अधिसचू ना नई दिल्ली, 12 जून, 2025 का.आ. 2575(अ).— ननम्नललखित प्रारूप अधिसूचना, जजसे पर्ाावरण (संरक्षण) अधिननर्म, 1986 (1986 का 29) की िारा 3 की उपिारा (2) के िडं (v) और िडं (xiv) तथा उपिारा (3) के साथ पदित उपिारा (1) द्वारा प्रित्त शजततर्ों का प्रर्ोग करत े हुए जारी करने का प्रस्ताव करती है, पर्ाावरण (संरक्षण) ननर्म, 1986 के ननर्म 5 के उपननर्म (3) के अिीन अपेक्षक्षत रूप से, उससे प्रभाववत होन े वाली जनता की जानकारी के ललए प्रकालशत की जाती है; और इसके द्वारा र्ह सूचना िी जाती है कक उतत प्रारूप अधिसूचना उस तारीि से साि दिन की अवधि की समाजतत पर र्ा उसके पश्चात ् ववचार में ली जाएगी, जजसको इस अधिसूचना वाले राजपत्र की प्रनतर्ां जनता को उपलब्ि करा िी जाती हैं; मसौिा अधिसूचना में ननदहत प्रस्तावों पर कोई आपवत्त र्ा सुझाव िेने में रुधच रिने वाला कोई भी व्र्जतत इसे ललखित रूप में, केन्द्रीर् सरकार के दिल्ली-110003 को भेज सकता है, र्ा मंत्रालर् के ई-मेल पते esz-mef@nic.in पर भेज सकता है। प्रारुप अधिसूचना जबकि, कंुभलगढ़ वन्द्र्जीव अभर्ारण्र् अरावली पवता माला के सबसे नाजुक पाररजस्थनतकी तंत्रों में से एक में जस्थत है और सुरम्र् झील शहर उिर्पुर से लगभग 80 ककलोमीटर उत्तर में जस्थत है। भौगोललक दृजटट से, अभर्ारण्र् 73°02′ स े 73°30′ पवू ी िेशांतर और 25°00′ स े 25°40′ उत्तरी अक्षांश के बीच जस्थत है। र्ह 610.528 वग ा ककलोमीटर क्षेत्र में फैला हुआ है, जो राजस्थान राज्र् के राजसमंि, पाली और उिर्पुर जजलों के कुछ दहस्सों को घेरता है; और जबकि कंुभलगढ़ वन्द्र्जीव अभर्ारण्र् पजश्चम में जस्थत अरावली के पहाडी जंगलों और थार रेधगस्तान के बीच एक पाररजस्थनतकी तंत्र बनाता है। कंुभलगढ़ की पहाडडर्ााँ एक अवरोिक की तरह काम करती हैं, जो रेधगस्तान के पूव ा की ओर ववस्तार को रोकती हैं। पहाडी के ऊपर जस्थत प्रलसद्ि कंुभलगढ़ ककला पर्टा कों के ललए आकर्णा का कें र है। अभर्ारण्र् का पूवी भाग अधिकतर समुर तल से 3500 फीट से अधिक ऊाँ चाई वाली पवता माला है, जबकक अभर्ारण्र् का पजश्चमी भाग मारवाड के मैिानों से सटा हुआ है; और जबकि अभर्ारण्र् में ववववि स्थलाकृनत है, इसललए इसका महत्व और भी बढ़ जाता है तर्ोंकक र्ह िेश के िो प्रमुि जलग्रहण क्षेत्रों के बीच एक ववभाजन रेिा भी बनाता है। इसका पूवी भाग बनास निी का स्रोत माना जाता है, जो बंगाल की िाडी में धगरती है। पजश्चमी ढलान पर वर्ाा का पानी सुकडी, लमिडी, सुमेर और कोट जैसी छोटी नदिर्ों के रूप में बहती है, र्े सभी लूनी निी की सहार्क नदिर्ााँ बनती हैं जो अतं तः अरब सागर में ववलीन हो जाती हैं; और जबकि अभर्ारण्र् समद्ृ ि और अद्ववतीर् जैव वववविता का समथना करता है जो जंगली सूअर (सस स्रोफा), ग्रे मस्क श्रू (संचस मुररनस), चमगािड (सार्नोतटेरस जस्फंतस), फ्लाइंग फॉतस (पेरोपस धगजेंदटकस), सामान्द्र् तेंिआु (पथैं ेरा पाडसा ), िारीिार लकडबग्घा (हएना हर्ाना), जंगली बबल्ली (फेललस चाउस), पांच िारीिार ताड धगलहरी (फनमबुलस पेनांती), जैसी प्रजानतर्ों का घर है। भारतीर् पगैं ोललन (मैननस कैरालसकाउडाटा), भारतीर् लोमडी (वुल्पेस बेंगालेंलसस), आम नेवला (हपेस्टेस एडवडसा ी), नीला बैल (बोसेलाफस ट्रैगोकैमेलस), भारतीर् साही (दहजस्ट्रतस इंडडका), धचकं ारा (गजेला गजेला), लसर्ार (कैननस ऑररर्स), भारतीर् छोटा लसवेट (वववाररकुला इंडडका) आदि। जबकक अभर्ारण्र् में पाए जान े वाले महत्वपूण ा पक्षी हैं पेंटेड फ्रैंकोललन (फ्रैंकोललनस वपतटस), ग्रे फ्रैंकोललन (एफ. पोंडडसेररर्नस), कॉमन तवेइल (कोटननता स कोटननता स), रेन तवेइल (सी. कोरोमेडले लक), रॉक बुश तवेइल (पेडडका ुला आगााउंडाह), पीले पैर वाले बटन तवेइल (टननता स टंकी), बैरड बटन तवेइल (टी. सजस्कटेटर), भारतीर्[भाग II—खण् ड 3(ii)] भारत का दहरसुता) आदि; और जबकि कंुभलगढ़ वन्द्र्जीव अभर्ारण्र् के संरक्षक्षत क्षेत्र के आसपास इस अधिसूचना के पैरा1 में ववननदिाटट क्षेत्र, ववस्तार और सीमा को पाररजस्थनतक, पर्ाावरणीर् और जैव वववविता के दृजटटकोण से पाररजस्थनतक-संवेिी जोन के रूप में संरक्षक्षत और सुरक्षक्षत रिना आवश्र्क है और उतत पाररजस्थनतक-संवेिी जोन में उद्र्ोगों र्ा उद्र्ोगों के वग ा और उनके संचालन और प्रकरर्ाओं को प्रनतलसद्ि करना आवश्र्क है; अतः अब, पर्ाावरण (संरक्षण) ननर्म, 1986 के ननर्म 5 के उपननर्म (3) के साथ पदित पर्ाावरण (संरक्षण) अधिननर्म, 1986 (1986 का 29) की िारा 3 की उपिारा (1) तथा उपिारा (2) के िण्ड (v) और (xiv) तथा उपिारा (3) द्वारा प्रित्त शजततर्ों का प्रर्ोग करते हुए, केन्द्रीर् सरकार, राजस्थान राज्र् में कंुभलगढ़ वन्द्र्जीव अभर्ारण्र् की सीमा के आसपास के क्षेत्र को कंुभलगढ़ वन्द्र्जीव अभर्ारण्र्, पाररजस्थनतकी संवेिी जोन (जजसे इसके बाि पाररजस्थनतकी संवेिी जोन कहा गर्ा है) के रूप में अधिसूधचत करती है, जजसका ब्र्ौरा ननम्नानुसार है अथाात:्- (1) पाररस्थिततिी-संवेदी जोन िा ववथतार और सीमा.- (1 ) पाररजस्थनतकी संवेिी जोन की सीमा कंुभलगढ़ वन्द्र्जीव अभर्ारण्र् की सीमा के आसपास शून्द्र् से एक ककलोमीटर तक है, जजसमें 243 वग ा ककलोमीटर का पाररजस्थनतकी संवेिी जोन क्षेत्र सजम्मललत है। अभर्ारण्र् की उत्तरी सीमा में4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पाररजस्थनतकी संवेिी जोन की शून्द्र् सीमा रावली टॉडगढ़ वन्द्र्जीव अभर्ारण्र् के साथ साझा सीमा के कारण है। ववलभन्द्न दिशाओं में पाररजस्थनतकी संवेिी जोन की सीमा इस प्रकार है: उत्तर 0 ककलोमीटर उत्तर-पूव ा 1.00 ककलोमीटर पूव ा 1.00 ककलोमीटर िक्षक्षण-पूव ा 1.00 ककलोमीटर िक्षक्षण 1.00 ककलोमीटर िक्षक्षण-पजश्चम 1.00 ककलोमीटर पजश्चम 1.00 ककलोमीटर उत्तर-पजश्चम 1.00 ककलोमीटर (2) पाररजस्थनतकी संवेिी जोन का सीमा वववरण अनुलग्नि-I में संलग्न है। (3) पाररजस्थनतकी संवेिी जोन के मानधचत्र सीमा वववरण सदहत अनुलग्नि-II ि, अनुलग्नि-II ख और अनुलग्नि-II ग में संलग्न हैं। (4) संरक्षक्षत क्षेत्र और उसके पाररजस्थनतकी संवेिी जोन की सीमा के भू-ननिेशांक रमशः अनुलग्नि-III और अनुलग्नि-IV में संलग्न हैं। (5) पाररजस्थनतकी संवेिी जोन में आने वाले 94 गांवों की सूची अनुलग्नि-V में संलग्न है। 2. पाररस्थिततिी संवेदी जोन-िे ललए आंचललि महायोजना – (1) राज्र् सरकार, पाररजस्थनतकी संवेिी जोन के प्रर्ोजनों के ललए इस अधिसूचना में दिए गए उपबंिों के अनुसरण में राजपत्र में इस अधिसूचना के प्रकाशन की तारीि से िो वर् ा के भीतर, स्थानीर् व्र्जततर्ों के परामश ा से और भीतर राज्र् सरकार में सक्षम प्राधिकारी के अनुमोिन के ललए एक आंचललक महार्ोजना तैर्ार और अधिसूधचत करेगी। (2) राज्र् सरकार द्वारा पाररजस्थनतकी संवेिी जोन के ललए आचलं लक महार्ोजना को इस अधिसूचना में ववननदिाट ट तत्समर् प्रवतृ ववधि के ललए सुसंगत ववधिर्ों तथा केन्द्रीर् सरकार द्वारा जारी मागिा शका लसद्िांतों के अनुरूप र्दि कोई हों, तैर्ार ककर्ा जार्ेगा। (3) आंचललक महार्ोजना को उतत र्ोजना में पाररजस्थनतकी तथा पर्ाावरण ववचारों को समादहत करने के ललए, राज्र् सरकार ननम्नललखित ववभागों के परामश ा से तैर्ार ककर्ा जाएगा, अथाात:्[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 i. पर्ाावरण; ii वन और वन्द्र्जीव iii. शहरी ववकास; iv. पंचार्ती राज और ग्रामीण ववकास; v. पर्टा न; vi. राजस्व; vii. कृवर्; viii. राजस्थान राज्र् प्रिर्ू ण ननर्ंत्रण बोड;ा ix. लसचं ाई और बाढ़ ननर्ंत्रण; x. नगर पाललका; और, xi. लोक ननमााण ववभाग और राजमाग।ा (4) जब तक इस अधिसूचना में ववननदिाटट न हो, आंचललक महार्ोजना में अनुमोदित ववद्र्मान भू-उपर्ोग, अवसंरचना और करर्ाकलापों पर कोई ननबिं न अधिरोवपत नहीं ककर्ा जाएगा तथा आचलं लक महार्ोजना में सभी अवसंरचनाओं और करर्ाकलापों में सुिार करके उन्द्हें अधिक िक्ष और पाररजस्थनतकी-अनुकूल बनाने की व्र्वस्था की जाएगी। (5) इस आंचललक महार्ोजना में वनरदहत और अवरलमत क्षेत्रों के जीणोंद्िार, ववद्र्मान जल ननकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंिन, जल-संभरों के प्रबिं न, भू-जल के प्रबंिन, मिृ ा और नमी के संरक्षण, स्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्थनतकी एव ं पर्ाावरण से संबंधित ऐस े अन्द्र् पहलुओं के ललए उपबंि ककर्े जार्ेंगे जजन पर ध्र्ान दिर्ा जाना आवश्र्क है। (6) इस आंचललक महार्ोजना में सभी ववद्र्मान पूजा सथ् लों, ग्रामों एव ं शहरी बजस्तर्ों, वनों की श्रेखणर्ों एव ं ककसम् ों, कृवर् क्षेत्रों, उद्र्ानों एव ं उद्र्ानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् जल ननकार्ों की सीमा का सहार्क मानधचत्र के साथ ननिाारण ककर्ा जाएगा और प्रस्ताववत भू-उपर्ोग की ववशर्े ताओं का ब्र्ौरा भी दिर्ा जाएंगा। (7) आंचललक महार्ोजना में पाररजस्थनतकी संवेिी जोन में ववकास का ववननर्मन ककर्ा जाएगा और सारणी के पैरा में सूचीबद्ि 4 प्रनतलसद्ि और ववननर्लमत करर्ाकलापों का अनुपालन ककर्ा जाएगा और इसमें स् थानीर् समुिार् की आजीववका की सुरक्षा के ललए पाररजस्थनतकी-अनुकूल ववकास को भी सुननजश्चत ककर्ा जाएगा और संविना ककर्ा जाएगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (8) आंचललक महार्ोजना, क्षेत्रीर् ववकास र्ोजना के साथ सह-ववस्तारी होगी। (9) इस प्रकार अनुमोदित आंचललक महार्ोजना, मॉनीटरी सलमनत के ललए एक प्रनत ननिेश िस्तावेज का काम करेगी ताकक वह इस अधिसूचना के उपबंिों के अनुसार मॉनीटरी के अपने कतव्ा र्ों का ननवहा न कर सके। 3. राज्य सरिार द्वारा किए जाने वाले उपाय - राज्र् सरकार इस अधिसूचना के उपबंिों को प्रभावी बनाने के ललए ननम्नललखित उपार् करेगी, अथाात:् - (1) भू-उपयोग – (क) पाररजस्थनतकी संवेिी जोन में वनों, बागवानी क्षेत्रों, कृवर् क्षेत्रों, मनोरंजन के प्रर्ोजनों के ललए अलभज्ञात उद्र्ानों और िलु े स्थानों का वाखणजज्र्क र्ा औद्र्ोधगक करर्ाकलापों के ललए प्रर्ोग र्ा संपररवतना नही होगा: परंत ु पाररजस्थनतकी संवेिी जोन के भीतर उपर्ुता त भाग (क) में ववननदिाटट प्रर्ोजन से लभन्द्न ककसी अन्द्र् प्रर्ोजन के ललए कृवर् और अन्द्र् भूलम का संपररवतना मॉनीटरी सलमनत की लसफाररश पर और क्षेत्रीर् नगर र्ोजना अधिननर्म तथा र्था लागू केन्द्रीर् सरकार/राज्र् सरकार के अन्द्र् ननर्मों एव ं ववननर्मों के अिीन सक्षम प्राधिकारी के पूव ा अनुमोिन से और इस अधिसूचना के उपबंिों के द्वारा स्थानीर् ननवालसर्ों की ननम्नललखित आवासीर् आवश्र्कताओं को पूरा करने के ललए अनुज्ञात ककर्ा जा सकेगा:- (i) ववद्र्मान सडकों को चौडा करना और उन्द्हें सुदृढ़ करना तथा नई सडकों का ननमााण करना; (ii) बुननर्ािी ढांचों और नागररक सुवविाओं का संननमााण और नवीकरण; (iii) प्रिर्ू ण उत्पन्द्न न करने वाले लघु उद्र्ोग; (iv) ग्राम उद्र्ोग सदहत कुटीर उद्र्ोग; पाररजस्थनतकी पर्टा न में सहार्क सुवविा भण्डार, और गहृ वास सदहत स्थानीर् सुवविाएं; और (v) पैरा 4 के अतं गता वखणता संवधिता कार्का लाप; परंत ु र्ह और कक संघ शालसत राज्र् सरकार अनुमोिन के बबना एव ं भारत के संवविान के अनुच्छेि 244 के उपबंिों तथा तत्समर् प्रवत्तृ ववधि, जजसके अतं गता अनुसधू चत जनजानत और अन्द्र् परंपरागत वन ननवासी (वन अधिकारों की मान्द्र्ता) अधिननर्म, 2006 (2007 का 2) भी आता है, का अनुपालन ककए बबना वाखणजज्र्क और औद्र्ोधगक ववकास करर्ाकलापों के ललए जनजातीर् भूलम के प्रर्ोग की अनुज्ञा नहीं होगी; परंत ु र्ह भी कक पाररजस् थनतकी संवेिी जोन के भीतर आने वाली भूलम के अलभलेिों में उत्पन्द्न ककसी त्रदु ट को, मॉनीटरी सलमनत के ववचार प्रातत करने के पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामले में एक बार सुिारा जा सकेगा और उतत त्रदु ट को सुिारे जाने की संसूचना केंरीर् सरकार के पर्ाावरण, वन और जलवार्ु पररवतना मंत्रालर् को िी जाएगी;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 परंत ु र्ह भी कक उपर्ुता त त्रदु ट के संशोिन में इस उप परै ा के अिीन र्था उपबंधित के लसवार् ककसी भी िशा में भू-उपर्ोग का पररवतना सजम्मललत नहीं होगा ; (ि) वनीकरण तथा पर्ाावास पुनःस्थापन कार्का लापों के माध्र्म स े अप्रर्ुतत र्ा अनत्ु पािक कृवर् क्षेत्रों में पुनः वन लगाने के प्रर्ास ककए जाएंगें; (2) प्रािृतति जल स्रोत.- सभी प्राकृनतक झरनों/नदिर्ों/चनै लों जलमागों के जलग्रहण क्षेत्रों की पहचान की जाएगी और आंचललक महार्ोजना में उनके संरक्षण और बहाली की र्ोजना सजम् मललत की जाएगी और राज्र् सरकार द्वारा मागिा शका लसद्िांत इस रीनत से तैर्ार ककए जाएंगे कक उसमें जो ऐस े क्षेत्रों के ललए हाननकारक हैं र्ा उसके पास ववकास करर्ाकलापों को प्रनतवर्द्ि और ननबधं ित ककर्ा गर्ा हो। (3) पयटय न एव ं पाररस्थिततिी पयटय न – (क) पाररजस्थनतकी संवेिी जोन में सभी नए पाररजस्थनतकी पर्टा न करर्ाकलाप र्ा ववद्र्मान पर्टा न करर्ाकलापों का ववस्तार पाररजस्थनतकी संवेिी जोन संबंिी पर्टा न महार्ोजना के अनुसार होगा। (ि) पाररजस्थनतकी पर्टा न महार्ोजना राज्र् सरकार के पर्ाावरण और वन ववभाग के परामश ा स े राज्र् सरकार के पर्टा न ववभाग द्वारा बनार्ी जाएगी। (ग) पर्टा न महार्ोजना आंचललक महार्ोजना एक घटक के रूप में होगी। (घ) पर्टा न महार्ोजना पाररजस्थनतकी-संवेिी जोन की वहन क्षमता के अध्र्र्न के आिार पर तैर्ार की जार्ेगी। (ङ) पाररजस्थनतकी पर्टा न संबंिी करर्ाकलाप ननम् नानुसार ववननर्लमत ककए जाएंगे, अथाात:्- (i) संरक्षक्षत क्षेत्र की सीमा से एक ककलोमीटर के भीतर र्ा पाररजस्थनतकी संवेिी जोन की सीमा तक, इनमें से जो भी अधिक ननकट हो: ककसी होटल र्ा ररजॉटा का नर्ा सजन्द्नमााण र्ा अनुमत नही ं ककर्ा जाएगा, परंत ु र्ह, पाररजस्थनतकी पर्टा न सुवविाओं के ललए संरक्षक्षत क्षेत्र की सीमा से एक ककलोमीटर की िरू ी स े परे पाररजस्थनतकी संवेिी जोन की सीमा तक पूव ा पररभावर्त और अलभदहत क्षेत्रों में पर्टा न महार्ोजना के अनुसार, नए होटलों और ररजॉटा की स्थापना और अनुमत होगी; (ii) पाररजस्थनतकी-संवेिी जोन के अन्द्िर सभी नए पर्टा न करर्ा-कलापों र्ा ववद्र्मान पर्टा न करर्ाकलापों का ववस्तार, केन्द्रीर् सरकार के पर्ावा रण, वन और जलवार्ु पररवतना मंत्रालर् द्वारा8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] जारी मागिा शका लसद्िांतों तथा पाररजस्थनतकी पर्टा न, पाररजस्थनतकी-लशक्षा और पाररजस्थनतकी-ववकास पर बल िेने वाले राटट्रीर् व्र्ाघ्र संरक्षण प्राधिकरण द्वारा जारी पाररजस्थनतकी पर्टा न संबंिी मागिा शका लसद्िांतों (समर्-समर् पर र्था संशोधित) के अनुसार होगा; (iii) जब तक आंचललक महार्ोजना के अनुमोिन नहीं लमल जाता, तब तक पर्टा न के ववकास और ववद्र्मान पर्टा न करर्ाकलापों के ववस्तार को स्थल-ववलशटट संवीक्षा और मॉनीटरी सलमनत की लसफाररश के आिार पर संबंधित ववननर्ामक प्राधिकरणों द्वारा अनुमत ककर्ा जाएगा और पाररजस्थनतकी संवेिी जोन में ककसी नर्े होटल/ररजाटा र्ा वाखणजज्र्क प्रनतटिान का संननमााण की अनुमनत नहीं िी जाएगी। (4) प्रािृतति ववरासत – पाररजस्थनतकी संवेिी जोन में बहुमूल्र् प्राकृनतक ववरासत के सभी स्थलों जैस े कक जीन पूल ररज़वा क्षेत्र, शैल संरचना, जल प्रपात, झरने, िरे, उपवन, गुफाएं, स्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की जाएगी और उनकी सुरक्षा एव ं संरक्षण के ललए आंचललक महार्ोजना के भाग के रूप में एक ववरासत संरक्षण र्ोजना बनार्ी जाएगी। (5) मानव तनलमतय ववरासत थ िल - पाररजस्थनतकी संवेिी जोन में भवनों, संरचनाओ,ं कलाकृनत-क्षेत्रों तथा ऐनतहालसक, स्थापत्र् संबिी, सौंिर्ाात्मक और सांस्कृनतक महत्व के क्षेत्रों की पहचान की जाएगी और उनके संरक्षण के ललए आंचललक महार्ोजना के भाग के रूप में एक ववरासत संरक्षण र्ोजना बनार्ी जाएगी। )6( ध् वतन प्रदषू ण - पाररजस्थनतकी संवेिी जोन में ध्वनन प्रिर्ू ण की ननवारण और ननर्ंत्रण का अनुपालन पर्ाावरण (संरक्षण) अधिननर्म 1986 और उसके र्था संशोिनों के अिीन ध्वनन प्रिर्ू ण (ववननर्मन और ननर्ंत्रण) ननर्म, 2000 के उपबंिों के अनुसार ककर्ा जाएंगा । (7) वाय ु प्रदषू ण. पाररजस्थनतकी संवेिी जोन में वार्ु प्रिर्ू ण का ननवारण और ननर्ंत्रण का अनुपालन (प्रिर्ू ण की रोकथाम और ननर्ंत्रण) अधिननर्म, 1981 (1981 का 14), तथा तद्िीन बनाए गए ननर्मों और संशोिनों के उपबंिों के अनुसार ककर्ा जाएगा । (8) बहहस्राव िा तनथसरण. - पाररजस्थनतकी संवेिी जोन में उपचाररत बदहःस्राव का ननवहा न जल (प्रिर्ू ण ननवारण एव ं ननर्ंत्रण) अधिननर्म, 1974 (1974 का 6) पर्ाावरण (संरक्षण) अधिननर्म, 1986 और उसके अिीन बनाए गए ननर्मों र्ा राज्र् सरकार द्वारा ननिााररत मानिंडों, जो भी अधिक किोर हो, के उपबंिों के अनुसार ककर्ा जाएगा। (9) ठोस अपलिष्ट. - िोस अपलशटटों का ननपटान ननम्नललखित रूप में होगा-- (क) पाररजस्थनतकी संवेिी जोन में िोस अपलशटट का ननपटान और प्रबन्द्िन भारत सरकार के पर्ाावरण, वन और जलवार्ु पररवतना मंत्रालर् की अधिसूचना संख्र्ा का.आ. 1357 (अ), तारीि 8[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 अप्रैल, 2016 के अिीन प्रकालशत िोस अपलशर्ट् प्रबंिन ननर्म, 2016, समर् -समर् पर र्था संसोधित उपबंिों अनुसार ककर्ा जाएगा; अकाबना नक सामग्री का ननपटान पर्ाावरणीर् रीनत में पाररजस्थनतकी संवेिी जोन से बाहर अलभज्ञात स्थल पर ककर्ा जाएगा । (ि) पाररजस्थनतकी संवेिी जोन में मान्द्र् अलभज्ञात प्रौद्र्ोधगककर्ों का प्रर्ोग करत े हुए ववद्र्मान ननर्मों और ववननर्मों के अनुरूप िोस अपलशटट का सुरक्षक्षत और पर्ाावरण अनुकूल प्रबंिन अनुज्ञात ककर्ा जार्ेगा। (10) जैव धचकित्सा अपलिष्ट. - जैव धचककत्सा अपलशटट का प्रबंिन ननम्नललखित रूप में होगा- (क) पाररजस्थनतकी संवेिी जोन में जैव धचककत्सा अपलशटट का ननपटान भारत सरकार के पर्ाावरण, वन और जलवार्ु पररवतना मंत्रालर् की अधिसूचना संख्र्ा सा.का.नन. 343 (अ), तारीि 28 माच,ा 2016 के अिीन प्रकालशत जैव धचककत्सा अपलशटट प्रबंिन ननर्म, 2016, समर् -समर् पर र्था संशोधित उपबंिों के अनुसार ककर्ा जाएगा। (ि) पाररजस्थनतकी संवेिी जोन में अलभज्ञात प्रौद्र्ोधगककर्ों का प्रर्ोग करते हुए ववद्र्मान ननर्मों और ववननर्मों के अनुरूप जैव धचककत्सा अपलशटट का सुरक्षक्षत और पर्ाावरण अनुकूल प्रबंिन (ईएसएम) अनुमत ककर्ा जार्ेगा। (11) प्लास्थटि अपलिष्ट िा प्रबंिन. – पाररजस्थनतकी संवेिी जोन में तलाजस्टक अपलशटट का प्रबंिन भारत सरकार के पर्ाावरण, वन और जलवार्ु पररवतना मंत्रालर् की समर् -समर् पर र्था संसोधित अधिसूचना संख्र्ा सा.का.नन. 340 (अ), तारीि 18 माच,ा 2016, के अिीन प्रकालशत तलाजस्टक अपलशटट प्रबंिन ननर्म, 2016 के उपबंिो के अनुसार ककर्ा जाएगा। (12) सस्ननमायण और ववध्वंस अपलिष्ट िा प्रबंिन.- पाररजस्थनतकी-संवेिी जोन में सजन्द्नमााण और ववध्वंस अपलशटट का प्रबिं न भारत सरकार के पर्ाावरण, वन और जलवार्ु पररवतना मंत्रालर् की समर् -समर् पर र्था संसोधित अधिसूचना संख्र्ा सा.का.नन. 317 (अ), तारीि 29 माच,ा 2016 के अिीन प्रकालशत सजन्द्नमााण और ववध्वंस अपलशटट प्रबंिन ननर्म, 2016 के उपबंिों के अनुसार ककर्ा जाएगा। (13) ई–अपलिष्ट. - पाररजस्थनतकी-संवेिी जोन में ई–अपलशटट का प्रबंिन भारत सरकार के पर्ाावरण, वन और जलवार्ु पररवतना मंत्रालर् द्वारा प्रकालशत और समर् -समर् पर र्था संशोधित ई–अपलशटट प्रबंिन ननर्म, 2016 के उपबंिों के अनुसार ककर्ा जाएगा। 14. वाहन यातायात .- वाहन र्ातार्ात को पर्ाावास-अनुकूल तरीके से ववननर्लमत ककर्ा जाएगा और इस संबंि में आंचललक महार्ोजना में ववशर्े उपबंि सजम्मललत ककए जाएंगे और आंचललक10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] महार्ोजना के तैर्ार होने और राज्र् सरकार के सक्षम प्राधिकारी से अनुमोदित होने तक, मॉनीटरी सलमनत सुसंगत अधिननर्मों और उनके अिीन बनाए गए ननर्मों एव ं ववननर्मों के अनुसार वाहन र्ातार्ात के अनुपालन की मॉनीटरी करेगी। (15) वाहन प्रदषू ण.- वाहन प्रिर्ू ण की रोकथाम और ननर्ंत्रण लाग ू कानूनों के अनुसार ककर्ा जाएगा। स्वच्छ ईंिन जैसे सीएनजी, एलपीजी आदि के उपर्ोग के ललए प्रर्ास ककए जाएंगे। (16) औद्योधगि ईिाइया.ं – (क) राजपत्र में इस अधिसूचना के प्रकाशन पर र्ा उसके पश्चात ् पाररजस्थनतकी-संवेिी जोन के भीतर कोई नए प्रिर्ू णकारी उद्र्ोगों की स्थापना की अनुमनत नही ं िी जाएगी। (ि) केन्द्रीर् प्रिर्ू ण ननर्ंत्रण बोड ा द्वारा फरवरी, 2016, समर्-समर् पर र्था संशोधित जारी मागिा शका लसद्िान्द्तों में उद्र्ोगों के वगीकरण के अनुसार, जब तक कक अधिसूचना में इस प्रकार ववननदिाटट न हो, पाररजस्थनतकी-संवेिी जोन के भीतर केवल गैर-प्रिर्ू णकारी उद्र्ोगों को अनुज्ञात ककर्ा जाएगा और इसके अनतररतत, गैर प्रिर्ू णकारी उद्र्ोगों का संविना जाएगा। (17) पहाडी ढलानों िा संरक्षण. - पहाडी ढलानों का संरक्षण ननम्नानुसार ककर्ा जाएगा:- (क) आंचललक महार्ोजना में पहाडी ढलानों के उन क्षेत्रों को िशाार्ा जाएगा जजनमें ककसी भी प्रकार के ननमााण कार्ा की अनुज्ञा नहीं होगी; (ि) जजन ढलानों र्ा ववद्र्मान िडी पहाडी ढलानों में अत्र्धिक भू-क्षरण होता है उनमें ककसी भी प्रकार के ननमााण कार् ा की अनुज्ञा नहीं होगी । 4. पाररस्थिततिी-संवेदी जोन में प्रततवषद्ि या ववतनयलमत किए जाने वाले कियािलापों िी सूची- पाररजस्थनतकी-संवेिी जोन में सभी करर्ाकलाप पर्ाावरण (संरक्षण) अधिननर्म, 1986 (1986 का 29) के उपबंिों तथा इसके अतं गता बनाए गए ननर्मों एवं अन्द्र् अधिसूचना, पर्वा रण, वन तथा वन्द्र्जीव से संबंधित भारत सरकार के ववधिर्ों तथा अधिननर्मों, तत्कालीन पर्ाावरण एवं वन मंत्रालर्, दिनाक 14 लसतंबर, 2006 की अधिसूचना सं0 1533 (अ) और इस संबंि में तत्समर् प्रवत्तृ ववधिर्ों ओर ननच े िी गई सारणी में ववननदिाटट समर्-समर् पर र्था संशोिन के तहत, नामत:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 सारणी िम स.ं कियािलाप हटप्पणी ि. प्रततवषद्ि कियािलाप 1 वाखणजज्र्क िनन, पत्थर 1. पाररजस्थनतकी संवेिी जोन के भीतर घरों के उत्िनन और अपघर्णा ननमाणा र्ा मरम्मत के ललए लमट्टी िोिने इकाईर्ााँ । सदहत स्थानीर् ननवालसर्ों की घरेल ू जरूरतों को पूरा करन े को छोडकर, सभी नए और मौजूिा िनन (लघ ु और प्रमुि िननज), पत्थर उत्िनन और उनके तोडने की इकाइर्ों पर तत्काल प्रभाव से प्रनतबंि लगार्ा गर्ा है; (ि) िनन कार्,ा जो टी.एन. गोिावमना धथरुमुलपाि बनाम र्ूओआई के डब्ल्र्ू.पी.(सी) संख्र्ा 202/1995 के मामले में; दिनांक 21 अप्रैल, 2014 के आिेश (आिेशों) के अनुसार, जो गोवा फाउंडशे न बनाम र्ूओआई के डब्ल्र्ू.पी.(सी) संख्र्ा 435/2012 और आईए संख्र्ा 1000/2003 दिनांक 03 जून, 2022 और उसके बाि आईए संख्र्ा 131377/2022 ननणर्ा दिनांक 26 अप्रैल, 2023 और 28 अप्रैल, 2023 के मामले में दिए गए थे; माननीर् उच्चतम न्द्र्ार्ालर् के दिनांक 4 अगस्त, 2006 के आिेश (आिेशों) के अनुसार ककए जाएंगे। 2 प्रिर्ू ण (जल, वार्ु, मिृ ा, पाररजस्थनतकी-संवेिी जोन में नर्े उद्र्ोगों और ध्वनन, आदि) पैिा करन े वतमा ान प्रिर्ू णकारी उद्र्ोगों का ववस्तार करने की वाले उद्र्ोगों की स्थापना। अनुमनत नहीं होगी। मौजूिा उद्र्ोगों द्वारा जोन के भीतर नई और स्थापना। ववद्र्मान आरा मीलों के ववस्तार की अनुमनत नहीं होगी। 7 ईंट भट्टों की स्थापना प्रनतवर्द्ि। करना। 8 जलावन लकडी का प्रनतवर्द्ि। वाखणजज्र्क उपर्ोग। 9 नई पवन चजतकर्ों का प्रनतवर्द्ि। ननमााण 10 फमों और कंपननर्ों, प्रनतवर्द्ि; परंत ु कक स्थानीर् ककसानों द्वारा छोटे कारपोरेट, आदि द्वारा बड े पैमाने पर कुतकुट पालन समर्-समर् पर र्था पैमाने पर वाखणजज्र्क संशोधित सीपीसीबी मागिा शक लसद्िांतों 2016 के पशुिन और कुतकुट अनुसार स्थावपत ककए जा सकते हैं। पालन इत्र्ादि की स्थापना। ख.ववतनयलमत कियािलाप 11 होटलों और ररसोटों की पाररजस्थनतकी पर्टा न करर्ाकलापों हेत ु लघ ु व वाखणजज्र्क स्थापना । अस्थार्ी संरचनाओ ं के ननमााण के लसवार्, संरक्षक्षत[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 13 क्षेत्र की सीमा से एक ककलोमीटर के भीतर र्ा पाररजस्थनतकी-संवेिी जोन की सीमा तक, इनमें जो भी अधिक ननकट हो, नए वाखणजज्र्क होटलों और ररसोटों की स्थापना की अनुमनत नही ं होगी: परंत ु कक संरक्षक्षत क्षेत्र की सीमा से एक ककलोमीटर बाहर र्ा पाररजस्थनतकी-संवेिी जोन की सीमा तक, इनमें जो भी अधिक ननकट हो, पर्टा न महार्ोजना और लागू मागिा शका लसद्िांतों के अनुसार सभी नए पर्टा न करर्ाकलाप करने र्ा ववद्र्मान करर्ाकलापों का ववस्तार करने की अनुज्ञा होगी । 12 संननमााण करर्ाकलाप । (क) संरक्षक्षत क्षेत्र की सीमा से एक ककलोमीटर िार्रे में र्ा पाररजस्थनतकी संवेिी जोन की सीमा तक, जो भी ननकटतम हो, ककसी भी प्रकार के नए वाखणजज्र्क ननमााण की अनुमनत नहीं िी जाएगी: परंत, ु स्थानीर् लोगों को स्थानीर् ननवालसर्ों की आवासीर् आवश्र्कताओ ं को पूरा करने के ललए भवन उप-ननर्मों के अनुसार पैराग्राफ 3 के उप-पैरा (1) में सूचीबद्ि करर्ाकलापों सदहत उनके उपर्ोग के ललए उनकी भूलम पर ननमााण कार् ा करने की अनुमनत िी जा सकेगी: परंत ु र्ह और कक प्रिर्ू ण न फैलाने वाले लघु उद्र्ोगों से संबंधित ननमाणा संबंिी करर्ाकलापों को प्रर्ोजर्् ननर्मों और ववननर्मों, र्दि कोई हो, के अनुसार तथा सक्षम प्राधिकारी से पूव ा अनुमोिन से ववननर्लमत ककर्ा जाएगा और न्द्र्ूनतम ही रिा जाएगा। (ि) एक ककलोमीटर के िार्रे से आगे इस े आंचललक महार्ोजना के अनुसार ववननर्लमत ककर्ा जाएगा।14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 13 लघु पैमाने के प्रिर्ू ण न फरवरी, 2016 में केन्द्रीर् प्रिर्ू ण ननर्ंत्रण बोड ा द्वारा फैलाने वाले उद्र्ोग। जारी उद्र्ोगों के वगीकरण, समर्-समर् पर र्था संशोधित के अनुसार प्रिर्ू ण न फैलाने वाले उद्र्ोग, तथा पाररजस्थनतकी संवेिी जोन से स्विेशी सामधग्रर्ों से उत्पाि बनान े वाले जोखिम रदहत, लघ ु एव ं सेवा उद्र्ोग, कृवर्, पुटप-कृवर्, बागवानी र्ा कृवर्-आिाररत उद्र्ोगों को सक्षम प्राधिकारी द्वारा अनुमनत िी जाएगी। 14 वक्षृ ों की कटाई। (क) राज्र् सरकार के सक्षम प्राधिकारी की पूव ा अनुमनत के बबना वन, सरकारी, राजस्व र्ा ननजी भूलम पर से वक्षृ ों की कटाई की अनुज्ञा नहीं होगी। (ि) वक्षृ ों की कटाई को संबंधित केन्द्रीर् र्ा राज्र् अधिननर्म तथा उसके अिीन बनाए गए ननर्मों के उपबंिों के अनुसार ववननर्लमत ककर्ा जाएगा। 15 वन उतप् ाि र्ा काटिेतर लागू ववधिर्ों के अिीन ववननर्लमत। वन उतप् ाि का संग्रहण। 16 ववद्र्ुत एव ं संचार टावरों लागू ववधिर्ों के अिीन ववननर्लमत (भूलमगत का ननमााण तथा केबल केबललगं को बढ़ावा दिर्ा जा सकता है)। बबछाना एव ं अन्द्र् अवसंरचनाएं। 17 नागररक सुवविाओं सदहत लागू ववधिर्ों, ननर्मों और ववननर्मों तथा उपलब्ि अवसंरचना। मागिा शका लसद्िांतों के अनुसार शमन के साथ ककर्ा जाएगा। 18 मौजूिा सडकों का लागू ववधिर्ों, ननर्मों और ववननर्मों तथा उपलब्ि चौडीकरण एव ं सुदृढ़ीकरण मागिा शका लसद्िांतों के अनुसार शमन के साथ ककर्ा तथा नई सडकों का जाएगा। ननमााण।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 15 19 पर्टा न से संबंधित अन्द्र् लागू ववधिर्ों के अनुसार ववननर्लमत। करर्ाकलाप जैस े ववधिर्ों के अिीन वर्् ावसानर्क उद्िेश्र् के ललए आवागमन। ववननर्लमत। 22 स्थानीर् समुिार्ों द्वारा स्थानीर् लोगों के उपर्ोग के उद्िेशर्् से लाग ू डर्े री, डर्े री फालमगं , ववधिर्ों के अिीन अनुमनत िी गई है। जलीर् कृवर् और मत्स्र् पालन के साथ-साथ की जा रही कृवर् और बागवानी कार् ा प्रथाएाँ। 23 फमों, कॉपोरेटों और स्थानीर् आवश्र्कताओं को पूरा करने के अलावा कंपननर्ों द्वारा बड े पैमान े लागू ववधिर्ों के अिीन ववननर्लमत। पर वर्् ावसानर्क पशुिन और मुगीपालन की स्थापना। 24 प्राकृनतक जल ननकार्ों र्ा उपचाररत अपलशटट जल र्ा अपलशटटों को जल भूलम क्षेत्र में उपचाररत ननकार्ों में जाने से रोका जाएगा और उपचाररत अपलशटट जल/अपलशटटों अपलशटट जल के पुनचरा ण और पुनः उपर्ोग के का ननवहा न। ललए प्रर्ास ककए जाएंगे। अन्द्र्था, अनुपचाररत अपलशटट जल/अपलशटटों के ननवहा न को लागू ववधिर्ों के अिीन ववननर्लमत ककर्ा जाएगा।16 THE published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available Draft Notification WHEREAS, the Kumbhalgarh Wildlife Sanctuary is situated in one of the most fragile ecosystems of the Aravalli range and lies approximately 80 kilometers north of the picturesque Lake City of Udaipur. Geographically, the sanctuary is located between 73°02′ to 73°30′ East longitude and 25°00′ to 25°40′ North latitude. It spans an area of 610.528 square kilometers, covering parts of Rajsamand, Pali, and Udaipur districts in the state of Rajasthan; AND WHEREAS the Kumbhalgarh Wildlife Sanctuary makes an ecotone between hilly forests of Aravallis and Thar Desert situated in the west. Kumbhalgarh hills acts like a barrier, checking eastward extension of desert. Famous Kumbhalgarh Fort situated atop of a hill is an attraction for tourists. The eastern part of the Sanctuary is mostly ranges having an altitude of more than 3500 feets above sea level, while the western part of the Sanctuary is adjoined to the Marwar plains; AND WHEREAS the Sanctuary offers diverse topography, adding more to its significance as it also forms a dividing line between the two major watersheds of the country. Its eastern part is considered as source of river Banas, which falls into the Bay of Bengal. The rainwater on the western slope flow in the form of the small rivers like Sukdi, Mithdi, Sumer and Kot, all these forming the tributaries of river Luni which ultimately merges into the Arabian Sea; AND WHEREAS the sanctuary supports rich and unique biodiversity which is home for species like wild boar (Sus scrofa), grey musk shrew (Sunchus murinus), bat (Cyanopterus sphynx), flying fox (Pteropus gigenticus), Common leopard (Panthera pardus), striped hyena (Hyaena hyaena), jungle cat (Felis chaus), five striped palm squirrel (Funambulus pennanti), Indian pangolin (Manis carassicaudata), Indian fox (Vulpes bengalensis), common mongoose (Herpestes edwardsi), blue bull (Boselaphus tragocamelus), Indian porcupine (Hystrix indica), chinkara (Gazella gazella), jackal (Canis aureus), Indian small civet34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (Vivaricula indica) etc. While important birds found in the Sanctuary are painted francolin (Francolinus pictus), grey francolin (F. pondicerianus), common quail (Coturnix coturnix), rain quail (C. coromadelica), rock bush quail (Perdicula argoundah), yellow-legged button quail (Turnix tanki), barred button quail (T. suscitator), Indian peafowl (Pavo cristatus), ruddy shelduck (Tadorana ferruginea), gadwal (Anas strepera), common teal (A. crecca), garganey (A. querquedula), etc.; AND WHEREAS the major flora found in the Sanctuary are khair (Acacia catechu), ronjh (Acaia leucophloea), desi bawalia (Acacia nilotica), kumta (Acacia senegal), haldu (Adina cordifolia), bili (Aegle marmelos), ardusa, paba (Ailanthus excelsa), ankol (Alangium salvifolium), black siris (Albizzia leibbeck), safed siris (Albizzia odoratissima), safed siris (Albizzia procera), sitaphal (Annona sequamosa), dhokda (Anogeissus pendula), dhavda (Anogeissus latifolia), adrukh, indok (Anogeissus sericea), neem (Azadirachta indica), hingot (Balanites aegyptica), semal (Bombax ceiba), salar (Boswellia serrata), khakhro (Butea monosperma), karmela (Cassia fistula), kasid (Cassia siamea), gunda, lisoda (Cordia mixa), varna (Crataeva religiosa), sissoo (Dalbergia sissoo), timru (Diospyros melanoxylon), tambolia (Ehretia laevis), amla (Emblica officinalis), dhed khakhro (Erythrina suberosa), umara (Ficus racemosa), piplo (Ficus religiosa), kankan (Flacourtia montana), dikamari (Gardenia resinifera), khad dhaman (Grewia hirsuta) etc.; AND WHEREAS it is necessary to conserve and protect the area, extent and boundary which is specified in paragraph 1 of this notification around the protected area of Kumbhalgarh Wildlife Sanctuary as Eco-sensitive zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub section (l) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of Rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area around the boundary of Kumbhalgarh Wildlife Sanctuary in the State of Rajasthan as the Kumbhalgarh Wildlife Sanctuary, Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of Eco-sensitive Zone. – (1) the extent of Eco-Sensitive Zone is zero to one kilometre around the boundary of Kumbhalgarh Wildlife Sanctuary encompassing an ESZ area of 243 square kilometre. The Zero extent of Eco-sensitive Zone in the northern boundary of Sanctuary is due to common border with the Raoli Todgarh Wildlife Sanctuary. The extent of Eco-sensitive Zone at different directions are: North 0 kilometre North- East 1.00 kilometre East 1.00 kilometre South-East 1.00 kilometre South 1.00 kilometre South-West 1.00 kilometre West 1.00 kilometre North-West 1.00 kilometre (2) The boundary description of Eco-sensitive Zone is appended as Annexure- I. (3) The maps of the Eco-Sensitive Zone along with boundary details are appended as Annexure- II A, Annexure-II B and Annexure- II C.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 35 (4) The geo-coordinates of the boundary of protected area and its Eco-sensitive Zone is appended as Annexure- III and Annexure- IV respectively. (5) The list of 94 villages falling within the Eco-sensitive Zone is appended as Annexure- V. 2. Zonal Master Plan for Eco-Sensitive Zone. – (1) The State Government shall, for the purpose of the Eco-sensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan: i. Environment; ii. Forest and Wildlife; iii. Urban Development; iv. Panchayati Raj and Rural Development v. Tourism; vi. Revenue; vii. Agriculture; viii. Rajasthan State Pollution Control Board; ix. Irrigation and Flood Control; x. Municipality and; xi. Public Works and Highways (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco- friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table in paragraph 4 and also ensure and promote eco- friendly development for livelihood security of local communities. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government. -The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities. Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as: i. Widening and strengthening of existing roads and construction of new roads; ii. Construction and renovation of infrastructure and civic amenities; iii. Small scale industries not causing pollution; iv. Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and v. Promoted activities given under paragraph 4. Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.– The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 37 Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism.– a) All new eco-tourism activities or expansion of existing tourism activities within the Eco- Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; b) the Eco-Tourism Master Plan shall be prepared by State Department of Tourism in consultation with State Departments of Environment and Forests; c) the Tourism Master Plan shall form a component of the Zonal Master Plan; d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco- Sensitive Zone; e) the activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometer from the boundary of the protected area or upto the extent of the Eco-Sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco- Sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco- tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-Sensitive Zone area. (4) Natural heritage.– All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.– Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. (6) Noise pollution.– Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986 and as amended from time to time.38 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (7) Air pollution.– Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto. (8) Discharge of effluents.– Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.– Disposal and Management of solid wastes shall be as under:- a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 and as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco- Sensitive Zone. (10) Bio-medical waste.– Bio medical waste management shall be as under: a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016, as amended from time to time. b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (11) Plastic waste management.– The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.– The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.– The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 39 and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.– Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc. (16) Industrial units.– a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. b) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016 as amended from time to time, unless so specified in this notification. In addition, non- polluting cottage industries shall be promoted. (17) Protection of hill slopes.– The protection of hill slopes shall be as under: (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. Functions of Monitoring Committee.– (1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinise, the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification. (2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring44 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case-to-case basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in Annexure-VI, appended to this notification. (6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures: - The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Orders, Supreme Court, etc:- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
