And whereas, the said draft notification was made available to the public on 08th May 2026; And whereas, no objection/suggestion received in the said period with regard to the said draft notification; Now therefore, in exercise of the powers conferred by section 53 read with clause (q) of section 2 of the Legal Metrology Act 2009, the Lt. Governor of National Capital Territory of Delhi, in consultation with the Central Government, is pleased to make the following rules, namely; 1. Short title and commencement:- (1) These rules may be called the Delhi Legal Metrology (Enforcement) Amendment Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette of Delhi. 2. Amendment of Rule 11:- In the Delhi Legal Metrology (Enforcement) Rules 2011 (hereinafter referred to as the said rules), for rule 11, the following rule shall be substituted, namely:- (11) Registration Certificate of manufacturer, repairer and dealer of weights and measures– (1) Every manufacturer or repairer of, or dealer in, weight or measure shall make an application for the issue of a registration certificate to the Controller or such other officer as may be authorized by him in this behalf, in the appropriate form set out in Schedule II-A. Such Registration Certificate shall be issued on self-declaration basis without any inspection prior to issue of the registration certificate. Provided that no registration certificate to repair shall be required by a manufacturer to repair any weight or measure manufactured by him and used in a State other than the State of manufacture of the same, but the manufacturer has to inform in advance the concerned legal metrology officer about the repairing: Provided further that a person who bonafide repairs any weight or measure owned or possessed by him shall not require a repairer’s registration certificate. (2) Omitted. (3) Every registration certificate issued to a manufacturer, repairer or dealer shall be in the appropriate form set out in Schedule III. (4) Every registration certificate issued to a manufacturer, repairer, or dealer by the Controller or any officer authorised by him in this behalf, on payment of the fee specified in Schedule IV, shall remain valid unless it is suspended or cancelled by the Controller or any officer authorised by him in this behalf. (5) The fee payable for the alteration of a registration certificate or for the issue of a duplicate registration certificate shall be as specified in Schedule IV. (6) The Controller or such other officer as may be authorized by him in this behalf shall maintain a register of registration certificate of manufacturers, dealers and repairers in the form set out in Schedule V. (7) Every manufacturer/repairer/dealer, registered under the Act and these rules shall maintain such workshop/equipments/tools/registers, etc. as the case may be, as per the terms and conditions of the registration certificate. (8) Every repairer registered under the Act and these rules shall furnish a security deposit for each registration certificate to the Government as specified in schedule-VI. (9) Every registration certificate issued under the Act and these rules shall be displayed in a conspicuous place in the premises where the manufacturer, repairer and dealer registered carries on business. (10) A registration certificate issued under the Act and these rules shall not be saleable, transferable or inheritable.[PART IV DELHI GAZETTE : EXTRAORDINARY 19 3. Amendment of Rule 12:- In the said rules, for rule 12, the following rule shall be substituted, namely:— (12) Suspension and Cancellation of Registration Certificate – (1) The Controller or such other officer authorized by him on his behalf may, if he has any reasonable cause to believe that the holder of any registration certificate granted under the Act and these rules has made any statement in, or in relation to, any application for the issue, or continuance of the registration certificate, which is incorrect or false in any material particular or has contravened any provision of the Act or any rule or order made thereunder, suspend such registration certificate, pending the completion of any inquiry against the holder of such registration certificate: Provided that no such registration certificate shall be suspended unless the holder thereof has been given a reasonable opportunity of showing cause against the proposed action: Provided further that where the inquiry referred to in this sub-rule section is not completed within a period of three months from the date of suspension of a registration certificate, such suspension shall, on the expiry of the period aforesaid, stand vacated. (2) The Controller or such other officer authorized by him on his behalf may, if he is satisfied, after making such inquiry as he may think fit, that the holder of a registration certificate has made a false or incorrect statement of the nature referred to in sub- rule (1), or has contravened any law or order referred to in that sub-rule, cancel such registration certificate: Provided that no such registration certificate shall be cancelled unless the holder thereof has been given a reasonable opportunity of showing cause against the proposed action. (3) Every person whose registration certificate has been suspended shall, immediately after such suspension, stop functioning as such registered repairer and shall not resume business as such registered repairer until the order of such suspension has been, or stands, vacated. (4) Every registered repairer whose registration certificate has been suspended or cancelled shall, after such suspension or cancellation, as the case may be, surrender such registration certificate to the authority by which such registration certificate was issued. (5) Every registered repairer whose registration certificate has been cancelled shall, within a period of thirty days from the date of such cancellation, or within such further period, not exceeding three months from such date, as the Controller or such other officer authorized by him on his behalf may, on sufficient cause being shown, allow, dispose of the weights or measures which were in his possession, custody or control on the date of such cancellation and in the event of his failure to do so, the Controller or any other officer authorized by him, in writing, in this behalf, may seize and dispose of the same and distribute the proceeds thereof in such manner as may be prescribed. 4. Amendment of Rule 13 - In Rule 13, for the words “licensed under the Act and these rules”, the words “registered under the Act and these rules” shall be substituted. 5. Consequential Amendments - Throughout the rules and the Schedules appended thereto, unless the context otherwise requires, the words “licence”, “licensed”, “licensee”, “licenced”, “licensing” and “renewal of licence” shall respectively be construed as and substituted by “Registration Certificate”, “registered”, “registrant”, “registered”, “registration” and “continuance of Registration Certificate”, wherever they occur. 6. Amendment of Schedules. In the Schedule appended to the rules— (1) for Schedule II-A, the following Schedule shall be substituted, namely:— “Schedule II-A (as appended to these rules)”; (2) Schedule II-B shall be omitted; (3) for Schedule III, the following Schedule shall be substituted, namely:— “Schedule III (as appended to these rules)”; (4) for Schedule IV, the following Schedule shall be substituted, namely:— “Schedule IV (as appended to these rules)”; (5) for Schedule V, the following Schedule shall be substituted, namely:— “Schedule V (as appended to these rules)”; (6) for Schedule VI, the following Schedule shall be substituted, namely:— “Schedule VI (as appended to these rules)”; (7) for Schedule VII, the following Schedule shall be substituted, namely:— “Schedule VII (as appended to these rules)”.20 DELHI GAZETTE : EXTRAORDINARY PART IV] 7. The person in whose favour this Registration Certificate is issued shall. - (a) Comply with all the relevant provisions of the Act and Rules for the time being in force; (b) Not encourage or countenance any infringement of the provisions of the Act or the Rules for the time being in force; (c) Exhibit this Registration Certificate in some conspicuous part of the premises to which it relates; (d) Comply with any general or special directions that may be given by the Controller of legal metrology; (e) Surrender the Registration Certificate in the event of closure of business and/or cancellation of Registration Certificate; (f) (i) Present the weights, measures, weighing or measuring instruments as the case may be duly repaired to the legal metrology officer for under taking verification and stamping as specified in rule 14(1), before delivery to the user. (ii) In the case of weights, measures weighing or measuring instruments, if they are serviced/repaired before the date on which the verification falls due and where, in the process and the verification stamp of the legal metrology officer is defaced, removed or broken, they shall be presented duly repaired to the legal metrology officer for re-verification and stamping before delivery to the user. 2. Every condition prescribed after the issue of this Registration Certificate shall, if notified in the Official Gazette, be binding on the persons to whom the Registration Certificate has been granted."
