के कार्ाालर् आिेि स.ं 19-04/2021-आईए.।।। के त त एक जविेिज्ञ सजमजत गरित की गई थी;
और, उक्त जविेिज्ञ सजमजत न,े अन् र् बात के साथ-साथ, पर्ाावरण स्ट् वीकिजत प्रिान करन े ते ु रार् के मौिूिा स्ट्थ ानीर्
उपजनर्म के साथ-साथ मौिूिा जवजनर्ामक र्वस्ट् था की िांच की थी और पर्ाावरण की सुरक्षा के जलए प्रस्ट्त ाजवत जवजनर्म
के संबंध में एक ररपगिा प्रस्ट् तुत की थी;
और, पर्ाावरण के प्रभावकारी संरक्षण और प्रबंधन के प्रर्गिन से, मानकीकित, पररणाम-आधाररत और पररमाण-
जनधाारणीर् पर्ाावरणीर् जवजनर्म बनाना आव् र्क माना िाता तादक िजि टिककगण में पारि्िाता लगाई िा सके और
र्ापार में सगु मता कग प्रगत् साज त दकर्ा िा सके;
और, जवजनर्ामक ढांचे के समग्र अधीक्षण कग केन् द्रीर् सरकार के पास संधाररत करत े ुए ररत प्रमाणन कग प्रगत् साज त
करके और िासन के जवजभन् न स्ट्त र पर जवजनर्ामक एिेंजसर् की मौिूिगी कग सुि़ ि करके तीसरे पक्ष की िांच के मा् र्म
से जनगरानी तंत्र कग जवस्ट्त ाररत करना भी आव् र्क समवा िाता ;
अत: अब, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) के खंड (घ) के साथ परित पर्ाावरण (संरक्षण)
अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उप-धारा (1) और उप-धारा (2) के खंड (v) तथा उप-धारा (3) द्वारा
प्रित् त िजतियर् का प्रर्गग करत े ुए, केन् द्रीर् सरकार एति वद्वारा भवन जनमााण पररर्गिनाओं के जलए जनम्न जलजखत जवजनर्म
अजधसूजचत करती : -
1 सजं क्षप्त नाम और प्रारंभ :-
i. इन जवजनर्म कग भवन जनमाणा पर्ावा रण प्रबधं न जवजनर्म, 2022 क ा िाएगा।
ii. र्े जवजनर्म रािपत्र म ेंउनके प्रकािन की तारीख स ेप्रवित् त गे।
2. पररभािाएं:- इस अजधसूचना म,ें र्दि संिभ ामें अन् र्था अपेजक्षत न ग, िब् ि कग जनम्न वतव पररभाजित दकर्ा िाता :
1. ब् ल क वािर- मल-मूत्र के संििू ण से जमजित धुंधला िल।
2. भवन- मनुष् र् के र ने के जलए उपर्गग दकए िाने के प्रर्गिन, र्ावसाजर्क प्रर्गिन आदि से दकसी भी प्रकार की
सामग्री से जन्मात संरचना जिसमें औद्यगजगक भवन और पररसकं िमर् कार्ाकलाप से संबंजधत भवन िाजमल न ीं ।
3. धुंधला िल- घर र्ा कार्ाालर् भवन से जनस्ट् सररत अपजिष्ि िल जिसमें मल-मूत्र का संििू ण न ीं ।
4. पररसंकिमर् कार्ाकलाप से सबं ंजधत भवन- इसमें इन प्रर्गिन से प्रर्ुक् त भवन र्ा उसका ज स्ट् सा िाजमल :

5. औद्यौजगक भवन – इसम ें ऐसा भवन अथवा उसका ज स्ट्स ा िाजमल जिसम ें उत् पाि र्ा सामग्री कग जन्मात, संर्गजित
र्ा प्रसंस्ट् कित दकर्ा िाता , ि से-सर्ं गिन संर्ंत्र, प्रर्गगिालाए,ं जवद्युत संर्ंत्र, तेल िगधक कारखाना, ग स संर्ंत्र, जमल,

कगई जनकार्, जिस दकसी नाम से िाना िाए, जिसे कार्ा-संचालन के िौरान पररर्गिना के अनुरक्षण एवं िेखरेख का
िाजर्त् व सपपा गर्ा ।

8. तितीर्क िगधन – उ च गुणवत्त ा का, उपर्गर् िल त र्ार करने ते ु ाजनकारण पिाथा कग िाने के जलए प ल े ी
प्राथजमक और/र्ा जद्वतीर्क प्रदिर्ाओं से िगजधत दकए गए िल कग जवसंिजमत करने के उद्दे्र् से प्रर्ुक् त अपजिष्ि िल
िगधन प्रदिर्ा।
9. अपजिष्ि िल- घरेल,ू र्ावसाजर्क, औद्यगजगक र्ा किजि कार्का लाप के दकसी भी संर्गिन से जनस्ट् सररत प्रर्ुक्त िल,

3. जवजनर्म की अनप्रु र्गर् ता
(1) र्े जवजनर्म ऐसी पररर्गिनाओं पर लाग ू ग े जिनम ें > 5000 वगामीिर जन्मात क्षेत्र वाले भवन का जनमााण िाजमल
ग।
(2) र्े जवजनर्म नई भवन पररर्गिनाओं और पुरान/े मौिूिा भवन के जवस्ट् तार/िीण्धारार/मरम् मत संबंधी
पररर्गिनाओं पर लागू गे।
(3) र्े जवजनर्म दकसी अन् र् अजधजनर्म/जनर्म/जवजनर्म/उपजनर्म/अजधसूचना आदि के त त प्राप् त दकए िान े ते ु
अपेजक्षत अनुमगिन /स मजत/अनुमजतर् आदि कग प्रजतस्ट् थाजपत न ीं करते ।ैं पररर्गिना प्राजधकरण केन् द्रीर् र्ा रार्
सरकार के दकन् ीं अन् र् अजधजनर्म /जवजनर्म र्ा संजवजधर् अथवा उनके द्वारा नामगदद्दष्ि एिेंजसर् /जवकास
प्राजधकरण/स्ट् थानीर् जनकार् , पररर्गिना पर िग लाग ू ग, के जवजनर्म के त त अनुमगिन/स्ट् वीकिजतर्ां प्राप् त करन े ते ु
बा् र् र गे ा, जिनमें जनम्न क्षत्रे , प्राकिजतक िल-जनकास और पर्ाावरणीर् संवेिनिीलता अथाात व पाररजस्ट्थजतकी िजि टिक स े
संवेिनिील क्षेत्र, िगनल मास्ट्ि र प् लान/वन् र्िीव अभर्ारण्र् /राष्र ीर् उद्यान, तिीर् जवजनर्मन िगन क्षेत्र , ि व-मंडल
ररिवों और गंभीर ूपप स े प्रिजूित क्षेत्र , प ाडी क्षेत्र , आपिा प्रवण क्षेत्र से जनकिता/उनके भीतर पररर्गिना की जस्ट्थजत
ि से मापिण्ड कग ् र्ान म ें रखकर पररर्गिना की जस्ट्थजत के संबंध में प्राप् त दकए िान े वाल े अनुमगिन/स्ट् वीकिजतर्ां िाजमल

(4) दकन् ीं अन् र् जवजनर्म उप-जनर्म आदि स ेअसंगजत के मामल ेमें वे प्रावधान लागू ग ेिग अजधक किगर ।
4. मौििू ा र्ा सावा अवसरं चना कग उन्न त बनाना :
(1) संबंजधत मामल म ें जनधााररत जवजनर्म के अनुपालन ते ु पररर्गिना प्राजधकरण के उत् तरिार्ी र न े की िता के
अधीन पररर्गिनाओं कग चर्जनत प्रर्गिन के जलए उपलब् ध मौिूिा र्ा सावा अवसंरचना कग उन् नत करने की अनुमजत
प्रिान की िाती । तथाजप र्दि दकन् ीं कारण स े चा ेपररर्गिना प्राजधकरण के कारण र्ा अन् र्था उक्त र्वस्ट्थ ा जवफल
ग िाती अथवा उसके पररणामस्ट् वूपप इसम ें अजधसूजचत दकन् ीं जवजनर्म का उल् लघं न गता तग पररर्गिना
प्राजधकरण कग उन जवजनर्म के उल्ल ंघन के जलए उत् तरिार्ी माना िाएगा।
i. मलिल िगधन सर्ं त्रं : पररर्गिना प्राजधकरण अपजिष्ि िल के िगधन ते ु सावा एसिीपी की सेवाएं प्राप् त करन े
के जलए संजविात् मक करार कर सकता , बिते दक ऐसी र्वस्ट् था में िगजधत अपजिष्ि िल कग पुन: उपर्गग ते ु
संबंजधत भवन तक वापस लाने की पुनचािण प्रणाली की स्ट् थापना के साथ-साथ अपजिष्ि िल कग एसिीपी तक
पुचं ाने ते ु मलिल नेिवका की आव् र्क अवसंरचना (रंक सीवर, पमम्पंग स्ट् िेिन आदि) का जनमााण सुजनजित
दकर्ा िाना चाज ए। ऐसी सुजवधाओं के जलए, अिगजधत और िगजधत अपजिष्ि िल का पररमाण जनधााररत करने

ii. िगस अपजिष्ि प्रबधं न : िगस अपजिष्ि प्रबंधन जनर्म, 2016 तथा तत्प ् चातव उनमें दकए गए अनुवतस संिगधन के
प्रावधान के लाग ू दकए िान े के अधीन, पररर्गिना प्राजधकरण अलग-अलग दकए गए िगस अपजिष्ि कग संबंजधत
स्ट् थानीर् जनकार् कग सुपुि ा कर सकता , र्दि नगरपाजलका के पास कूडा उिाने का तंत्र मौिूि । र्दि ऐसी
र्वस्ट् था र्थेष्ि न ग र्ा उपलब् ध न ग, तग पररर्गिना प्राजधकरण पिथक दकए गए िगस अपजिष्ि कग उिान े ते ु
पेिेवर अपजिष्ि प्रबधं न सगं िन कग जवजनर्गजित करेगा।
5. भवन जनमाणा ते ुपर्ावा रणीर् जवजनर्म :
(1) पररर्गिना प्राजधकरण सुजनजित करेगा दक पररर्गिना के जनमााण एवं कार्ा-संचालन चरण के िौरान
जनम्न जलजखत पर्ाावरणीर् जवजनर्म का अनुपालन दकर्ा िाए :
क. स्ट्थ लाकिजत और प्राकिजतक िल-जनकास
1. िल का अजवरल प्रवा सुजनजित करन े ते ु पररर्गिना स्ट्थ ल पर प्राकिजतक िल-जनकास अनुरजक्षत दकर्ा िाना
चाज ए।
2. नमभूजम और िल-जनकार् में दकसी जनमााण-कार्ा की अनुमजत न ीं ।
3. पररर्गिना स्ट्थ ल म ें और उसके आस-पास िल-जनकास कग तूफानी िल-जनकास प्रणाली, 2019 संबंधी
सीपीएचईईओ म नअु ल के अनुसार प्रबंजधत दकर्ा िाना चाज ए।
4. मििा अपरिन के जनर्ंत्रण उपार् कग जनमााण से प ले, जनमााण के िौरान और जनमाणा के बाि में दकर्ा िाना चाज ए
तथा इसे भारत की राष्र ीर् भवन संज ता (एनबीसी), 2016 में उजल्लजखत सव्त् तम प्रबंधन प्रथाओं के अनुूपप गना
चाज ए।

प्रावधान उपलब् ध न ीं ,ैं तब आवासन और ि री जवकास मॉडल भवन उप-जनर्म, 2016 के अनुसार भंडारण और
पुनभारण के प्रावधान का अनुपालन दकर्ा िाना चाज ए।
7. त के ऊपर और त से इतर क्षेत्र में विाा िल संचर् की र्गिना त र्ार और कार्ााजन्वत की िाएगी तादक त और
त से इतर क्षेत्र स े कम से कम ‘एक दिन के विाा िल ब ाव की मात्रा’ कग इस ढंग स े संजचत दकर्ा िाए दक भू-िल
के संभाजवत संििू ण कग रगका िा सके।
एक दिन में ुई विाा का पररमाण, नीचे िी गई ताजलका में दिए अनुसार ‘’भारी विाा वाले मा की विाा की औसत
प्रजतितता’’ से आकजलत दकर्ा िा सकता :

10. िग री पाइपलाइन प्रणाली कार्ााजन्वत की िाएगी – एक पीने, खाना पकाने और न ाने आदि के जलए स्ट् व िल
की आपू्त ा ते ु और िसू री फ्लि करन े के जलए िगजधत िल की आपू्ता ते ु।
11. फ्लमिगं के जलए केवल िगजधत िल का उपर्गग दकर्ा िाएगा।
12. दकसी भी जस्ट्थजत म,ें पररर्गिना क्षेत्र के भीतर उत् पन् न गन े वाले सीवेि र्ा अिगजधत अपजिष्ि िल कग तूफानी िल
जनकास प्रणाली के मा् र्म से अथवा अन् र् प्रकार से िल जनकार् में अथवा भूजमगत िल में गडा/स्ट् त्राजवत न ीं
दकर्ा िाएगा।

15. दकसी जनष्प क्ष जविेिज्ञ द्वारा मल-िल िगधन संर्ंत्र (एसिीपी) की पर्ााप् तता का प्रमाणन दकर्ा िाएगा और इस
संबंध में एक ररपगिा प्राजधकित अजभकरण कग प्रस्ट् तुत की िाएगी।
16. एसिीपी में िगधन के प् चात, पररसर के बा र, अजधक िगजधत अपजिष्ि िल का जनस्ट् सरण समर्-समर् पर
सीपीसीबी/पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा र्था अजधसूजचत जनस्ट् सरण मानक के अनूपु प
गना चाज ए।
17. मापन/उप-मापन के मा् र्म से अपजिष्ि िल और िगजधत िल पररमाणन प्रणाली संस्ट्थ ाजपत की िाएगी।
18. मल-प्रवा और मल-िल िगधन प्रणाली के संबंध में केंद्रीर् लगक स्ट् वास्ट् ् र् और पर्ाावरणीर् अजभर्ांजत्रकी संगिन
(सीपीएचईईओ), आवासन और ि री कार्ा मंत्रालर् के म न्र् ुअल के अनुसार कार्ा स्ट् थल पर मल-िल िगधन स े
प्राप् त गाि का एकत्रण, व न और जनपिान दकर्ा िाना चाज ए।
19. ि ां भी सावा मल-िल िगधन संर्ंत्र की सुजवधा का उपर्गग दकर्ा गर्ा , र् सुजनजित दकर्ा िाना चाज ए दक
िगजधत अपजिष्ि िल का पनु चिा ण दकर्ा गर्ा और पुनउापर्गग ते ु संबंजधत भवन कग भेि दिर्ा गर्ा ।
घ. िगस अपजिष्ि प्रबधं न
20. इस अजधसूचना के खण्ड (3) के अ् र्धीन, कार्ा स्ट् थल पर िगस अपजिष्ि प्रबंधन की सुजवधा जवकजसत की िानी
चाज ए और सभी ग र ि व अविमणीर् अपजिष्ि के जनपिान के जलए प्राजधकित पुनचिा क/संबंजधत नगरीर्
अजभकरण के साथ एक औपचाररक संजविात् मक र्वस्ट् था सुजनजित की िानी चाज ए।

22. भ-ू खण् ड के कम से कम 10 प्रजतित क्षेत्र कग विक्ष आवरण के त त सुजनजित करने के जलए प्रत् र्ेक 80 वग ा मीिर
भूजम के जलए कम स े कम एक (01) विक्ष लगार्ा िाना चाज ए और उसका रखरखाव दकर्ा िाना चाज ए। इस
प्रर्गिन के जलए जवद्यमान विक्ष की गणना की िाएगी।

इन उपार् में जनमााणाधीन भवन के जलए स्ट्िीन, स्ट् थल के चार ओर लगातार धलू / वा रगकन े वाली िीवारें (कम

25. रेत, सीमेंि, मुराम और अन्र् जनमााण सामग्री लाने वाल े वा न जिससे स्ट् थल पर धलू प्रििू ण ग सकता के जलए
प्लाजस्ट्िक / जतरपाल िीि कवर प्रिान दकर्ा िाएगा और साथ ी स्ट् थल स ेमलब ेकग बा र जनकाला िाएगा।
26. वा न के पज र् की धलु ाई की िानी चाज ए। (20,000 वग ा मीिर स े अजधक के जनमााण क्षेत्र वाली पररर्गिनाओं
के जलए)
27. धूल प्रििू ण कग रगकने के जलए स्ट् थल पर भण् डाररत रेत, मुराम, खुली जमट्टी, सीमेंि कग पर्ााप्त ूपप से कवर दकर्ा
िाएगा।
28. ग्राइंमडंग और स्ट्िगन किंिंग के जलए वेि िेि की व्यवस्ट्था की िानी चाज ए। धूल कग िबाने के जलए कच्ची सत और
खुली जमट्टी पर पर्ााप्त ूपप से पानी ज डका िाना चाज ए।
29. सभी जनमााण और जव्वंस मलबे कग स्ट् थल पर सग्रं ीत दकर्ा िाएगा (और बा र सडक र्ा खुले स्ट्थान पर न ीं
डाला िाएगा) िब तक उनका उजचत जनपिान न दकर्ा िाए।
30. ब़ ते प्रििू ण भार का आकलन करन े के जलए जनधााररत दििाजनिेि के अनुसार ्वजन प्रििू ण की जनगरानी की
िाएगी।सीपीसीबी/एसपीसीबी द्वारा जनधााररत मानक के अनूपु प जनमााण और संचालन चरण के िौरान ् वजन के
स्ट्तर कग कम करने के जलए पर्ाप्ता उपार् दकए िाएंगे।
ि. जबिली आप्ू त ाऔर डीिी सिे का उपर्गग
31. पररर्गिना प्राजधकरण जनमााण चरण स े ी जडस्ट्कॉम से जनर्जमत जबिली आपू्त ा प्राप्त करेगा;
32. पररचालन चरण - आपातकालीन उपर्गग के अलावा डीिी सेि के उपर्गग की अनुमजत न ीं गगी। जबिली की
सामान्र् मांग कग जडस्ट्कॉम से जबिली आपू्ता के मा्र्म से पूरा दकर्ा िाना चाज ए।
33. ब कअप पावर - डीिी सेि का उपर्गग केवल आउिेि की अवजध के जलए ब कअप जबिली आप्ू ता के जलए दकर्ा िा
सकता , बिते दक जडस्ट्कॉम से अपेजक्षत लगड का जनर्जमत जबिली कनेक्िन प्राप्त दकर्ा गर्ा ग।

वाले पररर्गिना प्रस्ट् तावक कग एक पावती िारी की िाएगी।
39. पररर्गिना प्रस्ट् तावक जनम्न जलजखत मापिंड पर जविेि ् र्ान केंदद्रत करने के साथ सरकार कग प्रत् र्ेक विा जनमााण

WHEREAS, Ministry had constituted an Expert Committee vide Office Order No. 19-04/2021-IA.III dated
29.01.2021 to examine and recommend regulations for building construction and township projects;
AND WHEREAS, the said Expert Committee inter-alia examined the existing local bye-laws of states along with
existing regulatory regime for granting Environment Clearance and submitted a report on the proposed regulation for
environment protection.
AND WHEREAS, for the purposes of effective environment protection and management, it is considered necessary
to put in place Standardized, Outcome based & quantifiable environmental regulations so as to bring in transparency
in approach & encourage ease of doing business;
AND WHEREAS, it is also considered necessary to expand the monitoring mechanism through third party audits,
encouraging green certifications and leveraging on the presence of regulatory agencies at different levels of
governance while retaining the overall superintendence of regulatory framework with the Central Government;
NOW, THEREFORE, in exercise of powers conferred by sub-section (1) and clause (v) of sub-section (2) of section
3 & sub-section (3) of Section (3) of the Environment (Protection) Act, 1986 (29 of 1986), read with clause (d) of sub-
rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the following
regulations for building construction projects: -
1. Short title and commencement:-
i. These regulations may be called as Building Construction Environment Management Regulations, 2022
ii. The regulations shall come into force on the date of their publication in the Official Gazette.
2. Definitions: - In this notification, unless the context otherwise requires, the terms are defined as
follows:
1. Black Water – Grey water, mixed with faecal and urinal contamination.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
2. Building - A structure constructed with any material whatsoever for the purpose of being used for human
habitation, professional use etc. except industrial building and hazardous building.
3. Grey Water – Waste water generated in households or office buildings from streams without faecal and
urinal contamination.
4. Hazardous Building- Includes a building or part thereof used for;
i. Storage, handling, manufacture of processing of radioactive substances or highly combustible or explosive
materials or of products which are liable to burn with extreme rapidity and/or producing poisonous fumes or
explosive emanations.
ii. Storage, handling, manufacture or processing of which involves highly corrosive, toxic or noxious alkalis,
acids, or other liquids, gases or chemicals producing flame, fumes and explosive mixtures etc. or which result
in division of matter into fine particles capable of spontaneous ignition.
5. Industrial Building- Includes a building or part thereof wherein products or material are fabricated,
assembled or processed, such as assembly plants, laboratories, power plants, refineries, gas plants, mills,
dairies and factories etc.
6. Project Authority – An entity, by whatever name called, responsible for construction, management,
maintenance of the project including the Resident Welfare Association to whom the project has been
entrusted for maintenance & upkeep during operational phase.
7. Rainfall Run-off Volume: As defined in Indian Green Building Council (IGBC) Green Homes Rating System
- Version 3.0, 2019.
8. Tertiary Treatment- Waste water treatment process used to disinfect water that has already been treated by
primary and/or secondary processes for removing harmful material so as to produce high quality, usable
water.
9. Waste Water – Used water from any combination of domestic, commercial, industrial or agricultural
activities, surface runoff or storm water & any sewer inflow or sewer infiltration & includes grey water &
black water.
3. Applicability of the Regulation
(1) The Regulation shall be applicable for projects involving construction of buildings, having built up area ≥
5000 sq.mts.
(2) These Regulations shall be applicable to new building projects and expansion/renovation/repair of old
/existing buildings.
(3) These Regulations do not substitute approvals/consent/permissions etc., required to be obtained under any
other Act/Rule/regulation/bye-laws/notification etc. The Project Authority shall continue to be under
obligation to obtain approvals/clearances under any other Acts/ Regulations or Statutes of the Central or State
Govt. or their designated agencies/Development Authority/Local Bodies as applicable to the project
including in respect of site location for parameters such as low lying area, natural drainage, and for
environment sensitivity i.e. proximity/within Eco Sensitive Area, Zonal Master Plan/Wildlife
Sanctuary/National Park, Coastal Regulation Zone areas, Biosphere Reserves and Critically Polluted Area,
hill areas, disaster prone areas.
(4) In case of any inconsistency with any other regulations, byelaws, etc., the provisions that are more stringent
shall apply.
4. Leveraging on existing or common infrastructure:
(1) Subject to the project authority remaining accountable for compliance of regulations, stipulated in
respective cases, the projects are permitted to leverage on the existing or common infrastructure available for
select purposes. However, if for whatsoever reasons, attributable to the said project authority or otherwise,
the said arrangement fails or results in breach of any of the regulations notified herein, the project authority
shall be considered liable for breach of the regulations.
i. Sewage Treatment Plant: The project authority may enter into contractual agreement so as to avail services
of common STP for treatment of waste water, provided that such arrangement should ensure putting in place
recycling system of treated wastewater back to respective buildings for reuse along with necessary
infrastructure of sewerage network (trunk sewer, pumping station etc.) for transporting waste water to STP.
Proper metering system for quantification of untreated and treated wastewater should be ensured for such

ii. Solid Waste Management: Subject to the applicability of the Solid Waste Management Rules, 2016 and
subsequent amendments thereafter, the project authority may hand over the segregated solid waste to
concerned local body if the municipality has garbage pick-up mechanism in place. If such arrangement is
inadequate or unavailable, the project authority shall engage professional waste management organisation to
pick up the segregated solid waste.
5. Environmental Regulations for Building Construction:
(1)The project authority shall ensure that the following Environmental regulations are complied with during
construction and operational phases of the project:
A. Topography & Natural Drainage
1. Natural drainage system at site should be maintained for ensuring unrestricted flow of water.
2. No construction is allowed on wetland and water bodies.
3. Drainage in and around site should be managed as per the CPHEEO Manual on Storm Water Drainage
Systems, 2019.
4. Soil erosion control measures should be taken before, during and after construction and conform to best
management practices highlighted in the National Building Code (NBC) of India, 2016
B. Adoption of Water Conservation methods by employing Rain Water Harvesting/Ground Water
Recharge
5. No ground water shall be used during construction phase of the project except with prior approval of the
Central Ground Water Authority.
6. In areas where ground water recharge is not feasible, rain water should be harvested and stored for reuse as
per local bye-laws provisions on rainwater harvesting. If local bye-law provisions are not available, provision
for storage and recharge should be followed as per the Ministry of Housing and Urban Development Model
Building Bye-laws, 2016.
7. Roof top and non-roof rain water harvesting plan shall be designed & implemented to capture at least ‘one-
day rainfall runoff volume’ from roof and non-roof areas in a manner that prevents possible contamination of
ground water.
One-day rainfall can be derived from ‘percentage of average peak month rainfall’ as given in table below:

Note: To estimate the average peak month rainfall, consider the average of at least last 5 years peak month
rainfall of the project location.
8. The storage capacity of rainwater harvested should be a minimum of one day of total fresh water
requirement.
9. Minimum 20% of the open spaces shall be pervious. Use of grass pavers, paver blocks with at least 50%
opening would also be considered as pervious surface.
C. Management of sewage/waste water, Reuse and recycle of treated wastewater by dual plumbing system
10. Dual Plumbing System shall be implemented - one for supplying fresh water for drinking, cooking and
bathing etc. and another for supply of treated water for flushing.12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
11. Only treated water shall be used for flushing.
12. In no case, sewage or untreated waste water generated within the project area shall be discharged through
storm water drains or otherwise into water bodies nor discharged/injected into the ground water by any mode.
13. Subject to Clause (3) of this notification, the project authority may opt or avail to common off-site treatment
facility, as feasible, for treatment with reuse & recycle of corresponding quantity of treated water through the
dual plumbing system for flushing and other non-potable use.
A. For projects with built up area of 5,000 sq.mtrs. to 20,000 sq.mtrs. –
i. In areas where there is no municipal sewage network,
a. Either Onsite Sewage Treatment Systems with capacity to treat 100% waste water may be installed with
appropriate tertiary treatment system with disinfection for black & grey water. Such treated water should be
used with dual plumbing system for flushing and other non-potable use;
OR
b. In case of usage of septic tank, only black water shall be discharged in the septic tank. Grey water may be
treated through natural treatment systems or other secondary treatment as feasible. Such treated water
should be used with dual plumbing system for flushing and other non-potable use;
The excess treated water should conform to the general discharge norms of CPCB/MoEF&CC.
ii. In areas where there is municipal sewage network,
a. Either Onsite Sewage Treatment Systems with capacity to treat 100% waste water may be installed with
appropriate tertiary treatment system with disinfection for black & grey water. Such treated water should be
used with dual plumbing system for flushing and other non-potable use;
OR
b. The project authority may opt to discharge only black water in such municipal sewage network subject to
availability of trunk sewer line. For this purpose, two separate pipeline network– one for black water
discharge and other for collection of grey water shall be installed. Grey water may be treated through
natural treatment systems or other secondary treatment as feasible. Such treated water should be used with
dual plumbing system for flushing and other non-potable use;
B. For projects involving built-up area of 20,000 sq. mts. or more –
14. Subject to Clause (3) of this notification, Onsite Sewage Treatment Plant with capacity to treat 100% waste
water generated within the project area through tertiary treatment shall be installed. Treated waste water shall
be reused on site for landscape, flushing, HVAC, fire-fighting, and other end-uses.
15. The adequacy of the Sewage Treatment Plant (STP) shall be certified by an independent expert and a report
in this regard shall be submitted to the authorized agency.
16. Discharge of excess treated wastewater outside the premises, after treatment in STP, should meet the
discharge standards as notified by CPCB/MoEF&CC from time to time.
17. Wastewater and treated water quantification system through metering/sub-metering shall be installed.
18. Sludge from the onsite sewage treatment shall be collected, conveyed and disposed as per the Central Public
Health and Environmental Engineering Organization (CPHEEO) Manual, Ministry of Housing and Urban
Affair, on Sewerage and Sewage Treatment Systems.
19. Where Common Sewage Treatment Plan facility has been availed, it shall be ensured that treated waste
water is recycled back to respective building for reuse.
D. Solid Waste Management
20. Subject to Clause (3) of this notification, onsite solid waste management facility should be developed and a
formal contractual arrangement shall be ensured with authorized recyclers/concerned municipal agency for
disposal of all non-biodegradable waste.
21. Subject to Clause (3) of this notification, where there is no alternate arrangement for disposal of bio-
degradable waste, Organic waste composter/Vermiculture pit with a minimum capacity of 1.0 kg/150 sqm. of
built-up area/day shall be installed & operated.
E. Green Cover
22. A minimum of 1 tree for every 80 sqm. of land should be planted and maintained so as to ensure at least
10% of plot area under tree cover. The existing trees will be counted for this purpose.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 13
23. Topsoil should be stripped only upto a maximum depth of 20 cm from the areas proposed for buildings,
roads, paved areas, and external services. It should be stockpiled appropriately in designated areas and
reapplied during plantation of the proposed vegetation on site.
F. Management of Dust/Air and Noise Pollution during Construction phase
24. Dust, smoke & other air pollution prevention measures shall be provided for the building as well as the site.
These measures shall include screens for the building under construction, continuous dust/wind breaking
walls all around the site (at least 3-meter height).
25. Plastic/tarpaulin sheet covers shall be provided for vehicles bringing in sand, cement, murram and other
construction materials prone to causing dust pollution at the site as well as taking out debris from the site.
26. Wheel washing for the vehicles should be done. (For projects with built up area of more than 20,000
sq.mtrs.)
27. Sand, murram, loose soil, cement, stored on site shall be covered adequately so as to prevent dust pollution.
28. Wet jet shall be provided for grinding and stone cutting. Unpaved surfaces and loose soil shall be adequately
sprinkled with water to suppress dust.
29. All construction and demolition debris shall be stored at the site (and not dumped on the roads or open
spaces outside) before they are properly disposed.
30. Noise monitoring shall be carried as per the prescribed guidelines to assess incremental pollution loads.
Adequate measures shall be made to reduce noise level during construction and operation phase to conform
to the stipulated standards by CPCB/SPCB.
G. Power Supply &Use of DG Sets
31. The project authority shall obtain Regular power supply from DISCOMS from the construction phase itself;
32. Operational Phase – Use of DG set shall not be permitted except for emergency use. Normal power demand
must be met through power supply from DISCOM.
33. Backup power – DG set may be used for backup power supply only for period of outage, provided regular
power connection of requisite load has been obtained from DISCOM.
34. The DG sets location, exhaust pipe height shall be as per the provisions of the CPCB norms and emissions
should meet prescribed standards.
H. Issuance of Occupancy or Possession Certificate or Handing over possession –
35. The Local Authority shall not issue Completion Certificate or Occupancy Certificate or any other document
that allows possession to the owners of constituent units unless the project authority has complied with the
following regulations:
i. Rain water Harvesting (Regulation 5-9 of this notification).
ii. Treatment, Recycle & Reuse of Waste Water: (Regulation 10-19 of this notification).
iii. Sewage Treatment (Regulation 20-21 of this notification).
iv. Plantation & Green Cover (Regulation 22 of this notification).
v. Power supply & use of DG sets (Regulation 30-33 of this notification).
36. The concerned authority shall neither issue any Possession Certificate or Occupancy Certificate or any other
document that signifies handing over possession of premise or any unit part thereof for its use nor shall hand
over possession of such premise, unless the following regulations have been complied & are operational –
i. Rain water Harvesting (Regulation 5-9 of this notification).
ii. Treatment, Recycle & Reuse of Waste Water: (Regulation 10-19 of this notification).
iii. Sewage Treatment (Regulation 20-21 of this notification).
iv. Plantation & Green Cover (Regulation 22 of this notification).
v. Power supply & use of DG sets (Regulation 30-33 of this notification).
I. Project Environment Management Cell within Project authority.

37. A Project Environment Management Cell with defined functions and responsibility shall be put in place by
the project authority to ensure compliance of these regulations during construction & operation phase. The
environment management cell shall also keep the record of environment monitoring and those related to the
environment infrastructure.
J. Relevant Regulations/Rules
38. The following regulations, as amended from time to time, shall apply:
(1) The Solid Waste Management Rules, 2016 and subsequent amendments thereafter.
(2) The Plastics Waste Management Rules, 2016, and subsequent amendments thereafter.
(3) Hazardous & Other Wastes (Management and Transboundary Movement) Rules, 2016 and subsequent
amendments thereafter.
(4) Bio-Medical Waste Management Rules, 2016 and subsequent amendments thereafter.
(5) Noise Pollution (Regulation and Control) Rules, 2000 and subsequent amendment thereafter.
(6) The Construction & Demolition Rules, 2016 & Dust Mitigation Measures for Construction and
Demolition Activities [Notification No. GSR 94(E) dated 25.01.2018 of MoEF&CC].
(7) National Building Code (NBC) of India 2016.
6. Declaration & Compliance Monitoring:
38. A ‘Self declaration’ undertaking to comply with the environmental regulations’ conditions along with
the project details, in prescribed format and the Environment Management Plan shall be submitted online
by the project proponent on the designated website of the Central Government (www.parivesh.nic.in).
Thereafter, an acknowledgement shall be issued to the project proponent confirming receipt of the
declaration made.
39. The project proponent shall submit Performance Data and Certificate of Compliance of the project for the
environmental regulations and the parameters applicable, every year during the period of construction and
every two years during operational phase (5 years in case the building has been certified as Green building in
terms of GRIHA guidelines of MNRE) to the Government with special focus on the following parameters:-
(a) Water use and waste water generated, treated and reused on site.
(b) Waste Segregated and Treated on site.
(c) Tree plantation and maintenance
(d) Ground Water Recharge & Rain Water Harvesting
40. The Regional Office of the Ministry of Environment, Forest & Climate Change or the State Pollution
Control Board or the local authority are authorized to monitor the implementation of these Regulations,
report non-compliance of these regulations to the Ministry.
