(1986 का 29) की धारा 3 की ईपधारा (2) के खडं (v) तथा ईपधारा (3) के साथ परित ईपधारा (1) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, जारी करने का प्रस्ट्ताव करती ह ै को पयाावरण (सरं क्षण) जनयमावली 1986 के जनयम 5 के ईपजनयम (3) की ऄपेक्षानुसार, जनसाधारण की जानकारी के जलए प्रकाजित दकया जाता ह ै जजनके ईससे प्रभाजवत होन े की संभावना ह,ै और यह सूजचत दकया जाता ह ै दक ईि प्रारूप ऄजधसूचना पर, ईस तारीख से, जजसको आस ऄजधसूचना को ऄंतर्ववष्ट करने वाले भारत के राजपत्र की प्रजतया ं जनसाधारण को ईपलब्ध करा दी जाती ह,ैं साि ददन की ऄवजध की समाजि पर या ईसके पश् चात ् जवचार दकया जाएगा; ऐसा कोइ व्यजि, जो प्रारूप ऄजधसूचना कनााटक के बेलगावी जजले के खानापुर तालुक म ें महादयी नदी के जल ग्रहण क्षत्रे म ें फैला हुअ ह।ै आसकी कनााटक के ईत्तर कन्नड़ जजले म ें दडं ेली वन्द् य जीव ऄभयारण् य और गोवा म ें महादयी वन्द्यजीव 5140 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ऄभयारण्य के साथ साझी सीमा ह।ै ऄभयारण्य का कुल क्षेत्रफल 19042.58 हक्े टेयर ह।ै आस ऄभयारण् य को ईत्कृष्ट प्राणी और वनस्ट् पजत जवजवधता के साथ अरजक्षत वन्द् य क्षत्रे स े काट कर बनाया गया ह।ै और, पजिमी घाट, ऄपनी जवजिष्ट जस्ट्थजत की वजह स,े प्रायद्वीप म ें जैव-जवजवधता के संरक्षण के जलए एक महत्त्वपूणा भूजमका जनभाते ह।ैं ईनके द्वारा पोजित पाररजस्ट्थजतकी जवपुलता समृद्ध जैव जवजवधता और संवेदनिील भू-अकृजत ईनकी जवजिष्टता को और ऄजधक बढ़ाती ह।ै भीमगढ़ क्षत्रे एक व्यापक जैव जवजवधता वाला क्षत्रे ह ै और जनकटवती संरजक्षत क्षेत्रों के साथ बाघ और ऄन्द्य वन्द्य जीवों के जलए गजलयारा ईपलब्ध करता ह।ै भीमगढ़ की बारापेड गुफा भारत म ें रॉटन के फ्री टेल्ड चमगादड़ों के जलए एकमात्र पयाावास का केंर ह।ै भीमगढ़ क्षत्रे भी कृष्णपुर गुफाओं म ें जथयोबाल््स मकबरे के चमगादड़ों के जलए दिे म ें दलु ाभ पयाावासों म ें स े एक ह।ै और, भीमगढ़ वन्द्यजीव ऄभयारण्य को जनम्नजलजखत जविेिताएं और ऄजधक जवजिष्ट बनाती ह:ैं भीमगढ़ वन्द् यजीव ऄभयारण् य का क्षत्रे ऄध ा सदाबहार और खड़ी ढलान के साथ सदाबहार घन े जगं लों के पजिमी घाट के क्रोडजोन म ें ह ै आस क्षत्रे म ें प्रचरु जीवजंतु और वनस्ट्पतीय जवजवधता ह।ै आस क्षत्रे म ेंबहुत स े वन्द्यजीवों का महत्व ह।ै यह संकटापन्न और स्ट्थाजनक रॉईटन फ्री टेल्ड चमगादड़ (ओटोमोपसरॉईटनी) और थाआयोबल्डस ् टॉम्ब चमगादड़ (टेफोजसु थेओबल्डी) के जलए पयाावास के केंर ह।ैं बारापडे े गुफाए ँ भारत म ें रॉईटन फ्री टेल्ड चमगादड़ के जलए ही बसेरा और प्रजनन स्ट्थल के जलए जानी जाती ह।ै वनों म ें सुंदर वन स्ट्थली की पच्चीकारी और घासभूजम के साथ बाघ, तेंदअु , भारतीय गौर, रीछ, सांभर, मुंजक, चीतल, जंगली कुत्ता, ककग कोबरा के जलए और ऄन्द्य स्ट्तनधाररयों और जवजवध प्रकार के सरीसृपों के पयाावास ह।ैं जैव जवजवधता के सबसे समृद्ध भंडार वाला यह क्षत्रे गोवा म ें महादयी वन्द्यजीव ऄभयारण्य के पूवा म ें और कनााटक में दांदेली वन्द्यजीव ऄभयारण्य के ईत्तर म ें जस्ट्थत ह।ै यह संपूणा क्षत्रे दांदेली वन्द्यजीव ऄभयारण्य, काली टाआगर ररजवा, भगवान महावीर और महादयी वन्द्यजीव ऄभयारण्यों के बीच बाघों और ऄन्द्य वन्द्यजीवों के जलए प्राकृजतक गजलयारे के रूप म ें काया करता ह।ै यह क्षत्रे कइ जलधाराओं के ऄलावा महादायी, बैलनादी अदद जैसी कइ महत्वपूण ा नददयों का ईद्गम स्ट्थल और जलग्रहण स्रोत ह।ै आस क्षत्रे म ें कइ गुफाओं के साथ कइ भ-ू अकृजत जवज्ञान चनू ा पत्थर की संरचनाए ं िाजमल ह,ैं जो आस स्ट्थान के जलए स्ट्थाजनक जीवों और वनस्ट्पजतयों की जवस्ट्तृत जवजवधता को बढ़ाती ह।ैं ईपरोि के ऄलावा, ऄभयारण्य म ें ऐजतहाजसक भीमगढ़ दकल े के खंडहर िाजमल ह,ैं जजन्द्ह ें संरजक्षत करन े की अवश्यकता ह।ै और, भीमगढ़ वन्द्यजीव ऄभयारण्य के जंगल मुख्य रूप स े सदाबहार और ऄध-ा सदाबहार प्रकार के ह ैं जो लगभग समान ऄनुपात म ें पाए जाते ह।ैं हम्े मदगा खंड म ें ऄध-ा सदाबहार वनस्ट्पजत ऄजधक ह ै और िेि क्षत्रे म ें सदाबहार प्रकार की वनस्ट्पजत ह।ै ऄभयारण्य के असपास के पररधीय क्षत्रे म ें नम पणापाती वन ह।ैं पहाड़ी ढलानों पर घनी वनस्ट्पजत के साथ घास की भूजम का जविाल जवस्ट्तार मोजेक म ें पाया जाता ह।ै लैटेराआट पिार (सदास) म ें बड़े वृक्षों की वृजद्ध नहीं होती और केवल घास की वृजद्ध देखी जाती ह।ै और, भीमगढ़ वन्द्यजीव ऄभयारण्य के सदाबहार जगं लों म ें प्रमुख वृक्ष प्रजाजतयां ऄंजन (मेमेसीलोन एडुल)े , हब्े बालासु (अटोकापास जहसुाटस), वाटे (अटोकापास लकूचा), रामपात्री (जमररजस्ट्टका मालाबाररकम), दालजचनी (जसनामोमम एसपीएस), नंदी (लगे रस्ट्रोजमया लांसोलाटा), धुप (वेटेररया आंजडका), ऄिोक (साराकैजन्द्डका), दफिटेल पाम (कैररयोटॉरेन्द्स), गोवाडा (मैजपया फोरटडा) ह ैं। और, आस प्रकार की वनस्ट्पजत म ें िीिा केनोपी वाले वृक्ष प्रजाजतयों जैसे नंदी (लगे रस्ट्रोजमया लांसोलाटा), हरड़ (टर्वमनजलया चेबलु ा), कवल (केरेया अबोररया), अंवला (एजम्ब्लका ऑदफजसनैजलस), तारे (टर्वमनजलया बेजलररका), होन (पेरोकापास मासुाजपयम), ककडल (टर्वमनजलया पैजनकुलता), िीिम (डालबर्वगया लैरटफोजलया), जैक (अटोकापास एसपीपी), मुकी (बुचाजनया लानजान), धुप (जडप्टरोकापास आंजडकस), गलु मावु (मजचलुस माकरजनहा), जामुन (जसजजजगयम क्यूजमनी) अदद का बाहुल्य होता ह।ै और, 2ए/सी2 प्रकार एक जद्वतीयक क्रजमक प्रकार को स्ट्थान देता ह ै जो दजक्षणी ईष्णकरटबंधीय माध्यजमक नम पणापाती वनों स े मले खाता ह ै और य े वन्द्यजीव ऄभयारण्य के हम्े माडागा क्षत्रे म ें पाए जात े ह।ैं वृक्ष प्रजाजतयाँ जजजजफस, ब्यूरटया मोनोस्ट्पमा,ा टर्वमनजलया चेबुला, एजम्ब्लका ऑदफजसनाजलस, लैजसयोजसफॉन एरीओसफे ालस के साथ पाइ जाती ह।ैं और, भीमगढ़ वन्द्यजीव ऄभयारण्य म ें ऄजधकांि खुली जगह ें या तो घास की भूजम ह ैं या दकसी प्रकार की खरपतवार ईगी हुइ ह।ैं जवदिे ी खरपतवारों म ें स े लैंटाना का संक्रमण, हालांदक बहुत व्यापक नहीं ह,ै ऄबनाली और हम्े माडागा वन क्षेत्रों म ें देखा जाता ह।ै िेि क्षत्रे म ेंकम उंचाइ वाले यूपेटोररयम की बाहुलता ह।ैं[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3 और, भीमगढ़ क्षत्रे की ऄजधकांि पहाजड़यों म ें स्ट्रोजबलथैं ेस की दो प्रमुख प्रजाजतयों की ईपजस्ट्थजत ह,ै ऄथाता ् स्ट्रोजबलैंथेसेजसजलस और स्ट्रोजबलैंथेस कैलोससकोनोनली जजन्द्ह ें अमतौर पर क्रमिः बेकरा और कावी के नाम स े जाना जाता ह।ै लगभग 1000 हक्े टेयर वन क्षत्रे परू ी तरह स े बेकरा (स्ट्रोजबलैंथ े सेजसजलस) स े प्रभाजवत ह।ै दरू स े देखन े पर यह घास की जविाल भूजम जैसा ददखता ह ै क्योंदक बेकरा जहां यह ईगता ह ै ईस क्षत्रे म ें दकसी ऄन्द्य प्रजाजत को ईगन े की ऄनुमजत नहीं देता । और, लैटेरररटक पिार पर घास युि भूजम ऄपन े चारों ओर घनी वनस्ट्पजत के साथ मोजके पैटन ा बनाती ह।ै ऄभयारण्य के तलेवाडी, मेंजडल, गवली और हम्े माडागा क्षत्रे ों म ें 2000 हक्े टेयर स े ऄजधक घास यिु भूजम ईपलब्ध ह।ै ऄभयारण्य के ऄन्द्य जहस्ट्स े म ें भी घने जंगलों के बीच छोटी-छोटी घास की भूजम देखी जाती ह,ै जजससे बड़ी संख्या म ें घास चरने वाल े पिओंु के जलए चारे की ईपलब्धता रहती ह।ै और, भीमगढ़ वन्द् यजीव ऄभयारण् य औिधीय पौधों का एक समृद्ध भंडार ह ै। ऄमागाँव के ऄध ा सदाबहार वनों म ें स े एक ऐसा ही क्षत्रे वि ा 2010-11 के दौरान औिधीय पादप संरक्षण क्षत्रे (एम.पी.सी.ए.) के जलए पहचाना गया ह ै । ऄजभजलजखत की गइ प्रजाजतयों म ें स,े 82 प्रजतित पौध े औिधीय गणु ों के पाए गए ह।ैं ऄजभजलजखत दकए गए पौधों म ें स े लगभग 47 प्रजतित वृक्षों की प्रजाजतयाँ ह,ैं जजसम ें 28 % झाड़ी और 18% जड़ी-बूटी ह ै । आस क्षेत्र म ें ऄनकीसरोक्लाडुसेयनीऄनस, जडयोसआपरो स्ट्पेनीकुलाटा, आयोनयमस आंजडकस, माआररसरटका ऄरबोररया अदद कइ स्ट्थाजनक पौधों की प्रजाजतयों का स्ट्थान ह;ै कइ ऄजभजलजखत औिधीय पौधे जैस े ऄरीसटोलोचीऄटागाला, जडयोस्ट्पआपरो मोनटाना, आमबलीका अँदफसीनलीस, गरकीनीया आंजडका, नोथापोडयटेस्नीम्मोनीअना अदद के साथ ईच्च औिधीय और अर्वथक गणु ों से युि ह।ैं और, भीमगढ़ वन्द्यजीव ऄभयारण्य जवजभन्न प्रकार के स्ट्तनधाररयों, सरीसृपों, पजक्षयों, जततजलयों और ऄन्द्य कीड़ों का पयाावास ह।ै आस तथ्य के ऄलावा दक भीमगढ़ रॉटन फ्री टेल्ड चमगादड़ों के पयाावास और प्रजनन के जलए एकमात्र ज्ञात स्ट्थान ह,ै आस क्षत्रे म ें ऄन्द्य महत्वपूणा जिकारी और जिकार करने वाल े जानवर भी ह।ैं ऄभयारण्य म ें रह रह े बाघों की ईपजस्ट्थजत और ईनके जलए ऄच्छे जिकार की ईपलब्धता स े पता चलता ह ै दक यह बाघों के जलए एक ऄच्छा पयाावास स्ट्थल ह।ै ऄभयारण्य जवजभन्न प्रकार के जीवों जैसे सांभर (सवास यूजनकलर), भारतीय गौर (बोस गौरस), चौसींगा मृग (टेरासेरस क्वाजिकोर्वनस), काकड़ जहरण (मुंरटयाकस मुंटजैक), बनैला सूऄर (सस स्ट्क्रोफा), भारतीय क्रेस्ट्टेड साही (जहजस्ट्टक्सआंजडका), भारतीय खरगोि (लेपस नाआग्रीकोजलस), भारतीय जचत्तीदार िेवरोटेन (रैगुलस मेजमन्ना), ग्र े लंगरू (प्रेजस्ट्बरटस एंटेलस), रेड स्ट्लडें र लोररस (लोररस टार्वडग्राडस), चीतल (एजक्सस एजक्सस), तेंदअु (पथें ेरा पाडास), ढोल या भारतीय जंगली कुत्ता (कुओन ऄल्पाआनस), तेंदअु जबल्ली (फेजलस बेंगालेंजसस) रीछ (मेलसास ईर्वसनस), स्ट् वण ा जसयार (कैजनस ऑररयस), पायथन (पायथन मोलरु स), ककग कोबरा (ओदफयोफैगस हन्ना), रसेल वाआपर (दबोआया रसेली), कॉमन करैत (बगं ारस कैयलूा स), रैट स्नेक (पटायस म्यूकोसा), वाआन स्नेक (ऄहतै ुल्लानासुता), कॉमन आंजडयन मॉजनटर (वरनस बेंगालेंजसस), आंजडयन फ्लाआंग जलजडा (िेको डुसुजमएरी), मालाबार गैंट जगलहरी (रतुफा आंजडका) अदद का पयाावास ह।ै भीमगढ़ क्षत्रे को बाघों के जलए सबसे अदिा पयाावासों म ें स े एक माना जाता ह।ै ऐसा माना जाता ह ै दक छह स े अि बाघ ऄभयारण्य म ें रहते ह ैं और कनााटक और गोवा राज्य के असपास के जंगलों म ें भी घूम रह ेह।ैं और, भीमगढ़ वन्द् यजीव ऄभयारण् य म ें पजक्षयों की बहुलता ह ै जजसम ें जविाल भारतीय धनिे सजम्मजलत ह ै और ऄंगारक, खंजन, किफोड़वा, कौजडल्ला, चील, बगुला, िकरखोरा, ईल्लू और पंडुक की जवजवधता ह ै । ग्र े जगं ली मुरगा, जंगल मयना, महोख, परलोक मक्खीमार, मालाबार ऄगं ारक अदद भी आस क्षत्रे म ेंसामान्द्यतः ददखाइ देत े ह।ैं और, भीमगढ़ वन्द् यजीव ऄभयारण् य के चारों ओर के क्षत्रे को, जजसका जवस्ट्तार और सीमाए ं आस ऄजधसूचना के परै ा 1 म ें जवजनर्ददष्ट ह,ैं पयाावरण की दजृ ष्ट स े पाररजस्ट्थजतक संवदे ी जोन के रूप म ें सरु जक्षत और संरजक्षत करना तथा ईि पाररजस्ट्थजतक संवेदी जोन म ें ईद्योगों या ईद्योगों के वगो के प्रचालन तथा प्रसंस्ट्करण करने को प्रजतजिद्ध करना अवश्यक ह;ै और, ऄब पाररजस्ट्थजतक, पयाावरणीय, जीव-जंतु, पुष्प, भौगोजलक या प्राणीिास्त्रीय संबंध या महत्व के कारण, ईनम ें या ईनके पररवेि म ें वन्द्य जीवन के प्रसार या जवकास की रक्षा के ईद्देश्य स,े भारत सरकार, पयाावरण (संरक्षण) ऄजधजनयम 1986 (1986 का 29) की धारा (3) की ईपधारा (2) के खंड (v) और खंड (xiv) के साथ परित ईपधारा (1) के तहत प्रदत्त िजियों का प्रयोग करत े हुए आसके द्वारा क्षत्रे , जजसकी जस्ट्थजत और सीमाए ं आस ऄजधसचू ना की ऄनुसूची म ें जनर्ददष्ट ह ैं को भीमगढ़ वन्द्यजीव ऄभयारण्य के "पाररजस्ट्थजतकी संवेदी जोन" के रूप म ेंघोजित करती ह।ै 1. पाररजस्ट्थजतकी सवं दे ी जोन का जवस्ट्तार और सीमा.- (1) भीमगढ़ वन्द्यजीव ऄभयारण्य कनााटक राज्य के बेलगावी जजल े के खानापुर तालुक म ें जस्ट्थत ह ै और आसम ें 13 ग्राम I स े XIII; िाजमल हIैं ईि पाररजस्ट्थजतकी संवेदी जोन का सीमा जववरण ऄनलु ग्नक-क म ें ददया गया ह ै और आसकी4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सीमा पर प्रमुख स्ट्थानों के साथ पाररजस्ट्थजतकी संवेदी जोन का मानजचत्र ऄनलु ग्नक-ख म ें ह।ै पाररजस्ट्थजतकी संवेदी जोन 117.75 वगा दकलोमीटर के क्षत्रे म ें फैला हुअ ह,ै जजसकी सीमा 0 दकलोमीटर (ऄंतर राज्य सीमा और काली टाआगर ररजवा) स ेलेकर भीमगढ़ वन्द्यजीव ऄभयारण्य की सीमा के चारो ओर 3.23 दकलोमीटर तक ह।ै (2) प्रमुख स्ट्थानों के जी.पी.एस. जनदेिांक ऄनलु ग्नक-ग के रूप में सलं ग्न ह।ैं (3) पाररजस्ट्थजतकी संवेदी जोन के ऄंतगता अन े वाल े ग्रामों का जववरण ऄनलु ग्नक-घ म ें िाजमल ह।ै आसके ऄलावा, पाररजस्ट्थजतकी संवेदी जोन के भीतर अरजक्षत वन क्षत्रे का जववरण ऄनलु ग्नक-ङ म ें ददया गया ह ै और पाररजस्ट्थजतकी संवेदी जोन सीमा के भीतर राजस्ट्व क्षत्रे का जववरण ऄनुलग्नक-च म ें ददया गया ह ै और पाररजस्ट्थजतकी संवेदी जोन की सीमा म ें अन े वाले अरजक्षत वन ऄनुलग्नक-छ म ेंददए गए ह।ैं (4) वन ब्लॉक क्षेत्रों म ें सभी गजतजवजधयाँ भारतीय वन ऄजधजनयम, 1927, वन (संरक्षण) ऄजधजनयम, 1980 (1980 का 69) के प्रावधानों द्वारा िाजसत होंगी और संरजक्षत क्षत्रे (ऄभयारण्य) म ें गजतजवजधयाँ वन्द्यजीव (संरक्षण) ऄजधजनयम, 1972 (1972 का 53) के प्रावधानों द्वारा िाजसत होंगी, जजसम ें लागू प्रासंजगक राज्य ऄजधजनयम/जनयम/ददिाजनदेि भी सजम्मजलत ह।ैं (5) पाररजस्ट्थजतकी संवेदी जोन की सीमा 0.00 दकलोमीटर स े3.23 दकलोमीटर तक होती ह।ै (6) संक्षेप म ें 11244.79 हक्े टेयर अरजक्षत वन और 530.59 हक्े टेयर राजस्ट्व की सीमा पाररजस्ट्थजतकी संवेदी जोन के ऄंतगात अता ह।ै 2. अचं जलक महायोजना.–(1) राज्य सरकार, द्वारा पाररजस्ट्थजतकी संवेदी जोन के प्रयोजन के जलए, राजपत्र म ें ऄंजतम ऄजधसूचना के प्रकािन की तारीख से दो विा की ऄवजध के भीतर, स्ट्थानीय व्यजियों के परामिा से और आस ऄजधसूचना म ें ददए गए ऄनुबंधों का पालन करते हुए, राज्य सरकार के सक्षम प्राजधकारी के ऄनुमोदनाथा एक अंचजलक महायोजना बनाइ जायेगी। (2) अंचजलक महायोजना म ें पाररजस्ट्थजतक और पयाावरणीय जवचारों को एकीकृत करन े के जलए पाररजस्ट्थजतकी और पयाावरण संबंधी पहलुओं को िाजमल करन े के जलए आसे राज्य सरकार के पयाावरण, वन, िहरी जवकास, पयाटन, नगर जनगम, राजस्ट्व और कनााटक राज्य प्रदिू ण जनयंत्रण बोड ा के सभी संबंजधत जवभागों के परामिा से बनाया जाएगा, ऄथाता ्:- (i) पयाावरण; (ii) वन एव ं वन्द्यजीव; (iii) कृजि (iv) राजस्ट्व (v) िहरी जवकास; (vi) पयाटन; (vii) ग्रामीण जवकास; (viii) ससचाइ एव ं बाढ़ जनयंत्रण; (ix) नगरपाजलका; (x) पंचायती राज; (xi) लोक जनमााण जवभाग, कनााटक सड़क जवकास जनगम जलजमटेड, भारतीय राष्ट्रीय राजमाग ा प्राजधकरण; (xii) हुबली आलेजक्रजसटी सप्लाइ कंपनी जलजमटेड; (xiii) पुजलस जवभाग (गृह); (xiv) कनााटक राज्य प्रदिू ण जनयंत्रण बोडा। (3) अंचजलक महायोजना म ें वनरजहत और ऄवक्रजमत क्षेत्रों के सुधार, जवद्यमान जल जनकायों के सरं क्षण, जलग्रहण क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भू-जल के प्रबंधन, मृदा और नमी के संरक्षण, स्ट्थानीय जनता की अवश्यकताओं तथा पाररजस्ट्थजतकी एव ं पयाावरण के ऐसे ऄन्द्य पहलओंु की व्यवस्ट्था की जाएगी जजन पर ध्यान ददया जाना अवश्यक ह।ै[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5 (4) अंचजलक महायोजना यह भी सुजनजित करेगी दक मौजदू ा कानूनी भूजम ईपयोग स्ट्वरूप, साथ ही कानूनी बुजनयादी ऄवसंरचना और दक्रयाकलापों पर कोइ प्रजतबंध नहीं लगाया जाएगा और यह पहले की तरह जारी रहगे ा। हालाँदक, अंचजलक महायोजना सभी बुजनयादी ढाँच/े दक्रयाकलापों को ऄजधक दक्ष और पाररजस्ट्थजतकी-ऄनुकूल बनाने म ें भी सुधार करेगी। (5) अंचजलक महायोजना म ें सभी जवद्यमान पूजा स्ट्थ लों, ग्रामों की बजस्ट्तयों, वनों की श्रेजणयों एव ं दकस्ट् मों, कृजि क्षेत्रों, उपजाउ भूजम, ईद्यानों एव ं ईद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और ऄन्द्य जल जनकायों की सीमा का जनधाारण दकया जाएगा। (6) अंचजलक महायोजना म ें हररत ईपयोग जैसे दक चाय बागानों, बागवानी क्षेत्रों, कृजि ईद्यानों और ऄन्द्य क्षत्रे जैसे गरै - हररत ईपयोगों के जलए भूजम ईपयोग म ें बदलाव की ऄनुमजत नहीं दी जाएगी। हालाँदक, मौजूदा स्ट्थानीय अबादी की प्राकृजतक वृजद्ध के कारण स्ट्थानीय जनवाजसयों की अवासीय जरूरतों को पूरा करन े के जलए, राज्य सरकार की पूव ा मंजरू ी के साथ, कृजि भूजम के सख्ती स े सीजमत रूपांतरण की ऄनुमजत दी जा सकती ह।ै (7) वन क्षत्रे , हररत क्षत्रे और कृजि क्षत्रे म ेंसामान्द्यतः कोइ कमी नहीं होगी। (8) पाररजस्ट्थजतकी संवेदी जोन के जलए अंचजलक महायोजना की तैयारी और पयाावरण और वन मंत्रालय द्वारा ईसके ऄनुमोदन तक सभी नए जनमााण और ऄन्द्य जवकासात्मक गजतजवजधयों को जनगरानी सजमजत द्वारा ऄजधसूचना के परै ाग्राफ 4 के ईप-पैरा (4) के ऄनुसार पयावा रण और वन मंत्रालय को भेजा जाएगा। (9) जनगरानी सजमजत सभी जवभागों और जहतधारकों द्वारा अंचजलक महायोजना के ईजचत कायाान्द्वयन की भी जनगरानी करती ह।ै यह सजमजत लोगों की जिकायतों पर भी गौर करेगी और ऐसी जिकायतों का सौहादपा ूणा समाधान जनकालगे ी। (10) अंचजलक महायोजना के प्रावधानों का पयााि प्रचार-प्रसार दकया जाएगा 3. राज्य सरकार द्वारा दकए जान े वाल े ईपाय.- राज्य सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत ईपाय करेगी, ऄथाात्:- (1) भू-ईपयोग.– (क) पाररजस्ट्थजतकी संवेदी जोन म ें वनों, बागवानी क्षेत्रों, कृजि क्षेत्रों, मनोरंजन के जलए जचजन्द्हत ईद्यानों और खुल े स्ट्थानों का वृहद वाजणजज्यक या अवासीय पररसरों या औद्योजगक दक्रयाकलापों के जलए प्रयोग या संपररवतान ऄनुमत नहीं दकया जाएगा: परंत ु पाररजस्ट्थजतकी संवेदी जोन के भीतर उपर भाग (क), म ें जवजनर्ददष्ट प्रयोजन से जभन्न प्रयोजन के जलए कृजि और ऄन्द्य भूजम का संपररवतान, जनगरानी सजमजत की जसफाररि पर और सक्षम प्राजधकारी के पूवा ऄनमु ोदन स े क्षेत्रीय नगर योजना ऄजधजनयम तथा यथा लाग ू केन्द्रीय सरकार एव ं राज्य सरकार के ऄन्द्य जनयमों एव ं जवजनयमों के ऄधीन तथा आस ऄजधसूचना के ईपबधं ों के ऄनुसार स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय जरूरतों को पूरा करन ेके जलए ऄनमु त दकया जाएगा जैस:े- (i) जवद्यमान सड़कों को चौड़ा करना, ईन्द्ह ेंसुदढ़ृ करना और नइ सड़कों का जनमााण करना; (ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रदिू ण ईत्पन्न न करन े वाले लघु ईद्योग; (iv) कुटीर ईद्योग एव ं ग्राम ईद्योग; पाररजस्ट्थजतकी पयाटन म ें सहायक सुजवधा भण्डार और स्ट्थानीय सुजवधाएं; और (v) पैराग्राफ-4 में ईजल्लजखत बढ़ावा ददए गए दक्रयाकलापः परंतु यह भी दक क्षेत्रीय िहरी जनयोजन ऄजधजनयम के ऄधीन सक्षम प्राजधकारी के पूवा ऄनमु ोदन के जबना तथा राज्य सरकार के ऄन्द्य जनयमों एव ं जवजनयमों एव ं संजवधान के ऄनुच्छेद 244 के ईपबंधों तथा तत्समय प्रवृत्त जवजध, जजसके ऄंतगता ऄनुसूजचत जनजाजत और ऄन्द्य परंपरागत वन जनवासी (वन ऄजधकारों की मान्द्यता) ऄजधजनयम, 2006 (2007 का 2) भी अता ह,ै का ऄनुपालन दकए जबना वाजणजज्यक या औद्योजगक जवकास दक्रयाकलापों के जलए जनजातीय भूजम का प्रयोग ऄनुमत नहीं होगा: परंत ु यह भी दक पाररजस्ट् थजतकी संवेदी जोन के ऄतं गता अने वाली भूजम के ऄजभलेखों म ें हुइ दकसी त्रुरट को, जनगरानी सजमजत के जवचार प्राि करन े के पिात,् राज्य सरकार द्वारा प्रत्यके मामल े म ें एक बार सुधारा जाएगा और ईि त्रुरट को सुधारन े की सूचना केंरीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय को दी जाएगी:6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (क) परंत ु यह भी दक ईपयुाि त्रुरट को सुधारन े म,ें आस ईप-पैरा में यथा ईपबंजधत के जसवाय, दकसी भी दिा म ें भू-ईपयोग का पररवतान िाजमल नहीं होगा। (ख) ऄनप्रु यिु या ऄनुत्प ादक कृजि क्षेत्रों म ें वनीकरण तथा पयावा ासों की बहाली के कायाकलापों से पुन: वनीकरण के प्रयास दकए जाएंगे। (2) प्राकृजतक जल जनकाय.- सभी प्राकृजतक जलमागों के जलग्रहण क्षेत्रों की पहचान की जाएगी और अंचजलक महायोजना में ईनके संरक्षण और बहाली की योजना सजम् मजलत की जाएगी और राज्य सरकार द्वारा ददिा-जनदेि आस रीजत स े तैयार दकए जाएंगे दक ईसमें ऐस े क्षेत्रों में या ईसके पास जवकास दक्रयाकलापों को प्रजतजिद्ध और जनबंजधत दकया जा सके जो ऐस े क्षेत्रों के जलए हाजनकारक हों। (3) पयटा न एव ं पाररजस्ट्थजतकी पयटा न.– (क) पाररजस्ट्थजतकी संवेदी जोन में सभी नए पाररजस्ट्थजतकी पयाटन दक्रयाकलाप या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेदी जोन संबंधी पयाटन महायोजना के ऄनुसार ऄनुमत होगा। (ख) पयाटन महायोजना राज्य के पयाावरण और वन जवभाग के परामि ा स े राज्य के पयाटन जवभाग द्वारा बनायी जाएगी। (ग) पयाटन महायोजना अंचजलक महायोजना का घटक होगी। (घ) पयाटन महायोजना पाररजस्ट्थजतकी संवेदी जोन की वहन क्षमता के ऄध्ययन के अधार पर तैयार की जायेगी। (ङ) पाररजस्ट्थजतकी पयाटन संबधं ी दक्रयाकलाप जनम्न ानुसार जवजनयजमत दकए जाएंग,े ऄथाात:्- (i) पाररजस्ट्थजतकी संवेदी जोन के भीतर दकसी भी नए वाजणजज्यक होटल और ररसॉट ा या मौजूदा वाजणजज्यक होटल और ररसॉटा के जवस्ट्तार की ऄनुमजत नहीं दी जाएगी; (ii) पाररजस्ट्थजतकी संवेदी जोन के ऄन्द्दर सभी नए पयाटन दक्रयाकलापों या जवद्यमान पयटा न दक्रयाकलापों का जवस्ट्तार, केन्द्रीय सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय द्वारा जारी ददिाजनदेिों तथा पाररजस्ट्थजतकी पयाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल देने वाल े राष्ट्रीय व्याघ्र संरक्षण प्राजधकरण द्वारा जारी पाररजस्ट्थजतकी पयाटन संबंधी ददिाजनदेिों (समय-समय पर यथा सिं ोजधत) के ऄनुसार होगा; (iii) अंचजलक महायोजना का ऄनुमोदन होन े तक, पयाटन के जवकास और जवद्यमान पयटा न दक्रयाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा जनगरानी सजमजत की जसफाररि के अधार पर संबंजधत जवजनयामक प्राजधकरणों द्वारा ऄनुमत दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन म ें दकसी भी नए वाजणजज्यक होटल और ररसॉटा या मौजूदा वाजणजज्यक होटल और ररसॉटा के जवस्ट्तार की ऄनुमजत नहीं दी जाएगी। (4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेदी जोन के ऄंतगता अने वाल े बहुमूल्य प्राकृजतक जवरासत के सभी स्ट्थलों जैसे दक जीन पूल ररजवा क्षत्रे , िैल संरचना, जल प्रपात, झरन,े दरे, ईपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा ईत्प्रपात अदद की पहचान की जाएगी और ईनकी सुरक्षा एव ं संरक्षण के जलए अंचजलक महायोजना के भाग के रूप म ें एक जवरासत संरक्षण योजना बनायी जाएगी। (5) मानव जनर्वमत जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेदी जोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्य संबधी, सौंदयाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की जाएगी और ईनके संरक्षण के जलए अंचजलक महायोजना के भाग के रूप में एक जवरासत संरक्षण योजना बनायी जाएगी। (6) ध्व जन प्रदिू ण.- पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदिू ण (जवजनयमन और जनयत्रं ण) जनयम, 2000 म ें जनयत ईपबंधों के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन में ध्वजन प्रदिू ण की रोकथाम और जनयंत्रण दकया जाएगा । (7) वाय ु प्रदिू ण.- पाररजस्ट्थजतकी संवेदी जोन म,ें वाय ु प्रदिू ण का जनवारण और जनयंत्रण, वाय ु (प्रदिू ण जनवारण और जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) और ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार दकया जाएगा । (8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेदी जोन में िोजधत बजहस्राव का जनस्ट्सरण, पयाावरण ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों के ऄधीन अन े वाल े पयाावरणीय प्रदिू ण के जनस्ट्सरण के जलए साधारण मानकों या राज्य सरकार द्वारा जनयत मानकों, जो भी ऄजधक किोर हो, के ईपबंधों के ऄनुसार होगा। (9) िोस ऄपजिष्ट.- िोस ऄपजिष्ट का जनपटान एवं प्रबन्द्धन जनम्नानुसार दकया जाएगा:-[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 7 (क) पाररजस्ट्थजतकी संवेदी जोन म ें िोस ऄपजिष्ट का जनपटान और प्रबधं न भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथा संिोजधत ऄजधसूचना सं. का.अ. 1357(ऄ), ददनांक 8 ऄप्रैल, 2016 के तहत प्रकाजित िोस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा; ऄकाबाजनक पदाथो का जनपटान पाररजस्ट्थजतकी संवेदी जोन से बाहर जचजन्द्हत दकए गए स्ट्थानों पर पयाावरण- ऄनुकूल रीजत से दकया जाएगा; (ख) पाररजस्ट्थजतकी संवेदी जोन म ें मान्द्य प्रौद्योजगदकयों का प्रयोग करत े हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप िोस ऄपजिष्ट का सुरजक्षत और पयाावरण ऄनुकूल प्रबधं न (इएसएम) ऄनुमत दकया जायेगा। (10) जैव जचदकत्सा ऄपजिष्ट.- जैव जचदकत्सा ऄपजिष्ट का प्रबंधन जनम्नानुसार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन म ें जैव जचदकत्सा ऄपजिष्ट का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की ऄजधसूचना सं.सा.का.जन. 343 (ऄ), तारीख 28 माचा, 2016 के तहत प्रकाजित जैव जचदकत्सा ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। (ख) पाररजस्ट्थजतकी सवं ेदी जोन म ें मान्द्य प्रौद्योजगदकयों का प्रयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप जैव जचदकत्सा ऄपजिष्ट का सुरजक्षत और पयाावरण ऄनकु ूल प्रबंधन ऄनुमत दकया जायेगा। (11) प्लाजस्ट्टक ऄपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन में प्लाजस्ट्टक ऄपजिष्ट का प्रबंधन, भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथा संिोजधत ऄजधसूचना सं.सा.का.जन 340(ऄ), तारीख 18 माचा, 2016 के तहत प्रकाजित प्लाजस्ट्टक ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबधं ो के ऄनुसार दकया जाएगा। (12) जनमाणा और जवध्वसं ऄपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन में जनमााण और जवध्वंस ऄपजिष्ट का प्रबंधन, भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथा संिोजधत ऄजधसूचना सं.सा.का.जन 317(ऄ), तारीख 29 माचा, 2016 के तहत प्रकाजित संजनमााण और जवध्वंस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। (13) इ–ऄपजिष्ट.- पाररजस्ट्थजतकी संवेदी जोन में इ–ऄपजिष्ट का प्रबंधन, भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय द्वारा प्रकाजित तथा समय-समय पर यथा संिोजधत इ–ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। (14) वाहन-यातायात.- वाहन-यातायात को पयाावास-ऄनुकूल तरीके स े जवजनयजमत दकया जाएगा और आस संबंध म ें अंचजलक महायोजना म ें जविेि ईपबंध िाजमल दकए जाएंग।े अंचजलक महायोजना के तैयार होने तक, जनगरानी सजमजत प्रासंजगक ऄजधजनयमों और ईनके तहत बनाए गए जनयमों एवं जवजनयमों के ऄनुसार वाहन-यातायात के ऄनुपालन की जनगरानी करेगी। (15) वाहन जजनत प्रदिू ण.- वाहन जजनत प्रदिू ण की रोकथाम और जनयंत्रण लागू जवजधयों के ऄनुसार दकया जाएगा और स्ट्वच्छतर ईंधन के ईपयोग के जलए प्रयास दकए जाएगं े । (16) औद्योजगक इकाआया.ं- (क) राजपत्र म ें आस ऄजधसूचना के प्रकािन पर या ईसके पिात पाररजस्ट्थजतकी संवेदी जोन के भीतर कोइ नए प्रदिू णकारी ईद्योगों की स्ट्थापना की ऄनुज्ञा नहीं दी जाएगी। (ख) केन्द्रीय प्रदिू ण जनयंत्रण बोड ा द्वारा फरवरी, 2016 द्वारा जारी मागादिाक जसद्धान्द्तों म ें ईद्योगों के वगीकरण के ऄनुसार, जब तक दक ऄजधसूचना में आस प्रकार जवजनर्ददष्ट न हो, पाररजस्ट्थजतकी संवेदी जोन के भीतर केवल गैर-प्रदिू णकारी ईद्योगों को ऄनुज्ञात दकया जाएगा और आसके ऄजतररि, गैर प्रदिू णकारी ईद्योगों को बढ़ावा ददया जाएगा। (17) पहाड़ी ढलानों का सरं क्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार दकया जाएगा:- (क) अंचजलक महायोजना म ें पहाड़ी ढलानों के ईन क्षेत्रों को दिााया जाएगा जजनम ें दकसी भी संजनमााण की ऄनज्ञु ा नहीं होगी; (ख) जजन ढलानों या जवद्यमान खड़ी पहाड़ी ढलानों म ें ऄत्यजधक भ-ू क्षरण होता ह ै ईनम ें दकसी भी संजनमााण की ऄनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी सवं दे ी जोन म ेंजनजिद्ध, जवजनयजमत और ऄनमु त दकए जान े वाल ेदक्रयाकलाप.- भीमगढ़ वन्द्यजीव पाररजस्ट्थजतकी संवेदी जोन म ें सभी दक्रयाकलाप पयाावरणीय प्रभाव अकलन ऄजधसूचना, 2006 के प्रावधानों और वन्द्यजीव (संरक्षण) ऄजधजनयम, 1972 (1972 का 53), वन (संरक्षण) ऄजधजनयम, 1980 (1980 का 69), भारतीय वन ऄजधजनयम, 1927 (1927 का 16), और पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) तथा ईनम ें दकए गए संिोधनों के ऄनुसार िाजसत होंग े और नीच े दी गइ सारणी म ें जवजनर्ददष्ट रीजत स े जवजनयजमत होंग,े ऄथाात:्-8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सारणी क्रम स.ं दक्रयाकलाप रटप्पणी (1) (2) (3) क. प्रजतजिद्ध दक्रयाकलाप 1. व ाजणजज्यक खनन, वाजणजज्यक (क) स्ट्थानीय जनवाजसयों की घरेलू अवश्यकताओं जजसमें मकानों के ईत्खनन, पत्थर ईत्खनन, रेत खनन संजनमाणा या मरम्मत के जलए धरती को खोदना सजम्मजलत है, के जसवाय और ऄपघिाण आकाआयां । सभी प्रकार के नए और वाजणजज्यक खनन, वाजणजज्यक ईत्खनन, पत्थर ईत्खनन, रेत खनन और ऄपघिाण आकाआयां प्रजतजिद्ध होंगी; खनन प्रचालन, 1995 की ररट याजचका (जसजवल) सं. 202 में टी.एन. गौडाबमान जथरुमूलपाद बनाम भारत संघ के मामल ेमें माननीय ईच्चतम न्द्यायालय के ददनांक 4 ऄगस्ट्त ,2006 के अदिे और 2012 की ररट याजचका (जसजवल) स.ं 435 में गोवा फाईंडेिन बनाम भारत संघ के मामले में ददनांक 21 ऄप्रैल ,2014 के अदिे के ऄनुसरण में होगा । 2. प्र दिू ण (जल, वायु, मृदा, ध्वजन, अदद) पाररजस्ट्थजतकी संवेदी जोन में कोइ नया ईद्योग लगाने और वतामान ईत्पन्न करने वाले ईद्योगों की स्ट्थापना प्रदिू णकारी ईद्योगों का जवस्ट्तार करने की ऄनमु जत नहीं होगीः । परन्द्तु यह दक केन्द्रीय प्रदिू ण जनयंत्रण बोडा द्वारा फरवरी, 2016 में जारी समय-समय पर यथा संिोजधत मागादिाक जसद्धान्द्तों में ईद्योगों के वगीकरण के ऄनुसार, जब तक दक ऄजधसूचना में ऐसा जवजनर्ददष्ट न हों, पाररजस्ट्थजतकी संवेदी जोन के भीतर गैर-प्रदिू णकारी ईद्योगों को ऄनुज्ञात दकया जाएगा और आसके ऄजतररि गैर-प्रदिू णकारी कुटीर ईद्यागों को बढ़ावा ददया जाएगा। 3. न इ अरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी जैसी पयाटन से संबंजधत गजतजवजधयाँ करना। 15. स ंकेत बोडा और होर्डडग प्रजतजिद्ध। तथाजप, पाररजस्ट्थजतकी संवेदी जोन के ग्राम की सीमा के भीतर ऄनुमजत ह।ै वन जवभाग और ईपयोगकताा एजेंजसयों जैसे लोक जनमााण जवभाग, कनााटक सड़क जवकास जनगम जलजमटेड, केएसएचअइपी, एनएचएअइ अदद को ऄभयारण्य और पाररजस्ट्थजतकी संवेदी जोन से गुजरने वाली सावाजजनक सड़कों पर गजत सीमा का पालन करने के जलए साआन बोडा जैसे वन्द्यजीवों के बारे में और वन्द्यजीवों के जहत में जागरूकता पैदा करने के जलए ऄनुमजत दी गइ ह।ै 16. दक सी पररसंकटमय पदाथा का प्रयोग प्रजतजिद्ध। या ईत्पादन या प्रस्ट्संकरण । 17. फ मों, कारपोरेट और कंपजनयों द्वारा ऄपजिष्ट प्रसंस्ट्करण सुजवधा की ऄनुमजत सामान्द्य भस्ट्मीकरण सुजवधा की नहीं दी जाएगी और औद्योजगक प्रदक्रया और स्ट्वास्ट्थ्य प्रजतष्ठानों, ऄस्ट्पतालों स्ट्थापना। अदद से ईत्पन्न दकसी भी प्रकार के िोस या जवद्यमान दक्रयाकलापों का जवस्ट्तार करने की ऄनुज्ञा होगी । 25. जन मााण दक्रयाकलाप* पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक जो भी जनकट हो, दकसी भी प्रकार का नया वाजणजज्यक जनमाणा ऄनुमत नहीं दकया जाएगा: तथाजप, स्ट्थानीय लोगों को स्ट्थानीय जनवाजसयों की अवासीय अवश्यकताओं को पूरा करने के जलए ईनके वास्ट्तजवक ईपयोग के जलए ऄपनी भूजम में जनमााण करने की ऄनुमजत दी जा सकती ह।ै (i) फरवरी 2016 के केंरीय प्रदिू ण जनयंत्रण बोडा द्वारा दकए गए वगीकरण के ऄनुसार प्रदिू ण नहीं फैलाने वाले लघु ईद्योग; तथाजप, प्रदिू ण न फैलाने वाले ऐसे ईद्योगों को जवजनयजमत दकया जाएगा और लागू जनयमों और जवजनयमों के ऄनुसार सक्षम प्राजधकारी की पूवा ऄनुमजत से न्द्यूनतम रखा गया ह,ै यदद कोइ हो और ऐसे ईद्योगों का जनमााण प्रकृजत में स्ट्थायी नहीं होगा। (ii) ग्रामोद्योग सजहत कुटीर ईद्योग; पाररजस्ट्थजतकी-पयाटन और ऐसे ईद्योगों के जनमााण का समथान करने वाले सुजवधा स्ट्टोर और स्ट्थानीय सुजवधाएं प्रकृजत में स्ट्थायी नहीं होंगी। 26. व ृक्षों की कटाइ । (क) राज्य सरकार के सक्षम प्राजधकारी की पूवा ऄनुमजत के जबना वन भूजम या सरकारी या राजस्ट्व या जनजी भूजम पर वृक्षों की कटाइ नहीं होगी ; (ख) वृक्षों की कटाइ केंरीय या संबंजधत राज्य के ऄजधजनयम या ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार जवजनयजमत होगी । 27. भ ूजल संचयन सजहत जल संसाधनों का (क) सतही जल और भूजल के जनष्किाण की ऄनुमजत केवल स्ट्थानीय लोगों व्यावसाजयक ईपयोग। को ईनके वास्ट्तजवक कृजि ईपयोग और भूजम के कब्ज े वाले के घरेलू ईपभोग के जलए दी जाएगी; (ख) औद्योजगक या वाजणजज्यक ईपयोग के जलए सतही जल और भूजल जनकासी की ऄनुमजत नहीं दी जाएगी। (ग) सतही जल या भूजल की जबक्री की ऄनुमजत नहीं दी जाएगी; (घ) कृजि सजहत दकसी भी स्रोत से पानी के प्रदिू ण या प्रदिू ण को रोकने के जलए कदम ईिाए जाएंगे। 28. जव द्युत केबलों, रांसजमिन लाआनों का लागू जवजधयों के ऄधीन जवजनयजमत होगा । जनमााण। बिते दक भजवष्य में 11 केवी तक घरेलू ईद्देश्यों के जलए जवद्युत केबल/रांसजमिन लाआनें जबछाइ जाएं, केबसलग ऄजनवाया रूप से भूजमगत की जानी चाजहए और ईपयोगकताा एजेंजसयों द्वारा आंजडकेिन टाआल्स/केबल सुरक्षा कवर ऄजनवाया रूप से लगाए जाने चाजहए। जंगली जानवरों को करंट लगने से बचाने के जलए मौजूदा जवद्युत लाआनों के दो टावरों के बीच का "झुकाव" सबद ुजमीन से सुरजक्षत दरू ी पर होना चाजहए। 29. स ंचार टावर और ऑजप्टकल फाआबर लागू जवजधयों के ऄधीन जवजनयजमत होगा । केबल लाआनें। 30. जव द्युत बाड़ लगाना, वाजणजज्यक लागू जवजधयों के ऄधीन जवजनयजमत होगा । होटलों/ररसॉर्टसा/जनजी होमस्ट्टे, जनजी फामों और फमों, कॉपोरेट घरानों, कंपजनयों द्वारा बड़े पैमान े पर वाजणजज्यक कृजि और बागवानी ईद्यमों के जलए पररसर।[भाग II—खण् ड दक्रयाकलाप 36. स्ट् थानीय समुदायों द्वारा चल रही कृजि स्ट्थानीय लोगों के ईपयोग के जलए लाग ू जवजधयों के ऄधीन ऄनमु त ह।ै और बागवानी प्रथाओं के साथ तथाजप, आनमें से कुछ गजतजवजधयों के ऄत्यजधक जवस्ट्तार को छोड़कर, पाररजस्ट्थजतक संवेदी जोन म ें अत े ह ैं और यथाजस्ट्थजत, जलवाय ु पररवतान या राज्य पयाावरण समाघात जनधाारण प्राजधकरण, ईि ऄजधसूचना के ईपबंधों के ऄधीन पूवा पयाावरणीय मंजूरी के जलए होंगे। (2) भारत सरकार के तत्कालीन पयाावरण एव ं वन मंत्रालय की ऄजधसूचना क्रमांक का.अ. 1533 (ऄ), तारीख 14 जसतंबर, 2006 और पाररजस्ट्थजतकी संवेदी जोन म ें अन े वाल,े ईसके पैरा 4 के ऄधीन सारणी म ें जनर्ददष्ट जनजिद्ध दक्रयाकलापों को छोड़कर, जनगरानी सजमजत द्वारा वास्ट्तजवक साआट-जवजिष्ट की जस्ट्थजतयों के अधार पर जांच की जाएगी और संबंजधत जवजनयामक प्राजधकरणों को जनर्ददष्ट की जाएगी। (3) जनगरानी सजमजत के सदस्ट्य-सजचव या संबंजधत कलेक्टर या संबंजधत ईप वन संरक्षक पयाावरण (संरक्षण) ऄजधजनयम, 1986 की धारा 19 के ऄधीन आस ऄजधसूचना के ईपबंधों का ईल्लंघन करने वाले दकसी भी व्यजि के जवरुद्ध जिकायत दज ा करन े के जलए सक्षम होंगे। (4) जनगरानी सजमजत संबंजधत जवभागों के प्रजतजनजधयों या जविेिज्ञों, ईद्योग संघों के प्रजतजनजधयों या संबंजधत जहतधारकों को ऄपने जवचार-जवमिा म ें सहायता के जलए जारी करने के अधार पर ऄपेक्षा के अधार पर It shares boundary with Dandeli Wildlife Sanctuary in Uttar Kannada district of Karnataka and Mahadayi Wildlife Sanctuary in Goa.The total area of the Sanctuary is 19042.58 Ha. The Sanctuary has been carved out of reserve forest areas with high floral and faunal diversity. AND WHEREAS, Western Ghats due to their unique location play a vital role for conservation of biodiversity in the peninsula. The ecological abundance supported by them, their rich biodiversity and sensitive geomorphology add further uniqueness. Bhimgad region has extensive biodiversity and provides corridor for tiger and other wild animals with adjacent protected areas. Barapede cave of Bhimgad is the only known roosting site for Wroughton‟s Free Tailed bats in India.Bhimgad region is also one of rare habitats in the country for Theobalds‟s tomb bat at Krishnapur caves. AND WHEREAS, the following features provide uniqueness to Bhimgad Wildlife Sanctuary: The area is in the core zone of Western Ghats comprising of semi evergreen & evergreen dense forests with steep slopes. The region is having rich floral and faunal diversity. This region is having lot of wildlife significance. It is habitat for Critically endangered and endemic Species Like Wroughton‟sfree tailed bats (Otomopswroughtoni) and Theobald‟s tomb bats (Taphozous theobaldi). Barapede caves are known to be the only roosting and breeding place for Wroughton‟s free tailed bats in India. The forests with beautiful mosaic of woodlands and grass lands are the habitat for Tiger, Leopard, Indian Gaur, Sloth Bear, Sambar, Barking deer, Chital, Wild dog, King Cobra and a variety of other mammals and reptiles. This region with richest reservoirs of biodiversity is located in the east of Mahadayi Wildlife Sanctuary in Goa and in the north of Dandeli Wildlife Sanctuary in Karnataka. This entire stretch acts as natural corridor for tigers and other wildlife between Dandeli Wildlife Sanctuary, Kali Tiger Reserve, Bhagwan Mahaveer & Mahadayi Wildlife Sanctuaries. This area is the place of origin and Catchment basin for many important rivers like Mahadayi, Bailnadi etc. apart from number of streams. The area encompasses several geo-morphological lime stone formations with lots of caves, which support wide variety of fauna and flora endemic to this location. Apart from above, the Sanctuary covers historical Bhimgad fort ruins, which needs to be protected. AND WHEREAS, the forests of Bhimgad Wildlife Sanctuary are mainly Evergreen and Semi-evergreen type occurring in almost equal proportions. Hemmadaga Section has more of semi-evergreen vegetation and rest of the area has evergreen type of vegetation. Peripheral region around the sanctuary has moist deciduous forests. Vast stretches of grass lands occur in mosaic with thick vegetation on hill slopes. The lateritic plateaus (Sadas) are devoid of big tree growth and only grass growth is seen. AND WHEREAS, Dominant tree species in Evergreen forests of Bhimgad WLS are Anjan (Memecylon edule), Hebbalasu (Artocarpus hirsutus), Wate (Artocarpus lakoocha), Rampatri (Myristica malabaricum), Dalchini (Cinnamomum sps), Nandi(Lagerstroemia lanceolata), Dhup (Vateria indica), Ashok (Saracaindica), Fishtail palm (Caryotaurens), Gowada (Mappia foetida). AND WHEREAS, Top canopy in this type of vegetation is dominated by tree species like Nandi (Lagerstroemia lanceolata), Harada (Terminalia chebula), Kaval (Careya arborea), Amla (Emblica officinalis), Tare (Terminalia bellirica), Honne (Pterocarpus marsupium), Kindal (Terminalia paniculata), Shisham (Dalbergia latifolia), Jack (Artocarpus spp), Murki (Buchanania lanzan), Dhup (Dipterocarpus indicus), Gulmavu (Machilus macaranyha), Jamun (Syzigium cumini)etc. AND WHEREAS, 2A/C2 type gives place to a secondary serial type which corresponds to southern tropical secondary moist deciduous forests and these are found in Hemmadaga Section of the Wildlife Sanctuary. Tree species Zizyphus, Butea monosperma, Terminalia chebula, Emblica officinalis are found along with Lasiosiphon eriocephalus. AND WHEREAS, Most of the open spaces in the Bhimgad Wildlife Sanctuary are either grass land or under some kind of weed growth. Amongst exotic weeds Lantana infestation, although not very extensive, is seen in Abnali & Hemmadaga forest areas.Remaining areas are infested by Eupatorium in lower altitudes. AND WHEREAS, most of the hills of Bhimgad region have the presence of two dominant species of Strobilanthes namely Strobilanthes sessilis and Strobilanthes callosus commonly known as Bekra and Karvy, respectively. Nearly 1000 Ha Forest area is completely dominated with Bekra (Strobilanthes sessilis). From a distance it looks like vast stretch of grass lands since Bekra does not allow any other species to come up in the area where it has grown. AND WHEREAS, grasslands on lateritic plateau form mosaic pattern with thick vegetation around them.More than 2000 ha Grasslands are available in Talewadi, Mendil, Gavali, and Hemmadaga areas of the sanctuary. In other portion of the sanctuary also small grass lands are seen amidst thick forests there by encouraging herbivore population. AND WHEREAS, Bhimgad Wildlife Sanctuary is a rich reservoir of medicinal plants. One such area in semi evergreen forests of Amagoan has been identified for Medicinal Plants Conservation Area (MPCA) during 2010-[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 29 11. Out of the recorded species, about 82% of the plants are found to be of medicinal value. Around 47% of the recorded plant species are trees, followed by shrubs (28%) and herbs (18%). The area is also home to several endemic plant species such as Ancistrocladus heyneanus, Diospyros paniculata, Euonymus indicus, Mastixia arborea, etc. Several among the recorded medicinal plants such as Aristolochia tagala, Diospyros montana, Emblica officinalis, Garcinia indica, Nothapodytes nimmonianaetc., are with high medicinal and economic value. AND WHEREAS, Bhimgad wildlife Sanctuary is a habitat for variety of mammals, reptiles, birds, butterflies & other insects. Apart from the fact that Bhimgad is the only known place for roosting & breeding of Wroughton free tailed bats, the region has other important predator &prey animals. Presence of resident tigers and their good prey base in the sanctuary indicates it is a good habitat for the Tigers. The Sanctuary is home to variety of Fauna such as Sambar (Cervus unicolor),Indian Gaur (Bos gauras), Four Horned Antelope (Tetracerus quadricornis), Barking deer (Muntiacus muntjak), Wild boar (Sus scrofa), Indian crested porcupine (Hystixindica),Indian Hare (Lepus nigricollis), Indian spotted chevrotain (Tragulus meminna), Gray Langur( Presbytis entellus), Red Slender Loris (Loris tardigradus), Chital (Axis axis), Leopard (Panthera pardus), Dhole or Indian Wild Dog (Cuon alpinus), Leopard Cat (Felis bengalensis) Sloth Bear (Melursus ursinus), Golden Jackal (Canis aureus), Python (Python molurus), King Cobra (Ophiophagus hannah), Russell‟s viper (Daboia russelii), Common Krait (Bungarus caeruleus), Rat snake (Ptyas mucosa), Vine Snake (Ahaetulla nasuta), Common IndianMonitor (Varanus bengalensis), Indian Flying Lizard (Draco dussumieri), Malabar Gaint squirrel (Ratufa indica)etc., Bhimgad region is also considered as one of the most ideal habitats for tigers. Six to Eight tigers are known to be resident and also moving from the Sanctuary to the surrounding forests of Karnataka and Goa State. AND WHEREAS, the Bhimgad Wildlife Sanctuary has a very good population of avifauna includes Great Indian hornbills and variety of Drongos, Wagtails, Wood peckers, Kingfishers, Eagles, Egrets, Sunbirds,Owls, Doves etc. Grey Jungle fowl, Jungle myna, Crow, Pheasants, Paradise flycatcher etc., are also commonly seen in the region. AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of Bhimgad Bird Sanctuary as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone. AND WHEREAS, now by reason of ecological, environmental, faunal, floral, geographical or zoological association or importance, for the purpose of protecting propagating or developing wildlife therein or its environment, the Government of India, in exercise of the powers conferred under by sub-section (1) read with clause (v) and clause (xiv) of sub-section (2) of section (3) of the Environment (Protection) Act 1986 (29 of 1986) hereby declares the area, the situation and limits of which are specified in the schedule to this notification as the “Eco-sensitive Zone” of the Bhimgad Wildlife Sanctuary. 1. Extent and boundaries of the Eco-Sensitive Zone.- (1) The Bhimgad Wildlife Sanctuary is situated in Khanapur Taluk of Belagavi District of Karnataka State and comprises of 13 villages viz; I to XIII. The boundary description of the said Eco-Sensitive Zone is given at Annexure-A and the map of the Eco-Sensitive Zone with Key locations on its boundary is at Annexure-B. The Eco-sensitive Zone is spread over an area of 117.75 square kilometer with an extent varying from 0 kilometer (Inter State Boundary and Kali Tiger Reserve) to 3.23 kilometers around the boundary of The Bhimgad Wildlife Sanctuary. (2) The G.P.S. co-ordinates of Key locations are annexed as Annexure-C. (3) Details of villages that falls within the ESZ are included at Annexure–D. Further, the details of Reserved Forest Area within the ESZ are given at Annexure – E. And revenue area details within the ESZ boundary are given at Annexure-F and reserved forest that falls within the ambit of ESZ is given at Annexure-G. (4) All activities in the Forest Block Areas shall be governed by the provisions of the Indian Forest Act, 1927, Forest (Conservation) Act, 1980 (69 of 1980) and all the activities in the Protected Area (Sanctuary) shall be governed by the provisions of the Wildlife (Protection) Act, 1972 (53 of 1972) including relevant State Acts/Rules/Guidelines as applicable. (5) The range of the Eco-Sensitive Zone varies from 0.00 kilometers to 3.23 kilometers. (6) In short 11244.79 ha of reserve forest and 530.59 ha. of revenue comes within the limits of ESZ. 2. Zonal Master Plan.- (1) The State Government shall, for the purposes of the Eco-sensitive Zone, prepare a Zonal Master Plan, in consultation with local people and adhering to the stipulations given in this notification for consideration, within a period of two years from the publication of this notification. (2) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments of Environment, Forest, urban Development, Tourism, Municipal, Revenue and the Karnataka State Pollution30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Control Board with a view to include therein various aspects of the environment and ecology for integrating the ecological and environmental considerations into the said plan, namely: - (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj; (xi) Public Works Department, Karnataka Road Development Corporation Limited, National Highway Authority of India; (xii) Hubballi Electricity Supply Company Limited; (xiii) Police Department (Home); (xiv) Karnataka State Pollution Control Board (3) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (4) The Zonal Master Plan would also ensure that no restrictions are imposed on the existing legal land use pattern, as well as the legal infrastructure and activities and same would continue as before. However, the Zonal Master Plan would also factor in improvement of all infrastructure / activities to be more efficient and eco-friendlier. (5) The Zonal Master Plan shall demarcate all the existing worshipping places, village settlements, types and kinds of forests, agricultural areas, fertile lands, green areas such as parks and like places, horticultural areas, orchards, lakes and other water bodies. (6) No change of land use from green uses such as tea gardens, horticulture areas, agriculture parks and others like places to non-green uses shall be permitted in the Zonal Master Plan. However, to meet the residential needs of the local residents due to the natural growth of existing local population, strictly limited conversion of agricultural lands may be permitted, with the prior approval of the State Government. (7) There shall ordinarily be no reduction in Forest Zone, Green Zones and Agricultural area. (8) Pending the preparation of the Zone Master Plan for Eco-Sensitive Zone and approval thereof by the Ministry of Environment and Forests all new constructions and other developmental activities shall be referred to the Ministry of Environment and Forests by the Monitoring Committee as per sub-para (4) of paragraph 4 of the notification. (9) The Monitoring Committee oversees the proper execution of the Zonal Master Plan by all Departments and stakeholders as well. This Committee would also look into the grievances of people and find amicable solution of such grievances. (10) Adequate publicity shall be given to the provisions of the Zonal Master Plan. 3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely: - (1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part(a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 31 Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco- tourism and (v) promoted activities given under paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: (a) Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies. -The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism. - (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco sensitive Zone. (e) The activities of eco-tourism shall be regulated/prohibited as under, namely: - (i) No new Commercial Hotels and Resorts or expansion of existing Commercial Hotels and Resorts shall be permitted within the Eco-Sensitive Zone.; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis one co-tourism, eco-education and eco-development; (iii) development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site-specific scrutiny and recommendation of the Monitoring Committee and no new Commercial Hotels and Resorts or expansion of existing Commercial Hotels and Resorts shall be permitted within the Eco-Sensitive Zone. (4) Natural heritage. - All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites. - Buildings, structures, arte facts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules,2000 under the Environment Act.32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (7) Air pollution. - Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of1981) and the rules made thereunder. (8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes. - Disposal and Management of solid wastes shall be as under: - (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357(E), dated the 8thApril, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-Medical Waste. – Bio Medical Waste Management shall be as under: - (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E),dated the 28thMarch, 2016. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco sensitive Zone. (11) Plastic waste management. - The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18thMarch, 2016, as amended from time to time. (12) Construction and demolition waste management. - The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29thMarch, 2016, as amended from time to time. (13) E-waste. - The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution. - Prevention and control of vehicular pollution shall be in compliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units. – (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016,unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes. - The protection of hill slopes shall be as under: - (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) Construction shall not be permitted on existing steep hill slopes or slopes with a high degree of erosion. 4. Prohibited, Regulated and Permitted Activities in Eco-Sensitive Zone.- All activities in the Bhimgad Wildlife Eco-Sensitive Zone shall be governed by the provisions of the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Wildlife (Protection) Act, 1972 (53 of 1972), the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927) and the Environment (Protection) Act, 1986 (29 of 1986)and amendments made thereto and be regulated in the manner specified in the Table below, namely:[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 33 Prohibited, Regulated and Promoted activities in the Eco-Sensitive Zone of Bhimgad Wildlife Sanctuary Sl. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-Sensitive Zone. 4. Establishment of Industries No new or expansion of existing industries shall be permitted within the Eco-Sensitive Zone. 5. Commercial use of firewood. Prohibited. 6. Establishment of new major Hydroelectric Prohibited. projects, Thermal Power Plants, Nuclear Power Plants and irrigation projects. 7. Introduction of Exotic Species Prohibited. 8. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority; (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made there under. 27. Terms and Functions: (1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinize, the activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1553 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 37 Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification. (2) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (3) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the state as per pro-forma appended at Annexure H. (6) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures: - The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. It shares common boundary with Amagav Village with GPS points 15° 38' 44.070" N, 74° 18' 27.404" E. At Sy. No. 8 it takes right turn and moves further towards Chapoli Village with GPS point 15° 38' 15.655" N, 74° 20' 37.043" E. Then the boundary of ESZ follows KotniNadi and takes turn at GPS point 15° 36' 30.832" N, 74° 18' 12.327" E and further continues at the boundary of Sy. No. 70 of Gavali Village. The ESZ Boundary shares common boundary with Kapoli K. Chapoli and Kiravali villages with GPS point 15° 37' 55.620" N, 74° 22' 31.882" E. A smallportion of land belonging to Pastole Village falls within the ESZ Boundary with GPS point 15° 36' 52.459" N, 74° 22' 19.008" E.The ESZ Boundary runs along the boundary of Sy.
