के अधीन प्रित्त िजिर्ों का प्रर्ोग करते हुए प्रस्ट्ताजवत जनम्नजलजखत प्रारुप अजधसूचना को िारी करने का प्रस्ट्ताव करती है, इसके द्वारा पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) की अपेक्षानुसार इससे प्रभाजवत होन े वाली िनसाधारण की िानकारी के जलए प्रकाजित करती ह;ै और एतद्द्वारा र्ह सूजचत दकर्ा िाता ह ै दक उि प्रारुप अजधसूचना पर उस तारीख से साि दिन की अवजध की समाजि पर र्ा उसके बाि जवचार दकर्ा िाएगा जिस तारीख को इस अजधसूचना वाले रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी िाती ह।ैं ऐसा कोई भी व्यजि, जिसे इस प्रारूप अजधसूचना म ें अतं र्वाष्ट प्रस्ट्तावों के संबंध म ें कोई आपजत्त ह िजक्षणी संरजक्षत क्षेत्र ह।ैं र्ह पजिमी घाट में जस्ट्थत अगस्ट््र्मलाई िैवमडं ल अभर्ारण्र् और पेररर्ार हाथी अभर्ारण्र् के मख्ु र् क्षेत्र का जहस्ट्सा ह।ै इन िोनों वन्द्र्िीव अभर्ारण्र्ों में समृद्ध िैव कलामाला एक्सटेंिन, कोट्टूर एक्सटेंिन और नेट्टुकलथेररकुन्नू आरजक्षत वनों के अधीन आता ह।ै पेप्पारा वन्द्र्िीव अभर्ारण्र् कोट्टूर और पालोड आरजक्षत वनों के अधीन आता ह।ै र् े वन्द्र्िीव अभर्ारण्र् जतरुवनंतपरु म वन्द्र्िीव प्रभाग के प्रिासजनक जनर्ंत्रण में ह।ैं और चदूं क, नेय्र्र वन्द्र्िीव अभर्ारण्र् पजिमी घाट के िजक्षण-पूवी कोने में 128 वगा दकलोमीटर क्षेत्र म ें फैला हुआ ह।ै र्ह जतरुवनंतपरु म जिल े के नेय्र्ाजतनकारा तालुका म ें 8017’ और 8053’ उत्तरी अक्षांि तथा 76040’ और 77017’ पवू ी िेिांतर के बीच जस्ट्थत ह;ै और चदूं क, पेप्पारा वन्द्र्िीव अभर्ारण्र् 53 वगा दकलोमीटर क्षेत्र में फैला हुआ ह ैऔर कोट्टूर और पालोड आरजक्षत वनों के अधीन आता ह।ै र्ह जतरुवनतं पुरम जिले के नेिमु गं ड तालुका में 80° 34' और 80° 41' उत्तरी अक्षांि तथा 77° 6' और 77° 14' पूवी ििे ांतर के बीच जस्ट्थत ह;ै और चदूं क, नेय्र्र वन्द्र्िीव अभर्ारण्र् को िीओ (एमएस) 871/58 तारीख 06.01.1958 के माध्र्म स े अजधसूजचत दकर्ा गर्ा था और इसकी सीमाओं को िीओ (पी) संख्र्ा 2305/एफ2/71 तारीख 18.03.1971 के माध्र्म से पुनः अजधसूजचत दकर्ा गर्ा था, जिसमें नेय्र्र िलािर् को वन्द्र्िीव अभर्ारण्र् में सजममजलत दकर्ा गर्ा था। पेप्पारा वन्द्र्िीव अभर्ारण्र् को िीओ (पी) संख्र्ा 379/83 तारीख 21.12.1981 के माध्र्म से अजधसूजचत दकर्ा गर्ा था; और चदूं क, संरजक्षत क्षेत्र में प्रार्द्वीपीर् भारत के लगभग सभी प्रमुख स्ट्तनधारी िीव पाए िाते ह।ैं अभर्ारण्र् की स्ट्थलाकृजत और िलवार् ु जवजभन्न सूक्ष्म और वृहि पर्ाावासों के जवकास को संभव बनाती है, िो र्हां के जवजभन्न प्रकार के िानवरों को आश्रर् प्रिान करते ह।ैं िीव-िंतुओं की जवजवधता म ें स्ट्तनधारी (43 प्रिाजतर्ां), पक्षी (233 प्रिाजतर्ां), सरीसृप (46 प्रिाजतर्ां), उभर्चर (13 प्रिाजतर्ां), मछजलर्ा ं(27 प्रिाजतर्ां) और जततजलर्ों की एक जवस्ट्ततृ जवजवधता िाजमल है; और चदूं क, नय्े र्र-पेप्पारा वन्द्र्िीव अभर्ारण्र् वनस्ट्पजत जवजवधता का खिाना हैं, जिनमें 132 स े अजधक पररवारों स े संबंजधत लगभग 1000 प्रिाजतर्ों के पुष्पीर् पौधे पाए िाते हैं, िो केरल से अनुमाजनत कुल पष्ु पीर् पौधों का लगभग 22% ह।ै वनस्ट्पजत म ें मुख्र् रूप स े सिाबहार और नम पणापाती वन सजममजलत ह,ैं जिसमें जवजभन्न प्रकार पेप्पारा अभर्ारण्र् के िगं ल करमाना निी के िलग्रहण क्षत्रे ह।ैं और चदूं क, नय्े र्र-पेप्पारा वन्द्र्िीव अभर्ारण्र् के उस क्षेत्र, जवस्ट्तार और सीमाओं का संरक्षण और सुरक्षा करना आवश्र्क ह,ै जिन्द्ह ें परै ाग्राफ 1 म ें पाररजस्ट्थजतक, पर्ाावरणीर् और िैव जवजवधता के िजृष्टकोण से पाररजस्ट्थजतकी-संवेिी िोन के रूप म ें जवजनर्िाष्ट दकर्ा गर्ा ह,ै और उि पाररजस्ट्थजतकी-संवेिी िोन म ें उद्योगों र्ा उद्योगों के वगा और उनके संचालन और प्रदक्रर्ाओं को प्रजतबंजधत करना आवश्र्क ह;ै अतः अब, केंद्र सरकार पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित, पर्ाावरण (सरं क्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, केंद्र सरकार एति ् द्वारा केरल के नेय्र्र-पेप्पारा वन्द्र्िीव अभर्ारण्र् की सीमा के चारों ओर एक पाररजस्ट्थजतकी-संवेिी िोन (जिसे इसके बाि पाररजस्ट्थजतकी-संवेिी िोन कहा िाएगा) के रूप म ें अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह:ै अथाात्: - पाररजस्ट्थजतकी-सवं िे ी िोन का जवस्ट्तार एव ं सीमाए.ाँ – (1) पाररजस्ट्थजतकी-संवेिी िोन 52.036 वग ा दकलोमीटर का होगा, जिसका जवस्ट्तार नेय्र्र-पेप्पारा वन्द्र्िीव अभर्ारण्र्ों की सीमाओं से 0 (िन्द्ू र्) से 2.72 दकलोमीटर तक होगा और औसत िरू ी 1.3 दकलोमीटर होगी। जवजभन्न दििाओं में पाररजस्ट्थजतकी-संवेिी िोन का जवस्ट्तार नीचे दिर्ा गर्ा ह:ै - दििा पाररजस्ट्थजतकी-सवं िे ी िोन का जवस्ट्तार (दकमी) उत्तर 1 उत्तर-पूव ा 0 पूवा 0 िजक्षण-पूव ा 0 िजक्षण 0 िजक्षण-पजिम 1.23 पजिम 2.72 उत्तर-पजिम 1.05 पाररजस्ट्थजतकी-सवं िे ी िोन (इएसिडे ) को िन्द्ू र् घोजषत करन ेका औजच्र्: • अभर्ारण्र्ों की उत्तर-पूवा, पवू ा, िजक्षण और िजक्षण-पूव ा सीमाएाँ तजमलनाडु की अंतरराज्र्ीर् सीमा से सटी हुई हैं, िो कलाक्कड़ मडुं नथुराई बाघ अभर्ारण्र् और कन्द्र्ाकुमारी वन्द्र्िीव अभर्ारण्र् से सटी हुई ह।ैं • नेय्र्र-पेप्पारा वन्द्र्िीव अभ्र्ारण्र्ों की िजक्षणी सीमा के बाहर जस्ट्थत घनी आबािी वाले गााँवों को पाररजस्ट्थजतकी-संवेिी िोन से बाहर रखा गर्ा ह।ै (2) नय्े र्र वन्द्र्िीव अभर्ारण्र् और पेप्पारा वन्द्र्िीव अभर्ारण्र् तथा इसके पाररजस्ट्थजतकी-संवेिी िोन की सीमा का जववरण अनलु िक-I की सारणी क, सारणी ख और सारणी ग के रूप में सलं ि ह।ै[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (3) नेय्र्र-पेप्पारा वन्द्र्िीव अभर्ारण्र्ों के मानजचत्र, जिनमें पाररजस्ट्थजतकी-संवेिी िोन का सीमांकन, सीमा जववरण तथा अक्षांि और िेिांतर ििााए गए ह,ैं अनलु िक-IIक, अनलु िक-IIख और अनलु िक-IIग के रूप में संलि ह।ैं (4) नेय्र्र वन्द्र्िीव अभर्ारण्र् और पेप्पारा वन्द्र्िीव अभर्ारण्र् तथा पाररजस्ट्थजतकी-संवेिी िोन की सीमा के भौगोजलक जनिेिांकों की सूची अनलु िक-III की सारणी क, सारणी ख और सारणी ग म ेंिी गई ह।ै (5) पाररजस्ट्थजतकी-संवेिी िोन में आन े वाले गांवों की सूची, उनके प्रमुख ल्बंिओंु पर भौगोजलक जनिेिांकों सजहत, अनलु िक-IV की सारणी क और सारणी ख के रूप में सलं ि ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए, स्ट्थानीर् लोगों से परामिा करके और इस अजधसूचना के उपबंधों के अनरूु प, आजधकाररक रािपत्र में इस अजधसूचना के प्रकािन की जतजथ स ेिो वषा के भीतर एक आंचजलक महार्ोिना तैर्ार करेगी। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसचू ना के उपबंधों के अधीन तथा केंद्रीर् और राज्र् जवधानों के सुसंगत और केंद्रीर् सरकार द्वारा िारी मागाििाक जसद्धांतों, र्दि कोई हों, के अनरुु प तैर्ार की िाएगी। (3) आंचजलक महार्ोिना, राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ासे तैर्ार की िाएगी तादक पाररजस्ट्थजतकी और पर्ाावरणीर् िजृ ष्टकोणों को एकीकृत दकर्ा िा सके.- i. पर्ाावरण; ii. वन और वन्द्र्िीव; iii. िहरी जवकास; iv. पर्ाटन; v. नगरपाजलका; vi. रािस्ट्व; vii. केरल राज्र् प्रिषू ण जनर्ंत्रण बोडा; viii. पंचार्ती राि; ix. कृजष; x. लोक जनमााण जवभाग। (4) आंचजलक महार्ोिना म ें अनुमोदित भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा िब तक इस अजधसूचना म ें ऐसा जवजनर्िाष्ट न हो, तथा आचंजलक महार्ोिना की सभी अवसंरचनाओं और उसके दक्रर्ाकलापों म ें सुधार करके उन्द्ह े अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनान े की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना, म ें वृक्षहीन क्षेत्रों की बहाली, जवद्यमान िल जनकार्ों के सरं क्षण, िल ग्रहण क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भ-ू िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐसे अन्द्र् पहलुओं का प्रावधान दकर्ा िाएगा, जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह ै। (6) आंचजलक महार्ोिना म ें सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों और दकस्ट् मों, कृजष क्षेत्रों, उपिाऊ भूजम, उद्यानों और उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा, सहार्क मानजचत्रों के साथ जिनम ें जवद्यमान तथा प्रस्ट्ताजवत भ-ू उपर्ोग जविेषताओं के ब्र्ौरों का जनधाारण दकर्ा िाएगा। (7) इस आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी-संवेिी िोन के जवकास का जवजनर्जमत दकर्ा िाएगा और पैरा 4 म ें सूचीबद्ध प्रजतजषद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन दकर्ा िाएगा और स्ट्थ ानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजित दकर्ा िाएगा और उसका संवधना दकर्ा िाएगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी ।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (9) इस प्रकार अनुमोदित आंचजलक महार्ोिना, इस अजधसूचना के उपाबंधों के अनुसार जनगरानी के अपने कार्ों को पूरा करने के जलए जनगरानी सजमजत के जलए संिभ ा िस्ट्तावेि होगा। 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्. - राज्र् सरकार अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्: - (1) भ-ू उपर्ोग. – (क) पाररजस्ट्थजतकी-संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खलु े स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा पररवतान की अनुमजत नहीं होगी: बित े दक पाररजस्ट्थजतकी-संवेिी िोन के भीतर कृजष और अन्द्र् भूजम का रूपांतरण, भाग (क) म ें जनर्िाष्ट उद्दश्े र् के अलावा अन्द्र् उद्देश्र् के जलए, मॉनीटटरंग सजमजत की जसफाररि पर केंद्र तथा राज्र् सरकार के िहरी जनर्ोिन अजधजनर्म तथा अन्द्र् जनर्मों एव ं जवजनर्मों र्था लागू, के अधीन तथा इस अजधसूचना के उपबंधों के पूवा अनुमोिन स े स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को परू ा करने के जलए अनुमजत िी िा सकती ह,ै िैसे,- (i) जवद्यमान सड़कों को चौड़ा करना, उन्द्ह ेंसुिढ़ृ करना और नई सड़कों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का सजन्नमााण और नवीनीकरण; (iii) प्रिषू ण उ्पन्न न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योग एव ं ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और (v) पैराग्राफ-4 के मि में र्था उजल्लजखत संवर्धात दक्रर्ाकलापः परंत ु र्ह भी दक राज्र् सरकार में सक्षम प्राजधकारी की पूवा स्ट्वीकृजत और राज्र् सरकार के अन्द्र् जनर्मों एवं जवजनर्मों के अनुपालन के जबना तथा संजवधान के अनुच्छेि 244 र्ा उस समर् लाग ू जवजधर्ों, जिसमें अनुसूजचत िनिाजत और अन्द्र् पारंपररक वनवासी (वन अजधकार मान्द्र्ता) अजधजनर्म, 2006 (2007 का अजधजनर्म 2) सजममजलत है, के उपबंधों के अनुपालन के जबना वाजणजज्र्क और औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के दकसी भी उपर्ोग की अनुमजत नहीं िी िाएगी: परंत ु र्ह भी दक पाररजस्ट्थजतकी-संवेिी िोन के अधीन आने वाली भूजम के अजभलेखों म ें हुई दकसी त्रुरट को, मॉनीटटरंग सजमजत के जवचार प्राि करन े के पिात,् राज्र् सरकार द्वारा प्र्र्ेक मामल े म ें एक बार सुधारा िाएगा और उि त्रुरट को सुधारने की सूचना केंद्र सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह भी दक उपर्िुा त्रुरट को सुधारन े म,ें इस उप-परै ा म ें र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भ-ू उपर्ोग का पररवतान सजममजलत नहीं होगा: (ख) अनुप्रर्िु र्ा अनु्प ािक कृजष क्षेत्रों म ें वनीकरण तथा पर्ाावासों की बहाली के कार्ाकलापों स े पनु : वनीकरण दकए िाने के प्रर्ास दकए िाएगं े। (2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक स्रोतों/निी/निी के िलग्रहण क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और पुनरुद्धार की र्ोिनाओं को आचं जलक महार्ोिना म ें सजममजलत दकर्ा िाएगा। (3) पर्टा न र्ा पारर-पर्टा न – (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पारर-पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन सबं ंधी पर्ाटन महार्ोिना के अनसु ार होगा। (ख) पर्ाटन महार्ोिना, पर्ाटन जवभाग द्वारा केरल सरकार के रािस्ट्व एव ं वन जवभाग के परामिा स ेतैर्ार दकर्ा िाएगा; (ग) पर्ाटन महार्ोिना, आंचजलक महार्ोिना का घटक होगी; (घ) पर्ाटन महार्ोिना, पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी; (ङ) पारर-पर्ाटन संबंधी दक्रर्ाकलाप जनमन ानुसार जवजनर्जमत दकए िाएंगे, अथाात:् - (i) संरजक्षत क्षेत्र की सीमा से एक दकमी. के पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी पास हो, होटलों और ररजॉटास् के नए जनमाणा की अनमु जत नहीं िी िाएगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 बिते दक सरं जक्षत क्षेत्र की सीमा से एक दकमी. की िरू ी के बाि पाररजस्ट्थजतकी संवेिी िोन की सीमा तक नए होटलों और ररजॉटा ररजॉटास ् की स्ट्थापना की अनुमजत आंचजलक महार्ोिना के अनुसार केवल पारर-पर्ाटन सुजवधाओं के जलए पूवा –पररभाजषत और नाजमत क्षेत्रों में ही िी िाएगी। (ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दक्रर्ाकलापों र्ा मौिूिा पर्ाटन दक्रर्ाकलापों का जवस्ट्तार केंद्र सरकार द्वारा िारी मागिा िाक जसद्धांतों और राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरणों द्वारा िारी पाररजस्ट्थजतकी पर्ाटन मागाििाक जसद्धांतों (समर्-समर् पर सिं ोजधत) के अधीन होगा, जिसम ें पाररजस्ट्थजतकी पर्टा न, पाररजस्ट्थजतकी जिक्षा और पाररजस्ट्थजतकी जवकास पर िोर दिर्ा िाएगा; (iii) िब तक इस आंचजलक महार्ोिना को अनुमोदित नहीं कर दिर्ा िाता तब तक पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार की अनुमजत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा स्ट्थल जवजिष्ट िांच और जनगरानी सजमजतर्ों की जसफाररि के आधार पर िी िाएगी। (4) प्राकृजतक जवरासत – पाररजस्ट्थजतकी संवेिी िोन के अधीन आने वाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैस े दक िीन पूल ररजवा क्षत्रे , िैल सरं चना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उ्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ेंएक जवरासत सरं क्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल - पाररजस्ट्थजतकी संवेिी िोन म ें ऐजतहाजसक, स्ट्थाप्र्, सौंिर्पा रक और सांस्ट्कृजतक मह्व की इमारतों, संरचनाओं, कलाकृजतर्ों, क्षत्रे और पररसरों की पहचान की िाएगी और उनके संरक्षण के जलए जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना म ें सजममजलत की िाएगी। (6) ध्व जन प्रिषू ण – पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रिषू ण की रोकथाम और जनर्ंत्रण ध्वजन प्रिषू ण (जनर्मन और जनर्ंत्रण) जनर्म, 2000 के उपाबंधों के अनुसार और समर्-समर् पर र्थासंिोजधत दकए गए प्रावधानों के अनुसार दकर्ा िाएगा। (7) वार् ु प्रिषू ण- पाररजस्ट्थजतकी संवेिी िोन में वार्ु प्रिषू ण की रोकथाम और जनर्ंत्रण, वार्ु (प्रिषू ण जनवारण एव ं जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) के उपाबंधों के अनुसार और समर्-समर् पर र्थासंिोजधत प्रावधानों के अनुसार दकर्ा िाएगा। (8) बजहस्राव का जनस्ट्सरण -पाररजस्ट्थजतकी-संवेिी िोन म ें उपचाररत अपजिष्टों का जनवाहन पर्ाावरण (सरं क्षण) अजधजनर्म, 1986 (समर्-समर् पर संिोजधत) के अधीन आन े वाले पर्ाावरण प्रिषू कों के जनवहा न के जलए सामान्द्र् मानकों और उसके अधीन बनाए गए जनर्मों र्ा राज्र् सरकार द्वारा जनधााररत मानकों, इनमें स े िो भी अजधक किोर हो, के उपबंधों के अधीन होगा। (9) िोस अपजिष्ट - िोस अपजिष्ट का जनपटान एवं प्रबधं न जनम्नानुसार दकर्ा िाएगा. - (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट जनपटान और प्रबंधन, िोस अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा, जिसे भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा अजधसूचना संख्र्ा का. आ. 1357(अ), तारीख 8 अप्रैल, 2016 द्वारा प्रकाजित दकर्ा गर्ा ह ै और समर्-समर् पर संिोजधत दकर्ा गर्ा ह;ै अकाबाजनक पिाथों का जनपटान पाररजस्ट्थजतकी संवेिी िोन के बाहर जचजन्द्हत स्ट्थल पर पर्ाावरण अनुकूल तरीके से दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में में िोस अपजिष्ट को िलाना र्ा भस्ट्म करना तथा लडैं दफल का जनमााण करना प्रजतजषद्ध होगा। (10) िवै जचदक्सा अपजिष्ट. - िैव जचदक्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी-संवेिी िोन में िैव-जचदक्सा अपजिष्ट का जनपटान, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा समर्-समर् पर र्था संिोजधत, अजधसूचना संख्र्ा सा.का.जन.343(अ), तारीख 28 माचा, 2016 द्वारा प्रकाजित िैव-जचदक्सा अपजिष्ट प्रबंधन जनर्म, 2016 के अधीन दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी भी प्रकार की सावािजनक िोधन सुजवधा र्ा भस्ट्मीकरण की अनुमजत नहीं होगी।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (11) प्लाजस्ट्टक अपजिष्ट का प्रबधं न -पाररजस्ट्थजतकी संवेिी िोन म ें प्लाजस्ट्टक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा, समर्-समर् पर र्थासंिोजधत; अजधसूचना संख्र्ा सा.का.जन.340(अ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अधीन दकर्ा िाएगा; (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न - पाररजस्ट्थजतकी-सवं ेिी िोन में जनमााण एवं जवध्वंस अपजिष्ट प्रबंधन, भारत सरकार के पर्ाावरण, वन एवं िलवार्ु पररवतना मंत्रालर् द्वारा समर्-समर् पर र्थासंिोजधत, अजधसूचना संख्र्ा सा.का.जन.317(अ), तारीख 29 माचा, 2016 के द्वारा प्रकाजित जनमााण एवं जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अधीन दकर्ा िाएगा; (13) ई–अपजिष्ट - पाररजस्ट्थजतकी संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित समर्-समर् पर र्थासंिोजधत; ई–अपजिष्ट प्रबधं न जनर्म, 2016, के उपबंधों के अधीन दकर्ा िाएगा। (14) सड़क-र्ातार्ात - सड़क-र्ातार्ात को पर्ाावास अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना म ें जविेष उपाबंध सजममजलत दकए िाएंगे। आंचजलक महार्ोिना के तर्ै ार होने और राज्र् सरकार के सक्षम प्राजधकारी स े अनुमोदित होन े तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके अधीन बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार सड़क-र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन िजनत प्रिषू ण - वाहन िजनत प्रिषू ण की रोकथाम और जनर्ंत्रण लागू जवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईधनों िैसे संपीजड़त प्राकृजतक गैस (सीएनिी), द्रवीकृत पेरोजलर्म गैस (पीएनिी), आदि के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ा ं. -(क) आजधकाररक रािपत्र म ेंइस अजधसूचना के प्रकािन तक र्ा उसके पिात ्पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए प्रिषू णकारी उद्योग की स्ट्थापना की अनुमजत नहीं िी िाएगी; (ख) केन्द्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा िनवरी, 2025 म ें िारी जसद्धान्द्तों में समर्-समर् पर संिोजधत रूप म ें उजल्लजखत उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रिषू णकारी उद्योगों को अनुमत दकर्ा िाएगा और इसके अजतररि, गरै प्रिषू णकारी कुटीर उद्योगों का संवधान दकर्ा िाएगा। (17) पहाड़ी ढलानों का सरं क्षण -पहाड़ी ढलानों का संरक्षण जनम्नानसु ार दकर्ा िाएगा :- (क) आंचजलक महार्ोिना म ें पहाड़ी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी जनमाणा की अनुमजत नहीं होगी; (ख) जिन जवद्यमान ढलानों र्ा खड़ी पहाड़ी ढलानों म ें अ्र्जधक भू-क्षरण होता ह ै उनम ें दकसी भी जनमाणा की अनुज्ञा नहीं होगी। 4. पाररजस्ट्थजतकी सवं िे ी िोन म ेंप्रजतजषद्ध र्ा जवजनर्जमत दकए िान ेवाल ेदक्रर्ाकलापों की सचू ी- 1927 (1927 का 16), वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69) तथा अन्द्र् लागू जवजधर्ों, जिनमें तटीर् जवजनर्मन क्षेत्र (सीआरिडे ), 2011, पर्ावा रण प्रभाव आकलन (ईआईए) अजधसूचना, 2006, तथा उनमें दकए गए संिोधन और राज्र् में प्रचजलत अन्द्र् अजधजनर्म सजममजलत ह,ैं के उपाबंधों द्वारा संचाजलत होंगें । पाररजस्ट्थजतकी संवेिी िोन के अधीन आन े वाले वन क्षेत्र वतमा ान वन जवजधर्ों तथा उनम ें दकए गए सिं ोधनों के अधीन ही संचाजलत होता रहगे ा। इस अनुच्छेि के उपाबंधों के अधीन रहत े हुए, पाररजस्ट्थजतकी संवेिी िोन म ें दक्रर्ाकलापों का जवजनर्मन नीचे िी गई सारणी में जवजनर्िाष्ट रीजत स ेदकर्ा िाएगा, अथाात:् -[भाग 131377 वष ा 2022, तारीख 26 अप्रलै , 2023 और 28 अप्रलै , 2023 के जनणार् और आईए संख्र्ा 162023, 162034, 162154 और 162155 वष ा 2025 में तारीख 23 िलु ाई 2025 के बाि के जनणार् र्ा खनन के संबंध में कोई और आििे के अनुसार दकए िाएंगे। 2. प्रि षू ण (िल, वार्,ु मृिा, ध्वजन, पाररजस्ट्थजतकी-संवेिी जोन म ें नए प्रिषू णकारी उद्योगों की स्ट्थापना आदि) उ्पन्न करने वाले उद्योगों और जवद्यमान प्रिषू णकारी उद्योगों के जवस्ट्तार की अनुमजत नहीं िी की स्ट्थापना । िाएगी। बिते दक, केंद्रीर् प्रिषू ण जनर्त्रं ण बोडा द्वारा िनवरी 2025 में िारी मागाििाक जसद्धांतों में उद्योगों के वगीकरण के अनुसार, समर्-समर् पर संिोजधत रूप में पाररजस्ट्थजतकी-संवेिी जोन के भीतर गैर- प्रिषू णकारी उद्योगों को अनमु जत िी िाएगी, िब तक दक इस अजधसूचना म ें अन्द्र्था जनर्िाष्ट न दकर्ा गर्ा हो, और इसके अजतररि, गैर-प्रिषू णकारी कुटीर उद्योगों द्वारा प्रजतजषद्ध। बड़े पैमाने पर वाजणजज्र्क पिधु न और कुक्कुट फामों इ्र्ादि की स्ट्थापना। 8. का ष्ठ आधाररत नर्ा उद्योग। प्रजतजषद्ध। 9. जव ध्वंसक पिाथों का जनमााण और प्रजतजषद्ध। भंडारण। 10. पह पाररजस्ट्थजतकी-संवेिी िोन के जवस्ट्तार तक, इनम ें िो भी अजधक जनकट हो, सभी नए पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान दक्रर्ाकलापों[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 का जवस्ट्तार पर्ाटन महार्ोिना और र्था लागू मागाििाक जसद्धांतों के अनुरूप होगा । 19. संज नमााण दक्रर्ाकलाप। (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी-संवेिी िोन के जवस्ट्तार तक, िो भी जनकट हो, दकसी भी प्रकार के नए वाजणजज्र्क सजं नमााण की अनुमजत नहीं िी िाएगी: (ख) बिते, स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने के जलए भवन उपजवजधर्ों के अनुसार पैराग्राफ 3 के उप-पैरा (1) में उजल्लजखत दक्रर्ाकलापों सजहत स्ट्थानीर् लोगों को उनके उपर्ोग के जलए अपनी भूजम पर संजनमााण करने की अनुमजत िी िाएगी, िैसा दक: (i) जवद्यमान सड़कों को चौड़ा करना, उन्द्ह ें पक्का करना और नई सड़कों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का सजन्नमााण और नवीनीकरण; (iii) प्रिषू ण उ्पन्न न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योग एव ं ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और (v) इस अजधसूचना म ें र्था उजल्लजखत संवर्धात दक्रर्ाकलाप। बित े र्ह दक, गैर प्रिषू णकारी लघ ु उद्योगों से संबंजधत सजं नमााण दक्रर्ाकलाप लाग ू जनर्मों और जवजनर्मों र्दि, कोई हो, के अनुसार सक्षम प्राजधकारी की पूवा अनज्ञु ा से जवजनर्जमत दकए िाएंगे और व े न्द्र्ूनतम होंगे। (ग)एक दकलोमीटर के परे र्े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे। 20. गैर प्रिषू णकारी लघ ु उद्योग। िनवरी, 2025 में केन्द्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा िारी और समर्-समर् पर संिोजधत उद्योगों के वगीकरण के अनुसार गैर- प्रिषू णकारी उद्योग और अपररसंकटमर्, लघु स्ट्तरीर् और सेवा उद्योग, कृजष, पुष्प कृजष, उद्यान कृजष र्ा पाररजस्ट्थजतकी संवेिी िोन की अपनी सामग्री स े उ्पािों को उ्पन्न करन े वाल े कृजष आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुमत होंगे। 21. वृक्ष ों की कटाई । (क) राज्र् सरकार में सक्षम प्राजधकारी की पूवा अनुज्ञा के जबना वन र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं की िाएगी। (ख) वृक्षों की कटाई समबद्ध केंद्रीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगें। 22. वन उ्पािों और गरै काष्ठ वन अनुसूजचत िनिाजत और अन्द्र् पारंपररक वनवाजसर्ों [वन अजधकार उ्पािों का संग्रहण । मान्द्र्ता] अजधजनर्म, 2006 के अनुसार जवजनर्जमत। 23. जव द्युत और संचार टॉवर लगाने, लागू जवजधर्ों के अधीन जवजनर्जमत होगा (भूजमगत केबल जबछाने को तार-जबछान े तथा अन्द्र् बुजनर्ािी बढ़ावा दिर्ा िाए)।12 THE उपार्ों के साथ दकर्ा िाएगा। 25. जव द्यमान सड़कों को चौड़ा करना, लाग ू जवजधर्ों, जनर्मों और जवजनर्मों तथा उपलब्ध माग ा ििाक उन्द्ह ें पक्का बनाना । जसद्धांतों के अधीन िमन उपार् दकए िाएंगे। 26. पह ाड़ी ढलानों और निी तटों का लाग ूजवजधर्ों के अनुसार जवजनर्जमत होगें। संरक्षण। 27. राज त्र में मोटर र्ातार्ात का लाग ूजवजधर्ों के अधीन वाजणजज्र्क उद्देश्र् के जलए जवजनर्जमत। संचलन । 28. स्ट्थ ानीर् समुिार्ों द्वारा कृजष और स्ट्थानीर् आवश्र्कताओं की पूर्ता करने के अलावा लागू जवजधर्ों के बागवानी की चल रही प्रथाएाँ, अनुसार जवजनर्जमत होगें। साथ ही डेर्री, िग्ु ध पालन, िलीर् कृजष और म्स्ट्र् पालन। 29. प्रा कृजतक िल जनकार्ों र्ा भू-क्षेत्र उपचाररत अपजिष्ट िल/बजहस्रााव का िल जनकार्ों में जनस्ट्सारण नहीं में उपचाररत अपजिष्ट होने दिर्ा िार्ेगा और उपचाररत अपजिष्ट िल के पुनचाक्रण और िल/बजहस्रााव का जनस्ट्सारण। पुन:उपर्ोग के प्रर्ास दकए िाएंगे, अन्द्र्था उपचाररत अपजिष्ट िल/बजहस्रााव का जनस्ट्सारण लाग ू जवजधर्ों के अनुसार जवजनर्जमत दकर्ा िाएगा। 30. सत ही और भूिल का वाजणजज्र्क लाग ूजवजधर्ों के अधीन से बढ़ावा दिर्ा िाएगा । जनगरानी सजमजत.- केन्द्द्र सरकार, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 3 की उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, इस अजधसूचना के उपबंधों की प्रभावी जनगरानी के जलए एतद्द्वारा एक जनगरानी सजमजत का गिन करती ह ै जिसमें जनम्नजलजखत सिस्ट्र् होंग,े अथाात:् - क्रम सख्ं र्ा जनगरानी सजमजत के सिस्ट्र् पिनाम 1. जिला कलेक्टर, जतरुवनतं पुरम अध् र्क्ष; 2. जिला पंचार्त अध्र्क्ष, जतरुवनतं पुरम सिस्ट्र्; 3. केरल सरकार द्वारा प्राकृजतक संरक्षण (जवरासत संरक्षण सजहत) सिस्ट्र्; के क्षेत्र में कार्रा त गरै -सरकारी संगिनों के प्रजतजनजधर्ों को नामजनर्िाष्ट दकर्ा िाएगा। 4. केरल राज्र् के दकसी प्रजतजष्ठत संस्ट्थान र्ा जवश्वजवद्यालर् से सिस्ट्र्; पाररजस्ट्थजतकी और पर्ाावरण के एक जविेषज्ञ को केरल सरकार द्वारा प्र्र्ेक मामल े में एक वष ा की अवजध के जलए नामजनर्िष्टा दकर्ा िाएगा। 5. केरल राज्र् िैव जवजवधता बोड ा सिस्ट्र्; 6. वन्द्र्िीव संरक्षक, जतरुवनंतपरु म सिस्ट्र्–सजचव; 6. जनगरानी सजमजत की सिं र्भता ित.ें – (1) जनगरानी सजमजत इस अजधसूचना के उपाबंधों के अनपु ालन की जनगरानी करेगी। (2) जनगरानी सजमजत का कार्ाकाल तीन (3) वषों का होगा र्ा तब तक, िब तक राज्र् सरकार द्वारा नई सजमजत का पुनगािन नहीं दकर्ा िाता, और इसके बाि मॉजनटटरंग सजमजत का गिन राज्र् सरकार द्वारा दकर्ा िाएगा। (3) भारत सरकार के त्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना सं. का.आ.1553 (अ), तारीख 14 जसतमबर, 2006 द्वारा की अनुसूची म ें सजममजलत तथा पाररजस्ट्थजतकी सवं ेिी िोन म ें आने वाल े दक्रर्ाकलापों, जिसमें परै ाग्राफ 4 के अंतगता सारणी म ें जवजनर्िाष्ट प्रजतजषद्ध दक्रर्ाकलापों को छोड़कर, वास्ट्तजवक स्ट्थल-जवजिष्ट जस्ट्थजतर्ों के आधार पर जनगरानी सजमजत द्वारा िांच की िाएगी, तथा िो उि अजधसूचना के उपबंधों के अधीन पूव ा पर्ाावरणीर् मंिूरी के जलए, िैसा भी मामला हो, केन्द्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् र्ा राज्र् पर्ाावरण प्रभाव आकलन प्राजधकरण को संिर्भात की स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे समबद्ध जवजनर्ामक प्राजधकरणों को जनर्िाष्ट दकर्ा िाएगा। (5) जनगरानी सजमजत का सिस्ट्र्-सजचव र्ा संबंजधत कलेक्टर र्ा संबंजधत उप वन संरक्षक पर्ाावरण Sanctuaries are the southern most Protected Areas in the State of Kerala. It forms a part of core area of the Agasthayamalai Biosphere Reserve and Periyar Elephant Reserve in the Western Ghats. These two wildlife sanctuaries have rich biodiversity and are named after the two rivers, viz. Neyyar and Peppara respectively. The Neyyar Wildlife Sanctuary falls in Klamala extension, Kottur extension and Nettukaltherikunnu Reserve Forests. The Peppara Wildlife Sanctuary falls in Kottur & Palode Reserve Forests. The wildlife sanctuaries are administrative control of the Thiruvananthapuram Wildlife Division. AND WHEREAS, the Neyyar Wildlife Sanctuary is spread over south-east corner of the Western Ghats covering an area of 128 km2. It is situated between 8017’ and 8053’N Latitude and 76040’ and 77017’E Longitude in Neyyatinkara Taluka of Thiruvananthapuram district;26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, the Peppara Wildlife Sanctuary is spread over an area of 53 km2 and falls in Kottur & Palode Reserve Forests. It is situated between 80° 34' and 80° 41'N Latitude and 77° 6' and 77°14'E Longitude in Nedumangad Taluka of Thiruvananthapuram district; AND WHEREAS, the Neyyar Wildlife Sanctuary was notified vide GO (MS) 871/58 AD dated 06.01.1958 and the boundaries of the same was re-notified vide GO (P)NO.2305/F2/71 AD dated 18.03.1971 adding the Neyyar Reservoir into the wildlife sanctuary. The Peppara Wildlife Sanctuary was notified vide GO(P) No. 379/83 AD dated 21.12.1981; AND WHEREAS, the protected areas harbours almost all the major mammals of peninsular India. The topography and the climate of the sanctuary enable the occurrence of varied micro and macro habitats to shelter its variety of animals. The faunal diversity includes mammals (43 species), birds (233 species), reptiles (46 species), amphibians (13 species) fishes (27 species) and a wide variety of butterflies; AND WHEREAS, the Neyyar - Peppara Wildlife Sanctuaries are treasure houses of plant diversity with about 1000 species of flowering plants belonging to more than 132 families, which represents nearly 22% of the total flowering plants estimated from Kerala. The vegetation mainly comprises of Evergreen and Moist Deciduous Forest which includes a variety of medicinal plants and tree species such as Abrus precatorius, Adhatoda zeylanica Medic., Alngium salvifolium, Aloe vera, Alphonsea zeylanica, Asparagus racemosus, Bombax ceiba, Caesalpinia mimosoides, Calamus brandisii, Calophyllum apetalum, Canarium strictum Roxb, Cassia fistula, Cinnamomum travancorium Gamble, Curcuma pseudomontana Graham, Cyathea gigantean, Dalbergia latifolia, Helicteres isora, Murraya koenigii, Myristica dactyloides Gaertn, Piper longum, Syzygium travancoricum Gamble, Terminalia arjuna, Terminalia bellerica, Terminalia chebula, Terminalia paniculata, Trichopus zeylanicus, Waltheria indica , Wrightia tinctoria, etc; AND WHEREAS, major endemic species recorded from the Neyyar - Peppara Wildlife Sanctuaries includes Arogyapacha (Trichopus zeylanicus), Kattuchena (Amorphophallus commutatus), Anjili (Artocarpus hirsutus Lam.), Amrithapala (Janakia arayalpathra), Aatuchamba (Syzygium occidentalis), Nilgiri tahr (Nilgiritragus hylocrius), Malabar slender loris (Loris lydekkerianus malabaricus), Brown palm civet (Paradoxurus jerdoni caniscus), Stripe- necked mongoose (Herpestes vitticollis), Western Ghats striped squirrel (Funambulus tristriatus), Travancore flying squirrel (Petinomys fuscocapillus), Southern tree pie (Dendrocitta leucogastra), Beddome’s leaping frog (Indirana beddomii), Malabar tree toad (Pedostibes tuberculosus), Anil’s bush frog (Raorchestes anili), Malabar danio (Devario malabaricus), Kanara swift (Caltoris canaraica), Malabar tree nymph (Idea malabarica), Red disk bush brown (Mycalesis oculus), Malabar rose (Pachliopta pandiyana), Malabar banded swallow tail (Papilio liomedon), palni fourring (Ypthima ypthimoides), etc; AND WHEREAS, the Myristica swamps are one of the unique ecosystems found in Neyyar - Peppara Wildlife Sanctuaries. These swamps are the only sites of occurrence of certain members of the ancient family Myristicaceae such as Myristica fatua (Kothappayin) and Myristica dactyloides (Pashupathi). These freshwater swamps play an important role in regulating the species diversity and abundance of both amphibians and reptiles. Also, the forests of Neyyar Sanctuary are the catchment areas of Neyyar River and forests of Peppara Sanctuary are the catchment areas of Karamana River; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of the Neyyar - Peppara Wildlife Sanctuary which are specified in paragraph 1 as Eco-Sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an Eco-Sensitive Zone around the boundary of Neyyar - Peppara Wildlife Sanctuaries of Kerala (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of Eco-Sensitive Zone. – (1) The Eco-Sensitive Zone shall be of 52.036 sq. km with an extent of 0 (zero) to 2.72 kilometer with a mean distance of 1.3 km from the boundaries of the Neyyar - Peppara Wildlife Sanctuaries. (2) The boundary description of Neyyar Wildlife Sanctuary and Peppara Wildlife Sanctuary and its Eco- Sensitive Zone is appended as Table A, Table B and Table C of Annexure-I. (3) The maps of the Neyyar - Peppara Wildlife Sanctuaries demarcating Eco-Sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB, and Annexure- IIC. (4) Lists of geo co-ordinates of the boundary of Neyyar Wildlife Sanctuary and Peppara Wildlife Sanctuary and Eco-Sensitive Zone are given in Table A, Table B and Table C of Annexure-III. (5) The list of villages falling in the Eco-Sensitive Zone along with their geo co-ordinates at prominent points is appended as Table A and Table B of Annexure-IV. 2. Zonal Master Plan for Eco-Sensitive Zone. – (1) The State Government shall, for the purposes of the Eco-Sensitive Zone, prepare a Zonal Master Plan within two years from the date of publication of this notification in the Official Gazette, in consultation with local people and in conformity to the provisions of this notification. (2) The Zonal Master Plan for the Eco-Sensitive Zone shall be prepared by the State Government in accordance with the provisions of this notification and in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan: - i. Environment; ii. Forest and Wildlife; iii. Urban Development; iv. Tourism; v. Municipality; vi. Revenue; vii. Kerala State Pollution Control Board; viii. Panchayati Raj; ix. Agriculture; x. Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure, and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 29 (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks and it’s like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-Sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and ensure and promote eco-friendly development for security of local community’s livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government. – The State Government shall take the following measures for giving effect to the provisions of this notification, namely: (1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-Sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities. Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-Sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority in the State Government and other rules and regulations of Central/State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents such as: i. Widening and strengthening of existing roads and construction of new roads; ii. Construction and renovation of infrastructure and civic amenities; iii. Small scale industries not causing pollution; iv. Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and v. Promoted activities and given under paragraph 4. Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority in the State Government and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007); Provided also that any error appearing in the land records within the Eco-Sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. b. Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies. – The catchment areas of all natural springs/river/channel shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan. (3) Tourism or eco-tourism. – (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-Sensitive Zone; a. the Tourism Master Plan shall be prepared by the Department of Tourism in consultation with the Department of Revenue and Forests, Government of Kerala; b. the Tourism Master Plan shall form a component of the Zonal Master Plan; c. the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-Sensitive Zone; d. the activities of eco-tourism shall be regulated as under, namely: -30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] i. No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Neyyar - Peppara Wildlife Sanctuaries or up to the extent of the Eco-Sensitive Zone whichever is nearer: Provided that beyond the distance of the 1 km from the boundaries of the protected areas till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts for eco-friendly tourism activities shall be allowed only in predefined and designated areas for eco-tourism facilities as per Tourism Master Plan; ii. All new tourism activities or expansion of existing tourism activities within the ESZ shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guideline issued by National Tiger Conservation Authorities (as amended from time to time) with emphasis on eco- tourism, eco-education and eco-development based on the carrying capacity study of the ESZ; iii. until the Zonal Master Plan is prepared and approved, development for tourism and expansion of existing tourism activities shall be permitted by the regulatory authorities concerned based on the actual site-specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage. – All sites of valuable natural heritage in the Eco-Sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites. – Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-Sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. – Prevention and control of noise pollution in the Eco-Sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 and as amended from time to time. (7) Air pollution. – Prevention and control of air pollution in the Eco-Sensitive Zone shall be complied in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and as amended from time to time. (8) Discharge of effluents. – Discharge of treated effluents in Eco-Sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 (as amended from time to time) and rules made there under or standards stipulated by State Government whichever is more stringent. (9) Solid wastes. – Disposal and Management of solid wastes shall be as under- a. the solid waste disposal and management in the Eco-Sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357(E), dated the 8th April, 2016 and as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-Sensitive Zone; b. No burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco- Sensitive Zone. (10) Bio-medical waste. – Bio medical waste management shall be as under: a. The bio-medical waste disposal in the Eco-Sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343(E), dated the 28th March, 2016; as amended from time to time. b. No common treatment facility or incineration shall be permitted within the Eco-Sensitive Zone.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 31 (11) Plastic waste management. – The Plastic Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management. – The Construction and Demolition Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317(E), dated the 29th March, 2016 as amended from time to time. (13) E-waste. – The E-Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate change and as amended from time to time. (14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution. – Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel such as CNG, LPG, etc. (16) Industrial units. – a. On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the ESZ, b. Only non-polluting industries shall be allowed within the Eco-Sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in January 2025, as amended from time to time, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes. – The protection of hill slopes shall be as under: a. The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. b. Construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco- Sensitive Zone of Neyyar – Peppara Wildlife Sanctuaries shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986), Wildlife (Protection) Act, 1972 (53 of 1972), Forest Act, 1927 (16 of 1927), Forest (Conservation) Act, 1980 (69 of 1980) and other applicable laws including the Coastal Regulation Zone (CRZ), 2011, Environmental Impact Assessment (EIA) Notification, 2006, and amendments made thereto and other Acts prevalent in the State. The forest area coming under the Eco- Sensitive Zone will remain to be governed under existing forest laws and amendments made thereto. Subject to the provisions of this paragraph, the activities in the Eco-Sensitive Zone shall be regulated in manner specified in the Table below, namely: - Table Sl. UOI in W.P.(C) No.435 of 2012; and IA No. 1000 of 2003 dated the 03rd June, 2022. IA No. 131377 of 2022, judgment dated the 26th April, 2023 and the 28th April, 2023 and subsequent judgment dated the 23rd July 2025 in I.A Nos. 162023, 162034, 162154 and 162155 of 2025 or any further orders regarding mining. 2. Setting of industries causing New industries and expansion of existing polluting industries in the pollution (Water, Air, Soil, Eco-Sensitive Zone shall not be permitted: Noise, etc.). Provided that, non-polluting industries shall be allowed within Eco-Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in January, 2025, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted. 3. Establishment of new major Prohibited. hydroelectric projects. 4. Use or production or processing of any hazardous Prohibited. substances. 5. Commercial Fishing. Prohibited, however, permitted for bona fide use of tribes. B. Regulated Activities 18. Construction activities. a. No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the protected area or up to the extent of the Eco-Sensitive Zone, whichever is nearer; b. Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye- laws to meet the residential needs of the local residents such as: i. Widening and strengthening of existing roads and construction of new roads; ii. Construction and renovation of infrastructure and civic amenities; iii. Small scale industries not causing pollution; iv. Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and v. Promoted activities listed in this notification. Provided that, the construction activity related to small-scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any; c. Beyond one kilometre it shall be regulated as per the Zonal Master Plan. 20. Small scale non-polluting Non-polluting industries as per classification of Industries issued by industries. the Central Pollution Control Board in January 2025 and as amended from time to time and non-hazards, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the Competent Authority. 21. Felling of trees. a. There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. b. The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under. 22. Collection of Forest Produce or Regulated as per the Scheduled Tribes and Other Traditional Forest Non-Timber Forest Produce. Dwellers [Recognition of Forest Rights] Act, 2006. 23. Monitoring Committee. - The Central Government herby constitutes a Monitoring Committee, for effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely: - Sl. Member; 5 Kerala State Biodiversity Board Member; 6 The Wildlife Warden, Thiruvananthapuram Member Secretary. 6. Terms of Reference of the Monitoring Committee. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee is for three (3) years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government. (3) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September 2006, and are falling in Eco- sensitive Zone, except for the prohibited activities as specified in the table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in Eco- Sensitive Zone, except for the prohibited activities as specified in the table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authority. (5) The Member Secretary of Monitoring Committee shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments or representative from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the state as per pro-forma given Annexure-V, appended to this notification. (8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such direction, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures. – The Central Government and State Government may specify additional measures, if any, for giving effect to the provisions of this notification. 8. Supreme Court, etc. orders. – The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal. ANNEXURE-I BOUNDARY DESCRIPTION OF ECO-SENSITIVE ZONE OF NEYYAR-PEPPARA WILDLIFE SANCTUARY Table A: Boundary description of Neyyar Wildlife Sanctuary DIRECTIONS DESCRIPTION Starting from Meenmutty Waterfall (Point 1) in Kallar river, a point about 2.41Km North-East of Neyyar Dam site, the boundary runs along the eastern boundary of Paruthippally Range of NORTH Thiruvananthapuram Forest Division up to Karimalakari at 636m, passing Chottupara at 491m and then along the common boundary of Neyyar and Peppara Sanctuaries and runs along the North-East direction along the watershed line between Neyyar and Karamana rivers passing36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Mappimalai at 710m, Kannankunnu, Nachiyadikunnu at 985m upto Athirumala at 1594m, the State boundary. Starting from Athirumala, the boundary runs along the state boundary passing Agasthyamala at EAST 1868 m, Vavattimala at 1862m, Varayattumudi at 1416m, and the points of 662m and 701m upto Vengulamala at 756m. From Vengulamala, the boundary runs along the state boundary up to Anamugham and then SOUTH along the level of Full Reservoir Leval (FRL) to Neyyar Dam site. From dam site the boundary runs along the FRL level up to Thooripara, a portion of Kottoor WEST extension reserve, and then along the boundary of Nettukaltherikunnureserve forests up to Mlavetty, the starting point. Table B: Boundary description of Peppara Wildlife Sanctuary DIRECTIONS DESCRIPTION From the point where Vithura-Bonaccord road enters the catchments area of the Peppara dam, the boundary runs along the watershed boundary of the catchment area till it reaches the NORTH boundary of Bonaccord tea estate, from where it passes along the Southern boundary of the estate till it reaches the eastern boundary of the estate. From there it runs along the watershed boundary of Peppara reservoir to Chemmunjimottai. From Chemmunjimottai the boundary runs along the inter-state boundary of Kerala and Tamil Nadu passing Arumukhamkunnu (1457 m) till it reaches the Athirumala peak (1594 m). From EAST Athirumala peak the boundary runs along the watershed boundary between Neyyar Wildlife Sanctuary and Karamana river basin till it reaches Kadiramudimalai passing along the following peaks Nachiyadikunnu (988 m), Kannan kunnu and Karimalakari (636 m). From Kadirumudi the boundary follows the watershed area of Peppara reservoir along the SOUTH Agasthiavanam Biological Park till it reaches the Peppara dam. Starting from the Peppara dam, along the left bank of the water spread area of the dam, excluding the plantation areas and including all the natural reserve portion in the catchments WEST area, till it reaches the Vithura-Bonoccord road in the north passing through the following peaks: Orachankunnu, Vattaparakunnu, Kalluparakunnu (473m) and Pumadathu kunnu. Table C: Boundary description of Eco-Sensitive Zone of Neyyar - Peppara Wildlife Sanctuaries DIRECTIONS DESCRIPTION Starting from Meenmutty waterfall (Point 1) in Kallar river runs along the course of river till it reaches the State boundary at Chemmunjimottai (Point 7). Thence from Chemmunjimottai (Point 7) runs along the common boundary of Peppara Wildlife North East Sanctuary and Parithippally Range till it reaches Kottamala (Point 13), also called Karichatty motta. Thence proceeds from Karichatty motta to Chathencode along Peppara Wildlife Sanctuary boundary and then to Kalluparakkunnu (Point 19) Thence, from Kalluparakkunnu runs along the Peppara Wildlife Sanctuary boundary East through Vattapparakunnu to meet Peppara reservoir at Point 24 and follows down along the Peppara reservoir boundary. Starting from Peppara reservoir boundary at Point 24, runs south east along the Peppara South East Wildlife Sanctuary boundary to Kadirmudy (Point 33), thence from Kadirmudy runs West along the Neyyar Wildlife Sanctuary boundary through Chottupara (Point 37).
