ा िाएगा अर्ाथत इसे ीसल ििथ 2027-28 से िारी दक ा
िाएगा धर ीसल िि थ 2027-28 तक ि:ध रहगे ा।
(ii) लाइसेन्दस अि:ध हो िाएगा दि ्-
क. दकसान अि:ध दि ाकलापों ं ेंजलप्त पा ा िाता ह,:
ख. एनडीपीएस एक्ट के अतं गतथ दकसान को आरोप-प् िे दि ा िाता ह,:
ग. िह अीमं पोस्ट्त कम खेती के बारे ंें िारी दकए गए जिभागी दििा जनिेिों का उल्लंघन दक ा हो
घ. स्ट्िेच्छा स ेलासेन्दस को सीबीएन को िापस कर दि ा हो।
6. पिू थचते ािनी
(i) ििथ 2022-23 के िौरान िी गई अीमं ं ें ंाीीन कम ंा्ा को ीसल िि थ 2022-23 के भगु तान का आधार
ंाना िा सकता ह,: दि सरकार इस बारे ंें जनणथ ले।
(ii) जिन दकसानों न े लगातार तीन ीसल िितों तक अपनी ीसल कम िोताई करा िी हो, अगल े ीसल िि थ के जल े
लाइसे4एनएस के पा् नहीं होंगे।
7. ंाीम ोग् सींा
दि खेती दक ा ग ा िास्ट् तजिक क्षे् लाइसेंसिुिा क्षे् से 5 प्रजतित तक अजधक ह : तो ऐसा अजधक क्षे् क्षम् हो
सकता ह।:
8. जिजिध
(i) िो दकसान ििथ 2021-22 के िौरान अीमं पोस्ट्त कम खेती अपने भ-ू खंड पर अर्िा िसू रों से प्े पर जल े ग े
भू-खंड पर करता ह,: भू-खंड के स्ट् िांी का ब् ौरा, सिेक्षण सं ा धर स्ट् िापक आ ुक् त ्ारा जनिेजित अन्द
ब् ौरा प्रिान करेगा।
(ii) इन सांान्द लाइसेंससंग िततों से नाकोरटक् स आ ुक्त /नाकोरटक् स उपा ुक् त के दकसी भी लाइसेंस को िारी
करने/उसे रोकने के अजधकार को उस जस्ट् र्जत ंें कोई क्षजत नहीं पुएचं ती िब कभी स्ट् िापक धिजध एि ं
ंन्प्रभािी पिार्थ अजधजन ं, 1985 के उपबंधों धर उसके अतं गथत बनाए गए जन ंों के अनसु ार ऐसा करना
ठीक संझा िाए।
(iii) लाइससें इस ित थ पर दि ा िाएगा दक दकसी भी खते को सरकार ्ारा अर्िा सरकार ्ारा जिजिष्ट सस्ट्ं र् ा
अर्िा एिेंसी के सार् सह ोग करके दक े िाने िाले अनुसंधान के प्र ोिनार् थ अजधगृजहत दक ा िा सकता ह।:
जिस दकसान के खेतों को अनसु ंधान के जलए चुना िाएगा उसका अगल े िि थ लाइसेंस ंंिूर करने पर जिचार
दक ा िाएगा बित े उसने जनधाथररत न्द ूनतं अहकथ उपि प्रस्ट्त तु कम हो धर िह अन र्ा पा् हो। अनुसंधान

(iv) लाइसेंस इस अजतररक्त ित थ के अध् धीन होगा दक अीमं को जनकाल े जबना पोस्ट् त भूसी प्राप् त करन े के जलए
दकसी भी खेत को चुना िा सकता ह।: जिन दकसानों के खेत ऐसे उप ोग के जलए चुने िाएगं े िे अन्द र्ा पा्
होने पर अगले ीसल ििथ के जलए लाइसेंस के जलए पा् होंगे।
(v) दकसी दकसान ्ारा सौंपी गई अीमं कम ंा्ा कम गणना रािकम अीमं एिं क्षारोध का थिाला, नींच
अर्िा गािीपुर ं ेंदकए गए जि लेिणों के आधार पर 70 जडग्री गाेेपन पर कम िाएगी।
(vi) ऐसे दकसान जिनका दकसी जििेि गांि ं ें अीमं कम खेती का लाइसेंस ह : लेदकन ि े पास के लग े िसू रे गांि के
जनिासी ह ैं तो उनको अपन े आिास पर अीमं को इकटट्ठा करने कम अनुंजत होगी बित े कम ऐसी ंानि बस्ट्ती
धर गांि के बीच लगातार आना िाना होता हो।
(vii) दि अीमं कम नीजत 2022-23 अंग्रेिी धर जहन्दिी के संस्ट्करणों ंें परस्ट्पर जिसंगजत पाई िाती ह : तो अग्रं ेिी
संस्ट्करण ही अजधंान्द होगा।

G.S.R. 739(E)—In pursuance of rule 8 of the Narcotic Drugs and Psychotropic Substances Rules, 1985, the
Central Government hereby notifies the general conditions for grant of license specified below for cultivation of
opium poppy for production of Poppy Straw from which no juice is extracted through lancing on account of the
Central Government during the Opium Crop Year Commencing on the 1st day of October, 2022 and ending with the
30th day of September, 2023.
1. Place of Cultivation
Opium poppy cultivation may be licensed in any tract as may be notified in this behalf by the Central
Government.
2. Eligibility for Cultivation
Subject to clauses 3 and 7 of this notification, the following shall be eligible for a license to cultivate opium
poppy for production of Poppy Straw from which no juice is extracted through lancing:
i. Cultivators who had cultivated opium poppy for production of Poppy Straw from which no juice is
extracted through lancing during the crop year 2021-22 and tendered poppy straw at weighment centre.
ii. Cultivators who have tendered an average yield of Morphine (MQY-M) 3.0 kg per hectare and above but
less than 4.2 kg per hectare in crop year 2021-22.
iii. Cultivators who are eligible for license under opium poppy cultivation for obtaining opium gum after
lancing, if they opt voluntarily to cultivate opium poppy for production of Poppy Straw from which no juice
is extracted through lancing.
iv. Cultivators who ploughed back their entire poppy crop cultivated during the crop year 2021-22 under the
supervision of the Central Bureau of Narcotics in accordance with the provisions in this regard.
v. Cultivators who were eligible for a license for the crop year 2021-22 but did not obtained/issued a license
for any reason, or who after having obtained a license, did not actually cultivate opium poppy due to any

vi. Cultivators who were de-licensed during crop year 1999-2000 to 2021-22 on the grounds of tendering
inferior opium but their morphine content was found more than 6% in the test results of the Government
Opium Alkaloid Works at Neemuch or Ghazipur.
vii. Cultivators who were de-licensed in the crop year since 1998-99 to crop year 2021-22 provided they have
tendered average opium/Morphine having total average equal/equivalent to or more than 100 percent the
total of MQY (fixed for licensing in the next crop year) for last four tendered years including the year of de
licensing. In case of transfer of license to legal heir, average tendering by deceased cultivators would be
taken into account for computation of total of averages of opium tendered.
viii. One of the legal heirs of deceased cultivators, as determined by the District Opium Officer after following
the due process, who were eligible for license since crop year 1999-2000 however could not obtain license
due to dispute in deciding legal heir.
ix. Cultivators who were de-licensed on the ground of charge/charges in any competent court for any offence
under NDPS Act, 1985 and the Rules made there under provided that they have been acquitted by the
competent court of Law in said case/ cases and such order/orders of acquittal has become final as on
31st July 2022, subject to production of certified copy of judgment and declaration to this effect.
Note:- Cultivators include their legal Heirs also
3. Conditions of License
No cultivator shall be granted license unless he/she satisfies that:
i. He/She did not, in the course of actual cultivation, exceed the area licensed for poppy cultivation during the
crop year 2021-22 beyond the 5% ‘Condonable Limit’ allowed in the licensing policy.
ii. He/she did not at any time resort to illicit cultivation of opium poppy and was not charged in any competent
court for any offence under the Narcotic Drugs and Psychotropic Substances Act, 1985, and the Rules made
there under.
iii. He/she did not during the crop year 2021-22 violate any departmental instructions issued by the Central
Bureau of Narcotics/ Narcotics Commissioner to the cultivators.
4. Maximum Area
i. All eligible cultivators will be issued license of 0.10 Hectares each.
ii. Cultivators can sow opium poppy in not more than two plots.
iii. Cultivators will be permitted to take on lease, land belonging to others, to make up the licensed area, if they
so desire.
5. Period of license
i. License to cultivate opium poppy for production of Poppy Straw from which no juice is extracted through
lancing will be issued for five crop years from the issuance i.e. license issued to cultivators for crop year
2022-23 will remain effective till crop year 2027-28.
ii. License will remain in force until cultivator
a. is found involved in illicit activities,
b. is charge sheeted under NDPS act,
c. violate the departmental instructions related to opium poppy cultivation.
d. voluntarily surrender license before CBN.
6. Forewarning
i. Morphine content of opium tendered during 2022-23 may become the basis for payment for the crop year
2022-23, if the Government decides to do so in this regard.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
ii. Cultivators who fully ploughed back their entire poppy crop for consecutive e three crop years would not be
entitled for license in the next crop year.
7. Condonable Limit:
If the area actually cultivated is up to 5% in excess of the licensed area, such excess cultivation maybe
condoned.
8. Miscellaneous
i. Any cultivator who cultivates opium poppy during 2022-23 in his own land or in the land leased from
others shall provide details of owner of the plot, survey number and any other details as may be directed by
the Narcotics Commissioner.
ii. These General Licensing conditions are without prejudice to the right of the Narcotics Commissioner/
Deputy Narcotics Commissioner to issue/ withhold a license whenever it is deemed proper so to do in
accordance with the provisions of the Narcotic Drugs & Psychotropic Substances Act, 1985 and the Rules
made thereunder.
iii. The license will be subject to the condition that any field may be taken over for any research that may be
conducted by the Government directly or in collaboration with any specialized Institution or Agency. The
cultivator whose field is selected for research shall be considered for license for the next year, if he has
tendered the stipulated MQY and is otherwise eligible. The area taken over for research will not be taken
into account while calculating the yield.
iv. The license shall be subject to the further condition that any field may be selected for obtaining poppy straw
without extraction of opium. The cultivators whose fields are selected for such use shall be eligible for a
license for the next crop year, if otherwise eligible.
v. For the purpose of making payment of opium tendered by the cultivator, the quantity of opium tendered by
a farmer will be calculated at 70° consistency, on the basis of analysis by the Government Opium and
Alkaloid Works, Neemuch or Ghazipur.
vi. In respect of cultivators having opium cultivation license in a particular village but are having residence in
adjacent village, such cultivators may be allowed to store opium in their residence, provided that there is
continuous human settlement between such villages.
vii. If there is difference in any para of Hindi version of opium policy 2022-23 then English version of same
shall be followed.
