प्रारूप जनयम
1. संजिि नाम और प्रारंभ- (1) इन जनयमों को अतं रदिे ीय गैर-पररवहन वाहन जनयम, 2022 कहा जा सकता ह।ै
(2) ये जनयम राजपत्र म ेंउनके अंजतम प्रकािन की तारीख से लाग ूहोंगे।
2. पररभाषाए-ं (1) इन जनयमों म,ें जब तक दक संदभग से अन्यथा अपेजित न हो,-
क. "अजधजनयम" का आिय मोटर वाहन अजधजनयम, 1988 (1988 का 59) ह;ै

ख. "ड्राइववग लाइसेंस" का आिय मूल दिे के सिम प्राजधकारी द्वारा जारी दकया गया लाइसेंस है, जो उसमें
जनर्ददष्ट व्यजि को दकसी जनर्ददष्ट श्रेणी या जनरूपण के मोटर वाहन को चलाने के जलए अजधकृत करता है;
ग. "बीमा पॉजलसी" का आिय बीमा की पॉजलसी ह ै जो भारतीय मोटर वाहन अजधजनयम, 1988 के अध्याय XI
की आवश्यकताओं के अनुपालन में जोजखमों को कवर करती ह;ै
घ. "अंतरागष्ट्रीय ड्राइववग परजमट" का आिय ह ै अंतरागष्ट्रीय सड़क यातायात सम्मेलन, 1949 और/या उसकी पुजष्ट
करने वाले और भारत और अन्य देिों, जो 19 जसतंबर, 1949 को जजनेवा में हस्ट्तािररत सड़क यातायात पर
कन्वेंिन के पिकार ह,ैं द्वारा हस्ट्तािररत दकसी भी बाद के कन्वेंिन के तहत जारी दकया गया अंतरागष्ट्रीय
ड्राइववग परजमट से ह;ै
ङ. "गरै -पररवहन वाहन" का आिय एक मोटर वाहन स े ह ै जो पररवहन वाहन नहीं ह ै(एक पररवहन वाहन म ें एक
सावगजजनक सेवा वाहन, एक माल गाड़ी, एक िैिजणक संस्ट्थान बस या एक जनजी सेवा वाहन िाजमल ह)ै ;
च. "पीयूसी प्रमाणपत्र" का आिय ह ै मोटर वाहन की उत्सजगन सीमा की जांच करने के जलए मलू देि के िासन के
अनुसार उपयिु अजधकाररयों द्वारा जारी प्रदषू ण जनयंत्रण प्रमाणपत्र;
छ. "पंजीकरण प्रमाण पत्र" जब मोटर वाहन के संदभग म ें उपयोग दकया जाता है, तो इसका आिय मलू देि के
िासन के अनुसार जारी दकया गया पंजीकरण प्रमाण पत्र ह;ै
ज. "पंजीकरण जचह्न" का आिय ह ै एक पंजीकृत संख्या, या एक पंजीकृत अिर और संख्या, या पंजीकृत अिर
और संख्या या मोटर वाहन को सौंपा गयी संख्या
3. वाहन - भारत में प्रवेि करते समय दसू रे देि में पंजीकृत एक गैर-पररवहन वाहन का जनमागण और रखरखाव इस
तरह दकया जाएगा दक वह इसे चलाने वाल ेव्यजि के प्रभावी जनयंत्रण म ेंहर समय बना रह।े
4. आवश्यक दस्ट्तावजे - (1) मेजबान देि में ठहरने की अवजध के दौरान अतं र-देिीय गैर-पररवहन वाहन जनयमों के
तहत चलन े वाले वाहन (वाहनों) म ेंजनम्नजलजखत दस्ट्तावेज ले जाए जाएंगे, अथागत्: -
(i) एक वैध पंजीकरण प्रमाणपत्र;
(ii) वैध ड्राइववग लाइसेंस या अतं रराष्ट्रीय ड्राइववग परजमट, जो भी लागू हो;
(iii) एक वैध बीमा पॉजलसी;
(iv) एक वैध प्रदषू ण जनयंत्रण प्रमाणपत्र (यदद मूल देि में लाग ूहो);
(2) उपरोि खडं 1 में जनर्ददष्ट सभी दस्ट्तावेज, एक यात्री वाहन के जनरीिण के जलए भारत म ें प्रवेि करत े समय और
ठहरन े की पूरी अवजध के दौरान मोटर वाहन चलान े वाल े व्यजि के कब्ज े में होंग े और सबं ंजधत सिम प्राजधकारी
द्वारा जनरीिण के जलए हमिे ा उपलब्ध रहगें े।
(3) यदद उपरोि खंड 1 में संदर्भभत दस्ट्तावेज अंग्रेजी के अलावा दकसी अन्य भाषा में हैं, तो एक अजधकृत अग्रं ेजी
अनुवाद, जारीकताग प्राजधकारी द्वारा जवजधवत प्रमाजणत, मूल दस्ट्तावेजों के साथ ले जाया जाएगा।
(4) पंजीकरण जचह्न, अग्रं ेजी के अलावा दकसी अन्य भाषा म ें प्रदर्भित होन े की जस्ट्थजत में, वाहन के आगे और पीछे
अंग्रेजी म ेंप्रदर्भित दकया जाएगा।
5. प्रजतबधं -भारत के अलावा दकसी अन्य देि म ें पंजीकृत मोटर वाहनों को भारत के िेत्र के भीतर स्ट्थानीय याजत्रयों
और सामानों के पररवहन की अनुमजत नहीं होगी।
6. यातायात जनयमों का अनपु ालन - भारत के अलावा दकसी अन्य देि म ें पंजीकृत मोटर वाहनों को भारत के मोटर
वाहन अजधजनयम, 1988 की धारा 118 के तहत बनाए गए जनयमों और जवजनयमों का पालन करना आवश्यक
होगा।
7. जनयमों का जवचलन, यदद कोई हो - अतं र-देिीय गैर-पररवहन वाहन जनयमों और भारत और अन्य देिों के बीच
जद्वपिीय समझौतों के बीच कोई जवरोध होन े की जस्ट्थजत में, बाद वाला इन जनयमों को प्रबल या अजधक्रजमत करेगा।

NOTIFICATION
New Delhi, the 16th March, 2022
G.S.R. 211(E).—The following draft of certain rules proposed to be made in exercise of the
powers conferred by clause (b) and (c) of sub-section (1) of section 139 of the Motor Vehicles Act, 1988
(59 of 1988) is hereby published as required by sub-section (1) of section 212 of the said Act for
information of all persons likely to be affected thereby and notice is hereby given that the said draft rules
shall be taken into consideration after the expiry of a period of 30 days from the date on which the copies of
this notification, as published in the Gazette of India, are made available to the public.
Objections and suggestions to these draft rules, if any, may be sent to the Joint Secretary
(MVL, Transport & Toll), Ministry of Road Transport and Highways, Transport Bhawan, Parliament
Street, New Delhi-110 001 or on the email: comments-morth@gov.in;
Draft Rules
1. Short title and commencement. – (1) These rules may be called as the Inter-Country Non-Transport
Vehicle Rules, 2022.
(2) These rules shall come into force on the date of their final publication in the Official Gazette.
2. Definitions.– (1) In these rules, unless the context otherwise requires,–
a. ―Act‖ means the Motor Vehicles Act, 1988 (59 of 1988);
b. ―Driving Licence‖ means the licence issued by a competent authority of the origin country,
authorising the person specified therein to drive a motor vehicle of any specified class or
description;
c. ―Insurance Policy‖ means a policy of insurance which covers risks in compliance with the
requirements of Chapter XI of the Indian Motor Vehicles Act, 1988;
d. "International Driving Permit" means the international driving permit issued under the International
Convention of Road Traffic, 1949 and/or any subsequent Convention ratifying the same and signed
by India and other countries who are parties to the Convention on Road Traffic signed at Geneva
on 19th day of September, 1949;
e. ―Non-transport vehicle‖ means a motor vehicle which is not a transport vehicle (a transport vehicle
includes a public service vehicle, a goods carriage, an educational institution bus or a private
service vehicle);
f. "PUC certificate" means Pollution Under Control Certificate issued by appropriate authorities as
per the regime of the origin country to check a motor vehicle’s emission limits;
g. ―Registration certificate‖ when used with reference to a motor vehicle means the registration
certificate issued as per the regime of the origin country;
h. ―Registration mark‖ means a registered number, or a registered letter and number, or registered
letters and number or numbers assigned to a motor vehicle
3. Vehicles -A non-transport vehicle registered in the other country, when entering India, shall be so
constructed and maintained as to be at all times under the effective control of the person driving it.
4. Documents required —(1) The following documents shall be carried in the vehicle(s) operating under
Inter-Country Non-Transport Vehicle Rules during the duration of stay in the host country, namely:–
(i) A valid registration certificate;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(ii) A valid driving license or international driving permit, whichever is applicable;
(iii) A valid insurance policy;
(iv) A valid pollution under control certificate (if applicable in the origin country);
(2) All the documents referred to in clause 1 above, shall be in the possession of the person driving the
motor vehicle at the time of entering India and during the entire period of stay and shall always be available
for inspection by the respective competent authority to inspect a passenger vehicle.
(3) In case the documents referred to in clause 1 above are in a language other than English, then an
authorized English translation, duly authenticated by the issuing authority, shall be carried along with the
original documents.
(4) Registration mark, in case displayed in any language other than English, shall be exhibited in English at
the front and back of the vehicle.
5. Restrictions-Motor vehicles registered in any country other than India shall not be permitted to transport
local passengers and goods within the territory of India.
6. Compliance with Traffic rules –Motor vehicles registered in any country other than India shall be
required to comply with rules and regulations made under Section 118 of Motor Vehicles Act, 1988 of
India.
7. Deviation of rules, if any -In case there is any conflict between the Inter-Country Non-Transport
Vehicle rules and the bilateral agreements between India and other country(ies), the latter shall prevail or
supersede these rules.
