1. संजिप्त, िीर्ाक और प्रारंभ -

1. (1) इन जनयमों को सीमा िल्ु क और केंद्रीय उत्पाि िल्ु क ड्रॉबैक (संिोधन) जनयम, 2026 कहा िा सकेगा।

(2) ये दिनांक 15.01.2026 को लागू होंगे।

2. सीमािुल्क और केंद्रीय उत्पाि िल्ु क ड्रॉबैक जनयम, 2017 म,ें - (क) जनयम 8 में, “जनयाात जबल या जिपपंग जबल” िब्िों के पश्चात, िब्ि और आंकडे “या डाक द्वारा जनयाात के जलए सीमािुल्क अजधजनयम, 1962 की धारा 84 के तहत की गई प्रजिजि” िोड ेिाएंगे;

309 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) जनयम 12 के िीर्ाक में, "डाक द्वारा" िब्िों के पश्चात, "िहा ं सीमा िल्ु क अजधजनयम, 1962 की धारा 84 के अंतगता कोई प्रजिजि मैन्यअु ल रूप से की िाती ह"ै िब्ि और आकं डे िोड ेिाएंग;े (ग) जनयम 13 म,ें-

(i) िीर्ाक में, “डाक द्वारा” िब्िों के स्ट्र्ान पर, “जनयम 12 के तहत जनयाात” िब्ि प्रजतस्ट्र्ाजपत दकए िाएंगे;

(ii) उप-जनयम (1) म,ें - (क) “के अलािा” िब्िों के बाि, “जनयम 12 के तहत आने िाल”े िब्ि और आंकड ेिोड ेिाएंग;े (ख) खंड (क) म,ें “जनयाात जबल” िब्िों के बाि, िहां भी िे आत े ह,ैं िब्ि और आंकडे “या डाक द्वारा जनयाात के जलए सीमा िल्ु क अजधजनयम, 1962 की धारा 84 के तहत की गई प्रजिजि” डाल ेिाएंग;े

(iii) उप-जनयम (2) म ें “जनयाता जबल” िब्िों के पश्चात “या डाक द्वारा जनयाात के जलए सीमािुल्क अजधजनयम, 1962 की धारा 84 के अंतगात की गई प्रजिजि” िब्ि और आंकडे िोड ेिाएंग;े (घ) जनयम 14 म,ें-

(i) िीर्ाक म,ें “डाक द्वारा” िब्िों की िगह “जनयम 12 के तहत जनयाात” िब्ि और आंकडे प्रजतस्ट्र्ाजपत दकए िाएगें;

(ii) उपजनयम (1) के बाि, जनम्नजलजखत उपजनयम िोडा िाएगा, अर्ाात:- “(1क) ड्रॉबैक के िाि े के तहत डाक से जनयाात के जलए धारा 84 के तहत इलेक्ट्रॉजनक तरीके से की गई प्रजिजि उस तारीख को िायर की गई ड्रॉबैक के जलए िािा माना िाएगा, जिस तारीख को सीमा िुल्क के उपयुि अजधकारी द्वारा उस धारा के तहत जनयाात के जलए माल की जनकासी और लोपडगं की अनुमजत िेने के आििे के बाि इलेक्ट्रॉजनक डेटा इंटरचेंि पर उि प्रजिजि प्राप्त होती ह ैऔर ड्रॉबैक के जलए उि िािे को ऐसे आिेि िेन े िाले उपयुि अजधकारी द्वारा बरकरार रखा िाएगा।” [फा. स.ं 609/75/2017-ड्रॉबैक (भाग-I)] ओम प्रकाि मीना, अिर सजचि नोट : मख्ु य जनयमों का प्रकािन अजधसूचना संख्या 88/2017-सीमािुल्क (एनटी), दिनांक 21 जसतंबर, 2017 के द्वारा भारत के रािपत्र, असाधारण, भाग II, खडं 3, उप- खंड (i) में संख्या सा.का.जन. 1177 (अ), तारीख 21 जसतंबर, 2017 के द्वारा दकया गया र्ा। MINISTRY OF FINANCE (Department Of Revenue)

NOTIFICATION New Delhi, the 15th January, 2026 No. 03/2026-Customs (N.T.) G.S.R.. 32(E).—In exercise of the powers conferred by section 75 of the Customs Act, 1962(52 of 1962) and

section 37 of the Central Excise Act, 1944 (11 of 1944), the Central Government hereby makes the following rules to amend the Customs and Central Excise Duties Drawback Rules, 2017, namely: -

1. Short, title and commencement. -

1. (1) These rules may be called the Customs and Central Excise Duties Drawback (Amendment) Rules, 2026.

(2) They shall come into force on the 15th day of January, 2026.

2. In the Customs and Central Excise Duties Drawback Rules, 2017, -

(a) in rule 8, after the words “bill of export or shipping bill”, the words and figures “or entry made under section 84 of the Customs Act, 1962, for exports by post” shall be inserted;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3

(b) in the heading of rule 12, after the words “by post”, the words and figures, “where an entry is made manually under section 84 of the Customs Act, 1962 ” shall be inserted;

(c) in rule 13, -

(i) in the heading, for the words “by post”, the words “exports under rule 12” shall be substituted;

(ii) in sub-rule (1),-

(A) after the words “other than”, the words and figures “those covered under rule 12’’ shall be inserted;

(B) in clause (a), after the words “bill of export”, at both places where they occur, the words and figures “or entry made under section 84 of the Customs Act, 1962, for exports by post” shall be inserted;

(iii) in sub-rule (2), after the words “bill of export”, the words and figures “or entry made under section 84 of the Customs Act, 1962, for exports by post” shall be inserted;

(d) in rule 14,-

(i) in the heading, for the words “by post”, the words and figures “exports under rule 12” shall be substituted;

(ii) after the sub-rule (1), the following sub-rule shall be inserted, namely:- “(1A) The entry made electronically under section 84 for exports by post under the claim of drawback shall be deemed to be a claim for drawback filed on the date on which the said entry is received on Electronic Data Interchange after the proper officer of Customs makes an order permitting clearance and loading of goods for exportation under that section and said claim for drawback shall be retained by the proper officer making such order”.
