सामाजिक-आर्थाक और िैव जवजवधता का बहुत महत्व रखता ह।ै र्ह िजक्षण म ें झारखंड की सीमा स े लगी सोन निी और
पजश्चम म ें उत्तर प्रििे की सीमा स े लगी कमना ािा निी के बीच जस्ट्थत एक पिार ह।ै कैमरू की पहाज़िर्ााँ अपनी अिेर्ता के
जलए िानी िाती ह,ैं और र्हााँ िेरगढ़ दकला और रोहतासगढ़ दकला िैसे ऐजतहाजसक दकले ह।ैं इसम ें कई गुफा जचत्र,
जिलालेख, मगे ाजलथ और प्राचीन मुंडेश्वरी मंदिर भी सजम्मजलत ह,ैं िो भारत के सबस े परु ाने हहिं ू मंदिरों म ें स े एक ह।ै
वन्द्र्िीव अभर्ारण्र् 1539.862 वगा दकलोमीटर क्षत्रे म ें फैला हुआ ह,ै िो जबहार राज्र् के रोहतास और कैमरू जिलों को
कवर करता ह;ै
और िबदक, कैमरू वन्द्र्िीव अभर्ारण्र् को वन्द्र्िीव (संरक्षण) अजधजनर्म 1972 (1972 का 53) की धारा 18 के
अधीन जबहार सरकार द्वारा िारी का.आ. 1160 तारीख 20 िुलाई, 1979 को अजधसूजचत दकर्ा गर्ा था और इसका
क्षेत्रफल 1520.095 वग ा दकलोमीटर ह।ै अजधसूचना संख्र्ा वन्द्र्प्राणी-10/09-1006 तारीख 20 अप्रलै , 2010 तथा 18
मई, 2010 को प्रकाजित करके अभर्ारण्र् क्षत्रे को 12.0176 वगा दकलोमीटर बढ़ाकर आगे बढ़ा दिर्ा गर्ा। राज्र् सरकार
की अजधसूचना संख्र्ा 119(अ) तारीख 29 फरवरी, 2024 द्वारा 22.2502 वगा दकलोमीटर क्षत्रे को जवमुि कर दिर्ा गर्ा
तथा 30 वगा दकलोमीटर का अजतररि क्षत्रे अभर्ारण्र् म ें िो़ि दिर्ा गर्ा। र्ह अभर्ारण्र् हवध्ं र् पवात श्ृंखला के पूवी छोर
पर जस्ट्थत ह ै और इसकी पिारी भू-आकृजतर्ााँ जबहार राज्र् म ें अजद्वतीर् ह ैं और चरे ो, उरांव और खरवार िैसी िनिाजतर्ााँ

जवस्ट्तार और सीमा को पाररजस्ट्थजतकी, पर्ाावरणीर् और िैव जवजवधता के िजृ ष्टकोण स े पाररजस्ट्थजतकी संवेिी िोन के रूप म ें
संरजक्षत और सुरजक्षत रखना आवश्र्क ह ै और उि पाररजस्ट्थजतकी संवेिी िोन म ें उद्योगों र्ा उद्योगों के वगा और उनके
संचालन और प्रदक्रर्ाओं को प्रजतजसद्ध करना आवश्र्क ह;ै
अतः अब, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित पर्ाावरण (संरक्षण)
अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) तथा उपधारा (2) के खण्ड (v) और (xiv) तथा उपधारा
(3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, केन्द्रीर् सरकार, जबहार राज्र् म ें कैमूर वन्द्र्िीव अभर्ारण्र् की सीमा के[भाग II—खण्‍ड 3(ii)] भारत का रािपत्र : असाधारण 3
आसपास के क्षत्रे को कैमूर वन्द्र्िीव अभर्ारण्र्, पाररजस्ट्थजतकी संवेिी िोन (जिसे इसके बाि पाररजस्ट्थजतकी संवेिी िोन
कहा गर्ा ह)ै के रूप म ेंअजधसूजचत करती ह,ै जिसका ब्र्ौरा जनम्नानुसार ह ैअथाात:् -
(1) पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमा.- (1 ) कैमरू वन्द्र्िीव की सीमा स े पाररजस्ट्थजतकी
संवेिी िोन की सीमा िून्द्र् स े 5.83 दकलोमीटर ह,ै जिसम ें 523.52 वगा दकलोमीटर का पाररजस्ट्थजतकी संवेिी िोन
क्षत्रे सजम्मजलत ह।ै पजश्चम, उत्तर-पजश्चम और िजक्षण-पजश्चम दििाओं म ें पाररजस्ट्थजतकी संवेिी िोन की िन्द्ू र् सीमा
उत्तर प्रिेि के साथ अतं रराज्र्ीर् सीमा के कारण ह।ै
(2) पाररजस्ट्थजतकी संवेिी िोन का सीमा जववरण अनलु ग्नक-I के रूप म ें सलं ग्न ह।ै
(3) पाररजस्ट्थजतकी संवेिी िोन के मानजचत्र सीमा जववरण के साथ क्रमिः अनलु ग्नक-IIक, IIख, IIग और IIघ
के रूप म ें सलं ग्न ह।ैं
(4) संरजक्षत क्षत्रे और उसके पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू-जनिेिांक क्रमिः अनलु ग्नक-III और
अनलु ग्नक-IV म ें सलं ग्न ह।ैं
(5) पाररजस्ट्थजतकी संवेिी िोन म ें आन े वाल े कुल 252 ग्रामों की सूची अनलु ग्नक-V म ें संलग्न ह,ै जिनम ें
रोहतास के 108 और कैमूर जिले के 144 ग्राम सजम्मजलत ह।ैं
2. पाररजस्ट्थजतकी-सवं िे ी िोन के जलए आचं जलक महार्ोिना –
(1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए इस अजधसूचना म ें दिए गए उपबंधों के
अनुसरण म ें रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो वर्ा के भीतर, स्ट्थानीर् व्यजिर्ों के परामि ा स े
और राज्र् सरकार म ें सक्षम प्राजधकारी के अनुमोिन के जलए एक, इस अजधसूचना म ें दिए गए अनुबंधों का
अनुपालन करते हुए, आंचजलक महार्ोिना तैर्ार करेगी।
(2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना को इस अजधसूचना म ें
जवजनर्िाष्‍ट तरीके तथा केन्द्रीर् एवं राज्र् जवजधर्ों और केंर सरकार द्वारा िारी दििा जनिेिों के अनरूु प तैर्ार दकर्ा
िाएगा।
(3) आंचजलक महार्ोिना को उि र्ोिना म ें पाररजस्ट्थजतकी तथा पर्ाावरण जवचारों को समाजहत करन े के
जलए, राज्र् सरकार जनम्नजलजखत जवभागों के परामिा स ेतैर्ार दकर्ा िाएगा, अथाात: ्
i. पर्ाावरण;
ii वन और वन्द्र्िीव;
iii. िहरी जवकास;

(4) िब तक इस अजधसूचना म ें जवजनर्िाष्ट न हो, आंचजलक महार्ोिना म ें अनुमोदित जवद्यमान भू-उपर्ोग,
अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं दकर्ा िाएगा तथा आचंजलक महार्ोिना म ें सभी
अवसंरचनाओं और दक्रर्ाकलापों म ें सुधार करके उन्द्ह ें अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनान े की व्यवस्ट्था
की िाएगी।
(5) इस आंचजलक महार्ोिना म ें वनरजहत क्षेत्रों के िीणोंद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह
क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भ-ू िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् समुिार्ों की
आवश्र्कताओं तथा पाररजस्ट्थजतकी एव ं पर्ाावरण स े संबंजधत ऐसे अन्द्र् पहलओंु के जलए उपबंध दकर् े िार्गें े जिन
पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै
(6) इस आंचजलक महार्ोिना म ें सभी जवद्यमान पूिा स्ट्‍थलों, ग्रामों एव ं िहरी बजस्ट्तर्ों, वनों की श्ेजणर्ों
एव ं दकस्ट्‍मों, कृजर् क्षेत्रों, उद्यानों एव ं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल
जनकार्ों की सीमा का सहार्क मानजचत्र के साथ जनधाारण दकर्ा िाएगा और प्रस्ट्ताजवत भू-उपर्ोग की जविेर्ताओं
का ब्र्ौरा भी दिर्ा िाएंगा।
(7) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी संवेिी िोन म ें जवकास का जवजनर्मन दकर्ा िाएगा और सारणी
के परै ा 4 म ें सूचीबद्ध प्रजतजसद्ध और जवजनर्जमत दक्रर्ाकलापों का अनपु ालन दकर्ा िाएगा और इसम ें स्ट्थ‍ ानीर्
समुिार् की आिीजवका की सरु क्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास को भी सुजनजश्चत दकर्ा िाएगा और
संवधान दकर्ा िाएगा।
(8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना के साथ सह-जवस्ट्तारी होगी।
(9) इस प्रकार अनुमोदित आंचजलक महार्ोिना, मॉनीटरी सजमजत के जलए एक प्रजत जनिेि िस्ट्तावेि का
काम करेगी तादक वह इस अजधसूचना के उपबंधों के अधीन मॉनीटरी के अपन े कताव्यों का जनवहा न कर सके।
3. राज्र् सरकार द्वारा दकए िान े वाल े उपार् - राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए
जनम्नजलजखत उपार् करेगी, अथाात्: -
(1) भ-ू उपर्ोग – (क) पाररजस्ट्थजतकी संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजर् क्षेत्रों, मनोरंिन के प्रर्ोिनों के
जलए अजभज्ञात उद्यानों और खुल े स्ट्थानों का प्रमुख आवासीर् परीसर र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा
संपररवतान नही होगा:
परंत ु पाररजस्ट्थजतकी संवेिी िोन के भीतर उपर्िुा भाग (क) म ें जवजनर्िाष्ट प्रर्ोिन स े जभन्न दकसी अन्द्र् प्रर्ोिन के
जलए कृजर् और अन्द्र् भूजम का संपररवतान मॉनीटरी सजमजत की जसफाररि पर और क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा
र्था लागू केन्द्रीर् सरकार र्ा राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन स े
और इस अजधसूचना के उपबंधों के द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करन े के
जलए अनुज्ञात दकर्ा िा सकेगा:-
(i) जवद्यमान स़िकों को चौ़िा करना और उन्द्ह ेंसुिढ़ृ करना तथा नई स़िकों का जनमााण करना;
(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;
(iii) प्रिर्ू ण उत्पन्न न करने वाल ेलघु उद्योग;
(iv) ग्राम उद्योग सजहत कुटीर उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और गृह वास सजहत
स्ट्थानीर् सुजवधाएं; और
(v) पैरा 4 म ेंिी गई संवर्धात दक्रर्ाकलाप;[भाग II—खण्‍ड 3(ii)] भारत का रािपत्र : असाधारण 5
परंत ु र्ह और दक राज्र् सरकार अनुमोिन के जबना एव ं भारत के संजवधान के अनच्ु छेि 244 के उपबंधों तथा
तत्समर् प्रवृत्त जवजध, जिसके अंतगता अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता)
अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना वाजणजज्र्क और औद्योजगक जवकास दक्रर्ाकलापों
के जलए िनिातीर् भूजम के प्रर्ोग की अनुज्ञा नहीं होगी;
परंत ु र्ह भी दक पाररजस्ट्‍थजतकी संवेिी िोन के भीतर आने वाली भूजम के अजभलेखों म ें उपसिं ात दकसी त्रुरट को,
मॉनीटरी सजमजत के जवचार प्राि करन े के पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामल े म ें एक बार सुधारा िा सकेगा और उि
त्रुरट को सुधारे िाने की संसूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतना मंत्रालर् को िी िाएगी;
परंत ु र्ह भी दक उपर्िुा त्रुरट के संिोधन म ें इस उप परै ा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा म ें भू-
उपर्ोग का पररवतान सजम्मजलत नहीं होगा ;
(ख) अप्रर्ुसत‍ र्ा अनुत्‍पािक कृजर् क्षेत्रों म ें वनरोपण तथा पर्ाावास पुनरूद्धार कार्ाकलापों के माध्र्म स े पुन:
वनीकरण करने के प्रर्ास दकए िाएंगे ;
(2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक झरनों/नदिर्ों/चैनलों िलमागों के िलग्रहण क्षेत्रों की पहचान की िाएगी
और आंचजलक महार्ोिना म ें उनके सरं क्षण और बहाली की र्ोिना सजम्‍मजलत की िाएगी और राज्र् सरकार द्वारा
मागाििाक जसद्धांत इस रीजत स े तैर्ार दकए िाएगं े दक उसम ें िो ऐसे क्षेत्रों के जलए हाजनकारक ह ैं र्ा उसके पास जवकास
दक्रर्ाकलापों को प्रजतजर्द्ध दकर्ा गर्ा हो।
(3) पर्टा न एव ं पाररजस्ट्थजतकी पर्टा न – (क) पाररजस्ट्थजतकी संवेिी िोन म ें सभी नए पाररजस्ट्थजतकी पर्ाटन
दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन संबंधी पर्ाटन महार्ोिना के अधीन
होगा।
(ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् सरकार के पर्ावा रण और वन जवभाग के परामि ा स े पर्ाटन जवभाग
द्वारा बनार्ी िाएगी।
(ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना एक घटक के रूप म ें होगी।
(घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी-संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तैर्ार की िार्ेगी।
(ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनम्‍नानुसार जवजनर्जमत दकए िाएंग,े अथाात:् -
(i) संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी-संवेिी िोन की सीमा तक, इनमें स े
िो भी अजधक जनकट हो: दकसी होटल र्ा ररिॉटा का नर्ा सजन्नमााण र्ा व्यापाररक प्रजतष्ठान अनुमत नहीं दकर्ा
िाएगा,
परंतु र्ह, पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए संरजक्षत क्षत्रे की सीमा से एक दकलोमीटर की िरू ी स े परे
पाररजस्ट्थजतकी-संवेिी िोन की सीमा तक पूवा पररभाजर्त और अजभजहत क्षेत्रों म ें पर्ाटन महार्ोिना के अधीन, नए
होटलों और ररिॉटा की स्ट्थापना और व्यापाररक प्रजतष्ठान अनुमत होगी;
(ii) पाररजस्ट्थजतकी-संवेिी िोन के अन्द्िर सभी नए पर्ाटन दक्रर्ा-कलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का
जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा िारी मागाििाक जसद्धांतों तथा
पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेन े वाल े राष्ट्रीर् व्याघ्र संरक्षण
प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी मागाििका जसद्धांतों (समर्-समर् पर र्था संिोजधत) के अधीन

(iii) िब तक आंचजलक महार्ोिना के अनुमोिन नहीं जमल िाता, तब तक पर्ाटन के जवकास और जवद्यमान
पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को स्ट्थल-जवजिष्ट संवीक्षा और मॉनीटरी सजमजत की जसफाररि के आधार पर
संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमत दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन म ें दकसी नर् े
होटल/ररिाटा र्ा वाजणजज्र्क प्रजतष्ठान का संजनमााण की अनुमजत नहीं िी िाएगी।
(4) प्राकृजतक जवरासत – पाररजस्ट्थजतकी संवेिी िोन म ें बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन
पूल ररजवा क्षत्रे , िैल संरचना, िल प्रपात, झरन,े िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की
पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आचं जलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण
र्ोिना बनार्ी िाएगी।
(5) मानव जनर्मता जवरासत स्ट्थ‍ ल - पाररजस्ट्थजतकी संवेिी िोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा
ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके सरं क्षण के जलए
आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी।
(6) ध्व‍ जन प्रिर्ू ण - पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रिर्ू ण की जनवारण और जनर्ंत्रण का अनुपालन पर्ाावरण
(संरक्षण) अजधजनर्म 1986 और समर् समर् पर उसके र्था संिोधनों के अधीन ध्वजन प्रिर्ू ण (जवजनर्मन और जनर्ंत्रण)
जनर्म, 2000 के उपबंधों के अधीन दकर्ा िाएंगा ।
(7) वार् ु प्रिर्ू ण. पाररजस्ट्थजतकी संवेिी िोन म ें वार् ु प्रिर्ू ण का जनवारण और जनर्ंत्रण का अनुपालन (प्रिर्ू ण की
रोकथाम और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14), तथा तद्धीन बनाए गए जनर्मों और संिोधनों के उपबंधों के
अधीन दकर्ा िाएगा ।
(8) बजहस्राव का जनस्ट्सरण. - पाररजस्ट्थजतक संवेिनिील क्षत्रे म ें उपचाररत बजहःस्राव का जनवाहन िल (प्रिर्ू ण
जनवारण एव ं जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) पर्ाावरण (संरक्षण) अजधजनर्म, 1986 और उसके अधीन बनाए
गए जनर्मों र्ा राज्र् सरकार द्वारा जनधााररत मानिंडों, िो भी अजधक किोर हो, के उपबंधों के अधीन दकर्ा िाएगा।
(9) िोस अपजिष्ट. - िोस अपजिष्टों का जनपटान जनम्नजलजखत रूप म ेंहोगा--
(क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट का जनपटान और प्रबन्द्धन भारत सरकार के पर्ाावरण, वन
और िलवार् ु पररवतान मंत्रालर् की अजधसूचना संख्र्ा का.आ. 1357 (अ), तारीख 8 अप्रैल, 2016 के अधीन
प्रकाजित िोस अपजिष्‍ट प्रबंधन जनर्म, 2016, समर् -समर् पर र्था संसोजधत उपबंधों अधीन दकर्ा िाएगा;
अकाबाजनक सामग्री का जनपटान पर्ाावरणीर् रीजत म ें पाररजस्ट्थजतकी संवेिी िोन से बाहर अजभज्ञात स्ट्थल पर दकर्ा
िाएगा ।
(ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करत े हुए जवद्यमान जनर्मों
और जवजनर्मों के अनुरूप िोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनज्ञु ात दकर्ा िार्ेगा।
(10) िवै जचदकत्सा अपजिष्ट. - िैव जचदकत्सा अपजिष्ट का प्रबधं न जनम्नजलजखत रूप म ें होगा-
(क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और
िलवार् ु पररवतना मंत्रालर् की अजधसूचना संख्र्ा सा.का.जन. 343 (अ), तारीख 28 माच,ा 2016 के अधीन
प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबधं न जनर्म, 2016, समर् -समर् पर र्था संसोजधत उपबंधों के अधीन दकर्ा
िाएगा।
(ख) पाररजस्ट्थजतकी संवेिी िोन म ें अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और
जवजनर्मों के अनुरूप िैव जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुमत दकर्ा िार्ेगा।[भाग II—खण्‍ड 3(ii)] भारत का रािपत्र : असाधारण 7
(11) प्लाजस्ट्टक अपजिष्ट का प्रबधं न. – पाररजस्ट्थजतकी संवेिी िोन म ें प्लाजस्ट्टक अपजिष्ट का प्रबंधन भारत सरकार
के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर् -समर् पर र्था सिं ोजधत अजधसूचना संख्र्ा सा.का.जन. 340
(अ), तारीख 18 माच,ा 2016, के अधीन प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अधीन दकर्ा
िाएगा।
(12) सजन्नमाणा और जवध्वसं अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी-संवेिी िोन म ें सजन्नमााण और जवध्वंस अपजिष्ट का
प्रबंधन भारत सरकार के पर्ावा रण, वन और िलवार् ु पररवतान मंत्रालर् की समर् -समर् पर र्था सिं ोजधत अजधसूचना
संख्र्ा सा.का.जन. 317 (अ), तारीख 29 माच,ा 2016 के अधीन प्रकाजित सजन्नमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म,
2016 के उपबंधों के अधीन दकर्ा िाएगा।
(13) ई–अपजिष्ट. - पाररजस्ट्थजतकी-संवेिी िोन म ें ई–अपजिष्ट का प्रबंधन भारत सरकार के पर्ाावरण, वन और
िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित और समर् -समर् पर र्था सिं ोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के
उपबंधों के अधीन दकर्ा िाएगा।
14. वाहन र्ातार्ात .- वाहन र्ातार्ात को पर्ाावास-अनुकूल तरीके स े जवजनर्जमत दकर्ा िाएगा और इस संबंध म ें
आंचजलक महार्ोिना म ें जविेर् उपबंध सजम्मजलत दकए िाएंग े और आंचजलक महार्ोिना के तैर्ार होन े और राज्र् सरकार
के सक्षम प्राजधकारी स े अनुमोदित होने तक, मॉनीटरी सजमजत सुसंगत अजधजनर्मों और उनके अधीन बनाए गए जनर्मों एव ं
जवजनर्मों के अधीन वाहन र्ातार्ात के अनपु ालन की मॉनीटरी करेगी।
(15) वाहन प्रिर्ू ण.- वाहन प्रिर्ू ण की रोकथाम और जनर्ंत्रण लाग ू काननू ों के अधीन दकर्ा िाएगा। स्ट्वच्छ ईंधन
िैसे सीएनिी, एलपीिी आदि के उपर्ोग के जलए प्रर्ास दकए िाएंगे।
(16) औद्योजगक ईकाइर्ा.ं –
(क) पाररजस्ट्थजतकी-संवेिी िोन के भीतर कोई नए प्रिर्ू णकारी उद्योगों की स्ट्थापना की अनुमजत नहीं िी
िाएगी।
(ख) केन्द्रीर् प्रिर्ू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016, समर्-समर् पर र्था संसोजधत िारी मागाििका
जसद्धान्द्तों म ें उद्योगों के वगीकरण के अधीन, िब तक दक अजधसूचना म ें इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी-
संवेिी िोन के भीतर केवल गरै -प्रिर्ू णकारी उद्योगों को अनज्ञु ात दकर्ा िाएगा और इसके अजतररि, गैर
प्रिर्ू णकारी उद्योगों का संवधान दकर्ा िाएगा।
(17) पहा़िी ढलानों का सरं क्षण. - पहा़िी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:-
(क) आंचजलक महार्ोिना म ें पहा़िी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी प्रकार के
जनमााण कार् ा की अनुज्ञा नहीं होगी;
(ख) जिन ढलानों र्ा जवद्यमान ख़िी पहा़िी ढलानों म ें अत्र्जधक भू-क्षरण होता ह ै उनम ें दकसी भी प्रकार के
जनमााण कार् ा की अनुज्ञा नहीं होगी ।
4. पाररजस्ट्थजतकी-सवं िे ी िोन म ें प्रजतजर्द्ध र्ा जवजनर्जमत दकए िान े वाल े दक्रर्ाकलापों की सचू ी- पाररजस्ट्थजतकी-
संवेिी िोन म ें सभी दक्रर्ाकलाप पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) के उपबंधों और अन्द्र् लाग ू
जवजधर्ों सजहत उसके अधीन बनाए गए जनर्मों तथा इसके अतं गात बनाए गए जनर्म तथा तत्कालीन पर्ाावरण एवं वन
मंत्रालर् में पर्ाावरण, वन और वन्द्र्िीव से संबंजधत भारत सरकार की अजधसूचनाओं, जवजधर्ों एवं अजधजनर्मों दिनांक 14
जसतंबर, 2006 की अजधसूचना सं. 1533 (अ) और उसमें दकए गए संिोधन एवं नीचे िी गई ताजलका में जवजनर्िाष्ट रीजत स ं

9 होटलों और ररसोटों की वाजणजज्र्क पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हते ु लघु व अस्ट्थार्ी संरचनाओं के
स्ट्थापना । जनमााण के जसवार्, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा
पाररजस्ट्थजतकी-संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो,

10 संजनमाणा दक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा स े एक दकलोमीटर िार्रे में र्ा पाररजस्ट्थजतकी
संवेिी िोन की सीमा तक, िो भी जनकटतम हो, दकसी भी प्रकार के नए
वाजणजज्र्क जनमाणा की अनुमजत नहीं िी िाएगी:
परंतु, स्ट्थानीर् लोगों को स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं
को पूरा करने के जलए भवन उप-जनर्मों के अधीन पैराग्राफ 3 के उप-पैरा
(1) में सूचीबद्ध दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम पर
जनमााण कार्ा करने की अनुमजत िी िा सकेगी:
परंतु र्ह और दक प्रिर्ू ण न फैलाने वाले लघ ु उद्योगों से संबंजधत जनमाणा
संबंधी दक्रर्ाकलापों को प्रर्ोज्‍र् जनर्मों और जवजनर्मों, र्दि कोई हो, के
अधीन तथा सक्षम प्राजधकारी से पूव ा अनुमोिन से जवजनर्जमत दकर्ा िाएगा
और न्द्र्ूनतम ही रखा िाएगा।
(ख) एक दकलोमीटर के िार्रे से आग े इसे आंचजलक महार्ोिना के अधीन
जवजनर्जमत दकर्ा िाएगा।
11 लघ ु पैमाने के प्रिर्ू ण न फैलाने वाले फरवरी, 2016 में केन्द्रीर् प्रिर्ू ण जनर्ंत्रण बोडा द्वारा िारी उद्योगों के
उद्योग। वगीकरण, समर्-समर् पर र्था संिोजधत के अधीन प्रिर्ू ण न फैलाने वाले
उद्योग, तथा पाररजस्ट्थजतकी संविे ी िोन से स्ट्विेिी सामजग्रर्ों स े उत्पाि
बनाने वाले िोजखम रजहत, लघु एव ंसेवा उद्योग, कृजर्, पुष्प-कृजर्, बागवानी
र्ा कृजर्-आधाररत उद्योगों को सक्षम प्राजधकारी द्वारा अनुमजत िी िाएगी।
12 वृक्षों की कटाई। (क) राज्र् सरकार के सक्षम प्राजधकारी की पूव ा अनुमजत के जबना वन,
सरकारी, रािस्ट्व र्ा जनिी भूजम पर से वृक्षों की कटाई की अनुज्ञा नहीं होगी।
(ख) वृक्षों की कटाई को संबंजधत केन्द्रीर् र्ा राज्र् अजधजनर्म तथा उसके
अधीन बनाए गए जनर्मों के उपबंधों के अधीन जवजनर्जमत दकर्ा िाएगा।

र्थाजवजनर्िाष्ट प्रजतजर्द्ध दक्रर्ाकलापों के जसवार्, की संवीक्षा करेगी, और उि अजधसूचना के उपबंधों के अधीन पूव ा
पर्ाावरणीर् अनापजत्त के जलए, र्थाजस्ट्थजत, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् र्ा
राज्र् पर्ाावरण समाघात जनधाारण प्राजधकरण को जनर्िाष्ट करेगी ।
(2) उन दक्रर्ाकलापों की िो दिनांक 14 जसतंबर, 2006 की अजधसूचना सं0 1533(अ) के तहत तत्कालीन
पर्ाावनण एवं वन मंत्रालर् में भारत सरकार की अजधसूचना की अनुसूची म ें सजम्मजलत नहीं ह ै और पाररजस्ट्थजतक
संवेिी िोन म ें आत े ह,ै इसके पैराग्राफ 4 के अधीन सारणी म ें र्थाजवजनर्िाष्ट प्रजतजर्द्ध दक्रर्ाकलापों के जसवार्,
मॉनीटरी सजमजत द्वारा वास्ट्तजवक स्ट्‍थल-जवजनर्िाष्ट ििाओं के आधार संवीक्षा की िाएगी और संबंजधत जनर्ामक
प्राजधकरणों को भेिी िाएगी।
(3) मॉनीटरी सजमजत का सिस्ट्र्-सजचव र्ा संबंजधत कलेसटर र्ा उप वन संरक्षक इस अजधसूचना के उपबंधों
का उल्लघं न करन े वाले दकसी भी व्यजि के जवरूद्ध पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के अधीन
पररवाि फाइल करन े के जलए सक्षम होगा।
(4) मॉनीटरी सजमजत मामले-िर-मामला आधार पर अपक्षे ाओं के अनुसार अपन े जवचार-जवमि ा म ें सहार्ता

NOTIFICATION
New Delhi, the 20th June, 2025
S.O. 2765(E).—In supersession of the notification number S.O. 3549(E), dated the 30th December, 2015 isued
by the Central Government in the Ministry of Environment, Forest and Climate Change, the following draft of the
notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1),
read with clause (v) and clause (xiv) of sub-section (2) and subsection (3) of section 3 of the Environment (Protection)
Act, 1986 (29 of 1986) is hereby published, in consonance with sub-rule (3) of rule 5 of the Environment (Protection)
Rules, 1986, for information of the public likely to be affected thereby; and notice is hereby given that the said draft
notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which
copies of the Gazette containing this notification are made available to the public;

Draft Notification
WHEREAS, the Kaimur Wildlife Sanctuary is located in southwestern part of Bihar and holds immense
historical, cultural, socio-economic, and biodiversity significance. It is a plateau situated between the Son River,
bordering Jharkhand to the south, and the Karmanasa River, bordering Uttar Pradesh to the west. The Kaimur Hills are
known for their invincibility, and is home to historical forts namely Shergarh Fort and Rohtasgarh Fort. It also includes
several cave paintings, inscriptions, megaliths and the ancient Mundeshwari Temple, which is one of the oldest Hindu32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
temples in India. The Wildlife Sanctuary spans over an area of 1539.862 square kilometers, covering Rohtas and
Kaimur districts in the state of Bihar;
AND WHEREAS the Kaimur Wildlife Sanctuary was notified under section 18 of the Wildlife
(Protection) Act 1972 (53 of 1972) number S.O. 1160, dated 20th July, 1979 issued by the Government of Bihar
and has an area of 1520.095 square kilometres. The Sanctuary area was further increased by the addition of
12.0176 square kilometre vide notification number Vanyaprani-10/09-1006, dated the 20th April, 2010 and
published on 18th May, 2010. An area of 22.2502 square kilometre was denotified and additional area of 30 square
kilometre was further added into the Sanctuary by the State Government vide notification number 119(E), dated
the 29th February, 2024. The sanctuary is located in the eastern extremity of Vindhyan Hill ranges and its plateau
landforms are unique in the State of Bihar and tribes like Chero, Oraon and Kharwar inhabit the plateau tract in
the sanctuary;
AND WHEREAS the sanctuary supports rich and unique biodiversity which is home for species like
Leopard (Panthera pardus), Hyena (Hyaena hyaena), Golden Jackal (Canis aureus), Indian Wolf (Canis lupus
pallipes), Wild Boar (Sus scrofa), Sloth Bear (Melursus urisinus), Cheetal (Axis axis), Sambar (Cervus unicolor),
Hog Deer (Axis porcinus), Chausingha (Tetracerus quadricornis), Nilgai (Boselaphus tragocamelus), Jungle Cat
(Felis chaus) etc. The Sanctuary is also home to many birds and butterflies species like Asian Koel, Black
Drongo, Black Kite, Black-winged kite, Brahminy myna, Common Quail, Eurasian collared dove, Greater coucal,
Green bee-eater, Grey Francolin, Painted Spurfowl, Pond Heron, Purple Sunbird, Red Vented Bulbul, Rose-
ringed parakeet and Lime butterfly, Lemon Pansy, Peacock pansy, Blue Pansy, Tawny Coster, Common Pierrot,
Small Grass yellow, Common small flat, Yellow Orange Tip, Common Gull, The Baronet, Plain Tiger etc.;
AND WHEREAS the major flora found in the Sanctuary are Acacia catechu, Adina cordifolia, Aegle
marmelos, Anogeissus latifolia, Azadirachta indica, Diospyros melanoxylon, Ehretia laevis, Ficus benghalensis,
Lagerstroemia parviflora, Lannea coromandelica, Phyllanthus emblica, Senna siamea, Syzygium cumini, Terminalia
tomentosa, Buchanania cochinchinensis, Madhuca longifolia, Semecarpus anacardium, Terminalia bellirica, Albizia
lebbeck, Bauhinia variegate, Bombax ceiba, Boswellia serrata, Pterocarpus marsupium, Terminalia arjuna, Wrightia
tinctoria, Casearia tomentosa, Shorea robusta, Buchananialanzan, Careya arborea etc.;
AND WHEREAS it is necessary to conserve and protect the area, extent and boundary which is specified in
paragraph 1 of this notification around the protected area of Kaimur Wildlife Sanctuary as Eco-sensitive zone from
ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their
operations and processes in the said Eco-Sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub section (l) and clauses (v) and (xiv) of sub-
section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule
(3) of Rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area around the
boundary of Kaimur Wildlife Sanctuary in the State of Bihar as the Kaimur Wildlife Sanctuary, Eco-sensitive Zone
(herein after referred to as the Eco-sensitive Zone) details of which are as under, namely: -
1. Extent and boundaries of Eco-sensitive Zone. – (1) the extent of Eco-Sensitive Zone is Zero to 5.83
kilometre from the boundary of Kaimur Wildlife Sanctuary encompassing an ESZ area of 523.52 square
kilometre. The Zero extent of Eco-sensitive Zone in the West, Northwest and Southwest directions is due to
the interstate boundary with Uttar Pradesh.
(2) The boundary description of Eco-sensitive Zone is appended as Annexure- I.
(3) The maps of the Eco-Sensitive Zone along with boundary details are appended as Annexures - IIA, IIB,
IIC and IID respectively.
(4) The geo-coordinates of the boundary of protected area and its Eco-sensitive Zone is appended as
Annexure- III and Annexure- IV respectively.
(5) The list of total 252 villages, comprising of 108 in Rohtas and 144 in Kaimur districts, which are falling
within the Eco-sensitive Zone, is appended as Annexure- V.[भाग II—खण्‍ड 3(ii)] भारत का रािपत्र : असाधारण 33
2. Zonal Master Plan for Eco-Sensitive Zone. –
(1) The State Government shall, for the purpose of the Eco-sensitive Zone, prepare a Zonal Master Plan, within a
period of two years from the date of publication of final notification in the Official Gazette, in consultation with
local people and adhering to the stipulations given in this notification for approval of the competent authority in the
State.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is
specified in this notification and also in consonance with the relevant Central and State laws and the guidelines
issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government,
for integrating the ecological and environmental considerations into the said plan:
i. Environment;
ii. Forest and Wildlife;
iii. Urban Development;
iv. Panchayati Raj and Rural Development
v. Tourism;
vi. Revenue;
vii. Agriculture;
viii. Bihar State Pollution Control Board;
ix. Irrigation and Flood Control;
x. Municipality and;
xi. Public Works and Highways
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and
activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all
infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture
conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types
and kinds of forests, agricultural areas, fertile lands, green area, such as, parks, horticultural areas, orchards, lakes
and other water bodies with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated
activities listed in Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood
security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out
its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by the State Government. -The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Land use.–
(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in
the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential
complex or industrial activities.34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Provided that the conversion of agricultural and other lands, for the purpose other than that specified at
part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring
Committee, and with the prior approval of the competent authority under Regional Town Planning Act and
other rules and regulations of Central/State Government as applicable and vide provisions of this
Notification, to meet the residential needs of the local residents such as:
i. Widening and strengthening of existing roads and construction of new roads;
ii. Construction and renovation of infrastructure and civic amenities;
iii. Small scale industries not causing pollution;
iv. Cottage industries including village industries; convenience stores and local amenities supporting
eco-tourism including home stay; and
v. Promoted activities given under paragraph 4.
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the competent authority under Regional Town Planning Act and other
rules and regulations of State Government and without compliance of the provisions of Article 244 of the
Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional
Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected
by the State Government, after obtaining the views of Monitoring Committee, once in each case and the
correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest
and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat
restoration activities.
(2) Natural water bodies.– The catchment areas of all natural springs/rivers/ channels shall be identified and plans
for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be
drawn up by the State Government in such a manner as to prohibit development activities at or near these areas
which are detrimental to such areas.
(3) Tourism or Eco-tourism.–
a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall
be as per the Tourism Master Plan for the Eco-sensitive Zone;
b) the Eco-Tourism Master Plan shall be prepared by State Department of Tourism in consultation with State
Departments of Environment and Forests;
c) the Tourism Master Plan shall form a component of the Zonal Master Plan;
d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-Sensitive Zone;
e) the activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometer from the boundary of
the protected area or upto the extent of the Eco-Sensitive Zone, whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected area till the
extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in
pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall
be in accordance with the guidelines issued by the Central Government in the Ministry of Environment,
Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation[भाग II—खण्‍ड 3(ii)] भारत का रािपत्र : असाधारण 35
Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-
development;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism
activities shall be permitted by the concerned regulatory authorities based on the actual site specific
scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial
establishment construction shall be permitted within Eco-Sensitive Zone area.
(4) Natural heritage.– All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be
identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of
the Zonal Master Plan.
(5) Man-made heritage sites.– Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for
their conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.– Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in
accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act,
1986 and as amended from time to time.
(7) Air pollution.– Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in
accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules
made thereunder and amendments thereto.
(8) Discharge of effluents.– Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) Environmental (Protection)
Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent.
(9) Solid wastes.– Disposal and Management of solid wastes shall be as under:-
a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with
the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016
and as amended from time to time; the inorganic material may be disposed in an environmental acceptable
manner at site identified outside the Eco-sensitive Zone.
b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules
and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-medical waste.– Bio medical waste management shall be as under:
a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-
Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March,
2016, as amended from time to time.
b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing
rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(11) Plastic waste management.– The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as
per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the
Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th
March, 2016, as amended from time to time.
(12) Construction and demolition waste management.– The Construction and Demolition Waste Management in
the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste
Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to
time.
(13) E-waste.– The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the
E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest
and Climate Change and as amended from time to time.
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and
specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal
Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring
Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations
made thereunder.
(15) Vehicular pollution.– Prevention and control of Vehicular Pollution shall be complied with in accordance with
applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc.
(16) Industrial units.–
a) No new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
b) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the
Guidelines issued by Central Pollution Control Board in February 2016 as amended from time to time,
unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes.– The protection of hill slopes shall be as under:
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.–
All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986
(29 of 1986) and the rules made there under and other notifications, laws and Acts of the Government of India
pertaining to environment, forests and wildlife, in the erstwhile Ministry of Environment and Forest, vide number
1533(E), dated the 14th September, 2006 and laws for the time being in force in the manner and as amended from time
to time specified in the Table below, namely

protected area or upto extent of the Eco-sensitive Zone,
whichever is nearer:
Provided that, local people shall be permitted to undertake
construction in their land for their use including the activities
mentioned in sub-paragraph (1) of paragraph 3 as per building
bye-laws to meet the residential needs of the local residents.
Provided further that the construction activity related to small
scale industries not causing pollution shall be regulated and
kept at the minimum, with the prior permission from the
competent authority as per applicable rules and regulations, if
any.
(b) Beyond one kilometer it shall be regulated as per the Zonal
Master Plan.

6. Functions of Monitoring Committee.–
(1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinise, the activities covered in
the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest,
vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for
the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central
Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact
Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said
notification.
(2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006 and falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the
concerned Regulatory Authorities.
(3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy
Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection)
Act, 1986 against any person who contravenes the provisions of this notification.
(4) The Monitoring Committee may invite representative or expert from concerned Department, representative from
industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on
case-to-case basis.
(5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the
31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro-forma
specified in Annexure-VI, appended to this notification.
(6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for

7. Additional measures: - The Central Government and State Government may specify additional measures, if any, for
giving effect to provisions of this notification.
8. Orders, Supreme Court, etc:- The provisions of this notification shall be subject to the orders, if any passed or to be
