ऐसे िनसाधारण की िानकारी के जलए प्रकाजित दकर्ा िाता ह ै जिनके उसस े प्रभाजवत होने की संभावना ह,ै और र्ह भी सूजचत दकर्ा िाता ह ै दक उि प्रारूप अजधसूचना पर, जिस तारीख इस अजधसूचना को अंतर्वाष्ट करन े वाले भारत के रािपत्र की प्रजतर्ां िनसाधारण को उपलब्ध करा िी िाती ह,ैं उस तारीख से साि दिन की अवजध की समाजि पर र्ा उसके पश् चातह ही जवचार दकर्ा िाएगा; ऐसा कोई भी व्यजि, िो इस प्रारूप अजधसूचना म ें और कश्मीर के कश्मीर प्रांत के श्रीनगर, गंडेरबल और अनंतनाग जिलों में फैला हुआ ह।ै और िहा ाँ दक, िाचीगाम राष्ट्रीर् उद्यान जिसका क्षेत्रफल 141 वगा दकलोमीटर ह ै को अजधसूचना सं.एस.आर.ओ: 134, दिनांक 10 अप्रैल, 1990 द्वारा राष्ट्रीर् उद्यान के रूप में अजधसूजचत दकर्ा गर्ा ह।ै ओवेरा अरू वन्द्र्िीव अभर्ारण्र् जिसका क्षेत्रफल 425 वगा दकलोमीटर ह,ै को एस.आर.ओ:154, दिनांक 19 माच,ा 1987 द्वारा वन्द्र्िीव अभर्ारण्र् के रूप में अजधसूजचत दकर्ा गर्ा ह ै और थिवास (बालटाल) वन्द्र्िीव अभर्ारण्र् जिसका क्षेत्रफल 210 वग ा दकलोमीटर ह ै को एस.आर.ओ: 156, दिनांक 19 माच,ा 1987 द्वारा वन्द्र्िीव अभर्ारण्र् के रूप में अजधसूजचत दकर्ा गर्ा ह।ै और िहा ाँ दक, िाचीगाम राष्ट्रीर् उद्यान श्रीनगर िहर से उत्तर-पूवा में 21 दकलोमीटर की िरू ी पर जस्ट्थत ह।ै र्ह उद्यान औसत समुर तल स े 1600 मीटर स े 4250 मीटर की ऊंचाई के बीच ग्रेट िानस्ट्कर पवात श्रेणी में जस्ट्थत ह ै और र्ह केंर जहमालर्न धरु ी के उत्तर पजिम उपखंड बनाता ह।ै िाचीगाम हगं ुल (कश्मीर लाल जहरण), के अंजतम िीवनक्षम और उसकी स्ट्थाजनक संख्र्ा के वास के जलए प्रजसद्ध ह ै िो िजक्षण-पूवा एजिर्ा म ें बचा हुआ एकमात्र वास स्ट्थल ह।ै इस उद्यान की ऐसी प्रजतष्ठा ह ैदक इसे ििे म ेंसवोत्तम प्रबंजधत राष्ट्रीर् उद्यान होने का पुरस्ट्कार प्रिान दकर्ा िा सकता ह।ै और िहा ाँ दक, थिवास (बालटाल) वन्द्र्िीव अभर्ारण्र् श्रीनगर से उत्तर-पूवा में 105 दकलोमीटर की िरू ी पर जस्ट्थत ह।ै र्ह अभर्ारण्र् 3437 उ अक्षांि और 74o29’ से 74o36’ पू िेिांतर के बीच जस्ट्थत ह ै और इसके िार्रे में समुर तल स े 3015 मीटर से 5466 मीटर की ऊाँचाई वाली पवात श्रेजणर्ा ं आती ह।ै इसम ें ससंध वन संभाग के वन कम्पाटामेंट सं.56/एस से 62/एस तक भी आत े ह।ैं इस क्षेत्र के मुख्र् आकर्ाण कश्मीर कस्ट्तूरी मगृ (मोस्ट्र्ूस कूपरेर्ूस) और जहमालर्न ब्राऊन भाल ू (अरसस अकाटोस) िैसे िीविंतु ह।ै र्ह अभर्ारण्र् अन्द्र् महत्त्वपूण ा वन्द्र्िीव क्षेत्रों िैसे अरू, ऊपरी िाचीगाम और ससंध वन के साथ िुडा हुआ ह।ै र्ह वन्द्र्िीव अभर्ारण्र् ‘सोनमाग’ा की बडी-बडी बफीली चोरटर्ों और ससंध निी स े जिरा हुआ ह,ै िो दक इसकी राउट और महसीर संख्र्ा के जलए प्रजसद्ध ह।ै थिवास ग्लेजिर्र पर्ाटकों के जलए एक आकर्णा केंर ह,ै िहााँ पर्ाटक ग्रीष्म ऋत ुमें पर्ाटन पर आते ह।ैं और िहा ाँ दक, ओवेरा-अरू वन्द्र्िीव अभर्ारण्र् श्रीनगर के िजक्षण-पूवा स े 76 दकलोमीटर की िरू ी पर जस्ट्थत ह।ै र्ह 33o55'0"उ से 34o20'0" उ अक्षांि और 75o5'0" पू से 75o32'30" पू िेिांतर के बीच जस्ट्थत ह ै और कश्मीर िाटी के अनंतनाग जिला के अंतगात आता ह।ै ओवेरा-अरू अभर्ारण्र् के वन अनेक झीलों और ग्लेजिर्रों से समृद्ध है, िो दक िल का बहुमूल्र् स्त्रोत का काम करते ह ैं र्ही िल कई धाराओं का रुप लेकर िहर के पररधी से होते हुए ग्रामों के नीचे की ओर बहती ह।ैं और िहा ाँ दक, िाचीगाम राष्ट्रीर् उद्यान रॉिसा ईटी एल., 2002 द्वारा दकर्े गर्े िैव-भौगोजलक वगीकरण के अनुसार 2ए प्रांत के अतं गता आता ह।ै संिोजधत चैजम्पर्न और सेि (1968) के अनुसार िाचीगाम राष्ट्रीर् उद्यान की वनस्ट्पजतर्ााँ जवजिष्ट रूप स े जहमालर्न आर ा समिीतोष्ण वन, उप-अल्पाइन वन और अल्पाइन वन प्रकार की ह ैं और आर ा समिीतोष्ण पणापाती वन, परोरटर्ा (पोहू) झाडी वन, पजिम जहमालर्न जनचला स्ट्तर ब्ल ू पाइन वन, पजिमी जमजश्रत िंकुधारी वन, पणापाती अल्पाइन झाडी, पजिम जहमालर्न उप-अल्पाइन ब्रीच-रहोडोडेनड्रोन वन, ड्वॉफा िूनीपर झाडी, िुष्क समिीतोष्ण झाडी के रुप में वगीकृत की िा सकती ह।ैं और िहा ाँ दक, िाचीगाम राष्ट्रीर् उद्यान के कुछ जवजिष्ट वनस्ट्पजतर्ों और िंतओंु म ेंउल्मस वाजल्लजचअना, सैजलक्स अल्बा, पोपुलुस स्ट्पा., प्रूनस आमेजनर्ा, क्र्ूरकस रोबर, रोजबना प्सेउडोअकेजिर्ा, पेरोटीओपजसस िेकाइमोंरटअना, रोसा वेजब्बअना, रूबस जनवेउस, ऐस्ट्कुलुस इंजडका, िगलांस रेजगर्ा, पाइनस जग्रजफफथी, सपंड्रो, बेतुला उलरटजलस, िगलांस रेजगर्ा और जपकेर्ा स्ट्पा. पुष्प वाले प्रमुख वृक्षों की श्रेणी में र्ह क्षेत्र इंडीगोफेरा हतेरांथ, बेरबेररइस लर्दककम, और रोसा वेजब्बअना िैसी मुख्र् झाजडर्ों से जिरा हुआ ह।ै क्षत्रे की महत्त्वपूणा िीविंतु प्रिाजतर्ों में ग्र ेलंगरू (प्रस्ट्बटीस इंटेल्लसु ), रहसे ुस मकाक (मकाका मुलाट्टा), साधारण तेंिआु (पेन्द्थेरा प्रड्यूस), स्नो तेिआु (पेन्द्थरेा र्ूजनका), तेंिआु जबल्ली (फेजलस बेन्द्गालेंजसस), जसर्ार (कैजनस ऑररर्स), रेड लोमडी (वुल्पेस वुल्पेस), जहमालर्न ब्राउन भाल ू (उरसूस अरक्टोस), एजिर्ारटक ब्लैक भाल ू (उरसूस जथबेटानुस), र्ेल्लो थ्रोटेड माटीन (मारटीस फलाजवगलु ा), लॉग-टेल्ड ममोट (मन्नोटा बोबक), रोलेस जपका (ओचोटोना रोर्लेइ), एजिर्ाई इबेक्स (कपरा जसबरीका), कश्मीर मुस्ट्क जहरन (मोस्ट्चुस कुपरेउस), आदि आत े ह।ैं और िहा ं दक, ऊंचाई, आकृजत और मृिा म ें जभन्नता के कारण, ओवेरा-अरू वन्द्र्िीव अभर्ारण्र् में वनस्ट्पजतर्ों म ें जवजवधता िेखने को जमलती ह।ै अभर्ारण्र् की वनस्ट्पजत मुख्र्त: नालों के जनकट जनचला ऊंचे स्ट्थान में कैल (पाइनस जग्रजफफथी) के साथ फर (एबीसह पीड्राव) ह।ै भौजतक जवजवधताओं के कारण र्हााँ तटीर् वनस्ट्पजत (औसत समुर तल स े 1600-2300 मीटर ऊाँचाई पर), िंकुधारी वन (औसत समरु तल 2300-3000 मीटर), अल्पाइन झाडी और चरागाह (औसत समुर तल स े 3000-3500 मीटर की ऊाँचाई पर), रॉक फेस (औसत समुर तल 3500 मीटर की ऊाँचाई पर) पाए िाते ह।ैं ओवेरा-अरू वन और्धीर् बहुमूल्र् पौधों की प्रिाजतर्ों से भी समृद्ध ह।ै िैसे वन इस क्षेत्र में उगने वाले वन में कुछ और्धीर् पौधें भी होते ह ैं जिसमें अकोजनतम हटे ेरोफर्ल्लुम, अरनेजबर्ा बेंथाजम, अरटेजमजसर्ा अबससंजथर्म, बेरबेररस लीजसर्म, बेरगेजनर्ा सलगंुलाटा, डातुरा स्ट्तरामोजनर्म, डोओस्ट्कोर अडेलटोआईजडर्ा, लवातेरा कासमेररअना, सौस्ट्सुरेर्ा कोस्ट्तुस और ताक्र्स वाजल्लजचना आत े ह।ैं और िहा ाँ दक, ओवेरा-अरू वन्द्र्िीव अभर्ारण्र् रॉिसा और पनवार (1998) के द्वारा दकए गए िैव-भौगोजलक सीमांकन के अनुसार जहमालर्न िोन के उत्तर-पजिम प्रांत (प्रांत 2ए) के अंतगता आता ह।ै इस प्रांत में संपूणा कश्मीर िाटी आती ह ै और समिीतोष्ण और उप-उष्णकरटबंधीर् िलवार् ु कश्मीरी स्ट्टैग एव ं हगं ुल (केरवुस हगंलु हगंलु), कश्मीर मस्ट्क जहरन (मोस्ट्चुस कुपरेउस), जहमालर्न ब्लैक भालू (उरसूस जथबेटानुस), जहमालर्न ब्राउन भाल ू (उरसुस अरक्टोस), सामान्द्र् तेंिआु (पेन्द्थरेा प्रड्यूस), जहमालर्न ग्रे लगं ूर (प्रेस्ट्बटीस अिाक्स), रीसस मकाक (मकाका मुलाट्टा), रेड लोमडी (वुल्पेस वल्ुपेस), ब्राउन मुस्ट्क श्रेव (करोदकडुरा मुरीना), र्ेल्लो थ्रोटेड माटीन (मारटेस फलाजवगुला), लॉग-टेल्ड ममोट (मारमोट जहमाजलर्ना), कश्मीर वेमपॉर्र(मेरगाडेमाा जविेर्ता ह।ै और िहा ाँ दक, िाचीगाम राष्ट्रीर् उद्यान, ओवेरा-अरू वन्द्र्िीव अभर्ारण्र् और थिवास वन्द्र्िीव (बालटाल) अभर्ारण्र् की प्राकृजतक सीमाएं एक िसू रे से खुले भ-ू समतलीर् स्ट्तर पर जमलती ह।ैं िाचीगाम राष्ट्रीर् उद्यान की सीमा उत्तर और उत्तर-पूवी भाग पर ओवेरा-अरू वन्द्र्िीव अभर्ारण्र् के साथ जमलती ह ैिबदक ओवेरा-अरू वन्द्र्िीव अभर्ारण्र् की सीमा उत्तर और उत्तर-पूवी भाग पर थिवास वन्द्र्िीव अभर्ारण्र् के साथ जमलती ह।ै र्ह संरजक्षत क्षेत्र समृद्ध िैव-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] जवजवधता और पिओंु , पजक्षर्ों और वनस्ट्पजत की कुछ महत्त्वपणू ा/ स्ट्थाजनक प्रिाजतर्ों की अच्छी खासी िनसंख्र्ा से जमलकर बना ह।ै प्रस्ट्ताजवत पाररजस्ट्थजतकी संवेिी िोन इन क्षेत्रों को एक ही इकाई बनाता ह ै और इससे इन क्षेत्रों म ें िैव- जवजवधता के जवकास के जलए िीन प्रवाह करने म ेंमिि जमलगे ी। और िहा ाँ दक, िाचीगाम राष्ट्रीर् उद्यान, थिवास (बालटाल) वन्द्र्िीव अभर्ारण्र् और ओवेरा-अरू वन्द्र्िीव अभर्ारण्र् के चारों ओर के क्षेत्र को, जिसका जवस्ट्तार और सीमा इस अजधसूचना के पैराग्राफ 1 में जवजनर्िष्टा ह,ैं पाररजस्ट्थजतकी, पर्ाावरणीर् और िैव-जवजवधता की िजृ ष्ट स े पाररजस्ट्थजतकी संवेिी िोन के रूप म ें सुरजक्षत और सरं जक्षत करना तथा उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों के वगों को और उनके प्रचालन तथा प्रसस्ट्ं करण को प्रजतजर्द्ध करना आवश्र्क ह;ै अतः अब, केन्द्र सरकार पर्ावा रण (संरक्षण) जनर्मावली, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इस अजधसूचना में इसके पिातह पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की उपधारा (1) तथा धारा 3 की उपधारा (2) के खडं (v) और खंड (xiv) एवं उपधारा (3) के तहत प्रित्त िजिर्ों का प्रर्ोग करते हुए, िम्मू और कश्मीर केंर िाजसत प्रिेि के िाचीगाम राष्ट्रीर् उद्यान, थिवास (बालटाल) वन्द्र्िीव अभर्ारण्र् और ओवरे ा-अरू वन्द्र्िीव अभर्ारण्र् की सीमा के चारों ओर 200 मीटर से 13.15 दकलोमीटर तक जवस्ट्ताररत, क्षेत्र को िाचीगाम राष्ट्रीर् उद्यान, थिवास (बालटाल) वन्द्र्िीव अभर्ारण्र् और ओवेरा-अरू वन्द्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी संवेिी िोन (जिसे इसम ें इसके पश् चातह पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप म ें अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै र्था :- 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमा.-(1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार िाचीगाम राष्ट्रीर् उद्यान, थिवास (बालटाल) वन्द्र्िीव अभर्ारण्र् और ओवेरा-अरू वन्द्र्िीव अभर्ारण्र् की सीमा से 200 मीटर स े 13.15 दकलोमीटर तक ह ै और इस प्रकार इसका क्षेत्रफल 448.00 वगा दकलोमीटर का बनता ह।ै जवजभन्न दििाओं (दकलोमीटर) में पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार जनम्नानसु ार है:- दििा जवस्ट्तार अवस्ट्थान पजिम 200 मीटर पीडब्ल्र्ूडी िल टैंक और िलािर् िजक्षण 13.15 दकलोमीटर ख्रेव सीआर सीमा िजक्षण पजिम 5 दकलोमीटर खानमोह सीआर सीमा िजक्षण पूवा 1 दकलोमीटर ममल वन, जलड्डर नाला पूव ा 1 दकलोमीटर जनचांग, अल्पाइन चरागाह उत्तर पूवा 1 दकलोमीटर सेबाल ग्राम, ससंध वन उत्तर 1 दकलोमीटर ससंध का वन उत्तर पजिम 4 दकलोमीटर जलडवास, अल्पाइन चारागाह िारा सीआर सीमा (2) िाचीगाम राष्ट्रीर् उद्यान, थिवास (बालटाल) वन्द्र्िीव अभर्ारण्र् और ओवेरा-अरू वन्द्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण अनलु ग्नक-I के रूप में सलं ग्न ह।ै (3) सीमा जववरण और अक्षांिों और िेिांतरों के साथ पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करते हुए िाचीगाम राष्ट्रीर् उद्यान, थिवास (बालटाल) वन्द्र्िीव अभर्ारण्र् और ओवेरा-अरू वन्द्र्िीव अभर्ारण्र् के मानजचत्र अनलु ग्नक–IIक, अनलु ग्नक–IIख, अनलु ग्नक –IIग और अनलु ग्नक–IIि के रूप में सलं ग्न ह।ैं[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण सारणी ख म ेंिी गई ह।ै (5) मुख्र् सबंिओंु पर भू-जनिेिांकों के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगात आन े वाल े ग्रामों की सूची अनलु ग्नक– IV के रूप म ेंसंलग्न ह।ै 2. पाररजस्ट्थजतकी संविे ी िोन के जलए आचं जलक महार्ोिना.–(1) संि िाजसत प्रििे की सरकार इस अजधसूचना के सरकारी रािपत्र में प्रकािन की तारीख से िो वर्ा की अवजध के भीतर तथा स्ट्थानीर् लोगों के साथ परामिा करके और इस संि िाजसत प्रिेि के सक्षम प्राजधकाररर्ों के अनुमोिन हते ु इस अजधसूचना म ें िी गर्ी जवजनर्िजा ष्टर्ों का अनुपालन करते हुए इस पाररजस्ट्थजतकी संवेिी िोन के जलए एक आंचजलक महार्ोिना बनार्ेगी। (2) केंर िाजसत प्रिेि सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसूचना में जवजनर्िष्ा ट रीजत से तथा प्रासंजगक केंरीर् और केंर िाजसत प्रिेि जवजधर्ों के अनरूु प तथा केंर िाजसत प्रिेि सरकार द्वारा िारी दकर्े गर्े दििा जनिेिों, र्दि कोई हों, के अनुसार बनार्ी िाएगी। (3) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी और पर्ाावरण सबं ंधी बातों को िाजमल करन े के जलए इस े केंर िाजसत प्रििे सरकार के जनम्नजलजखत जवभागों के परामि ासे बनार्ा िाएगा, र्था:- (i) पर्ाावरण; (ii) वन; (iii) कृजर्; (iv) रािस्ट्व; (v) िहरी जवकास; (vi) पर्ाटन; (vii) ग्रामीण जवकास; (viii) ससंचाई और बाढ़ जनर्ंत्रण; (ix) प्रिर्ू ण जनर्ंत्रण बोड;ा (x) नगरपाजलका; (xi) पंचार्ती राि; और (xii) लोक जन मााण जव भाग। (4) िब तक इस अजधसूचना में जवजनर्िष्टा न हो, आंचजलक महार्ोिना में वतामान में अनमु ोदित भू-उपर्ोग, अवसंरचना और दिर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा तथा आचंजलक महार्ोिना में सभी अवसंरचनाओं और दिर्ाकलापों में सुधार करके उन्द्ह ेअजधक सक्षम और पाररजस्ट्थजतकी-अनुकूल बनान ेकी व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना म ें वनरजहत और अविजमत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के सरं क्षण, िलग्रहण क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी एवं पर्ाावरण के ऐसे अन्द्र् पहलओंु की व्यवस्ट्था की िाएगी जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै (6) आंचजलक महार्ोिना में सभी जवद्यमान पूिा स्ट् थलों, ग्रामों एवं िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों एवं दकस्ट् मों, कृजर् क्षेत्रों, ऊपिाऊ भूजम, उद्यानों एवं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा का सहार्क मानजचत्र के साथ जनधाारण दकर्ा िाएगा और मौिूिा और प्रस्ट्ताजवत भू-उपर्ोग की जविेर्ताओं का ब्र्ौरा भी दिर्ा िाएंगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (7) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी संवेिी िोन में होने वाले जवकास का जवजनर्मन दकर्ा िाएगा और सारणी म ें र्थासूचीबद्ध पैराग्राफ 4 में प्रजतजर्द्ध एवं जवजनर्जमत दिर्ाकलापों का पालन दकर्ा िाएगा। इसमें स्ट् थानीर् िनता की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनिर्न एव ंसंवधान दकर्ा िाएगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) अनुमोदित आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक संिभा िस्ट्तावेि का काम करेगी तादक वह इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपने कताव्यों का जनवाहन कर सके । 3. केंर िाजसत प्रिेि सरकार द्वारा दकए िान े वाल े उपार्.- केंर िाजसत प्रिेि सरकार इस अजधसूचना के उपबंधों को लाग ू करने के जलए जनम्नजलजखत उपार् करेगी, र्था:- (1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजर् क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खलु े स्ट्थानों का वृहि वाजणजयर्क र्ा आवासीर् पररसरों र्ा औद्योजगक दिर्ाकलापों के जलए प्रर्ोग र्ा संपररवतान दकर् े िाने को अनुमजत नहीं िी िार्गे ी: परंतु पाररजस्ट्थजतकी संवेिी िोन के भीतर, ऊपर भाग (क), में जवजनर्िष्टा प्रर्ोिन से जभन्न प्रर्ोिन के जलए, कृजर् और अन्द्र् भूजम के संपररवतान को जनगरानी सजमजत की जसफाररि पर और क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा र्था लागू केन्द्र सरकार एवं केंर िाजसत प्रिेि सरकार के अन्द्र् जनर्मों एवं जवजनर्मों के अधीन सक्षम प्राजधकारी के पूव ा अनुमोिन से तथा इस अजधसूचना के उपबंधों के अनुसार स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् िरूरतों को पूरा करने के जलए अनुमजत िी िा सकेगी, र्था:- (i) जवद्यमान सडकों को चौडा करना, उन्द्ह ेंसुिढ़ृ करना और नई सडकों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का जनमााण और नवीकरण; (iii) प्रिर्ू ण उत्पन्न न करन े वाले लि ु उद्योग; (iv) कुटीर उद्योग एवं ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन में सहार्क सुजवधा भण्डार और स्ट्थानीर् सुजवधाएं तथा गृह वास; और (v) पैराग्राफ-4 में र्था उजल्लजखत दिर्ाकलाप जिन्द्ह ेंबढ़ावा दिर्ा गर्ाः परंतु र्ह भी दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना तथा केंर िाजसत प्रिेि सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों एव ं संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगात अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनपु ालन दकए जबना वाजणजयर्क र्ा औद्योजगक जवकास दिर्ाकलापों के जलए िनिातीर् भूजम के उपर्ोग की अनुमजत नहीं होगी। परंत ु र्ह भी दक पाररजस्ट्थ जतकी संवेिी िोन के अतं गता आने वाली भूजम के अजभलेखों म ें हुई दकसी त्रुरट को, जनगरानी सजमजत के जवचार प्राि करन े के पिातह, केंर िाजसत प्रिेि सरकार द्वारा प्रत्र्ेक मामले म ें एक बार सुधारा िाएगा और उि त्रुरट को सुधारे िान ेकी सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह भी दक उपर्ुाि त्रुरट को सुधारन े में, इस उप-पैरा म ें र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भ-ू उपर्ोग का पररवतान िाजमल नहीं होगा। (ख) अनुप्रर्िु र्ा अनुत् पािक कृजर् क्षेत्रों में वनीकरण तथा पर्ाावासों की बहाली के कार्ाकलापों के द्वारा पनु : वनीकरण के प्रर्ास दकए िाएंगे।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक िलस्त्रोतों के िलग्रहण क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना म ें उनके संरक्षण और बहाली की र्ोिना सजम् मजलत की िाएगी और केंर िाजसत प्रििे सरकार द्वारा दििा-जनिेि इस तरह स े तैर्ार दकए िाएगं े दक उसमें ऐसे क्षेत्रों में र्ा उसके पास जवकास दिर्ाकलापों को प्रजतजर्द्ध और जनबंजधत दकर्ा गर्ा हो। (3) पर्टा न एव ं पाररजस्ट्थजतकी पर्टा न.– (क) पाररजस्ट्थजतकी संवेिी िोन में सभी नए पाररजस्ट्थजतकी पर्ाटन दिर्ाकलाप र्ा जवद्यमान पर्ाटन दिर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन संबंधी पर्ाटन महार्ोिना के अनुसार ही हो सकेंगे। (ख) र्ह पर्ाटन महार्ोिना संि िाजसत प्रिेि के पर्ाटन जवभाग द्वारा संि िाजसत प्रििे के ही पर्ाटन और वन जवभाग के परामिा से तैर्ार की िाएगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का ही एक िटक होगी। (ि) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबधं ी दिर्ाकलाप जनम्न ानुसार जवजनर्जमत दकए िाएंग,े र्था:- (i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, दकसी नर्े होटल र्ा ररिॉटा के जनमााण की अनुमजत नहीं िी िार्ेगी। परंतु र्ह पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए संरजक्षत क्षत्रे की सीमा से एक दकलोमीटर की िरू ी से परे तथा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक पाररजस्ट्थजतकी सुजवधाओं के जलए केवल पूव ा जनधााररत र्ा जवजनर्िष्टा क्षेत्रों में नए होटलों और ररिॉटा की स्ट्थापना की अनुमजत िी िा सकेगी; (ii) पाररजस्ट्थजतकी संवेिी िोन के अन्द्िर सभी नए पर्ाटन दिर्ाकलापों र्ा जवद्यमान पर्टा न दिर्ाकलापों का जवस्ट्तार, केन्द्र सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा िारी दििाजनिेिों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेने वाल े राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी दििाजनिेिों (समर्-समर् पर र्था सिं ोजधत) के अनुसार ही दकर्ा िा सकेगा; (iii) आंचजलक महार्ोिना का अनुमोिन होन े तक, पर्ाटन के जवकास और जवद्यमान पर्टा न दिर्ाकलापों के जवस्ट्तार के जलए वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा जनगरानी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमजत िी िा सकेगी और पाररजस्ट्थजतकी संवेिी िोन में दकसी नए होटल/ ररिॉटा र्ा वाजणजयर्क प्रजतष्ठान को जनमााण की अनुमजत नहीं होगी । (4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन के अंतगता आने वाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैस े दक िीन पलू ररिवा क्षेत्र, िैल संरचना, िल प्रपात, झरन,े िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और उनके सुरक्षा एवं सरं क्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना भी बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना भी बनार्ी िाएगी। (6) ध्व जन प्रिर्ू ण.- पर्ाावरण अजधजनर्म के अंतगात ध्वजन प्रिर्ू ण (जवजनर्मन और जनर्त्रं ण) जनर्म, 2000 में जनर्त उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रिर्ू ण का रोकथाम और जनर्ंत्रण दकर्ा िाएगा । (7) वार् ु प्रिर्ू ण.- पाररजस्ट्थजतकी संवेिी िोन में, वार्ु प्रिर्ू ण का जनवारण और जनर्ंत्रण, वार् ु (प्रिर्ू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा ।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत बजहस्राव का जनस्ट्सरण, पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आन े वाल े पर्ाावरणीर् प्रिर्ू ण के जनस्ट्सरण के जलए साधारण मानकों र्ा केंर िाजसत प्रिेि सरकार द्वारा जनर्त मानकों, िो भी अजधक किोर हो, के उपबंधों के अनुसार होगा। (9) िोस अपजिष्ट.- िोस अपजिष्ट का जनपटान एवं प्रबन्द्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में िोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसचू ना सं. का.आ. 1357(अ), दिनांक 8 अप्रैल, 2016 के तहत प्रकाजित िोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन स ेबाहर अजभज्ञात दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्द्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िोस अपजिष्ट के जनरापि और पर्ाावरण अनुकूल प्रबंधन की अनुमजत िी िा सकेगी। (10) िैव जचदकत्सा अपजिष्ट.- िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्–समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016 के तहत प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्द्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनरूु प िैव जचदकत्सा अपजिष्ट के जनरापि और पर्ाावरण अनुकूल प्रबंधन की अनुमजत िी िा सकेगी। (11) प्लाजस्ट्टक अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माच,ा 2016 के तहत प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबधं ो के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 317(अ), तारीख 29 माचा, 2016 के तहत प्रकाजित संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित तथा समर्-समर् पर र्था संिोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) सडक-र्ातार्ात.- सडक-र्ातार्ात को पर्ाावास-अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध म ें आंचजलक महार्ोिना म ें जविेर् उपबंध दकए िाएंगे। आंचजलक महार्ोिना के तैर्ार होन े और केंर िाजसत प्रििे सरकार के सक्षम प्राजधकारी स े अनुमोदित होन े तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके तहत बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार सडक-र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन िजनत प्रिर्ू ण.- वाहन िजनत प्रिर्ू ण की रोकथाम और जनर्ंत्रण लागू जवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ा.ं- (क) सरकारी रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख को र्ा उसके बाि पाररजस्ट्थजतकी संवेिी िोन म ेंदकसी नए प्रिर्ू णकारी उद्योग की स्ट्थापना की अनुमजत नहीं होगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 (ख) केन्द्रीर् प्रिर्ू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी समर्-समर् पर र्था सिं ोजधत मागाििाक जसद्धान्द्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िष्टा न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर- प्रिर्ू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रिर्ू णकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा। (17) पहाडी ढलानों का सरं क्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना म ें पहाडी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनमें दकसी भी जनमााण की अनुमजत नहीं होगी। (ख) जिन ढलानों र्ा जवद्यमान खडी पहाडी ढलानों में अत्र्जधक भू-क्षरण होता ह ै उनम ें दकसी भी जनमााण की अनुमजत नहीं होगी। 4. पाररजस्ट्थजतकी सवं िे ी िोन म ें प्रजतजर्द्ध र्ा जवजनर्जमत दकए िान े वाल े दिर्ाकलापों की सचू ी- पाररजस्ट्थजतकी संवेिी िोन में सभी दिर्ाकलाप, पर्ाावरण अजधजनर्म और उसके अधीन बन े जनर्मों के उपबंधों, जिसमें तटीर् जवजनर्मन िोन, 2011 और पर्ाावरणीर् प्रभाव आकलन अजधसूचना, 2006 िाजमल ह,ै सजहत वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्द्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) तथा उनम ें दकए गए सिं ोधनों के अनुसार अजधिाजसत होंग े और नीच े िी गई सारणी म ें जवजनर्िष्टा रीजत स े जवजनर्जमत होंगे, र्था:- सारणी ि. स.ं दिर्ाकलाप रटप्पणी क. प्रजतजर्द्ध दिर्ाकलाप 1. वाजणजयर्क खनन, पत्थर उत्खनन प्रकार के नए और जवद्यमान खनन (लिु और वृहत खजनि), पत्थर उत्खनन और अपिर्ाण इकाइर्ां तत्काल प्रभाव से प्रजतजर्द्ध होंगी; (ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) सं. 202 में टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संि के मामले म ें माननीर् उच्चतम न्द्र्ार्ालर् के आििे 4 अगस्ट्त, 2006, 26 अप्रैल, 2023 और 28-04-2023 और 2012 की ररट र्ाजचका (जसजवल) स.ं 435 में गोवा फाउंडेिन बनाम भारत संि के मामल ेमें आर्े तारीख 21 अप्रैल, 2014 के आििे के अनुसरण म ें होगा । 2. प्रिर्ू ण (िल, वार्ु, मृिा, ध्वजन, आदि) पाररजस्ट्थजतकी संवेिी िोन म ें कोई नर्ा उद्योग लगाने और वतामान प्रिर्ू णकारी उद्योगों का जवस्ट्तार करने की अनुमजत नहीं होगीः उत्पन्न करने वाले उद्योगों की स्ट्थापना । परन्द्तु र्ह दक केन्द्रीर् प्रिर्ू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 म ें िारी समर्-समर् पर र्था संिोजधत मागाििाक जसद्धान्द्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में ऐसा जवजनर्िष्टा न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गैर-प्रिर्ू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि गैर-प्रिर्ू णकारी कुटीर उद्यागों को बढ़ावा दिर्ा िाएगा। 3. बडी िल जवद्युत पररर्ोिनाओं की प्रजतजर्द्ध। स्ट्थापना । 4. दकसी पररसंकटमर् पिाथा का प्रर्ोग र्ा प्रजतजर्द्ध। उत्पािन र्ा प्रस्ट्संकरण ।10 THE पाररजस्ट्थजतकी पर्ाटन दिर्ाकलापों हते ु लि ु अस्ट्थार्ी संरचनाओं के जनमााण के स्ट्थापना । जसवार्, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, नए वाजणजयर्क होटलों और ररसोटो की स्ट्थापना की अनुमजत नहीं होगी: परंतु, संरजक्षत क्षेत्र की सीमा स े एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, पर्ाटन महार्ोिना और लाग ू दििाजनििे ों के अनुसार सभी नए पर्ाटन दिर्ाकलाप करने र्ा जवद्यमान दिर्ाकलापों का जवस्ट्तार करने की अनुमजत नहीं होगी । 11. जनमााणकारी दिर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक िो भी जनकट हो, दकसी भी प्रकार के वाजणजयर्क जनमााण की अनमु जत नहीं िी िार्ेगी। परंतु स्ट् थानीर् लोगों को पैराग्राफ 3 के उप पैराग्राफ (1) में सूचीबद्ध दिर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम में स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने जलए जनमााण करने की अनुमजत भवन उपजवजधर्ों के अनुसार िी िा सकेगी। परन्द्तु ऐसे लिु उद्योगों िो प्रिर्ू ण उत् पन्द् न नहीं करते ह,ैं से संबंजधत जनमााण दिर्ाकलाप जवजनर्जमत दकए िाएंग े और लाग ू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार तथा सक्षम प्राजधकारी की पूवा अनमु जत से ही दकर्े िा सकेंग ेऔर ऐसे दिर्ाकलाप कम से कम ही दकर्े िार्ेंगे। (ख) एक दकलोमीटर से आगे आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे। 12. गैर प्रिर्ू णकारी लिु उद्योग। फरवरी, 2016 में केन्द्रीर् प्रिर्ू ण जनर्ंत्रण बोडा द्वारा िारी, समर्-समर् पर र्था संिोजधत उद्योगों के वगीकरण के अनुसार गैर-प्रिर्ू णकारी उद्योग और अपररसंकटमर्, लिु और सेवा उद्योग, कृजर्, पुष्प कृजर्, बागवानी र्ा पाररजस्ट्थजतकी संवेिी िोन से ििे ी सामग्री से उत्पािों को उत्पन्न करने वाले कृजर् आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे। 13. वृक्षों की कटाई । (क) केन्द्र िाजसत सरकार के सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं हो सकेगी। (ख) वृक्षों की कटाई केंरीर् र्ा संबंजधत संि िाजसत प्रििे के अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबधं ों के अनुसार जवजनर्जमत होगी । 14. वन उत्पािों और गैर काष्ठ वन उत्पािों लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा । का संग्रहण । 15. जवद्युत और संचार टॉवर लगाने, तार- लाग ू जवजधर्ों के अधीन जवजनर्जमत होंग े। पैमाने पर वाजणजयर्क पिुधन संपिा और कुक्कुट फामों की स्ट्थापना । 22. प्राकृजतक िल जनकार्ों र्ा भ ू क्षेत्र म ें िल जनकार्ों में उपचाररत अपजिष्ट िल/बजहस्रााव के जनस्ट्सरण से बचा िाएगा उपचाररत अपजिष्ट िल/बजहस्रााव का और उपचाररत अपजिष्ट िल के पुनचािण और पुन:उपर्ोग के प्रर्ास दकए जनस्ट्सरण । िाएंग ेअन्द्र्था उपचाररत अपजिष्ट िल/बजहस्रााव का जनस्ट्सरण लागू जवजधर्ों के अनुसार जनजर्द्ध दिर्ाकलापों को छोडकर, की जनगरानी सजमजत द्वारा वास्ट्तजवक साइट-जवजिष्ट की जस्ट्थजतर्ों के आधार पर िांच की िाएगी और संबंजधत जवजनर्ामक प्राजधकरणों को जनर्िष्टा की िाएगी।[भाग II—खण् ड 3(ii)] भारत Overa-Aru Wildlife Sanctuary is spread over an area of 776 sq.km. and is located in the Srinagar, Ganderbal and Anantnag Districts in Kashmir province of the Union Territory of Jammu and Kashmir. AND WHEREAS, the Dachigam National Park, comprising an area of 141 sq.km. has been notified as National Park vide notification No. S.R.O:134, dated 10th April, 1990. The Overa Aru Wildlife Sanctuary comprising an area of 425 sq.km. has been notified as Wildlife Sanctuary vide S.R.O: 154 dated 19th March, 1987 and Thajwas (Baltal) Wildlife Sanctuary comprising an area of 210 sq.km. has been notified as Wildlife Sanctuary vide S.R.O: 156 dated 19th March, 1987. AND WHEREAS, the Dachigam National Park is located at a distance of 21 km, North-East from Srinagar city. The park lies in the great Zanskar mountain range between altitudes of 1600 metres to 4250 meters above mean sea level and forms the North-West branch of the Central Himalayan axis. The Dachigam is famous for harbouring the last viable and endemic population of Hangul (Kashmir red deer), the only abode left in South-East Asia. The park has the prestige to be the recipient of the award for the best managed National Park in the country. AND WHEREAS, the Thajwas (Baltal) Wildlife Sanctuary is located at a distance of 105 kilometer, North- East from Srinagar. The sanctuary lies between 3437 N Latitude and 74o29’ to 74o36’ E Longitude and covers an altitudinal range of 3,015 m to 5,466 m above mean sea level. It comprises of forest compartment numbers from 56/S to 62/S of Sindh Forest Division. The main faunal attraction of this area is the Kashmir musk deer (Moschus cupreus)and Himalayan brown bear (Ursus arctos). The sanctuary is connected with other important wildlife areas, like Aru, Upper Dachigam and the Sindh forest. The Wildlife Sanctuary is flanked by the large snow laden peaks of ‘Sonamarg’ and the Sindh River, which is famous for its trout and mahseer population. Thajwas glacier is one of the tourist attraction visited by tourists in the summer months. AND WHEREAS, the Overa-Aru Wildlife Sanctuary is located at a distance of 76 kilometres from South- East of Srinagar. It lies between 33o55'0"N to 34o20'0" N Latitude and 75o5'0" E to 75o32'30" E Longitude and falls in the Anantnag District of the Kashmir Valley. The forests of Overa-Aru sanctuary are blessed with a number of lakes and glaciers, which happen to be invaluable sources of water, feeding numerous streams that flow down into the villages situated near the periphery. AND WHEREAS, the Dachigam National Park comes under 2A province of bio-geographic classification as suggested by Rodgers et al., 2002. As per revised Champion and Seth (1968), the vegetation of Dachigam National Park is typically Himalayan moist temperate forest, sub-alpine forest and alpine forest type and can be classified into moist temperate deciduous forest, Parrotia (pohu) scrub forest, west Himalayan low level blue pine forest, western mixed coniferous forest, deciduous alpine scrub, west Himalayan sub-alpine birch-rhododendron forest, dwarf juniper scrub, dry temperate scrub. AND WHEREAS,some of the notable flora and fauna of the Dachigam National Park includeUlmus wallichiana, Salix alba, Populus sp., Prunus armeniaca,Quercus robur, Robina pseudoacacia,Parrotiopsis jacquemontiana,Rosa webbiana, Rubus niveus, Aesculus indica,Juglans regia, Pinus griffithi, angaarda (Lychniscornaria (L.)Desr)., Bajardantu(Potentilla atrosanguinaLodd.), trumbadu (Picrishieracioides),Ghudkhura (Tussilago farfara), dodad (Codonopsis ovate), ratanjot(Onosmahispidum wallichex), Kashmir red deer(Cervus hangluhanglu.), Kashmir musk deer(Moschus cupreus), common leopard(Panthera pardus), Himalayan brown bear(Ursus arctos isabellinus), Asiatic black bear (Ursus thibetanus), Kashmir gray langur (Semnopithecus ajax), Himalayan griffon vulture(Gyps himalayensis), bearded vulture(Gypaetus barbatus), Kashmir flycatcher(Ficedula subrubra), etc.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, the area of Thajwas Wildlife (Baltal) Sanctuary is covered mostly under thick snow, round the year. The tree species such asAbies pindrow, Betula ultilis, Juglans regia and Picea sp. constitute the major assemblage of tree flora. Indigofera Hetranth, Berberies Lycicum, and Rosa Webbiana constitute the major shrub cover of the area. The important faunal species of the area are grey langur(Presbytis entellus), Rhesus macaque (Macaca mulatta), common leopard (Panthera pardus), snow leopard (Panther unica), leopard cat (Felis bengalensis), jackal(Canis aureus), red fox(Vulpes vulpes), Himalayan brown bear (Ursus arctos), Asiatic black bear (Ursus thibetanus), Yellow throated martin (Martis flavigula), long-tailed marmot (Mannota bobak), Royle’s pika (Ochotona roylei), Asiatic ibex (Capra sibrica), Kashmir musk deer (Moschus cupreus)etc. AND WHEREAS, due to variation in altitude, aspect and soil, a diversity of vegetation is discernible in the Overa-Aru Wildlife Sanctuary. The vegetation of the Sanctuary is mainly fir (Abis pindrow) with kail (Pinus griffithi) in the lower elevations near Nallas. On varied physical variations the forest types found are Riverian Vegetation (1600-2300meters above mean sea level), Coniferous Forests:(2300-3000 meters above mean sea level), Alpine Scrubs and Pastures:(Beyond 3000-3500meters above mean sea level), Rock Faces:(Beyond 3500meters above mean sea level). The Overa-Aru forests are blessed with numerous plant species of great medicinal value.Some of the medical plants growing wild in the area include Aconitum heterophyllum, Arnebia benthamii, Artemisia absinthium, Berberis lycium, Bergenia lingulata, Datura stramonium, Dioscore adeltoidea, Lavatera cashmeriana, Saussurea costus and Taxus wallichina. AND WHEREAS, the Overa-Aru Wildlife Sanctuary falls in the North-West province (Province 2A) of the Himalayan Zone as per the bio-geographic demarcation by Rodgers and Panwar (1998). This province includes the whole Kashmir valley, characterized by temperate and sub-tropical climate Kashmiri stag or hangul (Cervus hanglu hanglu), Kashmir musk deer (Moschus cupreus), Himalayan black bear (Ursus thibetanus), Himalayan brown bear (Ursus arctos), common leopard (Panthera pardus), Himalayan grey langur (Presbytis ajax), Rhesus macaque(Macaca mulata), red fox (Vulpus vulpes), brown musk shrew (Crocidura murina), yellow throated martin (Martes flavigula), long-tailed marmot (Marmot himaliyana), Kashmir vampire(Mergaderma spectrum), Leisler’s Hairy – armed bat (Nyctalus lessleri), Kashmir house rat(Rattus rattus), birch mouse (Sicista indica), Kashmir flying squirrel (Eoglaucomys fimbriatus), serow(Capricornis sumatraenis), Roule’s pika (Ochotona royelii), Himalayan griffon vulture(Gyps himalayensis), bearded vulture(Gypaetus barbatus), Kashmir flycatcher(Ficedula subrubra) etc. AND WHEREAS, the natural boundaries of Dachigam National Park, Overa-Aru Wildlife Sanctuary and Thajwas Wildlife(Baltal) Sanctuary are connected at landscape level. The boundary of Dachigam National Park on North and North Eastern side merges with Overa-Aru Wildlife Sanctuary while as Overa–Aru Wildlife Sanctuary on its North and North-Eastern side merges with Thajwas Wildlife Sanctuary. The protected areas together form a landscape of rich biodiversity and hold good population of some of the important/endemic species of animals, birds and vegetation. The Eco-sensitive zone proposed makes these areas as one unit and will help gene flow across these areas to flourish the biodiversity. AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Dachigam National Park, Thajwas (Baltal) Wildlife Sanctuary and Overa-Aru Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 200 meters to 13.15 kilometers around the boundary of Dachigam National Park, Thajwas (Baltal) Wildlife Sanctuary and Overa-Aru Wildlife Sanctuary, in the Union Territory of Jammu and Kashmir as Dachigam National Park, Thajwas (Baltal) Wildlife Sanctuary and Overa-Aru Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: 1. Extent and boundaries of Eco-sensitive Zone. – (1)The extent of Eco-Sensitive Zone shall be of 200 m to 13.15 km from the boundary of Dachigam National Park, Thajwas (Baltal) Wildlife Sanctuary and Overa- Aru Wildlife Sanctuary and comprising of an area of 448.00 sq.km. (3) The maps of the Dachigam National Park, Thajwas (Baltal) Wildlife Sanctuary and Overa-Aru Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB, Annexure-II C, Annexure-IID and Annexure-II E. (4) Lists of geo co-ordinates of the boundary of Dachigam National Park, Thajwas (Baltal) Wildlife Sanctuary and Overa-Aru Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure- III. (5) The list of village falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV. 2. Zonal Master Plan for Eco-sensitive Zone.-(1) The Union Territory Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the Union Territory. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the Union Territory Government in such manner as is specified in this notification and also in consonance with the relevant Central and Union Territory laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the Union Territory Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forests; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation & Flood Control; (ix) Pollution Control Board; (x) Municipality; (xi) Panchayati Raj; and (xi)Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 3. Measures to be taken by the Union Territory Government.-The Union Territory Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities; Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or Union Territory Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given in paragraph 4; Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Union Territory Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007); Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the Union Territory Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change; Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the Union Territory Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Tourism Master Plan shall be prepared by the Union Territory Department of Tourism in consultation with the Union Territory Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometer from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 29 (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. -Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under. (8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made there under or standards stipulated by the Union Territory Government, whichever is more stringent. (9) Solid wastes.-Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016, as amended from time to time. The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016, as amended from time to time. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and Demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the Union Territory Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act, 1972 (53 of 1972) and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE Sl. Provided that, non-polluting industries shall be allowed within Eco- Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted. 3. Establishment of major Prohibited. hydroelectric project. 4. Use or production or processing Prohibited. of any hazardous substance. 5. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye- laws to meet the residential needs of the local residents: Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 12. Small scale non-polluting Non-polluting industries as per classification of industries issued by industries. the Central Pollution Control Board in February, 2016, as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority. 13. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. Functions of the Monitoring Committee : (1) The Monitoring Committee shall, based on the actual site- specific conditions scrutinize, the activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1553 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification. (2) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (3) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the state as per pro-forma appended at Annexure V. (6) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures.-The Central Government and Union Territory Government may specify additional measures, if any, for giving effect to provisions of this notification. 8.
