उपधारा (3) के साथ परित उपधारा (1) के अधीन प्रित्त िजिर्ों का प्रर्ोग करत े हुए िारी करने का प्रस्ट्ताव करती ह,ै पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) की अपेक्षानुसार, ऐसे िनसाधारण की िानकारी के जलए प्रकाजित की िाती ह;ै जिनके उससे प्रभाजवत होने की संभावना ह;ै और र्ह सूचना भी िी िाती ह ै दक उि प्रारूप अजधसूचना पर, उस तारीख स,े जिस तारीख को इस अजधसूचना वाले भारत के रािपत्र की प्रजतर्ां िनसाधारण को उपलब्ध करा िी िाती ह,ैं साि दिन की अवजध की समाजि पर र्ा उसके पश्चात ्ही जवचार दकर्ा िाएगा; ऐसा कोई भी व्यजि, जिसे इस प्रारूप अजधसूचना म ें अतं र्वाष्ट प्रस्ट्तावों के संबंध म ें कोई आपजत्त ह ै र्ा वह सुझाव िेना चाहता ह,ै इस प्रकार जवजनर्िाष्ट अवजध के भीतर, केन्द्र सरकार के द्वारा जवचार दकए िाने के जलए, ऐसी आपजत्त र्ा सुझाव को सजचव, पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर्, वन्द्र्िीव अभर्ारण्र् (90 वग ा दकलोमीटर) और तीथना वन्द्र्िीव अभर्ारण्र् (61 वग ा दकलोमीटर) सजममजलत ह,ैं और र्ह जहमाचल प्रिेि के कुल्ल ू जिल े के बंिार उप- मंडल म ें जस्ट्थत ह;ै और िबदक उच्च अल्पाइन चोरटर्ों, अल्पाइन घास के मैिानों और निी-तटीर् िंगलों स े सुिोजभत ग्रेट जहमालर्ी राष्ट्रीर् उद्यान संरक्षण क्षत्रे को 25 िून, 2014 को र्ूनेस्ट्को जवश्व धरोहर स्ट्थलों की सूची म ें सजममजलत दकर्ा गर्ा था और इसम ें 128 पररवारों, 427 प्रकार और 832 पौधों की प्रिाजतर्ों (एंजिर्ोस्ट्पम ा - 794 प्रिाजतर्ां, जिम्नोस्ट्पम ा - 11 प्रिाजतर्ां और फना - 27 प्रिाजतर्ां) सजहत समृद्ध वनस्ट्पजत जवजवधता पाई िाती ह।ै र्ह जहमाचल प्रिेि राज्र् म ें संकटग्रस्ट्त श्रेणी म ें वगीकृत 47 औषधीर् पौधों की प्रिाजतर्ों म ें स े 34 का आवास स्ट्थल ह ै (कमिोर - 12, लुिप्रार् - 17 और गंभीर रूप स े लुिप्रार् - 5), जपछले ििक म ें दकए गए िैव जवजवधता सवेक्षणों म ें 31 स्ट्तनधारी प्रिाजतर्ां, 224 पक्षी प्रिाजतर्ां, 12 सरीसृप प्रिाजतर्ां, 9 उभर्चर प्रिाजतर्ां और 125 कीट प्रिाजतर्ा ं िि ा की गई ह।ैं र्ह राष्ट्रीर् उद्यान जवश्व स्ट्तर पर महत्वपूणा स्ट्थाजनक पक्षी क्षेत्रों (इबीए- डी 02: पजश्चमी जहमालर्) म ें स े एक के अधीन आता ह,ै िहां 224 पक्षी प्रिाजतर्ा ं ििा की गई ह;ैं और िबदक र्ह क्षत्रे जहमाचल प्रििे राज्र् के प्रमुख िीव-िंतु और वनस्ट्पजत प्रतीकों, िैसे दक रैगोपनै मेलानोसेफालस (राज्र् पक्षी - पजश्चमी रैगोपनै ), पथैं ेरा उनजसर्ा (राज्र् पि ु - जहम तेंिआु ), रोडोडड्रेंोन कैमपनेुलेटम (राज्र् फूल - गलु ाबी रोडोडड्रें ोन) और सेड्रस जडर्ोडारा (राज्र् वृक्ष - िेविार) का आवास ह,ै और पजश्चमी रैगोपैन की कुल िंगली आबािी का लगभग 10 प्रजतित ग्रेट जहमालर्न राष्ट्रीर् उद्यान संरक्षण क्षत्रे (िीएचएनपीसीए) म ेंजनवास करता ह;ै और िबदक इन संरजक्षत क्षेत्रों म ें ििा की गई जवजभन्न वनस्ट्पजत प्रिाजतर्ों म ें िेविार (सड्रेस िेविारा), ब्लू पाइन (पीनस वाजलजचर्ाना), जचर पाइन (पीनस रॉक्सबगी), जहमालर्न स्ट्प्रूस (जपका जस्ट्मजथर्ाना), द़िर (एजबस पपंड्रो), राखल (टैक्सस बकाटा), मोहरू (क्वेरकस जडलाटाटा), खारिु (क्र्ू. समे ेकार्पाफोजलर्ा), बंि (क्र्.ू ल्र्कू ोराइकोफोरा), हॉसा चेस्ट्टनट (एस्ट्कुलस इंजडका), अखरोट (िुग्लंस जहमालर्न राष्ट्रीर् उद्यान संरक्षण क्षत्रे के आसपास के क्षत्रे , जवस्ट्तार और सीमा को पाररजस्ट्थजतक, पर्ाावरणीर् और िैव जवजवधता के िजृ ष्टकोण स े पाररजस्ट्थजतकी-संवेिी िोन के रूप म ें संरजक्षत और सुरजक्षत करना आवश्र्क ह ै तथा उि पाररजस्ट्थजतकी-संवेिी िोन म ें उद्योगों र्ा उद्योगों के वगा तथा उनके संचालन और प्रदक्रर्ाओं को प्रजतजषद्ध करना आवश्र्क ह;ै अतः अब, केंर सरकार पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, जहमाचल प्रििे राज्र् म ें जस्ट्थत ग्रेट जहमालर् राष्ट्रीर् उद्यान, सैंि और तीथान वन्द्र्िीव अभर्ारण्र्ों की सीमा के आसपास 0 से 10.63 दकलोमीटर तक के क्षेत्र को ग्रेट जहमालर् राष्ट्रीर् उद्यान संरक्षण क्षत्रे पाररजस्ट्थजतकी-संवेिी िोन (जिसे इसके बाि पाररजस्ट्थजतकी-संवेिी िोन कहा िाएगा) के रूप म ें अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह:ै 1. पाररजस्ट्थजतकी-सवं िे ी िोन का जवस्ट्तार एव ं सीमाएाँ.– (1) 326.6985 वग ा दकलोमीटर क्षत्रे म ें फैले ग्रेट जहमालर्ी राष्ट्रीर् उद्यान संरक्षण क्षत्रे की सीमा के चारों ओर पाररजस्ट्थजतकी-संवेिी िोन का जवस्ट्तार 0 स े 10.63 दकलोमीटर तक होगा। कनवार और रूपी भाभा वन्द्र्िीव अभर्ारण्र्ों, जपन घाटी और खीरगंगा राष्ट्रीर् उद्यानों के साथ साझा सीमा के कारण 0 दकलोमीटर का जवस्ट्तार प्रस्ट्ताजवत दकर्ा गर्ा ह।ै पाररजस्ट्थजतकी-संवेिी िोन का जवस्ट्तार नीच े िी गई सारणी म ें दिर्ा गर्ा ह:ै उत्तर 0 दकलोमीटर उत्तर-पूव ा 0 दकलोमीटर पूवा 0 दकलोमीटर िजक्षण-पूव ा 1 दकलोमीटर िजक्षण 1 दकलोमीटर िजक्षण-पजश्चम 10.63 दकलोमीटर पजश्चम 9.56 दकलोमीटर उत्तर-पजश्चम 2.77 दकलोमीटर (2) पाररजस्ट्थजतकी-संवेिी िोन की सीमा का जववरण अनलु ग्नक-I के रूप म ेंसंलग्न ह।ै (3) पाररजस्ट्थजतकी-संवेिी िोन का मानजचत्र, सीमा जववरण सजहत, अनलु ग्नक-II के रूप म ेंसंलग्न ह।ै (4) सरं जक्षत क्षेत्रों और उसके पाररजस्ट्थजतकी-संवेिी िोन के भौगोजलक जनििे ांक अनलु ग्नक-III के रूप म ें सलं ग्न ह।ैं (5) पाररजस्ट्थजतकी-संवेिी िोन के अधीन आने वाल े 187 गांवों की सूची अनलु ग्नक-IV के रूप म ेंसंलग्न ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख स े िो वषा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्र् के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसचू ना में दिए गए उपबंधों का पालन करते हुए आंचजलक महार्ोिना तैर्ार करेगी। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसचू ना के उपबंधों के अधीन तथा केंरीर् और राज्र् जवधानों के सुसंगत और केंरीर् सरकार द्वारा िारी मागाििाक जसद्धांतों, र्दि कोई हों, के अनरु प तैर्ार की िाएगी। (3) आंचजलक महार्ोिना, राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ासे तैर्ार की िाएगी तादक पाररजस्ट्थजतकी और पर्ाावरणीर् िजृ ष्टकोणों को एकीकृत दकर्ा िा सके.- i. पर्ाावरण; ii. वन और वन्द्र्िीव; iii. िहरी जवकास; iv. ग्रामीण जवकास; v. पर्ाटन; vi. रािस्ट्व; vii. कृजष; viii. पिुपालन; ix. जहमाचल प्रिेि राज्र् प्रिषू ण जनर्ंत्रण बोडा; x. पसंचाई और बाढ़ जनर्ंत्रण; xi. नगरपाजलका और पंचार्ती राि; xii. लोक जनमाणा जवभाग। (4) आंचजलक महार्ोिना म ें अनुमोदित भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा िब तक इस अजधसूचना म ें ऐसा जवजनर्िाष्ट न हो, तथा आचंजलक महार्ोिना की सभी अवसंरचनाओं और उसके दक्रर्ाकलापों म ें सुधार करके उन्द्ह े अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनान े की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना, म ें वृक्षहीन क्षेत्रों की बहाली, जवद्यमान िल जनकार्ों के सरं क्षण, िल ग्रहण क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भ-ू िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐसे अन्द्र् पहलुओं का प्रावधान दकर्ा िाएगा, जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह ै। (6) आंचजलक महार्ोिना म ें सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों और दकस्ट् मों, कृजष क्षेत्रों, उपिाऊ भूजम, उद्यानों और उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा, सहार्क मानजचत्रों के साथ जिनम ें जवद्यमान तथा प्रस्ट्ताजवत भ-ू उपर्ोग जविेषताओं के ब्र्ौरों का जनधाारण दकर्ा िाएगा। (7) इस आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी-संवेिी िोन के जवकास का जवजनर्जमत दकर्ा िाएगा और पैरा 4 म ें सूचीबद्ध प्रजतजषद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन दकर्ा िाएगा और स्ट्थ ानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजश्चत दकर्ा िाएगा और उसका संवधना दकर्ा िाएगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी ।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (9) इस प्रकार अनुमोदित आंचजलक महार्ोिना, इस अजधसूचना के उपाबंधों के अनुसार जनगरानी के अपने कार्ों को पूरा करने के जलए जनगरानी सजमजत के जलए संिभ ा िस्ट्तावेि होगा। 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्. - राज्र् सरकार अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्: - (1) भ-ू उपर्ोग. – (क) पाररजस्ट्थजतकी-संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खलु े स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा पररवतान की अनुमजत नहीं होगी: बिते दक पाररजस्ट्थजतकी-संविे ी िोन के भीतर कृजष और अन्द्र् भूजम, मॉनीटररंग सजमजत की जसफाररि पर केंर तथा राज्र् सरकार के िहरी जनर्ोिन अजधजनर्म तथा अन्द्र् जनर्मों एव ं जवजनर्मों र्था लागू, के अधीन तथा इस अजधसूचना के उपबंधों के पूवा अनुमोिन स े स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं और दक्रर्ाकलापों को पूरा करने के जलए अनुमजत िी गई ह,ै िैसे,- (i) जवद्यमान सड़कों को चौड़ा करना, उन्द्ह ेंसुिढ़ृ करना और नई सड़कों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का सजन्नमााण और नवीनीकरण; (iii) प्रिषू ण उत्पन्न न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योग एव ं ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और (v) पैराग्राफ-4 के मि में र्था उजल्लजखत संवर्धात दक्रर्ाकलापः परंतु र्ह भी दक राज्र् सरकार के पूवा अनुमोिन के जबना और संजवधान के अनच्ु छेि 244 र्ा अनुसूजचत िनिाजतर्ां और अन्द्र् पारंपररक वनवासी (वन अजधकार मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) सजहत वतामान म ें लागू जवजधर्ों के उपबंधों के अनुपालन के जबना वाजणजज्र्क और औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के दकसी भी उपर्ोग की अनुमजत नहीं िी िाएगी: परंत ु र्ह भी दक पाररजस्ट्थजतकी-संवेिी िोन के अधीन आने वाली भूजम के अजभलेखों म ें हुई दकसी त्रुरट को, मॉनीटररंग सजमजत के जवचार प्राि करन े के पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामल े म ें एक बार सुधारा िाएगा और उि त्रुरट को सुधारने की सूचना केंर सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह भी दक उपर्िुा त्रुरट को सुधारन े म,ें इस उप-परै ा म ें र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भ-ू उपर्ोग का पररवतान सजममजलत नहीं होगा: (ख) अनुप्रर्िु र्ा अनुत्प ािक कृजष क्षेत्रों म ें वनीकरण तथा पर्ाावासों की बहाली के कार्ाकलापों स े पनु : वनीकरण दकए िाने के प्रर्ास दकए िाएगं े। (2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक झरनों/नदिर्ों/चैनलों के िलग्रहण क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और पुनरद्धार की र्ोिनाओं को आंचजलक महार्ोिना म ें सजममजलत दकर्ा िाएगा तथा राज्र् सरकार द्वारा मागाििका जसद्धांत तैर्ार दकए िाएगं े जिससे इन क्षेत्रों म ें र्ा इनके आसपास जवकास के ऐस े दक्रर्ाकलापों पर रोक लगाई िा सके िो इन क्षेत्रों के जलए हाजनकारक हों। (3) पर्टा न र्ा पारर-पर्टा न – (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पारर-पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन सबं ंधी पर्ाटन महार्ोिना के अनसु ार होगा। (ख) पर्ाटन महार्ोिना, पर्ाटन जवभाग द्वारा केरल सरकार के रािस्ट्व एव ं वन जवभाग के परामिा स ेतैर्ार दकर्ा िाएगा; (ग) पर्ाटन महार्ोिना, आंचजलक महार्ोिना का घटक होगी; (घ) पर्ाटन महार्ोिना, पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी; (ङ) पारर-पर्ाटन संबंधी दक्रर्ाकलाप जनमन ानुसार जवजनर्जमत दकए िाएंगे, अथाात:् -6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (i) संरजक्षत क्षेत्र की सीमा से एक दकमी. के पाररजस्ट्थजतकी संविे ी िोन की सीमा तक, िो भी पास हो, होटलों और ररजॉटास् के नए जनमाणा की अनमु जत नहीं िी िाएगी। बिते दक संरजक्षत क्षेत्र की सीमा से एक दकमी. की िरू ी के बाि पाररजस्ट्थजतकी संवेिी िोन की सीमा तक नए होटलों और ररजॉटा ररजॉटास् की स्ट्थापना की अनुमजत आंचजलक महार्ोिना के अनुसार केवल पारर-पर्ाटन सुजवधाओं के जलए पूवा –पररभाजषत और नाजमत क्षेत्रों म ेंही िी िाएगी। (ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दक्रर्ाकलापों र्ा मौिूिा पर्टा न दक्रर्ाकलापों का जवस्ट्तार पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् म ें केंर सरकार द्वारा िारी मागाििाक जसद्धांतों और राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरणों द्वारा िारी पाररजस्ट्थजतकी पर्ाटन मागाििाक जसद्धांतों (समर्-समर् पर संिोजधत) के अधीन होगा, जिसमें पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता अध्र्र्न के आधार पर पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी जिक्षा और पाररजस्ट्थजतकी जवकास पर िोर दिर्ा िाएगा; (iii) िब तक इस आंचजलक महार्ोिना को अनुमोदित नहीं कर दिर्ा िाता तब तक पर्टा न के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार की अनुमजत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा स्ट्थल जवजिष्ट िांच और जनगरानी सजमजतर्ों की जसफाररि के आधार पर िी िाएगी और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए होटल, ररजॉटा र्ा वाजणजज्र्क प्रजतष्ठान के जनमााण की अनुमजत नहीं िी िाएगी । (4) प्राकृजतक जवरासत – पाररजस्ट्थजतकी संवेिी िोन के अधीन आने वाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैस े दक िीन पूल ररजवा क्षत्रे , िैल सरं चना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ेंएक जवरासत सरं क्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल - पाररजस्ट्थजतकी संवेिी िोन म ें ऐजतहाजसक, स्ट्थापत्र्, सौंिर्पा रक और सांस्ट्कृजतक महत्व की इमारतों, संरचनाओं, कलाकृजतर्ों, क्षत्रे और पररसरों की पहचान की िाएगी और उनके संरक्षण के जलए जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना म ें सजममजलत की िाएगी। (6) ध्व जन प्रिषू ण –पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रिषू ण की रोकथाम और जनर्ंत्रण पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और उसके संिोधनों के अधीन ध्वजन प्रिषू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 के अनुसार दकर्ा िाएगा। (7) वार् ु प्रिषू ण -पाररजस्ट्थजतकी संवेिी िोन म ें वार् ु प्रिषू ण की रोकथाम और जनर्ंत्रण वार् ु (प्रिषू ण की रोकथाम और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्म और उसके संिोधनों के अनुसार दकर्ा िाएगा। (8) बजहस्राव का जनस्ट्सरण - पाररजस्ट्थजतकी-संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सरण िल (प्रिषू ण जनवारण तथा जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) तथा पर्ाावरण अजधजनर्म 1986 और उसके तहत बनाए गए जनर्मों, पर्ाावरण प्रिषू कों के जनस्ट्सरण के सामान्द्र् मानकों र्ा राज्र् सरकार द्वारा जनधााररत मानकों, इनम ें स े िो भी अजधक किोर हो, के उपबंधों के अधीन होगा। (9) िोस अपजिष्ट - िोस अपजिष्ट का जनपटान एवं प्रबधं न जनम्नानुसार दकर्ा िाएगा, - (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट जनपटान और प्रबंधन, िोस अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा, जिसे भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा अजधसूचना संख्र्ा[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 का. आ. 1357(अ), दिनांक 8 अप्रैल, 2016 द्वारा प्रकाजित दकर्ा गर्ा ह ै और समर्-समर् पर संिोजधत दकर्ा गर्ा ह;ै अकाबाजनक पिाथों का जनपटान पाररजस्ट्थजतकी संवेिी िोन के बाहर जचजन्द्हत स्ट्थल पर पर्ाावरण अनुकूल तरीके से दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में जवजनर्िाष्ट प्रौद्योजगदकर्ों का उपर्ोग करते हुए, जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िोस अपजिष्टों का सुरजक्षत और पर्ाावरण के अनुकूल प्रबंधन (ईएसएम) करने की अनुमजत िी िा सकती ह।ै (10) िवै जचदकत्सा अपजिष्ट.- िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी-संवेिी िोन में िैव-जचदकत्सा अपजिष्ट का जनपटान, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा समर्-समर् पर र्था संिोजधत, अजधसूचना संख्र्ा सा.का.जन.343(अ), तारीख 28 माचा, 2016 द्वारा प्रकाजित िैव-जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के अधीन दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन में जवजनर्िाष्ट प्रौद्योजगदकर्ों का उपर्ोग करते हुए, जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनकु ूल प्रबंधन (ईएसएम) करन े की अनुमजत िी िा सकती ह।ै (11) प्लाजस्ट्टक अपजिष्ट का प्रबधं न -पाररजस्ट्थजतकी संवेिी िोन म ें प्लाजस्ट्टक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा, समर्-समर् पर र्थासंिोजधत; अजधसूचना संख्र्ा सा.का.जन.340(अ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अधीन दकर्ा िाएगा; (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न - पाररजस्ट्थजतकी-सवं ेिी िोन में जनमााण एवं जवध्वंस अपजिष्ट प्रबंधन, भारत सरकार के पर्ाावरण, वन एवं िलवार्ु पररवतना मंत्रालर् द्वारा समर्-समर् पर र्थासंिोजधत, अजधसूचना संख्र्ा सा.का.जन.317(अ), तारीख 29 माचा, 2016 के द्वारा प्रकाजित जनमााण एवं जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अधीन दकर्ा िाएगा; (13) ई–अपजिष्ट - पाररजस्ट्थजतकी संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित समर्-समर् पर र्थासंिोजधत; ई–अपजिष्ट प्रबधं न जनर्म, 2016, के उपबंधों के अधीन दकर्ा िाएगा। (14) सड़क-र्ातार्ात - सड़क-र्ातार्ात को पर्ाावास अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना म ें जविेष प्रावधान सजममजलत दकए िाएंगे। आंचजलक महार्ोिना के तैर्ार होन े और राज्र् सरकार के सक्षम प्राजधकारी से अनुमोदित होन े तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके अधीन बनाए गए जनर्मों एवं जवजनर्मों के अनुसार सड़क-र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन िजनत प्रिषू ण - वाहन िजनत प्रिषू ण की रोकथाम और जनर्ंत्रण लागू जवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईधनों िैसे संपीजड़त प्राकृजतक गैस (सीएनिी), रवीकृत पेरोजलर्म गैस (पीएनिी), आदि के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ा ं . -(क) सरकारी रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पश्चात ् पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए प्रिषू णकारी उद्योग की स्ट्थापना की अनुमजत नहीं िी िाएगी;8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ख) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा द्वारा फरवरी, 2016 में िारी जसद्धान्द्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रिषू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गरै प्रिषू णकारी कुटीर उद्योगों का संवधान दकर्ा िाएगा। (17) पहाड़ी ढलानों का सरं क्षण -पहाड़ी ढलानों का संरक्षण जनम्नानसु ार दकर्ा िाएगा :- (क) आंचजलक महार्ोिना म ें पहाड़ी ढलानों के उन क्षेत्रों को ििार्ा ा िाएगा जिनम ें दकसी भी जनमााण की अनुज्ञा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खड़ी पहाड़ी ढलानों म ें अत्र्जधक भू-क्षरण होता ह ै उनम ें दकसी भी जनमाणा की अनुज्ञा नहीं होगी। 4. पाररजस्ट्थजतकी सवं िे ी िोन म ें प्रजतजषद्ध र्ा जवजनर्जमत दकए िान े वाल े दक्रर्ाकलापों की सचू ी - पाररजस्ट्थजतकी संवेिी िोन में सभी दक्रर्ाकलाप पर्ावा रण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) और उसके अधीन जनर्मात जनर्मों तथा पर्ाावरण, वन और वन्द्र्िीवों से संबंजधत भारत सरकार की अन्द्र् अजधसूचनाओं, जवजधर्ों और अजधजनर्मों द्वारा िाजसत होंगे, िो पूवावती पर्ाावरण एव ं वन मंत्रालर् द्वारा तारीख 14 जसतंबर, 2006 को संख्र्ा 1533(अ) के अधीन िारी की गई थीं, तथा जिन्द्ह ें समर्-समर् पर लाग ू जवजधर्ों द्वारा,समर्-समर् पर सिं ोजधत, नीचे िी गई सारणी में जवजनर्िाष्ट दकर्ा गर्ा ह ैअथाात्:- सारणी क्रम स.ं दक्रर्ाकलाप रटप्पजणर्ा ं (1) (2) (3) क. प्रजतजषद्ध दक्रर्ाकलाप 1. वा जणजज्र्क खनन, पत्थर उत्खनन, (क) पाररजस्ट्थजतकी-संवेिी जोन के भीतर घरों के जनमााण र्ा मरममत के जलए जमट्टी की खुिाई सजहत वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेलू और क्रपिंग इकाइर्ां । आवश्र्कताओं को पूरा करने के जसवार् सभी नए और जवद्यमान (लघु और प्रमुख खजनि), पत्थर उत्खनन और क्रपिंग इकाइर्ों को तत्काल प्रभाव से प्रजतजषद्ध दकर्ा िाता ह।ै (ख) खनन कार्ा माननीर् उच्चतम न्द्र्ार्ालर् के दिनांक 4 अगस्ट्त, 2006 के आिेि (टी.एन. गोिावमान जथरमुलपाि बनाम भारत संघ के मामले में, ररट र्ाजचका संख्र्ा 202/1995) और तारीख 21 अप्रैल, 2014 के आिेि (गोवा फाउंडेिन बनाम भारत संघ के मामले में, लोकजहत र्ाजचका संख्र्ा 435/2012); और आईए संख्र्ा 1000 वषा 2003 तारीख 03 िून, 2022। आईए संख्र्ा 131377 वषा 2022, तारीख 26 अप्रैल, 2023 और 28 अप्रैल, 2023 के जनणार् और आईए संख्र्ा 162023, 162034, 162154 और 162155 वषा 2025 में तारीख 23 िुलाई 2025 के बाि के जनणार् र्ा खनन के संबंध में कोई और आिेि के अनुसार दकए िाएंगे।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 2. प्रि षू ण (िल, वार्ु, मृिा, ध्वजन, आदि) पाररजस्ट्थजतकी-संवेिी जोन में नए प्रिषू णकारी उद्योगों की स्ट्थापना और उत्पन्न करने वाले उद्योगों की स्ट्थापना । जवद्यमान प्रिषू णकारी उद्योगों के जवस्ट्तार की अनुमजत नहीं िी िाएगी। जवद्यमान उद्योगों को प्रिषू ण जनवारण तकनीक और ध्वजन अवरोधक लगाने होंगे। 3. प्रम ुख िलजवद्युत पररर्ोिनाओं की प्रजतजषद्ध। स्ट्थापना। 4. दक सी पररसंकटमर् पिाथा का प्रर्ोग प्रजतजषद्ध। र्ा उत्पािन र्ा प्रस्ट्संकरण । 5. प्राक ृजतक िल जनकार्ों र्ा भूजम क्षेत्र में प्रजतजषद्ध। अनुपचाररत अपजिष्टों को बहाना/प्रवाजहत करना । 6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी-संवेिी िोन के भीतर नई र्ा जवद्यमान आरा जमलों का जवस्ट्तार अनुज्ञात नहीं होगा। 7. ईंट भट्टों की स्ट्थापना। प्रजतजषद्ध। 8. िल ावन लकड़ी का वाजणजज्र्क प्रजतजषद्ध। उपर्ोग। ख.जवजनर्जमत दक्रर्ाकलाप 9. वा जणजज्र्क होटलों और ररसॉर्टसा की पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों के जलए लघु अस्ट्थार्ी संरचनाओं के स्ट्थापना। जनमााण के जसवार्, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटो की स्ट्थापना अनुज्ञात नहीं की िाएगी: बिते, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी- संवेिी िोन के जवस्ट्तार तक, इनमें िो भी अजधक जनकट हो, सभी नए पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना और र्था लागू मागाििाक जसद्धांतों के अनुरूप होगा । 10. संज नमाणा दक्रर्ाकलाप। (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी- संवेिी िोन के जवस्ट्तार तक, िो भी जनकट हो, दकसी भी प्रकार के नए वाजणजज्र्क संजनमाणा की अनुज्ञा नहीं िी िाएगी: बिते, स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने के जलए भवन उपजवजधर्ों के अनुसार पैराग्राफ 3 के उप-पैरा (1) में उजल्लजखत दक्रर्ाकलापों सजहत स्ट्थानीर् लोगों को उनके उपर्ोग के जलए अपनी भूजम पर संजनमाणा करने की अनुज्ञा िी िाएगी, इसका उपर्ोग आजतथ्र् सरकार संर्ोिनों (होटलों, होमस्ट्टे तथा ररिॉटा) के दकए नहीं दकर्ा िाना चाजहए: बिते र्ह भी दक, गैर प्रिषू णकारी लघु उद्योगों से संबंजधत संजनमाणा दक्रर्ाकलाप लागू जनर्मों और जवजनर्मों र्दि, कोई हो, के अनुसार सक्षम प्राजधकारी की पूवा अनुज्ञा से जवजनर्जमत दकए िाएंगे और वे न्द्र्ूनतम होंगे। (ख) एक दकलोमीटर के परे र्े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे। 11. गैर प्रिषू णकारी लघु उद्योग। फरवरी, 2016 में केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा िारी उद्योगों के वगीकरण के अनुसार गैर-प्रिषू णकारी उद्योग और अपररसंकटमर्, लघु और सेवा उद्योग, कृजष, पुष्प कृजष, उद्यान कृजष र्ा पाररजस्ट्थजतकी संवेिी िोन की अपनी सामग्री से उत्पािों को उत्पन्न करने वाले कृजष आधाररत उद्योग सक्षम10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] प्राजधकारी द्वारा अनुज्ञात होंगे। 12. वृक्ष ों की कटाई । (क) राज्र् सरकार में सक्षम प्राजधकारी की पूवा अनुज्ञा के जबना वन र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं की िाएगी। (ख) वृक्षों की कटाई समबद्ध केंरीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगें। 13. वन उत्पािों और गैर काष्ठ वन उत्पािों लागू जवजधर्ों के अधीन जवजनर्जमत होगा। (एनटीएफपी) का संग्रहण । 14. जव द्युत और संचार टॉवर लगाने, तार- लाग ू जवजधर्ों के अधीन जवजनर्जमत होगा) भूजमगत केबल जबछाने को बढ़ावा दिर्ा िाना चाजहए । जबछाने तथा अन्द्र् बुजनर्ािी ढांचे की व्यवस्ट्था । 15. ना गररक सुजवधाओं सजहत बुजनर्ािी लागू जवजधर्ों, जनर्मों और जवजनर्मों तथा उपलब्ध मागाििाक जसद्धांतों के ढांचा। अनुसार िमन उपार्ों के साथ दकर्ा िाएगा 16. जव द्यमान सड़कों को चौड़ा करना, उन्द्हें लागू जवजधर्ों, जनर्मों और जवजनर्मों तथा उपलब्ध मागा ििाक जसद्धांतों के सुिढृ बनाना । अधीन िमन उपार् दकए िाएंगे। 17. पर् ाटन से संबंजधत अन्द्र् दक्रर्ाकलापों लागू जवजधर्ों के अनुसार जवजनर्जमत होगें। िैसे वार्ुर्ान, हॉट एर्र बलै ून, हजे लकॉप्टर, ड्रोन, माइक्रोलाइर्टस आदि द्वारा संरजक्षत क्षेत्र और पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से उड़ने के दक्रर्ाकलाप करना। 18. पह ाड़ी ढलानों और निी तटों का लागू जवजधर्ों के अनुसार जवजनर्जमत होगें। संरक्षण। 19. राज त्र में मोटर र्ातार्ात का संचलन । लागू जवजधर्ों के अधीन वाजणजज्र्क उद्देश्र् के जलए जवजनर्जमत। 20. फम ों, कंपजनर्ों, कॉरपोरेर्टस द्वारा बड़े स्ट्थानीर् आवश्र्कताओं की पूर्ता करने के अलावा लागू जवजधर्ों के अनुसार जवजनर्जमत होगें। पैमाने पर वाजणजज्र्क पिुधन और कुक्कुट फामों इत्र्ादि की स्ट्थापना। 21. प्राक ृजतक िल जनकार्ों र्ा भू-क्षत्रे में उपचाररत अपजिष्ट िल र्ा बजहस्रााव का िल जनकार्ों में जनस्ट्सारण नहीं होन े उपचाररत अपजिष्ट िल र्ा बजहस्रााव दिर्ा िार्ेगा और उपचाररत अपजिष्ट िल के पुनचाक्रण और इसके परै ा 4 के अधीन सारणी में जवजनर्िाष्ट प्रजतजषद्ध दक्रर्ाकलापों को छोडकर, और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरणीर् मंिूरी के जलए, िैसा भी मामला हो, केन्द्रीर् सरकार के पर्ाावरण, वन और 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this 110003, or send it to the e-mail address of the Ministry at esz-mef@nic.in Draft Notification WHEREAS, the Great Himalayan National Park Conservation Area (GHNPCA) encompassing an area of 905.4 square kilometres, comprises of Great Himalayan National Park (754.40 square kilometre), Sainj Wildlife Sanctuary (90 square kilometre) and Tirthan Wildlife Sanctuary (61 square kilometre) is situated in Banjar Sub- division of Kullu district in Himachal Pradesh;26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS the Great Himalayan National Park Conservation Area which is characterized by high alpine peaks, alpine meadows and riverine forests was inscribed into the list of UNESCO World Heritage Sites on 25th June, 2014 and harbours rich floral diversity comprising 128 families, 427 genera and 832 plant species (Angiosperms- 794 species, Gymnosperms- 11 species and Ferns- 27 species). It is habitat to 34 out of the 47 medicinal plant taxa categorized as Threatened in the State of Himachal Pradesh (Vulnerable- 12, Endangered- 17 and Critically Endangered- 5). Biodiversity surveys conducted during the past decade have recorded 31 mammal species, 224 bird species, 12 reptile species, 9 amphibian species and 125 insect species. The National Park falls within one of the globally important Endemic Bird Areas (EBA- D02: Western Himalaya), with 224 bird species recorded; AND WHEREAS the area provides habitat to key faunal and floral symbols of the Himachal Pradesh State, namely the Tragopan melanocephalus (State Bird- Western Tragopan), Panthera uncia (State Animal- Snow Leopard), Rhododendron campanulatum (State Flower- Pink Rhododendron) and Cedrus deodara (State Tree- Deodar) and approximately 10 per cent of the total wild population of Western Tragopan is reported to inhabit the GHNPCA; AND WHEREAS the various flora species recorded in these protected areas includes Deodar (Cedrus deodara), Blue Pine (Pinus wallichiana), Chir Pine (Pinus roxburghii), Himalayan Spruce (Picea smithiana), Fir (Abies pindrow), Rakhal (Taxus baccata), Mohru (Quercus dilatata), Kharshu (Q. semecarpifolia), Banj (Q. leucotrichophora), Horse Chestnut (Aesculus indica), Walnut (Juglans regia), Kosh (Alnus nepalensis), Buransh (Rhododendron arboreum), Pink Buransh (R. campanulatum), Himalayan Poplar (Populus ciliata), Ilex dipyrena, Sorbaria tomentosa, Prinsepia utilis, Arundinaria falcata, Corylus jacquemontii, Iris lactea, Sarcococca saligna, Carpinus viminea, Berberis lycium, B. aristata, Viburnum spp., Acer spp., Hippophae spp., Valeriana jatamansi, Dactylorhiza hatagirea, Taxus baccata, Leycesteria formosa, etc.; AND WHEREAS the important faunal species found in the area, including several endangered and Himalayan endemic species comprises of Snow Leopard (Panthera uncia), Common Leopard (Panthera pardus), Himalayan Serow (Capricornis sumatraensis thar), Himalayan Tahr (Hemitragus jemlahicus), Goral (Nemorhaedus goral), Black Bear (Ursus thibetanus), Musk Deer (Moschus moschifera), Brown Bear (Ursus arctos), Himalayan Yellow Throated Marten (Martes flavigula), Monkey (Macaca mullata), Langur (Semnopithecus ajax), Jackal (Canis aureus), Blue Sheep (Pseudois nayaur), Red Fox (Vulpes vulpes), Giant Indian Flying Squirrel (Petaurista philippensis), Western Tragopan (Tragopan melanocephalus), Cheer (Catreus wallichii), Monal (Lophophorus impegenus), Koklas (Pucrasia macrolopha), Kaleej (Lophura leucomelana), Red Jungle Fowl (Gallus gallus), Snow Partridge (Lerwa lerwa), Hill Partridge (Arborophila torqueola), Himalayan Snowcock (Tetragallus himalayensis), White-browed Shortwing (Brachypteryx montana), Little Pied Flycatcher (Ficedula westermanni), Rufous-vented Tit (Parus rubidiventris), Eurasian Woodcock (Scolopax rusticola), Himalayan Griffon (Gyps himalayensis), Lammergeier (Gypaetus barbatus), Golden Eagle (Aquila chrysaetos), Common Buzzard (Buteo buteo), Eurasian Sparrowhawk (Accipiter nisus), Scaly-bellied Woodpecker (Picus squamatus), Himalayan Woodpecker (Dendrocopos himalayensis), Great Barbet (Megalaima virens), Collared Owlet (Glaucidium brodici), Tawny Owl (Strix aluco), Mountain Scops-Owl (Otus spilocephalus), Eurasian Hoopoe (Upupa epops) etc.; AND WHEREAS it is necessary to conserve and protect the area, extent and boundary which is specified in paragraph 1 of this notification around the Great Himalayan National Park Conservation Area as Eco-sensitive zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub section (l) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub- rule (3) of Rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area to an extent of 0 to 10.63 kilometre around the boundary of Great Himalayan National Park, Sainj and Tirthan Wildlife Sanctuaries in the State of Himachal Pradesh as the Great Himalayan National Park Conservation Area Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of Eco-sensitive Zone. – (1) the extent of Eco-Sensitive Zone shall vary from 0 to 10.63 kilometre around the boundary of Great Himalayan National Park Conservation Area encompassing[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27 an area of 326.6985 square kilometre. An extent of 0 kilometre has been proposed due to common boundary with Kanawar and Rupi Bhaba Wildlife Sanctuaries, Pin Valley and Khirganga National Parks. Zonal Master Plan for Eco-Sensitive Zone. — (1) The State Government shall, for the purpose of the Eco-sensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan: i. Environment; ii. Forest and Wildlife; iii. Urban Development; iv. Rural Development; v. Tourism; vi. Revenue; vii. Agriculture; viii. Animal Husbandry; ix. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government. — The State Government shall take the following measures for giving effect to the provisions of this notification, namely: - (1) Land use. — (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities. Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as: i. Widening and strengthening of existing roads and construction of new roads; ii. Construction and renovation of infrastructure and civic amenities; iii. Small scale industries not causing pollution; iv. Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and v. Promoted activities given under paragraph 4. Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies. — The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism. — a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; b) the Eco-Tourism Master Plan shall be prepared by State Department of Tourism in consultation with State Departments of Environment and Forests;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 29 c) the Tourism Master Plan shall form a component of the Zonal Master Plan; d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-Sensitive Zone; e) The activities of eco-tourism shall be regulated as under, namely: - (i) new construction of hotels and resorts shall not be allowed within one kilometer from the boundary of the protected area or upto the extent of the Eco-Sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-Sensitive Zone area. (4) Natural heritage. — All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.— Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. (6) Noise pollution.— Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986 and as amended from time to time. (7) Air pollution.— Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto. (8) Discharge of effluents. — Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes. — Disposal and Management of solid wastes shall be as under: - a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 and as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (10) Bio-medical waste. — Bio medical waste management shall be as under: a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016, as amended from time to time. b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (11) Plastic waste management. — The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management. — The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste. — The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (14) Vehicular traffic. — The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution. — Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc. (16) Industrial units. — a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. b) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016 as amended from time to time, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes. — The protection of hill slopes shall be as under: (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone. — All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under and other notifications, laws and Acts of the Government of India pertaining to environment, forests and wildlife, in the erstwhile Ministry of Environment and Forest, vide number 1533(E), dated the 14th September, 2006 and laws for the time being in force in the manner and as amended from time to time specified in the Table below, namely.-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 31 TABLE S. (b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan. 11. Small scale non-polluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016, as amended from time to time and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority. 12. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under. 13. Monitoring Committee. — The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely: S. Functions of Monitoring Committee. — (1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinise, the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification. (2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case-to-case basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in proforma specified in Annexure-V, appended to this notification. (6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures. — The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 35 8. The boundary then follows upto the geo-coordinates E 077017’17.043” and 31048’44.208” further in the North-west. 2. East: - On eastern front, the area completely touches the Pin Valley National Park and Rupi Bhabha Wildlife Sanctuary. On South eastern side falling in Rampur Forest division, a one-kilometer wide strip of ESZ follows the geo-coordinates E 077045’24.237” & N 31042’29.738”, E 077041’9.511” & N 31041’41.627” and then upto E 077039’31.210” & N 31039’34.734”. 3. South: - In the South, the boundary of ESZ runs from the geo-coordinates E 077039’31.210” & N 31039’34.734” in the South-East through E 077032’45.024” & N 31034’57.572” South of Tirthan Wildlife Sanctuary upto the geo-coordinates E 077024’47.841” & N 31035’7.520” in South-West. 4.
