का प्रर्ोग करत े हुए केंद्र सरकार द्वारा िारी दकए िाना वाले जनम्नजलजखत प्रारुप अजधसूचना को, पर्ावा रण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) के अंतगात अपेक्षानुसार, इससे प्रभाजवत होने वाले िनसाधारण की िानकारी के जलए प्रकाजित दकर्ा िाता है; और इसके द्वारा र्ह भी सूचना िी िाती ह ै दक उि प्रारूप अजधसूचना पर, उस तारीख स े साि दिनों दक अवजध समाप्त होन े के पश्चात ् जवचार दकर्ा िाएगा, जिस तथा उपधारा (2) के खंड (v) और (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत ेहुए, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित, केन्द्द्रीर् सरकार, केरल राज्र् के जत्रिूर जिल ेके जत्रिूर और थलजपपल्ली तालुकों म ेंपीची-वझानी वन्द्र्िीव अभर्ारण्र् की सीमा के आसपास 0 दकलोमीटर स े 6.5 दकलोमीटर तक के क्षत्रे को पाररजस्ट्थजतकी संवेिी िोन (इस अजधसूचना म ें आग े पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप म ेंअजधसूजचत करती ह,ै जिसका ब्र्ौरा इस प्रकार ह ैंअथाात:् - 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमाएँ.- (1) पाररजस्ट्थजतकी संवेिी िोन पीची-वझानी वन्द्र्िीव अभर्ारण्र् की सीमा के चारों ओर 0 दकमी स े 6.5 दकमी तक होगा और पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल 76.8 वगा दकलोमीटर होगा। (2) पीची-वझानी वन्द्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन का सीमा जववरण अनलु ग्नक-I म ेंसंलग्न ह।ै (3) पीची-वजानी वन्द्र्िीव अभर्ारण्र् के पाररजस्ट्थजतकी संविे ी िोन के मानजचत्र अनुलग्नक- II क और अनलु ग्नक- II ख के रूप म ेंसंलग्न ह।ैं (4) पीची-वजानी वन्द्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू-जनिेिांक अनलु ग्नक-III के रूप म ें संलग्न ह।ैं (5) प्रस्ट्ताजवत पाररजस्ट्थजतकी सवं ेिी िोन म ेंआन े वाले गांवों की सूची अनलु ग्नक-IV म ेंिी गई ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना.– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख स े िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्र् के सक्षम प्राजधकारी के अनमु ोिन के जलए इस अजधसूचना में दिए गए उपबंधों का पालन करते हुए आंचजलक महार्ोिना तैर्ार करेगी। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसचू ना के प्रावधानों के अनुसार तथा केंद्रीर् और राज्र् जवधानों के सुसंगत और केंद्रीर् सरकार द्वारा िारी मागाििाक जसद्ांतों, र्दि कोई हों, अनुरुप तैर्ार दक िाएगी। (3) आंचजलक महार्ोिना, राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ा से दक िाएगी तादक पाररजस्ट्थजतकी और पर्ाावरणीर् िजृ ष्टकोणों को एकीकृत दकर्ा िा सके.- i. पर्ाावरण, वन; ii. िहरी जवकास; iii. पर्ाटन, नगरपाजलका; iv. रािस्ट्व; v. पसंचाई vi. स्ट्थानीर् स्ट्विासन जवभाग; vii. लोक जनमाणा जवभाग viii. केरल राज्र् प्रििू ण जनर्ंत्रण बोड ा6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) आंचजलक महार्ोिना म ेंअनुमोदित भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंि नहीं लगार्ा िाएगा िब तक इस अजधसूचना म ें ऐसा जवजनर्िाष्ट न हो, तथा आचंजलक महार्ोिना की सभी अवसंरचनाओं और उसके दक्रर्ाकलापों म ें सुधार करके उन्द्ह ेअजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनाने की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना, में वनरजहत क्षेत्रों का पुनस्ट्ा थापन, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, औजचत्र्पूणा िल प्रबंधन, भ-ू िल के प्रबंधन, मिृ ा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐसे अन्द्र् पहलुओं का प्रावधान दकर्ा िाएगा, जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह ै। (6) आंचजलक महार्ोिना म ेंसभी जवद्यमान पूिा स्ट् थलों, िामों और िहरी बजस्ट्तर्ों, वनों की श्जे णर्ों और दकस्ट् मों, कृजि क्षेत्रों, उपिाऊ भूजम, उद्यानों और उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा, सहार्क मानजचत्रों के साथ जिनम ें जवद्यमान तथा प्रस्ट्ताजवत भू-उपर्ोग जविेिताओं के ब्र्ौरों का जनधाारण दकर्ा िाएगा। (7) इस आंचजलक महार्ोिना म ेंपाररजस्ट्थजतकी-संवेिी िोन के जवकास को जवजनर्जमत दकर्ा िाएगा और पैरा 4 में सूचीबद् प्रजतबंजधत और जवजनर्जमत दक्रर्ाकलापों का अनुपालन दकर्ा िाएगा और स्ट्थ ानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजश्चत दकर्ा िाएगा और उसे बढावा दिर्ा िार्ेगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) इस प्रकार अनुमोदित आंचजलक महार्ोिना, इस अजधसूचना के उपाबंधों के अनुसार जनगरानी के अपने कार्ों को पूरा करने के जलए जनगरानी सजमजत के जलए संिभ ा िस्ट्तावेि होगा। 3. राज्र् सरकार द्वारा दकए िान ेवाल ेउपार्. - राज्र् सरकार अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात:् - (1) भ-ू उपर्ोग. – (क) पाररजस्ट्थजतकी-संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खलु े स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा पररवतान की अनुमजत नहीं होगी: बिते दक पाररजस्ट्थजतकी-संविे ी िोन के भीतर कृजि और अन्द्र् भूजम, जनगरानी सजमजत की जसफाररि पर केंद्र तथा राज्र् सरकार के िहरी जनर्ोिन अजधजनर्म तथा अन्द्र् जनर्मों एव ंजवजनर्मों र्था लाग,ू के अधीन तथा इस अजधसूचना के उपबधं ों के पूवा अनुमोिन स े स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं और दक्रर्ाकलापों को पूरा करन े के जलए अनुमजत िी गई ह,ै िैसे,- (i) जवद्यमान स़िकों को चौ़िा करना, उन्द्ह ेंसुिढृ करना और नई स़िकों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का जनमााण और नवीनीकरण; (iii) प्रििू ण उत्पन्न न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योग एव ं िाम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और (v) पैरािाफ-4 के मि में र्था उजल्लजखत बढावा दिए गए दक्रर्ाकलापः[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 परंतु र्ह भी दक राज्र् सरकार के पूवा अनुमोिन के जबना और संजवधान के अनुच्छेि 244 र्ा अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) सजहत वतामान म ें लाग ू जवजधर्ों के उपबंधों के अनुपालन के जबना वाजणजज्र्क और औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के दकसी भी उपर्ोग की अनुमजत नहीं िी िाएगी: परंतु र्ह भी दक पाररजस्ट्थजतकी-संवेिी िोन के अधीन आने वाली भूजम के अजभलेखों म ेंहुई दकसी त्रुरट को, मॉनीटरी सजमजत के जवचार प्राप्त करने के पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार सुधारा िाएगा और उि त्रुरट को सुधारने की सूचना केंद्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह भी दक उपर्िुा त्रुरट को सुधारन े म,ें इस उप-परै ा म ें र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भ-ू उपर्ोग का पररवतान सजम्ब्मजलत नहीं होगा: (ख )अनुप्रर्िु र्ा अनुत्प ािक कृजि क्षेत्रों म ेंवनीकरण तथा पर्ावा ासों की बहाली के कार्ाकलापों स े पुन: वनीकरण दकए िान े के प्रर्ास दकए िाएंगे। (2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक झरनों/नदिर्ों/चैनलों के िलिहण क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और पुनरुद्ार की र्ोिनाओं को आंचजलक महार्ोिना म ें सजम्ब्मजलत दकर्ा िाएगा। (3) पर्टा न र्ा पारर-पर्टा न – (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पारर-पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन संबंधी पर्टा न महार्ोिना के अनुसार होगा। (ख) पर्ाटन महार्ोिना, पर्ाटन जवभाग द्वारा केरल सरकार के रािस्ट्व एव ं वन जवभाग के परामिा स ेतैर्ार दकर्ा िाएगा; (i) वन क्षेत्रों में पारर पर्ाटन कार्ा र्ोिना और प्रबंधन र्ोिना के अनुसार होगी। (ii) पाररजस्ट्थजतकी संवेिी िोन का जहस्ट्सा बनने वाल ेवन क्षेत्रों के जलए पारर-पर्ाटन महा-र्ोिना वन और वन्द्र्िीव जवभाग, राज्र् पर्ाटन जवभाग के साथ जमलकर तैर्ार करेगा। (ग) पर्ाटन महार्ोिना, आंचजलक महार्ोिना का घटक होगी; (घ) पर्ाटन महार्ोिना, पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िाएगी; (ङ) पारर-पर्ाटन संबंधी दक्रर्ाकलाप जनम्ब्न ानुसार जवजनर्जमत दकए िाएंगे, अथाात:् - (i) पाररजस्ट्थजतकी संवेिी िोन के भीतर होटलों और ररसॉट्सा के नए जनमााण की अनुमजत नहीं िी िाएगी, जसवार् पर्ाावरण-अनुकूल पर्ाटन दक्रर्ाकलापों स े संबंजधत पर्ाटकों के अस्ट्थार्ी आवास के जलए; बिते दक मौिूिा प्रजतष्ठानों के जवस्ट्तार की अनुमजत आंचजलक महार्ोिना के अनुसार िी िा सकती ह;ै (ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नई पर्ाटन दक्रर्ाकलापों र्ा मौिूिा पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् म ें केंद्र सरकार द्वारा िारी मागाििाक जसद्ांतों और राष्ट्रीर् बाघ संरक्षण प्राजधकरणों द्वारा िारी पाररजस्ट्थजतकी पर्ाटन मागाििका जसद्ांतों (समर्-समर् पर संिोजधत) के अनुसार होगा, जिसम ें पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता अध्र्र्न के आधार पर पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी जिक्षा और पाररजस्ट्थजतकी जवकास पर िोर दिर्ा िाएगा; (iii) िब तक इस आंचजलक महार्ोिना को अनुमोदित नहीं कर दिर्ा िाता तब तक पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार की अनुमजत संबंजधत जवजनर्ामक प्राजधकरणों के द्वारा स्ट्थल जवजिष्ट िांच और8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] जनगरानी सजमजतर्ों की जसफाररि के आधार पर िी िाएगी। (4) प्राकृजतक जवरासत – पाररजस्ट्थजतकी संवेिी िोन के अधीन आन ेवाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैस े दक िीन पूल ररजव ा क्षत्रे , िलै सरं चना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एवं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनाई िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल - पाररजस्ट्थजतकी संवेिी िोन म ें ऐजतहाजसक, स्ट्थापत्र्, सौंिर् ा और सांस्ट्कृजतक महत्व की इमारतों, संरचनाओं, कलाकृजतर्ों, क्षत्रे और पररसरों की पहचान की िाएगी और उनके संरक्षण के जलए जवरासत संरक्षण र्ोिना अंजतम अजधसूचना के प्रकािन की तारीख स े छह महीने के भीतर तैर्ार की िाएगी और आंचजलक महार्ोिना म ें सजम्ब्मजलत की िाएगी। (6) ध्व जन प्रििू ण –पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रििू ण की रोकथाम और जनर्ंत्रण पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और उसके संिोधनों के अधीन ध्वजन प्रििू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 के अनुसार दकर्ा िाएगा। (7) वार् ुप्रििू ण - पाररजस्ट्थजतकी सवं ेिी िोन म ेंवार् ुप्रििू ण की रोकथाम और जनर्ंत्रण वार् ु(प्रििू ण की रोकथाम और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्म और उसके संिोधनों के अनुसार दकर्ा िाएगा। (8) बजहस्राव का जनस्ट्सरण - पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत अपजिष्टों का जनवाहन पर्ाावरण (संरक्षण) अजधजनर्म 1986 और उसके अधीन बनाए गए जनर्मों र्ा राज्र् सरकार द्वारा जनधााररत मानकों, िो भी अजधक किोर हो, के अधीन आन े वाले पर्ाावरण प्रििू कों के जनवाहन के सामान्द्र् मानकों के उपबंधों के अनुसार होगा। (9) िोस अपजिष्ट - िोस अपजिष्ट का जनपटान एवं प्रबधं न जनम्नानुसार दकर्ा िाएगा, - (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट जनपटान और प्रबंधन, िोस अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा, जिसे भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा अजधसूचना संख्र्ा का. आ. 1357(अ), तारीख 8 अप्रैल, 2016 द्वारा प्रकाजित दकर्ा गर्ा ह ैऔर समर्-समर् पर संिोजधत दकर्ा गर्ा ह;ै (ख) अकाबाजनक सामिी को पर्ाावरण के अनुकूल तरीके स ेपाररजस्ट्थजतकी संवेिी िोन के बाहर अजभज्ञात स्ट्थल पर जनपटार्ा िा सकता ह;ै (ग) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्टों को िलाने र्ा भस्ट्म करने तथा लैंडदफल की स्ट्थापना की अनुमजत नहीं होगी; (10) िवै जचदकत्सा अपजिष्ट - िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा,-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसचू ना स.ं सा.का.जन 343 (अ), तारीख 28 माच,ा 2016 के अधीन प्रकाजित िैव- जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016; समर्-समर् पर संिोजधत, के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी भी सामान्द्र् उपचार सुजवधा र्ा भस्ट्मीकरण की अनमु जत नहीं होगी। (11) पलाजस्ट्टक अपजिष्ट का प्रबधं न - पाररजस्ट्थजतकी संवेिी िोन म ें पलाजस्ट्टक अपजिष्ट का प्रबधं न, भारत सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् द्वारा, समर्-समर् पर संिोजधत; अजधसूचना स.ं सा.का.जन 340(अ), तारीख 18 माच,ा 2016 के अधीन प्रकाजित पलाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न - पाररजस्ट्थजतकी संविे ी िोन म ें जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् द्वारा, समर्-समर् पर संिोजधत; अजधसूचना, स.ं सा.का.जन 317(अ), तारीख 29 माच,ा 2016 के अधीन प्रकाजित जनमाणा और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट - पाररजस्ट्थजतकी संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित ई–अपजिष्ट प्रबंधन जनर्म,2016 , समर्-समर् पर संिोजधत; के उपबंधों के अनुसार दकर्ा िाएगा। (14) स़िक-र्ातार्ात - स़िक-र्ातार्ात को पर्ाावास अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना में जविेि उपबंध सजम्ब्मजलत दकए िाएंग।े आंचजलक महार्ोिना के तैर्ार होन े और राज्र् सरकार के सक्षम प्राजधकारी स े अनुमोदित होन े तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके अधीन बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार स़िक-र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन िजनत प्रििू ण - वाहन िजनत प्रििू ण की रोकथाम और जनर्ंत्रण लाग ूजवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईधनों िैसे संपीज़ित प्राकृजतक गैस, द्रवीकृत पेरोजलर्म गैस, आदि के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ा ं - (क) आजधकाररक रािपत्र म ें इस अजधसचू ना के प्रकािन पर र्ा उसके पश्चात ् पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए प्रििू णकारी उद्योग की स्ट्थापना की अनुमजत नहीं िी िाएगी; (ख) केन्द्द्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा फरवरी, 2016 म ें िारी जसद्ान्द्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रििू णकारी उद्योगों को अनुमजत िी िाएगी और इसके अजतररि, गरै प्रििू णकारी कुटीर उद्योगों को बढावा दिर्ा िाएगा। (17) पहा़िी ढलानों का सरं क्षण - पहा़िी ढलानों का संरक्षण जनम्नानसु ार दकर्ा िाएगा :- (क) आंचजलक महार्ोिना म ें पहा़िी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी जनमाणा की अनुमजत नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान ख़िी पहा़िी ढलानों म ें अत्र्जधक भू-क्षरण होता ह ै उनम ें दकसी भी जनमााण की अनुमजत नहीं होगी।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 4. पाररजस्ट्थजतकी सवं िे ी िोन म ेंजनजिद् र्ा पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) तथा राज्र् म ें प्रचजलत अन्द्र् अजधजनर्मों एव ं जनर्मों के उपाबंधों द्वारा िाजसत होंगी। पाररजस्ट्थजतकी संवेिी िोन के अधीन आन े वाले वन क्षत्रे जवद्यमान वन जवजधर्ों के अधीन ही िाजसत होगें। इस अनुच्छेि के उपाबंधों के अधीन, पाररजस्ट्थजतकी संवेिी िोन म ें दक्रर्ाकलापों का जवजनर्मन नीचे दिए गए सारणीबद् स्ट्तंभ के अनुसार दकर्ा िाएगा, अथाात्:- सारणी क्र.स ं. दक्रर्ाकलाप रटपपणी क. प्रजतजिद् दक्रर्ाकलाप (1) व ाजणजज्र्क खनन, पत्थर उत्खनन और (क) पाररजस्ट्थजतकी संवेिी िोन के अधीन वास्ट्तजवक स्ट्थानीर् क्रपिंग इकाइर्ां। जनवाजसर्ों की घरेल ू आवश्र्कताओं, जिसम ें मकानों के जनमाणा र्ा मरम्ब्मत के जलए धरती को खोिना सजम्ब्मजलत है, के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनि), पत्थर उत्खनन और क्रपिगं इकाइर्ां तत्काल प्रभाव से जनिेध की िाएगं ी; (ख) खनन कार् ा सख्ती स े माननीर् उच्चतम न्द्र्ार्ालर् के तारीख 4 अगस्ट्त, 2006 के अंतररम आििे के अनुसार होगा, िो दक टी.एन. गोिावमान जथरुमलु पाि बनाम र्ूओआई के डब्ल्र्.ू पी.(सी) संख्र्ा 202/1995 के मामल ेम ेंऔर िो दक गोवा फाउंडेिन बनाम र्ओू आई के डब्ल्र्.ू पी.(सी) संख्र्ा 435/2012 के मामल े म ें ह,ै माननीर् उच्चतम न्द्र्ार्ालर् के तारीख 21 अप्रलै , 2014 के आिेि के अनुसार होगा। (2) प्र ििू ण (िल, वार्ु, मृिा, ध्वजन, आदि) पाररजस्ट्थजतकी संवेिी िोन में कोई प्रििू णकारी उद्योग लगाने र्ा उसके जवस्ट्तार की अनुमजत नहीं िी िाएगी। केंद्रीर् प्रििू ण जनर्ंत्रण उत्पन्न करन े वाल े उद्योगों की स्ट्थापना। बोडा द्वारा फरवरी 2016 म ें िारी मागाििाक जसद्ांतों में वर्णात उद्योगों के वगीकरण के अनुसार, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गरै -प्रििू णकारी उद्योगों को ही अनुमजत िी िाएगी, िब तक दक इस अजधसूचना म ें ऐसा जवजनर्िाष्ट न दकर्ा गर्ा हो। इसके अलावा, गरै -प्रििू णकारी कुटीर उद्योगों का संवधान दकर्ा िाएगा। (3) ब ़िी िल जवद्युत पररर्ोिनाओं की लाग ू जवजधर्ों के अनुसार जनिधे (अन्द्र्था उपाबंध के अजतररि )। स्ट्थापना। (4) दक सी पररसंकटमर् पिाथ ा का प्रर्ोग र्ा लाग ू जवजधर्ों के अनुसार जनिधे (अन्द्र्था उपाबंध के अजतररि )। उत्पािन र्ा प्रस्ट्संकरण। (5) प्र ाकृजतक िल जनकार्ों र्ा भूजम क्षत्रे म ें लाग ू जवजधर्ों के अनुसार जनिधे (अन्द्र्था उपाबंध के अजतररि )। अिोजधत बजहस्रावों का जनस्ट्सरण। (6) ि ोस अपजिष्ट जनपटान स्ट्थल और िोस पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी भी नए िोस अपजिष्ट एव ं िैव जचदकत्सा अपजिष्ट के जलए जनपटान स्ट्थल और िोस अपजिष्ट उपचार र्ा प्रसंस्ट्करण सुजवधा की सामान्द्र् भस्ट्मीकरण सुजवधा की अनुज्ञा नहीं ह।ै औद्योजगक प्रदक्रर्ाओं और स्ट्वास्ट््र् प्रजतष्ठानों र्ा स्ट्थापना। अस्ट्पतालों आदि स े उत्पन्न दकसी भी प्रकार के िोस अपजिष्ट के उपचार के जलए आग े कोई साझा र्ा व्यजिगत भस्ट्मीकरण सुजवधा स्ट्थाजपत करना जनिेध ह।ै (7) फ मों, कॉपोरेट और कंपजनर्ों द्वारा ब़ि े स्ट्थानीर् आवश्र्कताओं को परू ा करन े के अलावा लाग ू जवजधर्ों के अनुसार जनिेध (अन्द्र्था उपाबंध के अजतररि)। पैमाने पर वाजणजज्र्क पिधु न और कु्कुट फामों की स्ट्थापना।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 (8) न व काष्ठाधाररत उद्योग। लाग ू जवजधर्ों के अनुसार जनिधे (अन्द्र्था उपाबंध के अजतररि )। (9) जव स्ट्फोटक वस्ट्तुओं का जवजनमााण और लाग ू जवजधर्ों के अनुसार जनिधे (अन्द्र्था उपाबंध के अजतररि )। भंडारण। (10) प हाज़िर्ों का व्यावसाजर्क उद्देश्र् के जलए लाग ू जवजधर्ों के अनुसार जनिधे (अन्द्र्था उपाबंध के अजतररि )। रूपांतरण। (11) ि लावन लक़िी का वाजणजज्र्क उपर्ोग। लाग ू जवजधर्ों के अनुसार जनिधे (अन्द्र्था उपाबंध के अजतररि )। (12) न ई सॉ जमलों की स्ट्थ ापना की स्ट्थ ापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई र्ा मौिूिा सॉ जमलों के जवस्ट्तार की अनुमजत नहीं िी िाएगी। (13) ईं ट भट्टों की स्ट्थापना। लाग ू जवजधर्ों के अनुसार जनिधे (अन्द्र्था उपाबंध के अजतररि )। (14) न िी तटों पर अजतक्रमण और निी तट की लाग ू जवजधर्ों के अनुसार जनिधे (अन्द्र्था उपाबंध के अजतररि )। वनस्ट्पजत का जवनाि, निी के पत्थरों का संिह। (15) न िी और भूजम क्षत्रे म ें िोस अपजिष्ट र्ा लाग ू जवजधर्ों के अनुसार जनिधे (अन्द्र्था उपाबंध के अजतररि )। पलाजस्ट्टक अपजिष्ट र्ा रासार्जनक अपजिष्ट से पाटना। ख. जवजनर्जमत दक्रर्ाकलाप (16) होटलों और ररजॉटों की वाजणजज्र्क संरजक्षत क्षत्रे की सीमा के एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी स्ट्थापना। संवेिी िोन की सीमा तक, िो भी जनकट हो, दकसी भी नए वाजणजज्र्क होटल और ररसॉटा की अनुमजत नहीं िी िाएगी, जसवार् पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों के जलए छोटे अस्ट्थार्ी ढाँचों के। बिते, मौिूिा प्रजतष्ठानों के जवस्ट्तार की अनुमजत आचं जलक महार्ोिना के अनुसार िी िार्गे ी । (17) जनमााण दक्रर्ाकलाप। पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी भी प्रकार के नए वाजणजज्र्क जनमााण की अनुमजत नहीं होगी। परंत ु दक स्ट्थानीर् लोगों को अपने आवासीर् उपर्ोग के जलए अपनी भूजम पर भवन उपजनर्मों के अनुसार पैरािाफ 6 के उप पैरािाफ (1) म ें सूचीबद् दक्रर्ाकलापों सजहत स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को परू ा करन े की अनुमजत होगी, िैसे: i. मौिूिा स़िकों का चौ़िीकरण और सुिढृ ीकरण तथा नई स़िकों का जनमााण; ii. बुजनर्ािी ढांच े और नागररक सुजवधाओं का जनमााण और नवीनीकरण; iii. फरवरी 2016 के केंद्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा दकए गए वगीकरण के अनुसार प्रििू ण न फैलाने वाल ेलघु उद्योग; iv. िामोद्योग सजहत कुटीर उद्योग; गृह वास सजहत पारर-पर्ाटन को बढावा िेने वाली सुलभ िकु ान और स्ट्थानीर् सुजवधाएं; और v. इस अजधसूचना म ेंसूचीबद् संवर्धात दक्रर्ाकलाप। ख. परंतु दक प्रििू ण न फैलाने वाले लघ ु उद्योगों स े संबंजधत जनमााण दक्रर्ाकलापों को, लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अनुसार सक्षम प्राजधकारी स ेपूव ाअनुमोिन के साथ, न्द्र्ूनतम स्ट्तर पर जवजनर्जमत दकर्ा िाएगा। ग. पाररजस्ट्थजतकी संवेिी िोन म ें जनमाणा दक्रर्ाकलाप आंचजलक महार्ोिना के अनुसार होंगी। (18) गैर प्रििू णकारी लघ ु उद्योग। फरवरी 2016 ,म ें केन्द्द्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा िारी उद्योगों के वगीकरण के अनुसार और अपररसंकटमर्, लघु पैमाने के और सेवा उद्योग उद्यान कृजि र्ा पाररजस्ट्थजतकी संवेिी िोन ,पुष्प कृजि ,कृजि , की िेिि सामिी से उत्पािों का उत् पािन करने वाले कृजि आधाररत उद्योग को सक्षम प्राजधकारी द्वारा अनुमजत िी िाएगी। (19) वृक्षों की कटाई। क. राज्र् सरकार के सक्षम प्राजधकारी की पूव ा अनुमजत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं की िा सकेगी। ख. वृक्षों की कटाई संबंजधत केंद्रीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी। ग. आरजक्षत वनों और संरजक्षत वनों के मामले म ें कार् ा र्ोिना के जनिेिों का पालन दकर्ा िाएगा। (20) वन उत्पािों और गैर काष्ठ वन उत्पािों लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। (एनटीएफपी) का सिं हण। (21) जवद्युत और संचार टॉवर लगाने, तार- भूजमगत केबल जबछाने संबंधी लाग ू जवजधर्ों के अधीन जवजनर्जमत करने को बढावा दिर्ा िाएगा। जबछाने तथा अन्द्र् बुजनर्ािी ढांचे की व्यवस्ट्था। (22) नागररक सुजवधाओं सजहत बुजनर्ािी लाग ू जवजधर्ों, जनर्मों और जवजनर्मों और उपलब्ध मागिा िाक ढांचा। जसद्ांतों के अनुसार िमन के उपार् दकर्े िाएगे। (23) मौिूिा स़िकों को चौ़िा करना, उन्द्ह ें लागू जवजधर्ों, जनर्मों और जवजनर्मन और उपलब्ध मागिा िाक सुिढृ बनाना और नई स़िकों, घाटों, पुलों जसद्ांतों के अनुसार उजचत पर्ाावरण प्रभाव मूल् र्ांकन के साथ न्द्र्ूनीकरण उपार् करना। और पुजलर्ाओं का जनमााण। (24) पर्ाटन स ेसंबंजधत अन्द्र् दक्रर्ाकलाप िैस े लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। दक पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से उ़िान भरना । (25) वाजणजज्र्क मत्स्ट्र् पालन और अवैज्ञाजनक लाग ू जवजधर्ों के अनुसार जनिेध (अन्द्र्था अन्द्र्था उपाबंध के मत्स्ट्र् पालन अजतररि), हालांदक, िनिाजतर्ों के वास्ट्तजवक उपर्ोग के जलए अनुमजत िी गई ह।ै (26) पहा़िी ढलानों और निी तटों का संरक्षण। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। (27) राजत्र म ें वाहन र्ातार्ात का सचं लन। लागू जवजधर्ों के अधीन वाजणजज्र्क उद्देश् र्ों के जलए जवजनर्जमत होगा। (28) स्ट्थानीर् समुिार्ों द्वारा अपनार्ी िा रही स्ट्थानीर् िनता के प्रर्ोग के जलए लागू जवजधर्ों के अधीन अनुमत वतामान कृजि और बागवानी पद्जतर्ों के होंगे। साथ डेर्ररर्ा,ं िग्ु ध उत्पािन, िल कृजि और मत्स्ट्र् पालन।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 13 (29) प्राकृजतक िल जनकार्ों र्ा भ ू क्षेत्र म ें िोजधत अपजिष्ट िल के पुनचाक्रण को प्रोत्साजहत दकर्ा िाएगा और िोजधत अपजिष्ट िल र्ा बजहस्रााव का स्ट्लेि र्ा िोस अपजिष्ट के जनपटान के जलए मौिूिा जनर्मों का पालन जनस्ट्सरण। दकर्ा िाएगा। उपचाररत अपजिष्ट िल/अपजिष्ट िल को िल जनकार्ों म ें िान े स े रोका िाएगा। अन्द्र्था, उपचाररत अपजिष्ट िल/अपजिष्ट िल के जनवाहन को लाग ू जवजधर्ों के अनुसार जवजनर्जमत दकर्ा िाएगा। (30) सतही और भूिल का वाजणजज्र्क लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। जनष्किाण। (31) कृजि र्ा अन्द्र् उपर्ोग के जलए खुला कुआं, जवजनर्जमत और कार्ाकलाप की सक्षम प्राजधकारी द्वारा क़िाई स े जनगरानी की िाएगी। बोरवेल आदि। (32) िोस अपजिष्ट प्रबंधन। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। (33) जविेिी प्रिाजतर्ों का पररचर्। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। (34) पाररजस्ट्थजतकी पर्ाटन। लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। (35) पॉजलथीन बगै का प्रर्ोग करें। जवजिष्ट आवश्र्कता के आधार पर, इस े लाग ू जवजधर्ों के अधीन जवजनर्जमत दकर्ा िाएगा। (36) वाजणजज्र्क संकेत बोडा और होर्डिंग का लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा। [PART II—SEC. 3(ii)] 5. पाररजस्ट्थजतकी सवं िे ी िोन की अजधसचू ना की जनगरानी के जलए जनगरानी सजमजत :- पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, केन्द्द्र सरकार इस अजधसूचना के अनुपालन की जनगरानी हते ु पीची-वझानी पाररजस्ट्थजतकी संवेिी िोन जनगरानी सजमजत नामक एक सजमजत का गिन करती ह।ै उप-अनुच्छेि (1) म ें जवजनर्िष्टा जनगरानी सजमजत म ें जनम्नजलजखत सिस्ट्र् सजम्ब्मजलत होंग,े अथाात्:- क्र.स. जनगरानी सजमजत का गिन पिनाम (i) जिला कले्टर, जत्रिूर, पलक्क़ि अध्र्क्ष; (ii) जिला पंचार्त अध्र्क्ष, जत्रिूर सिस्ट्र्; (iii) केरल राज्र् प्रििू ण जनर्ंत्रण बोड/ा केरल राज्र् जवद्युत बोडा/केरल िल सिस्ट्र्; प्राजधकरण/केरल राज्र् पसंचाई जवभाग/केरल राज्र् पर्ाावरण जवभाग के प्रजतजनजध (iv) प्राकृजतक संरक्षण (जवरासत सरं क्षण सजहत) के क्षत्रे म ें कार्ारत गैर-सरकारी सिस्ट्र्; संगिनों के प्रजतजनजधर्ों को केरल सरकार द्वारा नामजनर्िाष्ट दकर्ा िाएगा। (v) केरल राज्र् के प्रजतजष्ठत संस्ट्थान र्ा जवश्वजवद्यालर् स ेपाररजस्ट्थजतकी का एक सिस्ट्र्; जविेिज्ञ, जिसे केरल सरकार द्वारा नाजमत दकर्ा िाएगा (vi) वन्द्र्िीव संरक्षक, पीची-वझानी पिेन, सिस्ट्र्-सजचव। जनगरानी सजमजत के कार्-ा क्षत्रे - (1) जनगरानी सजमजत इस अजधसूचना के उपाबंधों के अनुपालन की जनगरानी करेगी। (2) जनगरानी सजमजत का कार्का ाल तीन विा का होगा। (3) भारत सरकार के तत्कालीन पर्ाावरण एव ं वन मंत्रालर् की अजधसूचना संख्र्ा का.आ. 1553 (अ), तारीख 14 जसतंबर, 2006 की अनुसूची म ें सजम्ब्मजलत दक्रर्ाकालाप पाररजस्ट्थजतकी संवेिी िोन म ेंआती ह,ैं इसके परै ािाफ 7 के अधीन सारणी म ें जवजनर्िाष्ट प्रजतजिद् दक्रर्ाकलापों को छो़िकर, वास्ट्तजवक स्ट्थल-जवजिष्ट जस्ट्थजतर्ों के आधार पर जनगरानी सजमजत द्वारा िांच की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूव ापर्ाावरणीर् अनापजत्त के जलए पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् म ें केंद्र सरकार को भेिा िाएगा। (4) भारत सरकार के तत्कालीन पर्ाावरण एव ं वन मंत्रालर् म ें प्रकाजित अजधसूचना संख् र्ा का.आ. 1533 (अ), तारीख 14 जसतंबर, 2006 म ें सजम्ब्मजलत नहीं दकए गए और पाररजस्ट्थजतकी संवेिी िोन म ें आने वाले दक्रर्ाकलापों, उसके पैरा 4 के अधीन सारणी म ें जवजनर्िाष्ट जनजिद् दक्रर्ाकलापों को छो़िकर, की जनगरानी सजमजत द्वारा वास्ट्तजवक स्ट् थल-जवजिष्ट जस्ट्थजतर्ों के आधार पर िांच की िाएगी और संबंजधत जवजनर्ामक प्राजधकरणों को अिेजित की िाएगी। (5) जनगरानी सजमजत के सिस्ट्र् सजचव पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के अधीन इस अजधसूचना के प्रावधानों का उल्लंघन करने वाले दकसी भी व्यजि के जखलाफ जिकार्त ििा करन े के जलए सक्षम होंगे। (6) मामले िर मामल े की अपक्षे ाओं के आधार पर जनगरानी सजमजत संबंजधत जवभागों के प्रजतजनजधर्ों र्ा जविेिज्ञों, उद्योग संघों के प्रजतजनजधर्ों र्ा संबंजधत पणधाररर्ों को अपन े जवचार-जवमि ा म ें सहार्ता के जलए आमंजत्रत कर सकती ह।ै (7) जनगरानी सजमजत इस अजधसूचना के अनलु ग्नक- V में जवजनर्िाष्ट प्रोफामाा के अनुसार प्रत्र्ेक विा 31 माचा तक के अपन े दक्रर्ाकलापों की वार्िाक कारावाई ररपोटा उस वि ा के 30 िून तक राज्र् के मख्ु र् वन्द्र्िीव सरं क्षक को प्रस्ट्तुत करेगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 15 (8) पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् म ें केन्द्द्र सरकार, जनगरानी सजमजत को उसके कार्-ा कलापों के प्रभावी जनवाहन के जलए जलजखत म ें ऐस ेजनिेि ि ेसकेगा िो वह उजचत समझे। (9) केंद्र सरकार और राज्र् सरकार इस अजधसूचना के उपाबंध को प्रभावी करने के जलए अजतररि उपार्, र्दि कोई हो, जनर्िष्टा कर सकती ह।ै (10) इस अजधसूचना के उपाबंध भारत के माननीर् उच्चतम न्द्र्ार्ालर् र्ा उच्च न्द्र्ार्ालर् र्ा राष्ट्रीर् हररत अजधकरण द्वारा पाररत र्ा पाररत दकए िान े वाले आिेिों, र्दि कोई हों, AND WHEREAS, the Peechi-Vazhani Wildlife Sanctuary supports a wide range of important reptile species such as Cochin Forest Cane Turtle (Vijayachelys sylvatica), Indian Black Turtle (Melanochelys trijuga), Travancore Tortoise (Indotestudo travancorica), Elliot's Forest Lizard (Monilesaurus ellioti), Roux's Forest Lizard (Monibesaurus rouxii), Wayanad Day Gecko (Cnemaspis wynadensis), Bark Gecko (Hemidactylus leschenaultii), Common Keeled Skink (Eutropis carinata), Bengal Monitor (Varanus bengalensis), Indian Rock python (Python molurus), Common Trinket Snake (Coelognathus helena), Common Kukri Snake (Oligodon arnensis), Common Wolf Snake (Lycodon aulicus), Striped Keelback (Amphiesma stolatum), Common Indian Krait (Bungarus caeruleus), Russel's Viper (Daboia russelii), etc. AND WHEREAS, the Peechi-Vazhani Wildlife Sanctuary supports a wide range of important amphibian species such as Common Indian Toad (Duttaphrynus melanostictus), Skittering Frog (Euphlyctis cyanophlyctis), Indian Burrowing Frog (Sphaerotheca breviceps), Reddish Narrow-mouthed Frog (Microhyla rubra), Bicoloured Frog (Clinotarsus curtipes), Common Indian Tree Frog (Polypedates maculates), Water Drop Frog (Raorchestes nerostagona), Malabar Gliding Frog (Rhacophorus malabaricus), Anamallais Leaping frog (Indirana brachytarsus), South Indian Frog (Indirana semipalmata), Menon's Caecilian (Uraeotyphlus menoni), etc. AND WHEREAS, fish species found in the Peechi-Vazhani Wildlife Sanctuary includes Black Line Rasbora (Rasbora dandia), Common Carp (Cyprinus caprio), Black Spot Barb (Dokinsia filamentosa), Rohu (Labeo rohita), Catla (Labeo catla), Peninsular Olive Bar (Systomus sarana), Western Ghat Loach (Bhavania australis), Malabar Loach (Lepidocephalus thermalis), Malabar Mystus (Mystus oculatus), Indian Butter Catfish (Ompok bimaculatus), Fresh Water Garfish (Xenentodon cancila), Malabar Killie (Aplocheilus lineatus), Orange Chromid (Pseudetroplus maculatus), Tank Goby (Glossogobius guiris), etc.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, the butterfly species found in the Peechi-Vazhani Wildlife Sanctuary includes Spot Swordtail (Graphium nomius), Crimson Rose (Pachliopta hector), Tailed Jay (Graphium Agamemnon), Red Helen (Papilio Helenus), Lime Butterfly (Papilio detnoleus), Blue Mormon (Papilio polymnestor), Painted Sawtooth (Prjoneris sita), Chocolate Albatross (Appias lyncida), Bamboo Tree brown (Lethe europa), Common Four-ring (Ypthima huebneri), Common Sailer (Neptis hylas), Common Castor (Ariadne merione), Peacock Pansy (Junonia almana), Blue Tiger (Tirumala limniace), Striped Tiger (Danaus genutia), Common Pierrot (Castalius rosimon), Pale grass blue (Pseudozizeeria maha), Common Awl (Hagora badra), Bush Hopper (Ampittia dioscorides), Giant Red-eye (Gangara thyrsis), Rice Swift (Borbo cinnara), Water Snow Flat (Tagiades litigiosa), Golden angle (Odontoptilum ransonnetii), Tawny Coster (Acraea violae), Mottled Emigrant (Catopsilia pyranthe), Pale grass blue (Pseudozizeeria maha), Coon (Psolos fuligo), etc. AND WHEREAS, the predominant vegetation type in the Peechi-Vazhani Wildlife Sanctuary is moist deciduous, covering about 80 percent of the sanctuary area. Semi evergreen and some evergreen patches are seen along the higher slopes. The vegetation, therefore, changes from moist deciduous to evergreen. The sanctuary area is at the end of north-western portion of a vast forested landscape extending from the Nelliampathies to the Chimmony Wildlife Sanctuary at the southern boundary. The forests of this sanctuary are connected with Parambikulam and Vazhachal forests. AND WHEREAS, the Peechi-Vazhani Wildlife Sanctuary is a part of the Anamudi Elephant Reserve in the State of Kerala, with a total forest area of 3728 sq. km. Anamudi Elephant Reserve consists of several Protected Areas viz., Parambikulam Tiger Reserve, Peechi Wildlife Sanctuary, Chimmony Wildlife Sanctuary, Thattekkad Wildlife Sanctuary, Chinnar Wildlife Sanctuary, Idukki Wildlife Sanctuary, Eravikulam National Park, Anamudi Shola National Park, Pambadum Shola National Park, Mathikettan Shola National Park and Kurinjimala Wildlife Sanctuary and the forest areas of Vazhachal, Nenmara, Chalakudy, Thrissur, Munnar, Malayattur, Kothamangalam and Mankulam forest divisions. AND WHEREAS, The sanctuary area is a large representative area of south Indian moist deciduous forests in the Western Ghats with associated floral and faunal diversity with representation of almost the entire range of south Indian wildlife. AND WHEREAS, the forests of the Peechi-Vazhani Wildlife Sanctuary forms the catchments of Peechi and Vazhani reservoirs by the way of their favourable influence on soil and water conservation regimes, ensuring water availability in these reservoirs by providing drinking water to Thrissur town as well as irrigating agricultural lands. AND WHEREAS, the Peechi-Vazhani Wildlife Sanctuary has exceptional medicinal plant diversity with rare and endangered species. The forests of the sanctuary ameliorate the micro climate and exert favourable influence on the soil and water conservation regimes of the adjacent habitations and agricultural lands. AND WHEREAS, it is necessary to conserve and protect the area, surrounding the boundaries of Peechi-Vazhani Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0 kilometer to 6.5 kilometers, around the boundary of Peechi-Vazhani Wildlife Sanctuary in Thrissur[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 25 and Thalappilly Taluks of Thrissur district in the state of Kerala as the Eco-sensitive Zone (hereafter in this notification referred to as the Eco-Sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of Eco-Sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 0 km to 6.5 km around the boundary of Peechi-Vazhani Wildlife Sanctuary and the area of the Eco-sensitive zone 76.8 square kilometer. (2) The boundary description of Peechi-Vazhani Wildlife Sanctuary and its Eco-Sensitive Zone are appended in Annexure-I. (3) The Maps of Eco-sensitive zone of Peechi-Vazhani Wildlife Sanctuary are appended as Annexure-II A and Annexure-II B. (4) Geo-coordinates of the boundary of Peechi-Vazhani Wildlife Sanctuary and its Eco-Sensitive Zone are appended as Annexure-III. (5) The list of villages falling in the proposed eco-sensitive zone is given in Annexure-IV. 2. Zonal Master Plan for Eco-Sensitive Zone:- (1) The State Government shall, for the purposes of the Eco-sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment, Forest, (ii) Urban Development, (iii) Tourism, Municipal, (iv) Revenue, (v) Irrigation, (vi) Local Self Government Department, (vii) Public Works Department, (viii) Kerala State Pollution Control Board (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies, and the plan is supported by land use map. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of the local communities. (8) The Zonal Master Plan shall be co-terminus with the regional development plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 3. Measures to be taken by the State Government. - The State Government shall take the following measures for giving effect to the provisions of this notification, namely: - (1) Land use. – (a) Forests, horticulture area, agriculture area, Parks and open spaces earmarked for recreation purposes in the ESZ shall not be used or converted into areas for major commercial or major residential complex or industrial activities. Provided that the conversion of agriculture and other land within the ESZ for the purpose other than that specified at part A, may be permitted on the recommendation of the Monitoring committee and with the prior approval of the State Government, to meet the residential needs of local residents, such as- (i) Widening and strengthening of existing roads and construction of new road; (ii) Construction and renovation of infrastructure and basic civic amenities; (iii) Small scale industries not causing pollution; (iv) Cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including home stay; (v) Promoted activities given in paragraph 4 Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph; (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies. - The catchment areas of all natural springs / rivers / channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan. (3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; (b) the Tourism Master Plan shall be prepared by the Department of Tourism in consultation with the Department of Revenue and Forests, Government of Kerala; (i) Ecotourism activities in the forest areas shall be as per the prescriptions of the working plans or management plans. (ii) The eco-tourism master plan for the forest areas forming part of the ESZ shall be prepared by the department of forests and wildlife in association with the state department of tourism. (c) the Tourism Master Plan shall form a component of the Zonal Master Plan; (d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone; (e) the activities of eco-tourism shall be regulated as under, namely:- (i) New constructions of hotels and resorts shall not be permitted within the ESZ except for accommodation of temporary occupation of tourist related to eco-friendly tourism activities; Provided that extension of existing establishments may be allowed in accordance with the Zonal Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the ESZ shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest And Climate Change and the eco-tourism guideline issued by National Tiger Conservation Authorities (as amended from[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27 time to time) with emphasis on eco-tourism, eco-education and eco-development based on the carrying capacity study of the ESZ; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the monitoring committees. No new hotels/ resorts or commercial establishment construction is permitted within eco sensitive zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, area and precincts of historical, architectural, aesthetic and cultural significance shall be identified in the ESZ and heritage conservation plan for their conservations shall be prepared within six months from the date of publication of final notification and incorporated in the Zonal Master Plan. (6) Noise Pollution. - Prevention and Control of noise pollution in the ESZ shall be compiled with in accordance with Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto. (7) Air Pollution. - Prevention and control of air pollution in the ESZ shall be compiled with in accordance with the prevention of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and rule made there under and amendments thereto. (8) Discharge of effluents. - The discharge of treated effluents in ESZ shall be in accordance with the provision of General Standards of Discharge of Environmental Pollutants covered under the Environmental (Protection) Act 1986 and rules made there under or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 and as amended from time to time; (b) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (c) No burning or incineration of solid wastes and establishment of landfills shall be permitted in the ESZ; (10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016; as amended from time to time. (b) No common treatment facility or incineration shall be permitted within the ESZ. (11) Plastic waste management. - The Plastic Waste Management in the ESZ shall be carried out as per the provision of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR. 340 (E), dated the 18th march 2016, as amended from time to time. (12) Construction and demolition Waste Management. - The Construction and Demolition Waste Management in the ESZ shall be carried out as per the provision of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR.317 (E), dated 29th March, 2016 as amended from time to time. (13) E-waste. - The E-waste management in the ESZ shall be carried out as per the provision of E-waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the Competent Authority in the state Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant acts and rules and regulation made there under. (15) Vehicular pollution. - Prevention and Control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc. (16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the ESZ; (b) Only non-polluting industries shall be allowed with in ESZ as per classification of industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification in addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) no construction on existing steep hill slopes or slopes with high degree of erosion shall be permitted. 4. List of activities prohibited, regulated, and permitted within Eco-Sensitive Zone.- All activities in the Peechi-Vazhani Eco-sensitive Zone shall be governed by the provisions of the Wildlife (Protection) Act, 1972 (53 of 1972), the Forest (Conservation) Act, 1980 (69 of 1980) and the Environment (Protection) Act, 1986 (29 of 1986) and other Acts and Rules prevalent in the State. Forest area coming under the eco-sensitive zone will remain to be governed under existing forest laws. Subject to the provisions of this paragraph, the activities in the Eco-sensitive Zone shall be regulated in accordance with tabular column given below, namely:- Table Sl. No. Activity Description A. Encroachment of river banks Prohibited (except as otherwise provided) as per applicable laws. and destruction of river bank vegetation, collection of river stone. 15. Dumping of solid wastes/ Prohibited (except as otherwise provided) as per applicable laws. plastic wastes/ chemical wastes in the river and the land area. B. Regulated Activities 16. Commercial establishment of No new commercial hotels and resorts shall be permitted within hotels and resorts. one kilometer of the boundary of the protected Area or up to the extent of ESZ, whichever is nearer, except for small temporary structure for Eco-tourism activities. Provided that, extension of existing establishments may be allowed in accordance with the Zonal Master Plan. 17. Construction activities. a. No new commercial construction of any kind shall be permitted within the ESZ Provided that local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws to beat the residential needs of the local residents such as: i. Widening and strengthening of existing roads and construction of new roads;30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ii. Construction and renovation of infrastructure and civic amenities; iii. Small scale industries not causing pollution termed as per classification done by Central Pollution Control Board of February 2016; iv. Cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including home stays; and v. Promoted activities listed in this notification. b. Provided that the construction activity related to small scale industries not causing pollution shall be regulated at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. c. Construction activities in ESZ shall be as per the Zonal Master Plan. 18. Small scale non-polluting Non- polluting industries as per classification of industries issued industries. by the Central Pollution Control Board in February 2016 and non- hazards, small scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the ESZ shall be permitted by the competent authority. 19. The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under. c. Monitoring Committee.- In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a committee32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] to be called as the Peechi-Vazhani Eco-sensitive Zone Monitoring Committee to monitor the compliance of this notification. The Monitoring Committee referred to in sub-paragraph (1) above, shall consist of the following members, namely:- Sl. Constituent of the Monitoring Committee Designation No. (i) The District Collector, Thrissur, Palakkad Chairman; (ii) The District Panchayat President, Thrissur Member; (iii) Representatives of Kerala State Pollution Control Board/Kerala State Electricity Member; Board/Kerala Water Authority/Kerala State Irrigation Department/Kerala State Environment Department (iv) Representative of Non-Governmental Organizations working in the field of natural Member; conservation (including heritage conservation) to be nominated by the Government of Kerala (v) One expert in Ecology from reputed Institution or University of the State of Kerala to Member; be nominated by the Government of Kerala (vi) The Wildlife Warden, Peechi Member Secretary; 6. Terms of Reference of the Monitoring Committee.- 1. The Monitoring Committee shall monitor the compliance of the provisions of this notification. 2. The tenure of the Monitoring Committee has been for three years. 3. The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and forests number S.O.1533 (E), dated the 14th September 2006 and are falling in ESZ, except for the prohibited activities as specified in the table under paragraph 7 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. 4. The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and forests number S.O. 1533(E), dated the 14th September 2006 and are falling in ESZ, except for the prohibited activities as specified in the table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authority. 5. The Member Secretary of Monitoring Committee shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. 6. The Monitoring Committee may invite representatives or experts from concerned Departments or representative from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. 7. The Monitoring Committee shall submit the annual action taken report of its activities by the 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the state as per pro-forma given Annexure-V.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 33 8. The central Government in the Ministry of Environment, Forests and Climate Change may give such direction, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 9. The central Government and State government may specify additional measures, if any, for giving effect to the provision of this notification. 10. The provision of this notification shall be subject to the orders, if any, passed or to be passed, by the Hon'ble Supreme Court of India or the High Court or National Green Tribunal. [F. KERKETTA, Scientist ‘G’ Annexure I BOUNDARY DESCRIPTION OF PEECHI- VAZHANI WILDLIFE SANCTUARY North & East: Starting from a point at elevation 370 m at about 3.2 km north of Vazhani Dam site, the boundary runs more or less southeast along the eastern catchment boundary of Vazhani reservoir up to the common Taluk boundary of Thalappilly and Thrissur Taluks at Munippara (515 m). Thence more or less in the same direction along the common Taluk boundary of the said Taluks up to the tri-junction of Palakkad, Thrissur and Thalappilly Taluks, thence along the common Taluk boundary of Palakkad and Thrissur Taluks up to the tri-junction of Palakkad, Mukundapuram and Thrissur Taluks at Ponmudi (914 m). South: Thence more or less west along the common Taluk boundary of Mukundapuram and Thrissur Taluks up to a point in the said Taluk boundary about a km West of Mangattukomban (840 m). West: Thence more or less North-west along with western catchment boundary of Peechi Reservoir up to Peechi Dam via. Vengappara (555 m) and height points 245 and 185; thence more or less North along the said catchment boundary till it meets Thrissur-Vaniampara road, thence first more or less West-North West and then more or less North-North-West along the Western catchment boundaries of Peechi and Vazhani reservoirs passing height points 200 and 205 and the Vazhani Dam to the starting point. The Sanctuary is surrounded by Reserve Forests except for the eastern boundary from Vaniampara up to Palakuzhy near the south-eastern end. The Reserve Forests of Machad Range of Thrissur Division is on the north, northeast and northwest and the reserve forests of the Pattikkad range is on the western side and a small portion of boundary adjoins the reserve forests of the Palappilly Range of the Chalakkudy Division on the southwest and the forests of the Chimmony Wildlife Sanctuary on the south and the reserve forests of the Alathur Range of Nenmara Division is on the southeastern boundary near to Palakuzhy and Ponmudi.34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] BOUNDARY DESCRIPTION OF THE ECO-SENSITIVE ZONE OF PEECHI- VAZHANI WILDLIFE SANCTUARY The Eco-Sensitive Zone boundary of Peechi-Vazhani Wildlife Sanctuary starts from the sanctuary boundary, GPS point 13, Kasumavinthoppe (10°38′41.5″N, 76°18′29.4″E), from here the boundary runs towards the west to the nearest reserve forest boundary Junda of Machad Range, (10°38'42.00"N, 76°18'26.00"E), thence, the boundary runs along the Reserve forest boundary towards the northwest direction till it reaches the GPS Point North 14, Karumattara (10°39′06.3″N, 76°17′04.9″E) from here the boundary runs straight towards the GPS Point 15, Cheppalakkod (10°39′27.2″N, 76°16′51.5″E), thence the boundary runs along the reserve forest boundary of Machad Range till it reaches the GPS point 1, Karakkad (10°41′09.5″N, 76°16′55.4″E) from here the boundary runs straight towards the south-east direction to GPS point 2, Tottekkod (10°40′18.3″N, 76°18′31.8″E). Thence, the boundary runs along the reserve forest boundary of Machad Range till it reaches GPS point 3, Palamyampadam (10°38′05.3″N, 76°22′03.8″E), from here the boundary runs further south along the Reserve Forest Boundary till it reaches the District boundary of Thrissur and Palakkad, from here the boundary follows East the district boundary towards the south west direction till it reaches the Sanctuary boundary, GPS point 4, Manimala (10°35′24.6″N & 76°24′09.6″E). Thence the boundary follows the sanctuary boundary until it reaches Ponmudi, here the width of the Eco-Sensitive zone is Zero. Thence, the boundary follows the sanctuary boundary of Peechi-Vazhani and Chimmony Wildlife Sanctuaries South towards the west direction till it reaches GPS point 5, Maghattukomban (10°28′11.9″N & 76°25′06.9″E). Here, the width of the ESZ is Zero. Thence, the boundary runs along the taluk boundary of Thrissur and Chalakudy till it reaches GPS Point 6, Nadampadam (10°27′21.1″N & 76°22′11.8″E), from here the boundary runs towards northwest direction along the reserve forest boundary of Pattikade Range till it reaches GPS Point 7, Marottichal (10°29′21.4″N, & 76°20′46.5″E), From here the boundary runs towards the northeast direction along the Reserve Forest boundary till it reaches the Sanctuary Boundary, GPS point 8, Thamaravellachal (10°30′54.1″N & 76°22′31.2″E). Thence the boundary runs along the Sanctuary Boundary till it reaches GPS point 9, Earth Dam (10°31′58.9″N & 76°22′31.8″E), here the width of the ESZ is Zero. From here the boundary runs towards the nearest Reserve Forest Boundary, GPS point 10, Chelikuzhi (10°32′06.9″N & 76°22′17.8″E) Thence, the boundary runs along the Reserve Forest Boundary of Pattikade Range towards the North till it reaches the Western Entrance of Kuthiran tunnel. From here the boundary follows the Reserve Forest Boundary till it reaches GPS point 11, West Naruke (10°34′32.1″N & 76°21′57.2″E), Thence, the boundary runs towards north to the enclosure boundary ( 10°34'34.99"N, 76°22'1.78"E) and follows the enclosure boundary till it reaches enclosure boundary Junda (10°34'36.44"N & 76°22'0.92"E), From here the boundary runs towards the nearest reserve forest boundary Junda (10°34'34.01"N, 76°21'57.40"E), Thence the boundary runs along the reserve forest boundary till it reaches Ninnukuzhi (10°34'33.60"N, 76°18'27.70"E). Thence, the boundary runs north towards the Ninnukuzhi enclosure boundary (10°34'40.20"N, 76°18'36.70"E) and follows the enclosure boundary till it reaches GPS point 10°34'45.00" N, 76°18'15.40"E.
