(4) तलािी-सह-चयन सजमजत मुख्य कायिपालक अजधकारी के पि पर संस्ट्तुत दकए िान े िाल े नामों के पैनल म ें िाजमल दकए िाने के जलए व्यजियों का चयन करन े की अपनी स्ट्ियं की प्रदक्रया तैयार करेगी। (5) तलािी-सह-चयन सजमजत मुख्य कायिपालक अजधकारी के पि पर संस्ट्तुत दकए िान े िाल े नामों के पैनल म ें िाजमल दकए िाने के जलए उपजनयम (2) के अधीन दिए गए जनिेि की तारीख से साठ से अनजधक दिन की अिजध के भीतर अध्यि को अपनी जसफाटरिे करेगी । 4. मख्ु य कायपि ालक अजधकारी की योग्यता और अनभु ि. ⎯ (1) मुख्य कायिपालक अजधकारी के पि पर जनयुजि के जलए जिचार दकए िा रह ेव्यजि के पास ⎯ (क) अनुसंधान, या निोन्द्मेष, या प्रौद्योजगकी जिकास के प्रमाजणत रैक टरकॉडि के साथ जिज्ञान में जनष्णात की जडग्री, या इंिीजनयरी या जचदकत्सा िास्त्र में स्नातक की जडग्री, या प्रबंधन म ेंजनष्णात की जडग्री,; और (ख) मान्द्यता प्राप्त राष्ट्रीय या अंतराष्ट्रि ीय जिश्वजिद्यालय, या सरकारी या दकसी कंपनी के िोध संस्ट्थान या िोध प्रयोगिाला म ें संकाय सिस्ट्य या जिज्ञानी के पि पर या दकसी कंपनी म ें िटरष्ठ प्रबंधकीय स्ट्तर पर कम स े कम बीस िषों का अनुभि, जिसमें अनुसंधान और जिकास कायिक्रमों या पटरयोिनाओं के प्रबंधन में पांच िषों का अनुभि िाजमल ह।ै (2) उपजनयम (1) के अधीन जनयुजि के जलए जिचार दकए गए व्यजि की आयु पैंसठ िषि से अजधक नहीं होगी। 5. मख्ु य कायपि ालक अजधकारी की पिािजध ⎯ प्रजतष्ठान का मुख्य कायिपालक अजधकारी जनयुजि की तारीख से तीन साल की अिजध या अध्यि द्वारा जनधािटरत ऐसी अन्द्य अिजध तक पि धारण करेगा और पनु र्नियुजि का पात्र होगा : बिते दक सत्तर िष ि से अजधक आयु का कोई भी व्यजि मख्ु य कायिपालक अजधकारी के पि पर तब तक नहीं धाटरत करेगा िब तक अध्यि द्वारा अन्द्यथा जनधािटरत न दकया िाएगा । 6. मख्ु य कायपि ालक अजधकारी की सिे ा िति ⎯ मख्ु य कायिपालक अजधकारी को अध्यि द्वारा यथा जनधािटरत िेतन और भत्ते की राजि का भगु तान दकया िाएगा और िह जनयम 9 और 10 के अधीन लाभ का पात्र भी होगा । 7. छुट्टी ⎯ मुख्य कायिपालक अजधकारी केंद्र सरकार के कमिचाटरयों के जलए यथा अनुप्रयोज्य प्रत्यके िषि की सेिा के जलए अर्िित छुट्टी का हकिार होगा और छुट्टी के िौरान िेतन का भगु तान समय-समय पर संिोजधत केंद्रीय जसजिल सेिा (छुट्टी) जनयम, 1972 के जनयमािली 40 द्वारा अजभिाजसत होगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 8. मख्ु य कायपि ालक अजधकारी के कृत्य ⎯ मख्ु य कायिपालक अजधकारी की जिम्मेिारी प्रजतष्ठान का कुिल प्रिासन करने की होगी, और उसके पास प्रजतष्ठान के सभी मामलों म ेंसामान्द्य अधीिण, जनिेिन और जनयत्रं ण करन े की िजियां होंगी। 9. केंद्र सरकार के टरहायिी आिास का आििं न ⎯ (1) मख्ु य कायिपालक अजधकारी सामान्द्य पलू म ेंकेंद्र सरकार के टरहायसी आिास के आिंिन के जलए उन्द्हीं ितों पर पात्र होंग ेिो केंद्र सरकार के कमिचाटरयों के जलए स्ट्िीकायि होंगे । (2) प्रजतष्ठान का मुख्य कायिपालक अजधकारी जिसे उप-जनयम (1) के अधीन आिास आिंटित नहीं दकया गया है, िासी बोडि द्वारा जनधािटरत मकान दकराया भत्ते के जलए पात्र होगा। 10. केंद्र सरकार स्ट्िास्ट््य योिना हकिारी - प्रजतष्ठान का मुख्य कायिपालक अजधकारी इस संबंध म ेंभारत की केंद्र सरकार द्वारा जनधािटरत ितों पर केंद्र सरकार की स्ट्िास्ट््य योिना के लाभों का हकिार होगा। 11. यात्रा और िैजनक भत्ता ⎯ मुख्य कायिपालक अजधकारी, भारत के भीतर िौरे पर या स्ट्थानांतरण पर, प्रजतष्ठान म ें कायािरंभ करने या प्रजतष्ठान में अपनी पिािजध पूरी होने पर अपने गृह नगर िान े के जलए की गई यात्रा सजहत यात्रा भत्ता, व्यजिगत सामग्री के पटरिहन का, िैजनक भत्ता और अन्द्य समान मामलों म ेंभारत सरकार के सजचि के जलए लाग ूिर पर हकिार होगा। 12. जििेिों की आजधकाटरक यात्राएँ. ⎯ मुख्य कायिकारी अजधकारी द्वारा जििेिों म ेंआजधकाटरक यात्राएं जिज्ञान और प्रौद्योजगकी जिभाग के सजचि के अनुमोिन से की िाएगं ी और समय-समय पर केंद्र सरकार द्वारा िारी दििा-जनिेिों या जनिेिों के अनुसार जिजनयजमत की िाएंगी। 13. ऐस ेजिषय जिनके सबं धं म ेंकोई उपबधं नहीं दकया गया है ⎯ प्रजतष्ठान के मुख्य कायिपालक अजधकारी की सेिा के जनबंधन और ित ि संबंधी मामल,े जिनके जलए इन जनयमों में कोई स्ट्पष्ट उपबंध नहीं दकया गया है, कायि पटरषि द्वारा केंद्र सरकार के जिजनश्चयनाथ ि अग्रेजषत दकए िाएंगे। 14. जिजथलन िजि - िहाँ केन्द्द्रीय सरकार का मत ह ैदक िहा ंऐसा करना आिश्यक या समीचीन ह ैिहाँ िह, जलजखत म ें ििि दकए िाने िाले कारणों से आिेि द्वारा, प्रजतष्ठान के मख्ु य कायिकारी अजधकारी के संबंध म ेंइस जनयमािली के उपबंधों में से दकसी उपबंध म ेंछूि ि े सकेगी। 15. व्याख्या ⎯ यदि इन जनयमों के कायािन्द्ियन संबंधी कोई प्रश्न उठता होते ह,ैं तो उनका जिजनश्चयन िासी बोडि द्वारा दकया िाएगा। 16. कटठनाई जनराकरण ⎯ कायिपालक पटरषि समय-समय पर ऐसे सामान्द्य या जिजिष्ट जनििे िारी कर सकती ह ैिो इन जनयमों के दकसी भी उपबंध के कायिकरण में कटठनाई जनराकरण के जलए आिश्यक हो। [फा. सं. डीएसिी/एएनआरएफ/िेड-02/2023] अजखलेि गुप्ता, िटरष्ठ सलाहकार MINISTRY OF SCIENCE AND TECHNOLOGY (Department of Science and Technology) NOTIFICATION New Delhi, the 2nd February, 2024 G.S.R. 86(E).—The following draft rules which the Central Government proposes to make in exercise of the powers conferred by clause (c) of sub-section (2) of Section 23 of the Anusandhan National Research Foundation Act, 2023 (25 of 2023), are hereby published for the information of all persons likely to be affected thereby, and notice is hereby given that the said notification will be taken into consideration on or after the expiry of a period of thirty (30) days from the date of publication of the draft in the official Gazette; Objections or suggestions, if any, may be addressed to the Senior Adviser, Department of Science and Technology, Government of India, Technology Bhawan, New Delhi – 110016 or by e-mail at akhilesh.g@nic.in and praveen@nic.in;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] The objections and suggestions, which may be received from any person with respect to the said draft rules before the expiry of the period so specified, will be considered by the Central Government. DRAFT RULES 1. Short title and commencement. ⎯ (1) These rules may be called the Anusandhan National Research Foundation (qualifications, experience, salary, allowances, and other terms and conditions of service of Chief Executive Officer) Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions. ⎯ (1) In these rules, unless the context otherwise requires, ⎯ (a) ‘Act’ means the Anusandhan National Research Foundation Act, 2023 (25 of 2023); (b) “President” means a president of the Governing Board referred to in clause (a) of sub-section (2) of section 5 of the Act; (2) Words and expressions used and not defined in these rules but defined in the Act shall have the same meanings as assigned to them in the Act. 3. Procedure for selection of Chief Executive Officer. ⎯ (1) The President shall select and appoint the Chief Executive Officer based on the qualifications set forth under these rules. (2) The President may, if he considers necessary, constitute a Search-cum-Selection Committee and make a reference to such Committee for recommendation of a panel of names for appointment of the Chief Executive Officer. (3) The Search-cum-Selection Committee shall be chaired by an eminent person as nominated by the President, and shall comprise of the following Members, namely : ⎯ (a) Principal Scientific Advisor to the Government of India; (b) Secretary to the Government of India in the Department of Science and Technology; (c) Secretary to the Government of India in the Department of Higher Education; and (d) A Member of the Governing Board from business organisation or industry as nominated by the President. (4) The Search-cum-Selection Committee shall devise its own procedure for selecting the persons for inclusion in the panel of names to be recommended as the Chief Executive Officer. (5) The Search-cum-Selection Committee shall make its recommendations for inclusion in the panel of names to be recommended as the Chief Executive Officer, to the President within a period not exceeding sixty days, from the date of reference made under sub-rule (2). 4. Qualifications and Experience of Chief Executive Officer. ⎯ (1) A person being considered for appointment as Chief Executive Officer shall possess ⎯ (a) a masters’ degree in science, or a bachelor’s degree in engineering or medicine, or a masters’ degree in management, with proven track record of research, or innovation, or technology development; and (b) at least twenty years of experience as faculty or scientist in recognised national or international university, or research institution, or research laboratory of the Government or a company or at a senior managerial level in a company, including five years of experience in managing research and development programmes or projects. (2) A person considered for appointment under sub-rule (1) shall not exceed sixty five years of age. 5. Term of office of Chief Executive Officer. ⎯ The Chief Executive Officer of the Foundation shall hold office for a period of three years from the date of appointment, or such other period as determined by the President, and shall be eligible for reappointment: Provided that no person above the age of seventy years shall occupy the office of the Chief Executive Officer, unless otherwise determined by the President. 6. Conditions of Service of Chief Executive Officer. ⎯ The Chief Executive Officer shall be paid a salary and allowances of such amount, as may be determined by the President, and shall also be eligible for benefits under rules 9 and 10. 7. Leave. ⎯ The Chief Executive Officer shall be entitled to earned leave for every year of service as applicable to employees of the Central Government and the payment of salary during leave shall be governed by rule 40 of the[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 Central Civil Services (Leave) Rules, 1972, as amended from time to time. 8. Functions of Chief Executive Officer. ⎯ The Chief Executive Officer shall be responsible for the efficient administration of the Foundation, and shall have the powers of general superintendence, direction and control in respect of all matters of the Foundation. 9. Allotment of Central Government Residential Accommodation. ⎯ (1) The Chief Executive Officer shall be eligible for allotment of Central Government Residential Accommodation in the general pool on the same terms as are admissible to Central Government servants. (2) In the event, the Chief Executive Officer of the Foundation who is not allotted accommodation under sub- rule (1), he shall be eligible for House Rent Allowance as determined by the Governing Board. 10. Entitlement to Central Government Health Scheme. ⎯ The Chief Executive Officer of the Foundation shall be entitled to the benefits of the Central Government Health Scheme on terms laid down by the Central Government of India in this behalf. 11. Traveling and daily allowances. ⎯ The Chief Executive Officer, while on tour within India or on transfer, including the journey undertaken to join the Foundation or on the completion of their tenure with the Foundation to proceed to their home town, shall be entitled to the travelling allowance, daily allowance transportation of personal effects and other similar matters at the rate applicable to a Secretary to the Government of India. 12. Official visits abroad. ⎯ Official visits abroad by the Chief Executive Officer, shall be undertaken with approval of the Secretary, Department of Science and Technology, and shall be regulated as per the guidelines or instructions issued by the Central Government from time to time. 13. Matters with respect to which no provision has been made. ⎯ Matters relating to the terms and conditions of service of the Chief Executive Officer of the Foundation, with respect to which no express provision has been made in these rules, shall be referred by the Executive Council to the Central Government for its decision. 14. Power to relax. ⎯ Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing, relax any of the provisions of these rules with respect to the Chief Executive Officer of the Foundation. 15. Interpretation. ⎯ If any queries relating to the implementation of these rules arise, they shall be decided by the Governing Board. 16. Removal of difficulties. ⎯ The Executive Council may from time to time issue such general or specific directions as may be necessary to remove difficulties in the operation of any of the provisions of these rules.
