(1) इन जनयमों को मसौिा माल के भौगोजलक उपििधन (रजिस्ट्रीकरण और संरक्षण) (संिोधन) जनयम, 2025 कहा िाएगा। 5348 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) य ेजनयम आजधकाररक रािपत्र म ें इनके प्रकािन की तारीख स े प्रभावी होंगे। 2. मूल जनयम म,ें पहली अनुसूची की ताजलका को जनम्नजलजखत ताजलका से प्रजतस्ट्थाजपत दकया िाएगा, अथातध ् :— प्रजवजष्ट की सख्ं या दकस मि हते ु िये होगा राजि रुपए म ें सबं जं धत प्रपत्र सख्ं या (1) (2) (3) (4) एक श्रेणी में िाजमल वस्ट्तुओं के जलए भौगोजलक उपििधन के िीआई-1 1क. पंिीकरण हते ु आवेिन करन े पर [धारा 11(1); जनयम 1000 23(2)]। दकसी कन्वेंिन ििे स े एक श्रणे ी म ें िाजमल वस्ट्तुओं के जलए 1ख. भौगोजलक उपििधन के पंिीकरण हते ु आवेिन करन े पर 1000 िीआई-1 [धारा 11(1), 84(1); जनयम 23(3)। जवजभन्न श्रेजणयों की वस्ट्तुओं के जलए भौगोजलक उपििनध के प्रत्येक श्रेणी के जलए िीआई-1 1ग. पंिीकरण हते ु एक आवेिन करन े पर [धारा 11(3); जनयम 1000 23(5)]। दकसी कन्वेंिन ििे की जवजभन्न श्रेजणयों की वस्ट्तुओं के जलए प्रत्येक श्रेणी के जलए िीआई -1 1घ. भौगोजलक उपििनध के पंिीकरण हते ु एक आवेिन करन े पर 1000 [धारा 11(3), 84(1); जनयम 23(4)]। धारा 14(1) के तहत भौगोजलक उपििधन के पंिीकरण के प्रत्येक श्रेणी के जलए 2क. जवरोध या प्राजधकृत उपयोगकता ध के जवरोध संबंधी नोरिस िीआई -2 1000 िेने पर [धारा 17(3)(ङ)]। जवरोध संबंधी प्रत्येक आवेिन के जलए धारा 14(2) या 17(3)(ङ) के तहत जवरोध के नोरिस के उत्तर म ें और प्रत्येक 2ख. भौगोजलक उपििनध के संबंध म ें धारा 27 के तहत आवेिन के 1000 िीआई -2 उत्तर म ें या धारा 29 के तहत जवरोध के नोरिस के उत्तर म ें िवाबी विव्य पर जवरोध का नोरिस फाइल करन ेके जलए समयावजध बढाने हते ु 2ग. आवेिन करने पर [धारा 14(1), 17(3)(ङ), 29(2); जनयम 300 िीआई -2 41(5)]। धारा 17 के तहत पंिीकृत भौगोजलक उपििधन के प्राजधकृत 3क. 10 िीआई -3] उपयोगकताध के पंिीकरण के जलए आवेिन पर जनयम 56(1) प्राजधकृत उपयोगकताध के पंिीकरण के नवीकरण के जलए 3ख. [धारा 18 की उप-धारा (2) और जनयम 60 का उप-जनयम 10 िीआई -3] (1)] अंजतम पंिीकरण के समाप्त होने पर भौगोजलक उपििधन के 4क. पंिीकरण के धारा 18(1) के तहत नवीकरण के जलए [जनयम 500 िीआई -4 60(1)]। भौगोजलक उपििनध या रजिस्ट्िर स े हिाए गए प्राजधकृत 1000 रुपए तथा 4ख. उपयोगकताध की बहाली के जलए धारा 18(5) के तहत नवीकरण के जलए िीआई -4 आवेिन पर [जनयम 63]। लाग ू िल्ु क धारा 18(4) के परन्तुक के तहत नवीकरण के जलए आवेिन 4ग. 1000 िीआई -4 पर। 5क. भौगोजलक उपििनध रजिस्ट्िर या प्राजधकृत उपयोगकता ध द्वारा िीआई आवेिन के िीआई -5[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 भारत म ें व्यवसाय करन े के मुख्य स्ट्थान या जनवास स्ट्थान के मामल े म ें300 पत े या गृह ििे के पत े म ें पररवतधन के अनुरोध पर [धारा 28; जनयम 69]। प्राजधकृत उपयोगकताध आविे न के मामल े म ें30 भौगोजलक उपििनध के स्ट्वामी के नाम या जववरण म ें 5ख. 300 िीआई -5 पररवतधन को रजिस्ट्िर म ेंििध करने के अनुरोध पर। िीआई आवेिन के दकसी भौगोजलक उपििधन के पंिीकृत स्ट्वामी या प्राजधकृत मामल े म ें300 5ग. उपयोगकताध के नाम, पते या जववरण म ें दकसी त्रुरि म ें सुधार प्राजधकृत िीआई -5 के अनरु ोध पर [धारा 28 (क)] उपयोगकताध आविे न के मामल े म ें30 दकसी प्राजधकृत उपयोगकता ध को हिाने के जलए भाग ख म ें 5घ. रजिस्ट्िर म ें सुधार के जलए आवेिन पर [धारा 27; जनयम 1000 िीआई -5 65]। धारा 15 के परन्तुक के तहत दकसी श्रेणी म ें वस्ट्तओंु के वगीकरण पर या जवजभन्न श्रेजणयों म ें दकसी भौगोजलक 5ङ. 1000 िीआई -5 उपििधन के पंिीकरण के जलए दकए गए आवेिन के वगीकरण पर, जनयम 23(7)। 5च. एक श्रेणी के संबंध म ेंजनयम 22 के तहत पता लगान े के जलए 500 िीआई -5 रजिस्ट्िर म ें सुधार या भौगोजलक उपििनध को हिाने या रजिस्ट्िर म ें ििध जनयम 32(1) के तहत मामले के जववरण या 6क. 1000 िीआई -6 रजिस्ट्िर से प्राजधकृत उपयोगकता ध को हिाने या बिलने के जलए धारा 27 के तहत आवेिन पर [जनयम 65]। रजिस्ट्िर में सुधार या रजिस्ट्िर स े दकसी भौगोजलक उपििधन या प्राजधकृत उपयोगकता ध को हिाने स े संबंजधत कायधवाही म ें 6ख. 500 िीआई -6 हस्ट्तक्षेप करने की अनुमजत के जलए आवेिन पर [जनयम 67 और 80 (4)]। िीआई आवेिन के रजिस्ट्रार के प्रमाण-पत्र के अनरु ोध पर [धारा 69 या 78(1) मामले में 300 7क. िीआई -7 के तहत प्रमाण-पत्र को छोड़कर; जनयम 96]। प्राजधकृत उपयोगकताध आवेिन के मामले म ें150 मामले के जववरण के समथधन म ें िपथ पत्र या अजधजनयम या 7ख. िून्य िीआई -7 जनयमों के तहत अपेजक्षत अन्य िस्ट्तावेि। अपीलीय बोडध की वैधता प्रमाण-पत्र के नोि को रजिस्ट्िर म ें 7ग. 200 िीआई -7 ििध करन े और जवज्ञापन िेन े के अनुरोध पर [जनयम 99]। 7घ. रजिस्ट्रार के जनणधय की समीक्षा के जलए आवेिन पर। 500 िीआई -7 भौगोजलक उपििधन के जवज्ञापन के जववरण के जलए रजिस्ट्रार 7ङ. 100 िीआई -7 स े अनरु ोध करने पर।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] िीआई आवेिन के मामले में 200 प्रमाण-पत्र की िसू री प्रजत या अजतररि प्रजत के जलए 7च. प्राजधकृत िीआई -7 रजिस्ट्रार से अनरु ोध करने पर। उपयोगकताध आवेिन के मामले म ें40 भौगोजलक उपििधन एिेंि के पंिीकरण के जलए आवेिन 8क. 1000 िीआई -8 [जनयम 107]। 8ख. भौगोजलक उपििधन एिेंि के रूप म ें प्रमाण-पत्र िारी करन े 1000 िीआई -8 के अनरु ोध पर[ जनयम 109]। जनयम 110 के तहत भौगोजलक उपििधन एिेंि के रजिस्ट्िर म ें दकसी व्यजि का नाम िारी रखने के जलए। - प्रत्येक वर् ध के जलए (पहले वर्ध को छोड़कर) प्रत्येक वर् ध की 1 अप्रलै को भुगतान दकया िाएगा। 8ग. 1000 िीआई -8 - पहले वर्ध के जलए, 1 अप्रलै स े 30 जसतंबर के बीच दकसी भी समय पंिीकृत व्यजि के मामल े म,ें पंिीकरण िुल्क सजहत भुगतान दकया िाएगा। नोि: इस प्रयोिन के जलए वर्ध 1 अप्रलै स े िरूु होगा और अगले वर् ध के 31 माच ध को समाप्त होगा। 1000 के साथ जनयम 113 के तहत भौगोजलक उपििनध रजिस्ट्िर म ें दकसी प्रजवजष्ट संख्या 8ग के 8घ. व्यजि का नाम पुनःडालन े के जलए आवेिन पर। िीआई -8 तहत िारी रखन े के जलए िल्ु क कुछेक वस्ट्तओंु को अजतररि संरक्षण प्रिान करन े के जलए 9क. 12000 िीआई -9 रजिस्ट्रार को आवेिन पर [धारा 22(2); जनयम 77]। दकसी पंिीकृत भौगोजलक उपििधन को िाजमल करन े या पररवर्तधत करन े की अनुमजत के जलए आवेिन पर[ ऐस े 9ख. मामलों को छोड़कर, िहां आवेिन दकसी व्यजि या दकसी 300 िीआई -9 लोक प्राजधकरण द्वारा या दकसी सांजवजधक आवश्यकता के पररणामस्ट्वरूप दकया गया हो, [धारा 29]। समयावजध बढाने के जलए आवेिन पर, जिसके जलए 9ग. अजधजनयम म ें स्ट्पष्ट रूप स े प्रावधान नहीं दकए गए ह ैं या 300 िीआई -9 जनयमों म ें जवजनर्िधष्ट नहीं दकया गया ह ै[जनयम 83]। रजिस्ट्िर में दकसी प्रजवजष्ट को रद्द करने या वस्ट्तओंु को 10क. रजिस्ट्िर स े हिान े के जलए आवेिन पर। [धारा 28 (ग) या 300 िीआई -10 (घ)] 10ख. अजधजनयम के तहत दकसी मामले या कायधवाही म ें एिेंि का िून्य िीआई -10[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 प्राजधकार संबंधी प्रपत्र [धारा 76; Objections or suggestions, if any, may be addressed to the Secretary, Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry, Government of India, Vanijya Bhawan, New Delhi- 110011 or by e-mail at “ipr4-dipp@nic.in”; The objections and suggestions, which may be received from any person with respect to the said draft rules before the expiry of the period so specified, will be considered by the Central Government.
