िनसाधारण की िानकारी के जलए प्रकाजित दकर्ा िाता ह ै जिनके उसस े प्रभाजवत होने की संभावना ह,ै और र्ह सूजचत दकर्ा िाता ह ै दक उि प्रारूप अजधसूचना पर, उस तारीख स,े जिसको इस अजधसूचना को अंतर्वाष्ट करन े प्रारूप अजधसचू ना रालामंडल वन्द्र्िीव अभर्ारण्र् मध्र् प्रिेि के इंिौर जिले के इंिौर वन संभाग में इंिौर िहर स े लगभग 12 दकलोमीटर की िरू ी पर जस्ट्थत ह ै और 2.34550 वगा दकलोमीटर के कुल क्षेत्रफल के साथ कम्पाटामेंट संख्र्ा आर-260 म ें जस्ट्थत ह।ै र्ह अभर्ारण्र् 1989 म ें मध्र् प्रििे अजधसूचना स.ं 14-20-10-2-88 तारीख 09 फरवरी, 1989 म ें घोजित दकर्ा गर्ा था। र्ह क्षत्रे तीन िोनों क्रमि: वन्द्र्िीव िोन (152.550 हक्े टेर्र), पर्ाटन िोन (55.000 हक्े टेर्र) और जडर्र सफारी िोन (27.000 हक्े टेर्र) म ें वगीकृत ह।ै ऐजतहाजसक रूप स े रालामंडल महारािा जिवािी राव होल्कर के द्वारा क्रीडा अभर्ारण्र् के रूप म ें उपर्ोग दकर्ा िाता था। 1905 म,ें जिकारगाह का जनमााण दकर्ा गर्ा था और इसका उपर्ोग होल्कर महारािाओं द्वारा दकर्ा िाता था। र्ह समुर के औसत िल स्ट्तर स े 2608 फीट की ऊंचाई पर और अभर्ारण्र् के मुख्र् प्रवेि द्वार स े2.5 दकलोमीटर की िरू ी पर जस्ट्थत ह;ै और, रालामंडल वन्द्र्िीव अभर्ारण्र् म ें लगभग 28 चीतल, 19 ब्लैकबक, 42 नीलगार्, 5 भेिकी, 11 लकड़बग्घो और 10 लोमड़ी अजभजलजखत की गई ह।ै इसके अलावा, अभर्ारण्र् क्षत्रे ,जिसका जवस्ट्तार और सीमाए ं इस अजधसूचना के पैराग्राफ 1 म ें जवजनर्िष्टा ह ैं ,को पाररजस्ट्थजतकीर्, पर्ाावरणीर् और िैव-जवजवधता की िजृ ष्ट स े पाररजस्ट्थजतकी संवेिी िोन के रूप म ेंसुरजक्षत और सरं जक्षत करना तथा उि पाररजस्ट्थजतकी संवेिी िोन म ेंउद्योगों र्ा उद्योगों की श्रेजणर्ों के प्रचालन तथा प्रसंस्ट्करण को प्रजतजिद्ध करना आवश्र्क ह;ै अतः अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्मावली, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) जिसे)इस अजधसूचना म ें इसके पश्चात ् पर्ाावरण अजधजनर्म कहा गर्ा ह(ै की उपधारा (1) तथा धारा 3 की उपधारा) 2( के खंड (v) और खंड (xiv) एव ं उपधारा (3) के द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, मध्र् प्रििे राज्र् के इंिौर जिले म ें रालामंडल वन्द्र्िीव अभर्ारण्र् की सीमा के चारों ओर 0.100 दकलोमीटर तक के जवस्ट्ताररत क्षत्रे को पाररजस्ट्थजतकी संवेिी िोन जिसे) इसम ें इसके पश् चात् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह ै(के रूप म ेंअजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात ् :- 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमाए.ं - (1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार रालामंडल वन्द्र्िीव अभर्ारण्र् की सीमा के चारों ओर 0.100 दकलोमीटर तक जवस्ट्तृत ह ै और पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल 0.810 वगा दकलोमीटर ह।ै इस े राज्र् सरकार के द्वारा उजचत िहरार्ा गर्ा ह ै दक “इंिौर जवकास र्ोिना 2021 के अनुसार, जवकास र्ोिना म ेंमुंडला नर्ता, सानावाजडर्ा, जमिाापुर, रालामंडल ग्राम िाजमल थ ेऔर रालामंडल अभर्ारण्र् के पाररजस्ट्थजतकी संवेिी िोन के आसपास आवासीर् क्षत्रे को जसफा 100 मीटर की िरूी तक रखा गर्ा था।” (2) रालामंडल वन्द्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण अनलु ग्नक-I के रूप म ें संलग्न ह।ै (3) सीमा जववरण और अक्षािं ों और िेिांतरों सजहत पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करते हुए रालामंडल वन्द्र्िीव अभर्ारण्र् के मानजचत्र अनलु ग्नक–IIक और अनलु ग्नक –IIख के रूप म ें सलं ग्न ह।ै (4) रालामंडल वन्द्र्िीव अभर्ारण्र् और पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू- जनिेिाकं ों की सूची अनलु ग्नक-III की सारणी क और सारणी ख म ें िी गई ह।ै (5) मुख्र् लबंिओंु के भू-जनिेिांकों के साथ पाररजस्ट्थजतकी संवेिी िोन के अतं गता आन े वाले ग्रामों की सूची अनलु ग्नक –IV के रूप म ेंसंलग्न ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना.– (1) राज्र् सरकार ,द्वारा पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिन के जलए, रािपत्र म ें अंजतम अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामि ा स े और इस अजधसूचना म ें दिए गए अनुबंधों का पालन करत े हुए, राज्र् सरकार के सक्षम प्राजधकारी के अनुमोिनाथ ा एक आंचजलक महार्ोिना बनाई िार्ेगी और राज्र् म ें सक्षम प्राजधकारी द्वारा जवजधवत अनुमोदित दकर्ा िाएगा । (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसूचना म ें जवजनर्िष्ा ट रीजत स े तथा प्रासंजगक केंरीर् और राज्र् जवजधर्ों के अनुरूप तथा केंरीर् सरकार द्वारा िारी दििा जनििे ों ,र्दि कोई हों ,के अनुसार बनार्ी िाएगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (3) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी और पर्ाावरण सबं ंधी सरोकारों को िाजमल करने के जलए इस े राज्र् सरकार के जनम्नजलजखत जवभागों के परामिा स े बनार्ा िाएगा ,अथाात-् : (i) पर्ाावरण; (ii) वन और वन्द्र्िीव; (iii) कृजि; (iv) रािस्ट्व; (v) िहरी जवकास; (vi) पर्ाटन; (vii) ग्रामीण जवकास; (viii) लसंचाई और बाढ़ जनर्ंत्रण; (ix) नगरपाजलका; (x) पंचार्ती राि; (xi) मध्र् प्रिेि राज्र् प्रििू ण जनर्ंत्रण बोडा; और (xii) लोक जन मााण जव भाग। (4) िब तक इस अजधसूचना में जवजनर्िष्टा न हो, आंचजलक महार्ोिना म ें वतामान म ें अनमु ोदित भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा तथा आचंजलक महार्ोिना म ें सभी अवसंरचनाओं और दक्रर्ाकलापों म ें सुधार करके उन्द्ह े अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनान े की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना म ें वनरजहत और अवक्रजमत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, िलग्रहण क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी एव ं पर्ाावरण के ऐसे अन्द्र् पहलओंु की व्यवस्ट्था की िाएगी जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै (6) आंचजलक महार्ोिना म ें सहार्क मानजचत्रों के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्रामों एव ं िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों एव ं दकस्ट् मों, कृजि क्षेत्रों, ऊपिाऊ भूजम, उद्यानों एवं उद्यानों की तरह के हररत क्षत्रे ों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा के साथ जनधाारण दकर्ा िाएगा और र्ोिना म ें मौिूिा और प्रस्ट्ताजवत भ-ू उपर्ोग की जविेिताओं का ब्र्ौरा िते े हुए मानजचत्रों को भी ििाार्ा िाएगा। (7) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी संवेिी िोन म ेंजवकासात्मक दक्रर्ाकलापों को जवजनर्जमत करन े के जलए प्रदक्रर्ा प्रिान की िाएगी और सारणी म ें र्थासूचीबद्ध पैराग्राफ 4 में प्रजतजिद्ध एव ं जवजनर्जमत दक्रर्ाकलापों का पालन दकर्ा िाएगा। इसम ें स्ट् थानीर् िनता की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनश्चर् एव ं संवधान दकर्ा िाएगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) राज्र् सरकार द्वारा अनुमोदित आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक संिभा िस्ट्तावेि होगी तादक वह इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपन े कतव्या ों का जनवाहन कर सके। 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्:- (1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खलु े स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा संपररवतान अनुमत नहीं दकर्ा िाएगा:[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 परंतु पाररजस्ट्थजतकी संवेिी िोन के भीतर ऊपर भाग (क), में जवजनर्िष्टा प्रर्ोिन स े जभन्न प्रर्ोिन के जलए कृजि और अन्द्र् भूजम का संपररवतान, जनगरानी सजमजत की जसफाररि पर और सक्षम प्राजधकारी के पूवा अनमु ोिन स े क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा र्था लाग ू केन्द्रीर् सरकार एव ं राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन तथा इस अजधसूचना के उपबंधों के अनुसार स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् िरूरतों को पूरा करन े के जलए अनुमत दकर्ा िाएगा िैसे:- (i) जवद्यमान सड़कों को चौड़ा करना, उन्द्ह ेंसुिढ़ृ करना और नई सड़कों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रििू ण उत्पन्न न करन े वाले लघ ु उद्योग; (iv) कुटीर उद्योग एव ं ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार और स्ट्थानीर् सुजवधाए ं तथा गृह वास; और (v) पैराग्राफ-4 म ें उजल्लजखत बढ़ावा दिए गए दक्रर्ाकलापः परंत ु र्ह भी दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना तथा राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों एव ं संजवधान के अनच्ु छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगात अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का प्रर्ोग अनुमत नहीं होगा: परंत ु र्ह भी दक पाररजस्ट्थ जतकी संवेिी िोन के अतं गता आने वाली भूजम के अजभलेखों म ें हुई दकसी त्रुरट को, जनगरानी सजमजत के जवचार प्राि करने के पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार सुधारा िाएगा और उि त्रुरट को सुधारने की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह भी दक उपर्ुाि त्रुरट को सुधारन े म,ें इस उप-पैरा म ें र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भ-ू उपर्ोग का पररवतान िाजमल नहीं होगा। (ख) अनुप्रर्िु र्ा अनुत्प ािक कृजि क्षेत्रों म ें वनीकरण तथा पर्ावा ासों की बहाली के कार्ाकलापों स े पुन: वनीकरण के प्रर्ास दकए िाएंगे। (2) प्राकृजतक िल जनकार्.- सभी प्राकृजतक िलमागों के िलग्रहण क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना म ें उनके संरक्षण और बहाली की र्ोिना सजम् मजलत की िाएगी और राज्र् सरकार द्वारा दििा-जनिेि इस रीजत स े तैर्ार दकए िाएंगे दक उसम ें ऐस ेक्षेत्रों म ें र्ा उसके पास जवकास दक्रर्ाकलापों को प्रजतजिद्ध और जनबंजधत दकर्ा गर्ा हो। (3) पर्टा न एव ं पाररजस्ट्थजतकी पर्टा न.– (क) पाररजस्ट्थजतकी सवं ेिी िोन म ें सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन संबंधी पर्ाटन महार्ोिना के अनुसार अनुमत होगा; (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् सरकार के पर्ाावरण और वन जवभाग के परामिा स े पर्ाटन जवभाग द्वारा बनार्ी िाएगी; (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का घटक होगी; (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तैर्ार की िार्ेगी; (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनम्न ानुसार जवजनर्जमत दकए िाएंग े,अथाात-् : (i) संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक ,इनम ें िो भी अजधक जनकट हो ,दकसी होटल र्ा ररिॉटा का नर्ा सजन्नमााण अनुमत नहीं दकर्ा िाएगाः6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंत ु र्ह ,पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर की िरू ी स े परे पाररजस्ट्थजतकी संवेिी िोन की सीमा तक पूवा पररभाजित और अभीजहत क्षेत्रों म ें पर्टा न महार्ोिना के अनुसार, नए होटलों और ररिॉटा की स्ट्थापना अनुमत होगी; (ii) पाररजस्ट्थजतकी संवेिी िोन के अन्द्िर सभी नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्टा न दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा िारी दििाजनिेिों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेने वाल े राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी दििाजनिेिों (समर्-समर् पर र्था सिं ोजधत) के अनुसार होगा; (iii) आंचजलक महार्ोिना का अनुमोिन होन े तक, पर्ाटन के जवकास और जवद्यमान पर्टा न दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा जनगरानी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमत दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन म ें दकसी नए होटल/ ररिॉट ा र्ा वाजणजज्र्क प्रजतष्ठान का संजन्नमााण अनुमत नहीं होगा । (4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन के अंतगता आने वाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैस े दक िीन पलू ररिवा क्षत्रे , िैल संरचना, िल प्रपात, झरन,े िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मात जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (6) ध् वजन प्रििू ण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रििू ण (जवजनर्मन और जनर्त्रं ण) जनर्म, 2000 म ें जनर्त उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन म ेंध्वजन प्रििू ण की रोकथाम और जनर्ंत्रण दकर्ा िाएगा । (7) वार् ु प्रििू ण.- पाररजस्ट्थजतकी संवेिी िोन म,ें वार् ु प्रििू ण का जनवारण और जनर्ंत्रण, वार् ु (प्रििू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा । (8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत बजहस्राव का जनस्ट्सरण, पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आने वाले पर्ाावरणीर् प्रििू ण के जनस्ट्सरण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक किोर हो, के उपबंधों के अनुसार होगा। (9) िोस अपजिष्ट.- िोस अपजिष्ट का जनपटान एव ं प्रबन्द्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट का जनपटान और प्रबधं न भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना स.ं का.आ. 1357(अ), दिनांक 8 अप्रैल, 2016 के तहत प्रकाजित िोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन स े बाहर जचजन्द्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत स े दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन (ईएसएम) अनुमत दकर्ा िार्ेगा। (10) िैव जचदकत्सा अपजिष्ट.- िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना स.ं सा.का.जन 343 (अ), तारीख 28 माच,ा 2016 के तहत प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनरूु प िैव जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुमत दकर्ा िार्ेगा। (11) सलाजस्ट्टक अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन म ें सलाजस्ट्टक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना स.ं सा.का.जन 340(अ), तारीख 18 माच,ा 2016 के तहत प्रकाजित सलाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबधं ो के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन म ें जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना स.ं सा.का.जन 317(अ), तारीख 29 माच,ा 2016 के तहत प्रकाजित संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित तथा समर्-समर् पर र्था संिोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) सड़क-र्ातार्ात.- सड़क-र्ातार्ात को पर्ाावास-अनुकूल तरीके स े जवजनर्जमत दकर्ा िाएगा और इस संबंध म ें आंचजलक महार्ोिना म ें जवििे उपबंध िाजमल दकए िाएंग।े आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी स े अनुमोदित होने तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके तहत बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार सड़क-र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन िजनत प्रििू ण.- वाहन िजनत प्रििू ण की रोकथाम और जनर्ंत्रण लाग ू जवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएगं े । (16) औद्योजगक ईकाइर्ा.ं- (क) रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पश्चात पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रििू णकारी उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी; (ख) केन्द्रीर् प्रििू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 म ें िारी समर्-समर् पर र्था सिं ोजधत मागाििाक जसद्धान्द्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें इस प्रकार जवजनर्िष्टा न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रििू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रििू णकारी उद्योगों को बढ़ावा दिर्ा िाएगा। (17) पहाड़ी ढलानों का सरं क्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना म ें पहाड़ी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी संजनमााण की अनुज्ञा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खड़ी पहाड़ी ढलानों म ें अत्र्जधक भ-ू क्षरण होता ह ै उनम ें दकसी भी संजनमााण की अनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी सवं िे ी िोन म ें प्रजतजिद्ध र्ा जवजनर्जमत दकए िान े वाल े दक्रर्ाकलापों की सचू ी.- पाररजस्ट्थजतकी संवेिी िोन म ें सभी दक्रर्ाकलाप, पर्ाावरण अजधजनर्म के उपबंधों और तटीर् जवजनर्मन िोन, 2011 एव ं पर्ाावरणीर् प्रभाव आकलन अजधसूचना, 2006 सजहत उसके अधीन बन े जनर्मों और वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्द्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) सजहत अन्द्र् लाग ू जनर्मों तथा उनम ें दकए गए संिोधनों के ररट र्ाजचका (जसजवल) स.ं 202 म ें टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले म ें माननीर् उच्चतम न्द्र्ार्ालर् के दिनांक 4 अगस्ट्त, 2006 के आििे और 2012 की ररट र्ाजचका (जसजवल) स.ं 435 म ें गोवा फाउंडेिन बनाम भारत संघ के मामले म ेंतारीख 21 अप्रलै , 2014 के आिेि के अनुसरण म ें होगा । 2. प्रििू ण (िल, वार्ु, मृिा, ध्वजन, पाररजस्ट्थजतकी संवेिी िोन म ें कोई नर्ा उद्योग लगाने और वतामान प्रििू णकारी उद्योगों का जवस्ट्तार करने की अनुमजत नहीं होगीः आदि) उत्पन्न करन े वाल े उद्योगों की स्ट्थापना । परन्द्त ु र्ह दक केन्द्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा फरवरी, 2016 म ें िारी समर्-समर् पर र्था संिोजधत मागाििाक जसद्धान्द्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें ऐसा जवजनर्िष्टा न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गैर-प्रििू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि गैर-प्रििू णकारी कुटीर उद्यागों को बढ़ावा दिर्ा िाएगा। 3. बड़ी िल जवद्युत पररर्ोिनाओं की प्रजतजिद्ध। स्ट्थापना । 4. दकसी पररसंकटमर् पिाथ ा का प्रर्ोग प्रजतजिद्ध। र्ा उत्पािन र्ा प्रस्ट्संकरण। 5. प्राकृजतक िल जनकार्ों र्ा भूजम क्षत्रे प्रजतजिद्ध। म ें अनपु चाररत बजहस्रावों का जनस्ट्सरण । 6. नई आरा जमलों और काष्ठ आधाररत पाररजस्ट्थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा जमलों के उद्योगों की स्ट्थापना। जवस्ट्तार के जलए अनुमजत नहीं होगी । 7. ईंट भट्टों की स्ट्थापना करना। प्रजतजिद्ध। 8. िलावन लकड़ी का वाजणजज्र्क प्रजतजिद्ध। उपर्ोग । ख.जवजनर्जमत दक्रर्ाकलाप 9. होटलों और ररसोटों की वाजणजज्र्क पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हते ु लघु अस्ट्थार्ी संरचनाओं के स्ट्थापना । जनमााण के जसवार्, संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनम ें िो भी अजधक[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 जनकट हो, नए वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना की अनुमजत नहीं होगी: परंत,ु संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनम ें िो भी अजधक जनकट हो, पर्ाटन महार्ोिना और लागू दििाजनिेिों के अनुसार सभी नए पर्ाटन दक्रर्ाकलाप करने र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार करन े की अनुज्ञा होगी । 10. संजनमााण दक्रर्ाकलाप । (क) संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक िो भी जनकट हो, दकसी भी प्रकार का वाजणजज्र्क संजनमााण अनुमत नहीं दकर्ा िाएगा: परंतु स्ट् थानीर् लोगों को पैराग्राफ 3 के उप परै ाग्राफ (1) म ें सूचीबद्ध दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम म ें स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने जलए संजनमााण करने की अनुमत भवन उपजवजधर्ों के अनुसार िी िाएगी: परन्द्त ु ऐसे लघ ु उद्योगों िो प्रििू ण उत् पन्द् न नहीं करते ह,ैं स े संबंजधत संजनमााण दक्रर्ाकलाप जवजनर्जमत दकए िाएंगे और लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत स े ही न्द् र्नू तम पर रखे िाएंगे। (ख) एक दकलोमीटर स े आग े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे । 11. गैर प्रििू णकारी लघ ुउद्योग। फरवरी, 2016 म ें केन्द्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा िारी, समर्- समर् पर र्था संिोजधत उद्योगों म ें वगीकरण के अनसु ार गैर- प्रििू णकारी उद्योग और अपररसंकटमर्, लघु और सेवा उद्योग, कृजि, पुष्प कृजि, बागवानी र्ा पाररजस्ट्थजतकी संवेिी िोन स े िेिी सामग्री स े उत्पािों को उत्पन्न करन े वाले कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनज्ञु ात होंगे। 12. वृक्षों की कटाई । (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत केंरीर् र्ा राज्र् के अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी । 13. वन उत्पािों और गैर काष्ठ वन लाग ू जवजधर्ों के अधीन जवजनर्जमत होगा । उत्पािों का संग्रहण । 14. जवद्युत और संचार टॉवर लगान,े लागू जवजधर्ों के अधीन जवजनर्जमत (भूजमगत केबल जबछाने को बढ़ावा दिर्ा िाएगा) होगा। तार जबछान-े तथा अन्द्र् बुजनर्ािी ढांच े की व्यवस्ट्था । 15. नागररक सुजवधाओं सजहत बुजनर्ािी लागू जवजधर्ों, जनर्मों और वार् ु गब्ु बारें, हले ीकॉसटर, ड्रोन, माइक्रोलाइटस, आदि द्वारा पाररजस्ट्थजतकी संवेिी िोन क्षत्रे के ऊपर स े उड़ना िैसे दक्रर्ाकलाप करना। 18. पहाड़ी ढालों और निी तटों का लाग ू जवजधर्ों के अधीन esz-mef@nic.in Draft Notification WHEREAS, Ralamandal Wildlife Sanctuary is situated about 12 kilometres from Indore city in Indore Forest Division of Indore district Madhya Pradesh and is located within the compartment number R-260 having total area of 2.34550 square kilometres. The Sanctuary was declared in 1989 vide Madhya Pradesh notification No 14-20- 10-2-88 dated 09th February, 1989. The area is further classified in three zones such as Wild life Zone (152.550 ha.), Tourist Zone (55.000 ha.) and Dear Safari Zone (27.000 ha.), respectively. Historically Ralamandal was use as Game Sanctuary by the Maharaja Shivaji Rao Holkar. In 1905, Shikargaha was built and utilized by the former Holkar Maharajas. It is situated on 2608 ft mean sea level and 2.5 kilometres from the main entrance gate of the Sanctuary; AND WHEREAS, Ralamandal Wildlife Sanctuary has recorded about 28 cheetal, 19 black buck, 42 neelgai, 5 bhedki, 11 hyenas, and 10 lomdi. Apart from this, other fauna species such as sehi, mor, kharna, siyar, etc. are also present in the Sanctuary area. It was justified by the State Government that “According to the Indore Development Plan 2021, village Mundla Nayta, Sanawadiya, Mirzapur, Ralamandal were included in the development plan[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 17 and thus the residential area around the Ralamandal Sanctuary Eco-sensitive Zone was kept only 100 meters extent”. (2) The boundary description of Ralamandal Wildlife Sanctuary and its Eco-sensitive Zone is appended in Annexure-I. (3) The maps of the Ralamandal Wildlife Sanctuary demarcating the Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA and Annexure-IIB. (4) Lists of geo-coordinates of the boundary of Ralamandal Wildlife Sanctuary and the Eco-sensitive Zone are given in Table A and Table B of Annexure-III. (5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV. 2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco- sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification and get it duly approved by the competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj; (xi) Madhya Pradesh State Pollution Control Board; and (xii) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall provide mechanism for regulating developmental activities in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (9) The Zonal Master Plan so approved by the State Government shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given under paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph; (b) efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; (b) the Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests; (c) the Tourism Master Plan shall form a component of the Zonal Master Plan; (d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone; (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 19 Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone; (b) only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE Sl. Setting of industries causing pollution New industries and expansion of existing polluting industries (Water, Air, Soil, Noise, etc.). in the Eco-sensitive Zone shall not be permitted: Provided that non-polluting industries shall be allowed within the Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition the non-polluting cottage industries shall be promoted. 3. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents: Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 11. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent authority. 12. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 13. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification, the Central Government hereby constitutes a Monitoring Committee, under the provisions of sub-section (3) of section 3 of the Environment (Protection) Act, 1986, comprising of the following, namely:- Sl. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Orders of Supreme Court, etc.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
