र्ाजचका संख्र्ा 198/2014: (वनिजि फाउंडेिन बनाम भारत संघ) म,ें पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर्,
भारत सरकार को जनिेि दिर्ा दक वह वन्र्िीवों और उसके गजलर्ारों सजहत संपणू ा पाररजस्ट्थजतकी तंत्र की सुरक्षा और

डोडामाग ा ईएसए की घोिणा के जलए पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को अपना आजखरी प्रस्ट्ताव प्रस्ट्ततु
दकर्ा ह।ै
अब इसजलए, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के
खंड (v) और (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म
5 के उपजनर्म (3) के साथ परित, केन्द्रीर् सरकार, महाराष्ट्र राज्र् के ससंधुिगु ा जिले म ें आने वाले 25 गांवों में फैले 212.59
वगा दकलोमीटर के जचजननत क्षत्रे को सावंतवाडी-डोडामाग ाईएसए के रूप में अजधसूजचत करती ह।ै
1. सावतं वाडी-डोडामाग ा पाररजस्ट्थजतक सवं िे निील क्षत्रे का जवस्ट्तार और सीमा जववरण.- सावंतवाडी-डोडामाग ा
ईएसए म ें 25 गांव िाजमल ह,ैं िो ससंधुिगु ा जिल े के सावतं वाडी और डोडामाग ा तालुका में 212.59 वग ा
दकलोमीटर के क्षेत्र में फैला ह।ैं
क. पाररजस्ट्थजतकी संवेिनिील क्षेत्र का मानजचत्र अनलु ग्नक क के रूप में सलं ग्न ह;ै
ख. पाररजस्ट्थजतकी संवेिनिील क्षेत्र में आने वाल े गांवों की सूची संबंजधत तालुकाओं के साथ अनलु ग्नक ख के
रूप म ेंसंलग्न ह।ै
ग. पाररजस्ट्थजतकी संवेिनिील क्षेत्र की बाहरी सीमा पर प्रमुख सबंिओंु के भू-जनििे ांक अनलु ग्नक ग के रूप म ें
संलग्न ह;ैं
2. सावतं वाडी-डोडामग ा पाररजस्ट्थजतक रूप स े सवं िे निील क्षत्रे म ें पररर्ोिनाएं और गजतजवजधर्ा ं प्रजतबजं धत हैं. -
पाररजस्ट्थजतक संवेिनिील क्षेत्र में जनम्नजलजखत श्रेजणर्ों की पररर्ोिनाएं और दिर्ाकलाप प्रजतजसद्ध होंगे:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3
क- खनन.- पाररजस्ट्थजतकी संवेिनिील क्षेत्र में खनन, उत्खनन, जपसाई इकाइर्ों की स्ट्थापना पणू ातर्ा प्रजतजसद्ध होगा
तथा अंजतम अजधसूचना िारी होने की जतजथ स े पांच वि ा के भीतर र्ा मौिूिा खनन पट्टे की समाजि पर, िो भी
पहले हो, सभी मौिूिा खिानों को चरणबद्ध तरीके से समाि कर दिर्ा िाएगा।
बिते दक वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेल ूआवश्र्कताओं की पूर्त ा के जलए, मकानों के जनमााण र्ा
मरम्मत तथा पारंपररक सडक जनमााण एवं रखरखाव कार्ों के जलए राज्र् स्ट्तरीर् मॉनीटरी सजमजत के
अनुमोिन से जचजननत क्षेत्रों में जमट्टी खोिने की अनुज्ञा िी िाएगी।
बिते दक, ऐसी सभी दिर्ाकलाप टी.एन. गोिावमान जथरुमुलपाि बनाम र्ूओआई के मामले म ें
डब्ल्र्.ूपी.(सी) संख्र्ा 202/1995 और तारीख 4 अगस्ट्त, 2006 के मामल े म ें िमिः 26 अप्रैल 2023
और 28 अप्रलै 2023 के माननीर् सवोच्च न्र्ार्ालर् के आिेि के अनुसार की िाएगं ी; और गोवा
फाउंडेिन बनाम र्ओू आई के मामले में डब्ल्र्ू.पी.(सी) संख्र्ा 435/2012 के मामले में िमिः 21 अप्रलै ,
2014 के आििे के अनुसार की िाएंगी, और समर्-समर् पर संिोजधत केंद्रीर् प्रििू ण जनर्ंत्रण बोडा और
पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा इस जविर् पर िारी मागाििाक जसद्धांतों के अनुसार
की िाएंगी।
ख- ताप जवद्यतु सर्ं त्रं .- पाररजस्ट्थजतकी संवेिनिील क्षेत्र म ें दकसी भी नव ताप जवद्युत पररर्ोिना तथा मौिूिा संर्ंत्रों
के जवस्ट्तार की अनुज्ञा नहीं िी िाएगी।
ग- उद्योग.- केंद्रीर् प्रििू ण जनर्ंत्रण बोड ा र्ा राज्र् प्रििू ण जनर्त्रं ण बोड ा द्वारा जवजनर्िाष्ट सभी नए ‘लाल’ श्रणे ी के
उद्योगों और ऐसे मौिूिा उद्योगों के जवस्ट्तार को प्रजतजसद्ध दकर्ा िाएगा और उद्योगों की ‘लाल’ श्रणे ी की सूची
केंद्रीर् प्रििू ण जनर्ंत्रण बोडा द्वारा िारी और समर्-समर् पर र्था संिोजधत मागाििाक जसद्धांतों द्वारा उद्योगों के
वगीकरण के अनुसार जवजनर्िाष्ट दकर्ा िाएगा। बित े दक लाल श्रणे ी के उद्योगों, बार्ोमेजडकल अपजिष्ट प्रबंधन
जनर्म, 2016 के तहत र्था पररभाजित स्ट् वार्त िेखभाल प्रजतष्ि ानों सजहत, पर्ाावरणीर् रूप से संवेिनिील क्षेत्र
प्रर्ोज्र् जनर्मों एवं जवजनर्मों के तहत उनके जवस्ट् तार के जबना, के रूप म ेंबने रहगें े।
घ- भवन, जनमाणा , नगर और क्षत्रे जवकास पररर्ोिनाएं. - 20,000 वग ा मीटर और उससे अजधक जनर्मात क्षेत्र वाली
सभी नई और जवस्ट्ताररत इमारतें और जनमााण पररर्ोिनाएं तथा 50 हक्े टेर्र और उससे अजधक क्षेत्र वाली सभी
नई और जवस्ट्ताररत नगर और क्षेत्र जवकास पररर्ोिनाएं र्ा 1,50,000 वग ा मीटर और उससे अजधक जनर्मात क्षत्रे
वाली पररर्ोिनाएं प्रजतजसद्ध रहगें ी, बिते दक मौिूिा जवजधर्ों और जवजनर्मों के अनुसार पाररजस्ट्थजतकी
संवेिनिील क्षेत्र में मौिूिा आवासीर् घरों की मरम्मत र्ा जवस्ट्तार र्ा नवीनीकरण पर कोई प्रजतबंध नहीं होगा।
3. पाररजस्ट्थजतकी सवं िे निील क्षत्रे म ें पररर्ोिनाओं और दिर्ाकलापों की जनम्नजलजखत श्रजे णर्ों को जवजनर्जमत दकर्ा
िाएगा:-
(क) िलजवद्युत पररर्ोिनाएँ- पम्प स्ट्टोरेि िलजवद्युत पररर्ोिनाओं सजहत नई िलजवद्युत पररर्ोिनाओं को
पर्ाावरण प्रभाव आकलन अजधसूचना, संख्र्ांक का.आ. 1533 (अ), तारीख 14 जसतंबर, 2006 के अनुसार
जनम्नजलजखत ितों के अधीन अनज्ञु ा िी िाएगी, अथाात:्-
(i) कम से कम तीस प्रजतित नदिर्ों का पाररजस्ट्थजतक प्रवाह िबु ला मौसम म ें भी जनबााध बना रह,े
िब तक दक एक व्यापक अध्र्र्न प्रत्र्ेक पररर्ोिना के जलए अलग-अलग आधार रेखाएं
स्ट्थाजपत नहीं कर िेता;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(ii) एक संचर्ी अध्र्र्न िो प्रत्र्के पररर्ोिना के उन नदिर्ों के प्रवाह स्ट्वरूप पर जिन पर
पररर्ोिना का जनमााण दकर्ा िा रहा ह ै और वन, प्राकृजतक आद्राभूजम और िैव जवजवधता के
दकसी भी नुकसान पर प्रभाव आकलन करता ह;ै तथा
(iii) निी के एक जहस्ट्से म ें एक पररर्ोिना स े िसू री पररर्ोिना के बीच न्र्नू तम िरू ी तीन
दकलोमीटर रखी िाएगी तथा दकसी भी समर् निी िलािर् का पचास प्रजतित से अजधक
जहस्ट्सा प्रभाजवत नहीं होगा।
(ख) - केन्द्रीर् प्रििू ण जनर्ंत्रण बोड ा र्ा राज्र् प्रििू ण जनर्ंत्रण बोडा द्वारा समर्-समर् पर संिोजधत “नारंगी/हरा
और सफेि” श्रणे ी के उद्योगों को पर्ाावरण जवजनर्मों के सख्त अनुपालन के साथ अनुज्ञा िी िाएगी, लेदकन
उन उद्योगों को बढावा िेने के जलए सभी प्रर्ास दकए िाएंगे जिनका पर्ाावरण पर कम प्रभाव पडता ह ै और
िो “हरा” र्ा “सफेि” श्रेणी के उद्योगों में आते ह ैं िैसा भी मामला हो।
(ग) पर्ाावरण प्रभाव आकलन अजधसूचना संख्र्ा का.आ.1533 (अ), तारीख 14 जसतम्बर, 2006, जिसे
तत्कालीन पर्ाावरण एवं वन मत्रं ालर् द्वारा प्रकाजित दकर्ा गर्ा था, की अनुसूची म ें िाजमल दिर्ाकलापों के
मामले म,ें िो पाररजस्ट्थजतकी संवेिनिील क्षेत्र में आती हैं, जसवार् उन पररर्ोिनाओं और दिर्ाकलापों के,
जिन्ह ें उप-पैरा (1) के अधीन जवजिष्ट रूप से प्रजतजसद्ध दकर्ा गर्ा ह,ै उि अजधसूचना के उपबंधों के अधीन
मंत्रालर् द्वारा पूव ा पर्ाावरणीर् अनापजत्त पर जवचार करने स े पवू ा संचर्ी प्रभावों और जवकास आवश्र्कताओं
की संवीक्षा की िाएगी और उनका मूल्र्ांकन दकर्ा िाएगा।
(घ) जविेि रूप स े और प्रासंजगक अजधजनर्मों के उपबंधों पर प्रजतकूल प्रभाव डाल े जबना, पाररजस्ट्थजतकी
संवेिनिील क्षेत्र में गैर-वाजनकी उद्देश्र्ों के जलए वन भूजम के पररवतान के मामलों में, आवेिन चरण स े
अनुमोिन तक पररर्ोिना की सभी िानकारी पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की वेबसाइट
और वन जवभाग, महाराष्ट्र की वेबसाइट पर सावािजनक कार्ाक्षेत्र में रखी िाएगी।
(ङ) अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006
(2007 का 2) के अधीन पवू ा सूजचत सहमजत की आवश्र्कताओं का अनुपालन दकर्ा िाएगा और
पररर्ोिनाओं और दिर्ाकलापों को िुरू करन े के जलए ग्राम सभा की सहमजत अजनवार्ा होगी।
(च) वन भूजम के मामले म ें राज्र् सरकार की पूवा अनुमजत के जबना तथा सरकारी, रािस्ट्व और जनिी भूजम के
मामले में राज्र् सरकार द्वारा जनधााररत प्रदिर्ा के अनुसार संबजं धत जिला कलेक्टर की अनुमजत के जबना वन,
सरकारी, रािस्ट्व र्ा जनिी भूजम पर पेडों की कटाई नहीं की िाएगी।
4. कार्ान्ा वर्न और जनगरानी तत्रं .- (1) पर्ाटन आंचजलक महार्ोिना सजहत वहन क्षमता अध्र्र्न के आधार पर एक
अलग आंचजलक महार्ोिना, इसके घटक के रूप म,ें पाररजस्ट्थजतक संवेिनिील क्षेत्र के जलए तर्ै ार दकर्ा िाएगा
और इस े इस अजधसूचना के उपबंधों के कार्ाान्वर्न और ऐस े क्षत्रे ों के समग्र सतत जवकास के जलए इस अजधसूचना
के प्रकािन की तारीख से िो विा की अवजध के भीतर राज्र् सरकार म ें सक्षम प्राजधकारी द्वारा अनुमोदित दकर्ा
िाएगा।
(2) आंचजलक महार्ोिना म ें खडी पहाडी ढलानों वाल े क्षेत्रों र्ा िोजखम क्षेत्र र्ा उच्च स्ट्तर के कटाव वाले क्षेत्रों को
ििाार्ा िाएगा, िहाँ जनमााण दिर्ाकलापों की अनुज्ञा नहीं होगी। आंचजलक महार्ोिना के अनुमोिन तक
पाररजस्ट्थजतक संवेिनिील क्षेत्र के भीतर ऊपर पैरा 3 म ें जनर्िष्टा जवजनर्जमत दिर्ाकलापों के दकसी भी जवकास को
उसकी मंिूरी के जलए जनगरानी सजमजत को भेिा िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5
(3) इस अजधसूचना के उपबधं ों की जनगरानी और प्रवतान तथा आंचजलक महार्ोिना के कार्ाान्वर्न की
जिम्मेिारी राज्र् स्ट्तरीर् मॉनीटरी सजमजत म ें जनजहत होगी, जिसके अध्र्क्ष जिला कलेक्टर, ससंधुिगु ा होंगे तथा
उप वन संरक्षक, सावंतवाडी वन प्रभाग इसके सिस्ट्र् सजचव होंगे। इस सजमजत का गिन राज्र् सरकार द्वारा इस
अजधसूचना के प्रकािन के एक विा के भीतर दकर्ा िाएगा।
(4) जनगरानी सजमजत में राज्र् प्रििू ण जनर्ंत्रण बोडा, िल ससं ाधन, मृिा संरक्षण, कृजि एव ं मत्स्ट्र् पालन, लोक
स्ट्वास्ट््र्, लोक जनमााण जवभाग, राज्र् सरकार के र्ोिना एवं पर्ाटन जवभागों के प्रजतजनजध उजचत स्ट्तर पर "पिेन"
सिस्ट्र् के रूप में िाजमल होंग।े राज्र् सरकार द्वारा प्रत्र्ेक तीन वि ा के पश्चात ् पाररजस्ट्थजतकी और पर्ाावरण,
वन्र्िीव के क्षेत्र में दकसी प्रजतजित जवश्वजवद्यालर् र्ा संस्ट्थान तथा गरै -सरकारी संगिन स े िो जविेिज्ञों को गैर-
सरकारी सिस्ट्र्ों के रूप म ें नामजनर्िाष्ट दकर्ा िाएगा। जनगरानी सजमजत र्थासंभव बार-बार बैिक करेगी, लेदकन
प्रत्र्ेक छह माह में कम से कम एक बार बैिक होगी।
(5) जनगरानी सजमजत राज्र् सरकार को मौिूिा जवजनर्ामक संस्ट्थाओं और प्रदिर्ाओं को सुिढृ करने के उपार्ों की
जसफाररि करेगी, िहां तक उनका संबंध सावंतवाडी-डोडामागा पाररजस्ट्थजतक संवेिनिील क्षेत्र से ह ै और
वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की
अजधसूचना संख्र्ा का.आ. 1553 (अ), तारीख 14 जसतंबर, 2006 की अनुसूची म ें िाजमल दिर्ाकलापों की
संवीक्षा करेगी और पाररजस्ट्थजतक संवेिनिील क्षेत्र में सजम्मजलत ह,ै जसवार् इसके दक इसमें जवजनर्िाष्ट प्रजतजसद्ध
दिर्ाकलापों को छोडकर, और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरणीर् अनापजत्त के जलए
पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् में केंद्रीर् सरकार र्ा राज्र् पर्ाावरण प्रभाव आकलन प्राजधकरण
को जनर्िाष्ट दकर्ा िाएगा।
(6) जनगरानी सजमजत के सिस्ट्र्-सजचव र्ा संबंजधत कलेक्टर र्ा संबंजधत उप वन संरक्षक इस अजधसूचना के
उपबंधों का उल्लघं न करन े वाले दकसी भी व्यजि के जवरुद्ध पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 19
के तहत जिकार्त िि ाकरन े के जलए सक्षम होंगे।
(7) पाररजस्ट्थजतक संवेिनिील क्षेत्र म ें अनुमत पररर्ोिनाओं और दिर्ाकलापों की मंिूरी के बाि की मॉनीटरी
महाराष्ट्र राज्र् सरकार, राज्र् प्रििू ण जनर्ंत्रण बोड ा द्वारा की िाएगी और पाररजस्ट्थजतक संवेिनिील क्षेत्र में सभी
पररर्ोिनाएं जिन्ह ें पर्ाावरणीर् अनापजत्त र्ा वन अनापजत्त िी गई ह,ै उनकी मॉनीटरी पर्ाावरण, वन और
िलवार्ु पररवतान मंत्रालर् के संबंजधत क्षेत्रीर् कार्ाालर् द्वारा विा में कम स ेकम एक बार की िाएगी।
(8) पाररजस्ट्थजतक संवेिनिील क्षेत्र में सभी पररर्ोिनाएं, जिन्ह ें िल (प्रििू ण जनवारण एवं जनर्ंत्रण) अजधजनर्म,
1974 (1974 का 6) र्ा वार् ु (प्रििू ण जनवारण एवं जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) के अधीन
स्ट्थापना र्ा प्रचालन की अनुज्ञा िी गई ह,ै की मॉनीटरी राज्र् प्रििू ण जनर्ंत्रण बोड ा द्वारा वि ा में कम से कम एक
बार की िाएगी और राज्र् सरकार मॉनीटरी सजमजत की सहार्ता स े सावंतवाडी-डोडामगा पाररजस्ट्थजतक
संवेिनिील क्षेत्र के संबंध म ें जद्ववार्िाक रूप से 'स्ट्वास्ट््र् जस्ट्थजत ररपोटा' तैर्ार करेगी, जिसमें अन्र् बातों के साथ-
साथ इस अजधसूचना के उपबंधों की मॉनीटरी और प्रवतान में उिाए गए किमों का ब्र्ौरा दिर्ा िाएगा और उस े
सावािजनक कार्ाक्षेत्र में उपलब्ध करार्ा िाएगा।
(9) केन्द्रीर् सरकार, मॉनीटरी सजमजत को उसके कार्ों के प्रभावी जनवाहन के जलए जलजखत रूप म ें ऐसे जनिेि ि े

5. उल्लघं न के जलए कारावाई: इस अजधसूचना के उपबंधों के दकसी भी उल्लंघन के मामले में, पर्ाावरण (संरक्षण)
अजधजनर्म, 1986 (1986 का 29) और अन्र् प्रासंजगक जवजधर्ों के उपाबंधों के अधीन कारावाई की िाएगी। जनगरानी
सजमजत के सिस्ट्र्-सजचव र्ा संबंजधत कलेक्टर इस अजधसूचना के उपबंधों का उल्लघं न करन े वाले दकसी भी व्यजि के जवरुद्ध
पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के अधीन जिकार्त ििा करने के जलए सक्षम होंगे।
6. उच्च तम न्र्ार्ालर् के आिेि, आदि: इस अजधसूचना के उपाबंध भारत के माननीर् उच् चतम न्र्ार्ालर् र्ा उच्च
न्र्ार्ालर् र्ा राष्ट्रीर् हररत अजधकरण द्वारा पाररत अंजतम आिेिों, र्दि कोई हो, के अधीन होंगे।
7. अपील: (i) मॉनीटरी सजमजत के दकसी जनणार् र्ा आिेि से व्यजथत कोई भी व्यजि ऐसे जनणार् र्ा आििे के जवरुद्ध भारत
सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् में अपील कर सकेगा।
(ii) इस पैरा के अधीन प्रत्र्ेक अपील ज्ञापन में मामले के त्र्, उस जनणार् र्ा आिेि का जववरण, जिसके जवरुद्ध अपील की
गई ह,ै तथा उस जनणार् र्ा आिेि से व्यजथत होने का कारण तथा वांजछत उपचार भारत सरकार के पर्ाावरण, वन और
िलवार्ु पररवतान मंत्रालर् के सजचव को संबोजधत दकर्ा िाएगा।

NOTIFICATION
New Delhi, the 22nd April 2025
S.O. 1813(E).—The following draft of the notification, which the Central Government
proposes to issue in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv)
of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29
of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for
information of the public likely to be affected thereby; and notice is hereby given that the said
draft notification shall be taken into consideration on or after the expiry of a period of sixty days
from the date on which copies of the Gazette of India containing this notification are made
available to the Public;
Any person interested in making any objections or suggestions on the proposals contained
in the draft notification may forward the same in writing, for consideration of the Central

Draft notification
WHEREAS, considering the ecological importance of the Sawantwadi-Dodamarg area,
the Hon’ble High Court of Bombay, in its Judgment dated 22nd March 2024, in PIL No. 179 of
2012: Awaaz Foundation vs. Union of India and PIL No. 198 of 2014: Vanashakti Foundation vs.
Union of India, directed the Ministry of Environment, Forest and Climate Change, Government of
India to declare Sawantwadi-Dodamarg corridor in Sindhudurg District of Maharashtra as an
Ecologically Sensitive Area (hereinafter referred to as Sawantwadi-Dodamarg ESA) for the
protection and conservation of entire ecosystem, including wildlife and its corridors;
AND WHEREAS, the Government of Maharashtra in compliance to the Judgment dated
22nd March 2024, of the Hon’ble High Court of Bombay in PIL No. 179 of 2012: Awaaz
Foundation vs. Union of India and PIL No. 198 of 2014: Vanashakti Foundation vs. Union of
India, have submitted vide No. S-30/09.14/C.R.259/F-1, dated 11th March, 2025, its final proposal
for declaration of Sawantwadi-Dodamarg ESA to the Ministry of Environment, Forests and
Climate Change.
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses
(v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection)
Act, 1986 (29 of 1986), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules,
1986, the Central Government hereby notifies an identified area of 212.59 square kilometer
spreading across 25 villages falling in Sindhudurg district of Maharashtra State, as the
Sawantwadi-Dodamarg ESA.
1. Extent and boundary description of the Sawantwadi - Dodamarg Ecologically Sensitive
Area.- The Sawantwadi-Dodamarg ESA comprises of 25 villages, encompassing an area of 212.59
square kilometer in Sawantwadi and Dodamarg Talukas of Sindhudurg district.
a) The map of the Ecologically-sensitive Area is appended as Annexure A;
b) The list of villages falling in ESA with respective talukas is appended as Annexure B;
c) The geo-coordinates of prominent points on the outer boundary of the ESA is appended
as Annexure C;
2. Projects and activities prohibited in the Sawantwadi-Dodamarg Ecologically-sensitive
Area.-The following categories of projects and activities shall be prohibited in Eco-sensitive
Area:-
a) Mining.- There shall be a complete ban on mining, quarrying, establishment of crushing
units in the Ecologically Sensitive Area and all existing mines shall be phased out
within five years from the date of issue of the final notification or on the expiry of the
existing mining lease, whichever is earlier.
Provided that digging of earth in areas identified with the approval of the State-level
Monitoring Committee for meeting the domestic needs of bona fide local residents for
the construction or repair of houses and traditional road making and maintenance works

Provided further that, all such activities shall be carried out in accordance with the order
of the Hon’ble Supreme Court dated 26th April 2023; and 28th April 2023 respectively
in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and
dated 4th August, 2006; and 21st April, 2014 respectively in the matter of Goa
Foundation Vs UOI in W.P.(C) No. 435 of 2012, and the guidelines issued on the subject
by the Central Pollution Control Board and Ministry of Environment, Forest and
Climate Change as amended from time to time.
b) Thermal power plants.- No new thermal power projects and expansion of existing
plants shall be allowed in the Ecologically Sensitive Area.
c) Industry.- All new ‘Red’ category of industries as specified by the Central Pollution
Control Board or State Pollution Control Board and the expansion of such existing
industries shall be banned and the list of ‘Red’ category of industries shall be as
specified as per classification of Industries in the guidelines issued by the Central
Pollution Control Board and as amended from time to time. Provided that existing
‘Red’ category of industries including health care establishments as defined under Bio-
Medical Waste Management Rules, 2016 shall continue in Ecologically sensitive Area
without their expansion under the applicable rules and regulations.
d) Building, construction, township and area development projects.- All new and
expansion projects of building and construction with built up area of 20,000 square
meter and above and all new and expansion townships and area development projects
with an area of 50 hectares and above or with built up area of 1,50,000 square meter and
above shall be prohibited. Provided that there shall be no restriction on repair or
extension or renovation of existing residential houses in the ESA as per prevailing laws
and regulations.
3. The following categories of projects and activities shall be regulated in the ESA as given
below:-
(a) Hydropower projects- New Hydropower projects including Pumped Storage Hydro projects
shall be allowed as per the Environment Impact Assessment notification, published vide number
S.O. 1533 (E), dated the 14th September, 2006, subject to the following conditions, namely:-
(i) uninterrupted ecological flow of at least thirty percent of the rivers flow in lean season, till a
comprehensive study establishes individual baselines for each project;
(ii) a cumulative study which assesses the impact of each project on the flow pattern of the
rivers on which the project is being constructed and on any loss of forest, natural wetlands and
biodiversity; and
(iii) the minimum distance between one project and the other is maintained at three kilometers
on a river stretch and not more than fifty percent of the river basin is affected at any time.
(b) The “Orange /Green and White” category of Industries as specified by the Central Pollution
Control Board or State Pollution Control Board as amended from time to time, shall be allowed
with strict compliance of environmental regulations but all efforts shall be made to promote
industries that have low environmental impacts and fall in “Green” or “White” categories of

(c) In the case of activities that are covered in the schedule to the Environment Impact Assessment
notification number S.O. 1533 (E), dated 14th September, 2006, published by the erst-while
Ministry of Environment and Forests and are falling in the Ecologically sensitive Area, except the
projects and activities which are specifically prohibited under sub-para (1) shall be scrutinized and
assessed for cumulative impacts and development needs before considering for prior
environmental clearance by the Ministry under the provisions of the said notification.
(d) In particular and without prejudice to the provisions of the relevant Acts, in cases of diversion
of forest land for non-forestry purposes in the Eco-sensitive Area, all information of the project,
from application stage to approval shall be placed in the public domain on the website of the
Ministry of Environment, Forest and Climate Change and on the website of Forest Department,
Maharashtra.
(e) The requirements of prior informed consent under the Scheduled Tribes and other Traditional
Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007) shall be complied with and
the consent of Gram Sabha for undertaking projects and activities shall be mandatory.
(f) There shall be no felling of trees whether on Forest, Government, Revenue or Private lands,
without the prior permission of the State Government in case of forest land, and the respective
District Collector in case of Government, Revenue and private land, as per the procedure laid
down by the State Government.
4. Implementation and Monitoring mechanism.– (1) A separate Zonal Master Plan based on the
carrying capacity studies including tourism master plan, as its component shall be prepared for the
Ecologically-sensitive Area and the same shall be approved by the Competent Authority in the
State Government within a period of two years from the date of publication of this notification to
carry-out implementation of the provisions of this notification and for holistic sustainable
development of such areas.
(2) The Zonal Master Plan shall indicate areas on steep hill slopes or areas which lies in hazard
zone or high degree of erosion, where construction activities shall not be permitted. Pending
approval of the Zonal Master Plan any development of regulated activities as prescribed in para 3
above, within the ESA shall be referred to the Monitoring Committee for its approval.
(3) The responsibility for monitoring and enforcement of provisions of this notification and the
implementation of the Zonal Master Plan shall vest with the State-level Monitoring Committee
headed by District Collector, Sindhudurg District and Deputy Conservator of Forest, Sawantwadi
Forest Division as its Member Secretary, to be constituted by the State Government within one
year of publication of this notification.
(4) The Monitoring Committee shall have representatives from the State Pollution Control Board,
Water Resources, Soil Conservation, Agriculture and Fisheries, Public Health, Public Works
Department, Planning and Tourism Departments of the State Government at the appropriate level
as “ex officio” members. Two experts in the domain of ecology and environment, wildlife

official members shall be nominated by the State Government after every three-years. The
Monitoring Committee shall meet as frequently as possible but not less than once every six
months.
(5) The Monitoring Committee shall recommend to the State Government the measures for
strengthening of existing regulatory institutions and processes in so far as they concern the
Sawantwadi- Dodamarg Ecologically-sensitive Area and based on the actual site-specific
conditions scrutinize, the activities covered in the Schedule to the notification of the Government
of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1553 (E), dated
the 14th September, 2006, and are falling in the ESA, except for the prohibited activities as
specified thereof, and referred to the Central Government in the Ministry of Environment, Forest
and Climate Change or the State Environment Impact Assessment Authority, as the case maybe,
for prior environmental clearances under the provisions of the said notification.
(6) The Member-Secretary of the Monitoring Committee or the concerned Collector or the
concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of
the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this
notification.
(7) The post clearance monitoring of projects and activities allowed in the ESA shall be carried out
by the State Government of Maharashtra, State Pollution Control Board and all projects in the
ESA which have been given Environmental Clearance or Forest Clearance shall be monitored at
least once a year by the concerned Regional Office of the Ministry of Environment, Forest and
Climate Change.
(8) All projects in the Ecologically sensitive Area which have been given consent to establish or
Consent to Operate under the Water (Prevention and Control of Pollution) Act, 1974 ( 6 of 1974)
or the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) shall be monitored at least
once a year by the State Pollution Control Board and the State Government with the help of
Monitoring Committee shall prepare ‘State of Health Report’ in respect of Sawantawadi-
Dodamarg ESA biennially giving inter-alia the details of steps taken in monitoring and
enforcement of provisions of this notification and make the same available in public domain.
(9) The Central Government may give such directions in writing, as it deems fit, to the Monitoring
Committee for effective discharge of its functions.
5. Action for contravention: In case of any contravention of the provisions of this notification,
action under the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and other
relevant statutes shall be taken accordingly. The Member-Secretary of the Monitoring Committee
or the concerned Collector shall be competent to file complaint under section 19 of the
Environment (Protection) Act, 1986 against any person who contravenes the provisions of this

6. Orders of Supreme Court, etc.: The provisions in this notification shall be subject to the final
orders, if any, passed by the Hon’ble Supreme Court of India or High Court or the National Green
Tribunal.
7. Appeal: (i) Any person aggrieved by a decision or order of the Monitoring Committee shall
prefer an appeal against such decision or order to the Government of India in the Ministry of
Environment, Forest and Climate Change.
(ii) Every memorandum of appeal under this paragraph shall precisely states the facts of the case,
the particulars of the decision or order appealed against and the reason for being aggrieved by the
decision or order and the remedy sought for shall be addressed to the Secretary to Government of
India in the Ministry of Environment, Forest and Climate Change.
(iii)Every memorandum of appeal by the affected person shall be made within ninety days from
the date of receipt of the decision or order.
