और िबदक अभर्ारण्र् म ें पाए िाने वाल े स्ट्तनधाररर्ों की जवजभन्न प्रिाजतर्ों में सामान्द्र् तिें आु (पेंथरेा पाडास), िंगली जबल्ली (फेजलस बगंालेंजसस), छोटा भारतीर् जसवेट (जववररकुला इंजडका), मछुआरी जबल्ली (फेजलस जववररना), जसर्ार (कैजनस ऑररर्स), भारतीर् लोमडी (वल्पेस बंगालेंजसस) हाथी (एजलफस मैजक्समस), िगं ली भैंसा (बुबजलस अनी), सांभर (रूसा र्ूजनकलर), बार्किंग जडर्र (मंरटर्ाकस मुंटिैक), हॉग जडर्र (एजक्सस पोर्सानस), रीसस मकाक (मैकका मुलता), असजमर्ा मकाक (मैकका असामेंजसस), िंगली सअू र (सस स्ट्रोफा), चीनी साही (मैजनस पेंटाडक्ैटाइला) आदि सजम्मजलत ह;ैं और िबदक डेयर्गं एररंग मेमोररर्ल वन्द्र्िीव अभर्ारण्र् कई संकटग्रस्ट्त, लुिप्रार् और स्ट्थाजनक प्रिाजतर्ों का वास ह,ै हालााँदक उनके बारे म ेंिानकारी सीजमत ह।ै इस अभर्ारण्र् म ेंउनके संरक्षण पर केंदरत भजवष्र् के अनुसंधान की महत्वपूणा संभावनाए ाँ ह।ैं डेयर्ंग एररंग ममे ोररर्ल वन्द्र्िीव अभर्ारण्र् के क्षत्रे , जवस्ट्तार और सीमाओं को संरजक्षत और सुरजक्षत रखना आवश्र्क ह,ै जिन्द्ह ेंपाररजस्ट्थजतकी, पर्ाावरण और िैव जवजवधता के िजृ िकोण स ेपाररजस्ट्थजतकी-संवेिी िोन के रूप म ेंपैराग्राफ 1 म ें जवजनर्िाि दकर्ा गर्ा ह ै और उि पाररजस्ट्थजतकी-संवेिी िोन म ें उद्योगों र्ा उद्योगों के वग ा और उनके संचालन और प्रदरर्ाओं को जनषेध करना आवश्र्क ह;ै अतः अब, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) तथा उपधारा (2) के खण्ड (v) और (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, केन्द्रीर् सरकार द्वारा अरुणाचल प्रििे के डेयर्गं एररंग मेमोररर्ल वन्द्र्िीव[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 अभर्ारण्र् की सीमा के आसपास एक पाररजस्ट्थजतकी-संवेिी िोन (जिसे इसके बाि पाररजस्ट्थजतकी संवेिी िोन कहा िाएगा) के रूप में अजधसूजचत करती ह,ै जिसका ब्र्ौरा जनम्नानुसार ह,ै अथाात:् - 1. पाररजस्ट्थजतकी-सवं िे ी िोन का जवस्ट्तार और सीमाएाँ.- (1) पाररजस्ट्थजतकी-संवेिी िोन िून्द्र् स े 1 दकलोमीटर तक जवस्ट्ततृ ह,ै िो अभर्ारण्र् के चारों ओर 68.738 वगा दकलोमीटर क्षत्रे को घेरता ह,ै जिसम ें अवगीकृत राज्र् वन भूजम भी सजम्मजलत ह।ै जवजभन्न दििाओं म ेंपाररजस्ट्थजतकी-संवेिी िोन का जवस्ट्तार नीच े दिर्ा गर्ा ह:ै - दििा दकलोमीटर म ेंजवस्ट्तार उत्तर 1 दकलोमीटर उत्तर-पूवा 1 दकलोमीटर पूवा 1 दकलोमीटर िजक्षण-पूव ा 1 दकलोमीटर िजक्षण 0 दकलोमीटर िजक्षण-पजश्चम 1 दकलोमीटर पजश्चम 1 दकलोमीटर उत्तर -पजश्चम 1 दकलोमीटर िजक्षणी ओर, अरुणाचल प्रििे और असम की अंतर-राज्र्ीर् सीमा के कारण पाररजस्ट्थजतकी-संवेिी िोन की सीमा 0 दकमी रखी गई ह।ै (2) डेयर्गं एररंग मेमोररर्ल वन्द्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी-संवेिी िोन के मानजचत्र अनलु ग्नक- I क, I ख और I ग पर म ें सलं ग्न ह।ैं (3) पाररजस्ट्थजतकी-संवेिी िोन का सीमा जववरण अनलु ग्नक-II पर सलं ग्न ह।ै (4) सारणी क और ख म ें उजल्लजखत डेयर्ंग एररंग मेमोररर्ल वन्द्र्िीव अभर्ारण्र् और उसके पाररजस्ट्थजतकी-संवेिी िोन के प्रमुख स्ट्थानों के भू-जनिेिांक अनलु ग्नक-III पर संलग्न ह।ैं (5) पाररजस्ट्थजतकी-संवेिी िोन म ें आन े वाल े चार गांवों की सूची अनलु ग्नक-IV पर सलं ग्न ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख स े िो वषा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्र् के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसूचना में दिए गए उपबंधों का पालन करते हुए आंचजलक महार्ोिना तैर्ार करेगी। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसचू ना के प्रावधानों के अनुसार तथा केंरीर् और राज्र् जवधानों के सुसंगत और केंरीर् सरकार द्वारा िारी मागाििाक जसद्धांतों, र्दि कोई हों, के अनरुु प तैर्ार की िाएगी। (3) आंचजलक महार्ोिना, राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ासे तैर्ार की िाएगी तादक पाररजस्ट्थजतकी और पर्ाावरणीर् महत्वों को एकीकृत दकर्ा िा सके.- i. पर्ाावरण; ii. वन एव ं वन्द्र्िीव; iii. कृजष; iv. रािस्ट्व; v. िहरी जवकास;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] vi. पर्ाटन; vii. ग्रामीण जवकास; viii. यसंचाई एव ं बाढ़ जनर्ंत्रण; ix. नगर पाजलका; x. पंचार्ती राि; xi. लोक जनमााण जवभाग; xii. अरुणाचल प्रिेि राज्र् प्रिषू ण जनर्ंत्रण बोड ा (4) आंचजलक महार्ोिना म ें अनुमोदित भू-उपर्ोग, अवसंरचना और दरर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा िब तक इस अजधसूचना म ेंऐसा जवजनर्िाि न हो, तथा आचंजलक महार्ोिना की सभी अवसंरचनाओं और उसके दरर्ाकलापों म ें सुधार करके उन्द्ह ेअजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनाने की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना, म ेंवनरजहत क्षेत्रों का पुनस्ट्ा थापन, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल- संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐसे अन्द्र् पहलओंु का प्रबंध दकर्ा िाएगा, जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह ै। (6) आंचजलक महार्ोिना में जवद्यमान तथा प्रस्ट्ताजवत भू-उपर्ोग ब्र्ौरों का जववरण िेत े हुए सहार्क मानजचत्रों के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों और दकस्ट् मों, कृजष क्षत्रे ों, उपिाऊ भूजम, उद्यानों और उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा का जनधाारण दकर्ा िाएगा। (7) इस आंचजलक महार्ोिना म ेंपाररजस्ट्थजतकी-संवेिी िोन के जवकास का जवजनर्जमत दकर्ा िार्ेगा और पैरा 4 में सूचीबद्ध प्रजतबंजधत और जवजनर्जमत दरर्ाकलापों का अनुपालन दकर्ा िाएगा और स्ट्थ ानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजश्चत दकर्ा िाएगा और उसे बढ़ावा दिर्ा िार्ेगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) राज्र् सरकार द्वारा अनुमोदित आंचजलक महार्ोिना जनगरानी सजमजत के जलए एक संिभा िस्ट्तावेि होगी तादक इस अजधसूचना के उपबंधों के अनुसार अपने कताव्यों का जनवाहन दकर्ा िा सके। (10) पाररजस्ट्थजतकी-संवेिी िोन के जलए आंचजलक महार्ोिना तैर्ार होने तक, सभी नए जनमााण और अन्द्र् जवकासात्मक दरर्ाकलाप जनगरानी सजमजत को भेिे िाएगें। 3. राज्र् सरकार द्वारा दकए िान ेवाल ेउपार्. - राज्र् सरकार अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात:् - (1) भ-ू उपर्ोग. – (क) पाररजस्ट्थजतकी-संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खलु े स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दरर्ाकलापों के जलए प्रर्ोग र्ा पररवतान की अनुमजत नहीं होगी। बित े दक पाररजस्ट्थजतकी-संवेिी िोन के भीतर कृजष और अन्द्र् भूजम का भाग (क) म ें जवजनर्िाि प्रर्ोिनो के अजतररि अन्द्र् प्रर्ोिनो हते ु उपर्ोग, मॉनीटरी सजमजत की जसफाररि पर केंर तथा राज्र् सरकार के िहरी जनर्ोिन अजधजनर्म तथा अन्द्र् जनर्मों एव ं जवजनर्मों, र्था लागू, के अधीन तथा इस अजधसूचना के उपबंधों के पूवा अनुमोिन द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं और दरर्ाकलापों को परू ा करन े के जलए दिर्ा िाएगा, िैसे दक,- (i) जवद्यमान सडकों को चौडा और मिबूत करना और नई सडकों का जनमााण करना; (ii) बुजनर्ािी अवसंरचनाओं और नागररक सुजवधाओं का सजन्नमााण और नवीनीकरण; (iii) प्रिषू ण उत्पन्न न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योग एव ं ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और (v) पैराग्राफ-4 के मि में र्था उजल्लजखत संवर्धात दरर्ाकलापः[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 परंत ु र्ह भी दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म तथा राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना एव ं संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अधीन अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनपु ालन दकए जबना वाजणजज्र्क र्ा औद्योजगक जवकास दरर्ाकलापों के जलए िनिातीर् भूजम के प्रर्ोग की अनुमजत नहीं होगी: बिते र्ह भी दक पाररजस्ट्थजतकी-संवेिी िोन के अधीन आन ेवाली भूजम के अजभलेखों म ेंहुई दकसी त्रुरट को, मॉनीटरी सजमजत के जवचार प्राि करने के पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार सुधारा िाएगा और उि त्रुरट को सुधारने की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी: बिते र्ह भी दक उपर्िुा त्रुरट को सुधारन े म,ें इस उप-परै ा म ें र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भू-उपर्ोग का पररवतान सजम्मजलत नहीं होगा: (ख) अनुप्रर्िु र्ा अनुत्प ािक कृजष क्षेत्रों म ेंवनीकरण तथा पर्ावा ासों की बहाली के कार्ाकलापों स े पुन: वनीकरण दकए िान े के प्रर्ास दकए िाएंगे। (2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक िलमागों के िलग्रहण क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना म ें उनके संरक्षण और बहाली की र्ोिना सजम् मजलत की िाएगी और राज्र् सरकार द्वारा मागिा िाक जसद्धांत इस प्रकार स े तैर्ार दकए िाएंगे दक उसम ेंऐसे क्षेत्रों म ेंर्ा उसके पास जवकास दरर्ाकलापों पर रोक लगाई िा सके िो इन क्षेत्रों के जलए हाजनकारक ह।ै (3) पर्टा न एव ं पाररजस्ट्थजतकी पर्टा न. – (क) पाररजस्ट्थजतकी-संवेिी िोन म ें सभी नए पाररजस्ट्थजतकी पर्ाटन दरर्ाकलाप र्ा मौिूिा पर्ाटन दरर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी-संवेिी िोन संबंधी पर्ाटन महार्ोिना के अनुसार अनुमत होगा। (क) पर्ाटन महार्ोिना राज्र् सरकार के पर्ाावरण और वन जवभाग के परामि ा स ेपर्ाटन जवभाग द्वारा बनार्ी िाएगी। (ख) पर्ाटन महार्ोिना आंचजलक महार्ोिना के एक घटक के रूप म ेंहोगी। (ग) पर्ाटन महार्ोिना पाररजस्ट्थजतकी-संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तैर्ार की िाएगी। (घ) पाररजस्ट्थजतकी पर्ाटन संबंधी दरर्ाकलाप जनम्न ानुसार जवजनर्जमत दकए िाएंग,े अथाात:् - (i) पाररजस्ट्थजतकी-संवेिी िोन के अन्द्िर सभी नए पर्ाटन दरर्ाकलापों र्ा मौिूि पर्ाटन दरर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा िारी मागाििाक जसद्धातं तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िने े वाले राष्ट्रीर् बाघ संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी मागिा िाक जसद्धांतों (समर्-समर् पर र्था संिोजधत) के अनुसार होगा; (ii) िब तक आंचजलक महार्ोिना को अनुमोिन नहीं जमल िाता, तब तक पर्ाटन के जवकास और मौिूिा पर्ाटन दरर्ाकलापों के जवस्ट्तार को स्ट्थल-जवजिि संवीक्षा और जनगरानी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमत दकर्ा िाएगा। (4) प्राकृजतक जवरासत. – पाररजस्ट्थजतकी-संवेिी िोन के अधीन आने वाले बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पलू ररिव ा क्षत्रे , िलै संरचना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आचं जलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनाई िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी-संवेिी िोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनाई िाएगी। (6) ध्व जन प्रिषू ण.- पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रिषू ण की रोकथाम और जनर्ंत्रण समर्-समर् पर र्थासंिोजधत ध्वजन प्रिषू ण (जवजनर्मन और जनर्ंत्रण) जनर्म 2000 और इसके उपबंधों के अनुसार दकर्ा िाएगा। (7) वार् ुप्रिषू ण. – पाररजस्ट्थजतकी संवेिी िोन म ेंवार् ुप्रिषू ण का जनवारण और जनर्ंत्रण वार्ु (प्रिषू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) के उपबंधों और समर्-समर् पर र्थासंिोजधत उपबंधों के अनुसार दकर्ा िाएगा। (8) बजहस्राव का जनस्ट्सरण. - पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत बजहस्राव का जनस्ट्सारण- िल (प्रिषू ण जनवारण तथा जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) के उपबंधों और समर्-समर् पर र्था संिोजधत उपबंधों के अनुसार दकर्ा िाएगा। (9) िोस अपजिि. - िोस अपजििों का जनपटान जनम्नानुसार दकर्ा िाएगा:-6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिि जनपटान और प्रबंधन, िोस अपजिि प्रबंधन जनर्म, 2016 और समर्-समर् पर र्था संिोजधत जनर्मों के अनुसार दकर्ा िाएगा। अकाबाजनक सामग्री का जनपटान पर्ाावरणीर् रीजत म ें पाररजस्ट्थजतकी संवेिी िोन स े बाहर अजभज्ञात स्ट्थल पर दकर्ा िाएगा । (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िोस अपजिि का सुरजक्षत और पर्ाावरण अनुकूल प्रबधं न अनुमत दकर्ा िार्ेगा। (10) िवै जचदकत्सा अपजिि. - िैव जचदकत्सा अपजिि का प्रबधं न जनम्नजलजखत रूप म ें होगा- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिि का जनपटान िैव जचदकत्सा अपजिि प्रबंधन जनर्म, 2016, समर् -समर् पर र्था संिोजधत उपबधं ों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन म ें अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करत े हुए मौिूि जनर्मों और जवजनर्मों के अनुरूप िैव जचदकत्सा अपजिि का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन (ईएसएम) अनुमत दकर्ा िाएगा। (11) प्लाजस्ट्टक अपजिि का प्रबधं न. – (क) पाररजस्ट्थजतकी संवेिी िोन म ेंप्लाजस्ट्टक अपजिि का प्रबंधन समर् -समर् पर र्था संिोजधत प्लाजस्ट्टक अपजिि प्रबंधन जनर्म, 2016 के उपबंधो के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिि का प्रबधं न.- पाररजस्ट्थजतकी-संवेिी िोन म ेंजनमााण और जवध्वंस अपजिि का प्रबंधन समर् -समर् पर र्था संिोजधत सजन्नमााण और जवध्वंस अपजिि प्रबधं न जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिि.- पाररजस्ट्थजतकी-संवेिी िोन म ें ई–अपजिि का प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित और समर् -समर् पर र्था संिोजधत ई–अपजिि प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। 14. वाहन र्ातार्ात.- वाहन र्ातार्ात को पर्ाावास-अनुकूल तरीके स ेजवजनर्जमत दकर्ा िाएगा और इस संबंध म ेंआंचजलक महार्ोिना म ें जविेष उपबंध सजम्मजलत दकए िाएंगे और आंचजलक महार्ोिना के तैर्ार होन े और राज्र् सरकार के सक्षम प्राजधकारी स ेअनुमोदित होन ेतक, जनगरानी सजमजत सुसंगत अजधजनर्मों और उनके अधीन बनाए गए जनर्मों एव ंजवजनर्मों के अनुसार वाहन र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन प्रिषू ण.- वाहन प्रिषू ण की रोकथाम और जनर्ंत्रण लागू जवजधर्ों के अनुसार दकर्ा िाएगा। स्ट्वच्छ ईंधन िैस े सीएनिी, एलपीिी आदि के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ा.ं - (क) रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पश्चात् पाररजस्ट्थजतकी-संवेिी िोन के भीतर कोई नए प्रिषू णकारी उद्योगों की स्ट्थापना की अनुमजत नहीं िी िाएगी। (ख) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा द्वारा फरवरी, 2016 म ेंिारी मागाििाक जसद्धांतों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें इस प्रकार जवजनर्िाि न हो, पाररजस्ट्थजतकी-संवेिी िोन के भीतर केवल गरै -प्रिषू णकारी उद्योगों को अनुमत दकर्ा िाएगा और इसके अजतररि, गरै प्रिषू णकारी कुटीर उद्योगों का संवधान दकर्ा िाएगा। (17) पहाडी ढलानों का सरं क्षण. - पहाडी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना म ें पहाडी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी प्रकार के जनमााण कार् ा की अनुज्ञा नहीं होगी; The Sanctuary lies in the flood plains of mighty Siang river with a total area of 190 square kilometre. The notification of the Sanctuary was published vide Gazette Notification No FOR. 284.78/15895- 935 dated the 23rd August 1978; AND WHEREAS the said sanctuary is important and is known for presence of globally threatened birds and mammals. The sanctuary is extremely rich in biodiversity and forms a part of biodiversity hotspot in Eastern Himalayas. The grassland of Daying Ering is the finest area for Bengal Florican and other grassland birds which are globally threatened, such as Swamp Francolin, Black-breasted Parrotbill, Swamp Prinia and Jerdon’s Babbler. Presence of more than five specifies of critically endangered/near threatened vultures is also a unique feature of the sanctuary. The water body of the sanctuary also serves as an important route and destination for winter migratory birds. Besides avifaunal population, it is also the home of big mammals like Asiatic Elephants, Wild Buffalos, Leopard, Hog Deer, Sambars, etc. The rare and critically endangered Chinese Pangolin and hispid hare are found in the sanctuary; AND WHEREAS the Sanctuary is represented by various plant species such as Korai (Albizia procera), Holok (Terminalia myriocarpa), Moj (Albizia lucida), Subabul (Leuconea lecocephala), Simul (Bombax ceiba), Pichola (Kydia calycina), Sokamara (Urena lobate), Dimaru (Ficus neriifolia), Lata Dimaru (Ficus hederacea), Amari (Amoora wallichii), Chisocheton paniculatus, Baaramthuri (Magnolia pterocarpa), Udul (Sterculia villosa), Outenga (Dellenia indica), Satiana (Alstonia scholaris), Urium (Bischofia javanica), Amalaki (Emblica officinalis), Gunmola (Callicarpa arborea) etc.; AND WHEREAS the various species of mammals found in the Sanctuary includes Common leopard (Panthera pardus), Jungle Cat (Felis bengalensis), Small indian civet (Viverricula indica), Fishing Cat (Felis viverrina), Jackal (Canis aureus), Indian Fox (Vulpes bengalensis), Elephant (Elephus maximus), Wild Buffalo (Bubalis arnee), Sambar (Rusa unicolor), Barking Deer (Muntiacus muntjak), Hog Deer (Axis porcinus), Rhesus macaque (Maccaca mulata), Assamese macaque (Maccaca asamensis), Wild boar (Sus scrofa), Chinese Porcupine (Manis pentadactyla) etc.; AND WHEREAS, the Daying Ering Memorial Wildlife Sanctuary is home to many threatened, endangered and endemic species, though knowledge about them remains limited. The sanctuary holds significant potential for future research focused on their conservation. It is necessary to conserve and protect the area, the extent and boundaries of Daying Ering Memorial Wildlife Sanctuary which are specified in paragraph 1 as Eco-Sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub section (l) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub- rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an Eco-Sensitive Zone around the boundary of Daying Ering Memorial Wildlife Sanctuary of Arunachal Pradesh (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of the Eco-Sensitive Zone.– (1) The Eco-Sensitive Zone varies from zero to 1 kilometre, encompassing an area of 68.738 square kilometre around the Sanctuary which includes unclassed state forest land. (2) The Maps of the Daying Ering Memorial Wildlife Sanctuary and its Eco-sensitive Zone is appended as Annexure- I A, I B and I C. (3) The boundary description of the Eco-Sensitive Zone is appended as Annexure- II. (4) The geo-coordinates of the prominent locations of Daying Ering Memorial Wildlife Sanctuary and its Eco- Sensitive Zone mentioned at Table A and B is appended as Annexure-III. (5) The list of four villages falling in Eco-Sensitive Zone is appended as Annexure- IV. 2. Zonal Master Plan for Eco-Sensitive Zone.– (1) The State Government shall, for the purposes of the Eco-Sensitive Zone, prepare a Zonal Master Plan within two years from the date of publication of this notification in the Official Gazette, in consultation with local people and in conformity to the provisions of this notification. (2) The Zonal Master Plan for the Eco-Sensitive Zone shall be prepared by the State Government in accordance with the provisions of this notification and in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan: - i. Environment; ii. Forest and Wildlife; iii. Agriculture; iv. Revenue; v. Urban Development; vi. Tourism; vii. Rural Development; viii. Irrigation and Flood Control; ix. Municipality; x. Panchayati Raj; xi. Public Works Department; xii. Arunachal Pradesh State Pollution Control Board. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure, and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks and it’s like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-Sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and ensure and promote eco-friendly development for security of local community’s livelihood.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 19 (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. (10) Until the preparation of the Zonal Master Plan for the Eco-Sensitive Zone, all new construction and other developmental activities shall be referred to the Monitoring Committee. 3. Measures to be taken by the State Government.– The State Government shall take the following measures for giving effect to the provisions of this notification, namely: (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-Sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities. Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-Sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as: i. Widening and strengthening of existing roads and construction of new roads; ii. Construction and renovation of infrastructure and civic amenities; iii. Small scale industries not causing pollution; iv. Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and v. Promoted activities and given under paragraph 4. Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007); Provided also that any error appearing in the land records within the Eco-Sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. i. Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.– The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.– (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-Sensitive Zone; a) the Tourism Master Plan shall be prepared by the Department of Tourism in consultation with the Departments of Environment and Forests of the State Government; b) the Tourism Master Plan shall form a component of the Zonal Master Plan; c) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-Sensitive Zone; d) the activities of eco-tourism shall be regulated as under, namely: - i. all new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be in accordance with the guidelines issued by the Central Government and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; ii. until the Zonal Master Plan is prepared and approved, development for tourism and expansion of existing tourism activities shall be permitted by the regulatory authorities concerned based on the actual site- specific scrutiny and recommendation of the Monitoring Committee.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) Natural heritage.– All sites of valuable natural heritage in the Eco-Sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.– Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-Sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution.– Prevention and control of noise pollution in the Eco-Sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 and as amended from time to time. (7) Air pollution.– Prevention and control of air pollution in the Eco-Sensitive Zone shall be complied in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and as amended from time to time. (8) Discharge of effluents.– The discharge of treated effluent in the Eco-Sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and as amended from time to time. (9) Solid wastes.– Disposal and Management of solid wastes shall be as under- a. The solid waste disposal and management in the Eco-Sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and as amended from time to time. The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-Sensitive Zone. b. Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone (10) Bio-medical waste.– Bio medical waste management shall be as under: a) The bio-medical waste disposal in the Eco-Sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 and as amended from time to time. b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (11) Plastic waste management.– The Plastic Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 and as amended from time to time. (12) Construction and demolition waste management.– The Construction and Demolition Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 and as amended from time to time. (13) E-waste.– The E- Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.– Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel such as CNG, LPG, etc. (16) Industrial units.– a) No new polluting industries shall be allowed to be set up within the Eco-Sensitive Zone on or after the publication of this notification in the Official Gazette, b) Only non-polluting industries shall be allowed within the Eco sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.– The protection of hill slopes shall be as under: (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) Construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 21 4. List of activities prohibited or to be regulated within the Eco-Sensitive Zone.– All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 and the rules made there under and other notifications, laws and acts of the Government of India pertaining to environment, forests and wildlife, in the erstwhile Ministry of Environment and Forest, vide number 1533(E), dated the 14th September, 2006 and laws for the time being in force in the manner and as amended from time to time specified in the Table below, namely:- TABLE S. UOI in W.P.(C) No. 435 of 2012 dated the 21st April, 2014 and IA No. 1000 of 2003 dated the 3rd June, 2022 and subsequent IA No. 131377 of 2022 judgment dated the 26th April, 2023 and 28th April, 2023. 2. Setting of industries causing pollution New industries and expansion of existing polluting industries in the (Water, Air, Soil, Noise, etc.). Eco-Sensitive Zone shall not be permitted: Provided that, non-polluting industries shall be allowed within Eco-Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted. 3. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the protected area or up to the extent of the Eco-Sensitive Zone, whichever is nearer;22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (b) Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents. Provided that, the construction activity related to small- scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any; (c) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 12. Small-scale non-polluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016, as amended from time to time shall be permitted by the approval of competent Authority in the State. 13. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. Functions of the Monitoring Committee.– (1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinize, the activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification. (2) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco- Sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (3) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the state as per proforma appended at Annexure V. (6) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 7. Additional measures.– The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8.
