अपजत्तयां या सुझाि, यदद कोइ हो, िटरष्ठ सलाहकार, जिज्ञान और प्रौद्योजगकी जिभाग, भारत सरकार, प्रौद्योजगकी भिन, नइ ददल्ली-110016 को या akhilesh.g@nic.in और praveen@nic.in पर इ-मेल द्वारा भेज े जा सकते ह।ैं ईि मसौदा जनयमािली के संबंध म ें दकसी भी व्यजि स े प्राप्त होने िाली अपजत्तयों और सुझािों पर केन्द्द्र सरकार द्वारा जिचार जिजनर्ददष्ट ऄिजध की समाजप्त से पहल े दकया जाएगा। मसौदा जनयमािली 1. सजं िप्त नाम और प्रारंभ - (1) आन जनयमों को ऄनुसंधान राष्ट्रीय िोध प्रजतष्ठान (िासी बोडड और काय ड पटरषद के सदस्ट्यों की योग्यता, ऄनुभि, मानदेय, भत्ता और सेिा का ऄन्द्य जनबंधन और ितड) जनयमािली, 2023 कहा जाएगा। 665 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) ि ेराजपत्र म ेंप्रकािन की तारीख को प्रिृत्त होंगे। 2. पटरभाषाए ं (1) आस जनयमािली में जब तक दक संदभड स ेऄन्द्यथा ऄपेजित न हो,  (क) 'ऄजधजनयम' से ऄनुसंधान राष्ट्रीय िोध प्रजतष्ठान ऄजधजनयम, 2023 (2023 का 25) ऄजभप्रेत ह;ै (ख) "ऄध्यि" से ऄजधजनयम की धारा 5 की ईपधारा (2) के खडं (क) म ेंईजल्लजखत िासी बोडड का ऄध्यि ऄजभप्रेत ह;ै (2) जो िब्द और िाकयांि आन जनयमों म ें प्रयुि और ऄपटरभाजषत ह ैं दकन्द्त ु ऄजधजनयम म ें पटरभाजषत ह,ैं ईनके िही ऄजभप्राय होंगे जो आस ऄजधजनयम में ईनके जलए जनयत दकए गए ह।ैं 3. िासी बोडड के सदस्ट्यों की ऄहतड ाएं और ऄनभु ि - (1) ऄजधजनयम की धारा 5 की ईपधारा (3) के खंड (क) के ऄधीन नाजमत ऄथिा जनयिु दकए जाने िाल ेसदस्ट्य प्रधानमंजत्रय जिज्ञान, प्रौद्योजगकी और निोन्द्मेष पटरषद के सदस्ट्य होंगे। (2) ऄजधजनयम की धारा 5 की ईपधारा 3 के खंड (ख) के ऄधीन नाजमत ऄथिा जनयुि होने िाला सदस्ट्य िह व्यजि होगा जो दकसी व्यािसाजयक संगठन या ईद्योग म ेंऄग्रणी पद पहले धारण कर चुका ह ैऄथिा ितडमान में धारण कर रहा ह।ै (3) ऄजधजनयम की धारा 5 की ईपधारा 3 के खंड (ग) के ऄधीन नाजमत ऄथिा जनयुि दकया जाने िाला सदस्ट्य मानजिकी और सामाजजक जिज्ञान के िेत्र में न्द्यूनतम दस िष ड का ऄनुभिी होगा। (4) ऄजधजनयम की धारा 5 की ईपधारा 3 के खंड (घ) के ऄधीन नाजमत ऄथिा जनयिु दकए जाने िाल े सदस्ट्य िैज्ञाजनक और प्रौद्योजगकीय ऄनसु ंधान और जिकास में कायडरत राष्ट्रीय प्रयोगिाला या ऄनुसंधान/िैिजणक संस्ट्थान के प्रमुख होंग े या ऐसी संस्ट्था में िटरष्ठ िैज्ञाजनक या िटरष्ठ सकं ाय सदस्ट्य के पद धारक होंग े जजनके पास न्द्यूनतम बीस िषड का ऄनुभि हो। (5) ऄजधजनयम की धारा 5 की ईपधारा 3 के खडं (ङ) के ऄधीन नाजमत ऄथिा जनयिु दकए जाने िाल े सदस्ट्यों के पास जनम्नजलजखत में से दकसी एक या एक से ऄजधक िेत्रों म ें डॉकिरेि की ईपाजध या ऄन्द्य जििेषीकृत िैजिक ऄहतड ा होगी- (i) स्ट्िास्ट््य; (ii) गजणतीय और भौजतक जिज्ञान; (iii) जीि जिज्ञान; (iv) आंजीजनयरी और प्रौद्योजगकी; (v) निोन्द्मेष और भागीदारी; (vi) कम्प्यूिर और सूचना जिज्ञान; (vii) आंजीजनयरी, और ईि िेत्र म ेंऄनुभि ऄिजध न्द्यूनतम बीस िषड की होगी। 4. िासी बोड ड के सदस्ट्यों की पदािजध - िासी बोड ड के सदस्ट्य जनयुजि की तारीख स े सामान्द्यतः तीन िष ड की ऄिजध ऄथिा ऄध्यि द्वारा जनधाडटरत दकसी ऄन्द्य ऄिजध तक पद धारण करेंगे और पुनर्ननयुजि के पात्र होंगे। 5. िासी बोड ड के जनयिु सदस्ट्यों के भत्त े - (1) ऄजधजनयम की धारा 5 के ईपखंड (3) के ऄधीन जनयुि िासी बोड ड का प्रत्येक सदस्ट्य, िासी बोडड की बैठक में ईपजस्ट्थत होने पर, जनम्नजलजखत के ऄनुसार भत्ते और व्यय का हकदार होगा: (क) जहां दकसी सदस्ट्य स े िासी बोड ड की बैठक म ें भाग लने े के प्रयोजन स े या िासी बोडड के कृत्य को करने के प्रयोजन से स्ट्िेिन-बाह्य यात्रा करने की ऄपेिा की जाती ह,ै िहां ऐसा सदस्ट्य जनम्नजलजखत का हकदार होगा- (i) ईपलब्ध ईच्चतम श्रेणी के ऄनुसार हिाइ दकराया; (ii) िासी बोडड द्वारा समय-समय पर ऄनुमोददत ऄजधकतम राजि के ऄध्यधीन िास्ट्तजिक अिास व्यय; और (iii) िासी बोडड द्वारा समय-समय पर ऄनुमोददत ददिाजनदिे ऄथिा ऄनुदेि के ऄनुसार ऐसी यात्रा के ऄन्द्य सभी पहलओंु को जिजनयजमत दकया जाएगा।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 (ख) जहा,ं िासी बोडड का कोइ सदस्ट्य ईस स्ट्थान का जनिासी ह ै जहा ं िासी बोड ड की बैठक अयोजजत की जाती है, ऄथिा जहां िासी बोडड का कोइ ऄन्द्य कायड दकया जाता ह,ै तो ईस सदस्ट्य को िासी बोडड के सदस्ट्य के कायाडलय ऄथिा जनिास के सामान्द्य स्ट्थान स े बैठक स्ट्थल तक िासी बोड ड के दकसी भी काय ड म ें भाग लने े के जलए जान े और ऄपने कायाडलय ऄथिा जनिास स्ट्थल पर िापस अन े हते ु ईसके द्वारा पटरिहन पर दकए गए िास्ट्तजिक व्यय का भुगतान दकया जाएगा: बिते दक जब यात्रा दकसी ऄन्द्य स्ट्थान स े िरूु होती ह ै ऄथिा िापसी यात्रा दकसी ऄन्द्य स्ट्थान पर समाप्त होती ह,ै तो यात्रा भत्ते ईस राजि तक सीजमत होंग े जो तब देय होत े जब कायाडलय या जनिास के सामान्द्य स्ट्थान से यात्रा िुरू या समाप्त हुइ होती, ऄथिा िास्ट्तजिक रूप म ें की गइ यात्रा के मामलों में देय राजि, जो भी कम हो, तक सीजमत होगी: परंतु यह भी दक ऄध्यि, जिजिष्ट पटरजस्ट्थजतयों म,ें दकसी सदस्ट्य के कायाडलय या जनिास के सामान्द्य स्ट्थान स ेजभन्न स्ट्थान से यात्रा करने का भत्ता प्रदान कर सकता ह।ै (ग) िासी बोडड के सदस्ट्य को कोइ यात्रा भत्ता या दैजनक भत्ता तब तक नहीं ददया जाएगा जब तक िह यह प्रमाजणत न कर द े दक ईसने ईस यात्रा और ठहराि, जजसके जलए दािा दकया गया है, के संबंध में दकसी ऄन्द्य स्रोत स े कोइ यात्रा या दैजनक भत्ता नहीं जलया ह।ै (घ) बैठक भत्ता, दैजनक भत्ता और ऐसा ऄन्द्य भत्ता जो केंद्र सरकार के अयोगों और सजमजतयों के गरै -सरकारी सदस्ट्यों पर ऐसे अयोग या सजमजत की बैठकों में भाग लेन े पर लाग ूहोता ह।ै (2) पेंिन और ईपदान सजहत कोइ ऄजतटरि भगु तान राजि िासी बोडड के दकसी भी सदस्ट्य के जलए िासी बोडड हेतु की गइ ईसकी सेिा के जिषय म ेंऄनुमत नहीं होगी। 6. काय ड पटरषद के सदस्ट्यों की योग्यता और ऄनभु ि - ऄजधजनयम की धारा 7 की ईपधारा 3 के खडं (ख) के ऄधीन नाजमत ऄथिा जनयिु दकए जान े िाले सदस्ट्य- (क) ऄकादजमक जगत, लोकोपकारी िेत्रक, ऄनुसंधान प्रयोगिाला और ईद्योग में जिज्ञान और प्रौद्योजगकी िेत्र म ें डॉकिरेि जडग्री ऄथिा ऄन्द्य जिजिष्ट योग्यता धारक होंगे; और (ख) ऄपन े िेत्र म ेंपंद्रह साल का न्द्यूनतम ऄनुभि रखने िाल ेहोंगे। 7. काय ड पटरषद सदस्ट्यों की पदािजध - कायड पटरषद के सदस्ट्य सामान्द्यतः जनयुजि की तारीख से तीन िषड की ऄिजध या ऄध्यि द्वारा जनधाडटरत ऐसी दकए ऄन्द्य ऄिजध तक पद धारण करेंग ेऔर पनु र्ननयुजि के पात्र होंगे। 8. काय ड पटरषद सदस्ट्यों के भत्त-े (1) ऄजधजनयम की धारा 7 की ईपधारा (3) के खंड (ख) के ऄधीन जनयिु कायड पटरषद का प्रत्येक सदस्ट्य, जो कायड पटरषद की बैठक म ें ईपजस्ट्थत होता ह,ै जनम्नजलजखत के ऄनुसार भत्ता और व्यय का हकदार होगा: (क) काय ड पटरषद का सरकारी सेिक से जभन्न कोइ सदस्ट्य, बैठक में ईपजस्ट्थजत के प्रयोजन से ऄथिा कायड पटरषद द्वारा ईसे सौंप े गए दकसी कतव्यड जनिडहन के प्रयोजन से ईसके द्वारा की गइ दकसी यात्रा के संबंध म ें केन्द्द्रीय सरकार के ऄजधकाटरयों के जलए तत्समय प्रिृत्त स्ट्िीकायड ईच्चतम दरों पर बैठक भत्ता, यात्रा भत्ता, दैजनक भत्ता और ऐसा ऄन्द्य भत्ता लने े का हकदार होगा। (ख) कायड पटरषद का कोइ सदस्ट्य ईस स्ट्थान का जनिासी ह ै जहां कायड पटरषद की बैठक अयोजजत की जाती ह,ै ऄथिा जहां कायड पटरषद का कोइ ऄन्द्य कायड दकया जाता ह,ै तो ईस सदस्ट्य को कायड पटरषद के सदस्ट्य के कायाडलय ऄथिा जनिास के सामान्द्य स्ट्थान से बैठक स्ट्थल तक कायड पटरषद के दकसी भी कायड में भाग लेन े के जलए जाने और ऄपने कायाडलय ऄथिा जनिास स्ट्थल पर िापस अने हते ु ईसके द्वारा पटरिहन पर दकए गए िास्ट्तजिक व्यय का भुगतान दकया जाएगा: बिते दक जब यात्रा दकसी ऄन्द्य स्ट्थान स े िरूु होती ह ै ऄथिा िापसी यात्रा दकसी ऄन्द्य स्ट्थान पर समाप्त होती ह,ै तो यात्रा भत्ते ईस राजि तक सीजमत होंग े जो तब द े होत े ह ैं जब कायाडलय या जनिास के सामान्द्य स्ट्थान से यात्रा िरूु या समाप्त हुइ होती, ऄथिा िास्ट्तजिक रूप में की गइ यात्रा के मामले में देय राजि, जो भी कम हो, तक सीजमत होगी:4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] परंतु यह भी दक ऄध्यि ऄथिा सदस्ट्य सजचि, जिजिष्ट पटरजस्ट्थजतयों में, दकसी सदस्ट्य के कायाडलय या जनिास के सामान्द्य स्ट्थान स ेजभन्न स्ट्थान स ेयात्रा करन े का भत्ता प्रदान कर सकता ह।ै (ग) काय ड पटरषद के सदस्ट्य को कोइ यात्रा भत्ता या दैजनक भत्ता तब तक नहीं ददया जाएगा जब तक िह यह प्रमाजणत न कर दे दक ईसने ईस यात्रा और ठहराि, जजसके जलए दािा दकया गया ह,ै के संबंध में दकसी ऄन्द्य स्रोत से कोइ यात्रा या दैजनक भत्ता नहीं जलया ह।ै (2) पेंिन और ईपदान सजहत कोइ ऄजतटरि भगु तान राजि कायड पटरषद के दकसी भी सदस्ट्य के जलए कायड पटरषद हते ु की गइ ईसकी सेिा के जिषय म ेंऄनुमत नहीं होगी। 9. प्रजतष्ठान प्रिासन- जिज्ञान और प्रौद्योजगकी जिभाग, जिज्ञान और प्रौद्योजगकी मंत्रालय प्रजतष्ठान का प्रिासजनक मंत्रालय होगा। 10. ऐस े जिषय जजनके सबं धं म ें कोइ ईपबधं नहीं दकया गया ह ै - िासी बोडड के सदस्ट्यों और कायड पटरषद के सदस्ट्यों की सेिा के जनबन्द्धन और ितड संबधं ी मामले, जजनके जलए आन जनयमों में कोइ स्ट्पष्ट ईपबंध नहीं दकया गया है, केन्द्द्रीय सरकार के जिजनश्चयनाथ डऄग्रेजषत दकए जाएगँ े। 11. जिजथलन िजि-जहाँ केन्द्द्रीय सरकार का मत ह ैदक जहा ं ऐसा करना अिश्यक या समीचीन ह ैिहाँ िह, जलजखत म ें दज ड दकए जाने िाले कारणों से अदिे द्वारा, िासी बोडड के सदस्ट्यों और कायड पटरषद के सदस्ट्यों के संबंध में आस जनयमािली के ईपबंधों में स ेदकसी ईपबंध में छूि दे सकेगी। [फा. सं. डीएसिी/एएनअरएफ/जेड-02/2023] ऄजखलेि गुप्ता, िटरष्ठ सलाहकार MINISTRY OF SCIENCE AND TECHNOLOGY (Department of Science and Technology) NOTIFICATION New Delhi, the 2nd February, 2024 G.S.R. 85(E).—The following draft rules which the Central Government proposes to make in exercise of the powers conferred by clauses (a) and (b) of sub-section (2) of Section 23 of the Anusandhan National Research Foundation Act, 2023 (25 of 2023), are hereby published for the information of all persons likely to be affected thereby, and notice is hereby given that the said notification will be taken into consideration on or after the expiry of a period of thirty (30) days from the date of publication of the draft in the official Gazette; Objections or suggestions, if any, may be addressed to the Senior Adviser, Department of Science and Technology, Government of India, Technology Bhawan, New Delhi – 110016 or by e-mail at akhilesh.g@nic.in and praveen@nic.in; The objections and suggestions, which may be received from any person with respect to the said draft rules before the expiry of the period so specified, will be considered by the Central Government. DRAFT RULES 1. Short title and commencement.  (1) These rules may be called the Anusandhan National Research Foundation (qualifications, experience, honorarium, allowances, and other terms and conditions of service of Members of the Governing Board and Executive Council) Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions.  (1) In these rules, unless the context otherwise requires,  (a) ‗Act‘ means the Anusandhan National Research Foundation Act, 2023 (25 of 2023); (b) ―President‖ means a president of the Governing Board referred to in clause (a) of sub-section (2) of section 5 of the Act; (2) Words and expressions used and not defined in these rules but defined in the Act shall have the same meanings as assigned to them in the Act.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 5 3. Qualifications and experience of Members of Governing Board.  (1) The Members to be nominated or appointed under clause (a) of sub-section (3) of section 5 of the Act shall be Members of the Prime Minister‘s Science, Technology and Innovation Council. (2) The Members to be nominated or appointed under clause (b) of sub-section 3 of section 5 of the Act shall be a person who has previously occupied or currently occupies a position of leadership at a business organisation or an industry. (3) The Member to be nominated or appointed under clause (c) of sub-section 3 of section 5 of the Act shall possess minimum period of ten years of experience in the field of humanities and social sciences. (4) The Members to be nominated or appointed under clause (d) of sub-section 3 of section 5 of the Act shall hold the position of head of a national laboratory or research/academic institution engaged in scientific and technological research and development, or senior scientist or senior faculty member in such institution with a minimum period of twenty years of experience. (5) The Members to be nominated or appointed under clause (e) of sub-section 3 of section 5 of the Act shall possess a doctorate degree or other specialised educational qualification in one or more of the following fields,  (i) health; (ii) mathematical and physical sciences; (iii) biological sciences; (iv) engineering and technology; (v) innovation and partnership; (vi) computer and information sciences; (vii) engineering, and shall have minimum period of twenty years of experience in the field. 4. Term of office of Members of Governing Board.  The Members of the Governing Board shall ordinarily hold office for a period of three years from the date of appointment, or such other period as determined by the President, and shall be eligible for reappointment. 5. Allowances for Members of the Governing Board appointed.  (1) Every Member of the Governing Board appointed under sub-clause (3) of section 5 of the Act, attending the meeting of the Governing Board, shall be entitled to allowances and expenses in accordance with the following: (a) Where a Member is required to undertake outstation travel for the purpose of attending a meeting of the Governing Board, or for performing the functions of the Governing Board, such Member shall be entitled to  (i) air fare by the highest class available; (ii) accommodation expenses at actuals, subject to ceiling amounts as may be approved by the Governing Board from time to time; and (iii) all other aspects of such travel shall be regulated as per the guidelines or instructions as may be approved by the Governing Board from time to time. (b) Where a Member of the Governing Board is a resident at a place where the meeting of the Governing Board is held, or where any other business of the Governing Board is transacted, shall be paid the actual expenditure incurred on conveyance by him, from the usual place of office or residence of Member of the Governing Board to the place of the meeting where such Member has gone to attend any business of the Governing Board and back to his place of office or residence: Provided that when the journey commences from or the return journey terminates at any other place, the travelling allowances shall be restricted to the amount that would have been payable had the journey commenced from or terminated at the usual place of office or residence, or to the amount payable in respect of the actual journey undertaken, whichever is less: Provided further that in special circumstances, the President may grant travelling allowance from places other than the usual place of office or residence of a member. (c) No travelling allowance or daily allowance shall be allowed to a Member of the Governing Board unless he certifies that he has not drawn any travelling or daily allowance from any other source in respect of the journey and halt for which the claim is made.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (d) Sitting allowance, daily allowance and such other allowances as are applicable to non-official members of the Commissions and Committees of the Central Government attending the meetings of such Commission or Committee. (2) No additional amount of payment, including pension and gratuity, shall be admissible to any Member of the Governing Board for service rendered by him to the Governing Board. 6. Qualification and experience of Members of Executive Council.  The Members to be nominated or appointed under clause (b) of sub-section 3 of section 7 of the Act shall  (a) possess doctorate degree or other specialised qualification in the fields of science and technology in academia, philanthropic sector, research laboratories and industries; and (b) have minimum period of fifteen years of experience in the field. 7. Term of office of Members of Executive Council.  The Members of the Executive Council shall, ordinarily hold office for a period of three years, or such other period as determined by the President, from the date of appointment and be eligible for reappointment. 8. Allowances for Members of Executive Council.  (1) Every Member of the Executive Council appointed under clause (b) of sub-section (3) of section 7 of the Act, attending the meeting of the Executive Council, shall be entitled to allowances and expenses in accordance with the following: (a) A member of the Executive Council, other than a Government servant, shall be entitled to draw sitting allowances, travelling allowances, daily allowances, and such other allowances at the highest rates as admissible to the officials of the Central Government for the time being in force, in respect of any journey performed by him for the purpose of attending a meeting or for the purpose of discharging any duty assigned to him by the Executive Council. (b) A member of the Executive Council who is a resident at a place where the meeting of the Executive Council is held or where any other business of the Executive Council is transacted, shall be paid the actual expenditure incurred on conveyance by him, from the usual place of office or residence of member of the Executive Council to the place of the meeting where such Member has gone to attend any business of the Executive Council and back to his or her place of office or residence: Provided that when the journey commences from or the return journey terminates at any other place, the travelling allowances shall be restricted to the amount that would have been payable had the journey commenced from or terminated at the usual place of office or residence, or to the amount payable in respect of the actual journey undertaken, whichever is less: Provided further that in special circumstances, the Chairperson or the Member Secretary, may grant travelling allowance from places other than the usual place of office or residence of a member. (2) No additional amount of payment, including pension and gratuity shall be admissible to any Member of the Executive Council for service rendered by him to the Executive Council. 9. Administration of Foundation.  The Department of Science and Technology, Ministry of Science and Technology shall be the administrative Ministry for the Foundation. 10, Matters with respect to which no provision has been made.  Matters relating to the terms and conditions of service of the Members of the Governing Board and Members of the Executive Council, with respect to which no express provision has been made in these rules, shall be referred to the Central Government for its decision. 11. Power to relax.  Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing, relax any of the provisions of these rules with respect to the Members of the Governing Board and Members of the Executive Council.
