दिल्ली, 28 िुलाई, 2026 का.आ. 4172(अ).— केंद्र सरकार पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उप- धारा (1) के साथ परित उप-धारा (2) के खंड (v) और खडं (xiv) तथा उप-धारा (3) के अधीन प्रित्त िजिर्ों का प्रर्ोग करते हुए प्रस्ट्ताजवत जनम्नजलजखत प्रारुप अजधसूचना को िारी करने का प्रस्ट्ताव करती है, इसके द्वारा पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) की अपेक्षानुसार इससे प्रभाजवत होन े वाली िनसाधारण की िानकारी के जलए प्रकाजित करती ह;ै और एतद्द्वारा र्ह सूजचत दकर्ा िाता ह ै दक उि प्रारुप अजधसूचना पर उस तारीख से साि दिन की अवजध की समाजि पर र्ा उसके बाि जवचार दकर्ा िाएगा जिस तारीख को इस अजधसूचना वाले रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी िाती ह।ैं ऐसा कोई भी व्यजि, िो इस प्रारूप अजधसूचना म ें अंतर्ववष्ट प्रस्ट्तावों के संबंध म ें कोई आपजत्त र्ा सुझाव िेना सजममजलत ह।ैं और िबदक बाडं ली वन्द्र्िीव अभर्ारण्र् के आसपास के क्षेत्र को, जिसका जवस्ट्तार और सीमाएं इस अजधसूचना के परै ा 1 में जवजनर्दिष्ट ह ैं पर्ाावरण और पाररजस्ट्थजतकी की िजर ष्ट से ,पाररजस्ट्थजतकी संवेिी िोन के रूप म ें सुरजक्षत और सरं जक्षत करना तथा उि पाररजस्ट्थजतकी संवेिी िोन म ें उद्योगों और उद्योगों के वगो और उनके प्रचालन तथा प्रसंस्ट्करण करन े को प्रजतजिद्ध करना आवश्र्क ह;ै अतः अब, केन्द्द्रीर् सरकार पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के खडं (v) और (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, जहमाचल प्रिेि रा्र् में बांडली वन्द्र्िीव अभर्ारण्र् की सीमा के आसपास 1 से 2.1 दकलोमीरर के क्षेत्र को बांडली वन्द्र्िीव वन्द्र्िीव अभर्ारण्र् पाररजस्ट्थ जतकी संवेिी िोन (जिसे इसके बाि पाररजस्ट्थजतकी-संवेिी िोन कहा िाएगा) के रूप म ेंअजधसजू चत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात ् :-- ‎1.‎पाररजस्ट्थजतकी सवं िे ी जोन का जवस्ट्तार और सीमाएं- (1)‎ 28.1872 वगा दकलोमीरर क्षेत्र में ैैले बांडली वन्द्र्िीव अभर्ारण्र् की सीमा के चारों ओर पाररजस्ट्थ जतकी संवेिी िोन का जवस्ट्तार 1 स े 2.1 दकलोमीरर के बीच तक होगा। पाररजस्ट् थजतकी संवेिी िोन का जवस्ट्तार नीच ेिी गई सारणी म ेंििाार्ा गर्ा ह:ै उत्तर 2.1 दकलोमीरर उत्तर-पूवा 1 दकलोमीरर पूवा 1.3 दकलोमीरर िजक्षण-पूवा 1.1 दकलोमीरर िजक्षण 1.6 दकलोमीरर िजक्षण-पजिम 1 दकलोमीरर पजिम 1.3 दकलोमीरर उत्तर-पजिम 1 दकलोमीरर[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (2) पाररजस्ट् थजतकी संवेिी िोन की सीमा का जववरण अनलु ग्नक-I के रूप म ेंसंलग्न ह।ै (3) पाररजस्ट् थजतकी संवेिी िोन का मानजचत्र, सीमा जववरण सजहत, अनलु ग्नक-IIक और अनलु ग्नक-IIख के रूप म ें संलग्न ह।ै (4) संरजक्षत क्षेत्रों और इसके पाररजस्ट् थजतकी संवेिी िोन के भौगोजलक जनिेिांक अनलु ग्नक-III के रूप में सलं ग्न ह।ैं (5) पाररजस्ट् थजतकी संवेिी िोन में आन े वाल े62 गांवों की सूची अनलु ग्नक-IV के रूप में सलं ग्न ह।ै (6) बांडली वन्द्र्िीव अभर्ारण्र् के आसपास के पाररजस्ट् थजतकी संवेिी िोन का जवस्ट्तरत क्षेत्र जववरण अनलु ग्नक-V के रूप म ें संलग्न ह।ै 2. पाररजस्ट्थजतकी सवं िे ी जोन के जलए आचं जलक महार्ोिना.– (1) रा्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर स्ट्थानीर् व्यजिर्ों के परामिा से और रा्र् में सक्षम प्राजधकारी का अनुमोिन प्राि करने की अजधसूचना म ेंिी गई ितों का पालन करत े हुए आंचजलक महार्ोिना तैर्ार करेगी। (2) रा्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसूचना में जवजनर्दिष् र रीजत से तथा प्रासंजगक केंद्रीर् और रा्र् जवजधर्ों के अनुरूप और रा्र् सरकार द्वारा िारी दििा-जनिेिों, र्दि कोई हों, के अनुसार बनार्ी िाएगी। (3) इस आंचजलक महार्ोिना को रा्र् सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार दकर्ा िाएगा ,तादक इस र्ोिना म ें पाररजस्ट्थजतकी और पर्ाावरण समबंधी िजर ष्टकोणों को एकीकरत दकर्ा िा सके-: i. पर्ाावरण; ii. वन और वन्द्र्िीव; iii. िहरी जवकास; iv. ग्रामीण जवकास; v. पर्ारन; vi. रािस्ट्व; vii. करजि; viii. पिुपालन; ix. जहमाचल प्रिेि रा्र् प्रििू ण जनर्ंत्रण बोडा; x. ससचाई और बाढ़ जनर्ंत्रण; xi. नगरपाजलका और पंचार्ती राि; xii. लोक जनमाणा जवभाग। (4) आंचजलक महार्ोिना म ें अनुमोदित भ-ू उपर्ोग, अवसंरचना और दरर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा िब तक इस अजधसूचना म ें ऐसा जवजनर्दिष्ट न हो, तथा आचंजलक महार्ोिना की सभी अवसंरचनाओं और उसके दरर्ाकलापों म ें सुधार करके उन्द्ह े अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनान े की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना, वनों की कराई से प्रभाजवत क्षेत्रों के पुनास्ट्थापन, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मरिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐसे अन्द्र् पहलओंु का उपाबंध दकर्ा िाएगा, जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह ै। (6) आंचजलक महार्ोिना म ें सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों और दकस्ट् मों, करजि क्षेत्रों, उपिाऊ भूजम, उद्यानों और उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा, सहार्क मानजचत्रों के साथ जिनम ें जवद्यमान तथा प्रस्ट्ताजवत भ-ू उपर्ोग जविेिताओं के ब्र्ौरों का जनधाारण दकर्ा िाएगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (7) इस आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी-संवेिी िोन के जवकास को जवजनर्जमत दकर्ा िार्ेगा और पैरा 4 म ें सूचीबद्ध प्रजतजिद्ध और जवजनर्जमत दरर्ाकलापों का अनुपालन दकर्ा िाएगा और स्ट्थ ानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजित दकर्ा िाएगा और उसका संवधना दकर्ा िार्ेगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) इस प्रकार अनुमोदित आंचजलक महार्ोिना, इस अजधसूचना के उपबंधों के अनुसरण में जनगरानी कार्ों को पूरा करन े के जलए जनगरानी सजमजत के जलए संिभा िस्ट्तावेि होगा। 3. रा्र् सरकार द्वारा दकए िान े वाल े उपार्. - रा्र् सरकार अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्: - (1) भ-ू उपर्ोग. – (क) पाररजस्ट्थजतकी-संवेिी िोन म ें वनों, बागवानी क्षेत्रों, करजि क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खुल े स्ट्थानों का मुख्र् वाजणज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दरर्ाकलापों के जलए प्रर्ोग र्ा पररवतना की अनुमजत नहीं होगी: बिते दक जनगरानी सजमजत की जसैाररि पर केंद्र तथा रा्र् सरकार के िहरी जनर्ोिन अजधजनर्म तथा अन्द्र् जनर्मों एवं जवजनर्मों र्था लाग,ू के अधीन तथा इस अजधसूचना के उपबंधों के पूवा अनुमोिन स े पाररजस्ट्थजतकी-संवेिी िोन के भीतर करजि और अन्द्र् भूजम के गैर करजि उपर्ोग के रुपान्द्तरण को स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं और दरर्ाकलापों को पूरा करने के जलए अनुमजत िी गई ह,ै िैसे,- (i) जवद्यमान सड़कों को चौड़ा और मिबूत करना और नई सड़कों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का सजिमााण और नवीनीकरण; (iii) प्रििू ण उत्पि न करने वाल ेलघु उद्योग; (iv) कुरीर उद्योग सजहत ग्राम उद्योग; पाररजस्ट्थजतकी पर्ारन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गरह वास; और (v) पैराग्राै-4 म ें र्था उजल्लजखत संवर्वधत दरर्ाकलापः परंतु र्ह भी दक रा्र् सरकार के पूवा अनुमोिन के जबना और संजवधान के अनुच्छेि 244 र्ा अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) सजहत वतामान म ें लाग ू जवजधर्ों के उपबंधों के अनुपालन के जबना वाजणज्र्क और औद्योजगक जवकास दरर्ाकलापों के जलए िनिातीर् भूजम के दकसी भी उपर्ोग की अनुमजत नहीं िी िाएगी: परंत ु ‎र्ह भी दक पाररजस्ट्थजतकी-संवेिी िोन के अधीन आने वाली भूजम के अजभलेखों म ें हुई दकसी त्रुरर को, जनगरानी सजमजत के जवचार प्राि करने के पिात,् रा्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार सुधारा िाएगा और उि त्रुरर को सुधारने की सूचना केंद्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी: परंत ु ‎र्ह भी दक उपर्िुा त्रुरर को सुधारन े म,ें इस उप-पैरा म ें र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भ-ू उपर्ोग का पररवतान सजममजलत नहीं होगा: (ख )अनुप्रर्िु र्ा अनुत्प ािक करजि क्षेत्रों म ें वनीकरण तथा पर्ाावासों की बहाली के कार्ाकलापों स े पनु : वनीकरण दकए िाने के प्रर्ास दकए िाएगं े। (2) प्राकरजतक िल स्रोत.- आंचजलक महार्ोिना में सभी प्राकरजतक झरनों/नदिर्ों/नालों की पहचान की िाएगी और उनके संरक्षण और नवीकरण की र्ोिना सजममजलत की िाएगी और रा्र् सरकार द्वारा िल ग्रहण प्रबंधन र्ोिना इस प्रकार बनाई िाएगी दक इस क्षेत्रो और इसके आसपास के क्षेत्रों म ें जवकास दरर्ाकलापों को प्रजतबंजधत दकर्ा िाएगा ,िो इन क्षेत्रों के जलए हाजनकारक हों। (3) पर्रा न र्ा पाररजस्ट्थजतकी पर्रा न.– (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ारन दरर्ाकलाप र्ा वतामान पर्ारन दरर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन से सबंजधत पर्ारन महार्ोिना के अनुसार होगा। (ख) पर्ारन महार्ोिना, रा्र् सरकार के पर्ाावरण और वन जवभागों के परामि ास े रा्र् के पर्ारन जवभाग द्वारा बनार्ी िाएगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (ग) पर्ारन महार्ोिना आंचजलक महार्ोिना का घरक होगी। (घ) पर्ारन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ारन संबंधी दरर्ाकलाप जनमन् ानुसार जवजनर्जमत दकए िाएंग,े अथाात:्- (i) वन्द् र्िीव अभर्ारण्र् की सीमा से एक दकलोमीरर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें से िो भी अजधक जनकर हो, दकसी नए होरल र्ा ररिॉर ाके जनमााण को अनुमजत नहीं िी िाएगी; बिते दक संरजक्षत क्षेत्र की सीमा से एक दकमी. की िरू ी के बाि पाररजस्ट्थजतकी संवेिी िोन की सीमा तक नए होरलों और ररजॉरास् की स्ट्थापना की अनुमजत आंचजलक महार्ोिना के अनुसार केवल पारर-पर्ारन सुजवधाओं के जलए पूवा –पररभाजित और नाजमत क्षेत्रों में ही िी िाएगी। (ii) पाररजस्ट्थजतकी संवेिी िोन के अन्द्िर सभी नए पर्ारन दरर्ाकलापों र्ा वतामान पर्ारन दरर्ाकलापों का जवस्ट्तार, केन्द्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा िारी मागाििाक जसद्धांतों तथा पारर-पर्ारन, पारर-जिक्षा और पारर-जवकास पर बल िने े वाले राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पारर-पर्ारन संबंधी मागाििाक जसद्धांत (समर्-समर् पर र्था संिोजधत) के अनुसार होगा; (iii) िब तक इस आंचजलक महार्ोिना को अनुमोदित नहीं कर दिर्ा िाता तब तक पर्ारन के जवकास और वतामान पर्ारन दरर्ाकलापों के जवस्ट्तार की कोई भी अनुमजत संबंजधत जवजनर्ामक प्राजधकरणों के द्वारा ही िी िाएगी, िो दक जनगरानी सजमजत की वास्ट् तजवक स्ट्थल जवजिष्ट वास्ट्तजवक संवीक्षा और संस्ट् तुजत पर आधाररत होगी और पाररजस्ट्थजतकी संवेिी िोन म ें दकसी नए होरल, ररिॉरा र्ा वाजणज्र्क स्ट्थापना के जनमााण की अनुमजत नहीं होगी। (4) नसै र्वगक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन म ें बहुमूल्र् नैसर्वगक जवरासत के सभी स्ट्थलों िैसे दक िीन कोि आरजक्षत क्षत्रे , िैल संरचना, िल प्रपात, झरने, िरे, उपवन, गैु ाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्वमत जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन म ें भवनों, संरचनाओं, कलाकरजतर्ों ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्करजतक महत्व के क्षेत्रों अथवा आस –पास के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें तैर्ार की िाएगी। (6) ध्व जन प्रििू ण.- पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रििू ण के जनवारण और जनर्ंत्रण का अनुपालन पर्ाावरण अजधजनर्म (सरं क्षण ), 1986 के अधीन तथा समर् समर् पर र्था संिोजधत ध्वजन प्रििू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 के उपबंधों के अनुसार दकर्ा िाएंगा। (7) वार् ु प्रििू ण. - पाररजस्ट्थजतकी संवेिी िोन म ें वार्ु प्रििू ण का जनवारण और जनर्ंत्रण का अनुपालन वार् ु (प्रििू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्म तथा उनम ें संिोधन के उपबंधों के अनुसार दकर्ा िाएगा। (8) बजहस्राव का जनस्ट्सरण. - पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत बजहस्राव का जनस्ट्सारण समर् समर् पर र्था संिोजधत, िल (प्रििू ण जनवारण तथा जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) पर्ाावरण अजधजनर्म (संरक्षण ), 1986 और उसके अधीन बनाए गए जनर्मों र्ा रा्र् सरकार द्वारा जनधााररत मानकों, िो भी अजधक किोर हो, के उपबंधों के अनुसार दकर्ा िाएगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (9) िोस अपजिष्ट. - िोस अपजिष्ट का जनपरान और प्रबन्द्धन जनम्नानुसार दकर्ा िाएगा: - (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट का जनपरान और प्रबंधन भारत सरकार द्वारा पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर् समर् पर र्थासंिोजधत अजधसूचना स.ं का.आ. 1357(अ), तारीख 08 अप्रैल, 2016 के अधीन प्रकाजित िोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथों का जनपरान पाररजस्ट्थजतकी संवेिी िोन से बाहर अजभज्ञात दकए गए स्ट्थान पर पर्ाावरणीर् स्ट् वीकार्ा रीजत से दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् प्रौद्योजगदकर्ों का प्रर्ोग करत े हुए वतामान जनर्मों और जवजनर्मों के अनरूु प िोस अपजिष्ट के सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन(ईएसएम) की अनुमजत िी िा सकती ह।ै (10) िवै जचदकत्सा अपजिष्ट. - िैव जचदकत्सा अपजिष्र का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी-संवेिी िोन म ें िैव-जचदकत्सा अपजिष्ट का जनपरान, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा समर्-समर् पर र्था संिोजधत, अजधसूचना संख्र्ा सा.का.जन.343(अ), तारीख 28 माच,ा 2016 द्वारा प्रकाजित िैव-जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के अधीन दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन में अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करते हुए वतामान जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्ट को सुरजक्षत और पर्ाावरण अनकु ूल प्रबंधन (ईएसएम) की अनमु जत िी िाएगी। (11) प्लाजस्ट्रक अपजिष्ट का प्रबधं न- पाररजस्ट्थजतकी संवेिी िोन म ें प्लाजस्ट्रक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा, समर्-समर् पर र्थासंिोजधत; अजधसूचना संख्र्ा सा.का.जन.340(अ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्रक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अधीन दकर्ा िाएगा; (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न- पाररजस्ट्थजतकी-संवेिी िोन में जनमााण एवं जवध्वंस अपजिष्ट प्रबधं न, भारत सरकार के पर्ाावरण, वन एवं िलवार्ु पररवतान मंत्रालर् द्वारा समर्-समर् पर र्थासंिोजधत, अजधसूचना संख्र्ा सा.का.जन.317(अ), तारीख 29 माचा, 2016 के द्वारा प्रकाजित जनमााण एवं जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अधीन दकर्ा िाएगा; (13) ई–अपजिष्ट - पाररजस्ट्थजतकी संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित समर्-समर् पर र्थासंिोजधत; ई–अपजिष्ट प्रबंधन जनर्म, 2016, के उपबंधों के अधीन दकर्ा िाएगा। (14) सड़क-र्ातार्ात - सड़क-र्ातार्ात को पर्ाावास अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना म ें जविेि प्रावधान सजममजलत दकए िाएंगे। आंचजलक महार्ोिना के तैर्ार होन े और रा्र् सरकार के सक्षम प्राजधकारी से अनुमोदित होन े तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके अधीन बनाए गए जनर्मों एवं जवजनर्मों के अनुसार सड़क-र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन िजनत प्रििू ण. – वाहन प्रििू ण का जनवारण और जनर्ंत्रण लाग ू कानूनों के अनुसार दकर्ा िाएगा और स्ट्वच्छ ईंधन िैसे संपीजड़त प्राकरजतक गैस, तरलीकरत पेरोजलर्म गैस आदि के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ां.- (क) सरकारी रािपत्र म ें इस अजधसचू ना के प्रकािन तक र्ा उसके पिात ् पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए प्रििू णकारी उद्योग की स्ट्थापना की अनुमजत नहीं िी िाएगी;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (ख) केन्द्द्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा ैरवरी, 2016 में िारी जसद्धान्द्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्दिष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रििू णकारी उद्योगों को अनुमत दकर्ा िाएगा और इसके अजतररि, गैर प्रििू णकारी कुरीर उद्योगों का संवधान दकर्ा िाएगा। (17) पहाड़ी ढलानों का सरं क्षण -पहाड़ी ढलानों का संरक्षण जनम्नानसु ार दकर्ा िाएगा :- (क) आंचजलक महार्ोिना म ें पहाड़ी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी जनमाणा की अनुमजत नहीं होगी; (ख) जिन जवद्यमान ढलानों र्ा खड़ी पहाड़ी ढलानों म ें अत्र्जधक भू-क्षरण होता ह ै उनम ें दकसी भी जनमााण की अनुमजत नहीं होगी। 4. पाररजस्ट्थजतकी सवं िे ी िोन म ें प्रजतजिद्ध र्ा जवजनर्जमत दकए िान े वाल े दरर्ाकलापों की सचू ी .-पाररजस्ट्थजतकी संवेिी िोन म ें सभी दरर्ाकलाप पर्ावा रण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) और उसके अधीन जनर्वमत जनर्मों तथा पूवावती पर्ाावरण एव ं वन मंत्रालर् द्वारा तारीख 14 जसतंबर, 2006 को संख्र्ा 1533(अ) के अधीन पर्ाावरण, वन और वन्द्र्िीवों से संबंजधत भारत सरकार की अन्द्र् अजधसूचनाओं, जवजधर्ों तथा समर्-समर् पर उसमें दकए गए संिोधनों के उपबंधों द्वारा नीच ेिी गई सारणी में जवजनर्दिष्ट तरीके से लाग ूहोग ें; अथाात:्- सारणी र.स ं. दरर्ाकलाप ररप्पणी क . प्रजतजिद्ध दरर्ाकलाप (1) व ाजणज्र्क खनन, पत्थर उत्खनन और (क) पाररजस्ट्थजतकी संवेिी िोन में घरों के जनमााण र्ा मरममत के जलए जपसाई इकाइर्ां। खुिाई सजहत वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेलू िरूरतों को पूरा करने के अलावा, सभी नए और मौिूिा (लघ ु और प्रमुख खजनि), पत्थर खनन और पेराई इकाइर्ों पर तत्काल प्रभाव से प्रजतजिद्ध होगा; (ख) खनन कार्ा माननीर् उच्चतम न्द्र्ार्ालर् के तारीख 4 अगस्ट्त, 2006 के आििे (री.एन. गोिावमान जथरुमलु पाि बनाम भारत संघ के मामले में, ररर र्ाजचका संख्र्ा 202/1995) और तारीख 21 अप्रैल, 2014 के आििे (गोवा ैाउंडेिन बनाम भारत संघ के मामले में, ररर र्ाजचका संख्र्ा 435/2012); और आईए संख्र्ा 1000 वि ा 2003 तारीख 03 िून, 2022। आईए संख्र्ा 131377 विा 2022, तारीख 26 अप्रैल, 2023 और 28 अप्रैल, 2023 के जनणार् और आईए संख्र्ा 162023, 162034, 162154 और 162155 वि ा2025 में तारीख 23 िुलाई 2025 के बाि के जनणार् र्ा खनन के संबंध में कोई और आििे के अनुसार दकए िाएंगे। (2) प्र ििू ण (िल, वार्ु, मरिा, ध्वजन, आदि) पाररजस्ट्थजतकी संवेिी िोन में नए उद्योगों की स्ट्थापना और मौिूिा उत्पि करने वाले उद्योगों की स्ट्थापना। प्रििू णकारी उद्योगों के जवस्ट्तार की अनुमजत नहीं िी िाएगी। मौिूिा उद्योगों को प्रििू ण रोकथाम तकनीक और ध्वजन अवरोधक लगाने होंगे। (3) ब ड़ी िल जवद्युत पररर्ोिनाओं की स्ट्थापना। प्रजतजिद्ध । (4) दक सी पररसंकरमर् पिाथा का वाजणज्र्क उपर्ोग। प्रजतजिद्ध । ख. जवजनर्जमत दरर्ाकलाप (9) होरलों और ररजॉरों की वाजणज्र्क पाररजस्ट्थजतकी पर्ारन दरर्ाकलापों हते ु लघु व ‎अस्ट्थार्ी संरचनाओं के स्ट्थापना। जनमााण के जसवार्, संरजक्षत ‎क्षेत्र की सीमा से एक दकलोमीरर के भीतर र्ा ‎पाररजस्ट्थजतकी-संवेिी िोन की सीमा तक, इनमें िो ‎भी अजधक जनकर हो, नए होरलों, ररसोरों और ‎व्यापाररक प्रजतष्ठानों के स्ट्थापना की अनुमजत नहीं ‎होगी:‎ ‎ बिते दक संरजक्षत क्षेत्र की सीमा से एक ‎दकलोमीरर बाहर र्ा पाररजस्ट्थजतकी-संवेिी िोन की ‎सीमा तक, इनमें िो भी अजधक जनकर हो, पर्ारन ‎महार्ोिना और लाग ू मागाििाक जसद्धांतों के ‎अनुसार सभी नए पर्ारन दरर्ाकलाप करने र्ा ‎जवद्यमान दरर्ाकलापों का जवस्ट्तार करने की ‎अनुज्ञा होगी । (10) स ंजनमाणा दरर्ाकलाप। ‎(क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीरर ‎िार्रे में र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा ‎तक, िो भी जनकरतम हो, दकसी भी प्रकार के नए ‎वाजणज्र्क जनमाणा की अनुमजत नहीं िी िाएगी:‎ बिते, स्ट्थानीर् लोगों को स्ट्थानीर् जनवाजसर्ों की ‎आवासीर् आवश्र्कताओं को पूरा करने के जलए ‎भवन उप-जनर्मों के अनुसार पैराग्राै 3 के उप-‎पैरा (1) में सूचीबद्ध दरर्ाकलापों सजहत उनके ‎उपर्ोग के जलए उनकी भूजम पर जनमााण कार्ा ‎करने की अनुमजत िी िा सकेगी:‎ बिते र्ह और दक प्रििू ण न ैैलाने वाले लघु ‎उद्योगों से संबंजधत जनमाणा संबंधी दरर्ाकलापों को ‎प्रर्ो्र् जनर्मों और जवजनर्मों, र्दि कोई हो, के ‎अनुसार तथा सक्षम प्राजधकारी से पूवा अनुमोिन से ‎जवजनर्जमत दकर्ा िाएगा और न्द्र्ूनतम ही रखा ‎िाएगा। ‎ ‎(ख) एक दकलोमीरर के िार्रे से आगे इसे ‎आंचजलक महार्ोिना के अनुसार जवजनर्जमत दकर्ा ‎िाएगा। (11) ग ैर प्रििू णकारी लघु उद्योग। ैरवरी 2016, में केन्द्द्रीर् प्रििू ण जनर्ंत्रण बोडा द्वारा िारी उद्योगों के वगीकरण के अनुसार और अपररसंकरमर्, लघु पैमाने के और सेवा उद्योग, उद्यान करजि र्ा पुष्प करजि र्ा करजि पाररजस्ट्थजतकी संवेिी िोन की ििे ि सामग्री से उत्पािों का उत् पािन करने वाले करजि आधाररत उद्योग को सक्षम प्राजधकारी द्वारा अनुमजत िी िाएगी। (12) व रक्षों की कराई। (क) रा्र् सरकार के सक्षम प्राजधकारी की पूव ा अनमु जत के जबना वन, सरकारी, रािस्ट्व र्ा जनिी भूजम पर से वरक्षों की कराई की अनुज्ञा नहीं होगी। (ख) वरक्षों की कराई को संबंजधत केन्द्द्रीर् र्ा रा्र् अजधजनर्म तथा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत दकर्ा िाएगा। (13) व न उत्पािों और गैर काष्ठ वन उत्पािों लागू जवजधर्ों के अधीन जवजनर्जमत होगा। (एनरीएैपी) का संग्रहण। (14) जव द्युत और संचार रॉवर लगाने, तार- लाग ू जवजधर्ों के अधीन जवजनर्जमत (भूजमगत केबल जबछाने को बढ़ावा दिर्ा िाए)। जबछाने तथा अन्द्र् बुजनर्ािी ढांचे की व्यवस्ट्था।[भाग ‎दरर्ाकलापों िैसे लागू जवजधर्ों के अधीन जवजनर्जमत होगा। वार्ुर्ान, ‎हॉर एर्र बैलून, ‎हेजलकॉप्रर, ड्रोन, ‎माइरोलाइट्स आदि द्वारा ‎संरजक्षत क्षेत्र और ‎पाररजस्ट्थजतकी संवेिी िोन ‎क्षेत्र के ऊपर से उड़ने के ‎दरर्ाकलाप करना। ‎ (18) प हाड़ी ढलानों और निी तरों का संरक्षण। लागू जवजधर्ों के अधीन जवजनर्जमत होगा। (19) र ात के समर् वाहनों का आवागमन। लाग ूजवजधर्ों के अधीन व् र्ावसाजर्क उद्देश्र् के जलए जवजनर्जमत। (20) ै मों, कंपजनर्ों, कॉरपोरेट्स द्वारा बड़े पैमाने स्ट्थानीर् िनता के प्रर्ोग के जलए लागू जवजधर्ों के अधीन अनुमत होंगे। पर वाजणज्र्क पिुधन और कुक्कुर ैामों इत्र्ादि की स्ट्थापना। (21) प्र ाकरजतक िल जनकार्ों र्ा भूजम क्षेत्र में उपचाररत अपजिष्ट िल र्ा अपजिष्टों को िल जनकार्ों में िाने से रोका उपचाररत अपजिष्ट िल/अपजिष्टों का िाएगा और उपचाररत अपजिष्ट िल के पुनचारण और पुनः उपर्ोग के जनवाहन। जलए प्रर्ास दकए िाएंगे। अन्द्र्था, अनुपचाररत अपजिष्ट िल/अपजिष्टों के जनवाहन को लागू जवजधर्ों के अधीन जवजनर्जमत दकर्ा िाएगा। (22) स तही और भूिल का वाजणज्र्क जनष्किाण । लाग ूजवजधर्ों के अनुसार जवजनर्जमत। (23) क रजि र्ा अन्द्र् उपर्ोग के खुला कुआाँ, बोरवेल लाग ूजवजधर्ों के अनुसार जवजनर्जमत। आदि। (24) ि ोस अपजिष्ट प्रबंधन। लाग ूजवजधर्ों के अनुसार जवजनर्जमत। (25) जव ििे ी प्रिाजतर्ों का र्ाावरण के प्रजत िागरुकता। सदरर् रूप से संवधान दकर्ा िाएगा। 5. जनगरानी सजमजत - केन्द्द्रीर् सरकार, पर्ाावरण (सरं क्षण) अजधजनर्म, 1986 की धारा 3 की उपधारा (3) के अधीन इस अजधसूचना के उपाबंधों की प्रभावी और पर्ाावरण के क्षेत्र में दकसी जव्ववजवद्यालर् र्ा संस्ट्थान से एक सिस्ट्र्; जविेिज्ञ, जिसे जहमाचल प्रििे रा्र् सरकार द्वारा समर्-समर् पर प्रत्र्ेक तीन विा में नामजनर्दिष्ट दकर्ा िाएगा 4. वररष्ठ पाररजस्ट्थजतकी संवेिी िोन म ें आन े वाली गजतजवजधर्ों का इसके पैरा 4 के अधीन सारणी में जवजनर्दिष्ट प्रजतजिद्ध दरर्ाकलापों को छोडकरस्ट्थल जवजिष्ट वास्ट्तजवक पररजस्ट्थजतर्ों के आधार पर जनगरानी सजमजत द्वारा संवीक्षा की िाएगी और संबंजधत जवजनर्ामक प्राजधकरणों को संिर्वभत दकर्ा िाएगा। (3) जनगरानी सजमजत का सिस्ट्र्-सजचव र्ा संबंजधत कलेक्रर र्ा संबंजधत उप वन संरक्षक पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की The major vegetation found in and around Bandli Wildlife Sanctuary are Amla (Phyllanthus emblica), Khair (Acacia catechu), Amaltas (Cassia fistula), Bahera (Terminalia bellerica), Shisham (Dalbergia sissoo), Jamun (Syzygium cumini), Banj oak (Quercus leucotrichophora), Indian bay leaf (Cinnamomum tamala), Ficus benghalensis, Flacourita ramontchi, Girardiana hetrephylla, Grewia oppositiflia, Hedra helix, Hypericum cernum, Jatropha cucus, Indigophera spp, Jasminum pubescence, Kasminum humile, Lennea grandis, Litsea spp, Mallotus phillipinenesis, Mangifera indica, Pinus roxburghii, Dodonaea viscose, Murraya spp., Euphorbia roylean, Bauhinia vahlii, Pueraria tuberose etc.; AND WHEREAS the important faunal species including avifauna found in the area comprises of Panthera pardus, Felis bengalensis, Felis chaus, Nemorhaedus goral, Paguma larvata, Martes flavigula, Selenarctos thibetanus, Petaurista petaurista, Macaca mulatta, Presbytis entellus, Muntiacus muntjak, Lepus nigricollis, Hystrix indica, Sus scrofa, Francolinus francolinus, Gallus gallus, Lophura leucomelanos, Gyps himalayensis, Accipiter badius, Catreus wallichii, Picus canus, Dicrurus macrocercus, Urocissa erythroryncha, Dicrurus macrocercus, Turdoides striata etc.; AND WHEREAS it is necessary to conserve and protect the area, extent and boundary which is specified in paragraph 1 of this notification around the Bandli Wildlife Sanctuary as Eco-sensitive zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub section (l) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub- rule (3) of Rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area to an extent of 1 to 2.1 kilometre around the boundary of Bandli Wildlife Sanctuary in the State of Himachal Pradesh as the Bandli Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely: - Extent and boundaries of Eco-sensitive Zone. – (1) the extent of Eco-Sensitive Zone shall vary from 1 to 2.1 kilometre around the boundary of Bandli Wildlife Sanctuary encompassing an area of 28.1872 square kilometre. The Eco-sensitive Zone extent is provided in table below: North 2.1 kilometre North- East 1 kilometre East 1.3 kilometre South-East 1.1 kilometre South 1.6 kilometre South-West 1 kilometre West 1.3 kilometre North-West 1 kilometre (2) The boundary description of Eco-sensitive Zone is appended as Annexure- I. (3) The map of the Eco-Sensitive Zone along with boundary details is appended as Annexure-II A and Annexure- II B. (4) The geo-coordinates of the protected areas and its Eco-sensitive Zone are appended as Annexure-III. (5) The list of 62 villages falling within the Eco-sensitive Zone is appended as Annexure-IV. (6) Detailed Area Statement of Eco-Sensitive Zone around Bandli Wildlife Sanctuary is appended as Annexure- V. 2. Zonal Master Plan for Eco-Sensitive Zone. — (1) The State Government shall, for the purpose of the Eco-sensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan: i. Environment; ii. Forest and Wildlife; iii. Urban Development; iv. Rural Development; v. Tourism; vi. Revenue; vii. Agriculture; viii. Animal Husbandry; ix. Himachal Pradesh State Pollution Control Board; x. Irrigation and Flood Control; xi. Municipality and Panchayati Raj; xii. Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government. — The State Government shall take the following measures for giving effect to the provisions of this notification, namely: - (1) Land use. — (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities. Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as: i. Widening and strengthening of existing roads and construction of new roads; ii. Construction and renovation of infrastructure and civic amenities; iii. Small scale industries not causing pollution; iv. Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and v. Promoted activities given under paragraph 4.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies. — The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism. — a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; b) the Eco-Tourism Master Plan shall be prepared by State Department of Tourism in consultation with State Departments of Environment and Forests; c) the Tourism Master Plan shall form a component of the Zonal Master Plan; d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-Sensitive Zone; e) The activities of eco-tourism shall be regulated as under, namely: - (i) new construction of hotels and resorts shall not be allowed within one kilometer from the boundary of the protected area or upto the extent of the Eco-Sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-Sensitive Zone area. (4) Natural heritage. — All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (5) Man-made heritage sites.— Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. (6) Noise pollution. — Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 and as amended from time to time. (7) Air pollution.— Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto. (8) Discharge of effluents. — Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes. — Disposal and Management of solid wastes shall be as under: - a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 and as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (10) Bio-medical waste. — Bio medical waste management shall be as under: a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time. b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (11) Plastic waste management. — The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management. — The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste. — The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (14) Vehicular traffic. — The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution. — Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc. (16) Industrial units. —[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 25 a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. b) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016 as amended from time to time, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes. — The protection of hill slopes shall be as under: (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone. — All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under and other notifications, laws and Acts of the Government of India pertaining to environment, forests and wildlife, in the erstwhile Ministry of Environment and Forest, vide number 1533(E), dated the 14th September, 2006 and laws for the time being in force in the manner and as amended from time to time specified in the Table below, namely TABLE S. IA No. 131377 of 2022 judgment dated the 26th April, 2023 and the 28th April, 2023 and subsequent judgment dated the 23rd July 2025 in I.A Nos. 162023, 162034, 162154 and 162155 of 2025 or any further orders regarding mining. 2. Setting of industries causing pollution Establishment of new and expansion of existing polluting (Water, Air, Soil, Noise, etc.). industries in the Eco-sensitive Zone shall not be permitted. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer; Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents. Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan. 11. Small scale non-polluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016, as amended from time to time and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority. 12. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under. 13. Functions of Monitoring Committee. — (1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinise, the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification. (2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 29 (3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case-to-case basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in proforma specified in Annexure-VI, appended to this notification. (6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures. — The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Orders, Supreme Court, etc. — The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
