अजधसचू ना नई दिल्ली,13 िून , 2025 का.आ. 2644(अ).— जनम्नजलजखत प्रारूप अजधसचू ना, जिसे केन्द्रीर् सरकार पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (2) के खडं (v) और खंड (xiv) तथा उपधारा (3) के साथ परित उपधारा (1) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए िारी करन े का प्रस्ट्ताव करती ह,ै पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के अधीन जवजहत उपबंधों के अनुसार, उसस े प्रभाजवत होने वाली िनता की िानकारी के जलए एतद्द्वारा प्रकाजित की िाती ह;ै और इसके द्वारा र्ह सूचना िी िाती ह ैदक उि प्रारूप अजधसूचना उस तारीख स ेसाि दिन की अवजध की समाजि पर र्ा उसके पश्चात् जवचार म ें ली िाएगी, जिसको इस अजधसूचना वाले रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी िाती ह;ैं मसौिा अजधसूचना म ें जनजहत प्रस्ट्तावों पर कोई आपजत्त र्ा सुझाव िेन े म ें रुजच रखन े वाला कोई (31° 39' 29" उत्तर और 78° 17' 24" पूवा) और पजश्चम (31° 41' 27" उत्तर और 78° 13' 09" पूवा) के बीच जस्ट्थत ह।ै र्ह तैती धारा के ऊपरी िलग्रहण क्षत्रे म ेंजस्ट्थत एक उच्च ऊंचाई वाला क्षत्रे ह,ै िो सतलुि निी की एक महत्वपूण ासहार्क निी ह।ै ऊंचाई 3000 मीटर स े लेकर 5122 मीटर तक ह।ै अभर्ारण्र् िुष्क रांस-जहमालर्ी क्षत्रे का एक अनूिा पररिश्ृ र् ििााता ह,ै जिसम ें अजधकांि अभर्ारण्र् क्षत्रे काफी हि तक समतल और आंजिक रूप स ेबंिर िंडा रेजगस्ट्तान ह;ै और िबदक जलप्पा-असरंग को पहली बार 1974 म ेंजहमाचल प्रिेि राज्र् सरकार की अजधसचू ना संखर्ांक 5-11/70-एसपी, तारीख 27-04-1974 के तहत एक अभर्ारण्र् के रूप म ें अजधसूजचत दकर्ा गर्ा था। उसके बाि, अभर्ारण्र् को वन्द्र्िीव संरक्षण अजधजनर्म (1972) की धारा 26ए के अधीन 7 िून, 2013 को अजधसूचना सखं र्ा एफईई-बी-एफ(6)-11/2005-II/ जलप्पा आसरंग के अधीन र्ुजिसगं त बनाने के बाि अंजतम रूप स ेअजधसूजचत दकर्ा गर्ा था। वन्द्र्िीव अभर्ारण्र् का क्षेत्रफल 31 वगा दकलोमीटर ह;ै और िबदक अभर्ारण्र् और अजधकांि क्षत्रे भौगोजलक और िलवार् ु िोनों िजृ ि स े अलग-थलग ह,ैं जिनम ें अल्पाइन झाज़िर्ा ाँ और अल्पाइन चरागाह िैस े वन सजममजलत ह।ैं अभर्ारण्र् म ें वनस्ट्पजतर्ों और िीवों की कई सकं टग्रस्ट्त प्रिाजतर्ााँ पाई िाती ह।ैं अभर्ारण्र् म ें पाई िाने वाली आरईटी प्रिाजतर्ों सजहत प्रमुख प्रिाजतर्ों म ें जहमालर्न तहर (हजे मत्रागस िेमलाजहकस), जहमालर्ी भूरा भाल ू(उसास आकाटोस इसाबेजलनस), जहमालर्ी काला भाल ू(उसास जथबेटानस लैजनगर), कस्ट्तरू ी मगृ (मोस्ट्कस ल्र्ूकोगास्ट्टर), आईबेक्स (कैप्रा आइबेक्स), ब्लू िीप (स्ट्र्डू ोइस नार्ौर), गोराल (नेमोरहडे स गोरल) आदि सजममजलत ह।ैं र्ह अभर्ारण्र् िानिार जहम तेंिएु (पथें ेरा उजन्द्िर्ा) का घर ह ै िो जहमाचल प्रिेि का राज्र् पि ु ह ै और रांस-जहमालर्ी क्षत्रे के संरक्षण के जलए एक प्रमुख प्रिाजत ह;ै और िबदक र्ह अभर्ारण्र् एक महत्वपूणा पक्षी क्षत्रे ह ैिो अपने जवजवध पक्षी िीवन के जलए प्रजसद्ध ह,ै िो पक्षी प्रेजमर्ों और पक्षीजवज्ञाजनर्ों को आकर्षात करता ह।ै र्ह अभर्ारण्र् कई प्रवासी पजक्षर्ों के जलए सर्िार्ों के जनवास स्ट्थान के रूप म ें ह।ै अभर्ारण्र् म ेंपाए िाने वाले पक्षी और अन्द्र् कीट प्रिाजतर्ों म ेंगोल्डन ईगल (एदिला क्राइसेटोस), जहमालर्न जग्रफ़ॉन वल्चर (जिप्स जहमालर्ेंजसस), स्नो पार्ट्राि (लेरवा लरे वा), जहमालर्न मोनाल (लोफोफोरस इमपेिानस), अल्पाइन एक्सेंटर (प्रुनले ा क़ॉलररस), लैमर्िार्र (जिपेटस बाबेटस), जहमालर्न स्नोक़ॉक (टेराओगलै स जहमालर्ेंजसस) जमस्र का जगद्ध (जनर्ोफ्ऱॉन पकानोप्टेरस), राम चकोर (एलेक्टोररस चुकार), व्हाइट कैप्ड रेडस्ट्टाटा (फोजनकुरस ल्र्ूकोसेफालस), जहमालर्न बज़डा (ब्र्ूरटर्ो ररफेक्टस), क़ॉमन बैंडेड एवल (हसोरा क्रोमस), इंजडर्न दफ्ररटलरी (आर्गाजनस हाइपरजबर्स), पेंटेड लडे ी (वनै ेसा काडुाई), इंजडर्न जस्ट्कपर (हस्ट्े पेररर्ा क़ॉमा) आदि; सजममजलत ह।ैं और िबदक अभर्ारण्र् म ें कई तरह की वनस्ट्पजत प्रिाजतर्ााँ पाई िाती ह,ैं जिनम ें कई िलु ाभ और स्ट्थाजनक प्रिाजतर्ााँ भी िाजमल ह।ैं अल्पाइन घास के मिै ानों स े लेकर घने िगं लों तक के जवजवध आवासों म ें वनस्ट्पजतर्ों की एक समृद्ध जवजवधता ह ै जिसम ें बेतुला र्ूरटजलस, जपनस व़ॉजलजचर्ाना, आटेजमजसर्ा ब्रेजवफोजलर्ा, हरे ाजक्लर्म कैंजडकन्द्स, थाइमस लीजनर्ररस, बगाजनर्ा स्ट्रेची, जबस्ट्टोटाा एदफजनस, रोडोडड्रें ोन एंथोपोगोन, सेड्रस िेविारा, िुजनपरस कमर्ुजनस, जस्ट्कजमर्ा ल़ॉररर्ोला, एकोजनटम हटे रोदफलम, िेंरटर्ाना कुरू, ज्र्ूररजनर्ा मैक्रोसेफला, एफेड्रा िेरार्डार्ाना, आदि; सजममजलत ह।ैं और जलप्पा-असरंग वन्द्र्िीव अभर्ारण्र् के क्षत्रे , जवस्ट्तार और सीमा को, िो इस अजधसूचना म ें नीच े दिए गए पैरा 1 म ें पाररजस्ट्थजतक, पर्ाावरणीर् और िैव जवजवधता के िजृिकोण से पाररजस्ट्थजतक संवेिी िोन के रूप म ेंजवजनर्िाि ह,ै संरजक्षत और सुरजक्षत रखना आवश्र्क ह ै और उि पाररजस्ट्थजतक-संवेिी िोन म ें उद्योगों र्ा उद्योगों के वगा और उनके संचालन और प्रदक्रर्ाओं को प्रजतजसद्ध करना आवश्र्क ह;ै अतः अब, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित पर्ाावरण (सरं क्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) तथा उपधारा (2) के खण्ड (v) और (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत ेहुए, केन्द्रीर् सरकार, जलप्पा-असरंग वन्द्र्िीव अभर्ारण्र् की सीमा के आसपास एक पाररजस्ट्थजतकी संवेिी िोन (जिसे इसके बाि पाररजस्ट्थजतकी संवेिी िोन कहा िाएगा) के रूप म ें अजधसूजचत करती ह,ै जिसका ब्र्ौरा जनम्नानुसार ह,ै अथाात:् - (1) पाररजस्ट्थजतकी- सवं िे ी िोन का जवस्ट्तार और सीमा.- (1 ) पाररजस्ट्थजतकी संवेिी िोन जलप्पा-असरंग वन्द्र्िीव अभर्ारण्र् की सीमा के चारों ओर 1 दकलोमीटर स े 20.527 दकलोमीटर तक फैला हुआ ह,ै जिसम ें298.469 वग ादकलोमीटर का पाररजस्ट्थजतकी सवं ेिी िोन सजममजलत ह।ै इसम ें स े 125.68 वगा दकलोमीटर भूजम बंिर भूजम ह,ै 156.08 वगा दकलोमीटर बफा स े ढका ह,ै 14.74 वग ा दकलोमीटर घास का मैिान ह ैऔर 1.969 वग ा दकलोमीटर म ेंनदिर्ा ं ह।ैं (2) पाररजस्ट्थजतकी संवेिी िोन का सीमा जववरण अनलु ग्नक I के रूप म ें सलं ग्न ह।ै (3) पाररजस्ट्थजतकी संवेिी िोन के जवजभन्न मानजचत्र अनलु ग्नक II क, अनलु ग्नक II ख और अनलु ग्नक II ग और अनलु ग्नक II घ के रूप म ेंसंलग्न ह ैं[भाग II—खण्‍ड 3(ii)] भारत का रािपत्र : असाधारण 3 (4) जलप्पा असरंग वन्द्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी-संवेिी िोन की सीमा पर भ-ू जनिेिांक अनलु ग्नक- III के रूप म ें सलं ग्न ह।ैं (5) पाररजस्ट्थजतकी-संवेिी िोन के भीतर कोई गांव नहीं ह।ै 2. पाररजस्ट्थजतकी सवं िे ी िोन- के जलए आचं जलक महार्ोिना – (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए इस अजधसूचना म ेंदिए गए उपबंधों के अनुसरण में रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो वष ा के भीतर, स्ट्थानीर् व्यजिर्ों के परामि ा से और भीतर राज्र् सरकार म ें सक्षम प्राजधकारी के अनुमोिन के जलए एक आंचजलक महार्ोिना तैर्ार और अजधसूजचत करेगी। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना को इस अजधसूचना में जवजनर्िाष्‍ट तत्समर् प्रवृत जवजध के जलए सुसंगत जवजधर्ों तथा केन्द्रीर् सरकार द्वारा िारी मागिा िाक जसद्धांतों के अनुरूप र्दि कोई हों, तैर्ार दकर्ा िार्ेगा। (3) आंचजलक महार्ोिना को उि र्ोिना म ेंपाररजस्ट्थजतकी तथा पर्ाावरण जवचारों को समाजहत करन ेके जलए, राज्र् सरकार जनम्नजलजखत जवभागों के परामिा स े तैर्ार दकर्ा िाएगा, अथाता :् i. वन; ii. रािस्ट्व; iii. कृजष और बागवानी; iv. पंचार्ती राि और ग्रामीण जवकास; v. ससंचाई और बाढ़ जनर्ंत्रण; vi. पर्ाटन; vii. नगर पाजलका और िहरी जवकास; viii. लोक जनमााण जवभाग और रािमागा; ix. जहमाचल प्रिेि राज्र् प्रिषू ण जनर्ंत्रण बोडा; x. पर्ाावरण (4) िब तक इस अजधसूचना म ें ऐसा जवजनर्िाि न हो, आंचजलक महार्ोिना म ें तब तक जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबधं न अजधरोजपत नहीं दकर्ा िाएगा तथा आचंजलक महार्ोिना की सभी अवसंरचनाओं और उसके दक्रर्ाकलापों म ें सुधार करके उन्द्ह ेअजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनान े की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना, म ें वनरजहत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल- संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐसे अन्द्र् पहलओंु का उपबंध दकर्ा िाएगा, जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह ै। (6) आंचजलक महार्ोिना म ेंसभी जवद्यमान पूिा स्ट्‍थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों की श्रजे णर्ों और दकस्ट्‍मों, कृजष क्षेत्रों, उपिाऊ भूजम, उद्यानों और उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा, सहार्क मानजचत्रों के साथ जिनम ें जवद्यमान तथा प्रस्ट्ताजवत भू-उपर्ोग जविेषताओं के ब्र्ौरों का जनधाारण दकर्ा िाएगा। (7) इस आंचजलक महार्ोिना म ेंपाररजस्ट्थजतकी-संवेिी िोन के जवकास का जवजनर्जमत दकर्ा िार्ेगा और परै ा 4 की ताजलका म ें दिर् े गर् े प्रजतजसद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन दकर्ा िाएगा और स्ट्‍थानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजश्चत दकर्ा िाएगा और उसे बढावा दिर्ा िार्ेगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) इस तरह अनुमोदित आंचजलक महार्ोिना म़ॉनीटरी सजमजत के जलए एक संिभा िस्ट्तावेि होगी तादक वह इस अजधसूचना के उपबंधों के अनुसार अपन े कताव्यों का जनवाहन कर सके। (10) आंचजलक महार्ोिना की तैर्ारी लंजबत रहने के िौरान और अनुमोिन तक, नई जवकासात्मक दक्रर्ाकलापों को पैरा 6 के उप-परै ा (1) और (2) म ेंजवजनर्िाि उपबंधों द्वारा जनर्ंजत्रत दकर्ा िाएंगा। 3. राज्र् सरकार द्वारा दकए िान ेवाल ेउपार्. - राज्र् सरकार अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात:् -4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (1) भ-ू उपर्ोग. – (क) पाररजस्ट्थजतकी-संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के जलए जचजननत उद्यानों और खुल े स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा संपररवतना की अनुमजत नहीं होगी: परंतु पाररजस्ट्थजतकी-संवेिी िोन के भीतर कृजष और अन्द्र् भूजम, उपर्िुा भाग (क) में जवजनर्ििा प्रर्ोिनों के अजतररि अन्द्र् प्रर्ोिनों के जलए, म़ॉनीटरी सजमजत की जसफाररि पर तथा राज्र् सरकार र्ा केंर सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन क्षेत्रीर् िहर जनर्ोिन अजधजनर्म के तहत सक्षम प्राजधकारी के पूवा अनुमोिन से, इस अजधसूचना के उपबंधों के तहत तेह र्था प्रर्ोज्र् स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं और दक्रर्ाकलापों को पूरा करने के जलए अनुमजत िी िा सकेगी, िैसे,- (i) जवद्यमान स़िकों को चौ़िा करना, उन्द्ह ेंसुिढ़ृ करना और नई स़िकों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का सजन्नमााण और नवीनीकरण; (iii) प्रिषू ण उत्पन्न न करने वाल ेलघु उद्योग; (iv) कुटीर उद्योग एव ं ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं तथा गृह वास; और (v) पैराग्राफ-4 के मि में र्था उजल्लजखत बढ़ावा दिए गए दक्रर्ाकलापः परंत ु र्ह भी दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म तथा राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना एव ं संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगात अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनपु ालन दकए जबना वाजणजज्र्क तथा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के प्रर्ोग की अनुमजत नहीं होगी: परंतु र्ह भी दक पाररजस्ट्थजतकी-संवेिी िोन के अधीन आने वाली भूजम के अजभलेखों म ेंहुई दकसी त्रुरट को, म़ॉनीटरी सजमजत के जवचार प्राि करने के पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार सुधारा िाएगा और उि त्रुरट को सुधारने की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह भी दक उपर्िुा त्रुरट को सुधारन े म,ें इस उप-परै ा म ें र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भ-ू उपर्ोग का पररवतान िाजमल नहीं होगा: परंत ु र्ह भी दक हररत क्षेत्र, िसै े वन क्षेत्र तथा कृजष क्षेत्र में कोई पररणामी कमी नहीं आएगी। अनुप्रर्िु र्ा अनुत्‍पािक कृजष क्षेत्रों म ें वनीकरण तथा पर्ाावासों की बहाली के कार्ाकलापों स े पुन: वनीकरण दकए िान े के प्रर्ास दकए िाएंगे। (2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक झरनों के िलग्रहण क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना म ें उनके संरक्षण और बहाली की र्ोिना सजम‍मजलत की िाएगी और राज्र् सरकार द्वारा मागाििाक जसद्धांत इस रीजत स े तैर्ार दकए िाएंगे दक उसम ें ऐसे क्षेत्रों म ें र्ा उसके पास जवकास दक्रर्ाकलापों को प्रजतजषद्ध और जनबंजधत दकर्ा गर्ा हो िो इन क्षेत्रों के जलए हाजनकारक ह।ैं (3) पर्टा न एव ं पाररजस्ट्थजतकी पर्टा न. – (क) पाररजस्ट्थजतकी-संवेिी िोन म ें सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी-संवेिी िोन संबंधी पर्ाटन महार्ोिना के अनुसार अनुमत होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् सरकार के पर्ाावरण और वन जवभाग के परामि ा स े राज्र् पर्ाटन जवभाग द्वारा बनार्ी िाएगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना एक घटक के रूप म ें होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी-संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनम‍नानुसार जवजनर्जमत दकए िाएंग,े अथाात:् - (i) सरं जक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी-संवेिी िोन की सीमा तक, इनम ें स े िो भी अजधक जनकट हो: दकसी होटल र्ा ररि़ॉटा का नर्ा सजन्नमााण अनुमत नहीं दकर्ा िाएगा, परंत ुर्ह, पाररजस्ट्थजतकी पर्टा न सुजवधाओं के जलए संरजक्षत क्षत्रे की सीमा स ेएक दकलोमीटर की िरू ी स ेपरे पाररजस्ट्थजतकी- संवेिी िोन की सीमा तक पूवा पररभाजषत और अजभजहत क्षेत्रों म ें पर्ाटन महार्ोिना के अनुसार, नए होटलों और ररि़ॉटा की स्ट्थापना अनुमत होगी;[भाग II—खण्‍ड 3(ii)] भारत का रािपत्र : असाधारण 5 (ii) पाररजस्ट्थजतकी-संवेिी िोन के अन्द्िर सभी नए पर्ाटन दक्रर्ा-कलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार द्वारा िारी मागाििाक जसद्धांतों तथा पाररजस्ट्थजतकी पर्टा न, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेने वाल ेराष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी मागिा िाक जसद्धांतों (समर्-समर् पर र्था संिोजधत) के अनुसार होगा; (iii) िब तक आंचजलक महार्ोिना को अनुमोिन नहीं जमल िाता, तब तक पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को स्ट्थल-जवजिि संवीक्षा और म़ॉनीटरी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमत दकर्ा िाएगा और पाररजस्ट्थजतकी सवं ेिी िोन म ें दकसी नर् े होटल/ररिाटा र्ा वाजणजज्र्क प्रजतष्ठान के संजनमााण की अनुमजत नहीं िी िाएगी। (4) प्राकृजतक जवरासत. – पाररजस्ट्थजतकी-संवेिी िोन के अंतगात आने वाले बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पलू ररिव ा क्षत्रे , िलै संरचना, िल प्रपात, झरने, िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आचं जलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ‍ ल.- पाररजस्ट्थजतकी-संवेिी िोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (6) ध्व‍ जन प्रिषू ण.- पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रिषू ण की रोकथाम और जनर्ंत्रण ध्वजन प्रिषू ण (जवजनर्मन और जनर्ंत्रण) जनर्म 2000 और इसके संिोधनों के उपबंधों के अनुसरण म ें दकर्ा िाएंगा । (7) वार् ुप्रिषू ण. - पाररजस्ट्थजतकी संवेिी िोन म ेंवार् ुप्रिषू ण का जनवारण और जनर्ंत्रण वार् ु(प्रिषू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और पर्ाावरण (संरक्षण ) अजधजनर्म 1986 और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा। (8) बजहस्राव का जनस्ट्सरण. - पाररजस्ट्थजतकी संवेिी िोन म ेंउपचाररत बजहस्राव का जनस्ट्सारण; - िल (प्रिषू ण जनवारण तथा जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) और पर्ाावरण (सरं क्षण) अजधजनर्म 1986 और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा। (9) िोस अपजिि. - िोस अपजििों का जनपटान और प्रबंधन जनम्नजलजखत रूप म ेंहोगा-- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिि का जनपटान और प्रबन्द्धन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना संखर्ा का.आ. 1357 (अ), तारीख 8 अप्रलै , 2016 के अधीन प्रकाजित िोस अपजिष्‍ट प्रबंधन जनर्म, 2016, समर् -समर् पर र्था संिोजधत उपबधं ों के अनुसार दकर्ा िाएगा; अकाबाजनक सामग्री का जनपटान पर्ाावरणीर् रीजत म ें पाररजस्ट्थजतकी संवेिी िोन स े बाहर अजभज्ञात स्ट्थल पर दकर्ा िाएगा । (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करत े हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िोस अपजिि का सुरजक्षत और पर्ाावरण अनुकूल प्रबधं न अनुज्ञात दकर्ा िार्ेगा। (10) िवै जचदकत्सा अपजिि. - िैव जचदकत्सा अपजिि का प्रबधं न जनम्नजलजखत रूप म ें होगा- (क) पाररजस्ट्थजतकी संवेिी िोन म ेंिैव जचदकत्सा अपजिि का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् की अजधसूचना संखर्ा सा.का.जन. 343 (अ), तारीख 28 माच,ा 2016 के अधीन प्रकाजित िैव जचदकत्सा अपजिि प्रबंधन जनर्म, 2016, समर् -समर् पर र्था संिोजधत उपबधं ों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन म ें अजभज्ञात प्रौद्योजगदकर्ों का प्रर्ोग करत े हुए जवद्यमान जनर्मों और जवजनर्मों के अनरूु प िैव जचदकत्सा अपजिि का सुरजक्षत और पर्ाावरण अनुकूल प्रबधं न अनुमत दकर्ा िार्ेगा। (11) प्लाजस्ट्टक अपजिि का प्रबधं न.– पाररजस्ट्थजतकी संवेिी िोन म ेंप्लाजस्ट्टक अपजिि का प्रबधं न भारत सरकार के पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् की समर् -समर् पर र्था संिोजधत अजधसूचना संखर्ा सा.का.जन. 340 (अ), तारीख 18 माच,ा 2016, के अधीन प्रकाजित प्लाजस्ट्टक अपजिि प्रबंधन जनर्म, 2016 के उपबंधो के अनुसार दकर्ा िाएगा। ( 12) सजन्नमाणा और जवध्वसं अपजिि का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन म ें सजन्नमााण और जवध्वंस अपजिि का प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतना मंत्रालर् की समर्-समर् पर र्था संसोजधत अजधसूचना संखर्ा सा.का.जन. 317 (अ), तारीख 29 माच,ा 2016 के अधीन प्रकाजित सजन्नमााण और जवध्वंस अपजिि प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (13) ई–अपजिि.- पाररजस्ट्थजतकी संवेिी िोन म ें ई–अपजिि का प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित और समर् -समर् पर र्था संिोजधत ई–अपजिि प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) वाहनों का आवागमन.- वाहनों के आवागमन स ेउत्पन्न समस्ट्र्ा को पर्ाावास-अनुकूल तरीके स ेजवजनर्जमत दकर्ा िाएगा और इस संबंध म ें आंचजलक महार्ोिना म ें जविेष उपबंध सजममजलत दकए िाएगं े और आंचजलक महार्ोिना के तैर्ार होन े और राज्र् सरकार के सक्षम प्राजधकारी स ेअनुमोदित होने तक, म़ॉनीटरी सजमजत सुसंगत अजधजनर्मों और उनके अधीन बनाए गए जनर्मों एव ंजवजनर्मों के अनुसार वाहन िजनत के अनुपालन की म़ॉनीटरी करेगी। (15) वाहन िजनत प्रिषू ण. - वाहन िजनत प्रिषू ण की रोकथाम और जनर्ंत्रण लाग ू जवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे । (16) औद्योजगक ईकाइर्ा.ं - (क) रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पश्चात् पाररजस्ट्थजतकी-संवेिी िोन के भीतर कोई नए प्रिषू णकारी उद्योगों की स्ट्थापना की अनुमजत नहीं िी िाएगी। (ख) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016, समर्-समर् पर र्था संिोजधत, द्वारा िारी मागाििाक जसद्धान्द्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें इस प्रकार जवजनर्िाि न हो, पाररजस्ट्थजतकी-संवेिी िोन के भीतर केवल गैर-प्रिषू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रिषू णकारी उद्योगों को बढ़ावा दिर्ा िाएगा। (17) पहा़िी ढलानों का सरं क्षण. - पहा़िी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना म ें पहा़िी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी प्रकार के जनमााण कार् ा की अनुज्ञा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान ख़िी पहा़िी ढलानों म ेंअत्र्जधक भू-क्षरण होता ह ैउनम ें दकसी भी प्रकार के जनमााण कार् ा की अनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी-सवं िे ी िोन म ेंप्रजतजषद्ध र्ा जवजनर्जमत दकए िान ेवाल ेदक्रर्ाकलापों की सचू ी- पाररजस्ट्थजतकी-संवेिी िोन म ेंसभी दक्रर्ाकलाप पर्ाावरण अजधजनर्म के उपबंधों और पर्ावा रणीर् समाघात जनधाारण अजधसूचना, 2006 (र्ा नवीनतम अजधसूचना) और वन (संरक्षण) अजधजनर्म सजहत अन्द्र् लाग ू जवजधर्ों सजहत उसके अधीन बनाए गए जनर्मों द्वारा िाजसत होंगी और 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्द्र्िीव (संरक्षण) अजधजनर्म 1972 (53 का) 1972), और उसमें दकए गए संिोधन और नीच े िी गई ताजलका म ें जवजनर्िाि रीजत स े जवजनर्जमत दकए िाएंग,े अथाात:् सारणी क्रम स.ं दक्रर्ाकलाप रटप्पणी क . प्र जतजषद्ध दक्रर्ाकलाप 1 वाजणजज्र्क खनन, पत्थर उत्खनन क. पाररजस्ट्थजतकी संवेिी िोन के भीतर घरों के जनमााण और अपघषाण इकाइर्ा ाँ । स ेप्रजतबंध लगार्ा गर्ा ह;ै ख. खनन प्रचालन कार्,ा टी.एन. गोिावमान जथरुमलु पाि बनाम र्ूओआई के मामल े में डब्ल्र्.ूपी.(सी) संखर्ा 202/1995 म,ें दिनांक 21 अप्रैल, 2014 के आिेि के अनुसार, िो गोवा फाउंडेिन बनाम र्ओू आई के मामले म ेंडब्ल्र्.ू पी.(सी) संखर्ा 435/2012 म,ें तथा दिनांक 28 अप्रैल, 2023 के आिेि के अनुसार टी.एन. गोिावमान जथरुमलु पाि बनाम र्ूओआई के मामले म ें और डब्ल्र्.ूपी.(सी) संखर्ा 202/1995 म ें[भाग II—खण्‍ड 3(ii)] भारत का रािपत्र : असाधारण 7 दिए गए थ,े माननीर् उच्चतम न्द्र्ार्ालर् के तारीख 4 अगस्ट्त, 2006 के आिेि के अनुसार दकए िाएगं े। 2 प्रिषू ण (िल, वार्,ु मृिा, ध्वजन, पाररजस्ट्थजतकी-संवेिी िोन म ें नर् े उद्योगों और वतामान आदि) पैिा करने वाल े उद्योगों की प्रिषू णकारी उद्योगों का जवस्ट्तार करन ेकी अनुमजत नहीं होगी। स्ट्थापना। मौिूिा उद्योगों द्वारा प्रिषू ण जनवारण प्रौद्योजगकों तथा िोर अवरोधों की स्ट्थापना की िाएगी। 3 ब़िी िल जवद्युत पररर्ोिनाओं की प्रजतजषद्ध । स्ट्थापना। 4 दकसी पररसंकटमर् पिाथ ा प्रजतजषद्ध /खतरनाक कचरा का प्रर्ोग र्ा उत्पािन र्ा प्रस्ट्संकरण । से एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी-संवेिी िोन की सीमा तक, इनम ें िो भी अजधक जनकट हो, पर्ाटन महार्ोिना और लाग ू दििाजनििे ों के अनुसार सभी नए पर्ाटन दक्रर्ाकलाप करन े र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार करने की अनुज्ञा होगी । 12 सजन्नमााण दक्रर्ाकलाप । (क) संरजक्षत क्षत्रे की सीमा स ेएक दकलोमीटर के िार्रे म ेंर्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकटतम हो, दकसी भी प्रकार के नए वाजणजज्र्क जनमााण की अनुमजत नहीं िी िाएगी: परंत,ु स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने के जलए भवन उप-जनर्मों के अनुसार परै ाग्राफ 3 के उप-पैरा (1) म ेंसूचीबद्ध दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम पर जनमााण कार् ाकरने की अनुमजत स्ट्थानीर् लोगों को िी िा सकेगी:8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंतु र्ह और दक प्रिषू ण न फैलाने वाले लघु उद्योगों स े संबंजधत जनमााण संबंधी दक्रर्ाकलापों को प्रर्ोज्‍र् जनर्मों और जवजनर्मों, र्दि कोई हो, के अनसु ार तथा सक्षम प्राजधकारी स े पूवा अनुमजत लेकर जवजनर्जमत दकर्ा िाएगा और न्द्र्ूनतम ही रखा िाएगा। (ख) एक दकलोमीटर के िार्रे स े आग े इस े आंचजलक महार्ोिना के अनुसार जवजनर्जमत दकर्ा िाएगा। 13 लघु पैमाने के प्रिषू ण न फैलाने फरवरी, 2016 म ें केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा द्वारा िारी वाले उद्योग। उद्योगों के वगीकरण, समर्-समर् पर र्था संिोजधत के अनुसार प्रिषू ण न फैलान े वाले उद्योग, तथा पाररजस्ट्थजतकी संवेिी िोन स े स्ट्विेिी सामजग्रर्ों स े उत्पाि बनाने वाल े िोजखम रजहत, लघ ु एव ं सेवा उद्योग, कृजष, पुष्प-कृजष, बागवानी र्ा कृजष-आधाररत उद्योगों को अनुमजत िी िाएगी। 14 वृक्षों की कटाई। (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन, सरकारी, रािस्ट्व र्ा जनिी भूजम पर स े वृक्षों की कटाई की अनुज्ञा नहीं होगी। (ख) वृक्षों की कटाई को संबंजधत केन्द्रीर् र्ा राज्र् अजधजनर्म तथा उसके अंतगात बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत दकर्ा िाएगा। 15 वन उत्‍पाि र्ा काष्ठते र वन उत्‍पाि लाग ू जवजधर्ों के अधीन जवजनर्जमत। का संग्रहण। 16 जवद्युत एव ं संचार टावरों का लागू जवजधर्ों के अधीन जवजनर्जमत भूजमगत केबसलगं को जनमााण तथा केबल जबछाना एव ं बढ़ावा दिर्ा िा सकता द्वारा अनुमजत दिए िान े तक, ख़िी संरक्षण। पहाज़िर्ों पर तथा दकसी निी र्ा प्राकृजतक नाले के दकनारों स े 100 मीटर की िरू ी तक कोई भी जनमाणा कार् ा नहीं दकर्ा िाएगा। 21 रात के समर् वाहनों का लाग ू जवजधर्ों के अधीन जवजनर्जमत। आवागमन। 22 स्ट्थानीर् समुिार्ों द्वारा डेर्री, स्ट्थानीर् लोगों के उपर्ोग के उद्देश्‍र् स ेलागू जवजधर्ों के अधीन डेर्री फार्मंग, िलीर् कृजष और अनुमजत िी गई ह।ै मत्स्ट्र् DRAFT NOTIFICATION WHEREAS the Lippa-Asrang Wildlife Sanctuary falls within the Moorang Tehsil of Pooh sub- division of Kinnaur district, Himachal Pradesh state. It is situated between geo-coordinates North (31° 44' 21" N and 77° 15' 00" E), East (31° 40' 32" N and 78° 18' 07" E), South (31° 39' 29" N and 78° 17' 24" E) and West (31° 41' 27" N and 78° 13' 09" E). It is a high-altitude area situated in the upper catchment of Taiti stream, which is an important tributary of the Sutlej River. The altitude ranges from 3000 m to 5122 m. The sanctuary beholds a unique landscape of dry Trans-Himalayan region with most of the sanctuary area being largely flat and in part barren cold desert; AND WHEREAS the Lippa-Asrang was first notified as a sanctuary in 1974 vide Himachal Pradesh State Government notification number 5-11/70-SP, dated 27-04-1974. Thereafter, the sanctuary was finally notified after its rationalization under section 26A of the Wildlife Protection Act (1972) on 7th June, 2013, vide notification number FEE-B-F(6)-11/2005-II/Lippa Asrang. The area of the Wildlife Sanctuary is 31 square kilometers; AND WHEREAS the sanctuary and most of the areas are isolated both physio-graphically and climatically consisting of forest type like Alpine Scrubs and Alpine pastures. The Sanctuary harbour many threatened species of flora and fauna. The prominent species including RET species found in the sanctuary includes, Himalayan Tahr (Hemitragus jemlahicus), Himalayan Brown Bear (Ursus arctos isabellinus), Himalayan Black Bear (Ursus thibetanus laniger), Musk Deer (Moschus leucogaster), Ibex (Capra ibex), Blue Sheep (Pseudois nayaur), Goral (Naemorhedus goral), etc. The Sanctuary is home to the magnificent Snow Leopard (Panthera uncia) which is the State Animal of Himachal Pradesh and a flagship species for conservation of Trans-Himalayan region; AND WHEREAS the sanctuary is an important bird area renowned for its diverse birdlife, attracting birdwatchers and ornithologists. The sanctuary serves as a wintering ground for several migratory birds. The avifauna and other insects species found in the sanctuary includes Golden Eagle (Aquila chrysaetos), Himalayan Griffon Vulture (Gyps himalayensis), Snow Partridge (Lerwa lerwa), Himalayan Monal (Lophophorus impejanus), Alpine Accentor (Prunella collaris), Lammergeier (Gypaetus barbatus), Himalayan Snowcock (Tetraogallus himalayensis), Egyptian vulture (Neophron percnopterus), Ram chakor (Alectoris chukar), White capped redstart (Phoenicurus leucocephalus), Himalayan Buzzard (Buteo refectus), Common Banded Awl (Hasora chromus), Indian Fritillary (Argynnis hyperbius), Painted Lady (Vanessa cardui), Indian Skipper (Hesperia comma) etc.; AND WHEREAS the sanctuary supports a wide variety of plant species, including many rare and endemic ones. The varied habitats, from alpine meadows to dense forests, harbor a rich assortment of vegetation which includes Betula utilis, Pinus wallichiana, Artemisia brevifolia, Heracleum candicans, Thymus linearis, Bergenia stracheyi, Bistorta affinis, Rhododendron anthopogon, Cedrus deodara, Juniperus communis, Skimmia laureola, Aconitum heterophyllum, Gentiana kurroo, Jurinea macrocephalla, Ephedra gerardiana, etc.; AND WHEREAS it is necessary to conserve and protect the area, extent and boundary of Lippa- Asrang Wildlife Sanctuary which is specified in paragraph 1 given below in this notification as Eco-sensitive[भाग II—खण्‍ड 3(ii)] भारत का रािपत्र : असाधारण 19 Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-Sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an Eco-Sensitive Zone around the boundary of Lippa-Asrang Wildlife Sanctuary (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of Eco-Sensitive Zone.- (1) The Eco-sensitive Zone is extends from 1 kilometer to 20.527 kilometer around the boundary of Lippa-Asrang Wildlife Sanctuary encompassing Eco-sensitive Zone area of 298.469 square kilometer. Out of this 125.68 square kilometer land is waste land, 156.08 square kilometer is snow covered, 14.74 square kilometer is grassland and streams accounts for 1.969 square kilometer. (2) The boundary description of the Eco Sensitive Zone is appended as Annexure I. (3) The various maps of the Eco-sensitive Zone is appended as Annexure II A, Annexure II B and Annexure II C and Annexure II D (4) Geo Coordinates on the boundary of Lippa Asrang Wildlife Sanctuary and its Eco-sensitive zone are appended as Annexure –III. (5) There are no village within the Eco-sensitive Zone. 2. Zonal Master Plan for Eco-Sensitive Zone- (1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- i. Forest; ii. Revenue; iii. Agriculture and Horticulture; iv. Panchayati Raj and Rural Development; v. Irrigation and Flood Control; vi. Tourism; vii. Municipality and Urban Development; viii. Public Works Department and Highways; ix. Himachal Pradesh State Pollution Control Board; x. Environment; (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. (10) Pending preparation and approval of the Zonal Master Plan, any new developmental activities shall be governed by provisions specified at sub-para (1) and (2) of paragraph 6. 3. Measures to be taken by the State Government. - The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- 1. Land use.– (a) Forests, horticulture areas, agricultural areas, orchards, parks, lakes and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities; Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or the State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as- i. widening and strengthening of existing roads and construction of new roads; ii. construction and renovation of infrastructure and civic amenities; iii. small scale industries not causing pollution; iv. cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and v. promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:[भाग II—खण्‍ड 3(ii)] भारत का रािपत्र : असाधारण 21 Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. 2. Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. 3. Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco- sensitive Zone; b. the Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests; c. the Tourism Master Plan shall form a component of the Zonal Master Plan; d. the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco- sensitive Zone; e. the activities of eco-tourism shall be regulated as under, namely:- i. new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer; Provided that beyond the distance of one kilometer from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; ii. all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; iii. until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. 4. Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. 5. Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. 6. Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 and its amendments. 7. Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and Environment (Protection) Act, 1986 and the rules made there under these Acts. 8. Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and Environment (Protection) Act, 1986 and the rules made there under these Acts. 9. Solid wastes.- Disposal and Management of solid wastes shall be as under:- a. the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 and as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) Safe and Environmentally Sound Management (ESM) of solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-Sensitive zone. 10. Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:- a. the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016; b. safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco- sensitive Zone. 11. Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. 12. Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. 13. E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. 14. Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. 15. Vehicular pollution.- Prevention and control of vehicular pollution shall be in compliance with applicable laws and efforts shall be made for use of cleaner fuels. 16. Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone; (b) only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. 17. Protection of hill slopes.- The protection of hill slopes shall be as under:- a. the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; b. construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone- All activities in the Eco-Sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Environmental Impact Assessment Notification, 2006 (or the latest notification) and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980),[भाग II—खण्‍ड 3(ii)] भारत का रािपत्र : असाधारण 23 the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. Construction activities. a. New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye- laws to meet the residential needs of the local residents: Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. b. Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 13. Small scale non-polluting Non-polluting industries as per classification of industries issued industries. by the Central Pollution Control Board in February, 2016, as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro- based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted. 14. Monitoring Committee - The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely:26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (i) CCF (Territorial) Rampur Forest Circle Chairman, ex- officio; A representative of Non-governmental Organization working in the field of wildlife Member; including heritage conservation to be nominated by the State Government after every (ii) three years (iii) An expert in the area of ecology and environment or forestry from reputed Institution Member; or University to be nominated by the State Government after every three years (iv) Sub Divisional Magistrate having jurisdiction of the area Member, ex- officio; (v) DCF (Territorial) Kinnaur Forest Division Member, ex- officio; (vi) A representative from Himachal Pradesh, Pollution Control Board Member, ex- officio; (vii) A representative from Department of Tourism, Himachal Pradesh (viii) DCF Sarahan Wildlife Division Member- Secretary ex-officio. 6. Functions of the Monitoring Committee – (1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinise, the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14th September, 2006 and amended time to time, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification. (2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case to case basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in Annexure-IV, appended to this notification. (6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional Measures: The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.[भाग II—खण्‍ड 3(ii)] भारत का रािपत्र : असाधारण 27 8. Supreme Court, etc. orders. The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or any High Court or the National Green Tribunal. Annexure-I DETAILED BOUNDARY DESCRIPTION OF THE ECO SENSITIVE ZONE The Eco sensitive Zone boundary in terms of landscape features includes ridges like Thothi Dhar, Gmjhang Dhar, Tepong, Ladsa Dhar, Kiyari Dhar and Metang Dhar. Forest beats- It falls under the Lippa beat of Kinnaur Territorial Forest Division. Rivers- Gumjhang Nalla, Tepong Nalla, Ladsa Nalla, Wari Nalla and Taiti Khad. Glaciers- Metanglongpa Glacier, Gumjhang Glacier and Ladsa Glacier. Temporary Gaddi Deras- Dharwali, Dhar Ladsa, Dhar Tepong, Dhar Gumjhang, Dhar Metang and Dhar Kiyari. The boundary descitpion in different directions is as under: North: North East boundary of the Eco sensitive Zone is shared with Pin Valley National Park and North West is shared with Rupi Bhaba Wildlife Sanctuary. South: Tokto and Asarang are two villages located south of the Eco sensitive Zone falling in Moorang Range. East: East Boundaries of the Eco sensitive Zone is aligned with Moorang Range of Kinnaur Territorial Forest Division and Rupi Bhaba Wildlife Sanctuary; some part of boundary with Proposed Eco sensitive Zone of Rupi Bhaba Wildlife Sanctuary.
