(पी) संख्र्ा 259/84/एडी, तारीख 25.08.1984 के अधीन दकर्ा गर्ा था। र्ह अभर्ारण्र् 53 प्रिाजतर्ों के स्ट्तनधाररर्ों, 182 प्रिाजतर्ों के पजक्षर्ों, 46 प्रिाजतर्ों के सरीसृपों, 38 प्रिाजतर्ों के उभर्चरों, नेजल्लर्ामपथी पवातमाला की पजश्चमी ढलानों पर जस्ट्थत जचम्मोनी घाटी के िंगलों स े जमलकर बना ह,ै िो 4705 वगा दकलोमीटर क्षेत्र म ें फैल े अनामलाई-अनामडी संरक्षण इकाई की पाररजस्ट्थजतक जनरंतरता सुजनजश्चत करता ह।ै र्ह अभर्ारण्र् राज्र् के अनामडी हाथी अभ्र्ारण्र् का जहस्ट्सा है, जिसका कुल वन क्षेत्र 3728 वग ा दकलोमीटर ह ै और हाथी घनत्व 0.20 हाथी प्रजत वगा दकलोमीटर ह।ै र्ह अभर्ारण्र् प्राकृजतक सुंिरता से भरपूर िजक्षणी4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पजश्चमी घाट का एक उत्कृष्ट उिाहरण ह।ै इस अभर्ारण्र् में वैज्ञाजनक अनुसंधान और सरं क्षण जिक्षा की अपार संभावनाए ं ह।ैं और, पैरािाफ 1 में जवजनर्िष्टा जचम्मोनी वन्द्र्िीव अभर्ारण्र् की सीमाओं के आसपास के क्षेत्र को पाररजस्ट्थजतक, पर्ाावरणीर् और िैव जवजवधता के िजृ ष्टकोण से पाररजस्ट्थजतकी-संवेिी िोन के रूप में संरजक्षत और सुरजक्षत करना आवश्र्क ह,ै और उि पाररजस्ट्थजतकी-संवेिी िोन में उद्योगों र्ा उद्योगों के वगा और उनके संचालन और प्रदक्रर्ाओं को प्रजतजिद्ध करना आवश्र्क ह;ै अतः, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (अजधजनर्म 1986 का 29) (जिसे इस अजधसूचना म ें आग े पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की उपधारा (1) और उपधारा (2) के खंड (v) और (xiv) तथा धारा 3 की उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) के साथ परित, केन्द्द्रीर् सरकार एतद्द्वारा केरल राज्र् म ें जचम्मोनी वन्द्र्िीव अभ्र्ारण्र् की सीमा के आसपास 0 (िून्द्र्) से 7.5 दकमी तक के क्षेत्र को पाररजस्ट्थजतकी-संवेिी िोन(जिसे इसके बाि इस अजधसूचना में इस े पाररजस्ट्थजतकी-संवेिी िोन कहा गर्ा ह)ै के रूप म ें अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह:ै- 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार एव ं सीमाएाँ –(1) जचम्मोनी वन्द्र्िीव अभर्ारण्र् की सीमा के चारों ओर 0 (िून्द्र्) स े 7.5 दकमी तक पाररजस्ट्थजतकी-संवेिी िोन होगा और पाररजस्ट्थजतकी-संवेिी िोन का क्षेत्रफल 102.73 वग ा दकमी ह।ै जवजभन्न दििाओं में पाररजस्ट्थजतकी-संवेिी िोन का जवस्ट्तार नीचे दिर्ा गर्ा ह:ै दििा सरं जक्षत क्षत्रे की सीमा स ेदििा (दकमी म)ें उत्तर 0 पूवा 0.2 िजक्षण पूव ा 0 िजक्षण 2.08 - 7.07 िजक्षण पजश्चम 0.5 पजश्चम 1.94 - 7.5 िन्द्ू र् वन्द्र्िीव अभ्र्ारण्र् (पाररजस्ट्थजतकी-सवं िे ी िोन) का औजचत्र्: उत्तर दििा म,ें पीची-वाझानी वन्द्र्िीव अभ्र्ारण्र् के साथ सीमा साझा होन े के कारण पाररजस्ट्थजतकी-संवेिी िोन को िून्द्र् रखा गर्ा ह।ै िजक्षण-पूवी दििा में, परंजबकुलम बाघ अभ्र्ारण्र् के साथ सीमा साझा होने के कारण पाररजस्ट्थजतकी-संवेिी िोन को िन्द्ू र् रखा गर्ा ह।ै (2) जचम्मोनी वन्द्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी-संवेिी िोन की सीमा का जववरण अनलु ग्नक-Iक और अनलु ग्नक-Iख के रूप म ेंसंलग्न ह।ै (3) जचम्मोनी वन्द्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी-संवेिी िोन के मानजचत्र अनलु ग्नक-IIक, अनलु ग्नक-IIख और अनलु ग्नक-IIग के रूप में सलं ग्न ह।ैं (4) जचम्मोनी वन्द्र्िीव अभर्ारण्र् और पाररजस्ट्थजतकी-संवेिी िोन की सीमा के भौगोजलक जनिेिांकों की सूची अनलु ग्नक-IIIक और अनलु ग्नक-IIIख के रूप म ेंसंलग्न ह।ै (5) प्रस्ट्ताजवत पाररजस्ट्थजतकी-सवं ेिी िोन में आन े वाले गांवों की सूची अनलु ग्नक-IV म ेंिी गई ह।ै 2 . जचम्मोनी वन्द्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख स े िो विा की अवजध[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा स े और राज्र् के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसूचना में दिए गए उपबंधों का पालन करते हुए आंचजलक महार्ोिना तैर्ार करेगी। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसूचना के उपबंधों के अनुसार तथा केंद्रीर् और राज्र् जवधानों के सुसंगत और केंद्रीर् सरकार द्वारा िारी मागाििाक जसद्धांतों, र्दि कोई हों, अनुरुप तैर्ार दक िाएगी। (3) आंचजलक महार्ोिना, राज्र् सरकार के जनम्नजलजखत जवभागों के परामिा स े दक िाएगी तादक पाररजस्ट्थजतकी और पर्ाावरणीर् िजृ ष्टकोणों को एकीकृत दकर्ा िा सके.- (i) पर्ाावरण; (ii) वन; (iii) िहरी जवकास; (iv) पर्ाटन; (v) नगरपाजलका; (vi) रािस्ट्व; (vii) लसंचाई; (viii) स्ट्थानीर् स्ट्विासन जवभाग; (ix) लोक जनमााण जवभाग; (x) राज्र् प्रििू ण जनर्ंत्रण बोड।ा (4) आंचजलक महार्ोिना म ें अनुमोदित भ-ू उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा िब तक इस अजधसूचना म ें ऐसा जवजनर्िाष्ट न हो, तथा आचंजलक महार्ोिना की सभी अवसंरचनाओं और उसके दक्रर्ाकलापों म ें सुधार करके उन्द्ह ेअजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनान े की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना, वनों की कटाई से प्रभाजवत क्षेत्रों के पुनास्ट्थापन, मौिूिा िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भ-ू िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐस े अन्द्र् पहलओंु का उपाबंध दकर्ा िाएगा, जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह ै। (6) आंचजलक महार्ोिना म ें सभी मौिूिा पूिा स्ट् थलों, िामों और िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों और दकस्ट् मों, कृजि क्षेत्रों, उपिाऊ भूजम, उद्यानों और उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा, सहार्क मानजचत्रों के साथ जिनम ें मौिूिा तथा प्रस्ट्ताजवत भ-ू उपर्ोग जविेिताओं के ब्र्ौरों का जनधाारण दकर्ा िाएगा। (7) इस आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी-संवेिी िोन के जवकास को जवजनर्जमत दकर्ा िार्ेगा और पैरा 4 म ें सूचीबद्ध प्रजतजिद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन दकर्ा िाएगा और स्ट् थानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजश्चत दकर्ा िाएगा और उसका संवधान दकर्ा िार्ेगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) इस प्रकार अनुमोदित आंचजलक महार्ोिना, इस अजधसचू ना के उपबंधों के अनुसरण म ें जनगरानी कार्ों को परू ा करने के जलए जनगरानी सजमजत के जलए संिभ ा िस्ट्तावेि होगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्. - राज्र् सरकार अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्: - (1) भ-ू उपर्ोग. – (क) पाररजस्ट्थजतकी-संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खुल े स्ट्थानों का मुख्र् वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा पररवतना की अनुमजत नहीं होगी: बिते दक जनगरानी सजमजत की जसफाररि पर केंद्र तथा राज्र् सरकार के िहरी जनर्ोिन अजधजनर्म तथा अन्द्र् जनर्मों एव ं जवजनर्मों र्था लाग,ू के अधीन तथा इस अजधसूचना के उपबंधों के पूवा अनुमोिन स े पाररजस्ट्थजतकी-संवेिी िोन के भीतर कृजि और अन्द्र् भूजम के गैर कृजि उपर्ोह के रुपान्द्तरण को स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं और दक्रर्ाकलापों को पूरा करन े के जलए अनुमजत िी गई ह,ै िैसे,- (i) मौिूिा सड़कों को चौड़ा और मिबूत करना और नई सड़कों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का जनमााण और नवीनीकरण; (iii) प्रििू ण उत्पन्न न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योग सजहत िाम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और (v) पैरािाफ-4 के मि में र्था उजल्लजखत प्रोन्नत दक्रर्ाकलापः परंतु र्ह भी दक राज्र् सरकार के पूवा अनुमोिन के जबना और संजवधान के अनुच्छेि 244 र्ा अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) सजहत वतामान म ें लाग ू जवजधर्ों के उपबंधों के अनुपालन के जबना वाजणजज्र्क और औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के दकसी भी उपर्ोग की अनुमजत नहीं िी िाएगी: परंत ु र्ह भी दक पाररजस्ट्थजतकी-संवेिी िोन के अधीन आने वाली भूजम के अजभलेखों म ें हुई दकसी त्रुरट को, जनगरानी सजमजत के जवचार प्राि करने के पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार सुधारा िाएगा और उि त्रुरट को सुधारने की सूचना केंद्रीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह भी दक उपर्िुा त्रुरट को सुधारन े म,ें इस उप-परै ा म ें र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भ-ू उपर्ोग का पररवतान सजम्मजलत नहीं होगा: (ख ) अप्रर्ुि र्ा अनुत् पािक कृजि क्षेत्रों म ें वनीकरण तथा पर्ावा ासों की बहाली के कार्ाकलापों स े पुन: वनीकरण दकए िान े के प्रर्ास दकए िाएंगे। (2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक झरनों/नदिर्ों/चैनलों के िलिहण क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और पुनरुद्धार की र्ोिनाओं को आंचजलक महार्ोिना म ें सजम्मजलत दकर्ा िाएगा। (3) पर्टा न र्ा पारर-पर्टा न – ( क)पाररजस्ट्थजतकी संवेिी िोनके भीतर सभी नए पारर-पर्ाटन दक्रर्ाकलाप र्ा मौिूिा पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन सबं ंधी पर्ाटन महार्ोिना के अनसु ार होगा। (ख) पर्ाावरण और वन जवभाग के परामिा से राज्र् पर्ाटन जवभाग, केरल सरकार द्वारा पर्ाावरण-पर्ाटन आंचजलक महार्ोिना तैर्ार दकर्ा िाएगा।; (ग) पर्ाटन महार्ोिना, आंचजलक महार्ोिना का घटक होगी; (घ) पर्ाटन महार्ोिना, पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी; (ङ) पारर-पर्ाटन संबंधी दक्रर्ाकलाप जनम्न ानुसार जवजनर्जमत दकए िाएंगे, अथाात:् -[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (i) जचम्मोनी वन्द्र्िीव अभर्ारण्र् की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकट हो, होटलों और ररसॉट्सा का नर्ा जनमााण करन े की अनुमजत नहीं होगी: बिते दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर की िरू ी से परे, पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, नए होटल और ररसॉटा की स्ट्थापना केवल पर्ाटन आचं जलक महार्ोिना के अनुसार पर्ाावरण पर्ाटन सुजवधाओं के जलए पूवाजनधााररत और जवजनर्िाष्ट क्षेत्रों में ही अनमु त होगी; (ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दक्रर्ाकलापों र्ा मौिूिा पर्टा न दक्रर्ाकलापों का जवस्ट्तार केंद्र सरकार के वन और िलवार् ु पररवतान मंत्रालर् द्वारा िारी मागाििाक जसद्धांतों और राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरणों द्वारा िारी पाररजस्ट्थजतकी पर्ाटन मागाििका जसद्धांतों (समर्-समर् पर संिोजधत) के अनुसार होगा; जिसमें पर्ाावरण-पर्ाटन पर जविेि िोर दिर्ा िाएगा। (iii) िब तक इस आंचजलक महार्ोिना को अनुमोदित नहीं कर दिर्ा िाता तब तक पर्टा न के जवकास और मौिूिा पर्टा न दक्रर्ाकलापों के जवस्ट्तार की अनुमजत संबंजधत जवजनर्ामक प्राजधकरणों के द्वारा स्ट्थल जवजिष्ट संवीक्षा और जनगरानी सजमजतर्ों की जसफाररि के आधार पर िी िाएगी और पाररजस्ट्थजतकी सवं ेिी िोन के भीतर दकसी भी नए होटल, ररसॉटा र्ा वाजणजज्र्क प्रजतष्ठान के जनमाणा की अनुमजत नहीं िी िाएगी। (4) प्राकृजतक जवरासत – पाररजस्ट्थजतकी संवेिी िोन के अधीन आने वाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैस े दक िीन पूल ररजवा क्षत्रे , िैल सरं चना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ेंएक जवरासत सरं क्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल - पाररजस्ट्थजतकी संवेिी िोन म ें ऐजतहाजसक, स्ट्थापत्र्, सौंिर्ा और सांस्ट्कृजतक महत्व के भवनों, संरचनाओं, कलाकृजतर्ों, क्षेत्रों और पररसरों की पहचान की िाएगी और उनके संरक्षण के जलए जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रूप में तैर्ार की िाएगी। (6) ध्व जन प्रििू ण –पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रििू ण की रोकथाम और जनर्ंत्रण पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और समर्-समर् पर संिोजधत उपबधं ों के अधीन ध्वजन प्रििू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 के अनुसार दकर्ा िाएगा। (7) वार् ु प्रििू ण -पाररजस्ट्थजतकी संवेिी िोन म ें वार् ु प्रििू ण की रोकथाम और जनर्ंत्रण वार् ु (प्रििू ण की रोकथाम और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्म और उसके संिोधनों के अनुसार की िाएगी। (8) बजहस्राव का जनस्ट्सरण - पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत अपजिष्टों का जनवाहन पर्ाावरण (संरक्षण) अजधजनर्म 1986 और उसके अधीन बनाए गए जनर्मों र्ा राज्र् सरकार द्वारा जनधााररत मानकों, िो भी अजधक किोर हो, के अधीन आन े वाले पर्ाावरण प्रििू कों के जनवाहन के सामान्द्र् मानकों के उपबंधों के अनुसार होगा। (9) िोस अपजिष्ट - िोस अपजिष्ट का जनपटान एवं प्रबधं न जनम्नानुसार दकर्ा िाएगा, - (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट जनपटान एव ं प्रबधं न भारत सरकार के पर्ाावरण, वन एव ं िलवार् ु पररवतान मंत्रालर् द्वारा अजधसचू ना संख्र्ा का.आ. 1357 (अ), तारीख 8 अप्रैल, 2016 के माध्र्म से प्रकाजित िोस अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा, जिसमें समर्-समर् पर सिं ोधन दकए गए ह;ैं अकाबाजनक पिाथों का जनपटान पर्ाावरण के अनुकूल तरीके से पाररजस्ट्थजतकी संवेिी िोन के बाहर जवजनर्िाष्ट स्ट्थल पर दकर्ा िा सकता ह।ै8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) पर्ाावरण संवेिनिील क्षेत्र में जचजन्द्हत प्रौद्योजगदकर्ों का उपर्ोग करते हुए, मौिूिा जनर्मों और जवजनर्मों के अनुरूप िोस अपजिष्टों का सुरजक्षत और पर्ाावरण के अनकु ूल प्रबंधन (ईएसएम) करन े की अनुमजत िी िा सकती ह।ै (10) िवै जचदकत्सा अपजिष्ट- िैवजचदकत्सा अपजिष्ट प्रबंधन जनम्नानसु ार होगा- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना समर्-समर् पर संिोजधत, स. सा.का.जन.343(अ), तारीख 28 माच,ा 2016 के अधीन प्रकाजित िैव-जचदकत्सा अपजिष्ट प्रबंधन जनर्म, के अनसु ार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में जवजनर्िाष्ट प्रौद्योजगदकर्ों का उपर्ोग करत े हुए, मौिूिा जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्टों का सुरजक्षत और पर्ाावरण के अनुकूल प्रबंधन (ईएसएम) करने की अनुमजत िी िा सकती ह।ै (11) पलाजस्ट्टक अपजिष्ट का प्रबधं न -पाररजस्ट्थजतकी संवेिी िोन म ें पलाजस्ट्टक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा, समर्-समर् पर संिोजधत; अजधसचू ना स. सा.का.जन. 340(अ), तारीख 18 माचा, 2016 के अधीन प्रकाजित पलाजस्ट्टक अपजिष्ट का प्रबधं न जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न - पाररजस्ट्थजतकी संविे ी िोन में जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा, समर्-समर् पर संिोजधत अजधसूचना स. सा.का.जन. 317(अ), तारीख 29 माचा, 2016 के अधीन प्रकाजित जनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट - पाररजस्ट्थजतकी संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित ई–अपजिष्ट प्रबंधन जनर्म,2016 , समर्-समर् पर संिोजधत; के उपबंधों के अनुसार दकर्ा िाएगा। (14) सड़क-र्ातार्ात - सड़क-र्ातार्ात को पर्ाावास अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना में जविेि उपबंध सजम्मजलत दकए िाएंग।े आंचजलक महार्ोिना के तैर्ार होन े और राज्र् सरकार के सक्षम प्राजधकारी स े अनुमोदित होन े तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके अधीन बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार सड़क-र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन िजनत प्रििू ण - वाहन िजनत प्रििू ण की रोकथाम और जनर्ंत्रण लागू जवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईधनों िैसे संपीजड़त प्राकृजतक गैस, द्रवीकृत पेरोजलर्म गैस, आदि के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ा-ं (क) आजधकाररक रािपत्र में इस अजधसूचना के प्रकािन पर र्ा उसके पश्चात ् पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए प्रििू णकारी उद्योग की स्ट्थापना की अनुमजत नहीं िी िाएगी; (ख) केन्द्द्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा फरवरी, 2016 में िारी जसद्धान्द्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी-संवेिी िोन के भीतर केवल गरै -प्रििू णकारी उद्योगों को अनुमत दकर्ा िाएगा और इसके अजतररि, गरै प्रििू णकारी कुटीर उद्योगों का संवधान दकर्ा िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 (17) पहाड़ी ढलानों का सरं क्षण -पहाड़ी ढलानों का संरक्षण जनम्नानसु ार दकर्ा िाएगा :- (क) आंचजलक महार्ोिना म ें पहाड़ी ढलानों के उन क्षेत्रों को ििार्ा ा िाएगा जिनम ें दकसी भी जनमााण की अनुज्ञा नहीं होगी; (ख) जिन ढलानों र्ा मौिूिा खड़ी पहाड़ी ढलानों म ें अत्र्जधक भ-ू क्षरण होता ह ै उनम ें दकसी भी जनमााण की अनुमजत नहीं होगी। 4. पाररजस्ट्थजतकी सवं िे ी िोन म ेंजनिधे र्ा जवजनर्जमत दकए िान ेवाल ेदक्रर्ाकलापों की सचू ी - जचम्मोनी वन्द्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी-संवेिी िोन में सभी दक्रर्ाकलाप पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986का 29), वन्द्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972का 53), वन अजधजनर्म, 1927 (1927का 16), वन (संरक्षण) अजधजनर्म, 1980 (1980का 69) और अन्द्र् लागू जवजधर्ों, जिनमें तटीर् जवजनर्मन क्षेत्र (सीआरिडे ), 2011, पर्ाावरण समाघात जनधाारण (ईआईए) अजधसूचना, 2006 और उसमें दकए गए संिोधन तथा राज्र् में प्रचजलत अन्द्र् अजधजनर्म सजम्मजलत ह,ैं के उपबंधों द्वारा िाजसत होंगी। सारणी क्रम स.ं तत्काल प्रभाव से प्रजतबंजधत दकर्ा िाता है। (ख) खनन कार् ा माननीर् उच्चतम न्द्र्ार्ालर् के तारीख 4 अगस्ट्त, 2006 के आिेि (टी.एन. गोिावमान जथरुमलु पाि बनाम भारत संघ के मामले म,ें ररट र्ाजचका संख्र्ा 202/1995) और तारीख 21 अप्रलै , 2014 के आििे (गोवा फाउंडिे न बनाम भारत सघं के मामल े म,ें ररट र्ाजचका संख्र्ा 435/2012); और आईए संख्र्ा 1000 वि ा 2003 तारीख 03 िून, 2022। आईए संख्र्ा 131377 विा 2022, तारीख 26 अप्रलै , 2023 और 28 अप्रलै , 2023 के जनणार् और आईए संख्र्ा 162023, 162034, 162154 और 162155 वि ा 2025 म ें तारीख 23 िुलाई 2025 के पश्चात् के जनणार् र्ा खनन के संबंध म ें कोई और आिेि के अनुसार दकए िाएगं े। 2. प्रि िू ण (िल, वार्,ु मृिा, ध्वजन, पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और मौिूिा प्रििू णकारी उद्योगों का जवस्ट्तार करने की अनुमजत नहीं होगी। आदि) उत्पन्न करने वाले उद्योगों की स्ट्थापना । केन्द्द्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा फरवरी, 2016 में, समर् समर् पर र्था संिोजधत, िारी मागाििका जसद्धान्द्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें भस्ट्मीकरण सुजवधा की स्ट्थापना की अनुमजत नहीं िी िाएगी। 7. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी-संवेिी िोन के भीतर नई र्ा मौिूिा आरा जमलों के जवस्ट्तार की अनुमजत नहीं होगी। 8. ईंट भट्टों की स्ट्थापना। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे। 9. िल ावन लकड़ी का वाजणजज्र्क लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे। उपर्ोग। 10. राष्ट्र ीर् उद्यान क्षेत्र के ऊपर दकसी लाग ू जवजधर्ों के अनुसार िा सकते ह।ैं 12. संज नमााण दक्रर्ाकलाप। (क) संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी-संवेिी िोन के जवस्ट्तार तक, िो भी जनकट हो, दकसी[भाग II—खण् ड 3(ii)] भारत का रािपत्र : होंगे। 13. गैर प्रििू णकारी लघ ु उद्योग। फरवरी, 2016 म ें केन्द्द्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा िारी और समर् समर् पर र्था संिोजधत उद्योगों के वगीकरण के अनुसार गरै - प्रििू णकारी उद्योग और अपररसंकटमर्, लघ ु और सेवा उद्योग, कृजि, पुष्प कृजि, उद्यान कृजि र्ा पाररजस्ट्थजतकी संवेिी िोन की अपनी सामिी से उत्पािों को उत्पन्न करने वाले कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुमजत प्राि होंगे। 14. वृक्ष ों की कटाई । (क) राज्र् सरकार म ें सक्षम प्राजधकारी की पूव ा अनुमजत के जबना वन र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं की िाएगी। (ख) वृक्षों की कटाई सम्बद्ध केंद्रीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होंगे। 15. वन उत्पािों और गरै काष्ठ वन अनुसूजचत िनिाजत और अन्द्र् पारंपररक वनवाजसर्ों [वन अजधकार उत्पािों सरकार, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, एतद्द्वारा एक सजमजत का गिन करती ह ै जिसे जनगरानी सजमजत कहा िाएगा, िो इस जनगरानी करेगी। (2) जनगरानी सजमजत का कार्का ाल तीन (3) वि ा का होगा र्ा राज्र् सरकार द्वारा नई सजमजत के पुनगािन तक का होगा और उसके बाि राज्र् सरकार द्वारा जनगरानी सजमजत का गिन दकर्ा िाएगा। (3) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ा का.आ. 1553 (अ), तारीख 14 जसतंबर, 2006 की अनुसूची म े सजम्मजलत ह ै और िो पाररजस्ट्थजतकी संवेिी िोन में आते हैं, जसवार् इसके पैरािाफ 4 के अधीन सारणी में र्था जवजनर्िाष्ट प्रजतजिद्ध दक्रर्ाकलापों के जनगरानी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूव ा पर्ाावरण अनापजत्त के जलए केन्द्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् र्ा र्थाजस्ट्थजत, राज्र् पर्ाावरण समाघात जनधाारण प्राजधकारी को जवजनर्िाष्ट दकर्ा िाएगा। (4) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ा का.आ. 1553 (अ), तारीख 14 जसतंबर, 2006 की अनुसूची म े सजम्मजलत ह ैऔर िो पाररजस्ट्थजतकी संवेिी िोन में आत े हैं, जसवार् इसके पैरािाफ 4 के अधीन सारणी म ें र्था जवजनर्िाष्ट प्रजतजिद्ध दक्रर्ाकलापों के जनगरानी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे सम्बद्ध जवजनर्ामक प्राजधकरणों को जवजनर्िाष्ट दकर्ा िाएगा। (5) जनगरानी सजमजत के सिस्ट्र् सजचव इस अजधसूचना के उपबंधों का उल्लघं न करन े वाले दकसी भी व्यजि के जवरुद्ध पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के अधीन जिकार्त फाइल करन े के जलए सक्षम होंगे। (6) जनगरानी सजमजत मामला-िर मामला के आधार पर अपक्षे ाओं पर जनभार रहत े हुए सम्बद्ध जवभाग के प्रजतजनजध र्ा जविेिज्ञ, औद्योजगक सगं मों र्ा पणधाररर्ों के प्रजतजनजध को अपने जवचार-जवमिा म ेंसहार्त के जलए आमंजत्रत कर सकेगी। (7) जनगरानी सजमजत म ें जवजनर्िाष्ट जनििान पत्र प्रत्र्ेक वि ा के 31 माचा तक की अवजध के अपने दक्रर्ाकलापों की वार्िाक कारावाई ररपोटा उस विा के 30 िून तक राज्र् के मुख्र् वन्द्र्िीव संरक्षक को अनलु ग्नक–V प्रस्ट्तुत करेगी। (8) केन्द्द्रीर् सरकार का पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् जनगरानी सजमजत को उसके कार्ा-कलापों के प्रभावी जनवाहन AND WHEREAS, the major fishes found in the Chimmony Wildlife Sanctuary include Common Carp (Cyprinus caprio communis), Scarlet banded (Puntis amphibious), Giant danio (Danio aequipinnatus), Guenther's loach (Nemacheilus guentheri), Triangular banded (Nemacheilus triangularis), Denson's loach (Nemacheilus denisoni), Malabar loach (Lepidocephalus thermalis), Striped dwarf catfish (Mystus vittalus), Indian butter catfish (Ompok bimaculatus Bloch), Stinging catfish (Heteropnuestès fossilitus Bloch), and Fresh water garfish (Xenentodon cancila Ham.), among many others. AND WHEREAS, the major butterflies found in the Chimmony Wildlife Sanctuary include Plain Cupid (Luthrodes pandava), Angled Pierrot (Caleta decidia), Common Cerulian (Jamides celeno), Common hedge blue (Acytolepis puspa), Common Bluebottle (Graphium sarpedon), Crimson rose (Atrophaneura hector), Common Emigrant (Catopsilia pomona), Chestnut streaked Sailer (Neptis jumbah), Blue Tiger (Tirumala limniace), Slate Flash (Rapala manea), Chestnut Angle (Odontoptilum angulata), Red Helen (Papilio helenus), Mottled Emigrant (Catopsilia pyranthe), and Chocolate Pansy (Junonia iphita), among several others. AND WHEREAS, the forests of the sanctuary embracing the Chimmony Reservoir attains greatest conservation value by providing irrigation water to thousands of hectares of agricultural land in Thrissur District and hence the prime reason for protecting and developing the sanctuary for posterity. AND WHEREAS, the sanctuary area mainly comprises of forests in the Chimmony valley on the western slopes of the Nelliampathies, which ensures ecological continuity of the Anamalai-Anamudi conservation unit, covering an area of 4705 sq. km. The sanctuary is part of the Anamudi Elephant Reserve in the State, with a total forest area of 3728 sq. km. with a density of 0.20 elephants/sq.km. The sanctuary is a representative example of the southern Western Ghats with scenic splendour. The Sanctuary has high potential for scientific research and conservation education. AND WHEREAS, it is necessary to conserve and protect the area, surrounding the boundaries of Chimmony Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological,26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (Act 29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying of 0 (zero) to 7.5 km around the boundary of Chimmony Wildlife Sanctuary in the State of Kerala as Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and boundaries of Eco-Sensitive Zone- (1) The Eco-sensitive Zone shall be to an extent of 0 (zero) to 7.5 km around the boundary of Chimmony Wildlife Sanctuary and the area of the Eco-sensitive zone is 102.73 sq. km. The extent of Eco-sensitive Zone at various directions is given below: Direction From the Boundary of the Protected Area (in km) North 0 East 0.2 South East 0 South 2.08 - 7.07 South West 0.5 West 1.94 - 7.5 Justification for 0 (zero) ESZ: Towards north direction, ESZ is kept zero due to sharing of boundary with Peechi-Vazhani Wildlife Sanctuary. In the south-eastern direction, ESZ is kept zero due to sharing of boundary with Parambikulam Tiger Reserve. (2) The boundary description of Chimmony Wildlife Sanctuary and its Eco-sensitive zone is appended as Annexure-IA and Annexure-IB. (3) The maps of Eco-sensitive zone of Chimmony Wildlife Sanctuary are appended as Annexure-IIA, Annexure-IIB and Annexure-IIC. (4) List of geo-coordinates of the boundary of Chimmony Wildlife Sanctuary and Eco-Sensitive Zone is appended as Annexure-IIIA & Annexure-IIIB. (5) The list of villages falling in the proposed eco-sensitive zone is given in Annexure-IV. 2. Zonal Master Plan for the Chimmony Wildlife Sanctuary Eco-Sensitive Zone. (1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27 (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest; (iii) Urban Development; (iv) Tourism; (v) Municipal; (vi) Revenue; vii) Irrigation; viii) Local Self Government Department; ix) Public Works Department; x) State Pollution Control Board. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of the local communities (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government. - The State Government shall take the following measures for giving effect to the provisions of this notification, namely: (1) Land use. - (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purpose in the Eco-Sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Provided that the conversion of agriculture and other land within the ESZ for the purpose other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring committee and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents such as: (i) Widening and strengthening of the existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution (iv) Cottage industries including village industries; convenience stores and local amenities supporting ecotourism including home stay; and (v) Promoted activities and given under para 4 Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provision of the article 224 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 ( 2 of 2007): Provided also that any error appearing in the land records with in the Eco-Sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said errors shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that above correction of error shall not include change of land use in any case except as provided under this sub-paragraph; (b) Efforts shall be made to reforest the unused or unproductive agriculture areas with afforestation and habitat restoration activities. (2) Natural water bodies. - The catchment areas of all-natural springs/rivers/channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the zonal master plan. (3) Tourism or Eco-Tourism. - (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the eco sensitive zone;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 29 (b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment, Forests and Wildlife, in association with State Department of Tourism, Government of Kerala; (c) the Tourism Master Plan shall form a component of the Zonal Master Plan; (d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco- sensitive Zone; (e) the activities of eco-tourism shall be regulated as under, namely:- i. No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Chimmony Wildlife Sanctuary or up to the extent of the Eco-Sensitive Zone whichever is nearer: Provided that beyond the distance of the 1 km from the boundaries of the protected area till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in predefined and designated areas for eco-tourism facilities as per Tourism Master Plan; ii. all new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the Eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism. iii. until the zonal master plan is approved, development for tourism and expansion of existing tourism activities in the Eco-Sensitive Zone areas falling outside forest lands shall be permitted by the concerned regulatory authorities based on the actual site-specific scrutiny and recommendation of the monitoring committee and no new hotels/ resorts or commercial establishment construction is permitted within Eco-Sensitive Zone Area. (4) Natural Heritage.- All sites of valuable natural heritage in the Eco-Sensitive Zone, such as the gene pool reserve areas, rock formations waterfalls, springs, gorges, groves, caves, points, walks rides, cliffs, etc. shall be identified and preserved and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master plan. (5) Man-made Heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-Sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-Sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto.30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (7) Air Pollution. - Prevention and control of air pollution in the Eco-Sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made there under and amendments thereto. (8) Discharge of effluents. - Discharge of treated effluents in Eco-Sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made there under or standards stipulated by State Government whichever is more stringent. (9) Solid wastes. - Disposal and Management of solid wastes shall be as under:- a. the solid waste disposal and management in the Eco-Sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357(E), dated the 8th April, 2016 and as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-Sensitive Zone; b. Safe and Environmentally Sound Management (ESM) of solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco- Sensitive Zone. (10) Bio-Medical Waste.- Bio medical waste management shall be as under:- a. The bio-medical waste disposal in the Eco-Sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343(E), dated the 28th March, 2016; as amended from time to time. b. Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (11) Plastic Waste Management.- The Plastic Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and Demolition Waste Management. - The Construction and Demolition Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317(E) , dated the 29th March, 2016 as amended from time to time. (13) E-Waste. - The E-Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate change and as amended from time to time.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 31 (14) Vehicular Traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in the regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made there under. (15) Vehicular pollution. - Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel like CNG, LPG, etc. (16) Industrial units.- a. On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-Sensitive Zone. b. Only non-polluting industries shall be allowed within Eco-Sensitive Zone as per Classification of Industries in the guidelines issued by Central Pollution Control Board in February 2016, as amended from time to time, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- a. the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; b. no construction on existing steep hill slopes or slopes with higher degree of erosion shall be permitted. 4. List of Activities Prohibited or to be regulated within Eco-Sensitive Zone.- All activities in the Eco-Sensitive Zone of Chimmony Wildlife Sanctuary shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986), Wildlife (Protection) Act, 1972 (53 of 1972), Forest Act, 1927 (16 of 1927), Forest (Conservation) Act, 1980 (69 of 1980) and other applicable laws including the Coastal Regulation Zone (CRZ), 2011, Environmental Impact Assessment (EIA) Notification, 2006, and amendments made thereto and other Acts prevalent in the State. The forest area coming under the Eco-sensitive Zone will remain to be governed under existing forest laws and amendments made thereto. Subject to the provisions of this paragraph, the activities in the Eco-sensitive Zone shall be regulated in manner specified in the Table below, namely:- Table Sl. No. Activity Description A. Construction Activities a) No new commercial construction of any kind shall be permitted within one kilometre from the boundaries of the protected areas or up to the extent of Eco-sensitive Zone or whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residence such as: i. Widening and strengthening of existing roads and construction of new roads; ii. Construction and renovation of infrastructure and civic amenities; iii. Small scale industries not causing pollution; iv. Cottage industries including village artisans; convenience stores and local amenities supporting eco-tourism; and v. Promoted activities listed in this notification. Provided that the construction activity related to small scale industries not causing pollution shall be regulated at the minimum, with the prior permission from the Competent Authority as per applicable rules and regulations, if any. vi. Beyond one kilometre, it shall be regulated as per the Zonal Master Plan. 11. Small scale Non-polluting Non-polluting industries as per classification of Industries issued industries by the Central Pollution Control Board in February 2016 and as amended from time to time and non-hazards, small-scale and service industry, agriculture, floriculture, horticulture or agro- based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the Competent Authority. 12. Felling of Trees (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government. Monitoring Committee for Monitoring the Eco-Sensitive Zone Notification- In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Committee to be called as the Monitoring Committee, to monitor and ensure the compliance with the provisions of this notification. The Monitoring Committee referred to in sub-paragraph (1) above, shall consist of the following members, namely:- Sl. No. Constituent of the Monitoring Committee Designation (i) The District Collector, Thrissur, Palakkad Chairman; (ii) The District Panchayat President, Thrissur Member; (iii) Representatives of Kerala State Pollution Control Members; Board/Kerala State Electricity Board/Kerala Water Authority/Kerala State Irrigation Department / Kerala State Environment Department (iv) Representative of Non-Governmental Organization Member; working in the field of natural conservation (including heritage conservation) to be nominated by the Government of Kerala (v) One expert in Ecology from reputed Institution or Member; University of the State of Kerala to be nominated by the Government of Kerala (vi) The Wildlife Warden, Peechi Wildlife Division Member Secretary. 6. Terms of Reference of the Monitoring Committee - (1)The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee is for three (3) years or till the re constitution of the new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government. (3) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September 2006, and are falling in Eco-sensitive Zone, except for the prohibited activities as specified in the table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in Eco-sensitive Zone, except for the prohibited activities as specified in the table under36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authority. (5) The Member Secretary of Monitoring Committee shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments or representative from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the state as per pro-forma given Annexure-V, appended to this notification. (8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such direction, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures. - The Central Government and State government may specify additional measures, if any, for giving effect to the provision of this notification. 8. Supreme Court, etc. orders. - The provision of this notification shall be subject to the orders, if any, passed or to be passed, by the Hon'ble Supreme Court of India or the High Court or National Green Tribunal. [F. No. 25/96/2015-ESZ-RE] Dr. S. KERKETTA, Scientist ‘G’[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 37 Annexure IA Boundary description of Chimmony Wildlife Sanctuary Direction Description The boundary lines starts from a station at about 1.2 km north-east of Mangattukomban along the inter taluk boundary of Thrissur and Mukundapuram and runs along the above said North boundary towards east and meets with the district boundary of Thrissur and Palakkad, at Ponmudi at a height point of 3045 ft. Thence the boundary line runs along the inter district boundary of Thrissur and Palakkad and reaches at Pumalai at a height point of 3665’ passing height 1930’, 2839’, 1702’, 3045’, East 2685’ and 2534’ and thence the line runs towards south-west direction and meets with Mundavalichal at about ½ km west of Kavalai incline passing height point of 1750’. Thence the boundary line runs along the north of Muduvarachal towards southwest direction till the above chal meets with the Muplipuzha and thence along the northern bank of South Muplipuzha till it reaches a station at about 1 km upstream of Mupli where Valkattuthodu joins with Muplipuzha. Thence the boundary runs along the southern bank of Valkattuthodu towards southeast direction for a distance of about 1.5 km and thence to northeast direction and reaches at height point of 250’ and then the boundary runs towards northeast direction for about 1 km. and thence towards northwest direction till it reaches at Chimmonypuzha at about 2.50 km. West upstream of Chimmonypuzha from Anaipadam passing height points 1070’, 1250’ and 1327’ and forming in a Parabolic shape. Thence the boundary runs along the southern bank of the Chimmonypuzha towards east for about 3 km. till it reaches at Chimmony at a height point of 135’ and thence the boundary runs towards northwest direction and reaches at the starting point of the northern boundary of the area.38 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Annexure IB Boundary Description of the Eco-Sensitive Zone of Chimmony Wildlife Sanctuary Direction Description The boundary lines starts from the GPS point No. 1 (N10° 28’11.9” and E076° 25’06.9”) on the Maghattukomban, common boundary of Peechi- Vazhani and Chimmony Wildlife North Sanctuaries and runs towards the east along the Sanctuary boundary to meets Ponmudi, GPS point 2 (N100 29’05.2”, E76028’47.1”), here the width of Eco-sensitive zone is Zero. Thence the boundary runs towards the southeast direction, 200 meters away from the Sanctuary boundary till it reaches Karumalamudi (tri-junction of Alathur Range, Chimmony East WLS & Parambikulam TR), GPS point 3 (N10026’00.0”, E76033’35.1”), here the width of ESZ is 200 meters, due to the steep slope towards eastern side. From here, the boundary runs towards the southwest direction along the Sanctuary boundary South East till it reaches Kavala, GPS point 4 (N 10023’02.2”, E76032’03.3”), here, the Sanctuary share its boundary with Parambikulam Tiger Reserve, hence the extent of ESZ is Zero. Thence, the boundary runs towards east along the old range boundary of Pariyaram and Vellikulangara till it meets Kannankuzhitodu, GPS point 5 (N10022’50.8”, E76033’12.8”), from here the boundary runs towards south along the western bank of Kannankuzhitodu till it reaches GPS point 6 (N10019’32.6”, E76033’20.5”) near to Koranganpara. From here, the boundary runs towards the west along the trek path till it reaches Randukai GPS point 7 South (N10020’56.9”, E76028’10.5”). From here, the boundary further runs towards the west along the Reserve Forest boundary till it reaches Erungana, GPS point 8 (N10021’29.7. E76025’17.7). Thence, the boundary runs towards the northeast direction along the range boundaries of Vellikulangara and Pariyaram, till it meets the Sasthampoovam (10°21'58.03"N, 76°26'41.37"E). In this stretch, the width of the ESZ ranges from 2.08 km to 7.07 kilometres. From here, the boundary runs towards the northwest direction 500 meters away from the South West Sanctuary boundary till it reaches GPS point 9 (N10023’35.6”, E76025’13.5”). Thence, the boundary runs along the eastern bank of Mupli Puzha, till it reaches the point where Chimmony Puzha confluence Mupli Puzha. From here, the boundary runs along the southern bank of Chimmony Puzha till it reaches GPS point 10, Pump house (N10025’49.8”, E76023’53.7”). From here the boundary runs towards GPS point 11 (N10026’09.7”, E76023’39.5”) Chini Kunnu, thence the boundary runs towards the northwest direction along the reserve forest boundary till it reaches GPS point 12 (N10026’44.1”, E76023’38.7”) West Valiyakulam. From here the boundary runs towards the north along the stream till it reaches GPS point 13 (N10027’15.2”, E76023’51.2”) Muttalakappukad. From here, the boundary runs towards the west direction along the Reserve forest boundary till it reaches Nadampadam, GPS point 14 (N10027’21.0”, E76022’11.8”).
