L.-33004/99 सी.जी.-डी.एल.-अ.-21072023-247515 xxxGIDHxxx CG-DL-E-21072023-247515 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 422] नई दिल्ली, िुक्रिार, िुलाई 21, 2023/आषाढ़ 30, 1945 No. 422] NEW DELHI, FRIDAY, JULY 21, 2023/ASHADHA 30, 1945 सामाजिक न्याय और अजधकाररता मत्रं ालय (दिव्ागं िन सिजिकरण जिभाग) अजधसचू ना नई दिल्ली, 21 िुलाई, 2023 सा.का.जन. 528(आ).—िबदक दिव्ांगिन अजधकार अजधजनयम, 2016 (2016 का 49) की धारा 100 की उप- धारा (1) के तहत यथा अपेजित, दिनांक 13 अप्रलै , 2023 की अजधसूचना संख्या. सा.का.जन 290 (असा.) के माध्यम स े दिव्ांगिन अजधकार जनयम, 2017 म ें आग े और संिोधन करने के जलए भारत के रािपत्र, असाधारण, भाग-II, खंड 3, उप-खंड (i) म ें कजतपय जनयमों का एक मसौिा प्रकाजित दकया गया था जिसम ें आजधकाररक रािपत्र की उि अजधसूचना िाली प्रजतयां िनता को जिस तारीख स े उपलब्ध कराई गई थी, उस तारीख स े तीस दिनों की समाजि स े पहल,ेइसस े प्रभाजित होने की संभािना िाले सभी व्जियों स े आपजियां और सुझाि आमंजत्रत दकए गए थ े । और िबदक, उि अजधसूचना के आजधकाररक रािपत्र की प्रजतया ं 13 अप्रलै , 2023 को िनता के जलए उपलब्ध कराई गई थीं; और िबदक, उि अजधसूचना के संबंध म ें िनता स े प्राि आपजियों और सुझािों पर केंद्र सरकार द्वारा जिचार दकया गया था; अब, इसजलए, दिव्ांगिन अजधकार अजधजनयम, 2016 (2016 का 49) की धारा 100 की उप-धाराओं (1) और (2) द्वारा प्रिि िजियों का प्रयोग करते हुए, केंद्र सरकार दिव्ांगिन अजधकार जनयम, 2017 म ें आगे और संिोधन करन े के जलए एतिद्वारा जनम्नजलजखत जनयम बनाती ह,ै अथाात:्- (1) इन जनयमों को दिव्ांगिन अजधकार (संिोधन) जनयम, 2023 कहा िाए। 4740 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) ये आजधकाररक रािपत्र म ेंउनके प्रकािन की तारीख स ेलागू होंगे। 2. दिव्ांगिन अजधकार जनयम, 2017 म,ें जनयम (15) म,ें उप-जनयम (1) म,ें खंड (ड.) के पश् चात ् जनम्नजलजखत खंड को अंत: स्ट्थाजपत दकया िाएगा, अथाात्:- “(च) नागर जिमानन मंत्रालय म ें भारत सरकार द्वारा संख्या एिी-24032/56/2021-एएआई-एमओसीए दिनांक 9 िनिरी, 2023 के िररए समय-समय पर यथा संिोजधत नागर जिमानन के जलए सुगम् यता मानक और दििाजनिेि 2022 को अजधसूजचत दकया गया ह।ै ’’ [फा. स.ं 38-05/2023-डीडी-III] रािीि िमाा, संयुक् त सजचि नोट:- दिव्ांगिन अजधकार जनयम, 2017 को दिनांक 15 िून, 2017 की अजधसूचना संख्या. सा.का.जन. 591(असा.) के माध्यम स े भारत के रािपत्र, असाधारण, भाग II, खंड 3, उप-खंड (i) में प्रकाजित दकया गया था। MINISTRY OF SOCIAL JUSTICE AND EMPOWERMENT (Department of Empowerment of Persons with Disabilities (Divyangjan)) NOTIFICATION New Delhi, the 21st July, 2023 G.S.R. 528 (E).—Whereas a draft of certain rules further to amend the Right of Persons with Disabilities Rules, 2017 were published in the Gazette of India, Extraordinary, Part II, section 3, sub-section (i) vide notification number G.S.R 290 (E), dated the 13th April, 2023, as required under sub-section (1) of section 100 of the Rights of Persons with Disabilities Act 2016 (49 of 2016), inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of a period of thirty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public. And whereas, the copies of the Official Gazette of the said notification were made available to the public on the 13th April, 2023; And whereas, the objections and suggestions received from the public in respect of the said notification were considered by the Central Government; Now, therefore, in exercise of the powers conferred by sub-sections (1) and (2) of section 100 of the Rights of Persons with Disabilities Act, 2016 (49 of 2016), the Central Government hereby makes the following rules further to amend the Rights of Persons with Disabilities Rules, 2017, namely:- (1) These rules may be called the Rights of Persons with Disabilities (Amendment) Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Rights of Persons with Disabilities Rules, 2017, in rule 15, in sub-rule (1), after clause (e), the following clause shall be inserted, namely:- “(f) the Accessibility Standards and Guidelines for Civil Aviation 2022, notified by the Government of India in the Ministry of Civil Aviation, vide notification number AV-24032/56/2021-AAI-MoCA, dated the 9th January, 2023, as amended from time to time.” [F.
