(1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रभावी प्रबंधन के प्रर्ोिनों के जलए, अजधसूचना के प्रकािन की तारीख स े िो वर्ा की अवजध के भीतर एक क्षेत्रीर् मास्ट्टर प्लान तैर्ार करेगी। स्ट्थानीर् लोगों के परामिा स ेतथा इस अजधसूचना म ेंदिए गए उपबंधों का पालन करते हुए राज्र् सरकार म ें सक्षम प्राजधकारी के अनुमोिन हते ु आजधकाररक रािपत्र म ें अंजतम अजधसूचना िारी की िाएगी । (2) पाररजस्ट्थजतकी संवेिी िोन के जलए क्षेत्रीर् मास्ट्टर प्लान राज्र् सरकार द्वारा इस अजधसूचना म ें जवजनर्िाष्ट तरीके स े और प्रासंजगक केंद्रीर् और राज्र् कानूनों और केंद्रीर् सरकार द्वारा िारी दििाजनििे ों, र्दि कोई हो, के अनुरूप तैर्ार दकर्ा िाएगा। (3) उि क्षेत्रीर् मास्ट्टर प्लान को राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ा स े तर्ै ार दकर्ा िाएगा, तादक उि र्ोिना म ें पाररजस्ट्थजतकी और पर्ाावरणीर् पहलुओं को एकीकृत दकर्ा िा सके ; i. पर्ाावरण, ii. वन एव ं वन्र्िीव, iii. कृजर्, iv. आर्, v. िहरी जवकास, vi. पर्ाटन, vii. ग्रामीण जवकास,[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 viii. ससंचाई और बाढ़ जनर्ंत्रण, ix. नगरपाजलका x. पंचार्ती राि xi. लोक जनमााण जवभाग xii. रािमागा; और xiii. राज्र् प्रिर्ू ण जनर्ंत्रण बोड ा (4) क्षेत्रीर् मास्ट्टर प्लान अनुमोदित प्रारूप भूजम उपर्ोग, अवसंरचना और कार्ाकलापों पर कोई प्रजतबंध नहीं लगाएगा, िब तक दक इस अजधसूचना म ेंऐसा जनर्िाष्ट न दकर्ा गर्ा हो और क्षत्रे ीर् मास्ट्टर प्लान म ेंसभी अवसंरचनाएाँ और कार्ाकलापों को और अजधक कुिल और पर्ाावरण अनुकूल बनान े के जलए सुधार को िाजमल दकर्ा िाएगा। (5) क्षेत्रीर् मास्ट्टर प्लान म ें िल-जवहीन क्षेत्रों के पुनरुद्धार, जवद्यमान िल जनकार्ों के संरक्षण, िलग्रहण क्षेत्रों के प्रबंधन, िलग्रहण प्रबंधन, भूिल प्रबंधन, मृिा और नमी सरं क्षण, स्ट्थानीर् समुिार् की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण के ऐसे अन्र् पहलओंु , जिन पर ध्र्ान िने े की आवश्र्कता ह,ै के जलए प्रावधान दकर्ा िाएगा। (6) क्षेत्रीर् मास्ट्टर प्लान म ें सभी मौिूिा पूिा स्ट्थलों, गांवों और िहरी बजस्ट्तर्ों, वनों के प्रकार और दकस्ट्मों, कृजर् क्षेत्रों, उपिाऊ भूजम, हररत क्षत्रे , िैसे पाका और इसी तरह के स्ट्थान, बागवानी क्षत्रे , बाग-बगीच,े झीलें और अन्र् िल जनकार्ों को मौिूिा और प्रस्ट्ताजवत भूजम उपर्ोग जविेर्ताओं का ब्र्ौरा िने े वाल े मानजचत्रों के साथ जचजननत दकर्ा िाएगा। (7) क्षेत्रीर् मास्ट्टर प्लान पाररजस्ट्थजतकी संवेिी िोन म ें जवकास को जवजनर्जमत करेगा तथा इस अजधसूचना के परै ा 4 म ें ताजलका म ें सूचीबद्ध जनजर्द्ध, जवजनर्जमत और संवर्धात कार्ाकलापों का अनुपालन करेगा तथा स्ट्थानीर् समुिार्ों की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी अनुकूल जवकास सुजनजश्चत करेगा। (8) क्षेत्रीर् मास्ट्टर प्लान, क्षेत्रीर् जवकास र्ोिना के साथ समाि होगा। (9) इस प्रकार अनुमोदित क्षेत्रीर् मास्ट्टर प्लान, इस अजधसूचना के उपबंधों के अनुसार जनगरानी सजमजत के जलए उसके कार्ों के कार्ाान्वर्न हते ु संिभा िस्ट्तावेि होगा। (10) क्षेत्रीर् मास्ट्टर प्लान की तैर्ारी और अनुमोिन तक, कोई भी नई जवकासात्मक कार्ाकलाप उप-पैरा (1) और (2) के पैराग्राफ 6 म ें जवजनर्िाष्ट उपबंधों द्वारा िाजसत होंगे। 3. राज्र् सरकार द्वारा दकए िान ेवाल ेउपार्.- राज्र् सरकारें इस अजधसूचना के उपबंधों को प्रभावी करने के जलए जनम्नजलजखत उपार् करेंगी, अथाात:- (क) 1. भजू म उपर्ोग: पाररजस्ट्थजतकी संवेिी िोन म ें मनोरंिन के प्रर्ोिनों के जलए जचजन्हत वन, बागवानी क्षत्रे , कृजर् क्षत्रे तथा पाका और खलु े स्ट्थान का उपर्ोग वाजणजज्र्क, आवासीर् र्ा औद्योजगक कार्ाकलापों के जलए नहीं दकर्ा िाएगा र्ा उन्ह ेंपररवर्तात नहीं दकर्ा िाएगा। परंत ु दक पाररजस्ट्थजतकी संवेिी िोन के भीतर, ऊपर खडं (क) म ें जवजनर्िाष्ट उद्दश्े र् के अलावा दकसी अन्र् उद्देश्र् के जलए कृजर् और अन्र् भजू म के पररवतान की अनुमजत जनगरानी सजमजत की जसफाररि पर और र्थाप्रर्ोज्र् क्षेत्रीर् नगर जनर्ोिन अजधजनर्म और केंद्र सरकार र्ा राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के तहत सक्षम प्राजधकारी के पूवा अनुमोिन से और इस अजधसूचना के उपबंधों के अनुसार स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को परू ा करन े के जलए िी िा सकती ह,ै र् ेजनम्नानुसार ह:ैं - i. मौिूिा सडकों का चौडीकरण एव ं सुिढ़ृ ीकरण तथा नई सडकों का जनमााण; ii. अवसंरचना और नागररक सुजवधाओं का जनमाणा और नवीनीकरण;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] iii. प्रिर्ू ण न फैलान े वाले लघ ु उद्योग; iv. कुटीर उद्योग जिनम ें ग्रामोद्योग भी िाजमल ह;ै सुजवधािनक स्ट्टोर और होम स्ट्टे सजहत पररजस्ट्थजतकी पर्ाटन को समथना िने े वाली स्ट्थानीर् सुजवधाएं; तथा v. अनुच्छेि 4 म ेंताजलका म ेंदिए गए प्रवर्धता कार्ाकलाप; परंत ु इसके अलावा र्ह भी दक, राज्र् सरकार के पूव ा अनुमोिन के जबना तथा भारत के संजवधान के अनच्ु छेि 244 र्ा अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) सजहत वतामान म ें प्रर्ोज्र् कानून के उपबंधों के अनुपालन के जबना िनिातीर् भूजम के उपर्ोग को वाजणजज्र्क और औद्योजगक जवकास गजतजवजधर्ों के जलए अनुमजत नहीं िी िाएगी; परंत ु र्ह भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भूजम अजभलेखों म ें दिखाई िेन े वाली दकसी भी त्रुरट को संबंजधत राज्र् सरकार द्वारा प्रत्र्ेक मामले म ेंएक बार जनगरानी सजमजत के जवचार प्राि करन ेके बाि िीक दकर्ा िाएगा और उि त्रुरट के सुधार की सूचना पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर् म ेंकेंद्रीर् सरकार को िी िाएगी; परंतु दक उपरोि त्रुरट सुधार म ें इस उप-पैराग्राफ के अतं गता दिए गए उपबंध को छोडकर दकसी भी मामले म ें भूजम उपर्ोग म ें पररवतान िाजमल नहीं होगा; परंतु र्ह भी दक त्रुरट के िुद्धीकरण केवल उप-परै ा के तहत दिर्े गए मामलों के अलावा भूजम-उपर्ोग का अपवतान िाजमल नहीं दकर्ा िाएगा (ख) वनीकरण और पर्ाावास पुनबाहाली के साथ उपर्ोग न की गई र्ा अनुवार कृजर् भूजम पर पनु वाजनकरण के प्रर्ास दकए िाएंगे। (2) प्राकृजतक िल जनकार् एव ंझरन-े सभी प्राकृजतक झरनों के िलग्रहण क्षेत्रों को अजभज्ञात दकर्ा िाएगा और उनके संरक्षण और पुनरुद्धार के जलए र्ोिनाए ं क्षेत्रीर् मास्ट्टर प्लान म ें िाजमल की िाएंगी और राज्र् सरकार द्वारा दििाजनिेि इस प्रकार तैर्ार दकए िाएंगे दक इन क्षेत्रों म ें र्ा इनके जनकट ऐसी जवकास गजतजवजधर्ों पर रोक लगाई िा सके िो इन क्षेत्रों के जलए हाजनकारक ह।ैं (3) पर्टा न र्ा पाररजस्ट्थजतकी पर्टा न - (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन, पर्ाटन गजतजवजधर्ां र्ा मौिूिा पर्ाटन गजतजवजधर्ों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन के जलए पर्ाटन मास्ट्टर प्लान के अनुसार होगा। (ख) पारर-पर्ाटन मास्ट्टर प्लान राज्र् सरकार के पर्ाावरण एव ं वन जवभाग के परामिा स े पर्ाटन जवभाग द्वारा तैर्ार दकर्ा िाएगा। (ग) पर्ाटन मास्ट्टर प्लान, क्षेत्रीर् मास्ट्टर प्लान का एक घटक होगा (घ) र्ह पारर-पर्ाटन मास्ट्टर प्लान पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता अध्र्र्न पर आधाररत होगा। (ङ) पाररजस्ट्थजतकी पर्ाटन की गजतजवजध को जनम्नानुसार जवजनर्जमत दकर्ा िाएगा, अथाात्: - i. एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकटतम हो, होटलों और ररसॉर्टसा के दकसी भी नए जनमाणा की अनुमजत नहीं िी िाएगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 परंतु दक सरं जक्षत क्षत्रे की सीमा स ेएक दकलोमीटर की िरू ी स ेपरे पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, नए होटलों और ररसॉर्टसा की स्ट्थापना केवल पर्ाटन मास्ट्टर प्लान के अनुसार पाररजस्ट्थजतक पर्ाटन सजु वधाओं के जलए पूवा-जनधााररत और जनर्िष्टा क्षेत्रों म ें ही अनुमजत िी िाएगी; ii. पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नई पर्ाटन गजतजवजधर्ां र्ा मौिूिा पर्ाटन गजतजवजधर्ों का जवस्ट्तार पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा 2018 म ें िारी दकए गए पाररजस्ट्थजतक-पर्ाटन दििाजनिेिों और राष्ट्रीर् बाघ संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतक-पर्ाटन दििाजनििे ों (समर्-समर् पर संिोजधत) के अनुसार होगा, जिसम ें पाररजस्ट्थजतक-पर्ाटन, पाररजस्ट्थजतक-जिक्षा और पाररजस्ट्थजतक-जवकास पर िोर दिर्ा िाएगा; (iii) िब तक क्षेत्रीर् मास्ट्टर प्लान तैर्ार और अनुमोदित नहीं हो िाता, पर्ाटन के जलए जवकास और मौिूिा पर्ाटन गजतजवजधर्ों के जवस्ट्तार की अनुमजत संबंजधत जनर्ामक प्राजधकरणों द्वारा वास्ट्तजवक स्ट्थल-जवजिष्ट िांच और जनगरानी सजमजत की जसफाररि के आधार पर िी िाएगी। (4) प्राकृजतक जवरासत- पाररजस्ट्थजतकी संवेिी िोन म ें मूल्र्वान प्राकृजतक जवरासत के सभी स्ट्थल, िैस े िीन पलू आरजक्षत क्षत्रे , चट्टान संरचनाएं, झरने, झरन,े घारटर्ााँ, उपवन, गुफाए,ं सबंि,ु पैिल मागा, सैरगाह, चट्टान ें आदि की पहचान की िाएगी और क्षेत्रीर् मास्ट्टर प्लान के एक भाग के रूप म ेंउनके संरक्षण और संवधना के जलए एक जवरासत संरक्षण र्ोिना तैर्ार की िाएगी। (5) मानव जनर्मता जवरासत स्ट्थल - ऐजतहाजसक, स्ट्थापत्र्, सौंिर् ा और सांस्ट्कृजतक महत्व की इमारतों, सरं चनाओं, कलाकृजतर्ों, क्षेत्रों और पररसरों की पाररजस्ट्थजतकी संवेिी िोन म ें पहचान की िाएगी और क्षेत्रीर् मास्ट्टर प्लान के जहस्ट्स े के रूप म ें उनके संरक्षण की र्ोिना तैर्ार की िाएगी। (6) ध्वजन प्रिर्ू ण - पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रिर्ू ण की रोकथाम और जनर्ंत्रण का अनुपालन पर्ाावरण (संरक्षण) अजधजनर्म, 1986 के अतं गता ध्वजन प्रिर्ू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 और उसके संिोधनों के अनुसार दकर्ा िाएगा। (7) वार् ु प्रिर्ू ण - पाररजस्ट्थजतक संवेिी िोन म ें वार् ु प्रिर्ू ण की रोकथाम और जनर्ंत्रण वार् ु (प्रिर्ू ण जनवारण एव ं जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) तथा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा। (8) अपजिष्टों का जवसिना - पाररजस्ट्थजतकी संवेिी िोन म ेंउपचाररत अपजिष्टों का जनवाहन पर्ावा रण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अंतगात आन ेवाले पर्ाावरण प्रिर्ू कों के जनवाहन के जलए सामान्र् मानकों के उपबंधों र्ा राज्र् सरकार द्वारा जनधााररत मानकों के अनुसार दकर्ा िाएगा, िो भी अजधक किोर हो। (9) िोस अपजिष्ट - िोस अपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार होगा: - i. पाररजस्ट्थजतकी संवेिी िोन म ेंिोस अपजिष्ट जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् की अजधसूचना सं. का.आ. 1357 (अ), दिनांक 8 अप्रैल, 2016, समर् समर् पर र्थासंिोजधत, द्वारा िोस अपजिष्ट (प्रबंधन) जनर्म, 2016 के अनसु ार दकर्ा िाएगा। ii. स्ट्थानीर् प्राजधकरण िोस अपजिष्ट के िैव-अवरमणीर् और िवै -अनवरमणीर् घटकों म ें पृथक्करण के जलए र्ोिना तैर्ार करेंगे।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] iii. िैव-अवरमणीर् सामग्री को अजधमानतः खाि र्ा वमीकल्चर र्ा बार्ोगैस संर्ंत्रों के माध्र्म से पुनचादरत दकर्ा िाएगा। iv. अकाबाजनक सामग्री का जनपटान पाररजस्ट्थजतकी संवेिी िोन के बाहर अजभज्ञात दकए गए स्ट्थल पर पर्ाावरण की िजृ ष्ट से स्ट्वीकार्ा तरीके से दकर्ा िाएगा और पाररजस्ट्थजतकी-संवेिनिील क्षेत्र म ेंिोस अपजिष्टों को िलान े र्ा भस्ट्म करने की अनुमजत नहीं िी िाएगी। (10) िवै -जचदकत्सा अपजिष्ट - िैव-जचदकत्सा अपजिष्ट प्रबंधन जनम्नानुसार होगा: (क) पाररजस्ट्थजतकी संवेिी िोन में िवै -जचदकत्सा अपजिष्ट का जनपटान पर्ाावरण और वन मंत्रालर्, भारत सरकार की अजधसूचना सं. सा.का.जन. 343(अ) के द्वारा िैव-जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016, समर्-समर् पर र्थासंिोजधत, के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन के भीतर पहचानी गई प्रौद्योजगदकर्ों का उपर्ोग करत े हुए मौिूिा जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्टों के सुरजक्षत और पर्ाावरण की िजृष्ट से उजचत प्रबधं न दकर्ा िाएगा। (ग) (11) प्लाजस्ट्टक अपजिष्ट प्रबधं न - पाररजस्ट्थजतकी संवेिी िोन म ेंप्लाजस्ट्टक अपजिष्ट प्रबंधन, प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों और समर्-समर् पर र्थासंिोजधत उपबंधों के अनुसार दकर्ा िाएगा। (12) जनमाणा एव ं जवध्वसं अपजिष्ट प्रबधं न - पाररजस्ट्थजतकी सवं ेिी िोन म ें जनमााण एव ं जवध्वंस अपजिष्ट प्रबंधन, जनमााण एवं जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार तथा समर्-समर् पर र्थासंिोजधत उपबंधों के अनुसार दकर्ा िाएगा। (13) ई-अपजिष्ट - पाररजस्ट्थजतकी संवेिी िोन म ेंई-अपजिष्ट प्रबंधन, पर्ाावरण, वन और िलवार् ुपररवतान मंत्रालर्, भारत सरकार द्वारा प्रकाजित और समर्-समर् पर संिोजधत ई-अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) वाहन र्ातार्ात - वाहनों के आवागमन को पर्ाावास अनुकूल तरीके स े जवजनर्जमत दकर्ा िाएगा और इस संबंध म ें जवजिष्ट प्रावधान क्षेत्रीर् मास्ट्टर प्लान म ें िाजमल दकए िाएंगे और िब तक क्षेत्रीर् मास्ट्टर प्लान तैर्ार नहीं हो िाता और राज्र् सरकार म ें सक्षम प्राजधकारी द्वारा अनुमोदित नहीं हो िाता, तब तक जनगरानी सजमजत संबंजधत अजधजनर्मों और उनके अधीन बनाए गए जनर्मों और जवजनर्मों के तहत वाहनों के आवागमन के अनुपालन की जनगरानी करेगी। (15) वाहन प्रिर्ू ण - वाहन प्रिर्ू ण की रोकथाम और जनर्ंत्रण लागू कानूनों के अनुसार दकर्ा िाएगा। सीएनिी, एलपीिी आदि िैसे स्ट्वच्छ ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक इकाइर्ा ाँ – (क) इस अजधसूचना के सरकारी रािपत्र म ें प्रकािन के समर् र्ा उसके पश्चात ् पाररजस्ट्थजतकी संविे ी िोन म ें कोई भी नर्ा प्रिर्ू णकारी उद्योग स्ट्थाजपत करन े की अनुमजत नहीं िी िाएगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 (ख) फरवरी 2016 म ें केंद्रीर् प्रिर्ू ण जनर्ंत्रण बोडा द्वारा िारी दििा-जनिेिों म ें उद्योगों के वगीकरण के अनुसार पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गरै -प्रिर्ू णकारी उद्योगों को ही अनुमजत िी िाएगी, िब तक दक इस अजधसूचना म ेंऐसा जनर्िाष्ट न दकर्ा गर्ा हो। इसके अलावा, गरै -प्रिर्ू णकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा। (17) पहाडी ढलानों का सरं क्षण - पहाडी ढलानों का संरक्षण जनम्नानुसार होगा: (क) क्षेत्रीर् मास्ट्टर प्लान म ेंपहाडी ढलानों पर जस्ट्थत उन क्षेत्रों को ििाार्ा िाएगा िहां जनमााण की अनुमजत नहीं होगी। (ख) मौिूिा खडी पहाडी ढलानों र्ा अत्र्जधक कटाव वाली ढलानों पर जनमााण की अनुमजत नहीं िी िाएगी। 4. पाररजस्ट्थजतकी सवं िे ी िोन के भीतर जनजर्द्ध र्ा जवजनर्जमत की िान े वाली गजतजवजधर्ों की सचू ी.- पाररजस्ट्थजतकी संवेिी िोन म ें सभी कार्ाकलाप पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के उपबधं ों द्वारा िाजसत होंगे, जिनम ें तटीर् जवजनर्मन क्षत्रे , 2011 और पर्ाावरण प्रभाव आकलन अजधसूचना, 2006 और अन्र् लाग ू कानून िाजमल ह,ैं जिनम ें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) और उनम ेंदकए गए संिोधन िाजमल ह ैंऔर उन्ह ेंनीचे िी गई ताजलका म ेंजनर्िाष्ट तरीके स े जवजनर्जमत दकर्ा िाएगा, अथाात्:- ताजलका र. स.ं कार्का लाप जववरण (2) (3) (1) क. जनजर्द्ध गजतजवजधर्ा ाँ 1. वाजणजज्र्क खनन, पत्थर उत्खनन और (क) सभी नए और मौिूिा खनन (लघु और प्रमुख खजनि), पेराई इकाइर्ााँ। पत्थर उत्खनन और रसिंग इकाइर्ों पर तत्काल प्रभाव स े प्रजतबंध लगा दिर्ा गर्ा ह।ै इसम ें पाररजस्ट्थजतकी संवेिी िोन के भीतर घरों के जनमााण र्ा मर्मत के जलए जमट्टी खोिने सजहत स्ट्थानीर् जनवाजसर्ों की घरेल ू िरूरतों को पूरा करन े को छोड दिर्ा गर्ा ह;ै (ख) खनन कार् ाटीएन गोिावमान जथरुमलु पाि बनाम भारतीर् संघ के मामले म ेंररट र्ाजचका (सी) संख्र्ा 202/1995 और गोवा फाउंडेिन बनाम र्ओू आई के मामल े म ें ररट र्ाजचका (सी) संख्र्ा 435/2012 और आईए संख्र्ा 1000/2003 के जनणार् तारीख 3 िून, 2022 और उसके बाि आईए संख्र्ा 131377/2022 के जनणार् तारीख 26 अप्रलै , 2023 और 28 अप्रलै , 2023 के मामले म ेंमाननीर् सवोच्च न्र्ार्ालर् के आिेि (आिेिों) के अनुसार दकर्ा िाएगा। पाररजस्ट्थजतकी संवेिी िोन में नए उद्योगों और मौिूिा 2. प्रिर्ू ण उत्पन्न करने वाल े उद्योगों की प्रिर्ू णकारी उद्योगों के जवस्ट्तार की अनुमजत नहीं िी िाएगी: स्ट्थापना (िल, वार्ु, मृिा, ध्वजन, आदि)।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] परंत ु दक गरै -प्रिर्ू णकारी उद्योगों को केन्द्रीर् प्रिर्ू ण जनर्ंत्रण बोड ा द्वारा फरवरी, 2016 म ें िारी दििाजनिेिों में उद्योगों के वगीकरण के अनुसार पाररजस्ट्थजतकी संवेिी िोन के भीतर अनुमजत िी िाएगी, िैसा दक समर्-समर् पर र्था संिोजधत दकर्ा िाता ह,ै िब तक दक इस अजधसूचना म ें ऐसा जनर्िाष्ट न दकर्ा िाए और इसके अजतररि, गैर-प्रिर्ू णकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा। 3. प्रमुख िलजवद्युत पररर्ोिना की स्ट्थापना। जनजर्द्ध। 4. दकसी भी खतरनाक पिाथा का उपर्ोग, जनजर्द्ध। उत्पािन र्ा प्रसंस्ट्करण। 5. प्राकृजतक िल जनकार्ों र्ा भूजम क्षत्रे म ें जनजर्द्ध। अिोजधत अपजिष्टों का जवसिान। 6. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई आरा जमलों र्ा मौिूिा आरा जमलों के जवस्ट्तार की अनमु जत नहीं िी िाएगी। 7. ईंट भट्टों की स्ट्थापना। जनजर्द्ध। ख. जवजनर्जमत गजतजवजधर्ा ाँ 8. होटलों और ररसॉटों की व्यावसाजर्क संरजक्षत क्षत्रे की सीमा के एक दकलोमीटर के भीतर र्ा स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकटतम हो, पाररजस्ट्थजतकी-पर्ाटन गजतजवजधर्ों के जलए छोटे अस्ट्थार्ी ढाचं ों के अलावा दकसी भी नए वाजणजज्र्क होटल और ररसॉटा की अनुमजत नहीं िी िाएगी: परंत ु दक संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर स े आग े र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकटतम हो, सभी नई पर्ाटन गजतजवजधर्ां र्ा मौिूिा गजतजवजधर्ों का जवस्ट्तार, पर्ाटन मास्ट्टर प्लान और लागू दििाजनिेिों के अनुरूप होगा। 9. जनमााण कार्ाकलाप. (क) सरं जक्षत क्षत्रे की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, िो भी जनकट हो, दकसी भी प्रकार के नए वाजणजज्र्क जनमााण की अनुमजत नहीं िी िाएगी: जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने के जलए भवन उप-जनर्मों के अनुसार पैराग्राफ 3 के उप-परै ा (1) म ें उजल्लजखत गजतजवजधर्ों सजहत उनके उपर्ोग के जलए उनकी भूजम पर जनमाणा कार् ा करने की अनुमजत होगी। आगे र्ह भी प्रावधान ह ैदक प्रिर्ू ण न फैलाने वाल ेलघु उद्योगों स े संबंजधत जनमााण गजतजवजधर्ों को लाग ू जनर्मों और जवजनर्मों, र्दि कोई हो, के अनुसार सक्षम प्राजधकारी स े पूव ा[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 अनुमजत लेकर जवजनर्जमत दकर्ा िाएगा और न्र्ूनतम रखा िाएगा। (ख) एक दकलोमीटर स े आग े इस े क्षेत्रीर् मास्ट्टर प्लान के अनुसार जवजनर्जमत दकर्ा िाएगा। 10. लघ ु एव ंगैर प्रिर्ू णकारी उद्योग। फरवरी 2016 म ें केंद्रीर् प्रिर्ू ण जनर्ंत्रण बोड ा द्वारा िारी उद्योगों के वगीकरण के अनुसार केवल गैर-प्रिर्ू णकारी उद्योग और गरै -खतरनाक, लघ ु और सेवा उद्योग, कृजर्, पुष्प-कृजर्, बागवानी र्ा पाररजस्ट्थजतकी संवेिी िोन स े स्ट्विेिी सामजग्रर्ों से उत्पाि बनान े वाल े कृजर्-आधाररत उद्योग को लागू जनर्मों और जवजनर्मों के अनुसार सक्षम प्राजधकारी स े पूव ा अनुमजत के साथ अनुमजत िी िाएगी। 11. पेडों की कटाई. (क) राज्र् सरकार म ें सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम म ेंपेडों की कटाई नहीं की िाएगी। (ख) वृक्षों की कटाई को संबंजधत केन्द्रीर् र्ा राज्र् अजधजनर्म is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made to the e-mail address of the Ministry at esz-mef@nic.in DRAFT NOTIFICATION WHEREAS, the Rajauli (Nawada) Wildlife Sanctuary is located in the Rajauli Block of the Nawada District in the state of Bihar and has an area of 27.37 square kilometers. Three blocks make up the Wildlife Sanctuary: Dibaur Part-1 (12.76 square kilometers), Chatkari (6.25 square kilometers), and Dibaur Part-2 (8.36 square kilometers). The National Highway-31 bisects the Wildlife Sanctuary into Dibaur 1 & Dibaur 2. AND WHEREAS, the Rajauli (Nawada) Wildlife Sanctuary was notified under Section 18 of the Wildlife Protection Act, 1972 by the Government of Bihar vide its notification number : Vanya Prani – 07/19/527 (E) dated – 10.05.2019. AND WHEREAS, according to the Champion and Seth classification of forests, the Sanctuary is home to tropical dry deciduous forest and is situated on the Deccan Plateau of the Chota Nagpur Plateau bio- geographic zone. AND WHEREAS, the Rajauli (Nawada) Wildlife Sanctuary has the richest deposit of mica in the country and numbers of mica mines were operating in the area under lease by the government prior to imposition of ban on mining in the protected forest.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 AND WHEREAS, the floral species present in the protected area are Arar (Acacia pennata), Akwan (Calotropis gigantean), Amla (Emblica officinalis), Babul (Acacia arabica), Bantulsi (Perilla ocimoides), Bijasal (Ptetocarpus marusupiam), Bariar (Sida cordifolia), Bahara (Terminalia belerica), Chamror (Ehretia leavis), Choranth (Heteropogan contortus), Dhela (Alangium salvifoliam), Dhawai (Woodfordia fruticosa), Gamhar (Gmelina arborea), Harre (Terminalia chebula), Kajh (Bridelia retusa), Kusum (Schleichera oleosa), Kenjhi (Sterculia urens), Kokur-Khus (Vetiveria zizanioides), Kekar (Garuga pinnata), Mahua (Madhuca indica), Piar (Buchanania lanzan), Patdhaman (Grewia elastic), Satwar (Asparagus recemosus ), Semal (Salmalia malbarica), Salai (Boswellia serrata), Sidha (Lagerstroemia parviflora), Sagawan (Tectona grandis), Udal (Sterculia villosa)etc.; AND WHEREAS the rare, endangered and threatened floral species found in the area are Bhelao (Semicorpus anacardium ), T. Bedem (Terminalia catappa) , Haldu (Adina cardidifolia), Vanpyaj (Urginea indica), Chiraite (Swertia chirayita), Rose wood (Dolbergia latifolia) , Mahua (Madhuca longifalia), Kaind (Diospyros melanoxylon), Jungali Bel (Aegle marmelos ); AND WHEREAS, the rare endangered and threatened faunal species found in the Wildlife Sanctuary are Jungle Cat (Felis chaus) , Porcupine (Hystrix Indica), Hog deer (Axis porcinus), Wild boar (Sus scrofa ), Barking deer (Muntiacus muntjak) , Sloth Bear (Melursus urisinus), Mongoose (Herpestes urva ), Pongelin, Civet (Viverrricula indica). Other recorder faunal species includes Chittal (Axis axis), Sambar (Cervus unicolor), Hare (Lepus nigricollis), Hyena (Hyaena hyaena), Nilgai (Boselaphus tragocamelus), Jackal (Conis aureus), Indian fox (Vulpes bengalensis); AND WHEREAS, the major avifaunal species recoded from the Wildlife Sanctuary are Cheel (Milvus migrans), Dhanesh (Ocycenos birostris), Black stork (Ciconia nigra), Jungle Prinia (Prinia sylvatica), Cuckoo (Cuculus fugax) , Black headed munia (Malacca articapilla), Common Crane (Grus grus), Indian Courser (Cursorius coroman delicus), Owl (Otus lettia), Ghughu (Bubo bengalensis); AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Rajauli (Nawada) Wildlife Sanctuary which is specified in paragraph 1 as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW THEREFORE, in exercise of the powers conferred by sub section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area to an extent of 0.0 km to 4.965 km from the boundary of Rajauli (Nawada) Wildlife Sanctuary in the State of Bihar as the Rajauli (Nawada) Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone.- (1) The extent of the Eco-sensitive Zone varies from 0.0 km to 4.965 km around the boundary of Rajauli (Nawada) Wildlife Sanctuary. The area of the Eco-sensitive Zone is approximately 100.15 square kilometers. North-West Babhani P.F. 3.351 kilometres Note: The National Highway No. 31 bisects the Dibaur-1 and Dibaur-2 sections of the Sanctuary, serving as a crucial connector between Bihar, Jharkhand, West Bengal and adjacent states. Notably, this highway was constructed prior to the enactment of the Wildlife (Protection) Act, 1972. Given the sanctuary’s proximity to Jharkhand state border, the Eco-sensitive Zone on the side bordering Jharkhand State is designated as Zero. 2. The boundary description of the Eco-Sensitive Zone around Rajauli Wildlife Sanctuary is appended as Annexure-I. 3. The maps of the Eco-sensitive Zone along with latitude and longitude are appended as Annexure II A, II B and II C. 4. List of geo co-ordinates of the boundary of the Rajauli Wildlife Sanctuary and its Eco-sensitive Zone are given in Table A and Table B of Annexure-III. 5. The list of the villages falling within Eco-sensitive Zone is annexed as Annexure IV. 2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purposes of effective management of the Eco-sensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of publication of the this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State Government. (2) The Zonal Master Plan for the Eco-Sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and Union Territory laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the Union Territory Government, for integrating the ecological and environmental considerations into the said plan; (i) Environment, (ii) Forest and Wildlife, (iii) Agriculture, (iv) Revenue, (v) Urban Development, (vi) Tourism, (vii) Rural Development, (viii) Irrigation and Flood Control, (ix) Municipality (x) Panchayati Raj[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 25 (xi) Public Works Department, (xii) Highways; and (xiii) State Pollution Control Board. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to Prohibited; Regulated and Promoted activities listed in the Table in paragraph 4 of this notification and shall ensure eco- friendly development for security of local communities livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. (10) Pending preparation and approval of the Zonal Master Plan, any new developmental activities shall be governed by provisions specified at paragraph 6 of sub-para (1) and (2). 3. Measures to be taken by State Government.-The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:- (a) (1) Land use:- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:- (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution; (iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) Promoted activities given under table at para no.4. Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies and springs:- The catchment areas of all natural springs and all natural bodies shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas and discharge of any pollutants in such a manner as which are detrimental to such areas. (3) Tourism or Eco-tourism:- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco- development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage:- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites:- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution:- The Environment Department of the State Government shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder. (7) Air pollution:- The Environment Department of the State Government shall draw up guidelines and regulations fort he control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27 (8) Discharge of effluents:- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974) and the rules made thereunder. (9) Solid wastes: - Disposal of solid wastes shall be as under:- i. the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time; ii. the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; iii. the biodegradable material shall be recycled preferably through composting or vermiculture or biogas plants. iv. the inorganic material shall be disposed of in an environmentally acceptable manner at a site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone. (10) Bio-medical waste:- (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forests vide notification number G.S.R. 343(E), dated the 28th March, 2016 as amended for time to time. (b) Safe and environmentally sound management of Bio- medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic Waste management:- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management:- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste:- The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic:- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Ministry of Environment, Forests and Climate Change, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and made thereunder. (15) Vehicular pollution: - Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units – a) No new polluting industries shall be allowed to be set up within the Eco-Sensitive Zone on or after the publication of this notification in the Official Gazette, b) Only non-polluting industries shall be allowed within the ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes - The protection of hill slopes shall be as under: (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) Construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco- sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. UOI in W.P.(C) No.435 of 2012 and IA No. 1000 of 2003 judgment dated the 3rd June, 2022 and subsequent IA No. 131377 of 2022 Judgment dated the 26th April, 2023 and the 28th April, 2023. New industries and expansion of existing polluting 2. Setting of industries causing industries in the Eco-Sensitive Zone shall not be pollution (Water, Air, Soil, Noise, permitted: etc.). Provided that, non-polluting industries shall be allowed within Eco-Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non- polluting cottage industries shall be promoted. 3. Establishment of major hydro- Prohibited. electric project. 4. Use or production or processing of Prohibited. any hazardous substances. 5. Discharge of untreated effluents in Prohibited. natural water bodies or land area. 6. Setting up of new saw mills. Commercial establishment of hotels No new commercial hotels and resorts shall be and resorts. permitted within one kilometer of the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities: Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. 9. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub- paragraph (1) of paragraph 3 as per building bye- laws to meet the residential needs of the local residents. Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 10. Small scale non polluting industries. Only non-polluting industries termed as per classification of industries issued by the Central Pollution Control Board in February 2016 and non- hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted with the prior permission from the competent authority as per applicable rules and regulations. 11. Functions of the Monitoring Committee: (1) The Monitoring Committee shall, based on the actual site- specific conditions scrutinize, the activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1553 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification. (2) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-Sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (3) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the state as per pro-forma appended at Annexure V. (6) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional Measures- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Supreme Court, etc. orders- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
