और िबदक, िेंिनु ी वन्द्र्िीव अभर्ारण्र् की सीमाओं के आसपास के क्षत्रे को संरजक्षत और सुरजक्षत रखना आवश्र्क ह,ै जिसे पैरािाफ 1 म ेंपाररजस्ट्थजतकी, पर्ाावरणीर् और िैव जवजवधता के िजृ ष्टकोण स े पाररजस्ट्थजतकी सवं ेिी िोन के रूप म ेंजवजनर्िाष्ट दकर्ा गर्ा ह ै और उि पाररजस्ट्थजतकी संवेिी िोन म ें उद्योगों र्ा उद्योगों के वग ा और उनके संचालन और प्रदक्र्ाओं को प्रजतजर्द्ध करना आवश्र्क ह;ै अतः अब, पर्ाावरण (संरक्षण) अजधजनर्म 1986 (1986 का 29) (जिसे इस अजधसूचना में आगे पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की धारा 3 की उपधारा (1) और उपधारा (2) के खडं (v) और (xiv) तथा उपधारा (3) िारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, पर्ाावरण (सरं क्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित, केन्द्र सरकार, केरल के कोल्लम जिले के पनु ालरु तालकु म ें िेंिनु ी वन्द्र्िीव अभर्ारण्र् की सीमा स े 2.65 दकलोमीटर की औसत िरू ी के साथ 0 दकलोमीटर स े6.7 दकलोमीटर तक के क्षत्रे को पाररजस्ट्थजतकी सवं ेिी िोन (जिसे इस अजधसूचना म ेंआगे पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप म ेंअजधसूजचत करती ह,ै जिसका ब्र्ौरा इस प्रकार ह,ै अथाात:् - 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमाए-ाँ (1) पाररजस्ट्थजतकी संवेिी िोन 0 दकलोमीटर स े 6.7 दकलोमीटर तक होगा, जिसकी िेंिनु ी वन्द्र्िीव अभर्ारण्र् की सीमा स े औसत िरू ी 2.65 दकलोमीटर होगी और पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल लगभग 118.279 वगा दकलोमीटर ह।ै (2) िेंिनु ी वन्द्र्िीव अभर्ारण्र् और उसके पाररजस्ट्थजतकी संवेिी िोन का सीमा जववरण अनलु ग्नक-I म ें सलं ग्न ह।ै (3) िेंिनु ी वन्द्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी संवेिी िोन के मानजचत्र अनलु ग्नक-II क और अनलु ग्नक-II ख और अनलु ग्नक-II ग म ें सलं ग्न ह।ैं (4) िेंिनु ी वन्द्र्िीव अभर्ारण्र् और उसके पाररजस्ट्थजतकी संवेिी िोन की सीमा पर भू-जनििे ांक अनलु ग्नक-III म ेंसंलग्न ह।ैं (5) िेंिनु ी वन्द्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी संवेिी िोन के भीतर तीन गााँव जस्ट्थत ह,ैं जिनका ब्र्ौरा अनलु ग्नक-IV म ें संलग्न ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख स े िो वर्ा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्र् के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसूचना में दिए गए उपबंधों का पालन करते हुए आंचजलक महार्ोिना तैर्ार करेगी। (2) राज्र् सरकार िारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसचू ना के प्रावधानों के अनुसार तथा केंरीर् और राज्र् जवधानों के सुसंगत और केंरीर् सरकार िारा िारी मागाििाक जसद्धांतों, र्दि कोई हों, अनुरुप तैर्ार दक िाएगी। (3) आंचजलक महार्ोिना, राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ा से दक िाएगी तादक पाररजस्ट्थजतकी और पर्ाावरणीर् िजृ ष्टकोणों को एकीकृत दकर्ा िा सके.- i. पर्ाावरण, वन एव ं वन्द्र्िीव; ii. िहरी जवकास; iii. कृजर्; iv. पर्ाटन;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 v. नगरपाजलका सामान्द्र् सेवा vi. भू-रािस्ट्व; vii. राज्र् प्रिर्ू ण जनर्ंत्रण बोड ा viii. पसंचाई एव ं लोक जनमााण जवभाग (4) आंचजलक महार्ोिना म ें अनुमोदित भू-उपर्ोग, अवसंरचना और दक्र्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा िब तक इस अजधसूचना म ेंऐसा जवजनर्िाष्ट न हो, तथा आचंजलक महार्ोिना की सभी अवसंरचनाओं और उसके दक्र्ाकलापों म ें सुधार करके उन्द्ह ेअजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनाने की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना, म ेंवनरजहत क्षेत्रों का पुनस्ट्ा थापन, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल- संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐसे अन्द्र् पहलओंु का प्रावधान दकर्ा िाएगा, जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह ै। (6) आंचजलक महार्ोिना म ेंसभी जवद्यमान पूिा स्ट् थलों, िामों और िहरी बजस्ट्तर्ों, वनों की श्जे णर्ों और दकस्ट् मों, कृजर् क्षेत्रों, उपिाऊ भूजम, उद्यानों और उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा, सहार्क मानजचत्रों के साथ जिनम ें जवद्यमान तथा प्रस्ट्ताजवत भू-उपर्ोग जविेर्ताओं के ब्र्ौरों का जनधाारण दकर्ा िाएगा। (7) इस आंचजलक महार्ोिना म ेंपाररजस्ट्थजतकी-संवेिी िोन के जवकास को जवजनर्जमत दकर्ा िार्ेगा और पैरा 4 में सूचीबद्ध प्रजतबंजधत और जवजनर्जमत दक्र्ाकलापों का अनुपालन दकर्ा िाएगा और स्ट्थ ानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजश्चत दकर्ा िाएगा और उसे बढ़ावा दिर्ा िार्ेगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) इस प्रकार अनुमोदित आंचजलक महार्ोिना, इस अजधसूचना के उपबंधों के अनुसरण म ेंजनगरानी के अपन ेकार्ों को पूरा करने के जलए जनगरानी सजमजत के जलए संिभ ा िस्ट्तावेि होगी। 3. राज्र् सरकार िारा दकए िान ेवाल ेउपार्. - राज्र् सरकार अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात:् - (1) भ-ू उपर्ोग. – (क) पाररजस्ट्थजतकी-संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजर् क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खुल े स्ट्थानों का मुख्र् वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्र्ाकलापों के जलए प्रर्ोग र्ा पररवतना की अनुमजत नहीं होगी: बित ेदक मॉनीटरी सजमजत की जसफाररि पर केंर तथा राज्र् सरकार के िहरी जनर्ोिन अजधजनर्म तथा अन्द्र् जनर्मों एव ं जवजनर्मों र्था लागू, के अधीन तथा इस अजधसूचना के उपबंधों के पूव ाअनुमोिन स ेपाररजस्ट्थजतकी-संवेिी िोन के भीतर कृजर् और अन्द्र् भूजम के गैर कृजर् उपर्ोग के रुपान्द्तरण को स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं और दक्र्ाकलापों को पूरा करने के जलए अनुमजत िी गई ह,ै िैस,े - (i) जवद्यमान सडकों को चौडा और मिबूत करना और नई सडकों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का सजन्नमााण और नवीनीकरण; (iii) प्रिर्ू ण उ्पन्न न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योग सजहत िाम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और (v) पैरािाफ-4 के मि में र्था उजल्लजखत बढ़ावा दिए गए दक्र्ाकलापः परंतु र्ह भी दक राज्र् सरकार के पूवा अनुमोिन के जबना और संजवधान के अनुच्छेि 244 र्ा अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) सजहत वतामान म ें लाग ू जवजधर्ों के उपबंधों के अनुपालन के जबना वाजणजज्र्क और औद्योजगक जवकास दक्र्ाकलापों के जलए िनिातीर् भूजम के दकसी भी उपर्ोग की अनुमजत नहीं िी िाएगी:6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंतु र्ह भी दक पाररजस्ट्थजतकी-संवेिी िोन के अधीन आने वाली भूजम के अजभलेखों म ेंहुई दकसी त्रुरट को, मॉनीटरी सजमजत के जवचार प्राि करने के पश्चात,् राज्र् सरकार िारा प्र्र्ेक मामले म ें एक बार सुधारा िाएगा और उि त्रुरट को सुधारने की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह भी दक उपर्िुा त्रुरट को सुधारन े म,ें इस उप-परै ा म ें र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भ-ू उपर्ोग का पररवतान सजममजलत नहीं होगा: (ख )अनुप्रर्िु र्ा अनु्प ािक कृजर् क्षेत्रों म ेंवनीकरण तथा पर्ावा ासों की बहाली के कार्ाकलापों स े पुन: वनीकरण दकए िान े के प्रर्ास दकए िाएंगे। (2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक झरनों/नदिर्ों/चैनलों के िलिहण क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और पुनरुद्धार की र्ोिनाओं को आंचजलक महार्ोिना म ें सजममजलत दकर्ा िाएगा। (3) पर्टा न र्ा पारर-पर्टा न – (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पारर-पर्ाटन दक्र्ाकलाप र्ा जवद्यमान पर्ाटन दक्र्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन सबं ंधी पर्ाटन महार्ोिना के अनसु ार होगा। (ख) पर्ाटन महार्ोिना, पर्ाटन जवभाग िारा केरल सरकार के रािस्ट्व एव ं वन जवभाग के परामि ा स े तैर्ार की िाएगी; (ग) पर्ाटन महार्ोिना, आंचजलक महार्ोिना का घटक होगी; (घ) पर्ाटन महार्ोिना, पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी; (ङ) पारर-पर्ाटन संबंधी दक्र्ाकलाप जनमन ानुसार जवजनर्जमत दकए िाएंगे, अथाात:् - (i) पर्ाावरण-अनुकूल पर्ाटन दक्र्ाकलापों स े संबंजधत पर्ाटकों के अस्ट्थार्ी आवास के जसवार् पाररजस्ट्थजतकी संवेिी िोन के भीतर होटलों और ररसॉट्सा के नए जनमााण की अनुमजत नहीं िी िाएगी; बिते दक मौिूिा प्रजतष्ठानों के जवस्ट्तार की अनुमजत आंचजलक महार्ोिना के अनुसार िी िा सकती ह;ै (ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नई पर्ाटन दक्र्ाकलापों र्ा मौिूिा पर्ाटन दक्र्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता अध्र्र्न के आधार पर पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी जिक्षा और पाररजस्ट्थजतकी जवकास पर बाल िेते हुए पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् म ें केंर सरकार िारा िारी मागाििाक जसद्धांतों और राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरणों िारा िारी पाररजस्ट्थजतकी पर्ाटन मागाििाक जसद्धांतों (समर्-समर् पर संिोजधत) के अनुसार होगा; (iii) िब तक इस आंचजलक महार्ोिना को अनुमोदित नहीं कर दिर्ा िाता तब तक पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्र्ाकलापों के जवस्ट्तार की अनुमजत संबंजधत जवजनर्ामक प्राजधकरणों के िारा स्ट्थल जवजिष्ट िांच और जनगरानी सजमजतर्ों की जसफाररि के आधार पर िी िाएगी। (4) प्राकृजतक जवरासत – पाररजस्ट्थजतकी संवेिी िोन के अधीन आन ेवाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैस े दक िीन पूल ररजव ा क्षत्रे , िलै सरं चना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उ्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एवं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल - पाररजस्ट्थजतकी संवेिी िोन म ें ऐजतहाजसक, स्ट्थाप्र्, सौंिर् ा और सांस्ट्कृजतक मह्व की इमारतों, संरचनाओं, कलाकृजतर्ों, क्षत्रे और पररसरों की पहचान की िाएगी और उनके संरक्षण के जलए जवरासत संरक्षण र्ोिना अंजतम अजधसूचना के प्रकािन की तारीख स े छह महीने के भीतर तैर्ार की िाएगी और आंचजलक महार्ोिना म ें सजममजलत की िाएगी। (6) ध्व जन प्रिर्ू ण –पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रिर्ू ण की रोकथाम और जनर्ंत्रण पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और उसके संिोधनों के अधीन ध्वजन प्रिर्ू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 के अनुसार दकर्ा िाएगा। (7) वार् ुप्रिर्ू ण - पाररजस्ट्थजतकी सवं ेिी िोन म ेंवार् ुप्रिर्ू ण की रोकथाम और जनर्ंत्रण वार् ु(प्रिर्ू ण की रोकथाम और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्म और उसके संिोधनों के अनुसार की िाएगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (8) बजहस्राव का जनस्ट्सरण - पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत अपजिष्टों का जनवाहन पर्ाावरण (संरक्षण) अजधजनर्म 1986 और उसके अधीन बनाए गए जनर्मों र्ा राज्र् सरकार िारा जनधााररत मानकों, िो भी अजधक किोर हो, के अधीन आन े वाले पर्ाावरण प्रिर्ू कों के जनवाहन के सामान्द्र् मानकों के उपबंधों के अनुसार होगा। (9) िोस अपजिष्ट - िोस अपजिष्ट का जनपटान एवं प्रबधं न जनम्नानुसार दकर्ा िाएगा, - (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट जनपटान और प्रबंधन, िोस अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा, जिसे भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् िारा अजधसूचना संख्र्ा का.आ. 1357(अ), तारीख 8 अप्रैल, 2016 िारा प्रकाजित और समर्-समर् पर संिोजधत दकर्ा गर्ा ह;ै (ख) अकाबाजनक सामिी को पर्ाावरण के अनुकूल तरीके स ेपाररजस्ट्थजतकी संवेिी िोन के बाहर अजभज्ञात स्ट्थल पर जनपटार्ा िाएगा; (ग) पाररजस्ट्थजतकी संवेिी िोन म ेंिोस अपजिष्टों को िलान े र्ा भस्ट्म करन े तथा लैंडदफल बनान ेअनुमजत नहीं होगी; (10) िवै जचदक्सा अपजिष्ट - िैव जचदक्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा,- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िवै जचदक्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना समर्-समर् पर संिोजधत, स.ं सा. का. जन. 343(अ), तारीख 28 माच,ा 2016 के अधीन प्रकाजित िैव-जचदक्सा अपजिष्ट प्रबंधन जनर्म, के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी भी सामान्द्र् उपचार सुजवधा र्ा भस्ट्मीकरण की अनमु जत नहीं होगी। (11) प्लाजस्ट्टक अपजिष्ट का प्रबधं न - पाररजस्ट्थजतकी संवेिी िोन म ें प्लाजस्ट्टक अपजिष्ट का प्रबधं न, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् िारा, समर्-समर् पर संिोजधत; अजधसूचना स. सा.का.जन. 340(अ), तारीख 18 माचा, 2016 के अधीन प्रकाजित प्लाजस्ट्टक अपजिष्ट का प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न - पाररजस्ट्थजतकी संविे ी िोन में जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् िारा, समर्-समर् पर संिोजधत अजधसूचना स. सा.का.जन. 317(अ), तारीख 29 माचा, 2016 के अधीन प्रकाजित जनमाणा और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट - पाररजस्ट्थजतकी संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् िारा प्रकाजित ई–अपजिष्ट प्रबंधन जनर्म,2016 , समर्-समर् पर संिोजधत; के उपबंधों के अनुसार दकर्ा िाएगा। (14) सडक-र्ातार्ात - सडक-र्ातार्ात को पर्ाावास अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना में जविेर् उपबंध सजममजलत दकए िाएंग।े आंचजलक महार्ोिना के तैर्ार होन े और राज्र् सरकार के सक्षम प्राजधकारी स े अनुमोदित होन े तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके अधीन बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार सडक-र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन िजनत प्रिर्ू ण - वाहन िजनत प्रिर्ू ण की रोकथाम और जनर्ंत्रण लाग ूजवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईधनों िैसे संपीजडत प्राकृजतक गैस, रवीकृत पेरोजलर्म गैस, आदि के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ा-ं (क) आजधकाररक रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पश्चात ् पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए प्रिर्ू णकारी उद्योग की स्ट्थापना की अनुमजत नहीं िी िाएगी; (ख) केन्द्रीर् प्रिर्ू ण जनर्ंत्रण बोड ा िारा फरवरी, 2016 में िारी जसद्धान्द्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रिर्ू णकारी उद्योगों को अनुमत दकर्ा िाएगा और इसके अजतररि, गरै प्रिर्ू णकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा। (17) पहाडी ढलानों का सरं क्षण - पहाडी ढलानों का संरक्षण जनम्नानसु ार दकर्ा िाएगा :- (क) आंचजलक महार्ोिना म ेंपहाडी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी जनमााण की अनुज्ञा नहीं होगी;8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) जिन ढलानों र्ा जवद्यमान खडी पहाडी ढलानों म ें अ्र्जधक भू-क्षरण होता ह ैउनमें दकसी भी जनमााण की अनुज्ञा नहीं होगी। 4. पाररजस्ट्थजतकी सवं िे ी िोन म ेंप्रजतजर्द्ध र्ा जवजनर्जमत दकए िान ेवाल ेदक्र्ाकलापों की सचू ी -िेंिनु ी पाररजस्ट्थजतकी संवेिी िोन म ेंसभी दक्र्ाकलाप वन्द्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53), वन (सरं क्षण) अजधजनर्म, 1980 (1980 का 69) और पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) तथा राज्र् म ेंप्रचजलत अन्द्र् अजधजनर्मों एव ंजनर्मों के उपाबंधों िारा िाजसत होंगें। पाररजस्ट्थजतकी संवेिी िोन के अधीन आन े वाल े वन क्षत्रे जवद्यमान वन जवजधर्ों के अधीन ही िाजसत होगें। इस अनुच्छेि के उपबंधों के अधीन, पाररजस्ट्थजतकी संवेिी िोन म ें दक्र्ाकलापों का जवजनर्मन नीच े दिए गए सारणीबद्ध स्ट्तंभ के अनुसार दकर्ा िाएगा, अथाात:् - सारणी क्.स ं. दक्र्ाकलाप रटप्पणी क . प्रजतजर्द्ध दक्र्ाकलाप (1) वाजणजज्र्क खनन, प्थर उ्खनन और (क) पाररजस्ट्थजतकी संवेिी िोन म ेंघरों के जनमााण र्ा मरममत के जलए जपसाई इकाइर्ां। खुिाई सजहत वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेलू िरूरतों को पूरा करन ेके अलावा, सभी नए और मौिूिा (लघु और प्रमुख खजनि), प्थर खनन और परे ाई इकाइर्ों पर त्काल प्रभाव स े प्रजतजर्द्ध होगा ; (ख) खनन कार् ा माननीर् उच्चतम न्द्र्ार्ालर् के तारीख 4 अगस्ट्त, 2006 के आिेि (टी.एन. गोिावमान जथरुमुलपाि बनाम भारत संघ के मामले म,ें ररट र्ाजचका सख्ं र्ा 202/1995) और तारीख 21 अप्रैल, 2014 के आिेि (गोवा फाउंडेिन बनाम भारत संघ के मामल े म,ें ररट र्ाजचका संख्र्ा 435/2012); और आईए सख्ं र्ा 1000 वर् ा 2003 तारीख 03 िून, 2022। आईए संख्र्ा 131377 वर्ा 2022, तारीख 26 अप्रैल, 2023 और 28 अप्रैल, 2023 के जनणार् और आईए संख्र्ा 162023, 162034, 162154 और 162155 वर्ा 2025 म ें तारीख 23 िुलाई 2025 के बाि के जनणार् र्ा खनन के संबंध म ेंकोई और आििे के अनुसार दकए िाएंगे। (2) प्रिर्ू ण (िल, वार्ु, मृिा, ध्वजन, आदि) पाररजस्ट्थजतकी संवेिी िोन म ें कोई प्रिर्ू णकारी उद्योग लगाने र्ा उ्पन्न करन े वाल ेउद्योगों की स्ट्थापना। उसके जवस्ट्तार की अनुमजत नहीं िी िाएगी। केंरीर् प्रिर्ू ण जनर्ंत्रण बोडा िारा फरवरी 2016 म ें िारी मागाििाक जसद्धांतों म ें वर्णात उद्योगों के वगीकरण के अनुसार, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गरै -प्रिर्ू णकारी उद्योगों को ही अनुमजत िी िाएगी, िब तक दक इस अजधसूचना म ेंऐसा जवजनर्िाष्ट न दकर्ा गर्ा हो। इसके अलावा, गैर-प्रिर्ू णकारी कुटीर उद्योगों का संवधान दकर्ा िाएगा। (3) बडी िल जवद्युत पररर्ोिनाओं की लाग ू जवजधर्ों के अनुसार जनर्धे (अन्द्र्था उपाबंध के अजतररि)। स्ट्थापना। (4) दकसी पररसंकटमर् पिाथ ा का प्रर्ोग र्ा लाग ू जवजधर्ों के अनुसार जनर्धे (अन्द्र्था उपाबंध के अजतररि)। उ्पािन र्ा प्रस्ट्संकरण। (5) प्राकृजतक िल जनकार्ों र्ा भूजम क्षत्रे म ें लाग ू जवजधर्ों के अनुसार जनर्धे (अन्द्र्था उपाबंध के अजतररि)। अिोजधत बजहस्रावों का जनस्ट्सरण। (6) िोस अपजिष्ट जनपटान स्ट्थल और िोस पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी भी नए िोस अपजिष्ट एव ं िैव जचदक्सा अपजिष्ट के जलए जनपटान स्ट्थल और िोस अपजिष्ट उपचार र्ा प्रसंस्ट्करण सुजवधा की सामान्द्र् भस्ट्मीकरण सुजवधा की अनुमजत नहीं ह।ै औद्योजगक दक्र्ाओं और स्ट्वास्ट््र् प्रजतष्ठानों र्ा स्ट्थापना। अस्ट्पतालों आदि स े उ्पन्न दकसी भी प्रकार के िोस अपजिष्ट के उपचार के जलए आग े कोई साझा र्ा व्यजिगत भस्ट्मीकरण सुजवधा स्ट्थाजपत करना जनर्ेध ह।ै[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 (7) फमों, कॉपोरेट और कंपजनर्ों िारा बडे स्ट्थानीर् आवश्र्कताओं को परू ा करन े के अलावा लाग ू जवजधर्ों के पैमाने पर वाजणजज्र्क पिधु न और अनुसार जनर्ेध (अन्द्र्था उपाबंध के अजतररि)। कुसकुट फामों की स्ट्थापना। (8) लकडी आधाररत नए उद्योग। लाग ू जवजधर्ों के अनुसार जनर्धे (अन्द्र्था उपाबंध के अजतररि)। (9) जवस्ट्फोटक वस्ट्तुओं का जवजनमााण और लाग ू जवजधर्ों के अनुसार जनर्धे (अन्द्र्था उपाबंध के अजतररि)। भंडारण। (10) व ाजणजज्र्क प्रर्ोिनाथा पहाडों का लाग ू जवजधर्ों के अनुसार जनर्धे (अन्द्र्था उपाबंध के अजतररि)। पररवतान। (11) न ई सॉ जमलों की स्ट्थ ापना की स्ट्थ ापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई र्ा मौिूिा सॉ जमलों के जवस्ट्तार की अनुमजत नहीं िी िाएगी। (12) ि लावन लकडी का वाजणजज्र्क उपर्ोग। लाग ू जवजधर्ों के अनुसार जनर्धे (अन्द्र्था उपाबंध के अजतररि)। (13) ईं ट भट्टों की स्ट्थापना। लाग ू जवजधर्ों के अनुसार जनर्धे (अन्द्र्था उपाबंध के अजतररि)। (14) न िी तटों पर अजतक्मण और निी तट की लाग ू जवजधर्ों के अनुसार जनर्धे (अन्द्र्था उपाबंध के अजतररि)। वनस्ट्पजत का जवनाि, निी के प्थरों का संिह। (15) न िी और भूजम क्षत्रे म ें िोस अपजिष्ट र्ा लाग ू जवजधर्ों के अनुसार जनर्धे (अन्द्र्था उपाबंध के अजतररि)। प्लाजस्ट्टक अपजिष्ट र्ा रासार्जनक अपजिष्ट से डपमपंग । ख. जवजनर्जमत दक्र्ाकलाप (16) होटलों और ररजॉटों की वाजणजज्र्क संरजक्षत क्षत्रे की सीमा के एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी स्ट्थापना। संवेिी िोन की सीमा तक, िो भी जनकट हो, दकसी भी नए वाजणजज्र्क होटल और ररसॉटा की अनुमजत नहीं िी िाएगी, जसवार् पाररजस्ट्थजतकी पर्ाटन दक्र्ाकलापों के जलए छोटे अस्ट्थार्ी ढााँचों के। बिते, मौिूिा प्रजतष्ठानों के जवस्ट्तार की अनुमजत आचं जलक महार्ोिना के अनुसार िी िार्गे ी । (17) जनमााण दक्र्ाकलाप। पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी भी प्रकार के नए वाजणजज्र्क जनमााण की अनुमजत नहीं होगी। परंतु दक स्ट्थानीर् लोगों को अपने आवासीर् उपर्ोग के जलए अपनी भूजम पर भवन उपजनर्मों के अनुसार परै ािाफ 6 के उप परै ािाफ (1) म ें सूचीबद्ध दक्र्ाकलापों सजहत स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को परू ा करन े की अनुमजत होगी, िैसे: i. मौिूिा सडकों का चौडा करना और सुिढ़ृ ीकरण तथा नई सडकों का जनमााण; ii. बुजनर्ािी ढांच े और नागररक सुजवधाओं का जनमााण और नवीनीकरण; iii. फरवरी 2016 के केंरीर् प्रिर्ू ण जनर्ंत्रण बोड ा िारा दकए गए वगीकरण के अनुसार प्रिर्ू ण न फैलाने वाल ेलघु उद्योग; iv. िामोद्योग सजहत कुटीर उद्योग; होम स्ट्टे सजहत पारर-पर्टा न को बढ़ावा िेने वाली सुलभ िकु ान और स्ट्थानीर् सुजवधाएं; और v. इस अजधसूचना म ेंसूचीबद्ध प्रवर्तात दक्र्ाकलाप। ii. परंतु दक प्रिर्ू ण न फैलाने वाले लघु उद्योगों स े संबंजधत जनमााण दक्र्ाकलापों को, लाग ू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी स ेपूव ाअनुमोिन के साथ, न्द्र्ूनतम स्ट्तर पर जवजनर्जमत दकर्ा िाएगा। iii. पाररजस्ट्थजतकी संवेिी िोन म ें जनमााण दक्र्ाकलाप आंचजलक महार्ोिना के अनुसार होंगी।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (18) गैर प्रिर्ू णकारी लघ ु उद्योग। फरवरी 2016 ,में केन्द्रीर् प्रिर्ू ण जनर्ंत्रण बोडा िारा िारी उद्योगों के वगीकरण के अनुसार और अपररसंकटमर्, लघ ुपैमान ेके और सेवा उद्योग, उद्यान कृजर् र्ा पुष्प कृजर् र्ा कृजर् पाररजस्ट्थजतकी संवेिी िोन की िेिि सामिी से उ्पािों का उ् पािन करन े वाले कृजर् आधाररत उद्योग को सक्षम प्राजधकारी िारा अनुमजत िी िाएगी। (19) वृक्षों की कटाई। (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं की िा सकेगी। (ख) वृक्षों की कटाई संबंजधत केंरीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी। ग. आरजक्षत वनों और संरजक्षत वनों के मामल े म ें कार् ा र्ोिना के जनिेिों का पालन दकर्ा िाएगा। (20) वन उ्पािों और गरै काष्ठ वन उ्पािों लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। (एनटीएफपी) का सिं हण। (21) जवद्युत और संचार टॉवर लगाने, तार- भूजमगत केबल जबछान े संबंधी लाग ू जवजधर्ों के अधीन जवजनर्जमत जबछाने तथा अन्द्र् बुजनर्ािी ढांचे की करने को बढ़ावा दिर्ा िाएगा। व्यवस्ट्था। (22) नागररक सुजवधाओं सजहत बुजनर्ािी लाग ू जवजधर्ों, जनर्मों और जवजनर्मों और उपलब्ध मागिा िाक ढांचा। जसद्धांतों के अनुसार िमन के उपार् दकर्े िाएगे। (23) मौिूिा सडकों को चौडा करना, उन्द्ह ें लागू जवजधर्ों, जनर्मों और जवजनर्मन और उपलब्ध मागिा िाक सुिढृ बनाना और नई सडकों, घाटों, पुलों जसद्धांतों के अनुसार उजचत पर्ाावरण प्रभाव मूल् र्ांकन के साथ और पुजलर्ाओं का जनमााण। न्द्र्ूनीकरण उपार् करना। (24) पर्ाटन स े संबंजधत अन्द्र् दक्र्ाकलाप िैस े लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। दक पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से उडान भरना । (25) वाजणजज्र्क म्स्ट्र् पालन और अवैज्ञाजनक लाग ू जवजधर्ों के अनुसार जनर्ेध (अन्द्र्था अन्द्र्था उपाबंध के म्स्ट्र् पालन अजतररि ), हालांदक, िनिाजतर्ों के वास्ट्तजवक उपर्ोग के जलए अनुमजत िी गई ह।ै (26) पहाडी ढलानों और निी तटों का संरक्षण। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। (27) राजत्र म ें वाहन र्ातार्ात का सचं लन। लागू जवजधर्ों के अधीन वाजणजज्र्क उद्देश् र्ों के जलए जवजनर्जमत होगा। (28) स्ट्थानीर् समुिार्ों िारा अपनार्ी िा रही स्ट्थानीर् िनता के प्रर्ोग के जलए लागू जवजधर्ों के अधीन अनुमत वतामान कृजर् और बागवानी पद्धजतर्ों के होंगे। साथ डेर्ररर्ा,ं िग्ु ध उ्पािन, िल कृजर् और म्स्ट्र् पालन। (29) प्राकृजतक िल जनकार्ों र्ा भ ू क्षेत्र में िोजधत िल र्ा बजहस्रााव का िल जनकार्ों म ें जनस्ट्सरण नहीं होन े िोजधत अपजिष्ट िल र्ा बजहस्रााव का दिर्ा िार्ेगा और िोजधत अपजिष्ट िल के पुनचाक्ण और जनस्ट्सरण। पुन:उपर्ोग के प्रर्ास दकए िाएंगे। अन्द्र्था िोजधत अपजिष्ट िल र्ा बजहस्रााव का जनस्ट्सरण लाग ू जवजधर्ों के अनुसार जवजनर्जमत दकर्ा िाएगा। (30) सतही और भूिल का वाजणजज्र्क लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। जनष्कर्ाण। (31) कृजर् र्ा अन्द्र् उपर्ोग के जलए खलु ा कुआं, जवजनर्जमत और कार्ाकलाप की सक्षम प्राजधकारी िारा कडाई स े बोरवेल आदि। जनगरानी की िाएगी। (32) िोस अपजिष्ट प्रबंधन। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। (33) जविेिी प्रिाजतर्ों का पररचर्। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। (34) पाररजस्ट्थजतकी से संवधान दकर्ा िाएगा। 5. पाररजस्ट्थजतकी सवं िे ी िोन की अजधसचू ना की जनगरानी के जलए जनगरानी सजमजत:- पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (3) िारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, केन्द्र सरकार इस अजधसूचना के अनुपालन की जनगरानी हते ु ििें नु ी पाररजस्ट्थजतकी संवेिी िोन जनगरानी सजमजत नामक एक सजमजत का गिन करती ह।ै उप- अनुच्छेि (1) म ेंजनर्िाष्ट जनगरानी सजमजत म ें जनम्नजलजखत सिस्ट्र् सजममजलत होंग,े अथाता ्:- क्.स. जनगरानी सजमजत का गिन पिनाम (i) जिला कलेसटर, कोल्लम अध्र्क्ष; (ii) प्राकृजतक संरक्षण (जवरासत संरक्षण सजहत) के क्षत्रे म ें कार्ारत गैर- सिस्ट्र्; सरकारी संगिनों के प्रजतजनजधर्ों को केरल सरकार िारा नामजनर्िाष्ट दकर्ा िाएगा। (iii) केरल राज्र् के प्रजतजष्ठत संस्ट्थान र्ा जवश्वजवद्यालर् स े पाररजस्ट्थजतकी सिस्ट्र्; और पर्ाावरण म ें एक जविेर्ज्ञ को केरल सरकार िारा प्र्र्ेक मामल े म ें एक वर्ा की अवजध के जलए नामजनर्िाष्ट दकर्ा िाएगा। (iv) केरल राज्र् िैव जवजवधता बोड ा के प्रजतजनजध सिस्ट्र्; (v) वन्द्र्िीव वाडान, िेंिनु ी पिेन, सिस्ट्र्सजच-; जनगरानी सजमजत के कार्-ा क्षत्रे -(i) जनगरानी सजमजत इस अजधसूचना के उपाबंधों के अनुपालन की जनगरानी करेगी। (ii) जनगरानी सजमजत का कार्का ाल तीन वर्ा का होगा। (iii) भारत सरकार के त्कालीन पर्ाावरण एव ंवन मंत्रालर् की अजधसूचना संख्र्ा का.आ. 1553 (अ) तारीख 14 जसतंबर, 2006 की अनुसूची म ें सजममजलत दक्र्ाकालाप पाररजस्ट्थजतकी संवेिी िोन म ें आती ह,ैं इसके पैरािाफ 7 के अधीन सारणी म ें जवजनर्िाष्ट प्रजतजर्द्ध दक्र्ाकलापों को छोडकर, वास्ट्तजवक स्ट्थल-जवजिष्ट जस्ट्थजतर्ों के आधार पर जनगरानी सजमजत िारा िांच की िाएगी और उि अजधसूचना के उपाबंधों के अधीन पूवा पर्ाावरणीर् अनापजत्त के जलए पर्ाावरण, वन और िलवार् ु पररवतना मंत्रालर् म ें केंर सरकार को भेिा िाएगा।12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iv) भारत सरकार के त्कालीन पर्ाावरण एव ं वन मंत्रालर् म ें प्रकाजित अजधसूचना संख् र्ा का.आ. 1533 (अ), तारीख 14 जसतंबर, 2006 म ें सजममजलत नहीं दकए गए और पाररजस्ट्थजतकी संवेिी िोन म ें आन े वाले दक्र्ाकलापों, उसके पैरा 4 के अधीन सारणी म ेंजवजनर्िाष्ट प्रजतजर्द्ध दक्र्ाकलापों को छोडकर, की जनगरानी सजमजत िारा वास्ट्तजवक स्ट् थल-जवजिष्ट जस्ट्थजतर्ों के आधार पर िांच की िाएगी और संबंजधत जवजनर्ामक प्राजधकरणों को अिेजर्त की िाएगी। (v) जनगरानी सजमजत के सिस्ट्र् सजचव पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के तहत इस अजधसूचना के प्रावधानों का उल्लंघन करने वाले दकसी भी व्यजि के जखलाफ जिकार्त ििा करन े के जलए सक्षम होंगे। (vi) मामल े िर मामल े की अपक्षे ाओं के आधार पर जनगरानी सजमजत संबंजधत जवभागों के प्रजतजनजधर्ों र्ा जविेर्ज्ञों, उद्योग संघों के प्रजतजनजधर्ों र्ा संबंजधत जहतधारकों को अपने जवचार जवमि ा म ें सहार्ता के जलए आमजं त्रत कर सकता ह।ै (vii) जनगरानी सजमजत इस अजधसूचना के उपाबंध-V म ें जवजनर्िाष्ट प्रोफामा ा के अनुसार प्र्र्ेक वर् ा 31 माच ा तक के अपन े दक्र्ाकलापों की वार्र्ाक कारावाई ररपोटा उस वर् ा के 30 िून तक राज्र् के मख्ु र् वन्द्र्िीव सरं क्षक को प्रस्ट्तुत करेगी। (vii) पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् म ें केन्द्र सरकार, जनगरानी सजमजत को उसके कार्-ा कलापों के प्रभावी जनवाहन के जलए जलजखत म ें ऐस ेजनिेि ि ेसकेगा िो वह उजचत समझे। (ix) केंर सरकार और राज्र् सरकार इस अजधसूचना के उपाबंध को प्रभावी करन े के जलए अजतररि उपार्, र्दि कोई हो, जनर्िाष्ट कर सकती ह।ै (x) इस अजधसूचना के उपाबधं भारत के माननीर् उच्चतम न्द्र्ार्ालर् र्ा उच्च The Sanctuary is named after the locally-named ‘Chenkurinji’ tree which is endemic to this area and falls in Kulathupuzha reserved forests. AND WHEREAS, the Shendurney Wildlife Sanctuary is home to a rich and diverse range of living organism. The tropical climate complimented by heavy rainfall from two monsoons and favourable edaphic factors creates an ideal condition for the flourishing growth of plant life. The forests of Shendurney Wildlife Sanctuary forms the catchment area of Kallada river, The water from Shendurney reservoir supports a large tract of agricultural lands in Kollam, Pathanamthitta and Alappuzha districts of Kerala. AND WHEREAS, Myristica swamps are one of the unique ecosystems found in the tract. These swamps are the only sites of occurrence of certain members of the ancient family Myristicaceae such as Myristica fatua (Kothappayin) and Gymnacranthera farquhariana (Undappayin). These freshwater swamps play an important role in regulating the species diversity and abundance of both amphibians and reptiles. AND WHEREAS, the continuity of Agasthyamalai hill ranges to the adjoining Pandalam hill ranges is through a narrow passage of the sanctuary and Thenmala Forest Division. AND WHEREAS, angiosperm species identified from Shendurney Wildlife Sanctuary consist of 1293 species belonging to 122 families, out of which nearly 24.8 percent are endemic to the Western Ghats. Also, 52 species of fishes, 49 species of amphibians, 52 species of reptiles, 283 species of butterflies, 295 species of birds and 55 species of mammals of which over 30 percent species are endemic to the Western Ghats. AND WHEREAS, diverse population of wildlife is present in the Shendurney Wildlife Sanctuary such as Asian Elephant (Elephas maximus), Malabar Slender Loris (Loris lydekkerianus), Bonnet Macaque (Macaca radiata diluta), Lion-tailed Macaque (Macaca silenus), Nilgiri Langur (Semnopithecus johnii), Gaur (Bos gaurus), Indian Pangolin (Manis crassicaudata), Sambar (Rusa unicolor), Malabar Giant Squirrel (Ratufa indica), Three-striped Palm Squirrel (Funambulus palmarum), Indian crested Porcupine (Hystrix indica), Fulvous Fruit Bat (Rousettus leschenaultii), Blyth's Horseshoe Bat (Rhinolophus lepidus), Brown Mongoose (Herpestes fuscus), Barking Deer (Muntiacus muntjak), Nilgiri striped squirrel (Funambulus sublineatus), Sloth bear (Melursus ursinus), Tiger (Panthera tigris), Leopard (Panthera pardus), etc. AND WHEREAS, the Shendurney Wildlife Sanctuary is a treasure house of plant diversity. About 1293 species of flowering plants belonging to more than 122 families are reported from this sanctuary, representing nearly 28% of the total flowering plants estimated from Kerala. Major families of plant species include Annonaceae, Dilleniaceae, Menispermaceae, Clusiaceae, Euphorbiaceae, Phyllanthaceae, Loranthaceae, Lentibulariaceae, Celastraceae Malvaceae, Elaeocarpaceae, Sapindaceae, Rutaceae, Rubiaceae, Balsaminaceae, Acanthaceae, Lamiaceae, Apocynaceae, Begoniaceae, Urticaceae, Convolvulaceae, Vitaceae, Fabaceae, Myrtaceae, and Asteraceae, among others. Some RET Flora includes Large Cap-Flower (Mitrephora grandiflora), Rheed's Caper (Capparis baducca), Mangosteen (Garcinia rubro-echinata), Neerkuruntha (Blepharistemma serratum), Meruvalan (Diospyros courtallumensis), Avukkarim (Semecarpus travancorica), Kulavu (Kingiodendron pinnatum), etc. Some famous RET fauna includes Asian Elephant (Elephas maximus), Malabar Slender Loris (Loris lydekkerianus), Nilgiri Langur (Semnopithecus johnii), Smooth-coated Otter (Lutrogale perspicillata), Steppe Eagle (Aquila nipalensis), Large-billed Leaf Warbler (Phylloscopus magnirostris), Nilgiri Flycatcher (Eumyias albicaudatus), Travancore Tortoise (Indotestudo travancorica), King Cobra (Ophiophagus Hannah), Kerala Night Frog (Nyctibatrachus minor), Water drop Bush Frog (Raorchestes nerostagona), Kalakad gliding frog (Rhacophorus calcadensis), Indian Mottled Eel (Anguilla bengalensis), Red Canarese Barb (Hypselobarbus thomassi), Travancore[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 25 Batasio (Batasio travancorica), Mozambique Tilapia (Oreochromis mossambicus), Common Mime (Papilio clytia), Malabar Tree Nymph (Idea malabarica), Jewel Fourring (Ypthima avanta), etc. AND WHEREAS, for effective conservation and protection of this rich floral and faunal biodiversity of Shendurney Wildlife Sanctuary, the extent of anthropogenic pressure in the periphery of the park has to be regulated as the immediate area adjoining this fragile ecosystem is ecologically sensitive and exert great impact on this Protected Area; AND WHEREAS, it is necessary to conserve and protect the areas around Shendurney Wildlife Sanctuary for improvement and development the wildlife habitat therein and in the landscape; AND WHEREAS, it is necessary to conserve and protect the area, surrounding the boundaries of Shendurney Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0 kilometer to 6.7 kilometers, with a mean distance of 2.65 kilometers from the boundary of Shendurney Wildlife Sanctuary in Punalur Taluk of Kollam district in the Kerala as the Eco-sensitive Zone (hereafter in this notification referred to as the Eco-Sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of Eco-Sensitive Zone- (1) The Eco-Sensitive Zone shall be to an extent varying from 0 kilometer to 6.7 kilometers, with a mean distance of 2.65 kilometers from the boundary of Shendurney Wildlife Sanctuary and the area of the Eco-sensitive Zone is approximately 118.279 square kilometers. (2) The boundary description of Shendurney Wildlife Sanctuary and its Eco-Sensitive Zone is appended in Annexure-I. (3) The Maps of the Eco sensitive Zone of Shendurney Wildlife Sanctuary are Appended as Annexure- II A, Annexure-II B and Annexure-II C. (4) Geo Coordinates on the boundary of Shendurney Wildlife Sanctuary and its Eco sensitive zone are appended at Annexure-III. (5) Three villages are located within the Eco-sensitive Zone of Shendurney Wildlife Sanctuary is appended at Annexure-IV. 2. Zonal Master Plan for Eco-Sensitive Zone- (1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment, Forest, and Wildlife; (ii) Rural Development (iii) Agriculture; (iv) Tourism; (v) Municipal common service; (vi) Land Revenue; (vii) State Pollution Control Board (viii) Irrigation and Public Works Department26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies, and the plan is supported by land use map. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of the local communities. (8) The Zonal Master Plan shall be co-terminus with the regional development plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government. - The State Government shall take the following measures for giving effect to the provisions of this notification, namely: - (1) Land use. – (a) Forests, horticulture area, agriculture area, Parks and open spaces earmarked for recreation purposes in the ESZ shall not be used or converted into areas for major commercial or major residential complex or industrial activities. Provided that the conversion of agriculture and other land within the ESZ for the purpose other than that specified at part A, may be permitted on the recommendation of the Monitoring committee and with the prior approval of the State Government, to meet the residential needs of local residents, such as (i) Widening and strengthening of existing roads and construction of new road; (ii) Construction and renovation of infrastructure and basic civic amenities; (iii) Small scale industries not causing pollution; (iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; (v) Promoted activities given in paragraph 4 Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph; (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies. - The catchment areas of all natural springs / rivers / channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan. (3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; (b) the Tourism Master Plan shall be prepared by the Department of Tourism in consultation with the Department of Revenue and Forests, Government of Kerala; (c) the Tourism Master Plan shall form a component of the Zonal Master Plan; (d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone; (e) the activities of eco-tourism shall be regulated as under, namely:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27 (i) New constructions of hotels and resorts shall not be permitted within the ESZ except for accommodation of temporary occupation of tourist related to eco-friendly tourism activities; Provided that extension of excising establishments may be allowed in accordance with the Zonal Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the ESZ shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest And Climate Change and the eco-tourism guideline issued by National Tiger Conservation Authorities (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development based on the carrying capacity study of the ESZ; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the monitoring committees. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artifacts, area and precincts of historical, architectural, aesthetic and cultural significance shall be identified in the ESZ and heritage conservation plan for their conservations shall be prepared within six months from the date of publication of final notification and incorporated in the Zonal Master Plan. (6) Noise pollution. - Prevention and Control of noise pollution in the ESZ shall be compiled with in accordance with Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto. (7) Air pollution. - Prevention and control of air pollution in the ESZ shall be compiled with in accordance with the prevention of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and rule made there under and amendments thereto. (8) Discharge of effluents. - The discharge of treated effluents in ECZ shall be in accordance with the provision of General Standards of Discharge of Environmental Pollutants covered under the Environmental (Protection) Act 1986 and rules made there under or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 and as amended from time to time; (b) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (c) No burning or incineration of solid wastes and establishment of landfills shall be permitted in the ESZ; (10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016; as amended from time to time. (b) No common treatment facility or incineration shall be permitted within the ESZ (11) Plastic waste management. - The Plastic Waste Management in the ESZ shall be carried out as per the provision of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR. 340 (E), dated the 18th march 2016, as amended from time to time. (12) Construction and demolition Waste Management. - The Construction and Demolition Waste Management in the ESZ shall be carried out as per the provision of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR.317 (E), dated 29th March, 2016 as amended from time to time.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (13) E-waste. - The E-waste management in the ESZ shall be carried out as per the provision of E-waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the Competent Authority in the state Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant acts and rules and regulation made there under. (15) Vehicular pollution. - Prevention and Control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc. (16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the ESZ; (b) Only non-polluting industries shall be allowed with in ESZ as per classification of industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification in addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) no construction on existing steep hill slopes or slopes with high degree of erosion shall be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone- All activities in the Shendurney Eco-sensitive Zone shall be governed by the provisions of the Wildlife (Protection) Act, 1972 (53 of 1972), the Forest (Conservation) Act, 1980 (69 of 1980) and the Environment (Protection) Act, 1986 (29 of 1986) and other Acts and Rules prevalent in the State. Forest area coming under the eco-sensitive zone will remain to be governed under existing forest laws. Subject to the provisions of this paragraph, the activities in the Eco-sensitive Zone shall be regulated in accordance with tabular column given below, namely:- Sl. No. Activity Description A. Prohibited Activities Commercial Mining, stone (a) All new and existing (minor and major minerals), stone 1. quarrying and crushing units quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within Eco-sensitive Zone; (b) The mining operations shall be carried out in accordance with the order(s) of the Hon’ble Supreme Court dated dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995; dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012; and IA No. 1000 of 2003 dated the 03rd June, 2022. Monitoring Committee for Monitoring the Eco-Sensitive Zone Notification- In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a committee to be called as the Shendurney Eco-sensitive Zone Monitoring Committee to monitor the compliance of this notification. The Monitoring Committee referred to in sub- paragraph (1) above, shall consist of the following members, namely:- Sl. The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and forests number S.O. 1533(E), dated the 14th September 2006 and are falling in ESZ, except for the prohibited activities as specified in the table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authority. 5. The Member Secretary of Monitoring Committee shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. 6. The Monitoring Committee may invite representatives or experts from concerned Departments or representative from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. 7. The Monitoring Committee shall submit the annual action taken report of its activities by the 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the state as per pro-forma given Annexure-V. 8. The central Government in the Ministry of Environment, Forests and Climate Change may give such direction, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 9. The central Government and State government may specify additional measures, if any, for giving effect to the provision of this notification 10. From there, the boundary runs along the Kazhuthurutty river up to a point near Edappalayam L.P.S. From there, the boundary runs along the reserve forest boundary, excluding Lekshamveedu colony, Arunadhayam colony, Thevarkadu colony and Asraya colony up to North a point at the Kazhuthurutti river and along the Kazhuthurutti river up to point 7.Thence along the reserve forest boundary, excluding Palaruvi enclosure, boundary reaches at Palaruvi checkpost and along the Palaruvi water fall road towards Kaduvappara thodu.
