(xiv) तथा उप-धारा (3) के अधीन प्रित्त िजिर्ों का प्रर्ोग करते हुए प्रस्ट्ताजवत जनम्नजलजखत प्रारुप अजधसूचना को िारी करने का प्रस्ट्ताव करती है, इसके द्वारा पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) की अपेक्षानुसार इससे प्रभाजवत होन े वाली िनसाधारण की िानकारी के जलए प्रकाजित करती ह;ै और एतद्द्वारा र्ह सूजचत दकर्ा िाता ह ै दक उि प्रारुप अजधसूचना पर उस तारीख से साि दिन की अवजध की समाजि पर र्ा उसके बाि जवचार दकर्ा िाएगा जिस तारीख को इस अजधसूचना वाले रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी िाती ह।ैं ऐसा कोई भी व्यजि, जिसे इस प्रारूप अजधसूचना म ें अतं र्वाष्ट प्रस्ट्तावों के संबंध म ें कोई आपजत्त ह ै र्ा वह सुझाव िेना चाहता ह,ै इस प्रकार जवजनर्िाष्ट अवजध के भीतर, केन्द्द्र सरकार के द्वारा जवचार दकए िाने के जलए, ऐसी आपजत्त र्ा सुझाव को सजचव, पर्ाावरण, वन और िलवार्ु पठरवतान प्रिेि के वेस्ट्ट जसर्ांग जिल े के आलॉन्द्ग वन प्रभाग में जस्ट्थत ह।ै र्ह अभर्ारण्र् 397 वग ा दकमी क्षेत्र म ें फैला हुआ ह।ै भारत के रािपत्र की अजधसूचना सीएलडब्लू/डी/33/96/1451- 91, तारीख 4 िून 2007 के माध्र्म से इसे वन्द्र्िीव अभर्ारण्र् घोजषत दकर्ा गर्ा था; और िबदक, र्ोडी राबे सुप्से वन्द्र्िीव अभर्ारण्र् में ऊंचाई में व्यापक जभन्नता है, िो उष्णकठटबंधीर् से उप-समिीतोष्ण और अध-ा सिाबहार वन प्रिाजत, अिगर प्रिाजत, अहतेुल्ला प्रिाजत, एमफीस्ट्मा प्रिाजत, बगंारस प्रिाजत, नािा प्रिाजत, ओदफर्ोफैगस प्रिाजत िैसे सांप; कुओरा प्रिाजत, पागंिुरा प्रिाजत िैस ेकछुए सजममजलत ह;ैं और िबदक, पाठरजस्ट्थजतकी, पर्ाावरण और िैव जवजवधता के िजृ ष्टकोण से पाठरजस्ट्थजतकी-संविे ी िोन के रूप में परै ाग्राफ 1 में जवजनर्िाष्ट र्ॉडी राबे सुप्से वन्द्र्िीव अभर्ारण्र् की सीमाओं के आसपास के क्षेत्र का संरक्षण और सुरक्षा करना आवश्र्क ह ै तथा उि पाठरजस्ट्थजतकी-संवेिी िोन म ें उद्योगों र्ा उद्योगों की श्रेजणर्ों और उनके संचालन एव ं प्रदरर्ाओं को प्रजतजषद्ध करना आवश्र्क ह;ै अतः अब, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) के साथ पठित, पर्ाावरण (संरक्षण) अजधजनर्म 1986 (1986 का 29) की धारा 3 की उप-धारा (1) और उपधारा (2) के खंड (v) और (xiv) और उप-धारा (3) की उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए (जिसे इसके बाि इस अजधसूचना में पर्ाावरण अजधजनर्म के रूप म ें संिर्भात दकर्ा गर्ा ह)ै केंद्र सरकार अरुणाचल प्रििे के र्ॉडी राबे सुप्से वन्द्र्िीव अभर्ारण्र् की सीमा के चारों ओर[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 पाठरजस्ट्थजतकी-संवेिी िोन को अजधसूजचत करती ह ै (जिसे इसम ें इसके बाि पाठरजस्ट्थजतकी-संवेिी िोन कहा िाएगा) जिसका जववरण जनम्नानुसार ह,ै अथाात्: - 1. पाठरजस्ट्थजतकी-सवं िे ी िोन का जवस्ट्तार एव ं सीमाएाँ.– (1) पाठरजस्ट्थजतकी-संवेिी िोन िून्द्र् स े 1 दकलोमीटर तक फैला हुआ ह,ै िो अभर्ारण्र् के चारों ओर 39.17 वगा दकलोमीटर क्षेत्र को घरे ता करता ह।ै जवजभन्न दििाओं म ें पाठरजस्ट्थजतकी-संवेिी िोन का जवस्ट्तार नीच ेदिर्ा गर्ा ह:ै - दििा दकलोमीटर में जवस्ट्तार उत्तर-पजिम 1 उत्तर 1 उत्तर-पूव ा 0.1 पूवा 0.1 िजक्षण-पूव ा 0.1 िजक्षण 0 िजक्षण-पजिम 0 पजिम 0 िन्द्ू र् पाठरजस्ट्थजतकी-सवं िे ी िोन का औजचत्र्: ➢ अभर्ारण्र् की िजक्षण-पजिमी और पजिमी सीमा पजिम जसर्ांग और ऊपरी सुबनजसरी जिलों की प्रिासजनक सीमा से जमलती ह,ै िो अलॉन्द्ग वन प्रभाग की पजिमी सीमा भी ह।ै चूंदक अलोंग वन प्रभाग का अभर्ारण्र् की पजिमी सीमा से परे कोई अजधकार क्षेत्र नहीं ह,ै इसजलए कोई पाठरजस्ट्थजतकी-संवेिी िोन प्रस्ट्ताजवत नहीं दकर्ा िा सकता ह।ै इसके अलावा, र्ह क्षेत्र तीव्र ढलानों और चोठटर्ों से र्ुि ह ै िो एक बफर िोन के रूप में कार्ा करते ह ैं और अभर्ारण्र् क्षेत्र के भीतर दकसी भी मानविजनत गड़बड़ी के जलए प्राकृजतक अवरोध का काम करते ह।ैं ➢ अभर्ारण्र् के िजक्षणी भाग को स्ट्थानीर् लोगों के अनरु ोध पर आवासों और कृजष भूजम की उपजस्ट्थजत के कारण प्रजतबंजधत क्षेत्र के रूप म ेंिाजमल नहीं दकर्ा गर्ा ह।ै (2)र्ोडी राबे सुप्से वन्द्र्िीव अभर्ारण्र् और इसके पाठरजस्ट्थजतकी-संवेिी िोन का मानजचत्र अनलु ग्नक-Iक और अनुलग्नक- Iख के रूप में संलग्न ह।ै (3) र्ोडी राबे सुप्से वन्द्र्िीव अभर्ारण्र् और इसके पाठरजस्ट्थजतकी-संवेिी िोन की सीमा का जववरण अनुलग्नक-IIक और अनलु ग्नक-IIख के रूप म ेंसंलग्न ह।ै (4) र्ोडी राबे सुप्से वन्द्र्िीव अभर्ारण्र् और इसके पाठरजस्ट्थजतकी-संवेिी िोन के प्रमुख स्ट्थानों के भौगोजलक जनिेिांक, जिनका उल्लेख सारणी क और ख में दकर्ा गर्ा है, अनलु ग्नक-III के रूप में सलं ग्न ह।ैं (5) पाठरजस्ट्थजतकी-संवेिी िोन में कोई गााँव नहीं आता ह।ै 2. पाठरजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना– (1) राज्र् सरकार, पाठरजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए, स्ट्थानीर् लोगों से परामिा करके और इस अजधसूचना के उपबंधों के अनरूु प, आजधकाठरक रािपत्र में इस अजधसूचना के प्रकािन की जतजथ स ेिो वषा के भीतर एक आंचजलक महार्ोिना तैर्ार करेगी। (2) राज्र् सरकार द्वारा पाठरजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसचू ना के उपबंधों के अधीन तथा केंद्रीर् और राज्र् जवधानों के सुसंगत और केंद्रीर् सरकार द्वारा िारी मागाििाक जसद्धांतों, र्दि कोई हों, के अनरुु प तैर्ार की िाएगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (3) आंचजलक महार्ोिना, राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ासे तैर्ार की िाएगी तादक पाठरजस्ट्थजतकी और पर्ाावरणीर् सरोकारों को इस र्ोिना में एकीकृत दकर्ा िा सके.- i. पर्ाावरण; ii. वन और वन्द्र्िीव; iii. कृजष; iv. रािस्ट्व; v. िहरी जवकास; vi. पर्ाटन; vii. ग्रामीण जवकास; viii. लसंचाई और बाढ़ जनर्ंत्रण; ix. नगरपाजलका; x. पंचार्ती राि; xi. लोक जनमााण जवभाग। (4) आंचजलक महार्ोिना म ें अनुमोदित भू-उपर्ोग, अवसंरचना और दरर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा िब तक इस अजधसूचना म ें ऐसा जवजनर्िाष्ट न हो, तथा आचंजलक महार्ोिना की सभी अवसंरचनाओं और उसके दरर्ाकलापों म ें सुधार करके उन्द्ह े अजधक िक्ष और पाठरजस्ट्थजतकी-अनुकूल बनान े की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना, म ें वृक्षहीन क्षेत्रों की बहाली, जवद्यमान िल जनकार्ों के सरं क्षण, िल ग्रहण क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भ-ू िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाठरजस्ट्थजतकी और पर्ाावरण के ऐसे अन्द्र् पहलुओं का प्रावधान दकर्ा िाएगा, जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह ै। (6) आंचजलक महार्ोिना म ें सहार्क मानजचत्रों के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों और दकस्ट् मों, कृजष क्षेत्रों, उपिाऊ भूजम, उद्यानों और उद्यानों की तरह के हठरत क्षत्रे ों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा, जिनम ें जवद्यमान तथा प्रस्ट्ताजवत भू-उपर्ोग जविषे ताओं के ब्र्ौरों का जनधाारण दकर्ा िाएगा। (7) इस आंचजलक महार्ोिना म ें पाठरजस्ट्थजतकी-संवेिी िोन के जवकास को जवजनर्जमत दकर्ा िाएगा और पैरा 4 म ें सूचीबद्ध प्रजतजषद्ध और जवजनर्जमत दरर्ाकलापों का अनुपालन दकर्ा िाएगा और स्ट्थ ानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाठरजस्ट्थजतकी अनुकूल जवकास को सुजनजित दकर्ा िाएगा और उसका संवधना दकर्ा िाएगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) इस प्रकार अनुमोदित आंचजलक महार्ोिना, इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपन े कार्ों को परू ा करने के जलए जनगरानी सजमजत के जलए संिभ ा िस्ट्तावेि होगा। 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्. - राज्र् सरकार अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्: - (1) भ-ू उपर्ोग. – (क) पाठरजस्ट्थजतकी-संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खलु े स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पठरसरों र्ा औद्योजगक दरर्ाकलापों के जलए प्रर्ोग र्ा पठरवतान की अनुमजत नहीं होगी: बिते दक पाठरजस्ट्थजतकी-संवेिी िोन के भीतर (क) में जवजनर्िाष्ट उद्देश्र् के अलावा अन्द्र् उद्देश्र्ों के जलए कृजष और अन्द्र् भूजम का रूपांतरण जनगरानी सजमजत की जसफाठरि पर और क्षेत्रीर् नगर जनर्ोिन अजधजनर्म और केंद्र/राज्र् सरकार के अन्द्र्[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी की पवू ा अनुमोिन के साथ अनुमत दकर्ा िा सकता ह ै और इस अजधसूचना के उपबंधों के अनसु ार, स्ट्थानीर् जनवाजसर्ों की आवासीर् िरूरतों को पूरा करने के जलए दकर्ा िा सकता ह,ै िैसे: (i) जवद्यमान सड़कों को चौड़ा करना, उन्द्ह ेंसुिढ़ृ करना और नई सड़कों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागठरक सुजवधाओं का सजन्नमााण और नवीनीकरण; (iii) प्रिषू ण उत्पन्न न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योग एव ं ग्राम उद्योग; पाठरजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और (v) पैराग्राफ-4 के मि में र्था उजल्लजखत संवर्धात दरर्ाकलाप। बिते र्ह भी दक क्षेत्रीर् नगर जनर्ोिन अजधजनर्म और राज्र् सरकार के अन्द्र् जनर्मों और जवजनर्मों के तहत सक्षम प्राजधकारी की पूवा अनुमजत के जबना और संजवधान के अनच्ु छेि 244 के उपबंधों र्ा तत्समर् लागू जवजधर्ों के अनपु ालन के जबना, जिसमें अनुसूजचत िनिाजत और अन्द्र् पारंपठरक वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) िाजमल ह,ै वाजणजज्र्क और औद्योजगक जवकास दरर्ाकलापों के जलए िनिातीर् भूजम के कोई उपर्ोग की अनुमजत नहीं िी िाएगी: परंत ु र्ह भी दक पाठरजस्ट्थजतकी-संवेिी िोन के अधीन आने वाली भूजम के अजभलेखों म ें हुई दकसी त्रुठट को, जनगरानी सजमजत के जवचार प्राि करने के पिात,् राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार सुधारा िाएगा और उि त्रुठट को सुधारने की सचू ना केंद्र सरकार के पर्ाावरण, वन और िलवार् ु पठरवतान मंत्रालर् को िी िाएगी: परंत ु र्ह भी दक उपर्िुा त्रुठट को सुधारन े म,ें इस उप-परै ा म ें र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भ-ू उपर्ोग का पठरवतान सजममजलत नहीं होगा: (ख) अनुप्रर्िु र्ा अनुत्प ािक कृजष क्षेत्रों म ें वनीकरण तथा पर्ाावासों की बहाली के कार्ाकलापों स े पनु : वनीकरण दकए िाने के प्रर्ास दकए िाएगं े। (2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक झरनों के िलग्रहण क्षत्रे ों की पहचान की िाएगी और उनके संरक्षण और पुनरुद्धार की र्ोिनाओं को आंचजलक महार्ोिना म ें सजममजलत दकर्ा िाएगा तथा राज्र् सरकार द्वारा मागाििाक जसद्धांत तैर्ार दकए िाएंगे जिससे इन क्षेत्रों में र्ा इनके आसपास जवकास के ऐसे दरर्ाकलापों पर रोक लगाई िा सके िो इन क्षेत्रों के जलए हाजनकारक हों। (3) पर्टा न र्ा पाठर-पर्टा न – (क) पाठरजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाठर-पर्ाटन दरर्ाकलाप र्ा जवद्यमान पर्ाटन दरर्ाकलापों का जवस्ट्तार पाठरजस्ट्थजतकी संवेिी िोन सबं ंधी पर्ाटन महार्ोिना के अनसु ार होगा। (ख) पर्ाटन महार्ोिना, राज्र् सरकार के पर्ाावरण और वन जवभागों के परामि ासे पर्ाटन जवभाग द्वारा तैर्ार दकर्ा िाएगा; (ग) पर्ाटन महार्ोिना, आंचजलक महार्ोिना का घटक होगी; (घ) पर्ाटन महार्ोिना, पाठरजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी; (ङ) पाठर-पर्ाटन संबंधी दरर्ाकलाप जनमन ानुसार जवजनर्जमत दकए िाएंगे, अथाात:् - (i) र्ोडी राबे सुप्से की सीमा से एक दकमी. के अंिर र्ा पाठरजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी पास हो, होटलों और ठऱिॉटास् के नए जनमााण की अनुमजत नहीं िी िाएगी। बिते दक संरजक्षत क्षेत्र की सीमा से एक दकमी. की िरू ी के बाि स े लेकर पाठरजस्ट्थजतकी संवेिी िोन की सीमा तक नए होटलों और ठऱिॉटास् की स्ट्थापना की अनुमजत आंचजलक महार्ोिना के अनुसार केवल पाठर-पर्ाटन सुजवधाओं के जलए पूवा –पठरभाजषत और नाजमत क्षेत्रों में ही िी िाएगी।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ii) पाठरजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दरर्ाकलापों र्ा मौिूिा पर्ाटन दरर्ाकलापों का जवस्ट्तार केंद्र सरकार द्वारा िारी मागिा िाक जसद्धांतों और राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरणों द्वारा िारी पाठरजस्ट्थजतकी पर्ाटन मागाििाक जसद्धांतों (समर्-समर् पर सिं ोजधत) के अधीन होगा, जिसम ें पाठरजस्ट्थजतकी पर्टा न, पाठरजस्ट्थजतकी जिक्षा और पाठरजस्ट्थजतकी जवकास पर िोर दिर्ा िाएगा; (iii) िब तक इस आंचजलक महार्ोिना को तैर्ार और अनुमोदित नहीं कर दिर्ा िाता तब तक पर्ाटन के जवकास और जवद्यमान पर्ाटन दरर्ाकलापों के जवस्ट्तार की अनुमजत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा स्ट्थल जवजिष्ट िांच और जनगरानी सजमजतर्ों की जसफाठरि के आधार पर िी िाएगी। (4) प्राकृजतक जवरासत – पाठरजस्ट्थजतकी संवेिी िोन के अधीन आने वाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैस े दक िीन पूल ठऱिवा क्षत्रे , िैल सरं चना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एव ं सरं क्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ेंएक जवरासत सरं क्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल - पाठरजस्ट्थजतकी संवेिी िोन म ें ऐजतहाजसक, स्ट्थापत्र्, सौंिर्पा रक और सांस्ट्कृजतक महत्व की इमारतों, संरचनाओं, कलाकृजतर्ों, क्षत्रे और पठरसरों की पहचान की िाएगी और उनके संरक्षण के जलए जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना म ें सजममजलत की िाएगी। (6) ध्व जन प्रिषू ण – पाठरजस्ट्थजतकी संवेिी िोन में ध्वजन प्रिषू ण की रोकथाम और जनर्ंत्रण समर्-समर् पर र्थासंिोजधत ध्वजन प्रिषू ण (जनर्मन और जनर्ंत्रण) जनर्म, 2000 के उपबंधों के अनुसार दकर्ा िाएगा। (7) वार् ु प्रिषू ण- पाठरजस्ट्थजतकी संवेिी िोन में वार्ु प्रिषू ण की रोकथाम और जनर्ंत्रण, समर्-समर् पर र्थासंिोजधत वार्ु (प्रिषू ण जनवारण एवं जनर्त्रं ण) अजधजनर्म, 1981 (1981 का 14) के उपबंधों के अनुसार दकर्ा िाएगा। (8) बजहस्राव का जनस्ट्सरण -पाठरजस्ट्थजतकी-संवेिी िोन म ें उपचाठरत अपजिष्टों का जनवाहन पर्ाावरण (सरं क्षण) अजधजनर्म, 1986 (समर्-समर् पर संिोजधत) के अधीन आन े वाले पर्ाावरण प्रिषू कों के जनवहा न के जलए सामान्द्र् मानकों और उसके अधीन बनाए गए जनर्मों र्ा राज्र् सरकार द्वारा जनधााठरत मानकों, इनमें स े िो भी अजधक किोर हो, के उपबंधों के अधीन होगा। (9) िोस अपजिष्ट - िोस अपजिष्ट का जनपटान एवं प्रबधं न जनम्नानुसार दकर्ा िाएगा. - (क) पाठरजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट जनपटान और प्रबंधन, समर्-समर् पर संिोजधत िोस अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा, जिस े भारत सरकार के पर्ाावरण, वन और िलवार् ु पठरवतना मंत्रालर् द्वारा अजधसूचना संख्र्ा का.आ. 1357(अ), तारीख 8 अप्रलै , 2016 द्वारा प्रकाजित दकर्ा गर्ा ह;ै अकाबाजनक पिाथों का जनपटान पाठरजस्ट्थजतकी संवेिी िोन के बाहर जचजन्द्हत स्ट्थल पर पर्ाावरणीर् अनुकूल तरीके स े दकर्ा िाएगा। (ख) पाठरजस्ट्थजतकी संवेिी िोन में जवजनर्िाष्ट प्रौद्योजगदकर्ों का उपर्ोग करते हुए, जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िोस अपजिष्टों का सुरजक्षत और पर्ाावरण के अनुकूल प्रबंधन (ईएसएम) करने की अनुमजत िी िा सकती ह।ै (10) िवै जचदकत्सा अपजिष्ट. - िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाठरजस्ट्थजतकी-संवेिी िोन में िैव-जचदकत्सा अपजिष्ट का जनपटान, भारत सरकार के पर्ाावरण, वन और िलवार् ु पठरवतान मंत्रालर् द्वारा प्रकाजित अजधसूचना संख्र्ा सा.का.जन.343(अ), तारीख 28 माचा, 2016 समर्-समर् पर र्था संिोजधत िैव-जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के अधीन दकर्ा िाएगा;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (ख) पाठरजस्ट्थजतकी संवेिी िोन में जवजनर्िाष्ट प्रौद्योजगदकर्ों का उपर्ोग करते हुए, जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनकु ूल प्रबंधन (ईएसएम) करन े की अनुमजत िी िा सकती ह।ै (11) प्लाजस्ट्टक अपजिष्ट का प्रबधं न -पाठरजस्ट्थजतकी संवेिी िोन म ें प्लाजस्ट्टक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पठरवतान मंत्रालर् द्वारा प्रकाजित अजधसूचना संख्र्ा सा.का.जन.340(अ), तारीख 18 माचा, 2016, समर्-समर् पर र्थासिं ोजधत प्लाजस्ट्टक अपजिष्ट प्रबधं न जनर्म, 2016 के उपबंधों के अधीन दकर्ा िाएगा; (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न - पाठरजस्ट्थजतकी-सवं ेिी िोन में जनमााण एवं जवध्वंस अपजिष्ट प्रबंधन, भारत सरकार के पर्ाावरण, वन एवं िलवार्ु पठरवतान मंत्रालर् द्वारा प्रकाजित अजधसूचना संख्र्ा सा.का.जन.317(अ), तारीख 29 माचा, 2016, समर्-समर् पर र्थासंिोजधत, जनमाणा एवं जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अधीन दकर्ा िाएगा; (13) ई–अपजिष्ट - पाठरजस्ट्थजतकी संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पठरवतान मंत्रालर् द्वारा प्रकाजित समर्-समर् पर र्थासंिोजधत; ई–अपजिष्ट प्रबधं न जनर्म, 2016, के उपबंधों के अधीन दकर्ा िाएगा। (14) सड़क-र्ातार्ात - सड़क-र्ातार्ात को पर्ाावास अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना म ें जविेष उपाबंध सजममजलत दकए िाएंगे। आंचजलक महार्ोिना के तर्ै ार होने और राज्र् सरकार के सक्षम प्राजधकारी स े अनुमोदित होन े तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके अधीन बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार सड़क-र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन िजनत प्रिषू ण - वाहन िजनत प्रिषू ण की रोकथाम और जनर्ंत्रण लागू जवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईधनों िैसे संपीजड़त प्राकृजतक गैस (सीएनिी), द्रवीकृत पेरोजलर्म गैस (पीएनिी), आदि के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ा ं. -(क) आजधकाठरक रािपत्र म ें इस अजधसचू ना के प्रकािन पर र्ा उसके पिात ् पाठरजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए प्रिषू णकारी उद्योग की स्ट्थापना की अनुमजत नहीं िी िाएगी; (ख) केन्द्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा िनवरी, 2025 में िारी मागाििाक जसद्धान्द्तों में समर्-समर् पर संिोजधत रूप में उजल्लजखत उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाठरजस्ट्थजतकी संवेिी िोन के भीतर केवल गरै -प्रिषू णकारी उद्योगों को अनुमजत िी िाएगी और इसके अजतठरि, गैर प्रिषू णकारी कुटीर उद्योगों का संवधान दकर्ा िाएगा। (17) पहाड़ी ढलानों का सरं क्षण -पहाड़ी ढलानों का संरक्षण जनम्नानसु ार दकर्ा िाएगा :- (क) आंचजलक महार्ोिना म ें पहाड़ी ढलानों के उन क्षेत्रों को ििार्ा ा िाएगा जिनम ें दकसी भी जनमााण की अनुज्ञा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खड़ी पहाड़ी ढलानों म ें अत्र्जधक भू-क्षरण होता ह ै उनम ें दकसी भी जनमाणा की अनुज्ञा नहीं होगी। 4. पाठरजस्ट्थजतकी सवं िे ी िोन म ेंप्रजतजषद्ध र्ा जवजनर्जमत दकए िान ेवाल ेदरर्ाकलापों की सचू ी- र्ोडी राबे सूप्से अभर्ारण्र् के पाठरजस्ट्थजतकी संवेिी िोन में सभी दरर्ाकलाप पर्ाावरण (सरं क्षण) अजधजनर्म, 1986 (1986 का 29), वन्द्र्िीव (सरं क्षण) अजधजनर्म, 1972 (1972 का 53), वन अजधजनर्म, 1927 (1927 का 16), वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69) तथा अन्द्र् लाग ू जवजधर्ों, जिनम ें तटीर् जवजनर्मन क्षेत्र (सीआरिडे ), 2011, पर्ाावरण प्रभाव आकलन (ईआईए) अजधसूचना, 2006, तथा उनमें दकए गए संिोधन और राज्र् में प्रचजलत अन्द्र् अजधजनर्मों सजहत अन्द्र् लाग ू जवजधर्ों के उपाबंधों द्वारा िाजसत होंग।े पाठरजस्ट्थजतकी संवेिी िोन के अधीन आने वाले वन क्षेत्र मौिूिा वन जवजधर्ों तथा उनमें दकए गए संिोधनों के अधीन ही संचाजलत होता8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] रहगे ा। इस अनुच्छेि के उपाबंधों के अधीन रहत े हुए, पाठरजस्ट्थजतकी संवेिी िोन म ें दरर्ाकलापों का जवजनर्मन नीच े िी गई सारणी म ेंजवजनर्िाष्ट प्रकार से दकर्ा िाएगा, अथाात:् - सारणी रम स.ं दरर्ाकलाप ठटप्पजणर्ा ं (1) (2) (3) क. प्रजतजषद्ध दरर्ाकलाप 1. वा जणजज्र्क खनन, पत्थर उत्खनन, (क) पाठरजस्ट्थजतकी-संवेिी ़िोन के भीतर घरों के जनमााण र्ा और रलिंग इकाइर्ां । मरममत के जलए जमट्टी की खुिाई सजहत वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेलू आवश्र्कताओं को पूरा करने के जसवार् सभी नए और जवद्यमान (लघ ु और प्रमुख खजनि), पत्थर उत्खनन और रलिंग इकाइर्ों को तत्काल प्रभाव से प्रजतजषद्ध ह।ै (ख) खनन कार्ा माननीर् उच्चतम न्द्र्ार्ालर् के दिनांक 4 अगस्ट्त, 2006 के आििे (टी.एन. गोिावमान जथरुमलु पाि बनाम भारत संघ के मामल े में, ठरट र्ाजचका संख्र्ा 202/1995) और तारीख 21 अप्रलै , 2014 के आिेि (गोवा फाउंडेिन बनाम भारत सघं के मामले म,ें लोकजहत र्ाजचका संख्र्ा 435/2012); और आईए संख्र्ा 1000 वषा 2003 तारीख 03 िून, 2022। आईए संख्र्ा 131377 वषा 2022, तारीख 26 अप्रलै , 2023 और 28 अप्रलै , 2023 के जनणार् और आईए संख्र्ा 162023, 162034, 162154 और 162155 वष ा 2025 में तारीख 23 िुलाई 2025 के बाि के जनणार् र्ा खनन के संबंध में कोई और आिेि के अनुसार दकए िाएगं े। 2. प्रि षू ण (िल, वार्,ु मृिा, ध्वजन, आदि) पाठरजस्ट्थजतकी-संवेिी ़िोन म ें नए प्रिषू णकारी उद्योगों की उत्पन्न करन े वाल ेउद्योगों की स्ट्थापना । स्ट्थापना और जवद्यमान प्रिषू णकारी उद्योगों के जवस्ट्तार की अनुमजत नहीं िी िाएगी। बिते दक, केंद्रीर् प्रिषू ण जनर्त्रं ण बोड ा द्वारा िनवरी 2025 म ें िारी मागाििाक जसद्धांतों में उद्योगों के वगीकरण के अनुसार, समर्-समर् पर संिोजधत रूप में पाठरजस्ट्थजतकी-संवेिी ़िोन के भीतर गरै -प्रिषू णकारी उद्योगों को अनुमजत िी िाएगी, िब तक दक इस अजधसूचना में अन्द्र्था जनर्िाष्ट न दकर्ा गर्ा हो, और इसके अजतठरि, गैर-प्रिषू णकारी कुटीर उद्योगों का संवधान िाएगा। 3. प्रम ुख िलजवद्युत पठरर्ोिनाओं की प्रजतजषद्ध। स्ट्थापना। 4. दक सी पठरसंकटमर् पिाथा का प्रर्ोग र्ा प्रजतजषद्ध। उत्पािन र्ा प्रस्ट्संकरण । 5. प्रा कृजतक िल जनकार्ों र्ा भूजम क्षेत्र म ें प्रजतजषद्ध। अनुपचाठरत अपजिष्टों को प्रवाजहत करना। 6. िोस अपजिष्ट जनपटान स्ट्थल और िोस पाठरजस्ट्थजतकी-संवेिी ़िोन के भीतर दकसी भी प्रकार के िोस एवं िैव जचदकत्सा अपजिष्ट के जलए अपजिष्ट जनपटान स्ट्थल और िोस अपजिष्ट उपचार/प्रसंस्ट्करण संर्ुि भस्ट्मीकरण सुजवधा की स्ट्थापना। सुजवधा की अनुमजत नहीं ह।ै इसके अलावा, औद्योजगक प्रदरर्ाओं[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 और स्ट्वास्ट््र् संस्ट्थानों/अस्ट्पतालों आदि से उत्पन्न दकसी भी प्रकार के िोस अपजिष्ट के उपचार के जलए संर्ुि र्ा व्यजिगत भस्ट्मीकरण सुजवधा की स्ट्थापना प्रजतजषद्ध ह।ै 7. फम ों, कंपजनर्ों, कॉरपोरेट्स द्वारा बड़ े प्रजतजषद्ध। पैमाने पर वाजणजज्र्क पिधु न और कुक्कुट फामों इत्र्ादि की स्ट्थापना। 8. पर् ाटन से संबंजधत अन्द्र् दरर्ाकलापों प्रजतजषद्ध। िैसे दक संरजक्षत क्षेत्र और उसके पाठरजस्ट्थजतकी संवेिी िोन के ऊपर गम ा हवा के गब्ु बारे, हले ीकॉप्टर, ड्रोन, माइरोलाइट और अन्द्र् जवमानों आदि द्वारा उड़ान भरना। 9. नई आरा जमलों की स्ट्थापना। पाठरजस्ट्थजतकी-संवेिी िोन के भीतर नई र्ा जवद्यमान आरा जमलों के जवस्ट्तार की अनुमजत नहीं होगी । 10. ईंट भट्टों की स्ट्थापना। प्रजतजषद्ध। ख.जवजनर्जमत दरर्ाकलाप 11. वा जणजज्र्क होटलों और ठरसॉट्सा की पाठरजस्ट्थजतकी पर्ाटन दरर्ाकलापों के जलए लघ ु अस्ट्थार्ी स्ट्थापना। संरचनाओं के जनमााण के जसवार्, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाठरजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनम ें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ठरसोटो की स्ट्थापना की अनुमजत नहीं होगी : बिते, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर बाहर र्ा पाठरजस्ट्थजतकी-संवेिी िोन के जवस्ट्तार तक, इनमें िो भी अजधक जनकट हो, सभी नए पर्ाटन दरर्ाकलाप र्ा जवद्यमान दरर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना और र्था लाग ू मागाििाक जसद्धांतों के अनरूु प होगा । 12. संज नमााण दरर्ाकलाप। (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाठरजस्ट्थजतकी-संवेिी िोन के जवस्ट्तार तक, िो भी जनकट हो, दकसी भी प्रकार के नए वाजणजज्र्क संजनमााण की अनुमजत नहीं होगी : (ख) बित,े स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने के जलए भवन उपजवजधर्ों के अनुसार पैराग्राफ 3 के उप-पैरा (1) में उजल्लजखत दरर्ाकलापों सजहत स्ट्थानीर् लोगों को उनके उपर्ोग के जलए अपनी भूजम पर संजनमााण करन े की अनुमजत िी िाएगी, (i) जवद्यमान सड़कों को चौड़ा करना, उन्द्ह ें सुिढ़ृ करना और नई सड़कों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागठरक सुजवधाओं का सजन्नमााण और नवीनीकरण; (iii) प्रिषू ण उत्पन्न न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योग एव ं ग्राम उद्योग; पाठरजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] वास; और (v) इस अजधसूचना म ें र्था उजल्लजखत संवर्धात दरर्ाकलाप। बिते र्ह दक, गैर प्रिषू णकारी लघु उद्योगों से संबंजधत संजनमााण दरर्ाकलाप लाग ू जनर्मों और जवजनर्मों, र्दि कोई हो, के अनुसार सक्षम प्राजधकारी की पूवा अनुज्ञा से जवजनर्जमत दकए िाएंगे और व ेन्द्र्ूनतम होंगे। (ग) एक दकलोमीटर के परे र्े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे। 13. गैर प्रिषू णकारी लघ ु उद्योग। िनवरी, 2025 में केन्द्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा द्वारा िारी और समर्-समर् पर संिोजधत उद्योगों के वगीकरण के अनुसार गैर- प्रिषू णकारी उद्योग और अपठरसंकटमर्, लघु और सेवा उद्योग, कृजष, पुष्प कृजष, उद्यान कृजष र्ा पाठरजस्ट्थजतकी संवेिी िोन की अपनी सामग्री स े उत्पािों को उत्पन्न करन े वाल े कृजष आधाठरत उद्योग सक्षम प्राजधकारी द्वारा अनुमत होंगे। 14. वृक्ष ों की कटाई । (क) राज्र् सरकार में सक्षम प्राजधकारी की पूवा अनुज्ञा के जबना वन र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं की िाएगी। (ख) वृक्षों की कटाई समबद्ध केंद्रीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगें। 15. वन उत्पािों और गैर काष्ठ वन उत्पािों अनुसूजचत िनिाजत और अन्द्र् पारंपठरक वनवाजसर्ों [वन (एनटीएफपी) का सग्रं हण। अजधकार मान्द्र्ता] अजधजनर्म, 2006 के अनुसार जवजनर्जमत। 16. जव द्युत और संचार टॉवर लगाने, तार- लाग ू जवजधर्ों के अधीन जवजनर्जमत होगा (भूजमगत केबल जबछाने तथा अन्द्र् बुजनर्ािी ढांचे की जबछाने को बढ़ावा दिर्ा to the e-mail address of the Ministry at esz-mef@nic.in DRAFT NOTIFICATION WHEREAS, the Yordi Rabe Supse Wildlife Sanctuary is spread across 28°08′10.68″N to 28°25′21.43″N latitude and 94°22′35.07″E to 94°31′36.00″E longitude. It is located in the Along Forest Division, West Siang district of Arunachal Pradesh. The Sanctuary covers an area of 397 sq. km. The wildlife sanctuary was declared vide Gazette Notification CWL/D/33/96/1451-91, dated 4th June 2007; AND WHEREAS, the Yordi Rabe Supse Wildlife Sanctuary has a wide range of altitudinal variation from tropical to sub temperate and semi-evergreen forest types which holds its unique biodiversity and aquatic life. The flora and fauna represent rich biological significance of this Sanctuary; AND WHEREAS, the major flora in Yordi Rabe Supse Wildlife Sanctuary includes Terminalia myriocarpa, Ficus semicordata, Ficus auriculata, Macaranga denticalate, Macaranga indica, Macaranga denticulata, Mallotus roxburghianus, Altingia excels, Amoora wallichii, Ailanthus grandis, Cinnamomum sp. Magnolia sp., Canarium resiniferum, Termitmlia bellerica, Terminalia chebula, Tetracera sarmentosa, Bambax ceiba, Sterculia viilosa, Castanopsis indicam, Castanopsis tribuloides, Bischofia javanica, Albizzia lucida, Syzygium cuminii, Mesua ferrea, Dillenia indica, Kydia calycina, Artocarpus chaplasa. Important Bamboo species include Dendrocalamus hamiltonii, Pseudostachyum polymorphum. Cane species include Calamus floribundus. Important palm species include Livistona jenkinsiana; AND WHEREAS, the major fauna in Yordi Rabe Supse Wildlife Sanctuary includes Elephas maximus, Panthera tigris, Panthera pardus, Netfelis nebubsa, Ursus thibetanus, Macaca assamersis, Trachypithecus pileatus, Cervus unicolor, Muntiacus muntjak, Naemorhedus goral, Sus scrofa, Cuon alpines etc.; AND WHEREAS, the major avifauna in Yordi Rabe Supse Wildlife Sanctuary includes Babblers, Eagles, Flycatchers, Junglefowl, Kingfishers, Laughing thrushes, Minvits, etc.; AND WHEREAS, the important amphibian species in Yordi Rabe Supse Wildlife Sanctuary includes frogs such as Bufo sp. and Duttaphrynus sp.;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 AND WHEREAS, the important fish species in Yordi Rabe Supse Wildlife Sanctuary includes Danio sp., Barilus sp., Semiplotus sp., Puntius sp., Tor sp., Chagunius sp., Garra sp., Neomacheilus sp., and Glyptothorax sp.; AND WHEREAS, the important butterfly species in Yordi Rabe Supse Wildlife Sanctuary includes from the family of Endromidae and Eupterotidae; AND WHEREAS, the major reptile species in Yordi Rabe Supse Wildlife Sanctuary includes Calotes sp., Japalura sp. Hemidactylus sp., Varanus sp. etc.; Skinks such as Eutrophis sp., Lygosoma sp.; Snakes such as Ramphotyphlops sp., Python sp., Ahaetulla sp., Amphiesma sp., Bungarus sp., Naja sp., Ophiophagus sp.; Tortoises such as Cuora sp., Pangshura sp.; AND WHEREAS, it is necessary to conserve and protect the area, surrounding the boundaries of Yordi Rabe Supse Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub section (l) and clauses (v) and (xiv) of subsection (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an Eco-Sensitive Zone around the boundary of Yordi Rabe Supse Wildlife Sanctuary of Arunachal Pradesh (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of the Eco-Sensitive Zone. – (1) The Eco-Sensitive Zone varies from zero to 1 km, encompassing an area of 39.17 sq. km around the Sanctuary. The Extent of Eco-Sensitive Zone in different directions is given below: - Direction Extent in Km North-West 1 North 1 North-East 0.1 East 0.1 South-East 0.1 South 0 South-West 0 West 0 Justification for zero ESZ: ➢ The South-Western & Western boundary of the sanctuary coincides with the administrative boundary of West Siang and Upper Subansiri districts, which is also the Western boundary of Along Forest Division. As Along Forest Division does not have any jurisdiction beyond the western boundary of the sanctuary, as such no Eco-sensitive zone could be proposed. Moreover, the area is characterized by steep gradients and peaks which act as a buffer zone and as natural barrier to any anthropogenic disturbances inside the sanctuary area.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ➢ The southern portion of the sanctuary is excluded on the request of the local people due to the presence of habitations and agricultural lands. (2) The map of the Yordi Rabe Supse Wildlife Sanctuary and its Eco-sensitive Zone is appended as Annexure- IA and Annexure-IB. (3) The boundary description of Yordi Rabe Supse Wildlife Sanctuary and its Eco-Sensitive Zone is appended as Annexure- IIA and Annexure- IIB. (4) The geo-coordinates of the prominent locations of Yordi Rabe Supse Wildlife Sanctuary and its Eco- Sensitive Zone mentioned at Table A and B is appended as Annexure-III. (5) There are no villages falling in Eco-Sensitive Zone. 2. Zonal Master Plan for Eco-Sensitive Zone.– (1) The State Government shall, for the purposes of the Eco-Sensitive Zone, prepare a Zonal Master Plan within two years from the date of publication of this notification in the Official Gazette, in consultation with local people and in conformity to the provisions of this notification. (2) The Zonal Master Plan for the Eco-Sensitive Zone shall be prepared by the State Government in accordance with the provisions of this notification and in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan: - i. Environment; ii. Forest and Wildlife; iii. Agriculture; iv. Revenue; v. Urban Development; vi. Tourism; vii. Rural Development; viii. Irrigation and Flood Control; ix. Municipal; x. Panchayati Raj; xi. Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure, and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks and it’s like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-Sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and ensure and promote eco-friendly development for security of local community’s livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 25 (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government. – The State Government shall take the following measures for giving effect to the provisions of this notification, namely: (1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-Sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities. Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-Sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as: i. Widening and strengthening of existing roads and construction of new roads; ii. Construction and renovation of infrastructure and civic amenities; iii. Small scale industries not causing pollution; iv. Cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including home stay; and v. Promoted activities and given under paragraph 4. Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007); Provided also that any error appearing in the land records within the Eco-Sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.– The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.– (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-Sensitive Zone; a) the Tourism Master Plan shall be prepared by the Department of Tourism in consultation with the Departments of Environment and Forests of the State Government; b) the Tourism Master Plan shall form a component of the Zonal Master Plan; c) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco- Sensitive Zone; d) the activities of eco-tourism shall be regulated as under, namely: - i. No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Yordi Rabe Supse Wildlife Sanctuary or up to the extent of the Eco-Sensitive Zone whichever is nearer:26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Provided that beyond the distance of the 1 km from the boundaries of the protected area till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in predefined and designated areas for eco-tourism facilities as per Tourism Master Plan; ii. all new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be in accordance with the guidelines issued by the Central Government and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; iii. until the Zonal Master Plan is prepared and approved, development for tourism and expansion of existing tourism activities shall be permitted by the regulatory authorities concerned based on the actual site-specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage.– All sites of valuable natural heritage in the Eco-Sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.– Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-Sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. – Prevention and control of noise pollution in the Eco-Sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 and as amended from time to time. (7) Air pollution.– Prevention and control of air pollution in the Eco-Sensitive Zone shall be complied in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and as amended from time to time. (8) Discharge of effluents. – Discharge of treated effluents in Eco-Sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 (as amended from time to time) and rules made there under or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.– Disposal and Management of solid wastes shall be as under- a. the solid waste disposal and management in the Eco-Sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357(E), dated the 8th April, 2016 and as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-Sensitive Zone; b. Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco- Sensitive Zone. (10) Bio-medical waste.– Bio medical waste management shall be as under: a) The bio-medical waste disposal in the Eco-Sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343(E), dated the 28th March, 2016; as amended from time to time.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27 b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (11) Plastic waste management. – The Plastic Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management. – The Construction and Demolition Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317(E) , dated the 29th March, 2016 as amended from time to time. (13) E-waste. – The E-Waste Management in the Eco-Sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate change and as amended from time to time. (14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.– Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel such as CNG, LPG, etc. (16) Industrial units.– a) No new polluting industries shall be allowed to be set up within the Eco-Sensitive Zone on or after the publication of this notification in the Official Gazette, b) Only non-polluting industries shall be allowed within the Eco-Sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in January 2025, as amended from time to time, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.– The protection of hill slopes shall be as under: (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) Construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within the Eco-Sensitive Zone.– All activities in the Eco-Sensitive Zone of Yordi Rabe Supse Sanctuary shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986), Wildlife (Protection) Act, 1972 (53 of 1972), Forest Act, 1927 (16 of 1927), Forest (Conservation) Act, 1980 (69 of 1980) and other applicable laws including the Coastal Regulation Zone (CRZ), 2011, Environmental Impact Assessment (EIA) Notification, 2006, and amendments made thereto and other Acts prevalent in the State. The forest area coming under the Eco- sensitive Zone will remain to be governed under existing forest laws and amendments made thereto. Subject to the provisions of this paragraph, the activities in the Eco-sensitive Zone shall be regulated in manner specified in the Table below, namely:-28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] TABLE S No Activity Description (1) (2) (3) A. IA No. 131377 of 2022, judgment dated the 26th April, 2023 and the 28th April, 2023 and subsequent judgment dated the 23rd July 2025 in I.A Nos. 162023, 162034, 162154 and 162155 of 2025 or any further orders regarding mining. 2. Setting of industries causing New industries and expansion of existing polluting industries pollution (Water, Air, Soil, Noise, in the Eco-Sensitive Zone shall not be permitted: etc.). Provided that, non-polluting industries shall be allowed within Eco-Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in January, 2025, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted. 3. Establishment of major Prohibited. hydroelectric project. 4. Use, production, or processing of Prohibited. any hazardous substances. 5. Discharge of untreated effluents Prohibited. in natural water bodies or land area. 6. Establishment of Solid Waste No Solid Waste disposal site and waste treatment/ processing disposal site and common facility of solid waste are permitted within Eco-Sensitive incineration facility for solid and Zone. Further installation of common or individual bio medical waste. incineration facility for treatment of any form of solid waste generated from industrial process and health establishment/hospital etc. is prohibited. 7. Commercial establishment of No new commercial hotels and resorts shall be permitted hotels and resorts within one kilometer of the boundary of the protected area or up to the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities; Provided that, beyond one kilometer from the boundary of the protected area or up to the extent of Eco- Sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. 12. Construction activities (a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the protected area or up to the extent of the Eco-Sensitive Zone, whichever is nearer; (b) Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents such as: i. Widening and strengthening of existing roads and construction of new roads; ii. Construction and renovation of infrastructure and civic amenities; iii. Small scale industries not causing pollution; iv. Cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including home stay; and v. Promoted activities listed in this notification. Provided that, the construction activity related to small-scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any; (c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan. 13. Monitoring Committee.– The Central Government herby constitutes a Monitoring Committee, for effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely:- S. (3) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September 2006, and are falling in Eco-sensitive Zone, except for the prohibited activities as specified in the table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in Eco-sensitive Zone, except for the prohibited activities as specified in the table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authority. (5) The Member Secretary of Monitoring Committee shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments or representative from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the state as per pro-forma given Annexure-VI, appended to this notification. (8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such direction, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures.– The Central Government and State Government may specify additional measures, if any, for giving effect to the provisions of this notification.
