की धारा 3 की उपधारा (2) के खंड (v) और खडं (xiv) तथा उपधारा (3) के साथ परित उपधारा (1) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए िारी करने का प्रस्ट्ताव करती ह,ै पर्ाावरण (सरं क्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के अधीन अपेजक्षत रूप स,े उसस े प्रभाजवत होने वाली िनता की िानकारी के जलए प्रकाजित की िाती ह;ै और एति ्द्वारा र्ह सूचना िी िाती ह ैदक रािपत्र म ें िाजमल इस अजधसूचना की प्रजतर्ां िनता को उपलब्ध करने की तारीख स े साि दिन की अवजध की समाजि पर र्ा उसके पश्चात् इस मसौिा अजधसूचना पर जवचार दकर्ा िाएगा; मसौिा अजधसूचना म ें जनजहत प्रस्ट्तावों पर कोई आपजत्त र्ा सुझाव िेन े म ें रुजच रखन 3(ii)] 40 वगा दकलोमीटर तक फैलती ह ै और िीत ऋतु म ें लगभग 10 वगा दकलोमीटर तक कम हो िाती ह,ै जिसम ें स े 4.1 वग ा दकलोमीटर क्षत्रे को सरकारी अजधसूचना संख्र्ा एफआरएम.140/2005/260, तारीख 21 फरवरी, 2009 के अधीन वन्द्र्िीव अभर्ारण्र् के रूप म ेंअजधसूजचत दकर्ा गर्ा ह;ै और िबदक, िीपोर बील की आराभूजम िलीर् वनस्ट्पजतर्ों और पक्षी िीवों के जलए एक अजद्वतीर् आवास ह।ै अभर्ारण्र् म ें पजक्षर्ों की लगभग 150 प्रिाजतर्ााँ अजभजलजखत की गई ह ैं जिनम ें िो गंभीर रूप स े संकटग्रस्ट्त, एक संकटग्रस्ट्त, पााँच संवेिनिील और चार जनकट-संकटग्रस्ट्त प्रिाजतर्ााँ सजममजलत ह।ैं हाथी जनर्जमत रूप स े आस-पास के रानी और गरभगं ा आरजक्षत वनों स े इस आराभूजम पर आते ह,ैं जिससे बील उनके आवास का अजभन्न अंग बन िाता ह।ै इसके अजतररि, अभर्ारण्र् म ें सरीसृपों की 12 प्रिाजतर्ााँ, मछजलर्ों की 50 प्रिाजतर्ााँ, उभर्चरों की 6 प्रिाजतर्ााँ और िलीर् मैक्रो- बार्ोटा की 155 प्रिाजतर्ााँ अजभजलजखत की गई ह;ैं और िबदक, तेिी स े जवकजसत हो रह े गुवाहाटी िहर के समीप जस्ट्थत िीपोर बील वन्द्र्िीव अभर्ारण्र्, मानव बजस्ट्तर्ों के जवस्ट्तार और बढ़ती जवकासात्मक दक्रर्ाकलापों के कारण भारी िैजवक िबाव का सामना कर रहा ह।ै िहरी अपजिष्ट और औद्योजगक अपजिष्टों का बजहस्राव इस समृद्ध आराभूजम की पाररजस्ट्थजतकीर् और पर्ाावरणीर् मूल्र्ों के जलए गंभीर खतरा पैिा करता ह,ै जिससे िीपोर बील के भीतर सभी िीवन रूपों और पाररजस्ट्थजतकी तंत्रों को खतरा हो सकता ह।ै अभ्र्ारण्र् की िजक्षणी सीमा के साथ-साथ चलने वाली गुवाहाटी-गोलपाडा रेलमाग ातथा इसके िलग्रहण क्षेत्रों का अवक्रमण, आराभूजम पर प्रजतकूल प्रभाव डाल रहा ह।ै मानवीर् अजतक्रमण, बील के आसपास चल रहा जवकास, और इसके िलग्रहण क्षत्रे म ें आवासों का जवनाि इस महत्वपूणा आराभूजम के प्राकृजतक पाररजस्ट्थजतक स्ट्वरूप को बनाए रखने के जलए एकबडी चुनौती ह;ै और िबदक, र्ह अभर्ारण्र् समृद्ध और अजद्वतीर् िैव जवजवधता का समथान करता ह,ै िो जहमालर्न होरी बेलीड जगलहरी (कैलोजसर्ुरस पाइगेररथ्रस), हाउस श्रू िैव जवजवधता के िजृष्टकोण स े पाररजस्ट्थजतकी संवेिी िोन के रूप म ें सरं जक्षत और सुरजक्षत रखना आवश्र्क ह ै और उि पाररजस्ट्थजतकी संविे ी िोन म ें उद्योगों र्ा उद्योगों के वग ा और उनके संचालन और प्रदक्रर्ाओं को प्रजतजनषधे करना आवश्र्क ह;ै अतः अब, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित पर्ाावरण (सरं क्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) तथा उपधारा (2) के खण्ड (v) और (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, केन्द्रीर् सरकार असम राज्र् म ें िीपोर बील वन्द्र्िीव अभर्ारण्र् की सीमा के आसपास[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 के क्षत्रे को िीपोर बील वन्द्र्िीव अभर्ारण्र्, पाररजस्ट्थजतकी संवेिी िोन (जिसे इसके बाि पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप म ेंअजधसूजचत करती ह,ै जिसका ब्र्ौरा जनम्नानुसार ह,ै अथाात्:- (1)पाररजस्ट्थजतकी-सवं िे ी िोन का जवस्ट्तार और सीमा.- (1) पाररजस्ट्थजतकी संवेिी िोन की सीमा िीपोर बील वन्द्र्िीव अभर्ारण्र् की सीमा के आसपास 25.294 मीटर स े 5 दकलोमीटर तक ह,ै जिसम ें 38.84 वग ा दकलोमीटर का पाररजस्ट्थजतकी संवेिी िोन क्षत्रे सजममजलत ह।ै जवजभन्न दििाओं म ें पाररजस्ट्थजतकी संवेिी िोन की सीमा इस प्रकार ह:ै उत्तर 0.86 दकलोमीटर उत्तर -पूव ा 1.06 दकलोमीटर पूवा 1.08 दकलोमीटर िजक्षण -पूवा 25.294 दकलोमीटर िजक्षण 5.00 दकलोमीटर िजक्षण -पजश्चम 4.37 दकलोमीटर पजश्चम 0.75 दकलोमीटर उत्तर-पजश्चम 1.34 दकलोमीटर (2) पाररजस्ट्थजतकी संवेिी िोन का सीमा जववरण अनलु ग्नक-I म ें संलग्न ह।ै (3) पाररजस्ट्थजतकी संवेिनिील क्षत्रे के मानजचत्र सीमा जववरण सजहत अनलु ग्नक–IIक, अनलु ग्नक –IIख और अनलु ग्नक –IIग के रूप में सलं ग्न ह।ै (4) पाररजस्ट्थजतकी संवेिी िोन की सीमा और उसके संरजक्षत क्षत्रे के भू-जनििे ांक क्रमिः अनलु ग्नक - III और अनलु ग्नक- IV म ें संलग्न ह।ैं (5) पाररजस्ट्थजतकी संवेिी िोन म ें आन े वाल े 4 गांवों की सूची अनलु ग्नक-V के रूप म ें सलं ग्न ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख स े िो वषा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्र् के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसूचना म ें दिए गए अनुबंधों का पालन करत े हुए आंचजलक महार्ोिना तैर्ार करेगी। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस प्रकार तैर्ार की िाए, िैसा दक अजधसूचना में जवजनर्िाष् ट दकर्ा गर्ा ह ै और र्ह केंरीर् और राज्र् के प्रासंजगक कानूनों के अनुरुप और केंरीर् सरकार द्वारा िारी मागाििाक जसद्धांतों, र्दि कोई हों, के अनरूु प होगी। (3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करने के जलए राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ासे तैर्ार होगी.- (i) पर्ाावरण, वन और िलवार्ु पररवतान ; (ii) वन्द्र्िीव; (iii) िहरी जवकास; (iv) पंचार्ती राि; और ग्रामीण जवकास; (v) पर्ाटन; (vi) रािस्ट्व; (vii) कृजष; (viii) बागवानी; (ix) िल संसाधन;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (x) असम प्रिेि राज्र् प्रिषू ण जनर्त्रं ण बोडा। (xi) लसंचाई और बाढ़ जनर्ंत्रण; (xii) नगरपाजलका और; (xiii) लोक जनमााण और रािमागा। (4) इस अजधसूचना म,ें आंचजलक महार्ोिना म ें जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा, िब तक दक दकर्ा िाएगा तथा इस अजधसूचना म ें ऐसा दक जवजनर्िाष्ट न दकर्ा गर्ा था आचंजलक महार्ोिना की सभी अवसंरचनाओं और उसके दक्रर्ाकलापों म ें सुधार करके उन्द्ह े अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनाने की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना, म ें वनरजहत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल- संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐसे अन्द्र् पहलओंु का प्रावधान दकर्ा िाएगा, जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह ै। (6) आंचजलक महार्ोिना म ें सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों और दकस्ट् मों, कृजष क्षेत्रों, उपिाऊ भूजम, उद्यानों और उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा का जनधाारण मानजचत्रों के साथ दकर्ा िाएगा जिनम ें जवद्यमान तथा प्रस्ट्ताजवत भू-उपर्ोग जविेषताओं के ब्र्ौरा दिर्ा गर्ा ह ै। (7) इस आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी-संवेिी िोन के जवकास का जवजनर्जमत दकर्ा िार्ेगा और पैरा 4 की ताजलका म ें दिर् े गर् े प्रजतजसद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन दकर्ा िाएगा और स्ट्थ ानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजश्चत दकर्ा िाएगा और उसे बढावा दिर्ा िार्ेगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) राज्र् सरकार द्वारा अनुमोदित आंचजलक महार्ोिना मॉनीटरी सजमजत के जलए एक सिं भा िस्ट्तावेि होगी तादक वह इस अजधसूचना के उपबंधों के अनुसार अपन े कताव्यों का जनवहा न कर सके। 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्. - राज्र् सरकार अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्: - (1) भ-ू उपर्ोग. – (क) पाररजस्ट्थजतकी-संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खुल े स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा संपररवतना की अनुमजत नहीं होगी: परंतु पाररजस्ट्थजतकी-संवेिी िोन के भीतर कृजष और अन्द्र् भूजम, मॉनीटरी सजमजत की जसफाररि पर तथा राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन तथा इस अजधसूचना के उपबंधों के पूवा अनुमोिन स े स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं और दक्रर्ाकलापों को पूरा करने के जलए अनुमजत िी िा सकेगी, िैस,े - (i) जवद्यमान सडकों को चौडा करना, उन्द्ह ेंसुिढ़ृ करना और नई सडकों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का सजन्नमााण और नवीनीकरण; (iii) प्रिषू ण उत्पन्न न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योग एव ं ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और (v) पैराग्राफ-4 के मि में र्था उजल्लजखत बढ़ावा दिए गए दक्रर्ाकलापः परंत ु र्ह भी दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म तथा राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना एव ं संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगात अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनपु ालन दकए जबना वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के प्रर्ोग की अनुमजत नहीं होगी:[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 परंत ु र्ह भी दक पाररजस्ट्थजतकी-संवेिी िोन के अधीन आने वाली भूजम के अजभलेखों म ें हुई दकसी त्रुरट को, जनगरानी सजमजत के जवचार प्राि करने के पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार सुधारा िाएगा और उि त्रुरट को सुधारने की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह भी दक उपर्िुा त्रुरट को सुधारन े म,ें इस उप-परै ा म ें र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भ-ू उपर्ोग का पररवतान िाजमल नहीं होगा: (ख )अनुप्रर्िु र्ा अनुत्प ािक कृजष क्षेत्रों म ें वनीकरण तथा पर्ाावासों की बहाली के कार्ाकलापों स े पनु : वनीकरण दकए िाने के प्रर्ास दकए िाएगं े। (2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक िलमागों के िलग्रहण क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना म ें उनके संरक्षण और बहाली की र्ोिना िाजमल की िाएगी और राज्र् सरकार द्वारा मागाििका जसद्धांत इस प्रकार से तैर्ार दकए िाएंगे दक उसम ें ऐसे क्षेत्रों म ें र्ा उसके पास जवकास दक्रर्ाकलापों को जनषेध और जनबिंजधत दकर्ा गर्ा हो िो ऐसे क्षेत्रों के जलए नुकसानिार्क ह ै । (3) पर्टा न एव ं पाररजस्ट्थजतकी पर्टा न. – (क) पाररजस्ट्थजतकी-सवं ेिी िोन म ें सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी-संवेिी िोन संबंधी पर्ाटन महार्ोिना के अनुसार अनुमत होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् सरकार के पर्ाावरण और वन जवभाग के परामि ा स े पर्ाटन जवभाग द्वारा बनार्ी िाएगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना एक घटक के रूप म ें होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी-संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनमन ानुसार जवजनर्जमत दकए िाएंग,े अथाात:् - (i) संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी-संवेिी िोन की सीमा तक, इनम ें स ेिो भी अजधक जनकट हो: दकसी होटल र्ा ररिॉटा का नर्ा सजन्नमााण र्ा व्यापाररक प्रजतष्ठान के जनमाणा की अनुमजत नहीं िी िाएगी, परंत ु र्ह, पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए सरं जक्षत क्षत्रे की सीमा स े एक दकलोमीटर की िरू ी स े परे पाररजस्ट्थजतकी-संवेिी िोन की सीमा तक पूवा पररभाजषत और जनधााररत क्षेत्रों म ें पर्ाटन महार्ोिना के अनुसार, नए होटलों और ररिॉटा की स्ट्थापना और व्यापाररक प्रजतष्ठान की अनुमजत होगी; (ii) पाररजस्ट्थजतकी-संवेिी िोन के अन्द्िर सभी नए पर्ाटन दक्रर्ा-कलापों र्ा जवद्यमान पर्टा न दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतना मत्रं ालर् द्वारा िारी मागाििाक जसद्धांतों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िने े वाल े राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी मागाििाक जसद्धांतों (समर्-समर् पर र्था संिोजधत) के अनुसार होगा; (iii) िब तक आंचजलक महार्ोिना के अनुमोिन नहीं जमल िाता, तब तक पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को स्ट्थल-जवजिष्ट संवीक्षा और जनगरानी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमजत िी िाएगी और पाररजस्ट्थजतकी सवं ेिी िोन म ें दकसी नर् े होटल/ररिाटा र्ा वाजणजज्र्क प्रजतष्ठान का संजनमााण की अनुमजत नहीं िी िाएगी। (4) प्राकृजतक जवरासत. – पाररजस्ट्थजतकी-संवेिी िोन के अधीन आने वाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पलू ररिवा क्षत्रे , िैल संरचना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण मागा, उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी-संवेिी िोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (6) ध्व जन प्रिषू ण.- पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रिषू ण की रोकथाम और जनर्ंत्रण पर्ाावरण (संरक्षण) अजधजनर्म, 1986 के अधीन तथा समर्-समर् पर र्थासंिोजधत ध्वजन प्रिषू ण (जवजनर्मन और जनर्त्रं ण) जनर्म 2000 और इसके उपबंधों के अनुसार दकर्ा िाएगा। (7) वार् ु प्रिषू ण. - पाररजस्ट्थजतकी संवेिी िोन म ें वार् ु प्रिषू ण का जनवारण और जनर्ंत्रण वार् ु (प्रिषू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और पर्ाावरण (संरक्षण ) अजधजनर्म 1986 और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (8) बजहस्राव का जनस्ट्सरण. - पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सारण; - िल (प्रिषू ण जनवारण तथा जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) और पर्ाावरण (संरक्षण) अजधजनर्म 1986 और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा। (9) िोस अपजिष्ट. - िोस अपजिष्टों का जनपटान जनम्नजलजखत रूप म ेंहोगा-- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट का जनपटान और प्रबन्द्धन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना संख्र्ा का.आ. 1357 (अ), तारीख 8 अगस्ट्त, 2016 के अधीन प्रकाजित िोस अपजिष्ट प्रबंधन जनर्म, 2016, समर् -समर् पर र्था संिोधनों उपबंधों अनुसार दकर्ा िाएगा; अकाबाजनक सामग्री का जनपटान पर्ाावरणीर् रीजत म ें पाररजस्ट्थजतकी संवेिी िोन स े बाहर अजभज्ञात स्ट्थल पर दकर्ा िाएगा । (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करत े हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबधं न अनुज्ञात दकर्ा िार्ेगा। (10) िवै जचदकत्सा अपजिष्ट. - िैव जचदकत्सा अपजिष्ट का प्रबधं न जनम्नजलजखत रूप म ें होगा- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना संख्र्ा सा.का.जन. 343 (अ), तारीख 8 अप्रलै , 2016 के अधीन प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016, समर् -समर् पर र्था संिोजधत उपबधं ों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन म ें अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करत े हुए जवद्यमान जनर्मों और जवजनर्मों के अनरूु प िैव जचदकत्सा अपजिष्ट के सरु जक्षत और पर्ाावरण अनुकूल प्रबधं न की अनुमजत िी िाएगी। (11) प्लाजस्ट्टक अपजिष्ट का प्रबधं न. – पाररजस्ट्थजतकी संवेिी िोन म ें प्लाजस्ट्टक अपजिष्ट का प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर् -समर् पर र्था संिोजधत अजधसूचना संख्र्ा सा.का.जन. 340 (अ), तारीख 28 माच,ा 2016, के अधीन प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधो के अनुसार दकर्ा िाएगा। (12) सजन्नमाणा और जवध्वसं अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी-संवेिी िोन म ें सजन्नमााण और जवध्वंस अपजिष्ट का प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर् -समर् पर र्था संिोजधत अजधसूचना संख्र्ा सा.का.जन. 317 (अ), तारीख 29 माच,ा 2016 के अधीन प्रकाजित सजन्नमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट. - पाररजस्ट्थजतकी-संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित और समर् -समर् पर र्था संिोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। 14. वाहन र्ातार्ात .- वाहन र्ातार्ात को पर्ाावास-अनकु ूल तरीके स े जवजनर्जमत दकर्ा िाएगा और इस संबंध म ें आंचजलक महार्ोिना म ें जविेष उपबंध सजममजलत दकए िाएंग े और आंचजलक महार्ोिना के तैर्ार होन े और राज्र् सरकार के सक्षम प्राजधकारी स े अनुमोदित होने तक, मॉनीटरी सजमजत सुसंगत अजधजनर्मों और उनके अधीन बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार वाहन र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन प्रिषू ण.- वाहन प्रिषू ण की रोकथाम और जनर्ंत्रण लाग ू कानूनों के अनुसार दकर्ा िाएगा। स्ट्वच्छ ईंधन िैस े सीएनिी, एलपीिी आदि के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ा.ं - (क) रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पश्चात् पाररजस्ट्थजतकी-संवेिी िोन के भीतर कोई नए प्रिषू णकारी उद्योगों की स्ट्थापना की अनुमजत नहीं िी िाएगी। (ख) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016, समर्-समर् पर िारी र्था संिोजधत िारी मागाििाक जसद्धान्द्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में ऐसा जवजनर्िाष्ट न दकर्ा गार्क हो, पाररजस्ट्थजतकी-संवेिी िोन के भीतर केवल गरै -प्रिषू णकारी उद्योगों को अनुमजत िी िाएगी और इसके अजतररि, गैर प्रिषू णकारी उद्योगों को बढ़ावा दिर्ा िाएगा। (17) पहाडी ढलानों का सरं क्षण. - पहाडी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना म ें पहाडी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी प्रकार के जनमााण कार् ा की अनुज्ञा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खडी पहाडी ढलानों म ेंअत्र्जधक भू-क्षरण होता ह ैउनम ें दकसी भी प्रकार के जनमााण कार् ा की अनुज्ञा नहीं होगी ।[भाग अपघषणा इकाईर्ा ाँ मरममत के जलए जमट्टी खोिने सजहत स्ट्थानीर् । जनवाजसर्ों की घरेलू िरूरतों को परू ा करन े को छोडकर, सभी नए और मौिूिा खनन (लघु और प्रमुख खजनि), पत्थर उत्खनन और उनके तोडने की इकाइर्ों के तत्काल प्रभाव स ेप्रजतजनजषद्ध दकर्ा गर्ा ह;ै (ख) खनन कार्,ा टी.एन. गोिावमान जथरुमुलपाि बनाम र्ओू आई के डब्ल्र्.ूपी.(सी) संख्र्ा 1995 का 202 के मामल े म;ें दिनांक 4 अगस्ट्त, 2006 के (आिेिों)गोवा महार्ोिना और लागू मागाििका जसद्धांतों के अनुसार होगा। सभी नए पर्ाटन दक्रर्ाकलाप करने र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार करने की अनुज्ञा होगी । 12 संजनमााण दक्रर्ाकलाप । (क) संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर िार्रे म ें र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकटतम हो, दकसी भी प्रकार के नए वाजणजज्र्क जनमााण की अनुमजत नहीं िी िाएगी: परंत,ु स्ट्थानीर् लोगों को स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करन े के जलए भवन उप-जनर्मों के अनुसार परै ाग्राफ 3 के उप-परै ा (1) म ें सूचीबद्ध दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम पर जनमााण कार् ा करने की अनुमजत िी िा सकेगी: परंतु र्ह और दक प्रिषू ण न फैलाने वाले लघ ु उद्योगों से संबंजधत जनमााण संबंधी दक्रर्ाकलापों को प्रर्ोज्र् जनर्मों और जवजनर्मों, र्दि कोई हो, के अनुसार तथा सक्षम प्राजधकारी से पूवा अनुमजत लेकर जवजनर्जमत दकर्ा िाएगा और न्द्र्ूनतम ही रखा िाएगा। (ख) एक दकलोमीटर के िार्रे स े आगे इस े आंचजलक महार्ोिना के अनुसार जवजनर्जमत दकर्ा िाएगा। 13 लघ ु पैमाने के प्रिषू ण न फैलाने फरवरी, 2016 म the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration Draft Notification WHEREAS, the Deepar Beel Wildlife Sanctuary located in the south–western side of Guwahati city in Kamrup (Metropolitan) district of Assam and the only Ramsar site in the State, is one of the largest freshwater lakes of Assam, which extends up to 40 square kilometer in the summer and reduces to about 10 square kilometer in the winter, of which an area of 4.1 square kilometer has been notified as Wildlife Sanctuary as per the Govt. Notification no. FRM.140/2005/260, dated the 21st February, 2009; AND WHEREAS the wetland of Deepar Beel constitutes a unique habitat for aquatic flora and avian fauna. Around 150 species of birds have been recorded in the Sanctuary including two critically endangered, one endangered, five vulnerable and four near-threatened species. Elephants regularly visit the wetland from the adjoining Rani and Garbhanga Reserved Forests, making the Beel an integral part of their habitat. Additionally, 12 species of reptiles, 50 species of fishes, 6 species of amphibians, and 155 species of aquatic macro-biota have been documented in the sanctuary; AND WHEREAS the Deepar Beel Wildlife Sanctuary located adjacent to the rapidly developing city of Guwahati, is facing immense biotic pressure due to expanding human settlements and increasing developmental activities. The discharge of city waste and industrial effluents poses a serious threat to the ecological and environmental integrity of this rich wetland, endangering all life forms and ecosystems within Deepar Beel. The Guwahati–Goalpara railway track, which runs along the southern boundary of the sanctuary, along with the degradation of its watershed areas, further impacts the wetland adversely. Human encroachment, ongoing development around the Beel, and the destruction of habitats in its watershed pose a significant threat to maintaining the natural ecological character of this important wetland; AND WHEREAS the sanctuary supports rich and unique biodiversity which is home to mammals species like Himalayan hoary bellied squirrel (Callosciurus pygerythrus), House shrew (Suncus murinus), Pigmy shrew (Suncus etruscus), Large bandicota-rat (Bandicota indica), Lesser bandicota-rat (Bandicota bengalensis), black rat (Rattus rattus), Chinese procupine (Hystrix brachyura), Indian hare (Lepus nigricollis), Indian elephant (Elephas maximus indicus), Barking deer (Muntiacus muntjak), Sambar (Cervus unicolor), Indian flying fox (Pteropus gigenteus), Long- winged tom bat (Taphozous longimanus), Rhesus macaque (Macaca mulatta), Asiatic jackel (Canis aureus), Common otter (Lutra lutra) etc.; AND WHEREAS the major the flora species available in the Deepar Beel Wildlife Sanctuary are Water Thyme (Hydrilla verticellata), Common water hyacinth (Eichhornia crassipes). Eel grass (Vallisnaria spiralis), Bladderworts (Utricularia flexuosa). Water nut (Trapabis pinosa), Prickly Waterlily/Makhana (Euryale ferox), Guppy Grass (Najas indica), Hastate-leaved pondweed (Monochoria hastaefolia), Bush Morning Glory (Ipomoea fistulosa). Asian watergrass (Hygroryza aristata). Water pepper (Polygonum hydropiper), Indian marshweed (Limnophila sp.), etc.; AND WHEREAS the threatened avifauna recorded from the Deepar Beel Wildlife Sanctuary are White rumped vulture (Gyps bengalensis), Long billed vulture (G. indicus), Greater adjutant (Leptoptilosdubius), spotbilled pelican (Pelecanusphilippensis), lesser adjutant stork (Leptoptilos javanicus), Pallas’s sea eagle (Haliaeetus leucorphus), Fulvous whistling teal (Dendrocygna bicolor),40 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Baer’s pochard (Aythya baeri), Spoon billed sandpiper (Eurynorhynchus pygmeus), Black- necked stork (Ephippiorhynchus asiaticus), Red headed vulture (Sarcogyps calvus), Pallid harrier (Circus macrourus), Black-bellied tern (Sterna acuticauda), Red-headed vulture (Sarcogyps calvus) etc. While endangered reptiles found in the Sanctuary are Burmese python (Python molurusbivittatus), Yellow monitor lizard (Varanus flavescens), Indian roofed turtle (Kachuga tecta), Assam roofed turtle (Pangsura sylhetensis), Spotted black (pond) turtle (Geoclemys hamiltoni), Indian mud flapshell turtle (Lissemys punctata), Peacock softshell turtle (Nilssonia hurum), Ganges Indian soft-shell turtle (Trionyx gangeticus) etc.; AND WHEREAS it is necessary to conserve and protect the area, extent and boundary which is specified in paragraph 1 of this notification around the protected area of Deepar Beel Wildlife Sanctuary as Eco-sensitive zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub section (l) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of Rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area around the boundary of Deepar Beel Wildlife Sanctuary in the State of Assam as the Deepar Beel Wildlife Sanctuary, Eco-sensitive Zone (herein after referred to as the Eco- sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of Eco-sensitive Zone. – (1) the extent of Eco-Sensitive Zone is 25.294 meter to 5 kilometer around the boundary of Deepar Beel Wildlife Sanctuary encompassing an ESZ area of 38.84 square kilometre. The extent of Eco-sensitive Zone at different directions are: North 0.86 kilometre North- East 1.06 kilometre East 1.08 kilometre South-East 25.294 kilometre South 5.00 kilometre South-West 4.37 kilometre West 0.75 kilometre North-West 1.34 kilometre (2) The boundary description of Eco-sensitive Zone is appended as Annexure- I. (3) The maps of the Eco-Sensitive Zone along with boundary details are appended as Annexures- II A, II B and II C. (4) The geo-coordinates of the boundary of protected area and its Eco-sensitive Zone is appended as Annexure- III and Annexure- IV respectively. (5) The list of 4 villages falling within the Eco-sensitive Zone is appended as Annexure- V. 2. Zonal Master Plan for Eco-Sensitive Zone. – (1) The State Government shall, for the purpose of the Eco-sensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 41 (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan: i. Environment Forest and Climate Change; ii. Wildlife; iii. Urban Development; iv. Panchayati Raj and Rural Development v. Tourism; vi. Revenue; vii. Agriculture; viii. Horticulture; ix. Water Resources; x. Assam State Pollution Control Board; xi. Irrigation and Flood Control; xii. Municipality and; xiii. Public Works and Highways (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government. -The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities. Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State42 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as: i. Widening and strengthening of existing roads and construction of new roads; ii. Construction and renovation of infrastructure and civic amenities; iii. Small scale industries not causing pollution; iv. Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and v. Promoted activities given under paragraph 4. Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.– The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism.– a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; b) the Eco-Tourism Master Plan shall be prepared by State Department of Tourism in consultation with State Departments of Environment and Forests; c) the Tourism Master Plan shall form a component of the Zonal Master Plan; d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco- Sensitive Zone; e) the activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometer from the boundary of the protected area or upto the extent of the Eco-Sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 43 allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco- Sensitive Zone area. (4) Natural heritage.– All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.– Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. (6) Noise pollution.– Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986 and as amended from time to time. (7) Air pollution.– Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto. (8) Discharge of effluents.– Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.– Disposal and Management of solid wastes shall be as under:- a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 and as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (10) Bio-medical waste.– Bio medical waste management shall be as under: a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the44 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016, as amended from time to time. b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco- Sensitive Zone. (11) Plastic waste management.– The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.– The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.– The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.– Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc. (16) Industrial units.– a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. b) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016 as amended from time to time, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.– The protection of hill slopes shall be as under: (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.– All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under and other notifications, laws and Acts of the Government of India pertaining to environment, forests and wildlife, in the erstwhile Ministry of Environment and Forest, vide number 1533(E), dated the 14th September, 2006 and laws for the time being in force in the manner and as amended from time to time specified in the Table below, namely[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 45 TABLE S No Activity Description (1) (2) (3) A. (a) New commercial construction of any kind and earth filling for commercial activities shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents. Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 13. (2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case-to-case basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in Annexure-VI, appended to this notification. (6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures: - The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8.
